Artykuł wieńczą konkluzje na temat priorytetowych kierunków zmian w finansowaniu i organizowaniu ochrony zdrowia.
The aim of this paper is to revise selected demographic and epidemiologic trends regarding European societies. Next paper focuses on the implications of the defined trends on health care financing and organizing. The discussion is based on the comparative analysis of international statistics referring European region, mainly members of European Union. Then the conclusions are drawn regarding priorities in health care organizing and financing.

Contracting of health care benefits is a very important tool that allows a payer to create desired structure, considering the needs notified by the patients, the cost-effectiveness and the quality of the benefits. Contracting is aimed at attaining a number of important tasks such as the implementation of the existing rules of access to health care and the development of supply and demand in a way that facilitates the implementation of the adopted health policy. Contracting of health care benefits is thus an important tool enabling to introduce the regulated market and regulated competition. Therefore, a correct model for contracting of benefits is essential for correct exchanges of the limited (and specific) resources on the healthcare market. The purpose of this article is to assess the contracting of health care benefits by the National Health Fund. The following areas impacting on contracting of benefits were analysed: sources of financing, benefits purchase planning, valuation of benefits and the procedures for the award of contracts. A SWOT analysis was used to perform the analysis. At present the contracting of health care benefits in Poland is regulated by the Act of 27 August 2004 on health care benefits financed from public funds (consolidated text: Journal of Laws 2015, item 581, as amended). The article describes the legal situation on 31 March 2016. The conclusions from the analysis confirm the need for change, in particular by improving the cost efficiency and the implementation of activities promoting comprehensive care of a patient.

Both expenditure on healthcare and the functioning of the entire healthcare system in Poland stir up considerable controversy and are often discussed in the media. Hospital debts, the low quality of services, and the low availability of specialist medical services form the basis for the discussion of the effectiveness of the healthcare system. Statistical data are also bleak. Total health expenditure in Poland in 2019 amounted to 6.3% of GDP (estimated expenditure), whereas the average for health expenditure in the OECD countries was 8.8%. Therefore, Poland is below the average, and is placed last but four in the ranking (stat.oecd.org). The aim of this article is the presentation of public expenditure on healthcare in Poland from 2010 to 2020. In order to achieve this, the following research methods were used: a critical analysis of the literature, an analysis of statistical data, and - to make the research more transparent and the research results clearer - a tabular method was used. Also, widely accepted measurements were used, such as absolute values in domestic and international currencies, values per capita, and values in relation to the Gross Domestic Product (GDP).oduct (GDP).

The article is an attempt at diagnosing training needs of the employees of units operating in health care sector in the Podkarpacie Province. In times of permanent changes affecting each sphere of economy, providers of health care services cannot afford to remain outside this trend. Improving qualifications, adaptability of the offer, influencing its quality, and above all, the awareness of the necessity of these changes, have become an element which is fully integrated also with this sphere of public sector operations. Taking into account the above, the article verifies not only training needs articulated by employees of Health Care Centers (HCC) operating in the Podkarpacie Province, but also the way they are perceived by the managers of these centers, the ability to define training needs and their compatibility with characteristic features of analyzed HCCs. Therefore special emphasis has been placed on demonstrating the variety of diagnosed training needs with reference to such criteria as the size of analyzed centers, the market serviced by them, and their location. These determinants allowed us to conduct a complex analysis of conditions and structure of voiced need for subject training, and as a consequence, contributed to diagnosing the expectations of the health care sector concerning initiatives improving the quality of public services in the health care services area.

ObjectivesHealth care services in Poland are delivered by public and private providers. The aims of this study were to assess the attitudes towards private and public health care services in Poland and to identify differences between them, in the opinion of physicians.Material and MethodsA questionnaire-based survey was carried out among physicians attending mandatory courses delivered at the School of Public Health, the Centre of Postgraduate Medical Education in Warsaw, Poland. The questionnaire included 29 questions concerning private and public health care services.ResultsCompleted questionnaires were obtained from 502 physicians (67.7% females), aged 42.1±10.8 years, with a response rate of 77.2%. In the opinion of the surveyed doctors, the major advantages of private health care units, in comparison with public ones, are short waiting times for an appointment (88.2%), an efficient on-site service (78.6%) and convenient appointment times (75.7%). The respondents gave high scores to items such as relations with patients (p < 0.001), superiors (p < 0.001) and colleagues (p = 0.03) when working in private, rather than public, institutions. In the opinion of physicians, public health care institutions guarantee better employment conditions (44.4% vs. 13%; p < 0.001) and security (29.1% vs. 11.1%; p < 0.001) than private ones. The respondents did not observe any differences (p > 0.05) between public and private facilities in terms of the involvement of medical staff and infrastructure. There were significant differences (p < 0.001) in the perception of working conditions in public and private health care institutions depending on the medical education level and the place of primary employment. Conclusions: Among physicians in Poland, private medical institutions are perceived as better organized and granting faster as well as more comprehensive access to health care services when compared to public ones. Closing the gaps between working conditions in public and private units could encourage physicians to practice in the public health care sector.

The smooth operation of the health care system largely depends on how it is financed. The analysis assumes that the Polish system is not enough financed and poorly adapted to the changing socio-economic trends. Artykuł dotyczy uwarunkowań prowadzenia skutecznej publicznej polityki zdrowotnej w krajach rozwiniętych. Wbrew postulatom urynkowienia sfery opieki zdrowotnej, głoszonym na fali nowego zarządzania publicznego, ochrona zdrowia zachowała swój specyficzny, publiczny charakter. Istotne znaczenie należy przypisać w tym kontekście zabezpieczeniu zdrowotnemu, traktowanemu z jednej strony jako fundamentalny cel współczesnych systemów zdrowotnych, z drugiej zaś istotny motyw zaangażowania państw w finansowanie opieki zdrowotnej. Poszerzanie zabezpieczenia zdrowotnego w dużej mierze opiera się na środkach publicznych, w wielu przypadkach transferowanych metodą budżetową. Stąd prywatne dobrowolne ubezpieczenia zdrowotne mają jedynie uzupełniający charakter i nie mogą być postrzegane jako rzeczywista alternatywa publicznych źródeł finansowania opieki zdrowotnej. W analizach systemów zdrowotnych niezbędne jest kompleksowe podejście, uwzględniające różne aspekty systemu ochrony zdrowia, nie zaś wyłącznie dotyczące źródeł finansowania i mechanizmów alokacji środków.
The article concerns the circumstances of carrying on effective health policies in developed countries. Contrary to the ideas of marketization of medical care promoted in accordance with new public management, health care retained its specific, public character. The essential significance in this regard can be attributed to health protection which should be treated on the one hand as a fundamental goal of contemporary health systems, and on the other - as a decisive motive of state involvement in health care financing. The possibility of broadening health protection depends to a large extent on public resources, in many cases transferred by budgetary methods. Hence private voluntary health insurance may be only of a supplementary character and can not be regarded as a real alternative to public financing. When analysing health systems, a comprehensive approach is indispensable, with various aspects of health systems, not only these concerning financial sources and allocation mechanisms being taken into consideration.

Stan polskiego systemu zdrowotnego nie jest zadowalający. W opracowaniu zwraca się uwagę na potrzebę wprowadzenia zmian instytucjonalnych w systemie ochrony zdrowia w Polsce w kontekściem różnych problemów i wyzwań. Do najważniejszych z nich należą: zmieniająca się sytuacja demograficzna (starzenie się społeczeństwa, migracje Polaków za granicę), niedobory kadr medycznych, różnice w ich terytorialnym rozmieszczeniu oraz problem dostępności usług medycznych i występowanie kolejek do specjalistów. Podjęta została również kwestia panującego w ochronie zdrowia konfliktu interesów oraz trudności w uzyskaniu porozumienia dotyczącego charakteru wprowadzanych zmian przez różne grupy interesariuszy. Dokonano przeglądu sposobów finansowania systemu zdrowotnego w Polsce w ujęciu historycznym – począwszy od zakończenia II wojny światowej do powstania w 2003 r. Narodowego Funduszu Zdrowia. Zwrócono też uwagę na problem braku spójności ustaw regulujących polski system ochrony zdrowia i występowanie zjawiska odpowiedzialności rozmytej. Następnie przeanalizowano planowane zmiany w ramach reformy proponowanej przez ministra zdrowia Konstantego Radziwiłła. Ich głównym założeniem jest zmiana modelu finansowania systemu ochrony zdrowia oraz likwidacja Narodowego Funduszu Zdrowia.
The state of the Polish health care system is not satisfactory. In the elaboration the author discusses the need for introduction of institutional changes in the health care system in Poland in the context of various problems and challenges. The most important of them are the following: the changing demographic situation (ageing population, migration of the Poles abroad), the shortage of medical personnel, the differences in their territorial placement and problem of availability of medical services and the occurrence of queues to specialists. Also the issue of the dominating conflict of interest in health care was taken and the difficulties in reaching an agreement concerning the nature of introduced changes by various groups of stakeholders. A review was made of the ways of financing the health system in Poland from the perspective of history – beginning from the end of the World War II to the creating of the National Health Fund in 2003. Also attention was paid to the problem of the lack of coherence of the laws regulating the Polish system of health care and the occurrence of the phenomenon of softened responsibility. Next the author analysed the planned changes within the framework of the reform proposed by the minister of health Mr. Konstanty Radziwiłł. Their main assumption is the change of the model of financing of the health care system and liquidation of the National Health Fund.

