The author of this article makes an attempt to present legal regulations relating to the legal scope of the constitutional principle of the autonomy of parliament. This principle is indicated in Article 112 of the Constitution of the Republic of Poland. It means that chambers of parliament can independently determine their internal organization and mode of work as well as detailed matters related to their functioning. But the scope of the principle of the autonomy of the parliament is determined also by other provisions of the Constitution, as well as the provisions of the laws and the Standing Orders of the Sejm of the Republic of Poland. The article also deals with the question whether this principle affects constitutional review of acts of chambers of parliament.

The publication presents detailed issues related to the budgetary sovereignty of the Polish Parliament (i.e., the Sejm and the Senate) and the nature of the control / audit of budgetary expenditures. A deputy of the European Parliament is obliged to submit an asset declaration to both the Mar‑ shal of the Sejm and the President of the European Parliament. The declaration submitted to the President of the European Parliament is assessed by the President, who pays particular attention to the issue of the existence of a conflict of interest.

The paper concerns selected issues related to parliamentary procedures. The primary aim is to investigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally “formal motions”). In Poland, points of order are recognised as a separate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how motions of similar subject scope are regulated in foreign national parliaments.

The opinion points out that the rules and procedures of Sejm’s international cooperation, especially contacts within the European Union, must be regulated by the Standing Orders of the Sejm. Currently, both EU law and national law allow the Sejm to cooperate with the European Parliament on impact assessment of European Union legislation, involving the transfer to the European Parliament of the possessed materials relating to the exercise of EU law. It is advisable to regulate the cooperation on the basis of Article 9 of the Protocol (No. 1) and – prior to the adoption of the said regulation – the cooperation should be based on the structure of COSAC.

Podstawowym celem niniejszego artykułu jest próba ustalenia granic, w obrębie których porusza się prawodawca tworzący przepisy regulaminów Sejmu, Senatu oraz Zgromadzenia Narodowego. Czyniąc punktem odniesienia treść art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 konstytucji, statuujących zasadę autonomii parlamentu (a więc wyznaczających także normatywną płaszczyznę autonomii regulacyjnej) autor ukazuje, jaki wpływ na ustanawianie norm regulaminu ma otaczające go środowisko prawne. W kolejnych częściach artykułu pojawiają się rozważania poświęcone ingerencji w materie wewnętrzne parlamentu różnych aktów normatywnych, tj. konstytucji, ustaw zwykłych, aktów prawa unijnego, Europejskiej Konwencji o Ochroni Prawa Człowieka i Podstawowych Wolności oraz ingerujących względem siebie regulaminów izb. Główna teza badawcza tego opracowania opiera się na przekonaniu, że wytyczony w ramach przepisów konstytucyjnych zakres autonomii regulacyjnej doznaje poważnych ograniczeń, i że decyzje parlamentu regulującego własną organizację wewnętrzną podyktowane są w określonym wymiarze uwarunkowaniami zewnętrznymi.
The main purpose of this article is an attempt to delineate boundaries, within which the lawmaker has got discretionary power to establish rules of the standing orders of the Sejm, the Senat and the National Assembly. As making reference point to the content of art. art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 of the constitution, the author demonstrates what is the impact of the surrounding legal environment on establishing that rules. Consequently, the following parts of this article present the interference of different normativeacts into internal parliamentary affairs, i.e. the constitution, bills, UE law acts, the European Convention on Human Rights and the standing orders of parliament. The key thesis of the article is based on convenience that the scope of regulative autonomy, laid down by the constitution, is the subject of further limitations and that the decisions of parliament in this area have to meet some external (imposed „from outside”) conditions.

W artykule poruszona zostaje problematyka konstrukcji prawnej kadencji Izby Gmin pod rządami przepisów ustawy o sztywnej kadencji parlamentów z 2011 r. Autor dokonuje analizy przyjętych rozwiązań prawnych, wskazując na ich daleko idące konsekwencje ustrojowe. W pierwszej kolejności wyjaśnia on na czym polegała zmiana, na jaką zdecydował się brytyjski ustrojodawca w 2011 r. Następnie przedstawia skutki zniesienia dotychczasowej prerogatywy królewskiej służącej rozwiązywaniu parlamentu. W końcowej części artykułu omawia wreszcie nowe procedury rozwiązywania parlamentu, z założeniem wyeksponowania ich znaczenia dla funkcjonującego nad Tamizą konstytucyjnego systemu państwa.
The article raises an issue of legal construction of cadence of the House of Commons under the regime of the Fixed-term Parliament Act 2011. The author examines the legal rules included in the bill, showing all the constitutional consequences that they trigger. First, he makes an explanation what was the change that the lawmaker has decided to apply. Second, he also depicts the results of abolishing the prerogative of monarch for dissolving parliament. Finally, he performs the new procedures on the dissolving parliament, which he makes with an assumption to put emphasis on the meaning of these rules for the constitutional system on the Thames.

