The author of this article makes an attempt to present legal regulations relating to the legal scope of the constitutional principle of the autonomy of parliament. This principle is indicated in Article 112 of the Constitution of the Republic of Poland. It means that chambers of parliament can independently determine their internal organization and mode of work as well as detailed matters related to their functioning. But the scope of the principle of the autonomy of the parliament is determined also by other provisions of the Constitution, as well as the provisions of the laws and the Standing Orders of the Sejm of the Republic of Poland. The article also deals with the question whether this principle affects constitutional review of acts of chambers of parliament.

The publication presents detailed issues related to the budgetary sovereignty of the Polish Parliament (i.e., the Sejm and the Senate) and the nature of the control / audit of budgetary expenditures. A deputy of the European Parliament is obliged to submit an asset declaration to both the Mar‑ shal of the Sejm and the President of the European Parliament. The declaration submitted to the President of the European Parliament is assessed by the President, who pays particular attention to the issue of the existence of a conflict of interest.

The paper concerns selected issues related to parliamentary procedures. The primary aim is to investigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally “formal motions”). In Poland, points of order are recognised as a separate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how motions of similar subject scope are regulated in foreign national parliaments.

The opinion points out that the rules and procedures of Sejm’s international cooperation, especially contacts within the European Union, must be regulated by the Standing Orders of the Sejm. Currently, both EU law and national law allow the Sejm to cooperate with the European Parliament on impact assessment of European Union legislation, involving the transfer to the European Parliament of the possessed materials relating to the exercise of EU law. It is advisable to regulate the cooperation on the basis of Article 9 of the Protocol (No. 1) and – prior to the adoption of the said regulation – the cooperation should be based on the structure of COSAC.

Podstawowym celem niniejszego artykułu jest próba ustalenia granic, w obrębie których porusza się prawodawca tworzący przepisy regulaminów Sejmu, Senatu oraz Zgromadzenia Narodowego. Czyniąc punktem odniesienia treść art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 konstytucji, statuujących zasadę autonomii parlamentu (a więc wyznaczających także normatywną płaszczyznę autonomii regulacyjnej) autor ukazuje, jaki wpływ na ustanawianie norm regulaminu ma otaczające go środowisko prawne. W kolejnych częściach artykułu pojawiają się rozważania poświęcone ingerencji w materie wewnętrzne parlamentu różnych aktów normatywnych, tj. konstytucji, ustaw zwykłych, aktów prawa unijnego, Europejskiej Konwencji o Ochroni Prawa Człowieka i Podstawowych Wolności oraz ingerujących względem siebie regulaminów izb. Główna teza badawcza tego opracowania opiera się na przekonaniu, że wytyczony w ramach przepisów konstytucyjnych zakres autonomii regulacyjnej doznaje poważnych ograniczeń, i że decyzje parlamentu regulującego własną organizację wewnętrzną podyktowane są w określonym wymiarze uwarunkowaniami zewnętrznymi.
The main purpose of this article is an attempt to delineate boundaries, within which the lawmaker has got discretionary power to establish rules of the standing orders of the Sejm, the Senat and the National Assembly. As making reference point to the content of art. art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 of the constitution, the author demonstrates what is the impact of the surrounding legal environment on establishing that rules. Consequently, the following parts of this article present the interference of different normativeacts into internal parliamentary affairs, i.e. the constitution, bills, UE law acts, the European Convention on Human Rights and the standing orders of parliament. The key thesis of the article is based on convenience that the scope of regulative autonomy, laid down by the constitution, is the subject of further limitations and that the decisions of parliament in this area have to meet some external (imposed „from outside”) conditions.

W artykule poruszona zostaje problematyka konstrukcji prawnej kadencji Izby Gmin pod rządami przepisów ustawy o sztywnej kadencji parlamentów z 2011 r. Autor dokonuje analizy przyjętych rozwiązań prawnych, wskazując na ich daleko idące konsekwencje ustrojowe. W pierwszej kolejności wyjaśnia on na czym polegała zmiana, na jaką zdecydował się brytyjski ustrojodawca w 2011 r. Następnie przedstawia skutki zniesienia dotychczasowej prerogatywy królewskiej służącej rozwiązywaniu parlamentu. W końcowej części artykułu omawia wreszcie nowe procedury rozwiązywania parlamentu, z założeniem wyeksponowania ich znaczenia dla funkcjonującego nad Tamizą konstytucyjnego systemu państwa.
The article raises an issue of legal construction of cadence of the House of Commons under the regime of the Fixed-term Parliament Act 2011. The author examines the legal rules included in the bill, showing all the constitutional consequences that they trigger. First, he makes an explanation what was the change that the lawmaker has decided to apply. Second, he also depicts the results of abolishing the prerogative of monarch for dissolving parliament. Finally, he performs the new procedures on the dissolving parliament, which he makes with an assumption to put emphasis on the meaning of these rules for the constitutional system on the Thames.

