Opis:
Intercultural medical ethics are a new, necessary approach in ethics, as the example of Haiti dramatically showed during the aftermath of the catastrophic earthquake in 2010. For the search term « intercultural ethics » no hits are found in Google. Intercultural ethics are not meant to be a new kind of specialized or universal ethics, but are considered to be an immanent part of general ethical thinking and cover both systematical thoughtful reflexion and analysis of significant ethical subjects in medicine. At the same time it acknowledges and highly esteems interculturally different starting points, ways of thinking and living forms. Intercultural medical ethics respect explicitly a pluralism of moral values and counteracts moral relativism. The central reference is instead represented by anthropology and therefore the individual human being. It’s main instrument is communication (discourse ethics) on the same level. Intercultural medical ethics proceed from the participation of all in human existence and human dignity and do not call for one-sided reflexion, but positively, for responsible action.

Opis:
This article is about the human dignity which represents the phenomenon much discussed in the present society. Discussions about these issues function as a fundamental ground, but still it is not enough. The more important are the tendencies of society to implement this term to the practical life of the people. I decided to think about the human dignity in the context of ethics of social consequences; especially I focused on the theory of V. Gluchman. As the group of people with special needs create a significant object of my interest, my reflections about this theory of human dignity are connected to this special group. Gluchman does not think about the human dignity absolutely (as for example G. Collste), he rather considers several criteria as being needful for acquirement of human dignity. He introduces the scale of human dignity that includes individual numbers functioning as important boundaries, briefly number 1 stands for human dignity of all people when they are born, number 2 constitutes the human dignity of moral subject and other higher numbers can be achieved based on positive social consequences of their acts. There is one important question. What about the dignity of people with special needs, especially with those with mental handicap? They usually lack relevant qualities which constitute the criteria for being a moral subject. So it means that they can not obtain the higher level of human dignity then that represented by the number 2 (because this number stands for the dignity of moral subject). When concerning the group of people with mental handicap, I consider this scale with these special numbers (boundaries) as inadequate, because in my opinion it functions as some restriction for them. In this article I proposed two possible approaches which can be used in solution of this “problem.” Firstly, it is better to create a special scale of human dignity based on special needs of the people with mental handicap, because the fact is these people have their different and special needs as healthy people. Second possible way of attribution of higher dignity to people with special needs is to make it possible for them to omit the number 2 (the level of moral subject) in the scale of human dignity and to allow them to gain the higher dignity based on the consequences of their acts. We should always realize that the people with mental handicap are of the same value as we are and it should be our “moral duty” to help them and respect them.

The article shows the lost paradigms of human nature. It is also a sign of concern for respect for human dignity. The source of reflection is the thought written in the latest catechetical documents and the teaching of the Second Vatican council. The aim of the article is to recall theoretical assumptions important in catechetical ministry and to research for practical guidelines for their implementation. This goal is done through three points. The first is a reference to the philosophical and theological foundations that determine human dignity. The next step is to consolidate catechetical paradigms that express concern for the right view of man and his dignity. The third element is research for specific actions to promote human dignity. All considerations are interdisciplinary. His main thoughts and conclusions are the space of theological sciences. However, the issue raised requires the correlation of theological content with philosophical premises.

In Roman law confinement in jail as a means of containment of the prisoner to his subsequent trial and conviction, which coincides with situations in which the Roman legal system to exploit the defendant in sentencing in forced labor or in in metallum or in opus publicum. However, the jail met in Rome a suitable means preventive custody and not punishment, and the Roman law was never released on imprisonment as punishment for free men through judicial, as a result of a crime; therefore the prison was conceived as a means of police coercion or administrative judges, that is a security measure before trial by way of remand or awaiting execution. In this context, we will analyze how Roman law promulgates a series of norms aimed at dignifying the prison for the imprisoned, that is, the improvement in the treatment of prisoners due to the influence of Christianity to humanity as a recurring argument in the imperial legislation. The Standard Minimum Rules for the Treatment of Prisoners constitute the universally recognized minimum standards for the management of prisons and the treatment of persons deprived of their liberty and have had immense value and influence in the development of prison laws, policies and practices In Member States around the world, in 2015 it was promulgated under the name Mandela Rules. In this study, we will analyze how some of its principles are already beginning to be glimpsed in Roman law in relation to improvement of the conditions of the confinement´s place.

This article deals with the universal nature of human rights recognised by all civilisations and legal systems. The important thing is that the actions of the state are consistent with the content of these rights is justified by the fact that they protect the dignity of every human being and enable cooperation between people. Universal treaties impose the same international legal obligations in the field of human rights on as many states as possible. Regional treaties perform this function in relation to a group of states. It seems, however, that for the full protection of an individual’s rights, the ideas of universalism and regionalism of human rights need to complement each other. No regional system can exist if it is inconsistent with the norms and principles of the Universal Declaration of Human Rights.

What parents experience and learn becomes the living source for the pedagogical journey with their children. The author of this article explores various aspects of the new situation of education within the family in XXI century. He also reconsiders the challenges, concepts and contribution of the family in the educational mission in a contemporary European context.

