    Opis:
    Competition between “Public Health Funds”. Theory and Experiences from Germany and SwitzerlandThe introduction of competition between public insurers within the polish system of social health insurance, announced by the Ministry of Health Ewa Kopacz, is not a new idea. It raises doubts not so much about the potential possibility of using the instrument of competition for increasing the efficiency of the system but much more about the preparatio of the system for such a constitutive change. Competition between public insurers works quite well in the social health insurance system in Germany and Switzerland. The experiences from these systems as well as the theory of health insurance economics show us that there are some preconditions that have to be met in order to realize the positive results of competition. In the first place, the insurers must want to compete. Secondly, they must have instruments for competition. And thirdly they must be kept from developing the risk selection in the form of cream skimming. Showing the constitutive value and character of public  insurers’ competition the author of the article analyses the practical implications of the three mentioned preconditions and their realization in the German and Swiss health systems.

In my work I wanted to present ZUS as an institution which supports people unable to work because it is a problem affecting many Polish citizens. At work I used mainly in the ZUS web site, which is a big mine of knowledge in the field of insurance.

    Celem artykułu jest analiza specyfiki świadczenia ubezpieczyciela w umowie ubezpieczenia. Analiza obejmuje przede wszystkim próbę rozstrzygnięcia sporu między zwolennikami teorii ponoszenia ryzyka, zgodnie z którą istota świadczenia ubezpieczyciela polega na ponoszeniu ryzyka wypłaty przewidzianego w umowie świadczenia oraz teorii świadczenia pieniężnego, według której sprowadza się ona do zapłaty określonej sumy pieniężnej. Autor przychyla się do stanowiska przemawiającego za uznaniem, że istota świadczenia ubezpieczyciela polega na ponoszeniu ryzyka wypłaty przewidzianego w umowie świadczenia. Stwierdzenie to ma bezpośredni wpływ na charakter prawny owego świadczenia. Świadczenie ochrony ubezpieczeniowej współistnieje przy tym ze świadczeniem o charakterze pieniężnym i stanowi obok niego równorzędne świadczenie główne ubezpieczyciela. Pierwsze z nich jest świadczeniem o charakterze ciągłym i polega na określonym, stałym zachowaniu się dłużnika w czasie trwania zobowiązania; drugie (za wyjątkiem wynikających z umowy ubezpieczenia świadczeń rentowych) – świadczeniem o charakterze jednorazowym. Z uwagi na konieczność zapewnienia ubezpieczonemu ochrony przed określonymi w umowie różnymi rodzajami ryzyka przez cały okres ubezpieczenia, pierwsze ze wskazanych wyżej świadczeń będzie przy tym świadczeniem o niepodzielnym, drugie zaś – jako świadczenie pieniężne – świadczeniem o podzielnym charakterze.
    The purpose of this article is to analyze the specyfics of insurer’s performance in the insurance contract. This analysis covers mostly the attempt to resolve a dispute between doctrine of risk assumption which considers the insurer’s performance as bearing the risk of the insurance indemnity payment and doctrine of cash benefit which considers such performance solely as payment of the insurance indemnity. Author supports the doctrine of risk assumption which affects also directly the legal character of the insurer’s performance. The performance understood as risk assumption coexists with performance of payment of the insurance indemnity as equal main performance of the insurer. First of them should be recognized as continuous performance, second (except insurance pension) as one-time performance. First of them should be also recognized as indivisible performance, second as divisible.

    Ustawa z dnia 27 czerwca 2003 r. o rencie socjalnej określa zasady i tryb przyznawania oraz wypłaty renty socjalnej. Renta socjalna przysługuje osobie pełnoletniej całkowicie niezdolnej do pracy z powodu naruszenia sprawności organizmu, które powstało przed ukończeniem 18 roku życia, w trakcie nauki w szkole lub szkole wyższej – przed ukończeniem 25 roku życia, albo w trakcie studiów doktoranckich lub aspirantury naukowej. Jedną z przesłanek jej przyznania jest nieprzekroczenie określonego przychodu i na tym tle może dojść do wątpliwości interpretacyjnych ze względu na wieloznaczną treść przepisu. Osoba będąca w stosunku pracy i zarazem uprawniona do renty socjalnej pobierając wynagrodzenie od pracodawcy nie jest w stanie wpływać na datę wypłaty tego wynagrodzenia. Zdarza się, że pracodawca w jednym miesiącu przelewa na konto pracownika wynagrodzenie należne za poprzedni i aktualny miesiąc. Taką wykładnię przepisu art. 10 ust. 6 ustawy o rencie socjalnej stosują organy rentowe, a często również sądy powszechne. W sprawie, która stała się przedmiotem tego artykułu, dopiero sąd drugiej instancji wydał korzystny dla osoby uprawnionej wyrok, przyjmując wykładnię celowościową przytoczonego wyżej przepisu ustawy o rencie socjalnej.
    The Social Pensions Act of June 27, 2003 defines the rules and procedure for the granting and payment of a social pension. Social pension is vested in an adult person who is completely unable to work due to impairment of fitness of an organism, which was created before the age of 18, while studying at school or college - before the age of 25, or during doctoral studies or scientific aspiration. One of the conditions for granting is not to exceed a certain income, and this may lead to interpretation doubts due to the ambiguous content of the provision. A person who is in an employment relationship and also entitled to a social pension while receiving salary from an employer is not able to influence the date of payment of this salary. It happens that the employer transfers the salary for the previous and current month to the employee`s account in one month. This usually results in exceeding the income of the entitled person and suspension of the right to a social pension, which in turn results in the obligation to return the rent paid. Such an interpretation of the provision of art. 10 para. 6 of the Social Pensions Act are used by pension bodies, and often also by common courts. In the case which became the subject of this article, it was only the court of second instance that issued a sentence favorable for the person entitled, adopting a teleological interpretation of the above mentioned provision of the Social Pensions Act.

