The aim of this paper is to present the legal nature of the Convention for the Protection of Human Rights and Fundamental Freedoms as a special treaty under international human rights law. The article focuses on the twofold nature of the Convention. First, it presents the Convention as an international treaty, and thus as a source of specific obligations of states-parties. Second, it presents the Convention as the source of fundamental individual human rights. The article also discusses the role of ECtHR case law in the context of fundamental individual human rights.

Liechtenstein is undoubtedly one of the countries where respect for human rights is at a high level. The reasons for this should be sought first of all in the decision of this micro-state to join the most important international organizations emphasizing the pro-tection of human rights (UN, Council of Europe) as well as internal regulations that are of an increasingly higher standard. This does not mean that there are no problems or puzzling situations for researchers of the political affairs in this country in this respect. These include undoubtedly the relatively late granting of political rights to women and the actual lack of political rights of persons without the citizenship of the Principality, accounting for 1/3 of the country's population.

In the opinion of the author certain provisions of the proposed bill raise constitutional doubts or may cause constitutional reservations, inter alia, in the light of the principle of specificity of law, the principle of separation of powers, the scope of the subject matter of parliamentary rules of regulation. Furthermore, insofar as the bill relates to the payment of compensation and redress, it appears to be burdened with a constitutional defect of the nature of the so-called legislative omission. The author of the opinion points out that the bill also lacks a number of solutions concerning the payment of compensation and redress.

The multiplicity of international judicial authorities makes their mutual interactions a challenge. In recent years, three regional human rights courts, with the competence to hear casus of violations of human rights protected by international law, have worked together to establish a robust dialogue. In spite of their normative, social or political differences, they have begun to intensify efforts to strengthen their bonds. The historic San José Declaration has provided formal conditions for the trilateral dialogue between the European Human Rights Court, Inter-American Human Rights Court, and African Court on Human and People’s Rights. The dialogue undertaken by the regional human rights courts contains not only a reference to its jurisprudence, but also a number of practices, incl. the exchange of experience. It is intended to establish consistency between human rights protection systems across the region. The initially informal cooperation has transformed into a trilateral dialogue that directly contributes to the improved understanding and implementation of human rights, which in turn constitutes a challenge to international human rights legislation. The aim of the article is to present the judicial dialogue in the field of human rights, to draw attention to its dynamics and to emphasize its role in changing some aspects of the understanding of law characterized by the principle of territoriality. This discussion is also intended to focus attention on the functions of dialogue, including penetration and mutual inspiration as well as strengthening the authority of courts.

The participants of the debate were the youth from middle and high schools in Poznań and Greater Poland and invited experts from the Institute of Philosophy, AMU: Dr. Karolina M. Cern, Dr. Andrzej W. Nowak, Dr. Krzysztof Przybyszewski. Discussion was moderated by Dr. Piotr W. Juchacz. Youth was asking, inter alia, about what human rights are and how freedom is understood within human rights; whether human rights are associated with the European culture or have universal character; whether international documents relating to human rights are fully respected in Poland; and whether attempts at restricting the access to certain content on the Internet is a violation of human rights.

W artykule zaprezentowany został pogląd, iż z uwagi na fakt pluralizmu aksjologicznych źródeł praw człowieka, konieczne jest uświadomienie sobie, że mamy aktualnie do czynienia z analitycznym rozszerzeniem zarówno „ilości” praw człowieka poprzez pojawianie się ich nowych generacji, jak też „ilościowej jakości” praw człowieka z uwagi na nowo wyłaniające się aksjologiczne ich źródła, bądź to w postaci nowych wartości, bądź w drodze nowacyjnie (redefinicyjnie) rozumianych wartości dotychczasowych. W przedstawionym kontekście aksjologii praw człowieka oraz aksjologii ich ochrony nietrudno skonstatować występowanie zarówno pluralizmu aksjologicznego obu sfer, jak też liczne próby ich relatywizacji oraz instrumentalnej egzegezy i wykładni dokonywane w wymiarach krajowym, europejskim i międzynarodowym. Próby ograniczania praw człowieka w zakamuflowany sposób w praktyce prawodawczej poszczególnych państw są liczne, a uzasadnieniem aksjologicznym prawnych rozwiązań ubezskuteczniających de facto (bo nie de iure, gdyż z formalnoprawnego punktu widzenia są one zadeklarowane i formalnie bezwyjątkowo chronione) realizację i ochronę poszczególnych praw (w szczególność praw trzeciej, czwartej i piątek generacji) jest gwarancja bezpieczeństwa zbiorowego i paradoksalnie ochrony innych ludzi (np. ochrona ich uczuć religijnych, ochrona rodziny, ochrona moralności publicznej, której desygnatem najczęściej są zasady dominującej w danym państwie religii). Przenosząc ten problem z wymiaru państwowego na poziom ponadpaństwowy i transpaństwowy, wskazać należy, iż w międzynarodowym prawie ochrony praw człowieka ograniczenie tych praw może nastąpić również ze względów pozanormatywnych, w drodze tzw. relatywizacji instrumentalnej, dokonywanej w związku z potrzebami bieżącej polityki, dla której naruszana bywa przyrodzona godność człowieka. Twierdzimy także, iż w aksjologii praw człowieka newralgicznym punktem jest przecięcie się płaszczyzny (dyskursu) prawnej z płaszczyzną (dyskursem) etyczną, przy czym czynnikiem sprawczym tej newralgiczności nie jest wadliwość prawa czy jego interpretacji, czy też wadliwość etyki, lecz tego, co dzieje się w ramach tzw. Realpolitik.
Considering the pluralism of the axiological sources of human rights, we claim that it is necessary to realize that at the moment we are facing an analytic extension of both the “number” of human rights (appearance of new generations of human rights), as well as the “quantitative quality” of human rights due to newly uncovered axiological sources such as the appearance of new values or a redefinition of existing ones. In the presented context of the axiology of human rights and the axiology of their protection, it is easy to observe the axiological pluralism of the two spheres as well as numerous attempts to make the exegesis and interpretation both relative and instrumental in domestic, European, and international sphere. Attempts to limit human rights in a camouflaged manner in the jurisdiction practice of particular states are quite abundant and an axiological justification of legal solutions that would make the implementation and protection of those rights (in particular those of the third, fourth and fifth generations) ineffectual— de facto (not de iure, since from a formal and legal point of view they correspond to declared rights and, without exception, the protected ones) is the guarantee of community security and, paradoxically, the protection of other people (i.e., the protection of religious sentiments, family, public morality based usually on the rules of the dominant religion). When transposing these problematics from the state perspective to the intra – and trans-state level, we need to demonstrate that in the international law of human rights protection , the limitation of these rights may also take place as a result of extra-normative factors due to so-called “instrumental relativism”, applied in the function of current political interests for which intrinsic human dignity happens to be infringed. We also claim that the active factor of that critical crossing point are not faults in the law or its interpretation, nor is it faults of ethics, but rather the faults of what is going on within so-called Realpolitik.