has dramatically increased. The number of visits to EDs can be an important indicator of the quality of primary health care. Objectives. To analyse: 1) the frequency of admissions to EDs, 2) the type and number of medical procedures performed in EDs, and 3) the type and number of services provided by PHC in the Kedzierzyn-Kozle district. Material and methods. A retrospective analysis of the statistical data regarding services provided by PHC in the Kedzierzyn-Kozle district within the National Health Fund (NHF) and data from the hospital emergency department in Kedzierzyn-Kozle (Opole Province, Poland). Results. The results showed an annual increase in the number of hospitalisations (13,815 – 2012, 14,192 – 2013, 15,123 – 2014) and the number of medical procedures performed in the ED (mainly those from I–III categories), as well as the low rate of admission from the ED to ICU (Department of Anaesthesiology and Intensive Care). There was an increase in the overall number of consultations given by a primary health care doctor and the total number of healthcare services provided at night and during holidays. Conclusions. Reducing the number of non-urgent visits to EDs can be achieved by making efforts to meet the needs of patients at the level of primary health care, in particular through better coordination of services provided by EDs and PHC and better motivation of primary care doctors to perform the role of gatekeeper to the health care system

The legal rules of implementing the health care services to advantage of the persons having voluntary health insurances by the public health care unitsBecause of the difficult financial standing of the public payer, independent public health care facilities (SP ZOZ), specially hospitals, are searching the new sources of income. Patients, waiting for admission to hospitals for months, are much more interested in achieving in a lawful way a better access to health services. In view of no offer for additional voluntary insurance provided by our native entities, especially in the area of hospital benefits, foreign insurance companies (registered in the European Union), independently or together with Polish Partners are launching such products on our market. The official standpoint of the Ministry of Health is, that the independent public health care facilities, which have signed contracts with the National Health Fund, are not legally entitled to render health care services for people with additional voluntary insurance in any of the EU Insurance Companies. The  egalsystemic argumentation presented in the above material has proved, that in accordance with the Article 68 of the Republic of Poland  constitution Act and its limitations, as well as the health care facilities and financing health services act within the framework of public funds, spozoz which have contracts with the National Health Fund, are entitled to render health services for people who have own additional voluntary health insurance.

The aim of this paper is to analyse whether the medical rehabilitation segment is an important part of the entire Polish healthcare system, and if the medical rehabilitation services are provided with adequate levels of financing and management. The study reviews published literature and legal acts, and undertakes an analysis of data acquired from international and national health data repositories. In Poland there exists no coordination between medical, vocational and social rehabilitation or between the rehabilitation delivered by the health resort facilities. There is an observed lack of coordination among public fund payers. The described lack of coordination influences not only patient treatments (it is difficult to measure outputs and outcomes), but also makes summarizing the total expenditures on curative rehabilitation more difficult. Even though numerous countries spend a smaller or comparable amount of money on rehabilitation (per patient), funds allocated to rehabilitation in Poland (expressed in PPS) are over seven times lower than in France, about five times lower than in Austria and Belgium, and three times lower than in the Netherlands.

Introduction and objective. Measuring the level of patient satisfaction is a useful tool in delivering quality care that is responsive to consumer preferences. Various socio-demographic factors might be considered as potential predictors of patient satisfaction. The aim of the study was to assess whether place of residence (rural/urban) affects patient satisfaction with hospital health care. Materials and method. Data were obtained using face-to-face questionnaire, administered in five large, urban hospitals in Podlaskie Province, north-eastern Poland, during 2014–2018. The study sample comprised of 1,624 participants (585 rural, 1039 urban) who assessed satisfaction with 28 hospital health care items. The means and standard deviations were presented to compare 28 satisfaction items between the rural and the urban samples. Regression analysis was used to determine whether location difference (rural vs urban) affected patient satisfaction with various domains of hospital health care. Results. The mean results of 28 satisfaction items on the 1–5 scale were similar among the rural and the urban samples, and generally skewed towards positive experiences. In the univariate analysis, significant associations between place of residence and patient satisfaction were identified with regard to three components of inpatient care: 1) hospital settings and staff care, 2) doctors’ professional skills, and 3) hospitalization outcomes. After adjusting for socio-demographic variables, the association remained significant only with respect to satisfaction with hospitalization outcomes (b = 0.121; SE = 0.055; p = 0.028). Conclusions. Some evidence for differences in patient satisfaction by place of residence was found. Study findings may be helpful in implementing care quality improvement programmes.

This study is divided in three parts which intend to meet the following targets: Primarily to provide theoretical approaches toward the concept of equality in the healthcare. In the theoretical treatment of the concept of equality in health care the authors are cautious while making the difference between equality and justice; between equality in levels of health or health care and equity in financing etc. Secondly target it to assess the concept implemented in our legislation and make an overall assessment of whether this legal framework is comprehensive and convenient for the realization of the right to health care enshrined in the Constitution. The Albanian legislation stipulates that health care in the Republic of Albania is guided by very important principles. These principles embody the Constitution predictions from the formal point of view, primarily when declaring the right to health care as a key right of the individual, as well as when guaranteeing the equal rights based on non-discrimination. Thirdly to determine some of the specific areas of the legislation, which have to be improved and completed. After the analysis make in this paper, we found the need for some theoretical and practical improvements, which are reflected in the conclusions.

The necessity is emphasized to distinguish between the traditional model of data acquisition reported by a patient in doctor’s office and the more valuable and desired model to become acquainted with the core of the problem by going to a patient’s domicile. In the desired model it is possible to come across various determinants of health during home visits. Family members can be approached and there is a possibility to evaluate the relationships between the patient and his loved ones. One can visually assess one’s living conditions and predictable environmental hazard. For several years, the desired model has been put into practice by general practitioners and home health care nurses. Recently this model is also promoted by “health care therapists” who are members of “teams of home health care”. The authors, being convinced of the merits of “home and environmental model” of practical medicine, have developed a method of recording and illustrating data collected during visits in patient’s home. The elaborated tool helps to communicate and exchange information among general practitioners, home health care nurses, social workers of primary health care centers and specialists. The method improves the formulation of the plan of further therapeutic steps and remedial interventions in psycho-social relations and living conditions of patients.
Autorzy pracy podkreślają na wstępie, iż należy rozróżnić tradycyjny model obsługi problemu zdrowotnego, zgłaszanego przez pacjenta w gabinecie lekarza, na ogół przy jego biurku od bardziej wartościowego sposobu zaznajomienia się z istotą problemu poprzez udanie się do miejsca zamieszkania chorego. W trakcie takiej wizyty domowej jest możliwe zapoznanie się z rozmaitymi uwarunkowaniami stanu zdrowia pacjenta. Można poznać członków rodziny i ocenić relacje jakie zachodzą pomiędzy chorym a jego osobami najbliższym. Można naocznie ocenić jego warunki bytowe i ewentualne szkodliwości środowiskowe. Od kilkunastu lat ten drugi model czasami realizują lekarze rodzinni i tzw. pielęgniarki środowiskowe (środowiskowo – rodzinne). Ostatnio propaguje się poszerzenie takiego sposobu zaznajamiania się z problemami zdrowotnymi przez zalecenie go tzw. terapeutom środowiskowym, którzy są członkami tzw. „zespołów leczenia środowiskowego”. Autorzy pracy, będąc przekonani o zaletach owego „środowiskowego modelu” medycyny praktycznej opracowali metodę odnotowywania i ilustrowania danych pozyskiwanych w trakcie wizyt w domu chorego. Opracowanie przez nich narzędzie ułatwia przekazywanie i dyskutowanie danych pomiędzy pielęgniarka środowiskową, a lekarzami ośrodków podstawowej opieki zdrowotnej i specjalistami jak i pracownikami socjalnymi. Metoda doskonali ustalanie planu dalszych działań terapeutycznych i interwencji korygujących relacje psychospołeczne i warunki bytowe pacjentów.

Quality measurement is the first step in improving overall quality. Servqual has been identified as one of the most important methods frequently used in assessing the quality of healthcare services. This study aims to systematically review and conduct meta- analysis of conducted studies in this regard in which Servqual tools were used to assess and measure the quality of services. In this systematic review and meta-analysis, the required data were collected using several keywords (and their Persian equivalents): services quality, Servqual, quality, gap, primary health cares, health services, Iran. The databases searched were as follows: PubMed, Scopus, Google Scholar, SID, Magiran, and Iranmedex. The comprehensive meta-analysis (CMA) software, Version 2 was used for data analysis. Based on the random effect model, the total mean score of Service Consumers’ perception, Service Consumers’ expectation and the gap between them were estimated as being 3.81 (95% CI: 3.56–4.06), 4.49 (95% CI: 4.31–4.67) and -0.83 (95% CI: -065 – -1.01), respectively. The lowest score of consumers’ perception of services quality, was related to the empathy dimension (3.57) and the highest score of consumers’ expectation of services quality was related to the reliability dimension (4.60). Furthermore, there was a quality gap in all dimensions. In order to achieve desired quality and meet service receivers’ needs, attention should be always given to their views, so that proper planning can be done to address existing problems through assessing views. Should such be undertaken, we would be able to witness services quality improvement.

The level and quality of healthcare defines the sense of safety of patients who use medical services. Proper analysis of causes, monitoring and reporting of unwanted occurances and medical errors can help evaluate healthcare systems. Focussing on ergonomic conditions of those events lowers their number and reduces damage.

This article analyses issues related to the financing and effectiveness of health care systems. The first section reviews the new concept of sustainable development adopted by the United Nations – Agenda 2030. The next two sections present the process of health care transformation in Poland and the basic indicators of health financing in the European Union member states (total expenditure on health, general government expenditure, private expenditure, out-of-pocket expenditure). The final section assesses the selected health indicators for Poland versus the EU member states, with particular focus on the Euro Health Consumer Index produced by the Health Consumer Powerhouse.

