    Due to the principle of sustainable development and placement of the Hunting Law in the system of protection of natural environment, admission of archery as a method of hunting on the territory of the Republic of Poland may raise – according to the author – doubts. Extending the arsenal of hunting weapons by a bow could find a justification only in the situation, when, based on independent scientific research, it would confirm the thesis that the bow can be effective for purposes of the hunting economy and can constitute a weapon at least as humanitarian and safe as a hunting firearm.

    Opis:
    Under the proposed amendment of Hunting Law, decisions on compensation issued by a province governor (wojewoda) could not be appealed to an administrative court based on the alleged illegality. The author points out that there should not be a situation in which two decisions are made in the same case, one by a public authority and the other by the court of general jurisdiction, none of which has effect on the binding force of another one. An analysis of the bill allows us to conclude that the decision of the voivodship governor, to the extent to which the case will be decided upon the judgment of the court of general jurisdiction, will cease to have effect. The author argues that in order to ensure greater legal certainty it could be advisable to regulate expressly the mutual relationship between the administrative and civil law procedures and the decisions issued in the course of each of them.

    Under art. 33 it. 6 of Hunting law cases of different nature are heard before a regional court. It is the subject matter of specific proceedings that is decisive in determining which procedural regulations will apply as the above provision refers to different legal relations. The first one refers to the membership in the Polish Hunting Association, which is granted in a way that allows us to recognize it as a civil law occurrence, and therefore the request before a common court for the protection of the membership may be considered a civil action. The second one is related to disciplinary liability which due to repressive nature of sanctions falls within penal liability in its broad sense. In this case, the proceedings before a common court exercised as a result of making an appeal against the decision ending disciplinary proceedings within the structures of the Polish Hunting Association constitute continuation of the disciplinary procedure. The nature of this liability calls for the court appeal control to be conducted on the basis of the same rules pertaining to the law of criminal procedure, on which disciplinary proceedings within the organization were based, and for the procedure ensuring the defendant as far-reaching proceedings security as possible to be applied.

    In the Sejm’s draft position, concerning the application of the National Council of Agricultural Chambers, the author claims that rules of the Hunting Law, so far as they do not provide obligatory permit from a farmer – who is an owner of land included in a hunting zone – to lease that land forming a hunting district, are compatible with the Constitution. However, provisions regarding compensations for hunting damages are considered unconstitutional.

    According to the author, in numerous aspects the assessment of the compliance with the Birds Directive can be carried out at the local level, taking into account elements such as habitat characteristics, the nature of the hunt or the degree of actual probability of the error due to the similarity of hunted and protected species. The thesis that pheasants and partridges can be considered as game only after the maturity of their own broods is too far-reaching. According to the author, the use of lead shot in areas of special protection may be considered incompatible with the protection requirements of these areas, and the practice of general exclusion of hunting plans from the requirement to undergo an impact assessment on a given area may be considered incompatible with the Habitats Directive.

    Since the late 1920s, the legislator has been trying to indicate the place of animals in the legal system. Due to their psychophysical features, they can be classified neither as things nor as persons. Determination of the place of animals in the legal system was extremely important due to the need to grant them legal protection in order to combat inhumane treatment. Today, the term “animal” is regulated in the Animal Protection Act, which clearly states that an animal is not a thing. However, in matters not regulated in the said act, laws applicable to things apply. Such subjectivity of animals is opposed by the understanding of game under the Hunting Law. What is more, this is not the only significant difference in the understanding of these related terms based on analysis of the two legal instruments. Humaneness viewed through the prism of the two pieces of legislation seems to be contradictory – the above-mentioned acts present different understanding thereof as well as different implementation by law. The cited acts were analysed in terms of literal, purposive, logical, and functional interpretation. Research into the issues in question was carried out with the use of dogmatic-legal, theoretical-legal, historical-legal, and sociological methods. This publication indicates the problem of ambiguity of the term “animal” based on the Hunting Law. Its aim is an in-depth analysis of the legal aspects of humane protection of animals, as well as an a contrario presentation of hunting practices. The research work carried out has suggested both inconsistencies as to identical terms in the above-mentioned acts, and a clear problem with regard to respecting and implementing the norms that stem from the provisions of the Hunting Law. Such results lead to a justified concern about the topicality of the legal solutions presented in the said act, while approval of this position should result in a conclusion that there is a need to amend the Hunting Law.

