Opis:
The issues raised in this article present the organization and the tasks of the commune authorities in the Polish and in the French legal system, indicating their decision-making and executive function. The regulations concerning the organization and the operation of the commune authorities, outlined on the basis of the statutory regulations and the internal regulations, the output of the doctrine and the jurisprudence of administrative courts, are intended to identify the elements common and specific to these bodies. Creating good relations between the community authorities is of fundamental importance for the efficient exercise of power at the local level, hence the present issues are deemed crucial. De lege lata analysis of the research problems at hand will help to raise comments and postulates in the final assessment in respect of the relations between decision-making and executive authorities in the commune of both a personal as well as functional nature.
Problematyka poruszana w przedmiotowym artykule przedstawia organizację i zadania organów gminy w polskim oraz we francuskim porządku prawnym, wskazując na ich funkcję stanowiącą i wykonawczą. Unormowania dotyczące organizacji i działania organów gminy, nakreślone w oparciu o regulacje ustawowe oraz statutowe, dorobek doktryny, a także orzecznictwa sądowoadministracyjnego, mają na celu wskazanie elementów wspólnych dla tych organów oraz rozłącznych. Ułożenie dobrych relacji między organami gminy ma fundamentalne znaczenie w zakresie efektywnego wykonywania władzy na poziomie lokalnym, stąd ta problematyka jawi się jako istotna. Analiza de lege lata przedmiotowej problematyki badawczej pozwoli w ocenie końcowej na wysunięcie wniosków i postulatów dotyczących relacji między organami stanowiącymi i wykonawczymi w gminie zarówno o charakterze personalnym, jak i funkcjonalnym.

Przedmiot badań: Przedmiotem badań jest realizowana polityka podatkowa gmin i czynniki ją kształtujące. Badania zagraniczne potwierdziły, że podatki lokalne są zróżnicowane w zależności od wysokości lokalnej bazy podatkowej. Stąd też uwaga autorki koncentruje się głównie na rozpoznaniu zależności pomiędzy kondycją finansową jednostki samorządowej a przyjętą polityką podatkową władz gminnych. Cel badawczy: Celem artykułu jest ocena polityki podatkowej w poszczególnych typach gmin w zależności od sytuacji finansowej, na przykładzie województwa małopolskiego. Metoda badawcza: W artykule dokonano przeglądu literatury w zakresie lokalnej polityki podatkowej i czynników ją różnicujących. Zastosowano metodę unitaryzacji zerowanej służącą analizie danych pochodzących ze sprawozdań budżetowych JST. Wyniki: Analiza danych potwierdziła występowanie zależności pomiędzy kondycją finansową gminy i polityką podatkową władz lokalnych. Wyższe podatki zazwyczaj uchwalane były w gminach najbiedniejszych, prawdopodobnie zbyt biednych, by móc zrezygnować z części potencjalnych dochodów podatkowych. Wysokie podatki występowały również w jednostkach o najlepszej kondycji finansowej położonych w pobliżu aglomeracji krakowskiej, gdzie możliwości ponoszenia ciężarów podatkowych były wyższe.  
Background: The subject of the research is the implemented tax policy of communes and the factors that shape it. Foreign studies have confirmed that local taxes vary depending on the amount of the local tax base. Hence, the author’s attention is focused mainly on recognizing the relationship between the financial condition of a local government unit and the adopted tax policy of municipal authorities. Research purpose: The aim of the article is to analyze and evaluate the tax policy in individual types of communes, depending on the financial situation on the example of the Małopolskie Voivodeship. The author hypothesizes that the local tax policy of Polish municipal governments is determined by their financial condition. Methods: The article reviews the literature on local tax policy and its differentiating factors. The zero unitarization method was used to analyze data from the budgetary reports of local government units. Conclusions: The data analysis confirmed the relationship between a commune’s financial conditio and the local authorities’ tax policy. Higher taxes were usually enacted in the poorest communes, probably too poor to be able to give up some of the potential tax revenues. High taxes also occurred in the units with the best financial condition located near the Krakow agglomeration, where the possibility of bearing the tax burden was higher.