Rosnące zainteresowanie efektywnością usług publicznych skłania do stałego poszukiwania sposobów takiego zarządzania organizacjami, które realizują usługi publiczne, aby te potrafiły zaspokoić oczekiwania społeczne, zarówno w aspekcie ich dostępności, jak i jakości. Istotą podejmowanych działań jest efektywne realizowanie czynności społecznie uznanych za ważne. Zdrowie i jego ochrona odgrywają ważną rolę dla każdego człowieka, dlatego też stanowią przedmiot szczególnego zainteresowania. Funkcjonowanie ochrony zdrowia jest procesem wyjątkowo złożonym, zaś na państwie spoczywają obowiązki związane z jego organizacją. W artykule podjęto próbę zdiagnozowania czynników bezpośrednio wpływających na stan systemu opieki zdrowotnej w Polsce. Przedstawiono wszystkich uczestników systemu ochrony zdrowia, a następnie poszczególnym jego beneficjentom przypisano przysługujące im prawa i obowiązki. W kolejnym kroku przeanalizowano działania każdej ze stron, aby finalnie uwypuklić działania, które destabilizują system, czyniąc go nieefektywnym. Wykazano ponadto, że dla dwóch z trzech głównych uczestników systemu, pacjent stał się raczej sposobem zarabiania pieniędzy, aniżeli docelowym beneficjentem jego starań, w myśl zasad, dla których powstał.
The growing interest in the efficiency of public services leads to constant search of ways such management organizations; public services to those able to meet the social expectations, both in terms of their availability and quality. The essence of the measures taken is the effective implementation of activities considered socially important. Health and its protection play a special role for every human being, and therefore are of particular interest. The functioning of health care is particularly complex process, and the State have obligations associated with its organization. Thus, the article is an attempt to diagnose the factors directly affecting the state of the health care system in Poland. We present all participants in the health care system and its individual beneficiaries assigned their rights and responsibilities. In the next step we analyzed the action of each of the parties to finally highlight the actions that destabilize the system, making it ineffective.

The article explores the main driving forces behind the decentralization and centralization processes and the pro and cons often presented in this respect. The paper goal focuses on the analysis of the potential incentives (driving forces) initiating the processes of decentralization/centralization with the use of the arguments concerning the sphere of sciences in regard to the public administration, political sciences and management theories. The theoretical perspective offers the three concepts of the driving forces useful for the explanation of relationships between health systems and the realized decentralization strategy: (1) concerning the system’s performance issues; (2) the legitimacy questions, and (3) the self–interests of the given subject. The first category reflects the influence of vision of health systems functioning as organisms that can be adjusted to the new circumstances by the strategists and decision makers. The second perspective concentrates on the legitimacy. It concerns the vision of the organisations representing a particular social culture. Legitimacy and cultural adequacy are the important factors from the decision- makers perspective at all the organisational levels, enabling support and change. Self-interest (the third perspective) focuses on the personal and institutional engagement and real (material) interests as a driving forces for decentralization. It creates the image of health care organisations as politically related systems characte4rized by the conflict situation rather than unification of goals, plans and strategies

The health care system in Poland is an important element of the activities of state authorities. Public opinion polls confirm the need for reforms in this area. The health sector comprises healthcare, public health and health-related social welfare activities and as a whole requires operational improvement. Well planned activities should improve health security in general. One of the ways to improve the effectiveness of healthcare entities is commercialization of independent public healthcare institutions. It is in line with the generally observed tendency to more and more frequently outsource tasks to external entities by public administration. In this way, the traditional tasks of public administration, so far performed mainly by the public finance sector, are entrusted to private entities. However, this does not change the scope of public authorities’ responsibility for the functioning of healthcare security.

In the article an attempt was made to present the assumptions of Polish legislative solutions concerning e-health in the context of one of the basic principles of European philosophical and legal thought – the principle of subsidiarity. The principle of subsidiarity, the essence of which is to leave it to the political communities to carry out tasks for which they can take responsibility, has been incorporated into the legislation of nation states and the European Union, determiningthe identity of European civilisation. Article 5 of the Treaty on European Union and the Treaty on the Functioning of the European Union and the preamble to the Constitution of the Republic of Poland are an example of the translation of the subsidiarity principle into legal norms. Attention has been paid to the possibility of decentralising and delegating competences to lower levels of public authority in the field of health, using or amending the e-health legislation accordingly. Appropriate division of tasks and competences in the area of health care, taking into account the subsidiarity principle, can be observed at both national and EU level. European Union law recognises the autonomy of the Member States to define national health regulations. On the basis of selected national and EU regulations, a definition of e-health has been proposed, understood as a set of provisions within the health care system regulating the collection, processing of data and provision of health care services in order to identify and optimise the satisfaction of individual and collective health needs as well as to pursue an effective health policy by public authorities. The basic assumptions of key national and EU legal acts are also indicated. On the basis of the solutions adopted in the Act on Health Care Services Financed from Public Funds, the formal possibility of delegating and effective performance of tasks has been demonstrated in the field of health protection by local government units. New information and communication technologies provide the basis for a more complete implementation of the subsidiarity principle in health protection, as they enable the necessary knowledge on the collective and individual health needs at European, national and any other expected level – regional, population, age to be gathered and transferred. They are a tool, previously unavailable, for the precise identification of the needs of separated communities. On the other hand, new technologies can be a tool for communities to meet these needs to the extent that they are able to provide organisational and financial security. The combination of new information and communication technologies with the application of a systematic concept of tasks implementation based on the principle of subsidiarity will allow for a change in the model of health care in Poland.

The aim of this paper is to characterize the problems of immigration and subsequent integration of foreigners in the Czech Republic. The starting point is a brief historical perspective on the development of migration policies of the Czech Republic and the development of immigration in recent years. The aspects discussed in particular are education and health care, as the main factors affecting the integration of immigrants. The analysis suggests a pivotal role of the state in the activities focused on the integration of foreigners, an important role is played by non-profit organizations. In the end of the paper attention is focused on the Czech public attitude to immigration. Active immigration policy in the Czech Republic began in 2003. Currently, integration is understood as an essential part of the immigration policy of the Government of the Czech Republic. Integration of foreigners into the Czech society is directly linked to the process of immigration and is crucial for the smooth immigrant participation in the local labor market and life in the country. The main problem is the lack of knowledge of the Czech language by adult immigrants and especially their children, lack of knowledge of the Czech language, which significantly complicates the possibility of integration into the Czech society. Access to health care is another critical area of integration.

Moreover, as regards the Polish health care sector, we indicate the expenditure forecasts. The article concludes with a comparison of the state of the Polish system to the state of the systems in other European countries.

Healthcare is a very important, and at the same time difficult element of each state’s policy. For many countries, the issue of financing the healthcare system is a delicate matter, while at the same time one of the basic economic and social issues. Aim: The paper aims to study and present the case study of the health sector of India. The paper also aims to identify the opportunities for the application of Big data in the health sector. The major stakeholders of the system viz. doctors, hospitals, clinics, insurance companies, pharmaceutical companies, research, and development organizations, industries manufacturing medical instruments, laboratories, medical data analysts, and many more are utilizing big data and predictive analytics in their critical decision making. The predicted revenue was expected to reach 280 billion by 2020 as per the statistics given by the Indian Brand Equity Foundation. Research methods: A critical review has been conducted using electronic sources between 2015 and 2020, limited to English language articles and reports published from 2015 onwards. The reviews will be classified to identify the opportunities for future application of Big Data. Conclusions: The paper presents a trend in the use of Big Data Analysis in the health sector. The paper also explores and identifies the areas of future application of big data to increase the efficacy of the system. Originality/value of the article: This is an original piece of article in the context of India in terms of documenting the big data applications in the health sector and identifying the opportunities for the future application of the same.  Implications of the research: This research holds a significant contribution towards the implications of the application of Big Data in the health sector. The newly identified areas of the health sector, which can be improved by using the big data analytics, are important for the policy makers of the organizations, including the Government.  Limitations of the research: The research has been conducted based on the secondary data, which area available in the public domain. However, due to COVID 19, there could have been more innovations in the health sector in terms of using the big data, which may not have been published or are available in the public domain. Also, collection of the primary data in terms of an interview with the administrators/management can be explored in the future study.

Światowy kryzys gospodarczy wywarł również wpływ na stan finansów systemów ochrony zdrowia, mierzony poziomem i dynamiką zmian wydatków na zdrowie per capita, ich relacją do PKB i strukturą finansowania. Autorzy wykazali, że charakterystycznym zjawiskiem jest opóźnienie reakcji finansów systemów ochrony zdrowia na pogorszenie koniunktury gospodarczej krajów europejskich.Opracowanie zaś kończą rozwaąania przewidywanych scenariuszy finansowania opieki medycznej w przyszłości.
World economic crisis strongly affected healthcare outlays in terms of both their level and dynamics, measured by health care expenses per capita and relation of health care expenditure to GDP. Moreover, it had a significant impact on the structure of health care outlays. The authors demonstrated that in Europe changes in health care financing being the result of a slump in the economy, were observed with a delay. In addition, the authors developed several possible future scenarios of health care financing, which are presented in the last part of the publication.