The aim of this article is to present the liability of Russia and Ukraine regarding Crimea under the European Convention on the Protection of Human Rights. The author analyzes pending and possible prospective cases originating from the conflict around Crimea between Ukraine and Russia. Due to the inconsistency in case law of the EC-tHR it is difficult to clearly determine what state will be considered responsible for the violation of the rights of residents of Crimea resulting from the Convention. In author’s opinion the ECtHR could determine that the Russian Federation may be held respon-sible, as well as Ukraine. However, as it seems, the liability of Ukraine will be limited to the positive obligations under the ECHR.

While the Court has, to some degree, started to protect against discrimination based on birth or nationality, the protection against discrimination on the basis of race until 2005 has been very poor and dubious. Upon reviewing the case law of the ECHR, we find that since the case “Relating to certain aspects of the laws on the use of language in education in Belgium” v. Belgium in 1968, the Court has decided to opt in favor of the original English version of art. 14, which underscores that the enjoyment of the rights and freedoms must be assured “without discrimination” and defends the concept that equality should be interpreted as non-discrimination, while clarifying that this disposition does not prohibit preferential treatment, such that, in the eyes of the Court, this principle is only violated when preferential treatment implies “a discriminatory treatment”, so the task for us is to determine in detail when the two are correlated. The cited decision is an essential reference as it provides the pointers needed to discern whether or not a violation of art. 14 exists, as in a “test” of equality that entails: (1) whether the distinction in treatment lacks objective justification; (2) whether the difference in treatment results in conformity with the objective of the effects of the measure examined attendant to the principles that generally prevail in democratic societies; (3) whether there exists a reasonable relationship between the means used and the end sought. Despite this interpretational recognition of art. 14, if we analyze in detail the Court’s jurisprudence, how the Court has approached the topic of discrimination on the basis of racial or ethnic origin is somewhat disappointing. The fact that during decades plaintiffs were required to provide proof beyond the shadow of a doubt has restricted the Court’s influence on discriminatory actions based on race or ethnicity; for this reason, it is not unexpected that in time critical dissidence arose, even within the Court itself. A good example of this is given by Judge Bonello in the decision Anguelova vs Bulgaria (2002). Here we analyze how the jurisprudence of the Court of Strasbourg has evolved in the context of discrimination against Roma, so as to ascertain the challenges that remain in this area.
Przeciwdziałanie dyskryminacji ze względu na urodzenie lub przynależność państwową, a także ochrona dyskryminacją ze względu na rasę, były ściśle związane z początkami działalności Europejskiego Trybunału Praw Człowieka, jednak do 2005 r. ochrona w tym zakresie była stosunkowo słaba. Praktykę ukształtowało m.in. orzeczenie ETPCz w sprawie „Relating to certain aspects of the laws on the use of language in education in Belgium” v. Belgia z 1968 r.(1 EHRR 252), w którym trybunał stwierdził, że korzystanie z praw i wolności musi być zapewnione bez dyskryminacji, równość należy interpretować jako niedyskryminację, wyjaśniając, że nie oznacza to zakazu preferencyjnego traktowania. Cytowana decyzja jest istotna dla stosowania art. 14 Europejskiej Konwencji Praw Człowieka, co nie oznacza, że nie jest kwestionowana. Dobrym tego przykładem jest decyzja Anguelova vs Bułgaria (2002).

