    The author examines the language of the law. She refers to the contemporary acts; the legal regulations are the subject of her description. The author analyses legal cases which have been interpreted on the basis of the regulations. She discusses a modal dimension of the relationships which create legal cases and also makes closer characteristics of the participants of actions who are connected with these relationships. Language exponents of individual relations are presented. In order to emphasise specific character of legal material, the author precedes each description by indicating the peculiarities of modal dependence which are visible in sentences containing the so-called basic modal units. These sentences stem from other than legal modern Polish texts.

    The text is about modality from a linguistic point of view. The author takes a broad understanding of a modal category (modality indentified with communicative intention) and analyses the so called basic modal units: verbs and predicates, which together with an infinitive create a verbal construction. She examines a function of the mentioned expressions in the Code of Canon Law. Willing to accept a specific character of contexts with modal expressions, she includes in the description conclusions coming from earlier study of newspaper texts, homilies and speeches of John Paul II.

    Temat pracy wybrano, ponieważ cechy języka prawa nie zostały jeszcze opisane we wskazanej parze językowej. Celem pracy jest omówienie tych cech w japońskim i polskim języku prawnym i prawniczym. Autorki przedstawiają cechy języka prawa, posługując się definicjami i przykładami z polskiej i japońskiej ustawy o prawie autorskim i przykładami terminologii narodowej czy sądowej. Owe ustawy, jak i terminologia są zarazem materiałem badawczym. Metoda badawcza, która została obrana, opiera się na obserwacji empirycznej wskazanego materiału badawczego. Autorki skupiają się na omówieniu takich cech, jak: polisemia i homonimia, synonimy, metafory, faux amis czy terminy fachowe/specjalistyczne. Dodatkowo zarysowano różnice pomiędzy językiem potocznym a językiem prawnym i prawniczym. Praca ma charakter poglądowy. Wybrano tylko niektóre cechy języka prawa. W dalszych badaniach należałoby poszerzyć ten opis o większą ilość cech i przykładów.
    The subject of the paper was chosen because the features of language of law have not been described in every language pair yet. The aim of the paper is to discuss the features of the Japanese and Polish language of law. The presented features were taken from Polish and Japanese copyright acts, national terminology and language used in courts. The method focuses on empirical studies. The authors of the paper focus on the following features of language of law: polysemy and homonymy, synonyms, metaphors, false friends (faux amis) or specialized terminology, as well as differences between colloquial language and the varieties of the language of the law. The paper has an outlook nature. Only some features of language of law were chosen. In the nearest future the description of these features should be broadened, as well as the examples.

    W niniejszym artykule rozważam dwa pytania. Po pierwsze, jakie są relacje teoretyczne pomiędzy „thick terms”, „thick concepts” oraz „thick properties”. Staram się wykazać, że odpowiedź zależna jest od wyboru założeń filozoficznych. Po drugie, rozważam jakie są możliwe powiązania pomiędzy opisowymi i ewaluatywnymi komponentami „tłustych” wyrażeń. Koncentruję się na naturze elementu ewaluatywnego oraz przeciwstawiam sobie semantyczne i pragmatyczne ich ujęcie. W konkluzji stwierdzam, że wyrażenia takie jak „prawny” są tłuste par excellence. Co za tym idzie, budując spójną teorię prawa, powinniśmy być świadomi wszystkich teoretycznych zawiłości związanych z treścią ewaluatywną.
    In the present article I explore two questions. First, what are the theoretical relations between thick terms, concepts and properties? I try to depict that the answer is dependent upon a choice of philosophical assumptions. Second, I explore what are the possible bonds between descriptive and evaluative components of thick expressions. I concentrate on the nature of the evaluative component and contrast the semantic and pragmatic approaches. Finally, I conclude that terms such as ‘legal’ are par excellence thick. Therefore, we should be aware of all the theoretical intricacies of the evaluative content when building a coherent theory of the legal realm.

