Polish National Health Care Fund may sign contracts for medical services with private institutions (both natural and legal persons). The President of the National Health Care Fund has issued decree which sets down the precise rules of evaluation of offers made by private institutions. All medical service providers, who want to enter into contract with National Health Care Fund are treated equally and their offers are evaluated according to this decree. Among other criteria standard of provided services is taken into account and bonus points are awarded to health care providers who received ISO certificate as a proof of keeping high standards.

There is no doubt that public authorities may be directly or indirectly involved in economic activity. A traditional way of distinguish state activity which is not subject to the rules of the market is to decide when the state acts as public authority. In case of state activity two category of situations should be distinguished: these where the state is engaged in an economic activity (sphere of dominium) and these when the state acts by exercising of public powers (sphere of imperium). In the opinion of the author of the article, the distinction between imperium and dominium is still relevant. According to the Competition and Consumer Protection Act of February 16, 2007, an entrepreneur is inter alia natural and legal person, as well as an organisational unit without a legal status to which legislation grants legal capacity, organising or providing public utility services which do not constitute economic activity in the meaning of the provisions on freedom of economic activity. The President of the Office of Competition and Consumer Protection found that public authorities exercising their administrative powers (sphere of imperium) may be classified as entrepreneurs. In the recent decisions which were subject of judicial review the President of UOKiK decided that the National Health Fund – a state authority responsible for organization and management of health care services in Poland – is an entrepreneur in the meaning of the Polish law (act on competition and consumer protection). The aim of this article is to answer the question whether competition rules should be applied to the state activity in the imperium sphere. This article will focus on the notion of an entrepreneur (undertaking) in polish and EU law in the context of the activity of the state.

Opis:
Health care facility (In Polish ZOZ) is a basic, yet complex organizational and legal model within which, health service can be provided to patients in Poland. In the light of law ZOZ can receive funds from paid health benefits obtainable on the basis of bilateral agreement. Those contracts include agreement for the provision of health care service concluded between the service provider and the director of provincial department of National Health Fund (In Polish NFZ), commonly known as a contract. The subject of this paper is to present current legal basis and the rules for entering into agreement with National Health Fund by public and private health care facilities. The aim of this article is to attract the attention to the role of contract with NFZ as of the basic source of financing health care facilities and also to explain methods of financing health services awarded on the basis of contract.

Objective. The aim of the study was an assessment of direct costs of patients hospitalised for for skin adverse drug reactions during 2002–2012 in the Department of Dermatology at the Military Institute of Medicine (Ministry of Defence) in Warsaw. The analysis was carried out from the perspectives of the public payer and service provider. Materials and method. The retrospective study was carried out in a group of 164 adult patients due to skin adverse drug reactions. Analysis was based on data from patient medical records and medical orders which provided information on the used resources, including diagnostic tests, medical consultations, medicinal products, hospitalisation duration, together with cost estimation, regardless of the treatment being the cause of the skin reaction. Results. According to the International Statistical Classification of Diseases and Related Health Problems(ICD) diagnosis and scores, assigned by the National Healthcare Fund, it has been estimated that patient hospitalisation at the Department of Dermatology for skin drug reaction incurred costs at the average amount of €717.00 per patient. The complex diagnostics and pharmacotherapy of the same group of patients generated costs for the hospital at the average amount of €680 per patient. Conclusions. As a result of the analysis, the therapy for skin adverse drug effects generates significant costs, both for the payer and the service provider. Since the costs are comparable, it seems that the pricing of medical procedures by the public payer is adequate for the costs incurred by the medical service provider.

The share of privately paid medical care is steadily increasing. Polish patients pay immediately for single services and may also privately conclude the contracts for medical insurance or subscription (steady access to complex private medical care). The aim of this paper is to draw the reader's attention to the possibilities a Polish patient has of obtaining complex private medical care. The paper describes the range of services which are guaranteed for all patients insured by National Health Fund (financed from public resources) and contracts of private health insurance and medical subscription.