The article provides an analysis of the legal aspects of expulsion of an alien suffering from a serious physical or mental illness to a country where treatment options for this illness are less accessible than those available in the country of residence (particularly in the case of HIV/AIDS, HCV, various forms of cancer, etc.). The article indicates the legal basis under European law (especially Article 3 of the European Convention on Human Rights on the prohibition of inhuman treatment), and the case law of the European Court of Human Rights relating to this issue. The author emphasizes that the ECHR has adopted a very restrictive approach concerning the expulsion of seriously ill non-nationals, and the national courts of States parties to the ECHR must ensure protection against expulsion to foreigners.

Religion (as an aim) is a great example. It applies to the most intimate sphere of the individual’s life and it is difficult to legally regulate this issue. There is no definition of art, nor of religion, which is sufficiently precise to be a basis for judgments. The European Court of Human Rights has partly dealt with this matter in its judgments but this is still not enough to solve the problem.

The first attempts to combat corruption date back to ancient times and had mainly moral connotation. Despite being an old phenomena, nowadays it takes new shapes and becomes a more common feature of social life, especially in the Latin America region. Corruption is a complex, and multidimensional phenomenon that negatively impacts human rights on many levels. Therefore, serious effort have long been made at global, regional and state levels to combat corruption. The United Nations and regional organizations have adopted numerous non-binding and binding documents with a view to stifling this phenomenon but none of them refer to the issue of impact of corruption on human rights. But it should be stressed that it is very hard to establish a link between corruption and human rights violations. Some efforts has been made by the Inter-American Court of Human Rights (IACHR) and the Inter-American Commission on Human Rights (IAComHR). This article considers whether and how the IACHR and the IAComHR establish the link between corruption and violation of human rights in the inter-American system. It also determines which groups of people are, according the IACHR and the IAComHR, particularly affected by corruption, what measures should be taken to protect those exposed to acts of corruption, what obligations are incumbent on States with a view to preventing, combating and eradicating corruption.

The paper is an approach to present the category of social rights in the background of entire legal system of the human rights protection. It is particularly dealing with the issue of nature of the 2nd generation of human rights and its significance for society. It starts with a brief presentation of the philosophical (human dignity) and normative roots as well as a short historical view of the human rights’ codification; the established legal terminology (human rights, fundamental rights, individual rights and liberties) and various levels of the legal protection (international – of global or regional nature, supranational and national one). Thereafter it focuses directly on the issue of social rights. Unlike the 1st generation of human rights, they are rather connected with public activity, policy and services (facere) than with autonomy and liberty (non facere). This, in turn, demands appropriate institutional structures and procedures. Social rights are hardly provided – in a binding and effective way – by global or regional international law. Thus, the burden of their protection, guaranty and execution is satisfied by the particular state and depends on its economic and social circumstances. On the other hand – they significance is based on fact that they serve the protection of social security which is the fundamental issue for both – dignity and sense of community.

Celem niniejszego opracowania jest ukazanie, że wpisanie w ogólne prawo międzynarodowe organów rozstrzygających z zakresu międzynarodowego prawa praw człowieka jest na tyle silne, iż czyni naukowo koniecznym odrzucenie twierdzeń przemawiających na rzecz pełnej autonomii (niezależności) organów sądowych w prawie międzynarodowym. Powyższe ustalenie nie stanowi jednak celu samego w sobie. Antycypowane wpisanie organów rozstrzygających z zakresu międzynarodowego prawa praw człowieka w prawo międzynarodowe umożliwi udowodnienie istnienia wpływu (oddziaływania) humanizacji prawa międzynarodowego na międzynarodowy porządek prawny. Zwieńczeniem badań z tego zakresu jest konfirmacja hipotezy badawczej, zgodnie z którą organy rozstrzygające z zakresu międzynarodowego prawa praw człowieka przyczyniają się nie tylko do humanizacji prawa międzynarodowego, lecz także do daleko idącej internacjonalizacji praw człowieka. Wprowadzenie owych dwóch kategorii (tj. humanizacji prawa międzynarodowego i internacjonalizacji praw człowieka) stanowi novum w dotychczas prowadzonych badaniach temu poświęconych, a weryfikacja tak postawionej hipotezy wyznacza zakres konstatacji, realizowanych na podstawie metody analitycznej oraz metody formalno-dogmatycznej.
The purpose of this study is to demonstrate that “inscribing” adjudicating bodies in cases involving international law of human rights into the universal international law is so strong, that it makes it scientifically necessary to reject assertions advocating full autonomy (independence) of judicial bodies in international law. The above finding does not, however, constitute an end in itself. The anticipating inscription of adjudicating bodies of international law of human rights into international law will make it possible to prove the existence of the influence (impact) of humanization of international law over the international legal order. The culmination of research in this regard will involve confirmation of the research hypothesis according to which bodies adjudicating in cases involving international law of human rights contribute not only to humanization of international law, but also to far-reaching internationalization of human rights. Introduction of these categories (that is humanization of international law and internationalization of human rights) is a novum in current research addressing this subject matter and verification of the hypothesis outlines the scope of observations carried out on the basis of the analytical method and the method of interpretation of applicable law.