Autor wychodzi od zdefiniowania pojęć: „zbiorowość”, „społeczność”, „wspólnota lokalna”, „społeczność lokalna”, „władza lokalna”. W następnej kolejności definiuje procesy koncentracji i dekoncentracji oraz centralizacji i decentralizacji. Po tych rozważaniach koncentruje swoją uwagę na samorządzie terytorialnym i administracji rządowej w terenie oraz przytacza poglądy decydentów i opozycji na zjawisko dwuwładzy. Pierwsza część opracowania kończy się postawieniem pytań, na które należy poszukiwać odpowiedzi. W części drugiej Autor rekomenduje metodę analizy systemowej do badań lokalnych systemów. W trzystopniowej strukturze lokalności wyróżnia on system gminny jako nieredukowalny z punktu widzenia demokracji. Pozostałe dwa, czyli powiatowy i wojewódzki, winny być poddawane analizie, która rozstrzygnąć może o ich przydatności. W opracowaniu wyróżniono lokalny system społeczny, którego elementami są podsystemy: polityczny, ekonomiczny i kulturowy, lokalny system władztwa i lokalny system władzy. Wyodrębnienie systemu zależy od przyjętych celów badawczych. I tak, lokalny system społeczny bądź jego podsystemy są użyteczne do opisu, natomiast lokalne systemy władztwa czy władzy pomocne są przy badaniu funkcjonowania. Opracowanie kończy się wskazaniem kryteriów oceny lokalnego systemu władzy. Autor wyróżnia kryteria szczegółowe, takie jak wskaźniki partycypacji, decyzyjności, korupcji itd., oraz syntetyczne, polegające na pomiarze demokracji lokalnej czy rozwoju lokalnego społeczeństwa obywatelskiego.
The author begins with defining the basic notions: „collectivity”, “community”, “local community”, “local authority”. Next, he defines the processes of concentrating and de-concentrating as well as centralizing and decentralizing. In the further part, the author focuses on the local self-government and government administration locally as well as he shows the opinions formulated by the governing bodies and the opposition on the phenomenon of diarchy. The first part of the work is completed with a set of questions that need to be answered. The second part of the work, the author recommends the system analysis method in order to examine the local systems. In the three-level structure of population, he distinguishes the commune system as not reducible from the democratic point of view. The other two, i.e. district and regional ones should undergo the analysis that might settle the issue of their appropriability. In the article, the author identifies the local social system which has its subsystems: political, economic and cultural one, local dominion and system of local authority. The identification of the system depends on the adopted research aims. Thus, the local social system and its sub-systems are useful when it comes to description however the local systems of dominion or authority are useful when one examines their functionality. The work finishes with indication of the evaluation criteria of the local authority system. The author specifies the detailed criteria such as the criteria of participation, decisiveness, corruption, etc. and synthetic ones that enable to measure the local democracy or the development of local civic society.

Changes that occur on the local level can explain the processes on the population level and, at the same time, are the driving force of species adaptation. This manuscript reports data about genetic diversities of the fungus Schizophyllum commune on the level of a local population. Objects of the study were dicarious cultures of S. commune collected from 38 basidiocarps grown on the territory of Holosiivskyi National Nature Park, Lysa Hora Regional Landscape Park and Feofaniya forest parcel (Ukraine). Results showed similarity of genetic variability of S. commune in different local populations. The heterozygote deficiency of some loci that was discovered might have resulted from new forms of allozymes that have not become widespread or due to small population sizes. The degree of differentiation of genes between local studied populations was moderate due to the high flow of genes. The absence of spatial structuration of genotypes is established, and the Mantel test showed a lack of interconnection between the genetic component and the geographical coordinates of the samples. It has been suggested that wind direction and terrain are the factors that influence the genetic structure of local populations.