The 100th anniversary of creation of the quazi parliament in the form of the State Duma as the Lower Chamber and in general reorganized State Council as the Upper Chamber takes place in 2006 and is of great interest not only historians but also of the specialists in study of literature, as they watch and research the social changes in the Russian state organization and can’t stand paying attention to the influence of this event on the political consciousness of the Russians of the first decade of the XXth century which was consolidated in a lot of works, also works of literature.The subject of the article is to show the attitude to that event of the Polish society, especially of the Poles from the Polish Kingdom, which was under the Russian reign in those times. The author represents this attitude through the utterances of the most influential people of the Polish public opinion, such as: Bolesław Prus, Jozef Piłsudski, Wladysław Studnicki, Tadeusz Grużewski, Hipolit Korwin-Milewski, Konstanty Skirmunt and gen. Jan Jacyna, also the utterances of the leading figures of ND, PPS and the editors of the popular „Kurier Warszawski”.A conclusion, to which the author comes on the basis of this discourse, is the following: inPolish opinion, in the majority of cases the skepticism prevailed, which regarded the reformatory possibilities of the Duma and also the attitude to the new system in Russia, which replaced the former autocratic tsarist absolutism in 1906, as a system, which, despite all its limitations, nevertheless was constitutional, and of Russia itself, as a monarchy, already representative.

The article concerns the competences of the organs of the Sejm and the Senate related to protecting the dignity of the chambers. These competences were established as a part of a reaction to the course of the so-called “Sejm crisis”, consisting in the occupation, initially, of the Sejm’s rostrum and then the Sejm’s Meeting Room by MPs from opposition parties at the turn of 2016 and 2017. Using the dogmatic method, the publication aims to define the essence of competences, their applicable and planned regulations, and to evaluate these regulations and formulate possible de lege ferenda postulates on the basis of this evaluation. The main thesis of the article includes a negative evaluation of the applicable regulations of competences due to their contradiction with certain provisions of the Constitution, in particular with Art. 2 of the Constitution, i.e. within the framework of the principle of a democratic state ruled by law established in this provision and the resulting, inter alia, principles of decent legislation, including the principle of the specificity of law, as well as Art. 54 sec. 1 in connection with Art. 31 sec. 3 of the Constitution (i.e. the freedom of expression), Art. 11 of the Constitution (i.e. the freedom to establish and freedom of activity of political parties within the scope of the purpose of their activity, which is to influence on state policy by democratic methods) and Art. 32 of the Constitution (i.e. the principle of equality of political parties resulting from the principle of political pluralism). In this context, the most important is the risk of the so-called “chilling effect”. The publication also includes a positive evaluation of a few of the planned regulations of competences, which may allow for the elimination of the above contradictions or ensure a more complete implementation of the objective of competences, including guaranteeing the dignity of the chambers.

This article focuses on women's motivation to enter politics (5th Term of RP Parliament's Office). Presented conclusions are part of the study on gender's influence on performing the role of politician. The purpose of this article is to confront what women say with the theories concerning the common objectives in the selfishly motivated world. Firstly I describe Public Choice Theory. Then I comment on the research method and population characteristics, moreover I discuss the course of the study. The main part of this article presents motives of entering politics that were revealed by women-politicians. Women politicians declared different motives of entering into politics. I divided all revealed reasons into seven parts. The most frequently mentioned one was the desire to continue the career in Local Government at the central level. The second one was named by me willingness to help. There were also women that entered politics by other reasons, such as: the suggestion of significant others, challenge, et cetera.

The article examines the main state-building acts adopted by the highest authorities of Ukraine and the Baltic states starting from 1990 (as a result of the first free election of deputies of these republics in the post-war period) and until 2004 (when significant changes took place in the internal political and geopolitical context, in particular – the accession of the Baltic states to NATO and the EU, as well as changes in the form of government in Ukraine in amendments to the Constitution as a result of the so-called «Orange Revolution»). The article reflects not only the legal part of the specified period, but also the institutional part, in particular, in the part of the formation of both legislative and executive power in the specified countries. The interaction of political, regulatory and historical components in this article forms a holistic vision of state-building processes in their synergistic unity. The purpose of the study is to conduct a chronological comparison of the main statebuilding acts of Ukraine and the Baltic countries in the period from 1990 to 2004. The methodological basis is a chronological comparison of the normative framework of countries in the context of the processes of state formation. It was determined that the parliaments of these countries, which were elected in the spring of 1990, immediately began to fight for their sovereignty and set a course for separation from the union center. The August 1991 putsch in Moscow became the «trigger mechanism» in the declaration of independence of the Baltic states and Ukraine. From that time, these countries began to build their states independently, in particular in the political and legal sphere. First, there is a change in the name of the state itself and its parliament (getting rid of the Soviet one) at the legislative level, as well as the complete subordination of power structures and other authorities exclusively to republican structures. Subsequently, the main state symbols (flag, coat of arms and anthem), constitutions are adopted, the course of states towards a market economy through the denationalization of property and privatization is introduced, each has its own currency, property is divided with other republics, international treaties and agreements are adopted, and countries The Baltics (but not Ukraine) manage to completely get rid of Russian troops from their territory through complex diplomatic efforts. The latter also contributed to the fact that the Baltic countries, having immediately taken a course towards the West, later became full members of NATO and the EU. During this period, Ukraine only decided on its geopolitical vector, that it intends to join these international associations in the future.