The 100th anniversary of creation of the quazi parliament in the form of the State Duma as the Lower Chamber and in general reorganized State Council as the Upper Chamber takes place in 2006 and is of great interest not only historians but also of the specialists in study of literature, as they watch and research the social changes in the Russian state organization and can’t stand paying attention to the influence of this event on the political consciousness of the Russians of the first decade of the XXth century which was consolidated in a lot of works, also works of literature.The subject of the article is to show the attitude to that event of the Polish society, especially of the Poles from the Polish Kingdom, which was under the Russian reign in those times. The author represents this attitude through the utterances of the most influential people of the Polish public opinion, such as: Bolesław Prus, Jozef Piłsudski, Wladysław Studnicki, Tadeusz Grużewski, Hipolit Korwin-Milewski, Konstanty Skirmunt and gen. Jan Jacyna, also the utterances of the leading figures of ND, PPS and the editors of the popular „Kurier Warszawski”.A conclusion, to which the author comes on the basis of this discourse, is the following: inPolish opinion, in the majority of cases the skepticism prevailed, which regarded the reformatory possibilities of the Duma and also the attitude to the new system in Russia, which replaced the former autocratic tsarist absolutism in 1906, as a system, which, despite all its limitations, nevertheless was constitutional, and of Russia itself, as a monarchy, already representative.

The article concerns the competences of the organs of the Sejm and the Senate related to protecting the dignity of the chambers. These competences were established as a part of a reaction to the course of the so-called “Sejm crisis”, consisting in the occupation, initially, of the Sejm’s rostrum and then the Sejm’s Meeting Room by MPs from opposition parties at the turn of 2016 and 2017. Using the dogmatic method, the publication aims to define the essence of competences, their applicable and planned regulations, and to evaluate these regulations and formulate possible de lege ferenda postulates on the basis of this evaluation. The main thesis of the article includes a negative evaluation of the applicable regulations of competences due to their contradiction with certain provisions of the Constitution, in particular with Art. 2 of the Constitution, i.e. within the framework of the principle of a democratic state ruled by law established in this provision and the resulting, inter alia, principles of decent legislation, including the principle of the specificity of law, as well as Art. 54 sec. 1 in connection with Art. 31 sec. 3 of the Constitution (i.e. the freedom of expression), Art. 11 of the Constitution (i.e. the freedom to establish and freedom of activity of political parties within the scope of the purpose of their activity, which is to influence on state policy by democratic methods) and Art. 32 of the Constitution (i.e. the principle of equality of political parties resulting from the principle of political pluralism). In this context, the most important is the risk of the so-called “chilling effect”. The publication also includes a positive evaluation of a few of the planned regulations of competences, which may allow for the elimination of the above contradictions or ensure a more complete implementation of the objective of competences, including guaranteeing the dignity of the chambers.

This article focuses on women's motivation to enter politics (5th Term of RP Parliament's Office). Presented conclusions are part of the study on gender's influence on performing the role of politician. The purpose of this article is to confront what women say with the theories concerning the common objectives in the selfishly motivated world. Firstly I describe Public Choice Theory. Then I comment on the research method and population characteristics, moreover I discuss the course of the study. The main part of this article presents motives of entering politics that were revealed by women-politicians. Women politicians declared different motives of entering into politics. I divided all revealed reasons into seven parts. The most frequently mentioned one was the desire to continue the career in Local Government at the central level. The second one was named by me willingness to help. There were also women that entered politics by other reasons, such as: the suggestion of significant others, challenge, et cetera.