Opis:
The main purpose of the study was to assess the budget and financial balance, including financial stability and compare the situation of all communes and cities with county status, with particular emphasis on the situation of communes and cities with county status in the Lubelskie Voivodship. The choice of the Lubelskie Voivodship was deliberate and dictated by its low level of development expressed by a GDP per capita value significantly lower than the national average and much lower than the EU average (48% of the EU average) and poor financial potential. The time scope of the research was limited to 2018-2020, however, in 2020, current available data only covering Q3 was used. The main source of data was information obtained from the Ministry of Finance, Regional Audit Chamber and Local Data Bank GUS. An analysis and criticism of literature was carried out and selected research methods were used, including general methods, and quantitative methods of financial analysis (ratio analysis). The obtained results confirm that the situation of the budget balance and current balance of the surveyed units differs, while the value of the calculated ratios relating to financial balance, including financial stability, varied and these differences were revealed in the types of units and according to their number and location (all units of a given type – Poland or units of the Lubelskie Voivodship). Changes in the analysed values over time were also noted.
Głównym celem badań była ocena poziomu równowagi budżetowej i równowagi finansowej, w tym stabilności finansowej, a także porównanie sytuacji wszystkich gmin i miast na prawach powiatu ze szczególnym uwzględnieniem sytuacji gmin i miast na prawach powiatu województwa lubelskiego. Wybór województwa lubelskiego był celowy i podyktowany niskim poziomem rozwoju wyrażonym wartością PKB per capita, istotnie niższą niż średnia w kraju i znacznie niższą niż średnia w UE (48% średniej UE) oraz jego słabym potencjałem finansowym. Zakres czasowy badań ograniczono do lat 2018-2020, z tym że w 2020 roku dostępne były jedynie dane za III kwartał. Główne źródło danych stanowiły informacje pozyskane z Ministerstwa Finansów, Regionalnej Izby Obrachunkowej i Banku Danych Lokalnych GUS. Przeprowadzono analizę i krytykę piśmiennictwa oraz posłużono się wybranymi metodami badawczymi: metodami ogólnymi, metodą porównań, a także ilościowymi metodami analizy finansowej (analiza wskaźnikowa). Uzyskane wyniki potwierdziły, że sytuacja równowagi budżetowej, w tym równowagi bieżącej badanych jednostek, różni się. Natomiast wartość policzonych wskaźników odnoszących się do równowagi finansowej, w tym stabilności finansowej, była zróżnicowana i były to różnice ujawnione w różnych typach jednostek oraz według ich liczebności i położenia (wszystkie jednostki danego typu – Polska lub jednostki województwa lubelskiego). Odnotowano także zmiany analizowanych wartości w czasie.

In accordance with the Electoral Code a person employed as a secretary or a treasurer of a commune (district, voivodeship) has a right to stand for election for a head of commune, a mayor and a president of the city. However, combining the function of a secretary or a treasurer with the post of the head of commune, the mayor or the president of the city in a single or in different local self-government units is inadmissible Self-local government officials employed on official posts are restricted, during a potential election campaign, by their labour duties, in particular they are not allowed to undertake activities “causing reasonable suspicion of partiality or acting in self-interest” as well as they cannot disclose information constituting a statutorily protected secret learned with in connection with the performed professional duties.