In 2019, twenty-five years have passed since the implementation of the first legisla-tive act introducing for the first time family doctors (primary health care physicians) into the Polish model of basic health care. The beginning of changes in this area, falling in the nineties of the last century, was not easy and has not yet been complete but will continue until the end of 2024. Over the years, not only the conditions for the education and professional development of primary health care physicians, in-cluding family doctors, have undergone changes. Also the organisational and legal forms of providing basic health services by this group of doctors were changing, as well as the conditions allowing patients, the recipients of medical services, to choose their doctor from among those with whom health insurance institutions (health insurance funds, or the National Health Fund) concluded agreements on the provision of basic health care services, or those employed by a medical entity with whom the National Health Fund signed relevant agreements.The scope of changes introduced at that time was wide, and when it started at the beginning of the 1990s it was almost impossible to achieve the goals without the support of the World Bank and the PHARE programme, alongside the efforts of the Ministry of Health and Social Welfare and three regional health care consortia (unions). Their work and contribution of each of them and their activities were sig-nificant and together constituted a solid basis for further work on the improvement of the model of a universal primary health care after 1998.The Act on primary health care of 2017 has completed the process of changes in this respect. For the first time, the objectives of the basic, or primary health care have been clearly defined. Although the implementation of each of these objectives is to serve the patient who is the recipient of the services, the value of the services pro-vided by primary care physicians varies. Family doctors (general practitioners) are to provide the patient and the patient’s family with health care services, coordinating at the same time all the stages of the process of their provision. However, the social mission of their profession is to ensure the implementation of broader tasks, such as health promotion adapted to the needs of various groups of society, education of the medical services recipients in the field of responsibility for their own health, as well as shaping pro-health awareness, setting health priorities of the population covered by care and implementation of preventive actions.

The article presents the evolution of cost accounting in the Polish health care system. There are presented the causal factors of poor quality cost information, and the characteristics of currently operating solutions is given. Objective. To examine disparities in access to the public in Poland, in association of the resources of health care, socioeconomic development of Provinces and their level of urbanization. Materials and method. The Provinces were divided into four groups, using the quartile method, according to the urbanization and level of socio-economic development. The socio-economic development level was identified by the Human Development Index (HDI) for each Province. The urbanization level of each Province was determined by the Index of Urbanization (URBI). Disparities level to access to public health care was identified by taxonomic measure of accessibility (TMA), calculated using resources of health care data. TMA index was compared in the different regions, depending on the level of HDI and URBI. Results. There was no linear relationship between accessibility to public healthcare and socio-economic development of each tested region, nor between accessibility to public health care in the Provinces and their urbanization level. During the study, the correlation between the TMA and HDI and URBI alsdo produced a negative result. Conclusions. An insufficient number of physicians and the limited value of contracts within the public health service may cause a drop in the availability of the public medical service sector, regardless of regional level of urbanization and socioeconomic development.

For several decades the health care service in Poland has been an institution at the centre of attention of both those in power and society as a whole. There are many reasons for this interest, ranging from the economic aspect to the national social policy sphere. This article provides an insight into health issues in Poland from a slightly different perspective. It contains an analysis of the institutions of the health care system in Poland in terms of its multidimensional social responsibility as a special kind of obligation to all community members. It highlights social responsibility as a modern tool for managing contemporary organisations, including public ones. The study also includes an analysis of the range of opportunities to make demands on the management of healthcare services in the field of health security. The health care system in Poland is one of the most strategically important fields for the state's social policy, which has recently been confronted with probably the greatest test in the post-war history of this country. It is becoming increasingly common among practitioners and experts in the social sciences to use the concept of health security as an integral part of designing the state's internal security strategy. The author also considers the health care system as a set of institutions constituting one of the greatest organisational challenges for both effective social policy and Poland's internal security in the years to come.

Responsibilities in the field of health care have been imposed on public authorities in the Polish Constitution. The most important of these is the need to ensure citizens, regardless of their financial situation, equal access to healthcare services financed from public funds. Other responsibilities of public authorities is to provide special healthcare to children, pregnant women, disabled people and elderly people, as well as to combat epidemic illnesses and prevent the negative health effects of environmental degradation. In addition, the State should promote the development of physical culture, particularly among children and young people. The considerations undertaken in the article apply primarily to implementing of the above-mentioned liability of providing high-quality health care for children, pregnant women, disabled people and elderly people. Regrettably, the analysis of binding legal acts, current health care programs and the Commissioner of Patients’ Rights reports leads to the conclusion that the State does not fulfil the obligation in a satisfactory manner.
Obowiązująca Konstytucja RP nakłada na władze publiczne obowiązki w zakresie ochrony zdrowia. Najważniejszym z nich jest konieczność zapewnienia obywatelom, niezależnie od ich sytuacji materialnej, równego dostępu do świadczeń opieki zdrowotnej finansowanej ze środków publicznych. Innym obowiązkiem władz publicznych w zakresie ochrony zdrowia jest zapewnienie szczególnej opieki zdrowotnej dzieciom, kobietom w ciąży, osobom niepełnosprawnym oraz osobom starszym, a także zwalczanie chorób epidemicznych i zapobieganie negatywnym dla zdrowia skutkom degradacji środowiska. Ponadto państwo powinno wspierać rozwój kultury fizycznej, zwłaszcza wśród dzieci i młodzieży. Rozważania podjęte w artykule dotyczą głównie realizacji obowiązku zapewnienia szczególnej opieki zdrowotnej dzieciom, kobietom w ciąży, osobom niepełnosprawnym i osobom starszym. Niestety, analiza obowiązujących aktów normatywnych, aktualnych programów zdrowotnych oraz sprawozdań Rzecznika Praw Pacjenta prowadzi do wniosku, że państwo nie wywiązuje się z niego w sposób zadowalający.

Profilaktyka opieki zdrowotnej, wchodząca w skład prewencji zdrowotnej, ma bardzo znaczący wpływ na stan zdrowia jednostek, a w konsekwencji na społeczeństwo jako całość. W Polsce zauważa się znaczne różnice w stanie zdrowia i jakości życia w poszczególnych regionach. Głównym problemem jest niedobór właściwego wsparcia finansowego w niwelowaniu różnic, jak również niewystarczające działania niektórych regionów pod względem wspierania zachowań prozdrowotnych, np. brak odpowiednich mechanizmów przeznaczonych do realizacji zakładanych celów. Analizy wskazują na podobieństwa i różnice, które można zaobserwować w poszczególnych województwach w Polsce. Wynikają one z określenia wspólnych cech w odniesieniu do aktualnie realizowanych programów profilaktyki opieki zdrowotnej, wykrywania specyficznych symptomów chorób, a także pojawiających się szans w ich dalszym leczeniu. Badaniem objęto profilaktyczne programy zdrowotne realizowane na poziomie makro, jednakże najwięcej uwagi poświęcono województwu łódzkiemu, ze względu na niekorzystne środowisko epidemiologiczne i demograficzne – analizy dla województwa łódzkiego zostały przeprowadzone na poziomie NUTS–4. Ponadto artykuł skupia się na szacowaniu jednostkowych kosztów pomiaru programów zdrowotnych realizowanych w regionie łódzkim (finansowanych przez samorząd wojewódzkiego łódzkiego) w kategoriach per capita, a także w wartościach pierwotnych. Dzięki temu możliwe było wskazanie programów zdrowotnych, które okazały się najbardziej kosztowne, jak również tych, które cechowały się największą oszczędnością, przyczyniając się do stosunkowo wysokiego poziomu efektów zdrowotnych.
Health care prophylaxis as an element of health prevention has a major impact on health status of individual unit and consequently on society. In Poland there are significant disparities in health status and quality of life appearing in each region. The main problem in this field is the shortage of the appropriate financial support for combating these disparities, as well as insufficient action of some regions in terms of the promotion of healthy behavior, resulting in, eg. by the lack of suitable mechanisms required for their implementation. The result of the analyses should indicate the similarities and differences that exist in Polish voivodships. These result are from the defining common features in relation to ongoing programmes of health care prevention, detection by their specific disorders, as well as appearing opportunities for further treatment of selected diseases. The study included preventive health programmes implemented at the macro level, although most attention was paid to the Lodz province, due to its unfavourable epidemiological and demographics environment – analysis for the Lodz voivodships will be carried out at the NUTS–4 level. In addition, the article focuses on estimating an unit costs measurement of health programmes implemented in the Lodz region (financed by the Provincial Government of Lodz), in terms of per capita, as well as, in incremental values – in this way was possible to identify health programmes that have proved to be the most expensive, as well as identify those that manifested the greatest savings, contributing to the relatively high level of health effects.

The aim of the article is to show the aspects of health care policy, the main aims necessary for the entities corresponding to these aspects and, above all, the changes introduced by the reform of health service adopted by the Law and Justice government. The activities of the current government in the area of health protection clearly modify the system towards the National Health Service, whose model originates from Great Britain, where it has been in operation since 1948. The modifications introduced in the Polish system are aimed to streamline it, improve its effectiveness and accessibility for citizens. Designed and implemented transformations of the health care system in Poland, based on specific aspects as a result of government reform, introduce a system that in the long run will implement the principles of universal, unrestricted access to health services at the best possible level.
Celem artykułu jest ukazanie wymiarów polityki ochrony zdrowia – głównych celów koniecznych do realizacji przez podmioty odpowiedzialne w ramach tych wymiarów, a przede wszystkim zmian wprowadzanych reformą służby zdrowia rządu Prawa i Sprawiedliwości. Działania obecnego rządu w obszarze ochrony zdrowia jednoznacznie modyfikują system w kierunku Narodowej Służby Zdrowia, której wzór zaczerpnięto z Wielkiej Brytanii, gdzie model ten funkcjonuje od 1948 roku. Modyfikacje dokonywane w polskim systemie z założenia mają na celu usprawnić go, poprawić jego efektywność, a także stworzyć go bardziej przystępnym dla obywateli. Projektowane i wprowadzane przekształcenia sytemu ochrony zdrowia w Polsce, oparte w określonych wymiarach na reformie rządu, zaprowadzają system, który w perspektywie czasu ma realizować zasady powszechnego, niczym nieograniczonego dostępu do świadczeń zdrowotnych na jak najlepszym poziomie.

