Tuberculosis (TB) is a social disease with medical aspects accounting for 8.7 million new cases and 1.4 million deaths in the year 2011 worldwide. International standards for TB care (ISTC) were formulated to develop uniform guidelines for ensuring the delivery of a widely accepted level of care by all health care practitioners in managing TB patients, or those suspected to have tuberculosis. India alone has contributed 25% of the globally reported new cases of TB in 2011 and is also the leading nation in accounting for drug resistant TB (DR-TB). Thus to develop uniform standards of TB care and to engage private sector which caters to more than 70% of TB patients, the “central TB division” has developed standards of TB care in India (STCI). These local standards have been designed after taking into account the guidelines of the World Health Organization and ISTC disease control STCI has proposed 26 standards (viz. diagnosis – 1 to 6; treatment – 7 to 11; public health – 12 to 21; social inclusion – 22 to 26) for effective prevention and control of TB. To conclude, the Indian standards of TB care have been proposed to emphasize on individual patient care and public health principles of disease control for ultimately reducing not only the suffering but also the economic losses from tuberculosis.

Since several years already, a public law has been adopted in the Republic of Albania on the civil servants as well as their ethics in workplace. Integrity of civil servants and prevention of corruption are two key elements needed highly required from the latter aiming at serving the public interest at best. The legislation is a key measure to reach such a goal. This papers aims at assessing the efficacy of the two main laws, the status of civil service and rules of ethics for such a pursue and their consistency with best international practices of provisions of civil service legislation related to recruitment, promotion, job security, the independence and capacity of the body/bodies responsible for oversight, including OECD/SIGMA and Council of Europe recommendations. The paper presents several suggestions, according to which either the integrity of civil service recruitment should be better monitored or several legislation amendments are needed.

The article analyzes the rights in the area of social security resulting from the European Social Charter and the Revised European Social Charter. The study presents both standards resulting directly from the provisions of the above-mentioned treaties as well as requirements interpreted by the European Committee of Social Rights. Particular attention was paid to the guarantees of the social security system and protection of entitled persons in the event of the necessity to limit the level of granted benefits, especially in the event of an economic crisis.

Opis:
Na podstawie ustawy o dostępie do informacji publicznej sformułowano w literaturze i orzecznictwie dwa sposoby ujmowania informacji publicznej, podmiotowe i przedmiotowe. Pierwsze z nich, odwołując się do art. 61 Konstytucji RP, wiąże to pojęcie z wszystkim co dotyczy szeroko rozumianej działalności podmiotów publicznych, niezależnie do jakiego podmiotu się ona odnosi i kto jest autorem informacji. Drugie, nawiązując do pojęcia sprawy publicznej z art. 1 ust. 1 ustawy, łączy je jedynie ze sprawami zbiorowości, wyłączając z tego zakresu informacje pochodzące od osób prywatnych. W artykule przedstawiono szeroko argumenty przemawiające za ujęciem podmiotowym. Wynikają one zarówno ze standardów międzynarodowych i unijnych, podkreślających prawno-naturalny rodowód prawa do informacji, które jest podstawowym prawem człowieka, jak i ze standardów konstytucyjnych, wskazujących na jego wolnościowy charakter. Przemawia to zatem za szerokim ujmowaniem informacji będących przedmiotem tego prawa. Za takim rozumieniem pojęcia informacji publicznej przemawia też wykładnia systemowa i celowościowa ustawy o dostępie do informacji publicznej. Ujęcie przedmiotowe może skutkować bowiem zarówno ograniczeniem jawności życia publicznego, jak i naruszeniem obowiązujących w tym zakresie standardów.
As the formulations of “public information” presented in the publications and in the jurisdiction show, in Polish law there are two different ways in which the concept may be understood on the grounds of Ustawa o dostępie do informacji publicznej (the Access to Public Information Act). The first sense of the concept pertains to rights and is applicable to public bodies and their activities in a broad sense of the term, no matter  which public body is involved and who has created the information. The second is the subjective sense and refers to the concept of public information as defined in Art. 1 Part 1 of the Act, in which it applies only to matters concerning a group or community, not information generated by private individuals. This article presents the arguments for the concept of public information in the sense of a right. These arguments are derived from international and EU standards, which say that the right to information comes from natural law and is one of the fundamental human rights. Other reasons may be derived from the standards embedded in the Polish Constitution, which show that the right to public information is a freedom. This implies that there should be a broad scope to cover the types of information that come under this right. Another point in favour of this understanding of “public information” is the systemic and teleological interpretation of the Act. The subjective sense could lead to a restriction of the transparency of public affairs and infringe the applicable standards.

