This paper addresses a comparative analysis of the issue of necessary defense in terms of tort law. The concept of indispensable defense is most often associated with criminal law. However, it is not the only branch of law in which it occurs. It is also possible to find it on the grounds of the Civil Code. A necessary defense is one of the main counter-narratives which exclude the unlawfulness of an act. As a matter of fact, acting within the framework of necessary defense, we act according to the rules of law. Nevertheless, it is important to act only within the limits of such defense, because exceeding them excludes the unlawfulness of the act. The subject of this dissertation is to show, compare, and analyze legal regulations defining the right to indispensable defense in Poland and other contemporary countries.

Celem artykułu jest wykazanie, jak duże znaczenie dla zrozumienia specyfiki polskich historii alternatywnych mają uwarunkowania postkolonialne. Jednym z najważniejszych następstw postkolonializmu jest specyficzna zaniżona samoświadomość subalterna, prowadząca w konsekwencji do kompleksu niższości narodu podporządkowanego. Co więcej, „postkolonialny stan świadomości” trwa nawet po ustaniu procesu politycznego podporządkowania. Paradoksalnie jednak, kompleks niższości może objawiać się w pielęgnowaniu melancholijnych wyobrażeń o wspaniałej, pełnej chwały przeszłości. Takie wyobrażenia manifestują się między innymi w literaturze, która jest przecież sposobem mapowania świata i opisywania jego kulturowej różnorodności. W tym ujęciu literatura staje się zwierciadłem ideologii i polityki. Interesującym przykładem kreowania obrazów minionej hegemonii historycznej są powieści z gatunku historii alternatywnej. Dlatego też, autorka, korzystając z terminów H. Bhabhy „pisanie narodu”, „pedagogika narodowa” czy „necessary fictions”, opisuje i analizuje sposoby w jakie wybrane historie alternatywne wypełniają marzenia subalterna o minionej wielkości politycznej. Utwory literackie Marcina Wolskiego (Alterland, Mocarstwo, Jedna przegrana bitwa), Andrzeja Ziemiańskiego (Bomba Heisenberga), Dariusza Spychalskiego (Krzyżacki poker), Macieja Parowskiego (Burza. Ucieczka z Warszawy ‘40) oraz prace z gatunku dziennikarskiej niefikcjonalnej pop-historii (np. Pakt Ribbentrop-Beck, czyli jak Polacy mogli u boku III Rzeszy pokonać Związek Sowiecki Piotra Zychowicza) kreują fikcyjne, alternatywne światy, w których Polacy podbili znaczną część świata, pokonali wrogów podczas II wojny światowej oraz podporządkowali sobie ZSRR i mniejsze sąsiadujące narody. Wspomniane powyżej utwory literackie stanowią dla subalterna „konieczne fikcje” [necessary fictions], stanowiące rodzaj autoterapii. To zaś może być rozumiane jako efekt resentymentów czy postkolonialnej, nieprzepracowanej przez subalterna traumy.
The aim of this paper is to show the significance of the postcolonial determinants for understanding the specificity of the Polish alternate history novels. The author argues that one of the most meaningful repercussions of postcolonialism is the specific self-consciousness of the insignificant subalterns and, as a consequence, the inferiority complex. More importantly, the „subaltern state of mind” lasts even after the postcolonial subordination ends. Paradoxically, the inferiority complex could be manifested as a belief in one’s glorious and magnified past. Such a conviction is evoked inter alia by literature, which is a type of mapping the world and describing cultural diversity. In this scope, literature is a mirror of ideology and policy. Alternate history novels are interesting examples of creating a false magnificent past. Therefore, applying the terms such as „writing the nation”, „national pedagogy” and „necessary fictions” (H. Bhabha) the author discusses the capability of the selected alternate history novels for fulfilling the subalterns’ dreams about greatness, power and political importance. The literary works of Marcin Wolski (Alterland, Mocarstwo, Jedna przegrana bitwa), Andrzej Ziemiański (Bomba Heisenberga), Dariusz Spychalski (Krzyżacki poker), Maciej Parowski (Burza. Ucieczka z Warszawy ‘40) and the journalistic, non-fictional products of pop-history, such as Pakt Ribbentrop-Beck, czyli jak Polacy mogli u boku III Rzeszy pokonać Związek Sowiecki by Piotr Zychowicz, describe fictional, alternates, worlds in which Poland conquered a significant part of the world, defeated their enemies in the Second World War and subordinated the Soviet Union as well as smaller neighbours. Thence, the above mentioned authors give the subalterns the necessary fiction, a kind of self-therapy. The latter could be also understood, the author concludes, as the effect of postcolonial trauma, resentments and unresolved issues stemming from subjugation.

