While a system-theoretic approach to the safety analysis of innovative socio-technical systems gains a growing acceptance among academia, safety issues of Maritime Autonomous Surface Ships (MASS) remain largely unexplored. Therefore, we applied a System-Theoretic Process Analysis to develop and analyze a preliminary model of the unmanned shipping system in order to elaborate safety recommendations for future developers of the actual system. Results indicate that certain advancements shall be undertaken in relation to MASS’ software solutions in particular.

The law of general average is one of the oldest institutions in maritime law, which is still applicable in contemporary shipping. Although the role and function of general average have naturally changed throughout centuries of its history (the main reasons therefor being the popularization of maritime insurance, which evolved much later than the general average) and general average has been and is subject to criticism pointing to its anachronistic nature and redundancy in today’s maritime economic realities. However practice shows that general average continues to resist these accusations and is commonly used in the practice of maritime commercial trade. This article deals with the issue of general average in light of Polish maritime law regulations, the essence and specificity of these legislative solutions concerning the safety of shipping in Poland, and also gives examples of events that occurred at sea that permit the announcement of an act of the general average. This article also presents considerations with regard to arguments in favour of maintaining the institution of general average as a legal instrument used in shipping, as well as critical voices emphasizing the need to eliminate general average as an institution of maritime law aimed at distributing losses, incurred to avoid a common peril, to the participants of a maritime adventure.

Opis:
Implementation of ERIKA III, the third package of EU legislation intended to integrate international standards of marine accident investigation, has significantly changed the way Polish public authorities investigate marine accidents. Until the implementation, maritime chambers conducted the investigation of marine accidents. Since October 2012 there has been a dual system in place whereby public authorities are entitled to investigate marine accidents in Poland. This article reviews distinctive features of both approaches and the impact thereof on the system of investigating marine accidents. Beside a theoretical description of the legal basis for the functioning of both maritime chambers and the State Marine Accident Investigation Commission, this paper includes analytic data of investigations conducted by both these bodies in order to prove that the number of investigations conducted by maritime chambers has drastically decreased since the establishment of the State Commission, and that the number of investigations conducted by the State Commission itself cannot be sufficient, leading to a decrease of safety in maritime navigation.

W artykule został przeanalizowany organizacyjno-prawny system zapewnienia bezpieczeństwa pracy marynarzy. Pokazano przyczyny wypadkowości w transporcie morskim oraz z identyfikowano czynniki ryzyka utraty życia lub zdrowia marynarzy podczas pracy na morzu. Szczególną uwagę poświęcono przyczynom popełnienia błędów przez członków załóg statków. Stwierdzono, że nowa konwencja o pracy na morzu przyczyni się do podwyższenia poziomu bezpieczeństwa pracy marynarzy.
This article examines the organizational and legal system of seafarers' safety. It discusses the causes of accidents and identifies risk factors for the loss of seafarers’ life or health at sea. The article pays special attention to the causes of the crew's errors. The conclusion is that the new Maritime Labour Convention contributes to an increase in the level of seafarers' safety.

The ship's master has a number of duties in relation to the ship, the cargo and the shipowner's liability. His duties in the event of a marine accident are particularly important since all marine accidents occur as a type of insured loss. In addition to a number of general duties, some of the master's special duties are informing the classification society about the accident, damage report, cooperation with the insurer's expert and informing the P&I club about the accident. The content of the master's duties is the subject of analysis of this paper. Therefore, the goal of the paper is to analyse the content of the master's duties in the event of an accident that could result in damage, i.e. the occurrence of the insured event. The purpose of this analysis is to point out the important role of the master in the subject of maritime insurance.

4M Overturned Pyramid (MOP) model is a new model, proposed by authors, to characterized MTS which is adopting epidemiological model that determines causes of accidents, including not only active failures but also latent failures and barriers. This model is still being developed. One of utilization of MOP model is characterizing accidents in MTS, i.e. collision in Indonesia and Japan that is written in this paper. The aim of this paper is to show the characteristics of ship collision accidents that occur both in Indonesian and Japanese maritime traffic systems. There were 22 collision cases in 2008–2012 (8 cases in Indonesia and 14 cases in Japan). The characteristics presented in this paper show failure events at every stage of the three accident development stages (the beginning of an accident, the accident itself, and the evacuation process).

Error is a part of human. Despite that organizations are trying to reduce error to the zero level, this goal is unachievable. As far as human operation is taking place in a complicated environment, error will occurred, and its possibility would be increased under the conditions of stress, extra loading work, and fatigue. One of the most important transportation modes is marine transportations. The sea is an unsafe place that kills many by a simple event. Every year there are thousands of marine accidents that result in injuries, casualties, marine pollutions and also massive financial loss. To reduce the accidents, there should be more attention to the factors such as suitable training of human resource, proper implementation of national and international laws and regulations, vessels and the equipment on board them, port facilities, and also the utilities for marine search and rescue. In this research 1816 marine accidents have been studied in five Iranian shipping companies. 17 factors are known to be effective in occurrence of human error in these accidents. Four factors of the most influence are negligence, poor training, inadequate tools, and lack of skill and experience.

Sea accidents are aimed to be prevented with an extensive amount of maritime safety regulation. The purpose of this paper is to present the findings of a questionnaire study that was targeted at Finnish maritime experts and addressed the question: how to prevent an oil accident in the Gulf of Finland. This study also includes a literature study about the problems of the current maritime safety regime. The findings of the questionnaire study are compared to the findings of the literature study. The questionnaire study showed that many kinds of policies have improved maritime safety, and they are needed to ensure maritime safety. For instance, ship construction, fairway maintenance, nautical charts and rules of the road at sea can be considered the cornerstones of maritime safety. However, the results ranked voluntary activities of companies as the most effective way to improve maritime safety in the future. Self-regulative approaches could solve some problems connected to more traditional policy-making.