    Opis:
    Legal translation is a highly skilled task. It has even been described as the “ultimate linguistic challenge” (Harvey 2002: 177). However, law firms or corporations that procure translations from self- employed translation practitioners often find the intricacies of the task difficult to perceive. Following extensive fieldwork examining how legal translation is commissioned and performed in ‘outstitutional’ contexts, I have developed a multidimensional model which illustrates the legal translator’s textual agency, aimed at conveying the complexities of translation performance to clients and other stakeholders. It may also serve to train fledgling legal translators, and to heighten practising translators’ awareness of their overall task. The impetus for the model sprang primarily from findings of serious information asymmetry and goal divergence in the market, and evidence that actors involved do not grasp (a) the need for legal translators to be fully briefed, or (b) the layers of skills involved. 
    Tłumaczenie prawne jest zadaniem wymagającym wysokich kwalifikacji. Zostało nawet opisane jako „największe wyzwanie językowe” (Harvey 2002: 177). Jednak firmy prawnicze lub korporacje, które zamawiają tłumaczenia od samozatrudnionych tłumaczy często nie zauważają zawiłości tego zadania. Po przeprowadzeniu szeroko zakrojonych badań terenowych, analizując, w jaki sposób zlecane jest tłumaczenie prawne i przeprowadzane w kontekście „pozainstytucjonalnym”, opracowałam wielowymiarowy model, który ilustruje złożoności wykonania tłumaczenia. Może również służyć kształceniu początkujących tłumaczy prawniczych i zwiększaniu świadomości tłumaczy na temat ich zadania.

    The article attempts to provide an explanation why the English legal language is so complex and so difficult to understand especially for the lay people. Also mentioned are the attempts that have been made to simplify it. The paper also describes its development throughout history. It maintains that legal English is the result of history and political and social processes ongoing in the given historical period. This language is basically the reflection of the social and political conditions of the given historical period, and each period has left its mark on the current form of the language at issue. It reflects the influence of Anglo-Saxon mercenaries, Latinspeaking missionaries, Scandinavian and Norman war tribes. As it is highlighted further in the text, English has been used in various types of legal documents at different times. Last wills and testaments started to be drafted in English around 1400. Laws were written in Latin until around 1300, in French until about 1485, in English and French for a few more years and exclusively in English since 1489. The paper contains a number of the words and expressions related to law which are used even today and provides their etymology, at least as far the language of its origin is concerned. Also provided are expressions that were replaced with new ones, simpler, more understandable legal terms within reforms.

    Artykuł jest wykładem językoznawczym na temat wzajemnych związków między językiem prawnym a językiem prawniczym na płaszczyźnie semantycznej, syntaktycznej, pragmatycznej i stylistycznej. Autorka dokonała analizy decyzji i zarządzeń administracyjnych ze względu na status języka i lingwistyczne rozumienie komunikacji. Stwierdziła, że decyzyjny akt urzędowy jest świadectwem twórczego odczytania macierzystego tekstu ustawy przez urzędnika pełniącego rolę interpretatora i decydenta w stosowaniu prawa. Urzędnik wypełnia obowiązek narzucony mu przez normę kompetencyjną wysłowioną przepisami w aktach prawnych. Posiłkuje się regułami języka według wyuczonych i ustawowo zalecanych reguł wykładni prawa. Poprzez ewokację w odbiorze treści artykułów ustawy w dokumentach administracyjnych znaczenia i konteksty prawne ulegają swoistemu przyswojeniu przez urzędnika-interpretatora. Następnie podlegają adaptacji do odnośnych sytuacji prawnych, a w konsekwencji następuje proces uniwersalizacji wiedzy o prawie stanowionym, ponieważ urzędnik-decydent wpisuje indywidualną znajomość treści ustawodawczych w konkretną rzeczywistość prawną własnej wspólnoty komunikacyjnej.
    The article is a linguistic lecture on mutual relations between legal language and legislative language on the semantic, syntactic, pragmatic and stylistic planes. The author analysed decisions and official regulations with regard to the status of language as well as the linguistic understanding of communication. A decisive official act is a testimony of the primary reading of the text of a legislative act by an official, fulfilling the role of an interpreter and a decision maker in applying law. He fulfils a duty imposed on him by the norm of competence, verbalised in principles of legal acts. In the process of organizing a legal text, he makes use of the rules of language, according to both the studied and the statutorily recommended rules of the interpretations of law. Through evoking the content of legal articles in official documents, therefore through concretization of legal norms in the process of reception, the legal meanings and contexts undergo a certain kind of assimilation by an official-interpreter. Later, they become adapted in corresponding legal situations, and finally, as a consequence, a process of universalization of knowledge about the established law takes place, because an official-decision maker inscribes his personal knowledge of the legislative content into a specific legal reality of his own community.