The aim of the article is to present an overview of the semantic analyses of threat understood as a speech act that have been so far conducted in Polish linguistic studies. The overview includes three selected analyses. The first one is based on the idea of necessary and sufficient conditions proposed by Anna Wierzbicka. The second is Joanna Wołoszyn’s work based on a methodology developed in line with structural semantics and attempts to define the terms straszyć (to scare) and grozić (to threaten). The third one is an analysis by Roman Kalisz and Wojciech Kubiński based on prototypical effects in speech acts, meaning that it relies on the methodology of cognitive linguistics. The overview is complemented by a critical analysis focused on identifying the imperfections of all three ideas presented in it and by a presentation of possible and legitimate improvements.

Wystrzały bezpociskowymi 5,6 mm nabojami Long (tzw. amunicja hukowa vel alarmowa) „z przyłożenia" lub ze zbliżonej odległości w wypadku skierowania ich przeciwko istocie żywej zdaniem eksperymentatorów mogą uszkodzić organy (narządy) ważne dla życia organizmu lub spowodować pewne okaleczenia (np. pozbawienie wzroku, rozległe oparzenia itp.), przerwanie ciągłości skóry itd. Czynnikiem działającym traumatyzująco jest w omawianym wypadku ukierunkowana struga rozpalonych gazów powystrzałowych. Mniej niebezpieczne skutki powoduje użycie przez strzelającego nabojów Short. Zastrzega się, że strzały eksperymentalne oddawano z egzemplarzy o lufach w wymagany sposób wzdłużnie przedzielonych przegrodą, przez co początkowa energia kinetyczna strumienia gazów była zmniejszona w wyniku strat na przegrodzie. Użycie egzemplarzy o nieprzegrodzonych lufach powinno spowodować zwiększenie niebezpieczeństwa dla istot żywych. Z uwagi na ustawowy zakaz takich luf podczas eksperymentu nie stosowano. Na skórze dłoni, z której oddawano strzał (ewentualnie na wierzchniej odzieży strzelca) można szukać pozostałości powystrzałowych (w tym GSR). W połączeniu z nasadkowymi racami z ładunkiem pirotechnicznym amunicja bezpociskowa może stanowić instrument przypadkowego lub umyślnego zainicjowania pożaru przedmiotów łatwozapalnych, np. siana, słomy, stogu, strzechy, suchej ściółki leśnej.
Shots with blank 5.6 mm Long cartridges (known as stun or alarm ammunition), being taken against a living person or animal, according to the conductors of the experiments, can injure vital organs or cause mutilation (e.g. loss of sight, extensive burns etc), skin cuts etc. In the described case, the traumatic factor is a targeted stream of burning gunshotgases. Less dangerous consequences were caused using the Shortfiring cartridges. The stipulation is that the experimental shots were fired from the guns of barrels, as required, longitudinally separated by a partition so that the initial kinetic energy of the gas streams is reduced. Using guns of the barrels without partitions should result in increasing the danger to living beings, during the experiment such barrels were not used because of the statutory ban. On the skin of the firing hand (or on the shooter's outer garment) the gunshot residues can be looked for. In conjunction with socket flares with a pyrotechnic charge, the blank ammunition can serve as a means of accidental or deliberate ignition of flammable materials such as hay, straw, heap, thatch, dry forest floor.

The following article aims at discussing the attributes of the directness of attack and the commensurateness of the means of necessary self-defense, which constitute the most significant, but also the most controversial, prerequisites for the justification of necessary self-defense. The author conducts his study on the basis of selected case law of appeal courts and the Supreme court, dating back four years. In this way, the article allows to delineate the limits of necessary self-defense, as well as present particular cases of exceeding the limits of necessary self-defense.

Opis:
The purpose of the article is to analyse possible grounds, within the criminal sphere, for legalisation of behaviour involving damage to someone else’s property motivated by the desire to save a child or an animal left in a locked warming car. It is quite common to treat this type of event as one matching the features of the state of superior necessity. However, such an approach may raise some doubts of a dogmatic nature. From the point of view of the statutory shape of the existing countertypes, one can look for the possibility of assuming in such cases (when the owner of the damaged property and the perpetrator of leaving a living creature in such conditions is the same person) the occurrence of an assault justifying, after meeting all the required conditions in the form of directness, lawlessness and reality, taking teps within the right to necessary defence. The adoption of such a concept has its own tangible practical significance, as it makes it unnecessary to refer to the principle of subsidiarity and proportionality, which guarantees broader protection from criminal liability for those who damage other people’s property in order to take out a living creature left in a locked car in a situation of danger to its life or health.

