The aim of the study is to show the mutual relations between the government administration and local government units in the conditions of the COVID-19 pandemic. The article uses the decision-making method in order to analyse the actions taken and the decision-making process. Discourse analysis is used to study the communication process between the government administration and local government administration. To analyse the legal acts adopted during the pandemic, an institutional and legal analysis was used. New, serious challenges related to the COVID-19 pandemic did not change the difficult, tense relations between the local government and the central administration, nor did they weaken the conflict between them. In the period of the epidemic, the current animosities, which had existed even before its outbreak, were reinforced. They were related to the dispute between the omnipotence of the state and decentralist tendencies. Additionally, new discrepancies, resulting from the consequences of the epidemic and radical actions taken in relation to it, arose.

The amendment to both acts, formally force since 1936, concerns the adaptation of their contents to the geographical area of the Polish state, which has been changed after the Second World War. The amendment has no practical legal significance. In the author’s opinion, one should strive to adopt two separate religious statutes on the basis of current legal regulations, rather than introducing changes regarding replacing geographical terms and names of state bodies.

According to the author of the legal opinion, the current provisions of the 1936 act, which apply to the Muslim Religious Union, became outdated after the Second World War. This state of affairs was aggravated by the entry into force of the Constitution of the Republic of Poland of 1997 and by the conflict existing within the Union. In the author’s opinion, it should be acknowledged that the situation that has arisen is already ripe for the creation of a new statute in this regard.

The article presents changes in the method and scope of data collected and processed about citizens by government administration that have occurred over the last 15 years. During this time, there has been a significant increase in the number of areas in which data is collected, as well as the level of detail of the data itself. The reasons for the changes are the development of technologies for managing large data sets, adapting legislation to EU standards, increasing the number of public benefits and services, and increasing the scope of control and supervision exercised by administrative bodies. The article also presents changes in the methods of obtaining data.

The primary burden of tackling the pandemic COVID-19 lies with the state as the entity responsible for protecting the health and life of its citizens. Hence, it can be argued that the focus of the pandemic-induced changes to the Polish legal order was on administrative law, which not only sets out the principles of the functioning of the State as the executive power but also governs the relations between the government, local government and citizens, which had to be significantly modified during the pandemic. It would be impossible to analyse and discuss all the emergency measures that appeared in Poland’s administrative law due to the threats posed by the pandemic. The subject matter of the present study is the analysis of the legal solutions adopted in the Republic of Poland in the sphere of public law in connection with the spread of the virus and particular provisions shaping relationships between the two basic structural branches of Polish public administration, viz. the government administration and the local-government administration. The following part of this study will accordingly be devoted to the analysis of the legislative solution contained in Article 11h of the COVID-19 Act, establishing a legal framework for issuing binding instructions to, among others, the various bodies of local governments, local-government legal persons and local-government organisational entities without legal personality.

W obliczu pandemii COVID-19 ustawodawca podjął decyzję o konieczności zwiększenia możliwość działania administracji publicznej. Wobec tego przepisami specustawy wprowadził między innymi dodatkowe narzędzia dla wojewody. Dzięki temu do systemu prawa wprowadzony został szczególny typ „polecenia” wojewody, mocą którego może on zlecić działania wybranym, kluczowym organom i podmiotom działającym na terenie jego województwa. W pracy podjęto próbę usytuowania tej nowej kompetencji w katalogu prawnych form działania woje wody oraz próbę dokonania oceny systemowej zgodności tego instrumentu z dotychczasowymi modelami prawa administracyjnego.
In the face of the COVID-19 pandemic, the legislator decided to increase the capacity of public administration to operate. Therefore, the provisions of the special act introduced additional tools for the voivode. As a result, a special type of voivode’s „command” was introduced into the legal system. He can now outsource activities to selected authorities and entities in his voivodeship. The paper attempts to locate this new competence in the catalog of legal forms of the voivode’s activity and an attempt to perform a systemic assessment of the compliance of this instrument with the existing models of administrative law.

Changes that take place in social and media space on the local level indicate a weakening position of media. Current sources of media power start to be increasingly taken over by new political actors. Participants of the media market as well as actors active in social space acquire new competences, which were previously characteristic only of journalists. The balance of forces, relations as well as interrelations between media and politics starts to create a new form of partnership and cooperation. This gradually leads in consequence to the codependency of media and politics in financial and organizational aspects. This raises a question of how public institutions, including those of the local level, can find themselves in the existing reality? Do they have a chance to pursue their information and communication functions? And finally, does the mediatization of a local political scene allow for the individual shaping of the relations of the local government with its social environment and building a reputation?