    The objective of this article is to present the regulation of providing the functionaries of the Internal Security Agency with the pension and sickness benefit in the light of the right to social security guaranteed by the Constitution. For the past few years, Poland has undergone profound changes with regard to the system of social insurance, which primarily has affected the insurance side of the country’s system. The decision as to the actual changes stems from the demographic challenges which determine the economic efficiency of the system. Considering the issue of social justice, the legislator has taken specific legislative actions which result in diametrical changes with reference to normalizing the right to pension for functionaries of the Uniformed Services, inclusive of the Internal Security Agency. Legislative work is being carried out with regard to changes in remuneration rules during the functionaries’ incapacity for work. The author of this article takes into account the constitutional conditionings of the aforementioned modifications in the insurance system.

    Ubezpieczenie chorobowe wchodzi w skład powszechnego systemu ubezpieczeń społecznych, który stanowi wyraz realizacji obowiązków nakładanych na ustawodawcę w art. 67 Konstytucji RP. Ubezpieczenie chorobowe chroni na wypadek ziszczenia się określonych ryzyk socjalnych. Przedmiot niniejszego opracowania stanowi ryzyko niezdolności do pracy z powodu choroby. Omówiona została kwestia podlegania ubezpieczeniu chorobowemu, która jest przedmiotem regulacji ustawy systemowej (obowiązek i dobrowolność ubezpieczenia). Problematyka przedstawiona w artykule obejmuje kwestie związane z zasiłkiem chorobowym. Poruszony został aspekt tzw. okresu wyczekiwania jako warunku nabycia prawa do tego świadczenia, a także kwesti a utraty prawa do zasiłku w kontekście art. 17 ustawy zasiłkowej.
    Sickness insurance is part of the universal social insurance system, which is an expression of the legislator's implementation of the obligations imposed on the said in art. 67 of the Constitution of the Republic of Poland. Sickness insurance protects against certain social risks. The subject of this study is the risk of work incapacity due to illness. The issue of being subject to sickness insurance, which is the subject of systemic regulation (obligatory and voluntary insurance), is discussed. The issues presented in the article cover matters related to sickness benefit. The aspect of the so-called waiting period as a condition of acquiring the benefit rights, as well as the question of losing the right to benefit in the context of art. 17 of the Benefit Act are examined.

    The multi-stakeholder nature of group insurance contracts triggers various types of connections between the actors in this legal relationship. This is best illus- trated by the contract for insurance coverage, which is a separate agreement transacted between the insured and policyholder, but intrinsically linked with group insurance. The aim of this article is to discuss the selected aspects of contracts for insurance coverage. Particular emphasis is put on the insured’s right to withdraw from the contract if it was concluded by means of distance com- munication. The considerations in this respect include examples deriving from case-law practice, i.e. the decision of the President of the Office of Competition and Consumer Protection No. DDK-2/2014 of 16 October 2014 and the judgment of the Court of Competition and Consumer Protection (SOKiK) of 18 May 2018, reference number Act.     Wskazanie umowy ubezpieczenia jako obligatoryjnego prawnego zabezpieczenia spłaty kredytu (przede wszystkim długoterminowego) stało się powszechną praktyką na rynku usług finansowych, w tym także w relacjach z konsumentami. To zaś rodzi problemy praktyczne nie tylko na etapie transferu wierzytelności z umowy ubezpieczenia na bank, ale przede wszystkim na etapie realizacji roszczeń – już po zajściu wypadku ubezpieczeniowego. Celem artykułu jest analiza prawnej i faktycznej pozycji procesowej ubezpieczonego-kredytobiorcy lub jego spadkobierców po zajściu wypadku ubezpieczeniowego. Zaproponowane w orzecznictwie rozwiązania proceduralne ocenione zostaną pod kątem ich zgodności z wymogiem zagwarantowania konsumentom skuteczności instrumentów ochrony przewidzianych w unijnym reżimie prawa konsumenckiego, co determinuje również konieczność odwołania się do relacji ekonomicznych łączących ubezpieczonego-kredytobiorcę, bank oraz ubezpieczyciela.
    It is common practice on the financial services market to use loan collateral by transferring rights from a property or life insurance contract. This also applies to consumer trading. For this reason, practical problems must be faced not only at the stage of transfer of claims from the insurance contract, but primarily at the stage of implementation of claims – after an insurance accident. The purpose of this article is to analyze the legal and actual procedural position of the insured-borrower or his heirs in that cases. The procedural solutions proposed in the case-law will be analyzed in the light of their compliance with the requirement to guarantee consumers the effectiveness of protection instruments provided for in the EU consumer law regime. This will also determine the need to refer to economic relations between the insured-borrower, the bank and the insurer.