Opis:
Heat exhaustion of mining environments can cause a significant threat to human health. The existing cooling strategies for the mine face aim to cool the whole face. However, the necessary cooling space for the face is small, with a considerable amount of energy for cooling being wasted. Necessary cooling space is a space occupied by the workers in the face. This study proposed to build a non-homogeneous thermal environment for cost-effective energy savings in the face. An inlet air cooler was laid out in the intake airway to cool the whole face to some extent, and the tracking air cooler was designed to track the worker who constantly moved to improve the thermal environment. The cooling load and air distribution for this cooling strategy were investigated. In addition, the airflow in the face was solved numerically to estimate the cooling effect. The results revealed that an average energy saving of approximately 35% could be achieved. The thermal environment of the necessary cooling space within at least 10 m was significantly improved. This cooling strategy should be taken into account in mine cooling.

Jeden z kontrargumentów do argumentu z ukrycia Boga, który zyskuje popularność w ostatnich latach, odnosi się do niepojętości Boga. Jeśli Bóg jest transcendentny, twierdzą zwolennicy tego argumentu (tj. Michael Rea i Roger Pouivet), to nie wiemy, czy Boska miłość wyraża się w otwarciu na osobiste relacje ze skończonymi istotami, jak twierdzi pierwsza przesłanka argumentu o ukrytości. Oskarżają J. L. Schellenberga o kształtowanie koncepcji Boga na wzór współczesnych koncepcji człowieka. W odpowiedzi wskazuję na fakt, że chociaż w pismach Schellenberga istnieje niebezpieczeństwo antropomorfizmu, personalistyczny teizm musi zaakceptować pierwszą przesłankę argumentu z ukrycia. Uzasadniam swoją tezę, odwołując się do zasady scholastycznej, która pozwala przypisać Bogu wszystkie doskonałości, i argumentując na rzecz tezy, że osobowość (rozumiana w kategoriach racjonalności i wolności) jest jedną z doskonałości.
One of the counterarguments to the hiddenness argument that gains the popularity in the recent years refers to the inconceivability of God. If God is transcendent, state the proponents of the argument (i. e. Michael Rea and Roger Pouivet), then we do not know if the divine love is expressed in the openness to personal relationships with finite beings, as the first premise of the hiddenness argument claims. They accuse J. L. Schellenberg of shaping the concept of God on the model of modern concepts of person. In response I am indicating at the fact that even though there is a danger of anthropomorphism in Schellenberg’s writings, personalistic theism is bound to accept the first premise of the hiddenness argument. I justify my thesis by referring to the scholastic principle that allows to attribute to God all perfections and by arguing in favour of the thesis that personhood (understood in terms of rationality and freedom) is one of the perfections.

Cardinal Gerhard Ludwig Müller, the closest associate of Pope Benedict XVI, theologically as if his Alter-Ego, is certainly one of the best experts in the Catholic Church in Germany. And it is he who compares the present condition of this Church to the catastrophe of such a huge and luxurious Titanic, which, however, is slowly sinking, because those responsible turned out to be reckless and did  not predict the worst. Indeed, so far the application of almost all criteria that apply to the evaluation of a religious community has shown that, in fact, since the Second Vatican Council, this Church has been losing its vitality and shrinking. However, the so-called Synodal Way has deteriorated even more dramatically in recent times. Its agenda includes goals and demands that are contrary to both Revelation and the Tradition of the Church, and that are contrary to common sense. These are the goals and demands that  have been made by even extreme left and atheistic ideologues and politicians, and which are now to move to the center and  foundations of church teaching.It seems that just as almost all English bishops in the 16th century succumbed to the state violence of King Henry VIII and betrayed  Christ and the Church, today the vast majority of German clergymen succumb to ideological violence in the area of culture and the state and thus betray their own faith and betray Church and Christ. It seems that many of them are close to the ideas of Georg Wilhelm Hegel, who considered himself wiser and greater than all, also than Christ, and the thought of Friedrich Nietzsche, who wanted to replace the crucified Messiah with Dionysus – a patron of, among other things, debauchery. It seems that many of the faithful and clergy in Germany also want to carry out a sexual revolution in the Church as if the second Reformation, perhaps even more catastrophic than the first. It seems that they are putting gender theory in place of Revelation and Christianity. And gender is, in fact, another neo-Marxist pansexual ideology which elevates eroticism as if it were the most important value, more important  especially than God and one’s own salvation.One has to ask, how could such a great spiritual catastrophe of a Church that was once so numerous, so strong, so faithful and creative? We must ask what to do so that no more Church would destroy itself so that such a spiritual disease would not spread to other Churches. This article tries to answer these fundamental questions. It does so by analyzing the cultural, historical, national, economic, spiritual and religious conditions of German society that led to such an advanced process of self-destruction of the  Church.