The article presents the lowest level of local government – a commune – against the background of international local government standards formulated by such organizations as the Council of Europe, UNDP, OECD, the World Bank, the European Union. Firstly, the evolution of these standards is presented – starting from European Charter of Local Self-Government, through European Charter of Local Self-Government, ending with The Strategy for Innovation and Good Governance at Local Level and European Governance. Then, the range of implementation of these principles in Polish local government is analyzed. It can be determined that external influence in the form of international standards has been one of the key factors shaping the Polish self-government in the last 25 years.

Artykuł poświęcony został, szczególnie doniosłej w dzisiejszych czasach, problematyce jaką jest możliwość realizowania reintegracyjnego modelu wykonywania orzeczonej kary pozbawienia wolności w realiach polskich zakładów karnych oraz aresztów śledczych. Opracowanie zostało podzielone na dwie zasadnicze części. W części pierwszej, zarysowana została budowa Europejskich Regułach Więziennych z 2006 r. oraz przedstawione zostały najważniejsze uregulowania prawne dotyczące tytułowego zagadnienia. Część druga zawiera w sobie zarówno warstwę historyczną, ukazującą problematykę przeludnienia w jednostkach penitencjarnych w XX-to wiecznej Polsce, jak również stanowi omówienie norm metrażowych, obowiązujących w rodzimym ustawodawstwie, na tle wymogów przestrzeganych przez inne kraje europejskie. Istotnym walorem przedmiotowego opracowania jest jego aktualność bowiem zawarto w nim najnowsze dane statystyczne, opublikowane dnia 31 stycznia 2014 r., a dotyczące liczby osadzonych we wszystkich jednostkach penitencjarnych z terenu całego kraju.
The paper deals with possible ways to implement the reintegration model of serving imprisonment in the reality of Polish penal institutions and remand centres. The study is divided into two major parts. The first one outlines the structure of the European Prison Rules of 2006 as well as the key regulations concerning the issue under investigation. The second part comprises a historical glance at the problem of overcrowded penal institutions in 20th century Poland and a discussion of space norms currently in force in Poland, as seen against space requirements observed by other European countries. The presented work has an indisputable merit of being topical for it provides the latest statistical data (published on 31 January 2014) regarding the number of inmates in all penal institutions nationwide.

The financial sector of the economy has undergone turbulent times of late, a situation that continues as a result of the so-called debt crisis within the European currency union. Expert opinion has made efforts to respond to the effects brought about by this situation in many areas of the financial market. This article looks at capital market regulation within the European Union, focusing on International Financial Reporting Standards (IFRS). These standards should make it possible to harmonise the financial reporting of quoted companies and thus limit asymmetry of information when reducing the market risk, and in doing so, increasing trust in the capital market.

The COVID-19 pandemic has had consequences in several dimensions within contemporary society. One of them is the protection of human rights and the functioning of human rights protection systems. There is a broad understanding that fighting against the COVID-19 pandemic should not interfere with the protection of human rights. In order to mitigate the spread of COVID-19, governments throughout the world introduced emergency measures which constrain individual freedoms as well as social and economic rights, but demonstrate some global solidarity on the other hand. In doing so, civil obligations are rarely addressed, regardless of how significantly they are impacted by the response to the pandemic. The norms and principles of human rights should guide governments’ responses to COVID-19. The author of this article analyses the issue in the context of standards offered by international organisations. He particularly highlights the recommendations offered by the Parliamentary Assembly of the Council of Europe in Resolution 2339 (2020), namely “Upholding human rights in times of crisis and pandemics: Gender, equality and nondiscrimination.”