    An article under the title “The Development Of Legal Standards Governing Hunting in Poland," shows the evolution of the rules of law concerning hunting in Poland. In the paper there is a discussion on hunting as the activities in the natural environment. In addition, the author demonstrates whether legislation on hunting is a protective and is essential to the functioning of the State and society.

    The game shooting district lease contract is one of the instruments for environmental protection. As part of leased hunting districts, hunting clubs are obliged to conduct hunting economy. The structure of the provisions regulating the institution of the lease of hunting districts causes that doctrine and jurisprudence still have not developed a uniform concept regarding its legal nature.
    Umowa dzierżawy obwodu łowieckiego jest jednym z instrumentów ochrony środowiska. W ramach dzierżawionych obwodów łowieckich koła łowieckie są zobowiązane do prowadzenia gospodarki łowieckiej. Konstrukcja przepisów normujących instytucję umowy dzierżawy obwodów łowieckich powoduje, że w doktrynie i judykaturze nadal nie wypracowano jednolitej koncepcji w przedmiocie jej charakteru prawnego.

    Przedmiotem artykułu jest „prawo polowania”, rozumiane jako prawo podmiotowe do polowania na określonym gruncie. Pomimo iż określenie to nie jest używane przez ustawę Prawo łowieckie, to prawo polowania, jako instytucja prawa łowieckiego, nadal istnieje na gruncie tej ustawy. Przysługuje ono państwu (a właściwie Skarbowi Państwa). Świadczą o tymprzede wszystkim te przepisy ustawy, które określaja, kto wydzierżawia obwody łowieckie i komu przypada czynsz dzierżawny. Jeśli chodzi o konstrukcję prawa polowania to ma ono wiele cech prawa rzeczowego. Mimo więc, że prawo polowania nie należy do żadnej z trzech kategorii praw rzeczowych wyróżnionych w ich systematyce –prawo własności, prawo użytkowania wieczystego i ograniczone prawa rzeczowe, należy stwierdzić,że jest ono quasi prawem rzeczowym.  
    The present article deals with hunting rights understood as a subjective right to hunt on a given territory. It is the thesis of the present study that even though not named, hunting rights, as a legal institution, exist in Polish hunting law currently in force. This is evidenced by the fact that certain of its other institutions, in particular hunting preserve and hunting lease, rely upon this concept and cannot be properly understood without it. The present analysis tests the premise that hunting rights are real rights (iura in rem). Although they are not included in the list of the real rights mentioned in the Civil Code, they nevertheless have the characteristics of real rights. As hunting rights have the characteristics of real rights, but cannot be treated as such for the formal reason indicated above, it is proposed that they be considered quasi rights.