The author of this article, the lead lawyer for the applicants in the case relating to the 1940 Katyń massacre (Janowiec and Others v. Russia), provides a personal account of the case that was heard twice by the European Court of Human Rights, first as a chamber of seven judges and then in its Grand Chamber formation. The case concerned the key question of whether the Strasbourg Court is competent to adjudicate on the effectiveness of a domestic investigation when the triggering act (killing) precedes the ratification date of the European Convention on Human Rights. For the first time in its entire history, the Strasbourg Court examined whether its competence could be based on the “need to ensure the respect for the Convention’s founding values”, one prong of the test elaborated in the Silih judgment in 2009. The critical assessment of the Grand Chamber’s Katyń judgment offered in this article is based on two considerations: what the Court omitted (the applicants’ arguments referring to the relevant international law practice) and what the Court finally elaborated as its understanding of the two tests establishing the Court’s competence ratione temporis (the “genuine connection” test and “Convention values” test).

The article demonstrates how references to Nazi and Soviet past are perceived and evaluated by the European Court of Human Rights. Individual cases concerning Holocaust and Nazism, which the Court has examined so far, are compared here to judgments rendered with regard to Communist regime. The article proves that the Court treats more leniently state interference with freedom of expression when memory about Nazism and Holocaust is protected than when a post–Communist state wants to preserve a critical memory about the regime. The authors of the article agree with the attitude of the Court which offers a wide margin of appreciation to states restrictively treating references to Nazism and Holocaust, including comparisons to the Holocaust, Nazism or fascism used as rhetorical devices. At the same time they postulate that other totalitarian systems should be treated by the Court equally.

Given the whole spectrum of doubts and controversies that arise in discussions about laws affecting historical memory (and their subcategory of memory laws), the question of assessing them in the context of international standards of human rights protection – and in particular the European system of human rights protection – is often overlooked. Thus this article focuses on the implications and conditions for introducing memory laws in light of international human rights standards using selected examples of various types of recently-adopted Polish memory laws as case studies. The authors begin with a brief description of the phenomenon of memory laws and the most signifcant threats that they pose to the protection of international human rights standards. The following sections analyse selected Polish laws affecting historical memory vis-à-vis these standards. The analysis covers non-binding declaratory laws affecting historical memory, and acts that include criminal law sanctions. The article attempts to sketch the circumstances linking laws affecting historical memory with the human rights protection standards, including those entailed both in binding treaties and other instruments of international law.

During Perestroika, Russian authorities admitted publicly that, during Stalinism, a single order led to the extrajudicial execution of 26,000 Polish nationals (in what became known as the “Katyń forest massacre”). In 1990 Russia commenced criminal investigations, but they were discontinued and results were classified as secret in 2004. Following years of silence under communism, families of the victims demanded information from the Russian authorities, without results. The ECHR entered into force in Russia in 1998. This article analyzes the case Janowiec and Others v. Russia, brought before the Strasbourg Court by the relatives of the victims of the Katyń massacre. The applicants maintained that Russia violated the ECHR by discontinuing the investigation and failing to account for the fate of prisoners. In their opinion, Article 2 (right to life), and Article 3 (prohibition of torture and inhuman treatment) had been violated. This article compares the reasoning of the Court in the Chamber (2012) and Grand Chamber (2013) rulings. The latter produced a reformatio in peius with respect to the applicants’ interests. Grand Chamber ruled it had no competence either over the atrocity or over the subsequent improper treatment by Russian authorities. With this verdict, it deprived the applicants of the only claim upon which the Chamber had earlier ruled in their favour.

Prior to its ruling in Janowiec and Others v. Russia, the Grand Chamber of the European Court of Human Rights had recognised a “humanitarian exception” to the general rule by which the procedural obligations imposed by articles 2 and 3 of the European Convention only arise if the substantive violation of the Convention occurs after the entry into force of the Convention for the respondent State. In Janowiec, the Court was invited to apply this “humanitarian exception” to one of the great unpunished atrocities perpetrated on European soil in the past century. The Court declined to do so, mechanistically imposing its own temporal limitation on the “humanitarian exception” by which the substantive violation of the right to life and the prohibition of ill treatment must take place after the adoption of the Convention on 4 November 1950. The essay concludes that this limitation is questionable, that the reasoning behind it is dubious, and that the result is a regrettable confirmation of a situation of impunity.

The European Court of Human Rights ruled on whether Russia is responsible for human rights violations in relation to the Katyń massacre. Two of the major issues that had to be dealt with were the Court’s competence ratione temporis to assess the violation of the procedural obligations related to the right to life, and whether the applicants could be considered victims of inhumane treatment because of the failure of Russian authorities to provide information on the fate and whereabouts of their relatives. If the first judgment issued by the Chamber on 16 April 2012 was criticized because of its restrictive approach, the one issued by the Grand Chamber on 21 October 2013 took an even more controversial turn. The reasoning of the Court does not seem to be particularly sound and the outcome is a denial of justice. The comparison with the jurisprudence of the Inter-American Court of Human Rights in similar cases makes this all the more evident, suggesting that the application of different interpretative criteria would have been possible.