Wraz z wejściem w życie przepisów ustawy z dnia 11 stycznia 2018 r. o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych, przewodniczący rady gminy otrzymał nowe kompetencje. Kompetencje przewodniczącego rady gminy do wydawania poleceń służbowych pracownikom urzędu gminy ograniczają się do jego zadań związanych z organizacją pracy rady gminy, nie obejmując aktywności przewodniczącego organu stanowiącego i kontrolnego jako radnego. Przewodniczący rady gminy jest uprawniony wydawać polecenia służbowe pracownikom urzędu gminy wykonującym zadania organizacyjne, prawne oraz inne zadania związane z funkcjonowaniem organu stanowiącego, komisji i radnych. Zawarte w gminnej ustawie samorządowej sformułowanie, że przewodniczący rady gminy wykonuje uprawnienia zwierzchnika służbowego w stosunku do pracownika urzędu gminy należy odczytać w sposób ścisły, uwzględniając regulację art. 21a u.s.g.
With the entry into force of the provisions of the Law of 11 January 2018 on amending certain laws to increase the participation of citizens in the process of election, operation and control of certain public bodies, the chairman of the municipal council received new powers. The competence of the chairman of the municipal council to give official instructions to the employees of the municipal office is limited to his tasks related to the organization of the work of the municipal council, not including the activity of the chairman of the establishing and controlling body as a councillor. The chairman of the municipal council is entitled to give official instructions to the employees of the municipal office performing organizational, legal and other tasks related to the functioning of the governing body, committees and councillors. The wording contained in the Municipal Self-Government Act that the chairman of the municipal council exercises the powers of an official superior in relation to the municipal office employee should be read strictly, taking into account the provisions of Article 21a of the Municipal Act.

Artykuł porusza problematykę regulacji art. 15r1 tarczy antykryzysowej uchwalonego ustawą o dopłatach do oprocentowania kredytów bankowych udzielanych przedsiębiorcom dotkniętym skutkami Covid-19 oraz o uproszczonym postępowaniu o zatwierdzenie układu w związku z wystąpieniem Covid-19, który wprowadza do umów o zamówienie publiczne, ograniczenie uprawnień zamawiającego w związku z SARS-CoV-2 i stanowi, że w okresie obowiązywania stanu zagrożenia epidemicznego albo stanu epidemii ogłoszonego w związku z COVID-19, i przez 90 dni od dnia odwołania stanu, który obowiązywał jako ostatni, zamawiający nie może potrącić kary umownej zastrzeżonej na wypadek niewykonania lub nienależytego wykonania umowy o zamówienie publiczne z wynagrodzenia wykonawcy lub z innych jego wierzytelności, a także nie może dochodzić zaspokojenia z zabezpieczenia należytego wykonania tej umowy, o ile zdarzenie, w związku z którym zastrzeżono tę karę, nastąpiło w okresie obowiązywania stanu zagrożenia epidemicznego albo stanu epidemii. Ustawa zmieniająca weszła w życie z dniem 24 czerwca 2020 r.
The article discusses the regulation of Article 15r1 of the anti-crisis shield established by the Act on interest rate subsidies for bank loans granted to businesses affected by Covid-19 and on simplified proceedings for approval of the arrangement in connection with the occurrence of Covid-19, which introduces into public procurement contracts, a limitation of the contracting authority’s rights in connection with SARS-CoV-2 and provides that during the period in which the state of epidemic emergency or state of epidemic declared in connection with COVID-19 is in force, and for 90 days from the date of revocation of the state that was last in force, the contracting authority may not withhold the contractual penalty reserved in the event of non-performance or improper performance of the public procurement contract from the contractor’s remuneration or from his other receivables, and may not seek satisfaction from the security for due performance of that contract, provided that the event in connection with which the penalty was reserved occurred during the period in which the state of epidemic emergency or state of epidemic was in force. The amendment Act entered into force on 24 June 2020.