    Trwające od kilkudziesięciu lat intensywne zmiany w krajobrazach rolniczych, wpłynęły dość istotnie na dynamikę liczebności podstawowych gatunków zwierzyny grubej, a zwłaszcza dzików. Stan ten w połączeniu z obserwowaną w ostatnich latach wzrastającą roszczeniową postawą społeczeństwa, a zwłaszcza rolników prowadził do coraz liczniejszych konfliktów na tle szkód wyrządzanych przez zwierzynę w uprawach i płodach rolnych. Wymusiło to niejako konieczność poszukiwania nowych rozwiązań w zakresie procedur szacowania strat i ustalania wielkości odszkodowań. Począwszy od 2016 roku dokonano trzykrotnej nowelizacji prawa łowieckiego. Jedne z zaproponowanych rozwiązań ze względu na znaczne koszty nigdy nie zostały wprowadzone w życie. Drugie wprowadzone od 1 kwietnia 2018 roku nie sprawdziły się w ogóle i obwiązywały niespełna 5 miesięcy. Jednocześnie podnieść należy, że doprowadziły one do wielu konfliktów pomiędzy rolnikami a przedstawicielami samorządów lokalnych. Kolejne rozwiązania wprowadzone od 23 sierpnia 2018 roku, niejako powróciły do wcześniejszych, gdyż wydaje się, że jedynym podmiotem mogącym sprostać wymaganiom szacowania szkód i wypłaty odszkodowań za szkody wyrządzone przez zwierzynę w uprawach rolniczych są myśliwi zrzeszeni w Polskim Związku Łowieckim. Potwierdzeniem tego jest fakt, że opisane zmiany nie sprawdziły się w zupełności. Generowały one olbrzymie koszty i prowadziły do jeszcze większego, niż dotychczas, niezadowolenia społecznego.
    Intensive changes in agricultural landscapes, that have been going on for several decades, have had a significant effect on the dynamics of the number of basic large game species, especially wild boars. This situation, combined with the growing demanding attitude of the society observed in recent years, especially among farmers, led to more and more conflicts over the damages in crops caused by the game. It forced somehow the need to search for new solutions in the field of loss assessment procedures and determining the amount of compensation. Starting from 2016, the hunting law has already been amended three times. Some of the proposed solutions have never been implemented due to significant costs. Next amendments introduced on April 1, 2018 did not work at all and they were binding for less than 5 months. At the same time, it should be raised, that they have led to many conflicts between farmers and representatives of local governments. Subsequent solutions introduced on August 23, 2018, returned to the first legal solutions, because it seems that the only entity that can meet the requirements for estimating damages and paying compensation for damages caused by the game in agricultural crops are hunters associated in the Polish Hunting Association This is confirmed by the fact that the described changes have not worked at all. They generated enormous costs and led to even greater social dissatisfaction than before.

    The study contains the results of analysis of the Polish constitutional regulations in a scope of the environmental protection. Main thesis of the paper concerns a substantial role of the hunting law in realization of the environmental safety. At the beginning of paper, author scrutinized main terms, which influence legal definition of the term “ecological safety”. In the second part of the paper author described the polish hunting law regulations and its role in implementing the concept of the environmental safety. In the last part, author summarized and proved that polish hunting law regulations are in accordance with the constitution rule of the ecological safety and that it supports implementation of this rule.

    The review presents the analysis of resolutions and rulings of the Criminal Chamber of the Supreme Court adopted in the course of solving legal issues concerning criminal procedure in 2016. The following issues are discussed: the concept of the aggrieved (Article 59 §1 CPC), the appointment of a defence counsel on request (Article 80a §2 CPC), a compliant about the seizure of things versus the course of preparatory proceedings (Article 236 §1 CPC), conditional temporary detention (Article 257 §2 CPC), a complaint about a prosecutor’s decision containing a request that a bank provide information constituting bank secrecy (Article 301 §2 CPC), legal questions asked by appellate courts (Article 441 §1 CPC), valid court ruling concluding proceedings (Article 521 §1 CPC), awarding partial costs in cases initiated by public prosecution (Article 630 CPC), a complaint of a party whose right to a hearing without undue delay has been infringed as a result of action or inaction of a prosecutor supervising preparatory proceedings (Article 1(1) Act of 17 June 2004 on complaints about the violation of a party’s right to a hearing in preparatory proceedings conducted or supervised by a prosecutor and in judicial proceedings without undue delay), filing a written motion to a district court to order surveillance (Article 19(1) or (3) Act of 6 April 1990 on the Police), provisions binding in cases concerning requests that a resolution excluding a plaintiff from membership in a hunting organisation be quashed (Article 33(6) Act of 13 October 1995: Hunting law), transitional provisions (Act of 11 March 2016 amending the Act: Criminal Procedure Code and some other acts), a court bench (Article 30 Act of 11 March 2016), a court bench composition in cases concerning truthfulness of lustration declarations (Article 17 Act of 18 October 2006 on revealing information about documents of the state security bodies of 1944–1990 and the content of those documents), specific questions of the Supreme Court (Article 59 Act of 23 November 2002 on the Supreme Court), abstract questions (Article 60 §1 and §2 Act on the Supreme Court).