    Principles of solidarity and social solidarism are characterised by separate personal scopes, sources of financing, instruments and the scale of the redistributi on and historically shaped degree of social acceptance necessary for their accomplishment. Solidarism promotes mutual assistance and charity. In contemporary times it is reflected in social protecti on and social assistance systems. It is based not on the fact of work (employment) but on civil and human rights. Solidarity in the pension insurance is not based on charity but on the rati onality of the replacement of individual precaution with a group precaution which finds its basis in the actuarial calculations. It is based on the joint responsibility and joint acti on of persons exposed to the same risks, who form the insurance community of risk. The fundamental paradigm of the system of the insurance solidarity is the redistributory function. The scope and the scale of the redistribution within pension insurance depends on the structure of the contributi on, the form of the organisation of the compensati on fund and the form of the benefit. The restriction of the redistribution weakens the realisation of the principle of the social solidarity within pension insurance.
    Zasady solidarności i solidaryzmu społecznego charakteryzują się odrębnymi zakresami podmiotowymi, źródłami finansowania, narzędziami i skalą redystrybucji oraz historycznie ukształtowanym stopniem akceptacji społecznej dla ich realizacji. Solidaryzm promuje wzajemną pomoc i dobroczynność. Współcześnie znajduje odzwierciedlenie w systemach zaopatrzenia społecznego i pomocy społecznej. Opiera się nie na fakcie pracy czy zatrudnienia, a na prawach obywatelskich i prawach człowieka. Solidarność w ubezpieczeniu emerytalnym nie bazuje na dobroczynności, ale na racjonalności zastąpienia przezorności indywidualnej przezornością grupową, co ma podstawy w matematyce aktuarialnej. Opiera się na współodpowiedzialności i współdziałaniu osób narażonych na takie same ryzyka, które tworzą ubezpieczeniową wspólnotę ryzyka. Podstawowym paradygmatem systemu solidarności ubezpieczeniowej jest funkcja redystrybucyjna. Zakres i skala redystrybucji w ubezpieczeniu emerytalnym zależy wówczas od konstrukcji składki, formy zorganizowania funduszu kompensacji oraz formuły świadczenia. Ograniczenie redystrybucji w obrębie wspólnoty ryzyka osłabia realizację zasady solidarności społecznej w ubezpieczeniu emerytalnym.

    W glosowanym orzeczeniu Sąd Najwyższy podniósł, że jeśli spełnione są zarówno przesłanki zwrotu po stronie osoby, która pobrała nienależne świadczenie, jak też pobranie nienależnego świadczenia zostało spowodowane przekazaniem przez płatnika składek bądź inny podmiot nieprawdziwych danych, mających wpływ na prawo do świadczeń lub na ich wysokość (zachodzą więc równocześnie sytuacje przewidziane w art. 84 ust. 1, 2 oraz ust. 6 ustawy z dnia 13 października 1998 r. o systemie ubezpieczeń społecznych), wówczas Zakład Ubezpieczeń Społecznych ma wybór, kogo obciąży obowiązkiem zwrotu. Stanowisko takie budzi wątpliwości.
    : In the commented judgment the Supreme Court held that if the conditions of the recovery of undue benefits are fulfiled by the person who received a benefit unduly (art. 84 [1], [2] of the Act of 13 October 1998 on the social insurance system) as well as by the contribution payer or the other person due to the fact that some false data affecting entitlement to benefits or their amount have been passed by the contribution payer or by the other person (art. 84 [6] of the Act on the social insurance system), then the Polish Social Insurance Institution (ZUS) has the choice of who will charge the obligation to return the benefit. The opinion of the Supreme Court expressed in the commented judgment raises doubts.