In theology, a sin is described as mysterium iniquitatis and absolution from it— mysterium salutis or pietatis. In the New Testament a sin is always connected with absolution, “forgiveness,” and sinners are of great concern for Jesus. Nevertheless, modern culture becomes more and more detached from Christian tradition and thus deprives a human being of the spiritual values and makes him become further impoverished. This article provides a synthetic discussion of the reality of a sin—“mystery of illicitness” and also reflects on repentance and reconciliation with God and with one’s own neighbour. The reflections presented in this article are based on the teachings of the contemporary Church and on the Papal teachings especially.

An increasing number of children born from in vitro fertilization raises some questions: do children born from in vitro fertilization have the right to know their origins ? The answer may be run from the viewpoint of the child or from the parents. This problem is a really controversial issue: some people think that the right to know genetic origins is a fundamental human right, what’s more it is in the best interest of the child. On the other hand, others think that parents have the right to be anonymous. In the light of above worthy of particular attention is the position of judicial interpretation.

Many modern legal systems declare, that protection of human dignity plays an important role in its construction. Therefore, a question may be asked if the concept of dignity is similar in different legal systems. The following paper presents the results of the research on human dignity concepts in reasoning of national (Polish and German Supreme Courts) and international courts (ICC, ECHR). Both national systems provide a constitutional protection of human dignity, Rome Statute, which constitutes the ICC, prohibits behaviours infringing dignity (model of Geneva Conventions), whereas the European Convention of Human Rights does not include the term “human dignity”, only prohibition of torture or “inhuman or degrading treatment”, what is understood as protection of dignity. On the basis of the research there could be stated, that each legal system has developed its own concept of human dignity, although all concepts have a similar core, as nearly all ways of understanding “protection of human dignity” are combined with a commitment to respect each person. This kind of respect could be assumed as a basis of human dignity protection.

Aim: To put the human condition and the condition of the humanities in the perspective of critical human life situations and critical situations in the history of humanity. Methods: An analysis of primary sources and media statements by politicians and clerics. Results: The mutilation of human dignity is a constant element in the history of humanity. Man is a perpetrator, but also a victim of this mutilation. The constancy of mutilation of human dignity has its systemic sanction. Thus, it becomes a problem that transcends subjective conditions, for man is (becomes) a product of the system. Conclusions: The humanities, however, are incapable of putting what is singular, hat has happened, into a universal perspective beyond the area of declarative narrative. It is necessary, therefore, to reinterpret the basic concepts of the humanities seen in the perspective of critical human situations and the history of humanity.

The man is losing the ability not only to appropriately grasp one’s own human nature and the essence of the moral good, but also the ability of cognitive opening oneself to the intelligibility of being. A modern homo sapiens neutralises the need to seek the truth. After all, the truth ceases to be both a transcendental property of being and a superior value that is the very foundation of a rational discourse on the philosophical imponderabilia.

Opis:
The article deals with the potential infringement of human dignity through the choice of priority criteria for the provision of medical assistance in an emergency situation, when the treatment can only be provided for one person. The lack of sufficient equipment during the SARS-Cov-2 pandemic is a key example, but examples of acute shortage of medical personnel and various types of equipment are also analysed. The assumption made in the article is that selection guidelines need to be established for medical personnel. The text presents the concept of violation of human dignity and the issue of inability to provide assistance to an adequate number of patients. Then, with the use of the dogmatic-legal method, the proposed patient selection criteria such as age, social position, physical condition, and occurrence of comorbidities are analysed. As a result of the analysis, it is concluded that, due to the protection of human dignity, it is unacceptable to take away the assistance already provided for a patient (disconnection from the apparatus) in order to save the health of another patient. The criterion of assessing the patient’s health condition is unquestionable, whereas the choice of other decisive factors, such as a person’s social standing, may lead to unjustified discrimination and inequality.

This paper discusses selecting films (realized shortly before the COVID-19 pandemic) portraying the precariat in today’s world. Working poor in low-wage jobs cannot secure a livelihood, which creates frustration and leads to a loss of personal and social dignity among this social class. My main focus is human dignity in the face of poverty and economic and social marginalization, enabled by a political system allowing contemporary forms of exploitation. In this paper, I refer to social scientists and filmmakers who warn against the escalation of aggression brought on by this phenomenon. The research aim of my study was to acquire knowledge of how the precariat has been presented in selected films and whether and why this phenomenon is the cause of human dignity and social exclusion. The first part covers definitions of the terms involved (precariat, human dignity), while the second discusses three selected films that explore the subject above.
Pierwsza część artykułu zawiera omówienie kategorii prekariatu i godności ludzkiej, druga część poświęcona jest analizie trzech wybranych filmów przedstawiających sytuację ubogich pracujących. Analizowane w tekście filmy łączy problem nierówności ekonomicznych i społecznych, które prowadzą do prekaryzacji i wykluczenia.

Poverty, if it is not properly viewed by the public, may lead to the depersonalization of both poor and living in the midst of those who need help. Poverty is experienced by children in a specific way. They often suffer from hunger, they are undernourished, and they have limited access to a variety of goods, including culture and education. This, in turn, is often reflected in their self-esteem, a sense of self-dignity. The role of the school in fighting the poverty of the students is shown in this article. The existing forms of aid to poor students are presented, as well as the challenges facing the school in terms of helping marginalized students. It is also crucial for the teachers themselves to be trained in such a way that would promote not only the intellectual development of the students, but most of all – the pro-social attitudes and that would emphasize the value and dignity of a person.
