The aim of this study is to analyze the role that the Internet plays in the enjoyment of human rights and answer the question of whether we may be in the process of recog-nizing a new right, namely the right to Internet access. The conclusions are built upon a quantitative and qualitative analysis of the Internet-related recommendations adopted by the UN treaty-based bodies in the period between 2007 and 2017. Moreover, the paper is supplemented by a brief overview of the relevant recommendations formulated under the mechanism of the Universal Periodic Review. Analysis of the content of rec-ommendations allowed them to be classified into two groups – the first one integrates recommendations that refer to the duty of non-interference, and the second concerns the duty to expand Internet infrastructure across the country. The article ends with a call for further investigation of the normative potential of Article 15(1)b of the International Covenant on Economic, Social and Cultural Rights, as this hitherto forgotten provision might shed a new light on the proposed right to Internet access.

The article explores the concept of the positive and negative obligations of the state in securing human rights, recognized in human rights literature, and in the judgments of the European Court of Human Rights. The concept is then applied to show the importance of securing freedom of expression in regulating Internet access services and enforcing pertinent regulations in EU Member States. The author is of the opinion that economic arguments should not overshadow the need to secure the freedom of expression of the end-users of Internet access services.
L’article explore le concept des obligations positives et négatives de l’État en matière de défense des droits humains, reconnu dans la littérature sur les droits humains et dans les arrêts de la Cour européenne des droits de l’homme. Le concept est ensuite appliqué pour montrer l’importance de garantir la liberté d’expression dans la réglementation des services d’accès à Internet et dans l’application des réglementations pertinentes dans les États membres de l’UE. L’auteur est d’avis que les arguments économiques ne doivent pas occulter la nécessité de garantir la liberté d’expression des utilisateurs finals des services d’accès à Internet.

In the article the author examines state filtering of electronic content in terms of its compliance with international law, especially with provisions guaranteeing the freedom of expression and access to information. The White House implemented program “Internet Freedom”, whose aim is to introduce software enabling the circumvention of local content control in “filtering countries”, is subject to thorough analysis. The analysis covers recent (2011) events in Egypt, where the world’s first successful attempt at shutting down the Internet within state borders was completed. Although enforced through legitimate state actions this Internet shut-down was circumvented with the use of Google-introduced technology. The technology and its use seemed to meet the ideas behind the “Internet Freedom” program, introduced by the White House a few month prior to the Egypt events. In the course of argument the author discusses international responsibility for the possible breach of their international obligations by both: Egypt and the U.S. She provides for the assessment of the legality of the actions of Egyptian authorities’ introducing an Internate filter that constitutes an infringement of freedom of expression, as well as the responsibility of United States for their failure to halt a U.S. legal entity enabling users to circumvent the legitimate Egyptian technology. The author argues that the character of the global network requires a redefinition of state sovereignty, especially in the context of human rights protection on-line. An idea introduced by R.H. Weber of “shared sovereignty” is mentioned, as it reflects the basic principle of international Internet law: the principle of multistakeholder governance.

Artykuł analizuje uwarunkowania prawne i techniczno-organizacyjne związane z uruchomieniem w państwach Unii Europejskiej certyfikowanych mechanizmów monitorowania jakości usługi dostępu do Internetu w związku z wdrażaniem przepisów rozporządzenia UE 2015/2120. Certyfikowany mechanizm jest konieczny do skorzystania przez konsumentów z domniemania nienależytego wykonania usługi przez dostawcę w przypadku wystąpienia rozbieżności między wynikami pomiarów a wymaganiami jakościowymi określonymi w umowie. Artykuł analizuje charakter zobowiązań dostawców w zakresie gwarantowania jakości usługi, skutki przeprowadzenia pomiarów jakości z wykorzystaniem certyfikowanego mechanizmu i wymagania związane z certyfikacją. Przedstawiono działania podejmowane w państwach członkowskich UE, ze szczególnym uwzględnieniem Polski, w celu uruchomienia certyfikowanych mechanizmów monitorowania oraz główne trudności związane z realizacją tego zadania.
The article analyses legal, technical and organizational conditions related to the establishment of certified mechanisms of monitoring internet access service quality in EU Member States in connection with the provisions of EU Regulation 2015/2120. Certified mechanisms are necessary in order to allow consumers to take advantage of the presumption of an inappropriate service performance by a service provider in case of discrepancies between the measurements results and the quality requirements set out in the service contract. The article analyses the nature of the obligation of providers concerning service quality, effects of performing the measurements, making use of the certified mechanism, and the requirements of certification. Presented are the activities undertaken in EU Member States, in particular in Poland, to establish certified monitoring mechanisms as well as main difficulties in performing this task.