The issues covered by this policy after the entry into force of the Lisbon Treaty remained the domain of intergovernmental cooperation mechanisms. Despite the changes made to the Lisbon Treaty to unify the Union’s external relations by removing its pillars and expanding CSDP tasks, the role of the EP in its creation has not increased in line with its expectations. In accordance with the provisions of the TEU, decisions on the operation of the CSDP shall be adopted by the Council, acting unanimously on a proposal from the High Representative of the Union for Foreign Affairs and Security Policy or from a Member State. As a result of such Treaty arrangements, the EP is unable to play such a role in the area of CSDP that would correspond to the importance of this body in the EU’s institutional system. Therefore, the main instrument for the implementation of the EP policy in the area of CSDP remain resolutions in which this body calls for the inclusion of transnational cooperation mechanisms in it. By expressing its position in resolutions, the EP advocates for the development of a strong, unified CSDP based on defined European security interests, as well as the development of a pan-European approach to the issues covered by this policy.

Ensuring the energy security is currently one of the EU’s top priorities. The EU energy policy, after the entry into force of the Treaty of Lisbon, is regulated by Article 194 TFEU, which guarantees a solid legal basis for European Union actions in this area on the basis of the Community method. The European Parliament, within the scope of its Community competences, as a participant in the decision-making process, contributes to shaping the face of the EU energy policy. Furthermore, by adopting nonlegislative resolutions, the EP expresses its position on the most crucial issues included in this policy and has an indirect influence on its shape. The aim of this article is the analysis of the content of these resolutions and presentation of the EP’s opinion on the challenges facing the EU in the field of energy. It should be highlighted that the European Parliament is the EU body with a strong emphasis on a supranational approach to energy security. The European Parliament prefers the view that all Member States, in a spirit of solidarity, must take actions to guarantee the EU’s common energy security. In favour of a common, integrated European energy market, the EP puts great emphasis on the necessity to implement ambitious climate policy objectives within its framework, the key element of which is the reduction of greenhouse gas emissions.

The history of the Polish parliamentarianism has aroused numerous disputes since long due to many factors, causing difficulties in determining the beginnings of existence of this institution in the former Poland. The basic problem emerged in the distinction of the term “Sejm” (“Polish Parliament”) from the earlier rallies, court veches, local conventions or those covering larger areas of the country, or even all-state conventions, summoned by the particular regional dukes and after the unification of the state by monarchs. The disputes were related to the critical look at the role of Parliament in the history of the state: some glorified it, others expressed their critical view, determined by the historical school which the particular author belonged to. During those disputes, the final form was gained by the Polish Parliament as a bicameral parliament with the king, as one of the states, with the Senate and the Chamber of Deputies in the years 1493–1505.

At the end of World War I, in many European countries women won the active and passive right to vote. Poland was one of the first countries, where women were allowed to participate in political life. Already at the time of establishing the Legislative Sejm (1919) the first women-MPs took their seats in Parliament. Similarly, the situation presented itself in the case of the Senate. During its first session (1922) women participated in the works of the upper chamber. The purpose of this paper is to present the participation of women in the legislative work of the Senate in various terms of office. The participation of women in the legislative work of Parliament was characterized by their involvement in issues concerning education or social services, while avoiding participation in the legislative work or that dealing with political matters. The situation presented itself differently as regards women’s involvement in the work of the Senate. A good example here was the activity of Dorota Kałuszyńska, who – during the work on the so called April Constitution of 1935 – not only participated in it very actively, but also ruthlessly attacked the then ruling camp. Another very interesting episode related to activities of women in the Senate was an informal covenant during the work on the bill to limit the sale, administration and consumption of alcoholic beverages. Belonging to different political groups: the said D. Kłuszyńska as a representative of the Polish Socialist Party, Helena Kisielewska from the Bloc of National Minorities and Hanna Hubicka of BBWR [the Nonpartisan Bloc for Cooperation with the Government] unanimously criticized the regulations in force, which – in their opinion – did not fulfill their role when it came to anti-alcohol protection. The participation of women as far as their number was concerned was indeed small, but the Senate (like Parliament) of the Second Republic functioned in the period when women had just begun their activity on the legislative forum. Undoubtedly, it was a very interesting period, in which women had the benefit in the form of gaining their parliamentary experience. For example, it gave rise to subsequent activities of Dorota Kłuszyńska, who actively participated in the legislative works of the Sejm in the years 1947–1952, dealing with social issues or family.

The statutory prohibition on taking up paid employment is the most rigorous one among analogous restrictions on regarding functionaries of other uniformed services. This regulation prohibits officers of the Parliament’s Guard from undertaking other gaining activities than the ones of scientific or scientific-didactic nature, to which the Chief of the Chancellery of the Sejm consents on condition that it does not interfere with the performance of official tasks. The Parliamentary Guardian also cannot run his own economic activity.