Celem działania administracji samorządowej, a zatem celem działania każdej z jednostek samorządu terytorialnego, jest wykonywanie zadań publicznych o znaczeniu lokalnym, których realizacja wiąże się każdorazowo z zaspokajaniem bieżących, ciągłych potrzeb wspólnot samorządowych. Najwięcej zadań związanych z zaspokajaniem potrzeb publicznych ma do wykonania gmina jako podstawowa jednostka samorządu terytorialnego. Ustawodawca dał temu wyraz w treści art. 6 ustawy z dnia 8 marca 1990 r. o samorządzie gminnym, stanowiąc, że do zakresu działania gminy należą wszystkie sprawy publiczne o znaczeniu lokalnym, niezastrzeżone ustawami na rzecz innych podmiotów. Dodatkowo, jeżeli ustawy nie stanowią inaczej, rozstrzyganie w tych sprawach należy do gminy. Z reguły wykonywanie zadań odbywa się własnymi „środkami i siłami” danej gminy. Ustawodawca przewidział jednak możliwość współpracy i współdziałania gmin, czemu służy powoływanie związków międzygminnych, o czym stanowi art. 64 ustawy o samorządzie gminnym. Formą uzewnętrznienia działalności związku międzygminnego jest podejmowanie uchwał przez zgromadzenie związku międzygminnego. W opracowaniu analizie poddano również tryby umożliwiające zaskarżanie uchwał zgromadzenia związku.
The objective of local government administration, and therefore the objective of each local government unit is to perform public tasks of local importance, the implementation of which is each time connected with meeting the current, continuous needs of local communities. Most of the tasks connected with satisfying public needs are to be performed by the commune as the basic local government unit. The legislator expressed it in the content of Art. 6 of the Act of 8 March 1990 on Local Government, stating that the scope of a municipality’s activity includes all public matters of local importance, not reserved by the Acts for the benefit of other entities, additionally, unless the Acts provide otherwise, it is up to the municipality to resolve these matters. As a rule, the tasks are performed by the municipality’s own “means and forces”. However, the legislator has provided for the possibility of cooperation and collaboration between the municipalities, which is facilitated by the establishment of inter-municipal associations, as stipulated in Art. 64 of the Act on Local Government. A form of externalisation of the activity of an inter-municipal association is the adoption of resolutions by the assembly of an inter-municipal association. The study also analyzes the modes of appealing against the association’s assembly’s resolutions.

Przedmiotem rozważań w niniejszym artykule jest przedstawienie istoty ekonomii społecznej, idei powoływania przedsiębiorstw społecznych, a także zilustrowania problemu wynikami badań, zarówno dotyczącymi opinii społecznej mieszkańców analizowanej gminy, jak i samych pracowników funkcjonujących konkretnych przedsiębiorstw społecznych.
Social economy is an economic activity that sets itself social (I) and economic (II) goals. Social goals mainly include counteracting social exclusion, mitigating unemployment or combating various pathologies. Social enterprises, among others, serve these purposes. The subject of reflection in this article is the presentation of the essence of the social economy, the idea of establishing social enterprises, as well as illustrating the problem of research results both concerning the social opinion of the inhabitants in the analyzed commune, as well as the employees of specific social enterprises.

Opis:
The aim of the article is an attempt to define the basic elements of the administrative and legal concept of “village”. For many years, rural issues have been a significant subject of local government legislation. Hence the administrative and legal essence of the village is complex. A village can be either a municipality or only a town with certain administrative boundaries. The specific nature of the village is also reflected in the general population, which can be considered as local community with its own needs and interests, as well as certain powers. This community can be included in the framework of the auxiliary self-government and support the municipality in performing public tasks.

Opis:
The main purpose of this article was to present, the functioning of the self-government of the Galician village by the example of the commune Brzezowa. The many issues related to the activities of local authorities have been analyzed: the practice of granting the right of belonging to a commune (“Heimathrecht”), ensuring the safety of residents, educational policies as well as maintenance of local roads. The source basis was the Book of Protocols of the Commune Council in Brzezowa for the years 1904–1934. In addition, research has been carried out at the National Archives in Kraków and at the Parish Archives in Dobczyce.  The legal acts constituting the basis for the functioning of the city authorities could not be omitted. It was therefore possible not only to recreate the activities of local authorities, but also to show many aspects of the life of the inhabitants of this Galician vilage.