    Opis:
    W niniejszym opracowaniu przybliżono obowiązek informacyjny oraz obowiązek terminowego powiadomienia ubezpieczyciela o wypadku, występujący w umowie ubezpieczenia dóbr kultury. Badane zagadnienie przedstawione zostało w ujęciu teoretycznym oraz praktycznym. Analiza prowadzona była na przykładzie umowy ubezpieczenia muzealiów, stanowiących własność muzeum i użyczanych na wystawy czasowe, zarówno krajowe jak i zagraniczne. Wybór tej umowy nie był przypadkowy, albowiem w praktyce muzealnej często dochodzi do zawierania takich umów i mają one doniosłe znaczenie z punktu widzenia interesów majątkowych muzeów. Wyjaśniono również, iż umowa ubezpieczenia użyczanych muzealiów w praktyce najczęściej zawierana jest jako umowa ubezpieczenia na cudzy rachunek. Przybliżono konstrukcję prawną takiej umowy i wyjaśniono, jak uchronić się przed komplikacjami, jakie wywołuje ona w praktyce. W treści artykułu zaprezentowane zostały prawne aspekty deklaracji ryzyka, notyfikacji zmian ryzyka oraz obowiązku terminowego powiadomienia ubezpieczyciela o wypadku. Sformułowane zostały również praktyczne zalecenia co do realizacji tych obowiązków przez muzea w sposób optymalny, tj. chroniący interes majątkowy muzeum. W podsumowaniu zgłoszono postulat nowelizacji art. 818 § 3 k.c., który w obecnym brzmieniu posługuje się terminem ,,odpowiednie” zmniejszenie świadczenia. Termin ten jest nieprecyzyjny i wywołuje trudności interpretacyjne oraz poważne komplikacje w stosowaniu przepisu art. 818 § 3 k.c. w praktyce.
    This study is devoted to the disclosure obligation and the duty to timely notify the insurer of an accident under insurance contracts relating to cultural objects. The examined problem is presented from theoretical and practical perspective. The analysis is based on the example of insurance contracts relating to exhibits belonging to museums and lent for temporary exhibitions, both home and abroad. The choice of that type of contract was not random because in museum practice such agreements are often concluded and they are vital for museums’ financial interests. It is also explained that an insurance contract covering lent exhibits most frequently takes the form of an insurance contract for account of another entity. The legal construction of such contracts is outlined, and it is explained how to avoid complications which the construction implies in practice. The article discusses legal aspects of risk declaration, notification of changes to the risk and the duty to timely notify the insurer of an accident. It also includes practical recommendations on optimal implementation of such duties by museums, i.e. in a manner protecting the museums’ financial interest. In summary, the author postulates to amend Art. 818 § 3 of the Civil Code, which, in its current version, uses the term, “accordingly” in reference to the reduction of benefit. The term is imprecise and gives rise to interpretative problems as well as serious complications in application of the provision of Art. 818 § 3 of the Civil Code in practice.

    This review includes information about the number of private health insurance and medical subscriptions in Poland, as well as the level of increases in premium rates, and the scale of health promotion and prevention conducted by Polish employers. The aim of this article is to present the current situation on the supplementary private medical market, which is involved in employees’ healthcare, and the challenges that both employers and medical providers with health insurers are now facing, and also to present the reasons why prevention and health promotion are important factors of healthcare under private health insurance. For the purpose of this review, scientific publications devoted to health promotion at the workplace were used, along with statistical data presented in the studies released by the Polish Insurance Association, the Polish Social Security Institution, the World Health Organization and the Organization for Economic Co-operation and Development. The literature search was carried out using the electronic databases of PubMed. Search terms included medical subject headings and free text words. No year of publication restriction was imposed. The conducted analysis shows that the demand for private medical care is rising. Employers are willing to invest in private medical care for their employees, although the scale is much lower among small and medium-sized entrepreneurs due to fiscal burdens. Given the rising demand and an insufficient number of specialists, access to medical services is deteriorating, and the premium rates and costs are rising. More employers are investing in health promotion at the workplace in order to decrease absenteeism and presenteeism, lower the utilization of medical packages, and improve their attractiveness on the market. Although the interest in private medical care is rising, employers should focus on health promotion and prevention at the workplace, and adapt their actions to the employees’ current needs and health issues.     This paper constitutes an attempt at the analysis of provisions of the Civil Code regarding suicide in an insurance contract. The aim of the paper is to analyse the economic aspect of a suicidal death. Regardless of this analysis, a few aspects related to death by suicide in the insurance industry have been indicated. In this paper, the author also analysed the German legal system conception. Therefore, the method of examining applicable laws and the legal- comparative methods have been used herein. The main conclusion drawn up on the grounds of the conducted research is that strict legal regulations are not compatible with suicide as a complex psychological and social process.