This paper presents the attitude of the European Parliament to those issues that fall within the scope of interest of the Eastern Partnership. In the analysis of this attitude, the author stresses the significant role the EP has played in developing EU Eastern policy, in particular as concerns the promotion of democratic ideas and values within the scope of this policy. It should be emphasised that the EP is exceptionally interested in the advancement of democracy in East European partner countries, whose geopolitical significance the EP appreciates, frequently calling for the tightening of relations with these countries, and even opening European prospects to them. The deepening of cooperation between the EU and East European countries is conditioned by the EP by their adoption of what is called European values (i.e. democracy, rule of law, protection of human rights, etc.). Acting as the ‘guard of democracy,’ the EP is an institution of political influence which allows it to shape Eastern policy in ways that go beyond the formal rights vested in it by the treaties.

In the article the main characteristics of the European Parliament elections in 2014 in relation to the characteristics of the both previous elections to the Parliament were analysed. First, the legal framework is presented, followed by the presentation of candidate lists. As it is frequently the case, the authors for the analysis employed the analytical framework presented by Reif and Schmitt (1980). Following the framework, it is obvious the elections in Slovenia again demonstrated many elements of the second-order elections framework, for example in terms of the turnout, success of the governmental parties, success of small parties, as well as almost complete absence of party programmes, Euroscepticism and European topics in the campaign. Since several important domestic events happened just before the EP elections (e.g. resignation of the government at the beginning of May and the fact the leader of the biggest opposition party was by the court found guilty of corruption activity and sent to the prison at the end of April) such developments did not come as a big surprise.

One of the key issues in the process of preparing for an election to the European Parliament is to determine the number of seats for each country. The Treaty of Lisbon, signed by Member States of the European Union, has obliged the European Parliament to establish rules guaranteeing that the distribution of seats should be done according to, inter alia, the principle of degressive proportionality. The purpose of this paper is to explore how the principle of degressive proportionality is actually implemented, and to propose a compromise – a mathematical solution, guaranteeing that the distribution of seats is consistent with the requirements of the Lisbon Treaty.

Politicians and political campaigns are not inadvertent to the development of social media platforms as environments that allow access to a larger audience. Not relying solely on the traditional media as a mouthpiece for their messages and taking matters into their own hands offers new segues for analyzing political communication. However, not all elections are of equal interest, both for the electorate and for the candidates, as second-order election theory suggests (Reif & Schmitt, 1980; Hix & Marsh, 2004). Th is paper investigates the area situated at the intersection of these two research directions. This quantitative study aims to analyze how Romanian political parties and candidates used Facebook in the electoral campaign for the European Parliament, in May 2019. The study follows the correlation between Facebook metrics, like frequency of posts and the popularity of the pages, and the political agendas refl ected in each party’s Facebook posts. The conclusions are consistent with second-order elections theory, but raise questions about the dependable nature of Facebook metrics.

The Kuyavian-Pomeranian Voivodeship constitutes one of the smallest of the Polish voivodeships. It is composed of nineteen land districts and four city counties, including Bydgoszcz, Torun, Wloclawek and Grudziadz. According to the data provided by the Public Electoral Commission (PKW), in 2009 the Kuyavian-Pomeranian Voivodeship was inhabited by more than 2 million people, 1.65 million of whom had the right to vote. Despite the relatively small number of inhabitants, due to provisions of the act regulating the process of voting for the Members of the European Parliament, the voivodeship in question became a separate electoral district with the electoral commission located in Bydgoszcz. This decision was infl uenced mostly by members of the Democratic Left Alliance (SLD) representing this region in the Polish Parliament. This lobbing activity seemed benefi cial from the party’s perspective, since SLD has been gaining extraordinary support in the region. But for this lobbing, the voivodeship under consideration would have been included in one district together with the Pomeranian Voivodeship, where the majority of voters are prone to give their support to the right-wing and centre-wing parties.

The activities of the two chambers of the Polish parliament – the Sejm and the Senate – during the twenty years of Poland’s membership in the European Union can be analysed by taking two research approaches, the first of which is universalism, which addresses the civilisational need to build, harmonise, and unify. Universalism, which refers to the neo-functionalism paradigm, has characterised the European activity of both chambers of the Polish parliament. The other perspective is provided by neo-realist particularism, which takes an anti-idealist and anti-utopian stance. It is distinguished by national egotism expressed as an attachment to achieving the nation’s own interests. Today, particularism understood in this way is based on sovereign distinctiveness, independence, and self-reliance. The purpose of this article is to positively verify the hypothesis that the parliamentary dimension of Poland’s membership in the EU observed through the participation of the Sejm and Senate in the process of Europeanisation and de-Europeanisation simultaneously contributes to the dependence and independence of both chambers on the European Union and its institutions. The universalist and particularist approaches have allowed the author of this analysis to reach an empirically-confirmed conclusion that both chambers of the Polish parliament in the period under study had an influence on the following: (1) the political power of the government, reinforcing or sapping it during negotiations; (2) the effectiveness or ineffectiveness of coalition-building in the EU; (3) cooperation with or resistance to the dominance of the parliaments of large EU states; (4) varied responsibility for the integrative system as a united and harmonious whole; and (5) the union of the peoples of Europe or a Europe of Homelands.