The level of access to Internet is constantly evaluated and promoted by electronic communications regulators around the world. The issue is especially important in countries, such as Poland, where where Internet access is highly heterogenous among local markets. The objective of this paper is to identify socio-economic factors that influence the level of Internet access in local communities (gminas) in Poland. The definition of Internet access involves multiple criteria and encompasses in particular its availability, adoption, speed, quality of service and price. In the paper we propose a two-phase approach to a comparison of Internet access in various gminas. First we use Data Envelopment Analysis (DEA) to evaluate Internet broadband access depending on their demographic characteristics based on data from 2010 and 2011 collected by Poland's Office of Electronic Communications (UKE). In the second stage we explain the obtained DEA effectiveness indices using supervised learning techniques with the socio-economic status of the community as explanatory variables. We show that in the period under study rural communities experienced greater Internet access improvement than urban communities, therefore catching up with large cities and reducing technological gap. Moreover, we identify drivers of broadband Internet advancement, including: community type, community education and age structure, computerization level in schools and Herfindahl-Hirschman competition index. We show that an effective regulation may foster the advancement of fixed-location broadband Internet access.

An Internet application was developed to support the design process of the WLAN access network. The whole program was designed as a desktop application using the following languages: HTML, CSS and JavaScript. The main task of the application facilitates the planning process of the WLAN access network, including the location of multiple base stations. There is an example of using the program in the WLAN network planning process. The main purpose of this application as the ability to carry out network planning using multiple base stations and provide radio coverage for the entire area served by Wireless Internet Service Provider, is obtained.

The database was created in response to the need of obtaining complex information necessary for efficient management of the Polish coastal zone. Database preparation processes are co-ordinated within the EU PHARE project focusing on harmonising such databases in Estonia, Lithuania, Latvia and Poland. The majority of the information concerns the geographical objects, therefore the database was generated with application of Geographic Information Systems.

The academia of the University of Mysore in India encompasses faculty and research scholars. Both are involved in research, publication and lifelong learning, and faculty members are deeply engaged in assisting students. Besides the print collection, the library users have access to a variety of electronic resources. In the recent past, the librarians have been encouraging a more effective use of e-books, which are web based and downloadable. The library’s collection of electronic books is growing. It is said that ‘the most important development in literature in the world after Guttenberg is the e-book’ [6]. The aim of the present study was to evaluate the usage of e-resources at the University of Mysore. The paper covers demographic characteristics, computer and Internet usage, types of e-books accessed, the purpose of search, and duration of e-books use. E-books provide easy and instant access to the content and are convenient to read and browse. The findings of the survey reveal that the e-books of Springer, Taylor & Francis were used the most. Reference e-books were used very frequently. A lack of awareness together with acquisition costs seem to hinder usage of e-books.
Środowisko akademickie Uniwersytetu of Mysore w Indiach obejmuje wykładowców i uczonych badaczy. Oba środowiska prowadzą badania, wydają publikacje i organizują kształcenie ustawiczne, a pracownicy wydziału są głęboko zaangażowani w pomoc studentom. Oprócz zbiorów dokumentów drukowanych, użytkownicy biblioteki mają dostęp do różnych zasobów elektronicznych. W niedawnej przeszłości bibliotekarze zostali zachęceni do bardziej efektywnego wykorzystania e-książek, które są do pobrania dzięki sieci internetowej. Biblioteczne kolekcje książek elektronicznych powiększają się. Mówi się, że „najważniejszym wydarzeniem w rozwoju literatury na świecie po wynalazku Guttenberga jest e-book” [6]. Celem niniejszego badania była ocena wykorzystania e-źródeł na Uniwersytecie w Mysore. W artykule przedstawiono charakterystykę demograficzną, wykorzystanie komputera i Internetu, dostępne rodzaje e-booków oraz cel i okres użytkowania e-książek. E-książki zapewniają łatwy i szybki dostęp do ich zawartości. Wyniki badań wykazują, że bardzo często użytkowane były e-książki wydawnictwa Springer, Taylor & Francis. Często wykorzystywano także źródła informacji o e-bookach. Brak świadomości wraz z kosztami akwizycji zdają się utrudniać korzystanie z e-książek.