A city based on the sustainable development priorities, friendly to its residents, combines human activity, technology challenges, and environmental requirements. The implementation of the idea of smart city should be discussed with regard to specific areas of activity. In order to identify the way of perceiving the activity conducted under this concept, a survey was carried out among employees of the City Office in Zabrze. The cognitive, competence and informational scope was verified. It was found that the overwhelming majority of officials (79%) are convinced that smart city principles are being implemented. The survey participants also provided specific examples of smart-city initiatives undertaken in the city, and a significant part of the respondents (64%) assigned their professional tasks to them. Moreover, three out of four surveyed officials in Zabrze declared that they know the tools supporting the smart urban development. The results presented in the article constitute pilot studies aimed at understanding the extent to which the Smart City idea is known by local government administration employees. In addition, these results serve as a tool for the authorities of Zabrze to disseminate knowledge about smart city among employees of the city hall.

This article’s aim is to examine a dependency between local government administration at a municipal level and the level of local entrepreneurship. This paper attempts to answer the question of whether the size of the local government administration has features of stimulant or de-stimulant in the process of setting up a business. In other words, does the size of public administration at a local level (municipal level) have a positive or negative impact on creating new business entities? This is important due to at least a couple of reasons. First of all, the current research achievements are not extensive, when it comes to the publications that link entrepreneurship and the size of local government administration. Secondly, the problem of entrepreneurship determinants constitutes still topical and not fully investigated (or explained) aspects of local economy development. Thirdly and finally, the authors of this article have proposed and copyrighted an approach to the quantification of the size of local government administration, modifying commonly used measures of local public administration. Thus, this article fits not only into the explanation of the entrepreneurship phenomenon and its determinants, but also contributes to the development of knowledge about dependencies between the size of local self-government and the entrepreneurship level. It expands the knowledge resource on analyzed dependencies and re-orients current approaches to similar research.

The aim of this article is to present legal solutions showing the legal position and basic functions of a voivode, taking into account the definition of his constitutional position in the period from the Second Republic of Poland to the present. This is an organ of government administration that has appeared in the system of administrative bodies since the interwar period, with the exception of the years 1950–1973. This interval was the result of the solutions adopted in the Act of 20 March 1950 on local organs of uniform state authority. The competences of voivodes were then assumed by the presidencies of the voivodeship national councils as the executive and managing bodies of these councils. It was not until the amendment of the Constitution on 22 November 1973 and the enactment on the same day of the Act amending the Act on National Councils that new regulations were introduced, whereby collegial bodies at the voivodeship and poviat levels (presidia) were replaced with monocratic bodies. The solutions adopted in 1999 clearly refer to the interwar solutions, rendering the voivode both the representative of the Council of Ministers in the voivodeship and granting them many competences as a result, as well as the head of the combined government administration in the voivodeship. Recent years and changes in legislation (not least in the Act on the Voivode and Government Administration in the Voivodeship) have significantly strengthened the voivode’s position as a political body. The adopted solutions have clearly subordinated the voivode to the Prime Minister in both the official and personal sphere. The Prime Minister directs the activity of the voivode, issuing guidelines and orders in this respect, demanding the submission of reports on the activity of the voivode and conducting a periodic evaluation of their work, in addition to supervising the activity of the voivode based on the criterion of the compliance of his/her actions with the policy of the Council of Ministers.