The article presents the essence of parliamentary interpellations, refers to the obligation incumbent on the addressee to provide an answer within the time limit indicated in the Constitution. The author is of the opinion that not replying or replying after the deadline is a constitutional tort and is subject to liability before the State Tribunal. The currently occurring, rather negative parliamentary practice necessitates appropriate amendments to the Parliament’s Rules of Procedure. These changes should also cover the issues of abuse of the right of interpellation and enquiry by.
W artykule przedstawiono istotę interpelacji poselskich, odniesiono się do obowiązku spoczywającego na adresacie, aby odpowiedź udzielić we wskazanym w Konstytucji przepisie. Zdaniem autora nie udzielenie odpowiedzi bądź udzielenie, ale po upływie terminu, jest deliktem konstytucyjnym i podlega odpowiedzialności przed Trybunałem Stanu. Obecnie występująca, dość negatywna praktyka parlamentarna wymusza dokonanie odpowiednich zmian w regulaminie Sejmu. Zmiany te powinny objąć także kwestie nadużywania przez posłów prawa do interpelacji i zapytań.

Just before the 2019 European Parliament (EP) elections many authors have indicated their exceptional nature. In this article the author attempts to analyze how these particular characteristics and fi rst decisions taken after the elections by the key EU level actors may shape the EU integration process in the coming years. The article focuses on how the fragmentation of the EP may infl uence the choice of the European integration directions in the near future. One of the first observed effects of this fragmentation was the failure of leading candidates system during the appointment process of the Commission President. Another one is Ursula von der Leyen’s political programme for the European Commission, built on the strong awareness of the need to create a governing coalition between the EP and the European Commission. Acknowledgment of the challenge of the EP diversity by the New Commission President may have a positive effect on the EU-level democracy, however with a decrease in the efficiency of the EP legislative process.

Election of Members of the European Parliament on Polish territory for the first time took place in 2004. This election is a historic moment, because Poland and Polish people for the first time we were able to choose their representatives to the European Parliament. For the first time will Parliamentarians have its European family, the structures of the Polish accession to the European Communities, so that we share responsibility for the further development and future of our Europe. The elections were conducted under the Act of 23 January 2004 – Elections to the European Parliament. The literature on this subject is small, they are mainly publications concerning mechanisms for passing laws and discussing its main goals. Existing data do not cover the whole subject, as appeared before the majority of the Ordinance implementing acts. I hope that my article although the closer the issue of electoral law and the holding of elections to the European Parliament, and will be for the reader an introduction to the handbook and knowledge for entry to the course of European integration, European communities law and will bring the functioning of the institutions of the European Union.

This article discusses the problem of the definition of degressive proportionality. This term is used in many areas of economics but its meaning is not standardized. Opis:
The European Union (UE) is a unique organization, the representative organ of which – European Parliament (EP) – is chosen in universe elections. It was established in 1951 under Treaty of Paris as the General Assembly of the European Coal and Steel Com- munity. The Rome Treaties, establishing the European Economic Community and the European Community of Atomic Energy, continued the idea of a representative body by creating the Assembly of the European Communities. In 1962 the members changed the name from Assembly to European Parliament. A new name was officially recognized by the European Single Act in 1986. At the beginning, the members of the Assembly were appointed by national parliaments, since 1979 they have been elected in direct elections in accordance with the national law of the Member States. The aim of this article is to analyze EP direct elections through depicting the process of their implementation, discuss the turnout and introduce a new proposal for the electoral system such as electronic voting (e-voting).

The topic of this comparative study is the republican character of the system of governance in Kosovo. In the public discourse and political communication, as well as in academic discourse Kosovo is considered a Parliamentary Republic, based on the principle “of the separation of powers and checks and balances between them.” Although the constitutional definition of the relationship between the executive and legislative favors parliamentary republicanism, the constitutional powers of the president, the government and especially the constitutional and political power of the prime minister, significantly weaken the parliamentary character, in favor of a semi-presidential system. However, neither the current theories of government, nor constitutional provisions can rank Kosovo among semi-presidential systems, or pure parliamentary systems. Comparisons of competence powers relations in Kosovo, with similar relations and competences of the countries of the region and beyond, testify to the specific nature of parliamentary democracy in Kosovo. It is precisely the comparison of the Kosovo constitutional-legal system of governance with similar systems and theoretical analysis of parliamentary models facing Kosovo model which will be the basis of support of the hypothesis that Kosovo is not a typical parliamentary republic.

The proposal for directive aims at unifying the principles of the establishment of limited liability companies in all Member States. The authors claim that the proposal deserves support, but some of its provisions raise doubts because they do not serve the primary purpose. They also note that the Council of Ministers submitted to the Sejm a draft position on the proposed directive, failing to comply with the statutory time limit of 14 days.