In Poland, a provisions of the Act of 27 August 2004 on health care services financed from public funds1 defines the principles of the waiting list . Waiting list is one of the way to ensure equal access to health care services . Running waiting lists for health care services is the statutory duty of all providers and considers only first-time patients . The Act of 27 August specifies the responsibilities of the provider in relation to the patient, and to managing the waiting lists . Provider is obliged to give the patient information on the scope of health care services, the waiting time for health services, and information regarding the confirmation of the right to health care benefits at the first visit of the patient . In addition, a patient at the point of registration should receive comprehensive information on clinics . Minister of Health in regulation of 26 September 2005 on medical criteria, described what criteria should be guided by the provider entering a beneficiary on waiting lists for health care services . In case of deterioration of patients’ health, which may indicate the need to provide earlier health care service, the patient is obliged to inform the provider . Then, for medical reasons, the time of providing the health care service should be adjusted . Health care provider has no right to refuse to register patient on the waiting list to obtain health care servic. National Health Fund web sites provide information on waiting lists main-tained by individual providers, the number of people, by urgent cases and cases of a stable, and the average waiting time for providing medical services and infor-mation about other healthcare providers who offer benefits in within a shorter period of time

ABSTRACT Background. The health system responsiveness, defined as non-medical aspect of treatment relating to the protection of the patients’ legitimate rights, is the intrinsic goal of the WHO strategy for 21st century. Objective. To describe the patients’ opinions on treatment they received in hospital, namely: admission to hospital, the role of patient in hospital treatment, course of treatment, medical workforce attitude, hospital environment, contact with family and friends, and the efficacy of hospital treatment in respect to responsiveness to patient’s needs and expectations (dignity, autonomy, confidentiality, communication, prompt attention, social support, basic amenities and choice of provider). Material and methods. The data were collected in 2012 from 998 former patients of the randomly selected 73 hospital in Poland. Results. Dignity: Over 80% of patients experienced kindness, empathy, care and gentleness, and over 90% of them had the sense of security in hospital, met with friendliness during the admission to hospital and never encountered inappropriate comments from medical staff. Autonomy: About 80% of patients accepted the active role of patients in hospital, they perceived they had influence on procedures related to hospitalization and course of treatment, and they felt medical staff responded to their requests and concerns. Over 90 % of them had opportunity to communicate their concerns to medical staff and to discuss the course of treatment. On the other hand, the explanation of the reason for the refusal to meet their requests was given to only 23 % of the patients interested. Confidentiality: 70-80 % of patients declared the respect for privacy and confidentiality during collecting the health information and during medical examinations, and were not examined in presence of other people. Nevertheless, only 23% of patients examined so were asked of their consent. Communication: About 90% of patients declared they trusted their physician, received from him explanation regarding the course of treatment and information about further treatment after discharge from hospital, but physicians devoted the time and attention to only 70% of them. Prompt attention: Over 90% of patients perceived simplicity of the formalities of admission to hospital, and short waiting for treatment and additional tests in hospital (but only 50% received explanation of reason if they waited long). Nevertheless, 10% of them % of them perceived they waited for admission to hospital too long, and over 20% for admission to a ward as long. Social support: The unlimited direct and phone contact with family and friends was declared by 96% of patients. Basic amenities: The high percentage of patients assessed positively the marking in hospital (97%) and cleanliness of linen (89%), followed by the general indoor appearance room in which patient stayed, lack of noise (70-80%), hospital meals, furniture (60-70%), availability of personal hygienic articles (50-60%), cleanliness of hospital room, toilet, showers and bathtubs, and availability of soap (40-50%). Choice of provider: Only 41% of patients declared that they had influence on choice of the hospital. Conclusion. Responsiveness of Polish hospital patient needs is similar to that of the OECD countries of the lowest health system responsiveness. Compared to the Central European countries, the responsiveness in Polish hospitals is lower than that of Czech Republic and only slightly higher of those of Slovenia, Slovakia and Hungary.
Wprowadzenie. Wrażliwość systemu opieki zdrowotnej na potrzeby pacjenta, definiowana jako niemedyczny aspekt leczenia odnoszący się do ochrony praw należnych pacjentom, stanowi samoistny cel strategii Światowej Organizacji Zdrowia na 21-szy wiek. Cel badań. Zebranie i przedstawienie opinii pacjentów o leczeniu, które zapewniono im w szpitalu, mianowicie: przyjęcie do szpitala, rola pacjenta w czasie leczenia szpitalnego, przebieg leczenia, postawa personelu medycznego, środowisko szpitalne, kontakt z rodziną i znajomymi oraz skuteczność leczenia szpitalnego, w odniesieniu do wrażliwości na potrzeby i oczekiwania pacjenta (godność, autonomia, poufność, komunikacja, niezwłoczna pomoc, wsparcie społeczne i wybór szpitala). Materiał i metody. Dane zebrano od 998 byłych pacjentów z losowo wybranych 73 szpitali w Polsce. Wyniki. Szacunek: Ponad 80% pacjentów dostrzegało życzliwość, współczucie, troskę i delikatność, a ponad 90% miało poczucie bezpieczeństwa, spotkało się z uprzejmością podczas przyjęcia do szpitala i nie spotkało się z niewłaściwymi uwagami ze strony personelu medycznego. Autonomia: Około 80% pacjentów akceptowało aktywną rolę pacjenta w szpitalu, postrzegało, że mają wpływ na działania związane z pobytem w szpitalu i przebiegiem leczenia i reagowanie przez personel medyczny na ich prośby i wątpliwości. Ponad 90 % miało możliwość przekazywania personelowi medycznemu swoich wątpliwości i omawiać przebieg leczenia z lekarzem. Z drugiej strony, wyjaśnienie powodów odmowy spełnienia ich próśb przekazało tylko 23% zainteresowanych pacjentów. Poufność: Chociaż 70-80% pacjentów deklarowało respektowanie prywatności i poufności w czasie zbierania informacji o zdrowiu i w czasie badań medycznych, a także nie byli oni badani w obecności innych osób, jednakże o zgodę proszono tylko 23% pacjentów badanych w ten sposób. Komunikacja: Prawie 90% pacjentów odczuwało zaufanie do lekarza, otrzymywało od niego wyjaśnienia o przebiegu leczenia i informacje o dalszym leczeniu po wypisaniu ze szpitala, ale lekarz poświęcał swój czas i uwagę tylko 70% z nich. Szybka pomoc: Chociaż ponad 90% pacjentów postrzegało łatwość załatwiania formalności związanych z przyjęciem do szpitala i czas czekania na zabiegi i dodatkowe badania postrzegało jako krótki (ale jeśli długo czekali, to tylko 50% otrzymywało wyjaśnienia o przyczynie), jednakże prawie 10% czekających na przyjęcie do szpitala i ponad 20% czekających na przyjęcie na oddział postrzegało czas oczekiwania jako długi. Wsparcie społeczne: Brak ograniczeń w kontaktowaniu się z rodziną i znajomymi poprzez wizyty i rozmowy deklarowało 96% pacjentów. Podstawowe udogodnienia: Wysoki odsetek pacjentów ocenił pozytywnie oznakowania w szpitalu (97%) i czystość pościeli (89%), a w następnej kolejności: wygląd wnętrza szpitala, salę w której przebywa pacjent, brak hałasu (70-80%), posiłki, mebli (60-70%), zapewnienie papieru toaletowego, ręczników papierowych i suszarek do rąk (50-60%), czystość sali szpitalnej, toalet, pryszniców i wanien oraz dostępność mydła (40- 50%). Wybór usługodawcy: 41% pacjentów zadeklarowało, że mieli możliwość wyboru szpitala. Wnioski. Wrażliwość na potrzeby pacjentów szpitalnych w Polsce jest podobna do notowanej w państwach OECD o najniższej wrażliwości systemu zdrowia. W porównaniu do państw Europy Środkowej wrażliwość jest niższa niż w Republice Czeskiej i tylko nieco wyższa niż w Słowenii, na Słowacji i na Węgrzech.

The aim of the work is to discuss the workers' professional responsibility of the health care system. Proper exercising of the right to health and the right to protect health, first of all, depends on effective and stable law which would regulate the functioning of the health care system and on well prepared workers. Apart from the level of knowledge and factual preparation to work in the profession, the determinants of the workers' qualifications of the health care system are high sensibility, both ethical and moral. Actions or nonfeasances which determine professional responsibility of workers are characterized by infringement and they violate particular obligations. Responsibility of workers of health care is one of the mechanisms which should guarantee a satisfactory level of medical services. Its aim is to make the worker, who was proved to behave improperly, improve his/her actions, especially those serious ones and the ones which are repeated. Otherwise he/she could be temporarily or permanently deprived of his/her right to practice. The doctors who possess a diploma, but they do not have the right to carry the occupation are not subject to this mode. The range of doctors' professional responsibility is defined generally and the forbidden actions are not exactly described. Nurses and midwives bear the responsibility for the whole range of professional activity, including the field of relations nurse - patient - the members of the therapeutic team. The legal responsibility means the necessity of bearing the consequences provided for by legal regulations. Dissatisfaction with the health care system is justified but very often directed in an impropriate way. Surely, the quality of the doctors' or nursing practise should be constantly improved and while improving the conditions, the responsibility should increase.

Purpose – The purpose of the paper is to examine the relationship between the organisation of the state (determined by selected characteristics, i.e. the organisational structure model and the position of the SNG sector) and the organisation of the health care system, and an indication of the possible consequences for the sustainability of public finance. Research method – The author uses a method of descriptive analysis and the analysis of statistical data on health care expenditure in 12 EU Member States with an insurance model of health care. The quantitative analysis was based on the latest available statistical data (2017) from the OECD, the WHO and Eurostat databases (according to ICHA and SHA2011). Results – It was concluded that despite the legal separation and theoretical independence from the budget system, the insurance model of health care may pose a threat to the sustainability of public finance. This applies both to the state budget and the SNG sector, which is particularly vulnerable in countries where the decentralisation of public services is not accompanied by an appropriate design of the financing system. Originality /value / implications /recommendations – This paper discusses the problem of the compatibility of the health care system and state organisation, omitted in literature, including the position of the SNG sector, in the context of fiscal sustainability.