    Celem artykułu było przedstawienie w ujęciu historycznym, kodyfikacji prawa łowieckiego w zaborze austriackim na przełomie XIX i XX w. i wpływu jego poszczególnych rozwiązań na kształtowanie się stosunków myśliwskich w niepodległym państwie polskim po 1918 r. Początki tego procesu miały miejsce w połowie XIX w., kiedy to w ramach przeprowadzonych w państwach zaborczych (Cesarstwo Austrowęgierskie i Cesarstwie niemieckim) kodyfikacji praw podjęto prace nad uporządkowaniem zagadnień łowieckich. W celu zaprezentowania przebiegu prac nad kolejnymi etapami kodyfikacji prawa łowieckiego w zaborze austriackim na przełomie XIX i XX w., przebadano źródła wytworzone przez kancelarię Sejmu Krajowego Królestwa Galicji i Lodomerii do którego kompetencji przynależały kwestie kultury krajowej, w tym myślistwa. Były to: Sprawozdania Stenograficzne z posiedzeń izby z lat 1883–1910 oraz zawierające szczegółowe teksty i analizy poszczególnych projektów ustaw Allegaty ze wskazanego okresu. Uzupełnienie stanowił „Dziennik Ustaw i Rozporządzeń Krajowych dla Królestwa Galicji i Lodomerii wraz z Wielkim Księstwem Krakowskiem” zawierający teksty ustaw. W oparciu o powyższy materiał źródłowy przeprowadzono szczegółową analizę przyjętych rozwiązań, szczególnie w obszarze struktury okręgów łowieckich oraz odpowiedzialności za szkody wyrządzone przez zwierzynę łowną na terenach prywatnych. W oparciu o wyniki przeglądu galicyjskiego prawa łowieckiego posługując się metodą komparatystyczną i komentarzami do kolejnych kodyfikacji dokonano porównania rozwiązań wypracowanych w galicyjskiej ustawie łowieckiej z 1910 r. z zasadami organizacji łowiectwa przyjętymi w II Rzeczypospolitej (1918–1939) w ramach Dekretu Prezydenta Rzeczypospolitej Polskiej z 3 grudnia 1927 r. Pozwoliło to na wskazanie obszarów, w których nastąpiła implementacja wcześniejszych przepisów, m.in. w zakresie organizacji polowania i okręgów łowieckich. Wskazano również zasadnicze różnice, które wynikały z odmiennie definiowanego zjawiska polowania, w ramach porównywanych aktów normatywnych.
    The aim of the article is to present the codification of game laws in the territory of the Austrian Partition at the turn of the 19th and 20th centuries and the influence of its respective regulations on the shaping of hunting relations in the Polish independent state after 1918. The beginnings of this process took place in the mid-19th century when some work was undertaken in order to regulate hunting issues within the codification of laws carried out by the partitioning powers. I order to describe the proceedings referring to successive stages of the process of codification of game laws in the Austrian Partition at the turn of the 19th and 20th centuries, the sources produced by the chancellery of the Diet of the Kingdom of Galicia and Lodomeria were examined, the power of which embraced the questions of domestic culture as well as the sphere of hunting. These included parliamentary transcripts of chamber meetings from the years 1883-1910, some appendices dating from this period, which contain detailed texts and analyses of specific legislation drafts, and The Journal of Laws and Domestic Regulations for the Kingdom of Galicia and Lodomeria with the Grand Dutchy of Cracow. Using the above-mentioned material, a thorough analysis of the adopted solutions was conducted, particularly those concerning the structure of hunting districts and the problem of responsibility for damage caused by game on private land. Based on the results of the overview of the Galician hunting law and applying a comparative method together with commentaries on successive codification, a comparison was made between the regulations worked out in the Galician Hunting Act of 1910 and the rules of hunting organization, which were adopted in the Second Republic of Poland (1918-1939) under the Decree of the President of the Republic of Poland of December 3, 1927. This allowed the author to indicate the areas in which the implementation of the earlier regulations was effectuated in terms of hunting organization and hunting districts, among other things, as well as those in which there were fundamental differences resulting from the distinct definitions of the notion of hunting embedded in both pieces of legislation.