This paper addresses the question of distribution of support from the EU budget and the national budget to agricultural holders in Mazovia region in comparison with Poland as a whole. In the first main section, the characteristics of the agricultural sector in the region, using main sectoral indicators, is presented. The second section illustrates the agricultural and rural support under the Rural Development Program and the Sectoral Operational Program “Restructuring and modernization of agriculture and rural development” provided to Mazovian beneficiaries with reference to this support at whole country level. Empirical analyses are based on Eurostat statistics as well as on data obtained from the Agency for Restructuring and Modernization of Agriculture and the Ministry of Agriculture and Rural Development. Results of the study show that the Mazovian province, which is a region that can be placed in front of agricultural development, was awarded over the period 2004-2007 a relatively high level of support and ranked first or second among all 16 provinces according to selected measures.

The protection of individuals regarding to the processing of personal data is one of the fundamental rights. The General Data Protection Regulation (GDPR) lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data. Data concerning health is one of the areas the GDPR defines as special personal data, the so-called sensitive data. With regard to these data, the GDPR allows their processing only on an exceptional basis, in certain situations. According to Art. 6 sec. 1 let. e GDPR and art. 9 sec. 2 let. b GDPR, data processing is allowed, inter alia, when such processing is necessary for the purposes of meeting the obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law. In turn, Art. 9 sec. 2 let. h GDPR permits the processing of health data that is necessary for the purposes of providing health or social care or treatment, or for managing health or social care systems and services on the basis of European Union or Member State law. The article discusses the national legal regulations regarding the collection and processing of personal data concerning health in the light of the organization of the health care system and the tasks of the National Health Fund (NFZ) as a placeholder, whose task is only to manage financial resources and conclude health care contracts on its own behalf with independent healthcare providers and their accounting. Against the background of the GDPR, the author discusses the provisions of the acts on health care services financed from public funds and on the information system in health care. Finally, specific regulation regarding the COVID-19 pandemic are presented.

This article focuses on the analysis of the legal and financial framework in which the National Health Fund functions in Poland. It has been confirmed that the Polish health care system is a structurally and relationally complicated entity and that the public authorities are responsible for the health security of citizens. Public tasks in this area are implemented through the use of strategic documents. The National Health Fund plays a key role in this field. However, it does not exercise a coordinating role, and still, it has an actual impact on the state of health security in Poland. Consideration should be given to the changes of contracting procedures proposed by scientists and practitioners, bearing in mind that simply increasing the amount of funding will not automatically improve the current situation without the drive towards more efficient spending of public funds. The main objective of this article is to analyse the existing contradiction in the Polish health care system, which comes down to the dilemma: how to reconcile patient’s welfare with the economic efficiency of public health care providers. The undertaken research problem has been reflected in the selection of research methods. For the purposes of this article, the following research methods have been used: critical analysis, the examination of documents, and observation. The undertaking of considerations was preceded by a preliminary survey of publications related to security and health sciences as well as management and social policy. A lot of articles, binding legal acts, internal legal acts, judicial decisions, official documents that are significant for the reasoning process presented in the article have been insightfully analyzed. In this area, a comparative analysis has proved to be particularly helpful. 
W niniejszym opracowaniu dokonano analizy ram prawnych i finansowych funkcjonowania Narodowego Funduszu Zdrowia. Potwierdzono, że system ochrony zdrowiaw Polsce jest strukturalnie i relacyjnie tworem skomplikowanym, zaś władze publiczne odpowiadają za zapewnienie bezpieczeństwa zdrowotnego swoich obywateli. Zadania publiczne w tym obszarze wdrażane są przez realizację dokumentów strategicznych. Kluczową rolę w tym zakresie odgrywa Narodowy Fundusz Zdrowia. Nie pełni on funkcji koordynujących, ale realnie wpływa na stan bezpieczeństwa zdrowotnego w Polsce. Należy rozważyć postulowane przez naukowców i praktyków zmiany procedury kontraktowania, uwzględniając fakt, że proste zwiększenie strumienia finansowania, bez działań zwiększających efektywność wydatkowania środków publicznych, automatycznie nie poprawi aktualnego stanu rzeczy. Głównym celem artykułu jest analiza sprzeczności występującej w polskim systemie opieki zdrowotnej, która sprowadza się do następującego dylematu: jak pogodzić dobro pacjenta z ekonomiczną efektywnością publicznych placówek ochrony zdrowia. Na potrzeby niniejszego artykułu wykorzystano następujące metody badawcze: analiza krytyczna, badanie dokumentów oraz obserwacja. Podjęcie rozważań zostało poprzedzone kwerendą publikacji z zakresu nauk o bezpieczeństwie, nauk o zdrowiu, jak również zarządzania oraz polityki społecznej. Gruntownie przeanalizowano liczne artykuły naukowe, obowiązujące akty prawne, orzeczenia sądowe oraz inne oficjalne dokumenty, które miały znaczenie dla toku rozumowania zaprezentowanego w publikacji. W odniesieniu do zagadnień poruszanych w artykule szczególnie użyteczna okazała się analiza porównawcza.