In the Janowiec and Others v. Russia case, the European Court of Human Rights (ECtHR), trying to find its way between the Scylla of humanitarian ideals and the Charybdis of State sovereignty, demonstrated its unwillingness to deal in detail with the black pages of Europe’s past, handing this right over to historians. The article first draws parallels between temporary jurisdiction of the Inter-American Courts of Human Rights and the ECtHR. Both of them found ways to overcome the non-retroactivity principle, but by using different techniques. Secondly the article analyzes how the presumption of death became the factor severing the link between the substantive and procedural limbs of violation of the right to life, turning the latter aspect into a detachable autonomous obligation. Finally, the author of the article expresses his regrets that the Court and the applicants missed the chance to develop the “right to the truth”, using, inter alia, the potential of Art. 10 of the European Convention on Human Rights.

The Polish Government’s proposal, submitted in autumn 2017, for a comprehensive reprivatisation bill revived the international discussion on the scope of Polish authorities’ obligations to return property taken during World War II and subsequently by the communist regime. However, many inaccurate and incorrect statements are cited in the discussions, e.g. the argument that the duty of the Polish authorities to carry out restitution is embedded in the European Convention on Human Rights and its Protocol No. 1. This article challenges that claim and analyses the jurisprudence of the Convention’s judicial oversight bodies in cases raising issues of restitution of property taken over in Poland before the accession to both of the above-mentioned international agreements. In the article I argue that there is no legal basis for claiming that there exists a legal obligation upon the Polish State stemming directly from international law – in particular human rights law – to return the property and that the only possibly successful legal claims in this regard are those that can already be derived from the provisions of the Polish law applicable to these kinds of cases. In its latest rulings, issued in 2017–2019, the European Court of Human Rights determined the scope of responsibility incumbent on Polish authorities in this respect.

The content of this publication is a presentation of the meaning of the formula which refers to human dignity. The understanding of this idea should always remain in accordance with the legislative and judicial acquis of countries of western civilisation sphere. Based on judicature and source literature, respective attributes of human dignity, which Article 30 of the Constitution of the Republic of Poland refers to, have been explained. A change of the attitudes of constitutional lawyers’ community and the Constitutional Tribunal has been highlighted, with the possibility of referring to the content of this article as an independent model of constitutionality of law under an abstract and concrete control. Initially, human dignity was considered as a general rule and not legal rights.

In this article, we attempt to present the legal grounds for introducing restrictions on human rights during the COVID-19 pandemic from a comparative legal perspective. We refer to the findings of a research project completed in 2020, trying to synthesize them and confront them with existing theoretical models. We strive to capture general patterns in the legal basis for states’ actions in response to global threats such as the COVID-19 pandemic. Comparative legal research contributes to the creation of universal solutions, which, taking into account the specificity of the system, can then be applied in local conditions.

The article is devoted to the presentation of the outline of the concept of operationalization of human rights taking place in the states involved in the system of international protection of those rights. The concept of operationalization of protection is a collective term for a series of processes that lead to the establishment of legal provisions protecting human rights, and to transfer this abstract construct to specific societies. It includes both the decision-making processes of extralegal (uprising idea, its conceptualization, social issues and change the perception of axiology of society, cultural aspects) and legal (lawmaking and law application processes in the aspect of human rights and the impact of international institutions on them) character. The essence of the process of operationalization is providing effective protection of human rights in a state. The concept is set primarily on the consequences of membership of Poland in the system of the Council of Europe.

The author acknowledges the necessity for a comprehensive regulation of the implementation of judgments of the European Court of Human Rights in Polish law. However, he remains critical towards the bill in question. He considers the solutions concerning the concept of implementing judgments to be defective. The constitutional complaint is a means to protect constitutional rights, as well as being the core element of a state governed by the rule of law. It was introduced into the Latvian legal system only in 2001, which is five years after the establishment of the Constitutional Court. A constitutional complaint is of great importance since not only does it protect fundamental human rights, but also guarantees the public interest. Although the Baltic States share many historical, social, formal and political similarities, there are many differences in the precise legal solutions and institutions. Thus, the possibility of filing a Constitutional complaint is recognised only in the Latvian legal system. While in Estonia a person has a limited direct access to the Supreme Court and Lithuania is merely considering its introduction.

Opis:
This Article investigates how the European Court of Human Rights becomes competent to make decisions in cases concerning (or taking roots in) 'historical situations' preceding the ratification of the European Convention by a given Member State or even the enactment of the Convention. 'Historical situations' refer to events that occurred in the period of Second World War or shortly thereafter. In all such cases, the preliminary question arises whether the Court is competent temporally (ratione temporis) to deal with the application. This group of cases concerned usually allegations touching upon the right to life and the right to property. The Court had to decide if the allegation in question related to a temporally closed event (making the Court not competent) or rather to a continuous violation (where the Court could adjudicate). A specific set of legal questions arose vis-a-vis the right to life, first of all that of the autonomy of the procedural obligation to conduct an efficient investigation. The Strasbourg case law did not provide a clear answer. However, following two crucial judgements rendered by the Grand Chamber, the Court has established an interesting legal framework. Article analyses also two other situations having a historical dimension: bringing to justice those accused of war crimes or other crimes under international law (in light of the alleged conflict with the principle of nullum crimes sine lege) and pursuing authors of pro-Nazi statements or speech denying the reality of Nazi atrocities.