    Opis:
    The principle of cumulation in the inheritance and donation tax, as a legal concept, is an institution with a hundred-year history. Due to law changes and changes in law structure, proper interpretation is very difficult. Obeying the literal interpretation border necessarily leads to an unacceptable result. The solution ensuring the proper functioning of the cumulation rule is to transgress the limits of linguistic interpretation, so that the result of the interpretation would be in accordance with the deep structure of the tax act. In breaking the language border, a specific method of law interpretation can be helpful, method thats taking into account contextualism as well as the coherence of law and the legal and economic structure.  
    Zasada kumulacji w podatku od spadków i darowizn jest, jako koncepcja prawna, instytucją o stuletniej historii. Ze względu na zmiany o charakterze legislacyjno-systemowym interpretacja przepisów ustanawiających jej byt prawny napotyka na duże trudności. Traktowanie granicy wykładni językowej bezwzględnie prowadzi do niemożliwego do zaakceptowania rezultatu. Rozwiązaniem zapewniającym prawidłowe funkcjonowanie zasady kumulacji jest wykroczenie poza granicę językową wykładni, tak by wynik wykładni pozostawał w zgodzie z głęboką strukturą ustawy podatkowej. W przełamaniu granicy językowej może pomóc metoda wykładni prawa uwzględniająca problem kontekstualizmu oraz koherencję prawa i struktury prawno-ekonomiczne związane z ustawą podatkową.

    Temat artykułu stanowi analiza podstawowych założeń polityki językowej Unii Europejskiej, unijnego prawodawstwa oraz orzecznictwa Trybunału Sprawiedliwości UE pod kątem fenomenu praw językowych oraz dyskryminacji językowej. Problem ten jest wciąż w niewielkim stopniu rozpoznany w nauce. Tekst skupia się w szczególności na prawach językowych przysługujących jednostkom w ich stosunkach z instytucjami unijnymi na przykładzie postępowań rekrutacyjnych i konkursowych. We wstępie ujęto prawa językowe w perspektywie socjolingwistycznej. Pod uwagę wzięto w szczególności myśl związaną z ruchem Language Human Rights, a także teoretyczne podstawy polityki językowej oraz jej znaczenie w kontekście praw podstawowych. Mimo specyfiki dyskursu i analiz prawniczych przywołanych w pracy obecne w nich ustalenia wydają się istotne z punktu widzenia socjolingwistyki, ze względu na fakt, że to m.in. w ramach tej zinstytucjonalizowanej komunikacji ma miejsce debata o problemach kontaktu języków, funkcjonowania wielojęzyczności, dyrektyw komunikacji językowej wpływających na jej codzienne realizacje w przestrzeni UE .
    The topic of basic principles of the linguistic policy of the European Union, European law and the ECJ ’s jurisprudence on language rights of EU citizens and prevention of linguistic discrimination remain still unexploited in scientific literature. The paper focuses on language rights of individuals in their relations with EU institutions in the case-study of recruitment processes. In the introduction the general, sociolinguistic context, related to the Language Human Rights movement and linguistic policy was taken into consideration with regard to fundamental rights issues. Despite the specific, legal character of discourse and reasoning applied in the paper, the conclusions presented on their grounds seem to be important for sociolinguistics since it is within i.a. this institutionalised communication that takes place a debate on the problems of languages in contact, functioning of multilingualism, and some directives concerning linguistic communication that influence its everyday realisations in UE .