Employment is very important for every human being, but especially for people with disabilities. Employment gives people with disabilities an opportunity to regain self-confidence and make them feel needed and appreciated. Despite the improvement on the Polish labor market, people with disabilities have difficulties with accessing it. Local authorities implemented several programmes addressed to people with disabilities and employers, financed by the National Disabled Persons Rehabilitation Fund to make employment more accessible. Unfortunately, only a small percentage of people with disabilities benefited from these programs in 2010–2020. Both central and local authorities should take more measures to increase the number of people with disabilities in the labour force. First of all, they should generate optimal regulations and transparent procedures to encourage them to enter the labour market.

W niniejszym artykule zaprezentowano sposób ujęcia efektywności płatnika trzeciej strony. Jednocześnie dokonano charakterystyki Narodowego Funduszu Zdrowia oraz zaprezentowano przykładowe obszary konkurencji w relacji płatnikświadczeniodawca i płatnikświadczeniobiorca. Autor z dużą rezerwą pochodzi do wprowadzenia konkurencji w obszarze ceny za świadczenia opieki zdrowotnej. Stąd też nie udziela w tym zakresie jednoznacznych odpowiedzi, a co najwyżej sygnalizuje pewne wątpliwości i zadaje pytania. Natomiast jest przekonany co do istnienia przesłanek dających możliwość zwiększenia potencjału Narodowego Funduszu Zdrowia. Dlatego za konieczne uznaje podjęcie działań mających na celu identyfikację dysfunkcji i zaprojektowanie stosowanych zmian zarówno na poziomie instytucji, jak i w otoczeniu. W tym zakresie proponuje dokonać przeglądu rozwiązań będących propozycją zmian w zakresie funkcjonowania płatnika.
The paper presents a␣form of analyzing the efficiency of the third party payer. The analysis includes the characteristics of the National Healthcare Fund and presentation of examples of the areas of competition in the following relations: payer - he healthcare provider and payer – beneficiary (patient). The idea of introducing price competition in the area of healthcare provision is treated rather cautiously. Hence no unequivocal answers are given. Certain doubts are highlighted and seve- ral questions are asked. It is specifically suggested that there exist prerequisites for increasing the potential of the National Healthcare Fund. Thus it is vital to undertake actions aimed at identification of dysfunctions and formulation of relevant changes both at the level of the institution as well as in its environment. Potential solutions concerning changes in the functioning of the payer have to be reviewed.

Public special purpose funds are of a significant importance for the economy. Both National Health Fund and Social Insurance Fund play a particular role. Because of the fact that the financial policy of state special purpose funds is not a subject of strict rules characteristic for the principles of state budget, it is especially important to evaluate its efficiency and effectiveness. The article presents results of a study on the effectiveness of the financial policy of NHF Region Branch Offices, understood as relation between expenditure and outcome.
Publiczne fundusze celowe mają istotne znaczenie dla gospodarki. Szczególną rolę pełnią te związane z różnymi formami ubezpieczeniowymi – Fundusz Ubezpieczeń Społecznych oraz Narodowy Fundusz Zdrowia. Z uwagi na fakt, iż gospodarka finansowa państwowych funduszy celowych nie podlega rygorom charakterystycznym dla gospodarki budżetowej, szczególnego znaczenia nabiera ocena jej skuteczności i efektywności. W artykule zaprezentowano wyniki badań efektywności Oddziałów Wojewódzkich NFZ, rozumianej jako relacja między osiągniętymi wynikami a wykorzystanymi zasobami.