The article examines the main state-building acts adopted by the highest authorities of Ukraine and the Baltic states starting from 1990 (as a result of the first free election of deputies of these republics in the post-war period) and until 2004 (when significant changes took place in the internal political and geopolitical context, in particular – the accession of the Baltic states to NATO and the EU, as well as changes in the form of government in Ukraine in amendments to the Constitution as a result of the so-called «Orange Revolution»). The article reflects not only the legal part of the specified period, but also the institutional part, in particular, in the part of the formation of both legislative and executive power in the specified countries. The interaction of political, regulatory and historical components in this article forms a holistic vision of state-building processes in their synergistic unity. The purpose of the study is to conduct a chronological comparison of the main statebuilding acts of Ukraine and the Baltic countries in the period from 1990 to 2004. The methodological basis is a chronological comparison of the normative framework of countries in the context of the processes of state formation. It was determined that the parliaments of these countries, which were elected in the spring of 1990, immediately began to fight for their sovereignty and set a course for separation from the union center. The August 1991 putsch in Moscow became the «trigger mechanism» in the declaration of independence of the Baltic states and Ukraine. From that time, these countries began to build their states independently, in particular in the political and legal sphere. First, there is a change in the name of the state itself and its parliament (getting rid of the Soviet one) at the legislative level, as well as the complete subordination of power structures and other authorities exclusively to republican structures. Subsequently, the main state symbols (flag, coat of arms and anthem), constitutions are adopted, the course of states towards a market economy through the denationalization of property and privatization is introduced, each has its own currency, property is divided with other republics, international treaties and agreements are adopted, and countries The Baltics (but not Ukraine) manage to completely get rid of Russian troops from their territory through complex diplomatic efforts. The latter also contributed to the fact that the Baltic countries, having immediately taken a course towards the West, later became full members of NATO and the EU. During this period, Ukraine only decided on its geopolitical vector, that it intends to join these international associations in the future.

The issues covered by this policy after the entry into force of the Lisbon Treaty remained the domain of intergovernmental cooperation mechanisms. Despite the changes made to the Lisbon Treaty to unify the Union’s external relations by removing its pillars and expanding CSDP tasks, the role of the EP in its creation has not increased in line with its expectations. In accordance with the provisions of the TEU, decisions on the operation of the CSDP shall be adopted by the Council, acting unanimously on a proposal from the High Representative of the Union for Foreign Affairs and Security Policy or from a Member State. As a result of such Treaty arrangements, the EP is unable to play such a role in the area of CSDP that would correspond to the importance of this body in the EU’s institutional system. Therefore, the main instrument for the implementation of the EP policy in the area of CSDP remain resolutions in which this body calls for the inclusion of transnational cooperation mechanisms in it. By expressing its position in resolutions, the EP advocates for the development of a strong, unified CSDP based on defined European security interests, as well as the development of a pan-European approach to the issues covered by this policy.

Ensuring the energy security is currently one of the EU’s top priorities. The EU energy policy, after the entry into force of the Treaty of Lisbon, is regulated by Article 194 TFEU, which guarantees a solid legal basis for European Union actions in this area on the basis of the Community method. The European Parliament, within the scope of its Community competences, as a participant in the decision-making process, contributes to shaping the face of the EU energy policy. Furthermore, by adopting nonlegislative resolutions, the EP expresses its position on the most crucial issues included in this policy and has an indirect influence on its shape. The aim of this article is the analysis of the content of these resolutions and presentation of the EP’s opinion on the challenges facing the EU in the field of energy. It should be highlighted that the European Parliament is the EU body with a strong emphasis on a supranational approach to energy security. The European Parliament prefers the view that all Member States, in a spirit of solidarity, must take actions to guarantee the EU’s common energy security. In favour of a common, integrated European energy market, the EP puts great emphasis on the necessity to implement ambitious climate policy objectives within its framework, the key element of which is the reduction of greenhouse gas emissions.

The history of the Polish parliamentarianism has aroused numerous disputes since long due to many factors, causing difficulties in determining the beginnings of existence of this institution in the former Poland. The basic problem emerged in the distinction of the term “Sejm” (“Polish Parliament”) from the earlier rallies, court veches, local conventions or those covering larger areas of the country, or even all-state conventions, summoned by the particular regional dukes and after the unification of the state by monarchs. The disputes were related to the critical look at the role of Parliament in the history of the state: some glorified it, others expressed their critical view, determined by the historical school which the particular author belonged to. During those disputes, the final form was gained by the Polish Parliament as a bicameral parliament with the king, as one of the states, with the Senate and the Chamber of Deputies in the years 1493–1505.