This paper addresses issues related to health care in the context of the debate about the typology of welfare state regimes and comparative studies conducted in reference to the debate. Particular attention has been paid to the phenomenon of decommodification as one of the key dimensions that define welfare regimes identified in the literature associated with this debate. The study presents a health decommodification index, on the basis of which an attempt has been made to assess the decommodification potential of health care, taking into account the situation in the 28 EU Member States in 2012. The identification of a widely understood accessibility of publicly funded health care as a basic measure for assessing the decommodifying features of health programs is an important result of the empirical analysis. The study has also confirmed the views expressed in the literature about the existence of practical obstacles standing in the way of developing a universal typology of welfare states.

Background. In general practice, dysfunctions within the locomotor system are a recurring health issue. Most frequently, diagnoses and treatments relate to pain syndromes of the backbone, the shoulder girdle or the pelvic girdle. The authors believe that physiotherapy, along with other clinical disciplines, should be regarded as an important factor which influences the effectiveness of the therapeutic process in this area. In primary care, treatment of musculoskeletal disorders – especially at the stage of early clinical symptoms – should incorporate basic physiotherapy methods, e.g., massage, physical procedures, kinesiotherapy and the underrated education of the patient. Restoring appropriate spatial arrangement of tissues provides the right conditions for the regeneration and repair of muscles, ligaments and tendons, although it is a process that requires a long time. Therefore, it can be very important to introduce self-therapy in the form of systematically repeated, easy-to-replicate procedures in the scope of self-massage and self-kinesiotherapy. Objectives. This paper presents the impact of physiotherapy in treating selected disorders and pain syndromes of the locomotor system with particular attention to the role of massage. Emphasis is placed on the meaning of self-massage in the process of restoring structural balance of tissues. The model of active inclusion of the patient in the treatment process as preparation for self-therapy is presented. This paper aims to justify the need to reorganize health services provided through general practicioners within the National Health Fund network by incorporating physiotherapy in primary care.

This article presents the quality, safety and assessment system as the important tools to supervise the health care organization. Quality is the sum of the properties and characteristics of a product, process or service that is appropriate to meet the complex requirements. In the case of health care is difficult to valuate quality, the universal indicators become useful tool. The development of quality indicators requires collecting of data and their proper processing. The high quality of medical services requires continuous improvement and adaptation to patients’ needs. The quality indicators, for example, refer directly to the effects of therapy and are used to measure the success or failure of the applied therapeutic methods. Measuring the results of activities indicates only the level of quality of the services provided. The data helps to analyze information and improve the quality and safety of health care services.

This article presents a summary of the scientific view of the quality of health care facilities in dimensions reflecting the quality of certain device management. The main objective is to construct an alternative model that will reflect the quality of the health care device using the minimum inputs. The authors have selected inputs from four areas to evaluate the quality. The study has selected the area of marketing-management to the recommendations of the patient, from the field of crisis management in the dimension of preventive activity with the output of the number of extraordinary events. The third area captures the quality of the services provided as a prerequisite for minimizing sanctions and of course, the area of financial management has not been omitted, and so the model also includes the variable ability to generate own resources. The study can be characterized as secondary since the data were collected from the INEKO databases and the Health Care Surveillance Office with a sample of 65 health care facilities in the territory of Slovakia during the period of 2009-2016. The before mentioned dependent variables at the outputs of the correlation analysis significantly approximated all independent variables. If dependent variables were to be considered separately, the “recommending the hospital” variable correlated with more than 50% of the independent variables. Variable of sanctions is more than 30% and the variable of the ability to generate own resources is more than 20% of independent variables. Significant correlation with the variable of extraordinary events has occurred in almost 20% of cases. Many other health care quality-evaluating models have a common feature, which is cumbersome and complex, on contrary, the proposed model is easy to apply, and it is useful when “fast” evaluation is needed.
W artykule przedstawiono podsumowanie naukowego poglądu na jakość placówek służby zdrowia w wymiarach odzwierciedlających jakość zarządzania. Głównym celem było stworzenie alternatywnego modelu, który odzwierciedlałby jakość urządzeń medycznych przy użyciu jak najmniejszej ilości danych wejściowych, w celu oceny jakości wybraliśmy dane wejściowe z czterech obszarów. Z obszaru zarządzania marketingowego do obszaru zaleceń pacjenta, z obszaru zarządzania kryzysowego w wymiarze działania profilaktycznego z wynikiem zdarzeń nadzwyczajnych. Trzeci obszar określa jakość świadczonych usług. Model obejmuje również zmienną zdolność do generowania własnych zasobów. Przeprowadzone badania scharakteryzować można jako wtórne, zebrane zostały z baz danych INEKO i Urzędu Nadzoru Opieki Zdrowotnej w próbie 65 zakładów opieki zdrowotnej na terenie Słowacji w latach 2009-2016. Wspomniane wcześniej zmienne zależne na wyjściu analizy korelacji znacznie przybliżyły wszystkie zmienne niezależne. Jeżeli zmienne zależne rozpatrywano by osobno, zmienna "polecanie szpitala" korelowałaby z ponad 50% zmiennych niezależnych, zmienna sankcji korelowałaby z ponad 30%, a zmienna zdolność do generowania własnych zasobów z ponad 20% zmiennych niezależnych. Istotna korelacja ze zmienną zdarzeń nadzwyczajnych wystąpiła w prawie 20% przypadków. Wiele innych modeli oceny jakości opieki zdrowotnej ma wspólną cechę, są skomplikowane, a przez to trudne do praktycznego wykorzystania, nasz model w przeciwieństwie do pozostałych jest łatwy do zastosowania i przydatny, gdy potrzebna jest "szybka" ocena.

In 2009, following the election of Barack Obama to the Presidency of the United States, the American public entered into a fierce debate on how to reform its health care system. The intense debate on health care reform, however, is not a new phenomenon in American political life. Debate over health care has cycled its way into the American political discourse every twenty-years or so. History suggests that forceful opposition has prevailed against most major efforts to alter the health system in the United States. Yet, once again the Democratically-controlled Congress and Presidency in the United States aspire to break this cycle of history. With both houses in Congress passing a bill with significant reforms, it seems that this time may be different. While it is very likely some reforms will pass in 2010, no law has been signed yet56. In the end, only time will dictate the outcome of this round of health reform debates. Through a thorough literature review, this article provides the Polish reader a sense of health care reform efforts in the U.S. from the historical perspective and discusses the current proposed reforms. Particular attention is paid to the evolution of the American health insurance system, failed efforts of past health reform initiatives, their contrast with today’s efforts, and current health and economic indicators that could lead to reform in 2010.

The paper deals with the role of the state in the Polish health care sector. The goal of the paper is to show, that the state intervention in health care sector has been considerably reduced over the last twenty years by shifting certain risks to health care providers and patients and by forcing patients to obtain health services from private health care providers and by introducing copayments. This additional weight was neither compensated by tax concessions nor by any financial incentives. There is a ground to maintain that individual patients' obligations will be further strengthened and extended.

On 24 April 2011 entered into force the directive of the European Parliament and of the Council No 2011/24/UE of 9 march 2011 on the application of patients' rights in cross-border healthcare. The article analyses the duty of Member States connected with cross-border medical care, types and limits of using cross-border medical care and problems evoked by refund of medical expenses. The subject of this study is also evaluation of the preamble and the normative text of the directive No 2011/24/UE against the regulation of the European Parliament and Council (EC) No 883/2004 of 29 April 2004 on the coordination of social security systems. The new directive provides clarity about the rights of patients who seek healthcare in another Member States and supplements the rights that patients already have at European Union level through the legislation on the coordination of social security systems.

Aim/purpose – Estimation of the model of interdependent demand for health insurance and health care utilisation involves issues of stochastic dependence between health insurance and health care utilisation. This study explored a count data estimation technique to determine the most appropriate estimation method for the interdependence of health insurance and health care demand in Nigeria. Design/methodology/approach – The study employed Hidayat and Pokhrel (2010) framework to choose among the six alternatives of two classes of count data model. The data for the study were collected using a purposive sampling survey in the six geopolitical zones in Nigeria. Findings – The results showed that the general method of moments (GMM) estimator is preferable to model the determinants of medical care consumption with health insurance. Price of health care services is positively related to medical care consumption with health insurance and social health insurance. The income-medical care relationship indicated that medical care services are inferior good under private health insurance and a normal good with social health insurance during sick period. Research implications/limitations – The implication of this study is that the estimation method that accommodates endogenous regressors is the appropriate estimation technique for the interdependence of health insurance and health care utilisation. The limitation of this study is that the recall period was just six months prior to the survey. Originality/value/contribution – The study revealed that the estimation techniques for the interdependence of health insurance and health care utilisation must recognised the influence of individual and household characteristics on the decision to purchase health insurance and health care consumption. Hence, diagnostics tests are require to choose the most appropriate estimation technique.