    The object of this sketch is the legal and administrative Polish language of the interwar period, that is the time of the Second Polish Republic. Regaining the statehood after one and a half century of the Partitions marked signifi cant transformations in the history of the nation and the society, the return of the Polish language to offi ces, the gradual standardisation of the language of administration, unifi cation and codifi cation of law. The political system of the Second Polish Republic evolved. The system of parliamentary democracy, adopted in 1919 and established in the March Constitution, transformed gradually, in particular after the May Coup in 1926, into the authoritarian system. The principal value in the March Constitution is the nation, which was bestowed with power. In the April Constitution, the principal value is the state as the common good of all citizens. There were not enough Poles with a good background among administrative offi cers. A major role in preparing templates of documents was played by lawyers, who gave consideration also to language aspects.

    This essay is a survey of methods applied and topics scrutinized in legal-linguistic studies. It starts with the elucidation of the epistemic interest that led to the emergence and to the subsequent expansion of the mainstream legal-linguistic knowledge that we dispose of today. Thus, the essay focuses upon the development of problem awareness in the emerging legal-linguistic studies as well as upon the results of research that might be perceived as the state of the art in the mainstream legal linguistics. Meanwhile, some methodologically innovative tilts and twists that enrich and inspire contemporary legal linguistics are considered as well. Essentially, this essay traces the conceptual landscape in which the paradigms of legal-linguistic studies came about. This conceptual landscape extends from the research into the isolated words of law and the style used by jurists to the scrutiny of legal texts and legal discourses in all their socio-linguistic complexity. Within this broad frame of reference, many achievements in legal-linguistic studies are mentioned in order to sketch the consequences of processes in which legal-linguistic paradigms take shape. The author concludes upon a vision of legal linguistics called pragmatic legal linguistics as the newest stage in the intellectual enterprise that aims to pierce the language of the law and by so doing to understand law better.

    In the article, I discuss the legal aspects of language: using linguistic analyses for the benefit of the courts. I discuss linguists’ court communication situation and the expectations towards them. The starting point is one exemplary court case in which an expert linguist was appointed to issue an opinion on the evidence. The conclusions fall into two categories: linguistics and forensic science. Linguistic conclusions, developed in accordance with traditional methods of lexicographic analysis and lexicological and semantic analysis, are not necessarily (because they would not have to be) innovative for linguists. It was more important to show the situation of a linguist in court, the structure of judicial opinion and the procedures for building the linguistic response to a process inquiry as seen from the forensic perspective.

    Opis:
    How we function in social reality is determined by various types of cognitive schemas. These concern people, social events and other phenomena. According to the concept offered by various postpositivist currents, including postmodernism, poststructuralism and critical theory, such schemata cannot be objective. The most important element of postmodern considerations is the discovery of the arbitrary nature of modernity. This means rejecting the Enlightenment belief in progress. Innovation, understood as modernity resulting from human reason, is illusory in the postmodern perspective. Innovation consists precisely in a rejection of the myth of the existence of some absolute, objective truths that constitute the social order. The world is textual, made up of many alternative narratives. Definitions, including legal definitions, are socially constructed. They arise from specific social conditions, at a particular stage of development of a particular group. The assumption made by postmodernists is that language, including professional language – such as the language of law or legal language – is neither neutral nor transparent. The innovative power of this language lies in its use of narratives that influence the functioning of social groups of varying degrees of complexity. It is therefore necessary, adopting a postmodern interpretation, to look at the text of legal language in a similar way as we look at other texts. That is, to see in the narrativity of this language structural similarities with other texts that constitute social reality.