At the end of World War I, in many European countries women won the active and passive right to vote. Poland was one of the first countries, where women were allowed to participate in political life. Already at the time of establishing the Legislative Sejm (1919) the first women-MPs took their seats in Parliament. Similarly, the situation presented itself in the case of the Senate. During its first session (1922) women participated in the works of the upper chamber. The purpose of this paper is to present the participation of women in the legislative work of the Senate in various terms of office. The participation of women in the legislative work of Parliament was characterized by their involvement in issues concerning education or social services, while avoiding participation in the legislative work or that dealing with political matters. The situation presented itself differently as regards women’s involvement in the work of the Senate. A good example here was the activity of Dorota Kałuszyńska, who – during the work on the so called April Constitution of 1935 – not only participated in it very actively, but also ruthlessly attacked the then ruling camp. Another very interesting episode related to activities of women in the Senate was an informal covenant during the work on the bill to limit the sale, administration and consumption of alcoholic beverages. Belonging to different political groups: the said D. Kłuszyńska as a representative of the Polish Socialist Party, Helena Kisielewska from the Bloc of National Minorities and Hanna Hubicka of BBWR [the Nonpartisan Bloc for Cooperation with the Government] unanimously criticized the regulations in force, which – in their opinion – did not fulfill their role when it came to anti-alcohol protection. The participation of women as far as their number was concerned was indeed small, but the Senate (like Parliament) of the Second Republic functioned in the period when women had just begun their activity on the legislative forum. Undoubtedly, it was a very interesting period, in which women had the benefit in the form of gaining their parliamentary experience. For example, it gave rise to subsequent activities of Dorota Kłuszyńska, who actively participated in the legislative works of the Sejm in the years 1947–1952, dealing with social issues or family.

The statutory prohibition on taking up paid employment is the most rigorous one among analogous restrictions on regarding functionaries of other uniformed services. This regulation prohibits officers of the Parliament’s Guard from undertaking other gaining activities than the ones of scientific or scientific-didactic nature, to which the Chief of the Chancellery of the Sejm consents on condition that it does not interfere with the performance of official tasks. The Parliamentary Guardian also cannot run his own economic activity.

This paper presents the attitude of the European Parliament to those issues that fall within the scope of interest of the Eastern Partnership. In the analysis of this attitude, the author stresses the significant role the EP has played in developing EU Eastern policy, in particular as concerns the promotion of democratic ideas and values within the scope of this policy. It should be emphasised that the EP is exceptionally interested in the advancement of democracy in East European partner countries, whose geopolitical significance the EP appreciates, frequently calling for the tightening of relations with these countries, and even opening European prospects to them. The deepening of cooperation between the EU and East European countries is conditioned by the EP by their adoption of what is called European values (i.e. democracy, rule of law, protection of human rights, etc.). Acting as the ‘guard of democracy,’ the EP is an institution of political influence which allows it to shape Eastern policy in ways that go beyond the formal rights vested in it by the treaties.

In the article the main characteristics of the European Parliament elections in 2014 in relation to the characteristics of the both previous elections to the Parliament were analysed. First, the legal framework is presented, followed by the presentation of candidate lists. As it is frequently the case, the authors for the analysis employed the analytical framework presented by Reif and Schmitt (1980). Following the framework, it is obvious the elections in Slovenia again demonstrated many elements of the second-order elections framework, for example in terms of the turnout, success of the governmental parties, success of small parties, as well as almost complete absence of party programmes, Euroscepticism and European topics in the campaign. Since several important domestic events happened just before the EP elections (e.g. resignation of the government at the beginning of May and the fact the leader of the biggest opposition party was by the court found guilty of corruption activity and sent to the prison at the end of April) such developments did not come as a big surprise.

One of the key issues in the process of preparing for an election to the European Parliament is to determine the number of seats for each country. The Treaty of Lisbon, signed by Member States of the European Union, has obliged the European Parliament to establish rules guaranteeing that the distribution of seats should be done according to, inter alia, the principle of degressive proportionality. The purpose of this paper is to explore how the principle of degressive proportionality is actually implemented, and to propose a compromise – a mathematical solution, guaranteeing that the distribution of seats is consistent with the requirements of the Lisbon Treaty.

Politicians and political campaigns are not inadvertent to the development of social media platforms as environments that allow access to a larger audience. Not relying solely on the traditional media as a mouthpiece for their messages and taking matters into their own hands offers new segues for analyzing political communication. However, not all elections are of equal interest, both for the electorate and for the candidates, as second-order election theory suggests (Reif & Schmitt, 1980; Hix & Marsh, 2004). Th is paper investigates the area situated at the intersection of these two research directions. This quantitative study aims to analyze how Romanian political parties and candidates used Facebook in the electoral campaign for the European Parliament, in May 2019. The study follows the correlation between Facebook metrics, like frequency of posts and the popularity of the pages, and the political agendas refl ected in each party’s Facebook posts. The conclusions are consistent with second-order elections theory, but raise questions about the dependable nature of Facebook metrics.