European states responded in different ways to tensions related to the increase in religious diversity, and the restrictions introduced were considered appropriate when they resulted from public security and the need to protect others, especially if the state presented a credible justification. On this occasion, the case-law of the ECHR developed two key concepts for the determination of the presence of religious symbols in public places: a powerful external symbol and an essentially passive symbol. An important achievement of the Tribunal is also the introduction of the concept of “improper proselytism.” Certainly, a further increase in religious diversity in Europe may lead to new areas of controversy, which will then be assessed by the ECHR. However, the existing instruments used by the Court, such as the idea of the Convention as a living document, the theory of the margin of appreciation or the analysis of the existence of the European consensus, enable it to develop its interpretation in this regard.

On 3rd November 2009 the European Court of Human Rights in Strasburg ruled that Italy had to remove crucifi xes from school classrooms, thereby supporting the application submitted by Soile Lautsi Albertin, an Italian citizen of Finnish origin, “in the name of the principle of state secularism.” The above decision sparked an uproar and criticism which reverberated throughout entire Europe. On 30th June 2010, an appeal against this ruling, inspired by an ideological vision of religious freedom, had been discussed by Italian government lawyers before the Grand Chambre of the Court of Justice in Strasbourg. The Appeal judgment cancelled the first verdict and recognized the Italian Government’s reasons and rights to display crucifixes in public schools. It was concluded that the first judgment didn’t take into consideration the social and public role of religion, especially the Christian one, in the process of building a civil society and a public law system and promoted religious indifferentism which stands in contradiction with the entire history, culture and rights of the Italian people and the peoples of Europe.

Public authorities, as part of positive obligations, should be more actively involved in the protection of human rights, especially the freedom of expression and the right to privacy, which are currently being violated quite widely and especially in the horizontal dimension in cyberspace.

The analysis of the materials show that the CIA prisons, where the members of Al-Kaida were kept and interrogated, were founded in Poland in 2002 when the country was governed by SLD. The PiS politicians who were in the following government knew about the fact but did not want to reveal it to the public. The party of PO which has been governing the country since 2007 has not solved the problem yet. European Court Of Human Rights held in its verdict of 24 July 2014 that there had been the CIA prisons in our country. According to that verdict Poland violated the European Convention on Human Rights and its ban on torture. Poland has not solved the problem, prolonging the investigation 15 times. It is extended until 11 April 2015. On 23 October 2014 our country appealed to European Court of Human Rights to hear the case again.

nullum crimen sine lege
Opis:
The principle of nullum crimen sine lege expresses an old idea that only the law can prescribe a particular act as punishable. It is commonly understood as a requirement of sufficient definiteness of an offence, in particular – of a statutory description of an offence before it has been committed (lex scripta, lex praevia), and of clarity and precision in criminal provisions so as to enable an individual to conform with them (lex certa), as well as their strict interpretation (lex stricta). Nowadays the principle is an internationally recognized human right to foreseeable criminalization, guaranteed by, inter alia, Article 7 of the European Convention on Human Rights. However, the European Court of Human Rights seems to formulate two slightly different requirements on its basis, namely that the application of criminal law must be foreseeable for an individual and coherent with the “essence of an offence”. One may question whether this can serve as an adequate “shield” from arbitrariness on the part of State authorities. Nevertheless, the core aim of such a flexible approach is not to promote legal security for potential perpetrators, but to achieve better protection of human rights in general.

The human rights doctrine and in particular the Universal Declaration of Human Rights is undoubtedly an important step towards the search for an adequate formula, which would protect man and his rights. This statement points out that despite the efforts, which have been made in the last 70 years, this formula has not been effective. Many authors mentioned that and they were critical towards that idea, presenting many contradictions and problems related to that issue. Alfredo Cruz Prados is one of them. The objective of this article is to present the criticism of human rights by Alfredo Cruz Prados. Its perspective is a classical political philosophy. Thanks to this approach the author seems not to be entangled in modern philosophical terminology and its significance. It allows his criticisms to obtain certain freshness and novelty in relation to other proposals which criticize the human right ideas in philosophical literature. Alfredo Cruz Prados suggests we should reconsider the formula, in which we express the truth about human dignity and greatness, and we should again base it on the foundation of the classical political philosophy. For this author this project does not concern only the human rights doctrine, but it is a wider vision of the political philosophy renewal.

The article is an amended version of the Marek Nowicki Memorial Lecture presented at Warsaw University in 2014. It discusses the contemporary meaning of the right to free expression, concentrating on the basic principles of free speech as well as the limits of the right. In this context, the article pays special attention to British, Polish and European practice (particularly with respect to cases that are relevant for Poland). The specific topics tackled by the author include: free speech and the problem of criminalization of certain acts (e.g. the offence of defamation of public officials), hate speech, freedom of expression and the right of an individual to protect his or her good reputation (including the issue of libel laws), freedom of expression and the right to privacy (including the right to prior restraint on publication), free speech and internet, and the right to privacy versus national security.