The Swiss political system is an extremely specific management model, unparalleled in practically any other country in the world. It is a unique parliamentary committee system. The only organs that directly legitimize the public are the lower and upper houses of the Swiss Parliament, known as the National Council and the Council of Cantons. Both chambers have extensive systemic powers unparalleled anywhere else in the world. There is a kind of „safety valve” in the Swiss political system. They are the citizens themselves, whose voices may challenge the decision of the representative bodies that are strong in the political system. The voice of the citizens is indispensable for the conclusion of the legislative process. However, the widespread use of forms of direct democracy also has negative repercussions.

Opis:
Parliamentary representation of political parties is nowadays becoming an important field of activity of every grouping. Members of Parliament, following the standards of party charters, become an element of party elite, holding the official positions in collegiate organs. Personal changes in the parliament then mean changes in the party elite. The goal of the article is defining the scale of the phenomenon of debut Members of Parliament in the years of 2011, 2015 and 2019. The research question which the author was faced with is the question about the scale of the phenomenon of debut Members of Parliament and its consequences for the demographic structure of the Polish Sejm and the particular party representations in the parliament, defined as party elites. Detailed questions concern: the importance of parliamentary representatives in contemporary political groupings; defining whether the scale of the phenomenon in 2015 was significantly different from the election results from 2011 and 2019. The established hypotheses assume that: the important of parliamentary representation in contemporary parties is on a constant growth on the formal level and also within the political praxis, and consequently, Members of Parliament can be called party elites. Another hypothesis assumes that the phenomenon of debut MPs has stood out quantitatively in the analyzed period of time, nevertheless, it has not changed the demographic structure of the parliament dramatically, concerning the other two analyzed terms. The period of the analysis concerns the three parliamentary elections in 2011, 2015 and 2019, which allowed to pick up on the possible tendency of the phenomenon.
Parlamentarna reprezentacja partii politycznych współcześnie staje się istotnym obszarem działalności każdego ugrupowania. Posłowie, zgodnie ze standardami statutów partyjnych stają się elementem elity partyjnej, piastując oficjalne funkcje w organach kolegialnych. Zmiany personalne w parlamencie oznaczają zatem zmiany w partyjnej elicie. W tym kontekście celem artykułu jest określenie skali zjawiska debiutujących posłów w latach 2011, 2015, 2019. Problemem badawczym sformułowanym przez autora jest pytanie o skalę zjawiska posłów debiutantów oraz o jego konsekwencje dla struktury demograficznej polskiego Sejmu, jak i poszczególnych partyjnych reprezentacji w parlamencie ujmowanych jako partyjne elity. Pytania szczegółowe dotyczą natomiast znaczenia parlamentarnej reprezentacji we współczesnych ugrupowaniach politycznych oraz określenia czy skala zjawiska w 2015 r. była znacząco różna od wyników elekcji z 2011 i 2019 r.? Przyjęte hipotezy zakładają, że: znaczenie reprezentacji parlamentarnej we współczesnych partiach na poziomie formalnym, jak i w ramach politycznej praktyki, stale rośnie, a co za tym idzie można o posłach mówić jako o partyjnej elicie. Druga hipoteza zakłada z kolei, że zjawisko posłów debiutantów ilościowo wyróżniało się po wyborach w 2015 r., niemniej jednak radykalnie nie zmieniało struktury demograficznej parlamentu w odniesieniu do dwóch pozostałych analizowanych kadencji. Okres podjętej analizy dotyczy stanu osobowego parlamentu wygenerowanego w wyniku trzech elekcji parlamentarnych w latach 2011, 2015, oraz 2019, co pozwoliło wychwycić ewentualną tendencję zjawiska.

The present paper offers an analysis of the attitudes of Polish citizens towards the process of European integration. Two major points can be highlighted, based on the data obtained from various opinion surveys, e.g. CBOS, PBS, ISP, OPTEM, and Eurobarometer. The first one concerns the initial high level of scepticism in Poland about the decision to join the EU. The results of the public opinion polls indicated that Poles had agreed to be the Member State more “under pressure exerted by the course of history and that of the current European affairs” rather than “by an informed choice”. It may well be that due to this scepticism, Poland, as one of the few countries to join the EU, did not experience the socalled post-accession shock. On the contrary, the results of surveys suggested that there was a rapidly growing belief among Poles in positive repercussions of the accession, at least until the time when the effects of the economic crisis began to transpire. The second problem deals with how Poles see themselves as the members of the European Community. The data show that Polish citizens consider the membership in the EU as a fact of life, an existing condition that does not stimulate their action if the affairs are not directly associated with their own interests. That is probably the reason why Poles do not feel co-responsible for the European project. They still see the Union as an organisation that is supposed to bring profit but, at the same time, they do not feel obliged to actively take on responsibilities that follow.

According to Montesquieu tripartite system, formed in the European constitutionalism, the organs of authority, in a democratic state, affect each other in an inhibitory way, balancing mutually. Traditionally, it is understood that the executive power is performed by the Head of State (monarch, president) and government, legislative power belongs to the parliament, whereas the judicial power is exercised by independent courts. Analyzing the political reality of member states it is necessary to note, that the executive participates in the national legislative processes more actively, for example, through executing constitutionally granted right of legislative initiative (usually together with deputies), by issuing acts with the power of law, or incorporating Community directives into the internal legal order.