Cel: Wskazanie – na przykładzie miasta stołecznego Warszawy – miejsca administracji samorządowej w systemie zarządzania kryzysowego oraz stopnia przygotowania jej pracowników do realizacji powierzonych im zadań. Projekt i metody: Zasadniczą metodą pozyskania materiału empirycznego był sondaż diagnostyczny – ankietowanie przeprowadzone wśród członków administracji samorządowej. Sondaż przeprowadzono na reprezentatywnej grupie 783 osób pełniących różne funkcje w strukturach urzędu miasta i wybranych dzielnic, z czego 11,1% (87 osób) zajmowało stanowiska bezpośrednio związane z realizacją zadań na rzecz bezpieczeństwa. Tę grupę pracowników administracji poddano szczegółowej ocenie pod kątem jej wykształcenia i doświadczenia zawodowego. Wyniki: Administracja samorządowa Warszawy, jako stolicy państwa, realizuje szereg odpowiedzialnych zadań w obszarze bezpieczeństwa. W tym zakresie działalność pracowników administracji jest zinstytucjonalizowana głównie w ramach systemu zarządzania kryzysowego. Spośród osób bezpośrednio zaangażowanych w realizację zadań na rzecz bezpieczeństwa aż 24,12% zajmuje stanowiska kierownicze, 63,26% stanowiska urzędnicze, a tylko 12,64% to pracownicy realizujący zadania na innych, mniej odpowiedzialnych stanowiskach. Świadczy to o dużym znaczeniu spraw bezpieczeństwa w całokształcie działalności administracji stolicy. Zdecydowana większość tych stanowisk, bo aż 83,98% usytuowanych jest w strukturach Urzędu Miasta Stołecznego Warszawy, a tylko 16,02% w urzędach dzielnicowych i pozostałych jednostkach administracyjnych, co wskazuje na koncentrację zarządzania kryzysowego w rękach prezydenta miasta. Pracownicy administracji zajmujący stanowiska związane z bezpieczeństwem w większości są dobrze przygotowani do realizacji swoich zadań. Ponad 75% z nich posiada wykształcenie i doświadczenie z zakresu zarządzania kryzysowego lub dziedzin pokrewnych. Wnioski: W trakcie badań dokonano krytycznej analizy rozwiązań formalno-prawnych obowiązujących na szczeblu samorządowym ze szczególnym uwzględnieniem miasta na prawach powiatu. Rozwiązanie oparte na konsolidacji zadań z obszaru bezpieczeństwa w jednej komórce organizacyjnej – Biurze Bezpieczeństwa i Zarządzania Kryzysowego, które posiada swoje delegatury w urzędach dzielnicowych – jest rozwiązaniem właściwym dla dużej aglomeracji miejskiej. Wyniki badań empirycznych wskazują na dobre przygotowanie administracji samorządowej Miasta Stołecznego Warszawy do realizacji zadań na rzecz bezpieczeństwa.
Aim: To illustrate, using the capital city of Warsaw as an example, the function of local government administration in the crisis management system and how local authority personnel are prepared to perform their tasks. Project and methods: Empirical data was obtained through the conduct of a diagnostic survey. Surveys were carried out among a representative group of 783 local authority employees performing different functions in the city hall structure and selected district offices. Out of these, 11.1% (87 staff) held appointments directly linked to the discharge of responsibility in connection with security. This group of staff was exposed to a detailed analysis of their educational attainment and work experience. Results: The local authority in Warsaw, as the capital of Poland, performs many important security tasks. Consequently, activities of its employees are institutionalised, mainly within the crisis management system. Among personnel directly involved in security related activities, as many as 24.12% are managers, 63.26% are local authority officers and only 12.64% are employees performing duties at lower grades. This indicates the high degree of importance attributed to security issues in the overall administrative activity. The vast majority of these posts, as much as 83.98%, exist within the structure of Warsaw City Hall and only 16.02% are located in district offices and other administrative units. This reveals the concentration of crisis management responsibility placed in the hands of the City President. Staff employed in security related posts are, in the main, well prepared to discharge their responsibilities. More than 75% of the employees have education and experience in the field of crisis management or related fields. Conclusions: A critical analysis of formal and legal solutions in existence at local government level was performed during the study with a particular focus on cities and towns with district status. An approach based on the consolidation of activities aligned with security in one organisational structure, such as the Department of Security and Crisis Management with branches in district offices, provides an appropriate solution for large urban agglomerations. Empirical research results indicate that the local authority for the Capital City of Warsaw is well prepared to address matters of security.

W niniejszym artykule zostały opisane kluczowe kompetencje i umiejętności potrzebne kierownikom jednostek samorządowych w wykonywaniu ich ról menadżerskich i funkcji zarządzania. Szczególny nacisk położono na umiejętności decyzyjne, czyli te kompetencje, które umożliwiają kierownikom podejmowanie właściwych decyzji. W część badawczej postawiono pytania: Jakimi kompetencjami powinni charakteryzować się kierownicy administracji samorządowej? Czy decyzje kierownika administracji samorządowej wymagają posiadania innych, specyficznych kompetencji niż w przypadku tzw. klasycznego menedżera organizacji biznesowej? W celu odpowiedzi na tak postawione pytania posłużono się wynikami badań własnych przeprowadzonych na grupie 208 kierowników z 75 różnych urzędów administracji samorządowej województwa śląskiego.
The article presents managerial competencies’ issues in the decision-making aspect. We have claimed that there is a need for employing a new managerial (and not only administrative or political) paradigm in managing local government administration institutions. In the study part we have posed the following questions: What competencies should the managers in local government administration have to make appropriate decisions? Do decisions of the manager of the council administration require the possession of different, specific competences than in case of the manager of the business organization? The studies have been based on surveys of 208 managers from the 75 local government administrations from Upper Silesia region.

The article looks at the status of Tripartite Commission for Social and Economic Affairs (henceforth: Tripartite Commission) which plays an important role in social dialogue, as well as relations between business and government in Poland. First, the author describes the current legal status of Tripartite Commission, its members and scope of its activities. Next, he reflects on some aspects of norm collisions related to the Commission’s works.