Dans le présent article on effectue une description systématique de 260 mots japonais d’origine européenne. Ceux de provenance anglaise (parfois parvenus à l’anglais via le français) en constituent une grande majorité. La recherche porte exclusivement sur le lexique général (environ 6000 mots) et ne prend pas en compte de mots provenant des registres spécifiques. Le matériel analysé, qui constitue juste un échantillon à compléter, est relativement récent, vu que le Japon ne s’ouvre au monde occidental et à ses langues que dans la deuxième moitié du XIXe siècle. En 1867, après la suppresion du shogunat, l’empereur Mutsuhito commence la modernisation du pays. Les exemples recensés se répartissent en deux types : emprunts de nécessité (selon Louis Deroy), comme taipuraita (fr. machine à écrire, angl. typewriter) et emprunts de luxe comme omuretsu (angl. omelet(te)), classé ainsi puisque le japonais disposait d’un terme propre : tamago‑yaki.
The article discusses over 260 European borrowings in Japanese. In most cases they are Anglicisms (often of French origin). The research was conducted on the basic vocabulary (excluding technical and specialist terminology) consisting of about 6000 words. The list should not be considered a finished project but is the outcome of a preliminary research. Since Japan opened to the Western world and Western languages relatively recently (in the second half of the nineteenth century), the vocabulary is relatively new. The vocabulary discussed in the article is divided into two categories: necessary (de nécessité) and unnecessary (de luxe) borrowings.
W artykule przedstawiono zbiór przeszło 260 zapożyczeń z języków europejskich w japońszczyźnie. W ogromnej większości są to anglicyzmy (często pochodzenia francuskiego). Poszukiwaniem objęto słownictwo podstawowe (z całkowitym pominięciem terminologii technicznej, fachowej): około 6000 haseł. Zbiór bynajmniej nie jest kompletny, stanowi jedynie próbę rekonesansu. Zebrany zasób leksykalny jest stosunkowo świeżej daty, dopiero bowiem w drugiej połowie XIX wieku Japonia otwiera się na kontakty ze światem zachodnim, a więc i z jego językami. W 1867 r., po usunięciu szogunatu, cesarz Mutsuhito (Meiji Tennō, panuje od 1867 do 1912 r.) rozpoczyna modernizację kraju. Zebrany materiał dzieli się na zapożyczenia konieczne (de nécessité według L. Deroy), jak taipuraita ‘maszyna do pisania’, z ang. typewriter, i zapożyczenia niekonieczne (de luxe), jak omuretsu ‘omlet’, z ang. omelet(te), albowiem istniała nazwa rodzima na określenie tej potrawy: tamago‑yaki.

Second order optimality conditions have been derived in the literature in two different forms. Osmolovskii (1988a, 1995, 2000, 2004) obtained second order necessary and sufficient conditions requiring that, a certain quadratic form be positive (semi)-definite on a critical cone. Agrachev, Stefani, Zezza (2002) first, reduced the bang-bang control problem to finite-dimensional optimization and then show that well-known sufficient optimality conditions for this optimization problem supplemented by the strict bang-bang property furnish sufficient conditions for the bang-bang control problem. In this paper, we establish the equivalence of both forms of sufficient conditions and give explicit relations between corresponding Lagrange multipliers and elements of critical cones. Part 1 summarizes the main results while detailed proofs will be given in Part 2.

In Part 1 of this paper (Osmolovskii and Maurer, 2005), we have summarized the main results on the equivalence of two quadratic forms from which second order necessary and sufficient conditions can be derived for optimal bang-bang control problems. Here, in Part 2, we give detailed proofs and elaborate explicit relations between Lagrange multipliers and elements of the critical cones in both approaches. The main analysis concerns the derivation of formulas for the first and second order derivatives of trajectories with respect to variations of switching times, initial and final time and initial point. This leads to explicit representations of the second order derivatives of the Lagrangian for the induced optimization problem. Based on a suitable transformation, we obtain the elements of the Hessian of the Lagrangian in a form which involves only first order variations of the nominal trajectory. Finally, a careful regrouping of all terms allows us to find the desired equivalence of the two quadratic forms.

This paper provides an analysis of time optimal control problem of motion of a material point in the plane outside the given circle, without friction. The point is controlled by a force whose absolute value is limited by one. The closure of exterior of the circle plays the role of the state constraint. The analysis of the problem is based on the minimum principle.