Będzie wzrastał udział pacjentów za płacenie za usługi medyczne. Zwiększy się zainteresowanie dbałością o własne zdrowie, także samoopieką. Zmieni się rola aptek na rynku. Jako placówki z sąsiedztwa będą służyły pomocą, opieką farmaceutyczną. Wsparciem dla pacjentów będzie wiedza dostępna w mediach społecznościowych, także w różnych aplikacjach na telefony. Pomocne będzie korzystanie z osiągnięć ekonomii behawioralnej dla wspierania zdrowia pacjentów.
European societies, including Poland, are aging, and this increases the demand for health spending. The prices of new medicines and medical technologies will also increase. Health insurance funds will not be able to fully cover the growing demand for medical care. States will disclaim responsibility for the health of citizens. The proportion of patients paying for medical services will increase. There will be an increased interest in managing your own health, including self-care. The role of pharmacies in the market will change. As neighborhood facilities, they will be of assistance, providing pharmaceutical care. Patient support will be available in social media, as well as in various mobile applications. It will be helpful to use the achievements of behavioral economics to support the health of patients.

Introduction. E-Health tools allow a medical facility to set a given patient’s data in order using ICT techniques, and the patient to use those techniques when contacting a given organisation. Materials and method. Secondary statistical data was used in the research. The study was carried out among primary health care patients. Mining for affinity rules was done in the R programme. The apriori and inspect functions from the arules package were used. Moreover, any redundant rules were removed from thoseobtained using the afero-mentioned method. Applying the general description of the affinity analysis method onto the survey described herein, it should be stressed that the aim of using affinity analysis was to discover the rules which contain the sub-transaction B={V_6=1} as a consequent. This was determined by the intention to discover associations regarding the knowledge about a uniform information system that the patients under study might have. Results. In the discovered rules, the antecedent most often contained an indication of the need for introducing a uniform solution as regards telemedicine. Moreover, according to the opinions of ‚conscious‘patients, a uniform IT system should improve the work at primary health care institutions, introducing an on-line booking system for visits should improve the productivity and comfort of doctors, and an IT system should provide unambiguous identification of a patient. Conclusions. There is potential in using affinity analysis within e-Health. The example of affinity analysis described in his study led to the discovery of interesting and important (from the point of view of a medical facility) regularities regarding the knowledge and expectations of patients as regards e-Health.

Publikacja omawia istniejące współcześnie systemy ochrony zdrowia i ich źródła. Składa się z dwóch głównych części. W pierwszej analizowane jest pojęcie „zdrowie”, będące przedmiotem ochrony, z punktu widzenia medycznego, a także jego rozumienie prawne, zależne od kształtu regulacji normatywnych gwarantujących tę ochronę. W tym zakresie ewolucja historyczna i zmiany w sposobie pojmowania zadań państwa doprowadziły do oddzielenia od siebie ochrony zdrowia publicznego i zdrowia indywidualnego. Kluczowe dla funkcjonowania systemów ochrony zdrowia indywidualnego jest ich finansowanie. Artykuł szczegółowo charakteryzuje istniejące w tym zakresie modele, ich uwarunkowania i konsekwencje. W drugiej części publikacja przedstawia polskie doświadczenia w zakresie organizacji i finansowania opieki zdrowotnej w sferze indywidualnej na przestrzeni ostatnich 100 lat. Cechuje je ewolucja od zdecentralizowanego modelu ubezpieczeniowego, przez jego centralizację, do modelu budżetowego, a następnie powrót do scentralizowanego modelu ubezpieczeniowego. Obecna praktyka stara się respektować podstawowe wartości leżące u podstaw dawnych rozwiązań, boryka się jednak ustawicznie z problemem deficytu środków. W ich poszukiwaniu i dążeniach do optymalizacji systemu odchodzi się od rozwiązań czysto modelowych w kierunku pragmatycznych. Prowadzi to do powstawania systemów mieszanych, do konwergencji przeciwstawnych początkowo modeli wyjściowych, a jednocześnie rodzi niepewność co do przyszłego kształtu prawnego systemu ochrony zdrowia.
The publication discusses the current health care systems and their sources. It consists of two main parts. The first analyzes the concept of "health" that is the subject of protection, from the medical point of view, and its legal understanding, depending on the shape of the normative regulations guaranteeing this protection. In this respect, historical evolution and changes in the way of understanding the tasks of the state have led to the separation of public health and individual health protection. Funding is essential for the functioning of individual health care systems. The article describes in detail the models existing in this field, their conditions and consequences. In the second part, the publication presents Polish experiences in the field of organization and financing of healthcare in the individual sphere over the last 100 years. They are characterized by an evolution from a decentralized insurance model, through its centralization, to a budget model, and then a return to a centralized insurance model. The current practice tries to respect the basic values underlying the old solutions, but it is constantly struggling with the problem of the deficit of funds. In their search and efforts to optimize the system, purely model solutions are being moved to the pragmatic ones. This leads to the emergence of mixed systems, to the convergence of initially opposing models, and at the same time creates uncertainty as to the future shape of the legal healthcare system.

The different definitions of efficiency (in their medical meanings) are presented as the result of meta-reviews found in scientific databases. Efficacy and efficiency are often mismatched with effectiveness in the research of healthcare systems in different countries. In addition to the classic Bismarck's and Beveridge's models the modern concepts of health systems include personalized medicine, recognition of health as economic value, and so called salutogenesis. However, the basic problem in the Polish healthcare system is the low quality of overly specific and often changed legislation.

After the reform of health care system the patient was granted a right to choose where and by whom he wants to be treated, especially as far as a General Practitioner (GP) is concerned. All of the above mentioned factors caused that subjects providing medical services started using marketing tools in order to promote these institutions on the market and to create their positive image. Special concern was attached to the way patients were served, which directly influences satisfaction of the patients with the institution they are treated in. The purpose of this dissertation was to indicate the elements crucial for patients which influence which institution they choose, especially a behavior of a doctor of primary health care. The research took place in 2010 and it included a group of 140 patients in Silesia voivodeship. The stage concerned evaluation of the factors which influenced a decision to be treated by a particular General Practitioner (GP).

In Poland entities not being entrepreneurs are among healing entities determined with name of self-contained public healthcare centres (SPZOZ). In the article the special regulations included in the act on healing activity were presented referring to the SPZOZ financial management and influencing the accounting of such subjects. Additionally an influence of, so outside, as well as internal factors which they are exerting was stressed he influences the politics of SPZOZ accounting and are creating the specificity of solutions applied by such entities. Simultaneously they paid attention to meaning of the SPZOZ financial result to further functioning and the need of taking concrete actions by the entity creating in case of the loss.

Medicine is the field of knowledge and set of clinical practices, characterized by the presence of politics and ethics on all the levels. Politics should be treated as a domain of power, which aims to make strategic decisions concerning health of the citizens leading to form socially accepted objectives of health care policy. Ethics sets axiological frames for morally just decisions both political and medical in the field of health care. The article analyzes the reasons of conflicts and moral dilemmas in the health care system. Decisions which are made within health care system should accomplish five criteria: medical, economical, social, legal and axiological. The term “moral panic” is used to illustrate situations concerning corruption and moral atrophy of doctors.

Emergency departments are costly to maintain. They remain open every hour of the year to provide care for those who need it, when they need it. Therefore, emergency departments are a crucial resource for any modern society, and no sensible person would want to close them, despite their cost. However, the view held by many, that the care provided in an emergency department is excessively costly, is just plain wrong. When our doctors’ and our specialty’s performance is viewed objectively, it becomes clear that emergency physicians have become crucial agents of cost savings. The article presents the risk of occupational burnout observed in health care, as well as possibilities of prevention in this regard. Its authors used their knowledge and experience obtained during the implementation of the international Time2Grow project financed from the European Social Fund. The project was dedicated to developing a burnout prevention model mainly in the area of broadly understood health care. The project was implemented in the Polish-Belgian-Finnish partnership, thanks to which it provided great opportunities to benefit from good European practices. The article presents the results of quantitative primary research carried out on Poland in the group of nurses and midwives, as well as selected results of quantitative and qualitative research conducted in Finland on a group of practicing nurses caring for elderly people.

With reference to the current situation of national public hospitals, the article presents the possibility to implement the Lean Management concept in hospital management. Numerous common features connecting the management of commercial entities with the management of healthcare institutions are indicated. It has been stated that the management of contemporary organizations, regardless of the type of conducted operations, needs to focus on customer/patient satisfaction, financial liquidity and high quality. The purpose of the article is to assess the possibility to implement the Lean Management concept in hospitals. In particular, an attempt was made on the basis of a pilot survey to assess the introduction of the above concept in two selected hospitals. Critical analysis of the literature on the subject, the analysis of research results of other authors, casual interview, observation of practice as well as a survey based on the prepared questionnaire were used to achieve the purpose.

Purpose: The scientific objective of this research was to determine social groups affected by exclusion in Polish health care. Materials and methods: Survey was carried out among local government units and nongovernmental organizations by using authorial questionnaire distributed towards representative research group selected. Results: This work depicts activities of social welfare centers in cooperation with non-profit sector entities, in the field of exclusion from the access to health care benefits in Poland, appointing circumstances, causes and the range of this exclusion. It presents the results of the countrywide research in the context of structure and tasks of the health care, but also two points of view (institutional and social one) for resolving the same population issues. Conclusions: On the basis of the conducted analyses it has been stated that social exclusion, in the field of health care, is a significant social problem, but the biggest difficulty is the access to the rehabilitation benefits and pharmacological therapy

Background: Tattoo is becoming a more and more common form of body decoration of people from representatives of various professions.The aim of this study was: what is the opinion of university students about medical staff having visible tattoos. Material and methods: The study was conducted among the students of four universities in Gdańsk. The questionnaire contained questions about the acceptance of visible tattoos in people working in medical professions. The respondents were also asked about their attitudes to tattoos as a form of body decoration and whether they had tattoos themselves. The statistical analysis was performed using IBM SPSS Statistics 25 software. Results: Filled-in questionnaires were obtained from 676 respondents, including 477 students of the medical university and 199 students of non-medical universities. The students who have tattoos themselves accept visible tattoos in healthcare professionals to a significantly greater extent (92%) than those who do not have tattoos, but the acceptance of visible tattoos in healthcare professionals in this group turned out to be very high too (75%). The respondents most readily accepted a visible tattoo on the skin of a laboratory diagnostician (75%). Conclusions: University students, regardless of their university profile, consider a visible tattoo as a completely acceptable phenomenon in healthcare professionals.