The European consumer policy relies on the ideal of consumer empowerment, which involves providing all consumers with detailed information on the goods on offer. This policy also applies to the electronic communications sector, and empowering consumers who are the end-users of internet access services. The author reviews behavioural law and economics literature that pertains to consumer empowerment and applies the resulting insights to interpret Article 4 (1) of Regulation 2015/2120 laying down measures concerning open internet access in a way that would truly empower the sophisticated consumers. The author also proposes advising or obliging the providers of internet access services to label those services to provide even the unsophisticated consumers with meaningful and understandable information
La politique européenne des consommateurs repose sur l’idéal de l’autonomisation des consommateurs (consumer empowerment), qui consiste à fournir à tous les consommateurs des informations détaillées sur les produits proposés. Cette politique s’applique également au secteur des communications électroniques et habilite les consommateurs qui sont les utilisateurs finaux des services d’accès à Internet. L’auteur passe en revue la littérature sur les analyses économiques du droit relative à l’autonomisation des consommateurs et applique les idées qui en résultent pour interpréter l’article 4, paragraphe 1, du règlement 2015/2120 établissant des mesures relatives à l’accès ouvert à l’internet pour le bénéfice des consommateurs sophistiqués. L’auteur propose également de conseiller ou d’obliger les fournisseurs de services d’accès Internet à étiqueter ces services afin de fournir aux consommateurs moins sophistiqués des informations utiles et compréhensibles.

This case comment concerns the judgment of the Court of Justice of the European Union in the Telenor case. The CJEU responded to a request for a preliminary ruling by the Budapest High Court, which related to the use of zero tariff offers in commercial practices and agreements on internet access services. Zero tariffs consist in the traffic generated by specific applications or services not counting towards deductions in an end user’s data allowance in a given billing period. The CJEU came to the conclusion that such offers are incompatible with Article 3(3) of Regulation 2015/2120 on open internet access, if they involve traffic management measures blocking or slowing down all internet content other than the content subject to a zero tariff, once an end user’s data allowance has been exhausted. Finding this incompatibility does not require an assessment of the scale of the practice, and its influence on end user rights. Such an assessment would be necessary to establish incompatibility with Article 3(2) of Regulation 2015/2120. However, finding incompatibility with Article 3(3) makes it possible for national regulatory authorities to refrain from analyzing incompatibility with Article 3(2).

Celem artykułu jest zaprezentowanie konkretnych przykładów wpływu innowacji technologicznych i wirtualnego świata na rozwój nowych dróg komunikacji, umożliwiających szybki, wygodny i ekonomiczny dostęp do informacji, niezbędnej w procesie zdobywania wiedzy. Nowe drogi komunikacji niewątpliwie umożliwia internet, który otwiera drzwi do wirtualnej rzeczywistości. Atrakcyjnym atrybutem tej rzeczywistości są nowe media, których głównym atutem jest niemal natychmiastowy, globalny dostęp do wszelkiej informacji, w szczególności w postaci obrazowej. Oferowana przez nowe media rzeczywistość i możliwości komunikacji zasadniczo wpływają na stosunek człowieka do innych ludzi, jego przyzwyczajenia, pomysły, ideały i preferowany styl życia. Nowe media z jednej strony czynią życie łatwiejszym i bardziej komfortowym, z drugiej strony prowadzą do zmiany w postrzeganiu przestrzeni, czasu czy też wymiarów ludzkiej egzystencji. Należy podkreślić fakt, że nowe drogi komunikacji przy udziale nowych mediów, niewątpliwie przyczyniają się do powstawania swoistych nowych przestrzeni i form interakcji.
The aim of this article is to show how innovative technologies or rather the virtual world influences the development of new ways of communication by using concrete examples. They enable a rapid, comfortable and economical access to information in the process of acquisition of knowledge. Above all, these new ways are provided by Internet, which is the gate to virtual reality. The new media are an attractive attribute of this reality. Their main advantage is an immediate and global access to every kind of information, especially in form of pictures. But on the other side, the reality, which is offered by new media and the possibilities of communication basically get an impact on the relation of a human being to other people, their habits, ideas, ideals and preferred style of life. On one side, new media make life easier and much more comfortable, but on the other side, they lead to a change of perception of spaces and time or the dimension of human existence. So, there is a need to underline the fact, that new ways of communication by the participation of integrated new media undoubtedly contribute to the emergence of peculiar new spaces and forms of interaction.

W opracowaniu przedstawiono koncepcję e-Gminy, która odpowiada obserwowanym współcześnie zmianom, będącym konsekwencją rozwoju teleinformatyki i społeczeństwa informacyjnego. Szczególną uwagę poświęcono uwarunkowaniom technologicznym wdrażania e-Gminy, tj. infrastrukturze sieci e-Gminy, a także rozważono kwestię wpływu teleinformatyki, wykorzystywanej w ramach omawianej koncepcji, na funkcjonowanie jednostek samorządu terytorialnego, ich mieszkańców, jak również lokalnych przedsiębiorców.
The paper presents the concept of e-Municipality, which corresponds to the today observed changes, as the consequence of the development of ICT and the information society. Particular attention was paid to the technological determinants of e-Municipality implementation, i.e. network infrastructure of e-Municipality and there was considered the impact of ICT, used as a part of discussed concept, on the functioning of local governments and their citizens, as well as local businesses.