The Strait of Istanbul, 17 nautical miles long, is one of the main routes of international maritime trade. Connecting the Black Sea countries with other countries of the world, the Strait is the second busiest waterway in the world in terms of international ship traffic. In addition to busy sea traffic, limited geographical conditions also make it difficult to navigational safety. The Strait of Istanbul is the only chokepoint that stands out with the risk of maritime accidents on the primary routes of world maritime trade. This situation poses a risk for both the transiting ships and the city of Istanbul, which has a dense population around it. Some of the accidents that took place in the recent history have caused worldwide concern due to the environmental pollution they cause. Considering the advantages provided by the developing shipbuilding technology and today load capacity of the ships, a disaster that will occur in a possible accident today will cause much greater destruction than in the past. In this direction, it has become a necessity to examine the accident profile in the strait in order to develop effective accident prevention measures and to strengthen the level of navigational safety in the region. In this study, maritime accidents that occurred in the Strait of Istanbul over a 16-year period were discussed in terms of their types and the response time of tugboats to a possible accident was examined.

Marine accidents are caused by complex and diverse causes. Therefore, it is necessary to analyse accidents from the perspective of the whole system rather than the existing analysis models that focus on cause-effect. The STAMP analysis is a constraint-based model that focuses on improper management or enforcement of safety-related constraints in system operation. Thus, as a case study of the application of the STAMP technique in marine accident analysis, the Milano Bridge pier contact accident that occurred on April 6, 2020 in Busan New Port of South Korea was analysed by the STAMP technique in this study. Through this study, it was proposed to break away from the domestic accident investigation, which focused only on the punishment of the ship operator, and to suggest improvements that enable organizations related to the marine accidents to take initiative to take efforts for safety.

The purpose and scope of this paper is to present the demand of Polish waters for the boat MoB MEDS the Mobile Base of the Marine Emergency Diving Service, which would enable necessary underwater works (repairs and inspections) for ships requiring immediate assistance. The MoB MEDS boat could also protect sensitive sea areas against potential oil and / or chemical spills from the ship, which could seriously threaten the safety of human life, the safety of navigation and the protection of the natural environment with its unique ecological values. Mentioned demand is supported by the analysis of selected statistical data on maritime accidents in Polish waters and planned maritime investments.

A paradigm shift is presently underway in the shipping industry promising safer, greener and more efficient ship traffic. In this article, we will look at some of the accidents from conventional shipping and see if they could have been avoided with autonomous ship technology. A hypothesis of increased safety is often brought forward, and we know from various studies that the number of maritime accidents that involves what is called “human error” ranges from some 60‐90 percent. If we replace the human with automation, can we then reduce the number of accidents? On the other hand, is there a possibility for new types of accidents to appear? What about the accidents that are today averted by the crew? This paper will present a method to assess these different aspects of the risk scenarios in light of the specific capabilities and constraints of autonomous ships.

Transport and handling of hazardous chemicals and chemical products around the world’s waters and ports have considerably increased over the last 20 years. Thus, the risk of major pollution accidents has also increased. Past incidents/accidents are, when reported in detail, first hand sources of information on what may happen again. This paper provides an overview of the past tanker accidents in the Baltic Sea and chemical related accidents in seas worldwide. The aim is to find out what can be learned from past accidents, especially from the environmental point of view. The study is carried out as a literature review and as a statistical review. The study revealed that the risk of a chemical accident is highest in seas where the highest tonnes of chemicals are transported, the density of maritime traffic is highest and, of course, in the ship-shore interface where unloading/loading takes place. Incidents involving chemical spills are statistically much less likely to occur than oil spills. However, chemical cargoes can be more dangerous to humans and property because chemicals can be more combustible, poisonous, irritating and reactive. The most important difference between a chemical and an oil spill may be related to response actions. In case of a chemical accident, the air quality or the risk of explosion should be more carefully evaluated before any response actions are taken. In case of chemical spills, the response is more limited in comparison to oil. Actually, very little is known about the actual marine pollution effect of most of highly transported substances. From the environmental point of view, the previous studies have highlighted accidents in which pesticides were released to water, but also substances considered as non-pollutants (vegetable oils) seem to have a negative effect on biota in the water environment.

In the paper the issue of maritime safety is presented. Most of the modern world trade is carried by sea, where maritime safety plays a key role. The article also presents the analysis of marine casualties at the beginning of the 21st century, covering the years 2002–2015. Apparent systematic steady decline in accidents and total losses of vessels is the result of improved maritime safety.
W artykule została przedstawiona problematyka bezpieczeństwa morskiego. Współczesna światowa wymiana handlowa odbywa się w znaczącym procencie drogą morską, gdzie bezpieczeństwo morskie ma kluczowe znaczenie. W pracy dokonana została analiza wypadków morskich początku XXI wieku obejmująca lata 2002–2015. Przyjmuje się, że widoczny systematyczny spadek liczby wypadków morskich oraz całkowitych strat jednostek pływających to wpływ poprawy warunków bezpieczeństwa morskiego.

Due to the unique geographic location, complex navigation environment and intense vessel traffic, a considerable number of maritime accidents occurred in estuarine waters during recent years which caused serious loss of life, property and environmental contamination. Based on the historical data of maritime accidents from 2003 to 2012, which is collected from Shenzhen Maritime Safety Administration, this paper conducted a risk analysis of maritime accidents by applying Bayesian network and fault tree analysis. First a Bayesian network model was introduced to describe the consequence of accidents based on the accident investigation report. Then fault tree analysis was applied to estimate the probability on the basis of accident statistics and ship traffic flow. Finally the risk of maritime accidents in Shenzhen Waters was depicted through the consequence multiplied by the probability of an accident.