The arguments embraced here are those that examine the discourses of parliamentarians and their proposals that represent Evangelical fundamentalism with the support of conservatism of a moral and religious character, no longer exclusive to the right-wing Catholics, as pointed out in the literature of Political Science. The interpretation of religious politicians’ speeches is as legitimate and necessary as the discussion of the reverse of secularization and the increasing presence of religion in politics. Secularity is only an issue in Brazilian politics nowadays because of the conflict between conservative evangelical parliamentarians and Brazilian scientists. The latter are representatives of the scientific theories of evolutionism and proponents of scientific research on stem cells and embryos, considered as early as the beginning of the 20th century as threats to Christian civilization according to the Bible. The former, some of them propagators of the Bible, repeat this argument in public discourse, a symptom of fundamentalism as defined by Marsden. It discusses then the dispute between politics of morality and the process of informalization and permissiveness that have gained much widespread support of the young population since the 1960s. This dispute is still going on in Brazil, a country that has aroused the interest of missionaries because of its customs and non-Christian religions, especially Afro-Brazilians. The political crisis and the flaws of a fragmented public security policy has also called attention to the issues relative to the possession and use of guns as well as the role of repressive policies considered by the fundamentalist members of a divided Evangelical Front as the only way to stop violence and crime. This discourse is in flagrant contradiction with their defense of life in pregnancies.

The opinion shows that, specifying the range of entities that can participate in closed committee meetings, the Standing Orders of the Sejm expressly states that such meetings may be attended by Deputies who are not members of that committee and the persons whose participation the committee deems indispensable. There is no legal basis for the admissibility of participation of MEPs in closed meetings of Sejm committees that involve classified information. The author of the opinion notes that the possible attendance of a Member of the European Parliament at such a meeting would implicate the recognition by the Commission of their attendance “as indispensable” and the requirement to present of an appropriate security clearance.

It is without any doubt that one of the most important elements of every democratic political system is a Parliament, that is, a collective authority elected in direct elections, which is simultaneously an emanation of will of citizens as a sovereign. Over the years of the technological development of societies and evolution of the economic cooperation amongst states, its role and scope of responsibilities have gradually grown. The European Parliament is one of the key elements of the institutional system of the European Union, and thus, the only body, the composition of which is elected in direct election. This body, as a forum for universal representation by the elected deputies from the member states, brings together views and positions not only of the representatives but also of their electorate. The parliament is also an expression of the multinational EU community, its voice and its desire to have influence on the fate of the entire EU. This article presents the evolution of the European Parliament and of the election law concerning this body, since its formation as an institution of the European Union until now. The purpose of this article is to present changes which have taken place in the EU legislation in respect of the electoral law, on the basis of which members of the parliament are elected, since the formation of the EP. The main subject of this article covers following issues: how the evolution process of the parliament has looked like over the years, how its position in the institutional architecture of the EU has been evolving and how it has been endeavoured to harmonize electoral procedures to this body over the years. The article is about the evolutionary political position of the EP. The article focuses on selected aspects of unification of the electoral procedure for the election to the EP due to their path-breaking character and importance of the procedure being currently in force.
Jednym z najważniejszych elementów przesądzających o demokratycznym ustroju państwa jest bez wątpienia parlament, czyli kolegialny organ wyłaniany z bezpośrednich wyborów, będący jednocześnie emanacją woli obywateli jako suwerena. Na początku parlamenty wypełniały mało skomplikowane zadania, były jedynie organem reprezentacyjnym. Z upływem lat, rozwojem technologicznym społeczeństw i ewolucją realiów ekonomicznej współpracy państw ich rola oraz zakres kompetencyjny ulegały stopniowemu wzrostowi. PE jest jednym z kluczowych elementów systemu instytucjonalnego Unii Europejskiej, a tym samym jedynym organem, którego skład jest wybierany w bezpośredniej elekcji. Organ ten, jako forum powszechnej reprezentacji przez wybranych deputowanych z państw wspólnoty, skupia poglądy i stanowiska nie tylko samych reprezentantów, ale również ich elektoratu. Parlament jest również wyrazem wielonarodowej społeczności UE, jej głosem i dążeniem do wpływania na losy całej UE. Artykuł przedstawia ewolucję Parlamentu Europejskiego oraz ordynacji wyborczej w wyborach do tegoż organu od początku jego kształtowania się jako instytucji Unii Europejskiej do chwili obecnej. Celem niniejszego artykułu jest ukazanie przemian, jakie od początku tworzenia się PE następowały w ustawodawstwie UE w odniesieniu do samego PE oraz do ordynacji wyborczej, w oparciu o którą wyłaniani są jego członkowie. Podstawową tezą przedmiotowego artykułu jest zagadnienie, jak wyglądał proces ewolucji PE na przestrzeni lat, jak zmieniała się jego pozycja w systemie instytucjonalnym UE oraz jak z biegiem lat dążono do ujednolicenia procedury wyborczej w wyborach do tegoż organu. Artykuł dotyczy ewolucyjnej pozycji ustrojowej PE. Skupia się na wybranych aspektach ujednolicania procedury wyborczej w wyborach do PE z uwagi na ich przełomowość i doniosłość w obowiązującej obecnie procedurze.