Patient payments are considered to be a significant issue in health policy in Lithuania. Despite the unclear legislative framework, health care institutions are asking patients to co-pay (contribute) for services provided to them. Thus, patients and providers are facing challenging situation in legal, ethical and financial terms. The aim of the study was to evaluate the opinions and attitudes towards patient payments in Lithuania. Qualitative and quantitative research methods were applied in the study – focus group discussions and in-depth interviews combined with a self-administrated questionnaire filled in by each participant. The results suggest that there is no consistent policy on patient payments in Lithuania. Health care consumers are rather resistant towards the introduction of payments (they support fees only in case of services with better quality). Health care providers sustain patient payments considering the needs of health professionals and health care institutions. Health policy makers and health insurance representatives remain dispersal in their opinions. More conceptual and strategic thinking in defining the aims of patient payment policies in Lithuania and its governance is needed.

Public service delivery has never been the area of a state monopoly, but the process of the “destatization” of public service delivery accelerated with the wave of new public management (NPM). The competition between private suppliers of public services was expected to reduce public expenditures and improve the quality of services. However, current scepticism towards NPM triggered the revival of the idea of co-production, i.e. direct participation of citizens in public service delivery. This paper reviews the practices of co-production in European health care systems. It is based on an extensive definition of co-production, not only including co-delivery, but also co-planning, co-financing and co- -evaluation. The existing evidence regarding the effects of co-production is also reviewed.

The following paper critically evaluates the health care system in Poland, including the market reform of the Polish healthcare system between 1999 and 2010. The article presents the process of ownership transformation, including the scale and dynamics of the introduced reform. Apart from analysing the core assumptions and aims of the long-term programme entitled „Wsparcie jednostek samorządu terytorialnego w działaniach stabilizujących system ochrony zdrowia” (Support for Local Authorities in Healthcare System Stabilization) the paper analyses proposed solutions based on the so called „health acts package” including the health care activity bill. The main aim of this paper is to critically evaluate the health care system reform in Poland, mainly focusing on the process of commercialisation of public hospitals. As a conclusion it is suggested that the introduced reform does not solve the most important problems of the Polish healthcare system in a comprehensive and suffi cient manner.

Introduction of patient payments for publicly financed health care services – opinions of the main Polish health care system’s stakeholdersDuring the last decades many European governments have introduced patient payments in their public health care system with the aim to improve efficiency of health care provision, contain overall health care expenditure, and also to generate additional resources. In Poland, since 1999 patients have met formal payment obligations when they use dental services. Though introduction of formal patient payments for primary care services, out-patient specialists’ services and hospital services has been discussed, such payments do not exist. Empirical evidence suggests that the successful implementation of patient payments, to a large extent, depends upon public acceptance and political consensus. The paper presents the results of study on attitudes towards formal patient payments for publicly financed health care services, among different groups of Polish health care system’s stakeholders (health care consumers, providers, insurers and policy makers). The data are collected via focus group discussions and in-depth interviews carried out in Poland in June–October 2009 as part of project ASSPRO CEE 2007. The results are used to out-line policy recommendations.

Health human resources planning – Canadian experience The article is based on the document „Health Human Resources Modelling; Challenging the Past, Creating the Future” published by Canadian Health Services Research Foundation. The article describes three separate but related projects, which are undertaken to link population health needs to health care staff planning, to present the value and challenges in using health human resoures data to inform policy makers on nursing productivity and needs. Project 1, using health data survey explored the level,distribution and patterns of health indicators by demografic and social aspects. During realisation of project 2, nursing productivity was studied by analyzing data for inpatient episodes of care and severity. Project 3 surveyed former nursrs and register nurses across six Canadian provinces. Policy makers can improve estimates health human resources by incorporating population health needs, productivity analyses and evidences based policy strategies tailored for providers. Models and strategies for health human resources planning that are need-based, outcome-directed and that recognize the complex and dynamic nature of the impact these decisions need to be developed and implemented.

Purpose: To estimate the frequency of aggressive behaviors in health care institutions, and determine their influence on emotional reactions of medical workers. Materials and methods: The study involved 201 health care professionals from the regions of Lower Silesia and Opole in Poland. The authors employed the exposure to patient aggression inventory, based on the questionnaires of Merecz and Nowicka & Kolasa; this inventory divides patient aggression towards medical workers into seven different forms. Results: In over 90% of cases, health care professionals fell victim to patient aggression in a workplace. It mostly took forms of verbal aggression, a raised voice and shouting. A physical attack was reported by 45.6% of the surveyed; it resulted in physical injuries in 27.9% of psychiatric hospital workers and 24.7% of general hospital workers. As a reaction to patients’ verbal aggression, medical workers usually calmly explained that such behavior was improper. Violence and aggressive behaviors of patients evoked workers’ anger, fear, a feeling of resignation and the loss of their sense of safety. In most case's victims of patient aggression either coped with the problem themselves or asked their co-workers and superiors for help. Conclusions: Aggressive behaviors of patients arouse in medical staff, mostly anger. Medical workers usually cope with patient aggression themselves; nurses more often than other health care professionals ask their superiors and co-workers for help. It is necessary to conduct further research into the problem of patient aggression towards medical staff so that actions ensuring safety for workers can be taken.

Opis:
Safety is the basic need for every human as it determines the existence and proper development. Over the years, different levels of safety threats have been identified, as it was stated that the protection against external aggression is one of many challenges that must be faced in order to ensure the security of a country. It should be noted, however, that recent years have been a time characterized by a particular intensity of natural disasters in the form of adverse natural phenomena causing both natural catastrophes and technical failures. Natural disasters such as earthquakes, tsunamis, hurricanes, floods, epidemics such as acute respiratory distress syndrome (SARS), Ebola or the SARS-CoV-2 coronavirus causing the COVID-19 disease are gaining in importance and intensity. A quick response of medical personnel during a disaster is of key importance for the health care of mass casualties. Thus, a key aspect of the health care entities in situations of a threat to public safety is the ability to quickly expand the health care system operating under normal conditions of the functioning of the State.

Objectives: The study presents data concerning occupational exposures among the staff of 5 hospitals in the Małopolska province in 2008–2012, taking into account the frequency and circumstances of exposure formation, occupational groups of hospital workers, as well as diversification of the reported rates in subsequent years between the hospitals and in each of them. An additional objective of the analysis was to assess the practical usefulness of the reported data for planning and evaluation of the effectiveness of procedures serving to minimize the risk of healthcare workers’ exposure to pathogens transmitted through blood. Material and Methods: Data were derived from occupational exposure registries kept by 5 hospitals of varying sizes and operational profiles from the Małopolska province from the years 2008–2012. Results: Seven hundred and seventy-five cases of exposure were found in a group of 3165 potentially exposed workers in the analyzed period. Most cases were observed in nurses (68%) and these were mainly various types of needlestick injuries (78%). Exposure rates with respect to all workers ranged from 2.6% to 8.3% in individual hospitals, but the differences in their values registered in the hospitals in subsequent years did not bear any statistical significance, in a way similar to the rates calculated separately for each occupational group. Conclusions: There was no upward or downward trend in the number of reported cases of exposure to bloodborne pathogens in the studied period in any of the hospitals. Statistically significant differences in the percentages of exposures were reported between individual hospitals in some years of the analyzed period, which confirms the need for registries in individual units in order to plan and evaluate the effectiveness of preventative measures.

According to the author, the bill deserves further legislative consideration. Most of the provisions contained therein implement the provisions of the tobacco directive. Some of them impose on manufacturers, importers and distributors of e-cigarettes more far-reaching restrictions than those provided for in the Directive. She points out that the regulations that go beyond the scope of the Directive should be evaluated for compliance with the constitutional principles of freedom of economic activity. Moreover, it should also be considered whether the ban on the use of e-cigarettes in public places violates the constitutionally established right of individuals to make decisions about their own life. Doubts are also raised by the wording of Article 6 para. 1 of the proposed bill imposing a prohibition of making tobacco products, electronic cigarettes and refill containers available to people under the age of 18, whereas the existing prohibitions referred to “sale” of tobacco products.

This opinion deals with the relationship between the requirement for suspension of legislative work specified the notification procedure and the determination of the date of entry into force of a government bill amending the Act on the Protection of Health against the Consequences of the Use of Tobacco and Tobacco Products. According to the author, the provisions, which may unambiguously be considered as those implementing Directive 2014/40/EU, can be entered into force and effect on 20 May 2016, because they are exempted from the notification obligation under Directive 2015/1535. In contrast, the provisions of the bill, which implement the provisions of Directive 2014/40/EU, but at the same time leave regulatory discretion to the national legislature, as well as the provisions of the bill that go beyond the objective of implementation of this Directive, should not be adopted before 1 July 2016.

The purpose of the opinion is not to examine thoroughly the proposal for a regulation but only to assess the legal basis for its issue, and to provide an analysis of those provisions of the proposal that may raise doubts about their conformity with the Constitution of the Republic of Poland. The main conclusions of the opinion relate to the lack of grounds for delegation by the Republic of Poland to the bodies of the European Union of the competence to regulate the issue of clinical trials on medicinal products for human use under primary law of the EU. Such delegation would infringe Article 90(1) of the Constitution. The author claims that the time limits specified in the proposal for regulation for action of the State make it impossible for Polish public authorities to implement obligations resulting from the preamble to the Constitution and their duties relating to protection of individual’s rights referred to in its Article 30.