The aim of this article is to present the European Committee of Social Rights as a moni-toring treaty body in the system of the European Social Charter. The author pays par-ticular attention to the mechanism of collective complaints, which was introduced to the Charter’s supervisory system on the basis of the 1995 Additional Protocol. In the author’s opinion, on the basis of the competence of the European Committee of Social Rights to hear collective complaints, it is arguable that this important treaty body in the system of the European Social Charter performs the function of a quasi-judicial organ in the monitoring process, which distinguishes it from other treaty bodies in the field of the international protection of human rights

This article provides an overview of “memory laws” in Europe, reflecting upon what may be called the “asymmetry” of such laws. It then looks at the special case of Poland and its troubled experience with memory laws; it considers the question of whether, in the eyes of the law – genocide, and in particular the Holocaust – is so “special” that its public denials warrant legal intervention. It also looks at the case law of the European Court of Human Rights and its (not necessarily coherent) “doctrine” on memory laws and their consistency, or otherwise, with the European Convention for the Protection of Human Rights and Fundamental Freedoms (and in particular with freedom of expression as laid down in Art. 10). The article concludes by asserting that even if we take the law as an indicator of European public memory, there is no consensus on the past, except perhaps for the special case of the Holocaust. The main challenge lies in determining whether memory laws, defined by some as social engineering and the imposition of “imperative” versions of memory, are consistent with the principles inherent in open, democratic and free societies in Europe. This challenge remains unmet.

In this paper, we contribute to the debate on life-satisfaction gap between the citizens of post-socialist countries of Europe and Asia and their highly developed OECD counterparts, by examining the influence of de jure and de facto respect for empowerment rights. We mainly focus on the measure of rights protection called de jure - de facto rights protection gap. The empowerment rights included in the analysis are: the freedom of association, the freedom of expression, the freedom of religion, the freedom of foreign movement. Our results imply that government’s respect for these rights plays the role in diminishing happiness gap. We base the conclusions on an empirical study conducted on the sample of more than 59,000 observations. The data used for the study consist of World Values Survey database (waves 3–6) and a number of socio-economic indicators for 44 countries.

The scale of immigration problems in Europe today is well-known and broadly dis-cussed. The article identifies how this issue is reflected in two Human Rights Council mechanisms: Special Procedures and the Universal Periodic Review. The Special Rap-porteur on the human rights of migrants, François Crépeau, undertook a regional study on the management of the external borders of the European Union and its impact on the human rights of migrants. The analysis of the annual and country visits’ reports allows the main immigration problems facing the EU countries and threats for the protection of human rights to be identified. The recommendations made by the Special Rapporteur are confronted with those taken up in the UPR process. Special attention is given to the EU countries’ position on the problem of immigrants. Their reluctance to raise this issue in the UPR weakens the credibility of EU Member States and puts the objectivity of the mechanism into question.

The paper reveals modern problems of limiting, ensuring, and realizing human rights during crisis events in Ukraine. The unsatisfactory state of the social protection system of Ukraine in the pre-crisis period is revealed (including problems of unstructured legislation, excessive financial burden, etc.). The article analyzes the existing guarantees and standards of human rights during the pandemic (included in the selected international documents and the Constitution of Ukraine). Several negative factors faced by the most vulnerable social groups during the crisis were addressed (for IDPs – problems of displacement, residence, job search; for the older population – problems of social security, treatment of chronic diseases, movement restrictions, and relevant age-based discrimination; for the homeless – absolute insecurity from all manifestations of the COVIDfueled crisis; for the detained and imprisoned – problems of penitentiary medical care, postponement of amnesty and subsequent rehabilitation). The paper assesses the relevant normative documents regulating social relations during the pandemic in terms of their positive and negative impact on the above risk groups (facilitated with the analysis of additional financial aid and payments, legal restrictions, the impact of the increasing financial burden on state and local budgets due to quarantine, the unconstitutionality of certain provisions and the lack of adequate legal response from the Constitutional Court of Ukraine). Conclusions were drawn based on the analysis of the officially established strategy to combat COVID-19, supplemented by a prognosis of the long-term consequences of its implementation (the pros and cons of the selected strategy of simultaneous “hard” and “soft” quarantine measures, the lack of long-term care policy, unpreparedness for vaccination and the restoration of the pre-pandemic way of everyday life).

One of the basic principles on which the European Union bases is respect for human rights and the dignity of the human person. This is an extremely extensive subject, nevertheless still extremely important from the point of view of the ruling elite as well as the entire society. This article present a system of human rights protection in the EU. First of all, treaty guarantees aimed at ensuring the protection of fundamental rights will be discussed, as well as the EU Charter of Fundamental Rights and functioning of the EU Fundamental Rights Agency with its registered office in Vienna. Based on them, an analysis of the level of EU involvement in the protection of these rights will be made, their promotion not only on the territory of the Member States, and facts will be verified, which should be understood as the real actions taken by the EU to achieve its objectives.
Jedną z podstawowych zasad na których opiera się Unia Europejska jest poszanowanie praw człowieka i godności osoby ludzkiej. Jest to temat niezwykle obszerny, niemniej jednak wciąż niebywale istotny zarówno z punktu widzenia elit rządzących, jak i całego społeczeństwa. Niniejszy artykuł przedstawia system ochrony praw człowieka, który zapewnia organizacja międzynarodowa jaką jest UE. Omówione zostały przede wszystkim gwarancje traktatowe, które mają zapewnić ochronę praw podstawowych, a także Karta Praw Podstawowych UE i funkcjonowanie Agencji Praw Podstawowych UE z siedzibą w Wiedniu. Na ich podstawie została dokonana analiza stopnia zaangażowania UE w ochronę i promowanie tych praw nie tylko na terytorium państw członkowskich. Przede wszystkim zweryfikowany został stan faktyczny, przez co należy rozumieć stan realnych działań podjętych przez UE dla realizacji swoich założeń.