The migrant crisis in Europe, which reached its zenith in 2015, made EU politicians realize the urgent need for a more effective migration policy that would rely more on supranational cooperation. Absence of this policy triggers migrant influx to Europe, in particular of unqualified labour force, and enhances illegal migration from which organized criminal groups profit enormously. Moreover, uncontrolled migration processes give rise to a number of social, economic, political and cultural problems all across the EU, and thus nurture the Eurosceptic mood. This leads to societal negation of the European integration project and provides fertile soil to the spread of radicalism and xenophobia. The aim of the study is to capture the position of European Parliament on recent migrant crisis. The Parliament, a democratically legitimate body, which claims the right to represent European societies, advocates adoption of systemic EU approach to migration which should be based on the respect of human rights and creation of legal migration pathways for refugees and workers needed by Europe. The solution of the present migrant crisis is sought by the EP in moving towards a common, comprehensive European immigration policy and enhanced solidarity of EU member states in response to increased influx of refugees from conflict zones.

The author proves, that in Ukraine the level of political consolidation, when it would be possible to clearly define, whether a transition is completed or not, and what regime is firmly established in the state, is not achieved yet. Political players are far from confessing the inviolability of democratic rules of political game; there is a considerable threat of authoritarianism. Freedom House considers the Ukrainian state a free electoral state, not a liberal democracy. The judicial features of Ukraine in the democratization process are as follows: lack of fulfillment of one of the first tasks of the transition: replacement of elites; lack of legal culture of the authorities, their inability to realize the rules of governance; formal institutionalization; relative weakness of the basic opposition; slowness of the reformation and sustainable failure to perform the tasks of every stage of the transition; weakness and low legitimacy of democratic institutions, conjuncture reformation for party-group interests; gradual replacement of bits and pieces of the post-communist authoritarianism with the new oligarchic authoritarianism on the behavior level of some elite groups.

The paper refers to the essential problem of the European political space, namely the insufficient implementation scale of accountability standards, which has a direct effect on the democratization of the European political system, specifically on the democracy deficit. The paper was presented the accountability standard on the background on the EP election in 2014, with the strong focus on the relations between the voters and the EP candidates. In the analyses the factors characterizing the quality of political discourse were considered taking into account both, the electorate political activity (principal – in the meaning Principal-Agent-Theory), as well as the offer of the running politicians (as the agents).

Opis:
Poland came up to the EU membership gradually, reorientation on the West in trade and economic sphere was accompanied by desire of establishing with them close political relations. After the Warsaw Pact expiration polish leaders had to decide also the question of safety concerning the incorporation in NATO, at that membership in EU and NATO was considered as the related key objectives of the foreign policy. In 1988-1993 years the democratic reform of the armed forces of Poland was characterized by the political forces unsuccessful attempts to achieve a certain visibility of macro-stablity and come to an agreement concerning control of the armed forces. Poland received an offer of cooperation with NATO within the program «Partnership for the sake of peace» in January 1994 at the summit in Brussels with other CEE countries. In 1999 year the Polish Parliament ratified the North Atlantic Treaty, demonstrating consolidated position of the political forces concerning that question. To the Council of Europe took a decision for the start of negotiations concerning the accession to the EU, Poland had to satisfy the political criteria, for execution of which, the consolidated position of the political forces concerning eurointegrational question had to exist. The application for membership in EU was made then, when the majority of places in parliament belonged to the political party, which had been created before the parliamentary elections in 1991 year from the political forces connected with the previous system. Already on July 16 of the 1997 year the „Agenda 2000”, which was presented at the meeting of European parliament, denoted that, the political institutes of Poland function stably and consistently, and the parliamentary elections in 1991 and 1993 years had been free. Poland was recommended to negotiations concerning its membership, and its accession to the European Union took place while the fourth parliament cadence was functioning, when the majority belong to leftist forces.

This paper aims to present a case study analysis of the condition of the electoral system in the Republic of Belarus after more than a quarter of a century of independence. The main purpose of the paper is to explain the discrepancies between legislation and practice. The author intended to note a real situation that dominates the country’s political scene in comparison to theoretical establishments. A Constitution of the Republic (created in 1994, with minor changes in 1996 and 2004) is the legal ground of the electoral system, however, procedural details were drawn up in the Electoral Code. The principles of Belarusian electoral code consist of some statements known from democratic models, such as universal suffrage, direct suffrage, secret ballot and equality. There are different types of elections in Belarus but the most important ones are presidential and parliamentary elections. Despite the detailed legal rules for conducting these elections, in fact, the principles of democracy, as well as the internal rules in Belarus, are not respected. Both presidential and parliamentary elections have shown this in recent years. Independent observers for a long time have been alarming about worrying electoral practices in Belarus. It is also worth emphasizing that since 1994, one man has been in power uninterruptedly, and Parliament has in fact a symbolic function. In the source materials, the author used Belarusian legal acts, analyses and reports, press notes as well as scientific papers.