    The article analyzes the administrative and legal powers of forest protection and hunting service within the system of state management bodies in the field of forest protection and hunting. The relevance of the research topic is due to the processes of general reform of the forestry industry of Ukraine and the need to clarify the law enforcement powers of officials in this industry. The purpose of the study is to highlight the problems of law enforcement in the forestry industry; clarifying the powers of law enforcement entities, directions for reforming forestry law enforcement agencies, and prospects for improving their activities. The object of the study is the legal regulation of security activities aimed at ensuring law and order and legality in the forestry industry. The research is based on the use of general scientific and special methods. With the help of the dialectical method, internal contradictions in the activities of law enforcement agencies in the forestry industry were revealed. The analysis method is used to identify gaps in legislation regulating the powers of supervisory bodies, etc. Formulated conclusions are aimed at practical use. Thus, it is proposed: definition of the concept of «huntsman»; separation of the management function and state control in forestry enterprises; transfer of the control function to the level of territorial bodies of the State Forestry Agency. Thus, at the enterprises of the State Forestry Agency system and other permanent forest users, the functioning of forest protection will remain without the status of a law enforcement body, but with the right to draw up protocols and the limited right to consider cases of administrative offenses in the field of forest protection.
    У статті проаналізовано адміністративно-правові повноваження осіб лісової охорони та єгерської служби в межах системи органів державного управління галуззю охорони лісів та мисливського господарства. Актуальність теми дослідження зумовлено процесами загального реформування лісомисливської галузі України та потребою уточнення правоохоронних повноважень посадових осіб у цій галузі. Метою дослідження є висвітлення проблем правоохоронної діяльности в лісомисливській галузі; з’ясування повноважень суб’єктів правоохоронної діяльності, напрямів реформування лісомисливських правоохоронних органів та перспектив удосконалення їхньої діяльности. Об’єктом дослідження є правове регулювання охоронної діяльности, спрямованої на забезпечення правопорядку і законности в лісомисливській галузі. Дослідження побудовано на використанні загальнонаукових і спеціальних методів. За допомогою діалектичного методу виявлено внутрішні суперечності в діяльності правоохоронних органів лісомисливської галузі. Метод аналізу застосовано для встановлення прогалин у законодавстві, що регламентує повноваження контрольних органів та ін. Сформульовані висновки спрямовано на практичне використання. Зокрема, запропоновано таке: визначення поняття «єгер»; відокремлення функції господарювання і державного контролю в лісогосподарських підприємствах; передання функції контролю на рівень територіальних органів Держлісагентства. Отож на підприємствах системи Держлісагентства та інших постійних лісокористувачів залишиться функціонування лісової охорони без статусу правоохоронного органу, але з правом складання протоколів та лімітованим правом розгляду справ про адміністративні правопорушення у сфері охорони лісів.

    Opis:
    Zasadniczym celem artykułu jest omówienie rozwoju polskich uregulowań prawnych dotyczących zwierząt bezdomnych. Przeprowadzone badanie wykazało, że problem ochrony zwierząt bezdomnych przez całe dziesięciolecia był marginalizowany przez polskiego ustawodawcę. Przyczyniło się to w istotnym stopniu do powstania nadpopulacji zwierząt domowych i znacznego wzrostu liczby zwierząt bezdomnych. Obowiązujące aktualnie unormowania nie rozwiązują tego problemu, ponieważ bardziej koncentrują się na usuwaniu skutków bezdomności wśród zwierząt, niż na zapobieganiu temu problemowi.
    The main aim of the article is to discuss the development of Polish legal regulations on homeless animals. The research demonstrated that the problem of the protection of homeless animals had been marginalized by the Polish legislature for decades. This contributed significantly to the overpopulation of domestic animals and a significant increase in the number of homeless animals. The regulations currently in force fail to solve this problem as they focus more on remedying the effects of homelessness of animals than on preventing this problem.