This article should be treated as the contribution to take up the discussion about the choice of return on equity. In accordance with the subject literature, return on equity is the ratio of net profit to equity capital. The calculation of return on equity based on the growth of retained profits seems to in more adequate to reality way point at the possibility of achieving higher benefits by stockholders in the future. The essential aim of this article is to present several scholarly reflections resulting from the analysis of return on equity with the use of two it’s measures i. e. profitability estimated by the net profit and the growth of retained profits. The realization of the appointed goal has been done with taking advantage of data from financial statements of KGHM company in the years 2007–2011, drown up by International Financial Reporting Standards/ International Accounting Standards.

The scientific article is devoted to the study of the content of the legal provision of the constitutional right to peaceful assemblies in Ukraine as a means of ensuring the observance of citizens’ rights. Types of liability for violation of the order of organization and holding of meetings and rallies are considered. The study emphasizes the importance of enforcement of court decisions that have entered into force. The changes taking place in Ukrainian society arouse high activity and the desire of people to take a direct part in solving problems that concern their common interests, including the use of the right to peaceful assembly. However, despite the importance of this type of political rights, the constitutional provisions on freedom of assembly, assembly, street demonstrations and demonstrations, which are still not properly specified in the current legislation, are often limited or even violated. Based on the international experience of regulating the right to peaceful assembly, ways to increase the effectiveness of the mechanism of administrative and legal support of the right to peaceful assembly are proposed, which are to create a domestic mechanism to monitor compliance with international standards of human rights and freedoms. human being, if this or that problem is not solved at the national level. It is proved that even a rather small range of current norms enshrined in legislative acts of various levels, which guarantee the right to peaceful assembly, often show some inconsistency in the content of the outlined rights, especially from the standpoint of the right to freedom of peaceful assembly. the subject is called a citizen, and civil law - an individual. The necessity of introduction of international standards of ensuring the right to peaceful assembly, first of all the standards of the European community, which is connected with the European integration aspirations of Ukraine, is proved. After all, the implementation of European standards and their observance by the subjects of public administration is one of the preconditions for Ukraine’s integration into the European legal space. Since the right to freedom of peaceful assembly cannot be exercised in the absence of corresponding responsibilities imposed on the state by its authorized bodies, the analysis of the Constitution and laws of Ukraine allowed to separate such bodies into the category of subjects of power to ensure the right to peaceful assembly. In order to improve the situation in the studied area, it is advisable to review the current legislation, which ensures the implementation of court decisions, to continue reforming public authorities for the effective operation of the judiciary and the protection of citizens’ rights.

Background: In practice, the developers focus is on early identification of the functional requirements (FR) allocated to software, while the system non-functional requirements (NFRs) are left to be specified and detailed much later in the development lifecycle. Aim: A standards-based model of system performance NFRs for early identification and measurement of FR-related performance of software functions. Method: 1) Analysis of performance NFR in IEEE and ECSS standards and the modeling of the identified system/software performance functions using Softgoal Interdependency Graphs. 2) Application of the COSMIC-FSM method (e.g., ISO 19761) to measure the functional size of the performance requirements allocated to software functions. 3) Use of the COSMIC-SOA guideline to tailor this framework to service-oriented architecture (SOA) for performance requirements specification and measurement. 4) Illustration of the applicability of the proposed approach for specification and measurement of system performance NFR allocated to the software for an automated teller machine (ATM) in an SOA context. Results: A standards-based framework for identifying, specifying and measuring NFR system performance of software functions. Conclusion: Such a standards-based system performance reference framework at the function and service levels can be used early in the lifecycle by software developers to identify, specify and measure performance NFR.