W artykule opisano przemiany własnościowe realizowane w Polsce w latach 1990-2015. Wskazano trudności, na jakie natrafiono podczas tego procesu. Na potrzeby przemian, a w szczególności dla zawartego w nich procesu prywatyzacji przyjęto wiele ustaw i innych aktów prawnych. Prywatyzacji podlegał cały majątek państwowy w liczbie ok. 8,5 tys. przedsiębiorstw zarejestrowanych na dzień 31 grudnia 1990 r. Działania prywatyzacyjne były prowadzone na wiele sposobów i różnymi trybami. Tworzone były specjalne programy prywatyzacyjne dla różnych przedsiębiorstw. Jednym z istotnych był Program Powszechnej Prywatyzacji, obejmujący tzw. Narodowe Fundusze Inwestycyjne (NFI). Były tu zgromadzone przeważnie przedsiębiorstwa małe i średnie. Przedsiębiorstwa sprywatyzowane według tego programu trafiły w większości do polskich przedsiębiorców, tworząc na rynku polskim nowy segment gospodarki rynkowej opartej na polskim kapitale prywatnym. Duże przedsiębiorstwa trafiały jednak do inwestorów zagranicznych, dysponujących dużym kapitałem.
The article describes ownership changes carried out in Poland in years 1990-2015. Indicated on difficulties fund during mentioned process. For the purpose of changes, particulary for the included privatization process, several laws were adopted and other legal acts as well. Privatisation was a subject to whole companies assets in the number of 8,5 thousands companies registered on date of December, 31st 1990. Privatisation action were carried out in different ways, procedures and methods. Special new programmes were constructed for different types of companies. One of such significant programmes was General Programme for Privatisation, covering among the others co called National Investment Founds (NFI). In such Founds mosty small and medium companies were gathered. Companies privatised according to this programme in majority went to Polish businessmen creating in this way new segment of market economy based on private capital. Big companies however, went to foreign investors with huge capital in hand.

Opis:
The aim of this study is to determine the character of financial resources devoted to public purposes referred to in Art. 216(1) of the Polish Constitution as seen in legal measures adopted in selected national special purpose funds. The constitutionally values protected in this provision also was analized. The legal solutions adopted in selected national special purpose funds and funds for public purposes related to them will serve as an example. Directions of the evolution seen in the Polish legal order encourage a discussion of whether resources coming from sanctions may (or should) be a basic source of proceeds of these funds. The method of investigation of the law in force and a legal analysis are used in this study. A reference to decisions of the Constitutional Tribunal and of the Supreme Administrative Court was also necessary.
Celem artykułu jest ustalenie zakresu środków finansowych na cele publiczne, o których stanowi art. 216 ust. 1 Konstytucji RP i wartości konstytucyjnie chronionych w tym przepisie. Za przykład będą służyły rozwiązania prawne przyjęte w wybranych państwowych funduszach celowych i środki na cele publiczne z nimi związane. Dostrzegane w polskim porządku prawnym kierunki ewolucji skłaniają do rozważenia, czy podstawowym źródłem wpływów tych funduszy, z którego są finansowane zadania publiczne, mogą być (powinny być) pieniężne środki o charakterze sankcyjnym. W opracowaniu wykorzystano metodę dogmatycznoprawną oraz analizy prawnej. Niezbędne było również odniesienie się do orzeczeń Trybunału Konstytucyjnego, NSA.

Określenie tendencji badanego zjawiska ekonomicznego odgrywa niezwykle ważną rolę w podejmowaniu decyzji dotyczących zarządzania ochroną zdrowia i kreowania polityki zdrowotnej. Zatem celem artykułu jest przeprowadzenie regionalnych analiz wydatków publicznych na opiekę medyczną w województwach Polski. W artykule podjęto próbę określenia tendencji krótkoi długookresowej dla województw oraz zależności wydatków publicznych, m.in. od przychodów Narodowego Funduszu Zdrowia czy PKB dla województw. Badanie przeprowadzono na danych rocznych dla lat 2004-2014. Dane pochodzą z publikacji NZF-u i GUS-u.
The identification of trends of the examined economic phenomenon plays a major role in taking decisions concerning health service management and the creation of health care policy. Therefore, the aim of this paper is to carry out regional analysis of public expenditure on health care in the Polish voivodeships - the study attempts to determine the short-term and longterm tendencies for voivodeships and dependence of public expenses on health care among others on revenues of the National Health Fund from contributions to health insurance or the GDP for the voivodeships. The study was conducted on annual data for the years 2004-2014. The data come from the NHF and the CSO.