The presented paper of a contributory character is aimed at examining the extent to which the constitutional guarantees of cultural rights were limited in a time of pandemic. Fur- thermore, the paper aims to answer the question of whether the introduced limitations in cultural rights were compliant with the principle of proportionality, if they were adequate to the actual state of affairs and whether the implemented legal measures ensured the ef- fectiveness of law implementation. The legal sources analysed herein provide an answer to the question of whether the state has ensured alternative forms of enjoyment of products of culture and if it was obliged to do so. The paper focuses on a detailed analysis of the scope of the constitutional guarantees of cultural rights and the legal acts regulating the current state of the COVID-19 pandemic. Methods typical for legal sciences have been used herein, primarily the methodology of examining applicable laws. The legal norms analysed in the paper are included in the Constitution of the Republic of Poland, specific statutes and imple- menting regulations.

The aim of the study it to reconstruct the European standard for the protection of patients’ lives in its substantive and procedural aspects. In the case-law of the bodies of the system of the Convention for the Protection of Human Rights and Fundamental Freedoms, the scope of the state authorities’ substantive and procedural obligation to protect the right to life in the health care system was defined for the first time by the European Commission of Human Rights in the decision of 22 May 1995 in Mehmet Işıltan v. Turkey, and then repeated in the case-law of the reformed Court in the decision on the admissibility in Powell v. United Kingdom. The study of the European standard for the protection of patients’ lives traces its history, from Mehmet Işıltan v. Turkey and Powell v. United Kingdom; through developments of the meaning of its substantive limb, as illustrated by Mehmet and Bekir Senturk v. Turkey, Asiye Genc v. Turkey, Aydogdu v. Turkey, and Elena Cojocaru v. Romania; to developments of the meaning of its procedural limb, as exemplified by Calvelli and Ciglio v. Italy, Wojciech Byrzykowski v. Poland, Šilih v. Slovenia, and Gray v. Germany; and finally covers the Court’s attempt to sum up its previous approach to the European standard for the protection of patients’ lives, as expressed in the case of Lopes de Sousa Fernandes v. Portugal.

More and more Member States of the Council of Europe are becoming interested in drone technology. Currently, a number of them either possess or wish to obtain unmanned aerial vehicles equipped with missiles. Due to the increased number of targeted killing operations committed with the use of drones by countries such as the United States or Israel, there is a probability that Member States might also use them for such operations, especially if their forces will be subject to joint command. Although the issue of targeted killings with the use of drones has not yet been subject to the scrutiny of the European Court of Human Rights, there are two main reasons why this may change in the near future. First, the Court has already ruled on the extraterritorial applicability of the European Convention on Human Rights, and second, the Convention places strict limits on any attempts to carry out targeted killings and leaves only a limited space for their use, even in the context of warfare. In this article we assess whether the Member States of the Council of Europe might be ever justified under the European Convention on Human Rights to carry out targeted killing operations using drones.

The split into the predominantly Muslim Northern Sudan, and Southern Sudan with a Christian and animist majority, had been emerging in the course of many centuries. Without any doubt, one is bound to mention the natural and geographical boundaries, the ethnical diversity of the regions, the influence exercised during the centuries by the Egyptians, Arabs and later on by the British. According to the opinions of some experts on the subject, there can be two distinct matters that have contributed to the split of the North and the South. These were education and religion. Apart from education, also the issue of religion was dividing the Sudan. After the declaration of independence on January 1, 1954 all the Christian private schools in the South were closed down. There remained only state schools with Arabic as the language of instruction and with the upbringing model based on the Koran teaching. Having obtained political independence, the fears of the British administration and Christian missionaries became a reality: Islam was made the state religion. The only way to attain an occupational and social status was to convert to Islam. Frequently, this took place according to the rule of an already accomplished fact or by pressure. In the context of Sudan, one of the biggest country in Africa, with its population of over 37 million, made up of 70 per cent Muslim believers , 14 per cent of Christians, and 12 per cent of animists, it is of great importance for the perception of fundamentalism to be familiar with the history of this country.

Human Rights are natural rights that nature has given to all human beings and are inseparable, undividable and inalienable from human beings. They are vital, necessary and indispensable to a modern society, which without them would be unable to function and cannot be developed. From another perspective, “human rights are indivisible rights on individuals, based on their nature as human beings; they protect these potential attributes and holdings that are essential for a worthy life of human beings”. Human Rights in general and especially ESCR would be just illusory if they wouldn’t be justiciable. In relation to civil and political rights, it is generally taken for granted that judicial remedies for violations are essential. Regrettably, the contrary assumption is too often made in relation to ESCR. This discrepancy is not warranted either by the nature of the rights or by the relevant Covenant provisions, but is rather a result of states’ attempts to justify their failure to perform their obligations under ICESCR.
