It is argued in this paper that the relative defi cit of media freedom in most of Central and Eastern Europe as opposed to the relative freedom of the media in most of Western Europe is ultimately rooted in the specifi cities of the former communist countries’ party systems. Young parties in young democracies lack the resources needed for party building and organization, which they compensate for by colonizing the state and the media and by exploiting state and media resources; party colonization of the media necessarily inhibits media freedom. It is further argued that temporal and spatial variations in media freedom in and across Central and Eastern Europe are explained by diff erent patterns of media colonization. Th e more centralized the governing party’s or parties’ decisionmaking structures, the greater the likelihood of one-party colonization, and the more fragmented the governing party’s or parties’ decision-making structures, the lesser the likelihood of such colonization; one-party colonization of the media leads to lower levels of media freedom than multi-party colonization. In other words, the weaker the government, the more freedom the media have.

Celem przeprowadzonego badania było zidentyfikowanie źródeł informacji o kryzysie migracyjnym na wschodniej granicy Polski w 2021 r. Ponieważ polski rząd wprowadził stan wyjątkowy w strefie przygranicznej, a dziennikarzom zakazał do niej wstępu, powstała sytuacja wyjątkowa, szczególnie nadająca się do badania źródeł i kierunków przepływu informacji. Kryzys na granicy polsko-białoruskiej w 2021 r. stanowi przykład problemu globalnego (migracje) skonfrontowanego z lokalnym kontekstem, który ograniczył siłę platform i portali internetowych ze względu na położenie geograficzne oraz uwarunkowania geopolityczne. Metody badań: badanie było prowadzone w trakcie trwania kryzysu (wrzesień–grudzień 2021 r.), wobec czego wykorzystano metodę etnograficzną, metaanalizę raportów o kryzysie, a także analizę ilościową kont na Facebooku i Twitterze oraz na stronach internetowych wybranych mediów. Uzyskane wyniki wykazały, że platformy online pełniły w czasie tego kryzysu rolę kanałów komunikacji dla źródeł rządowych – polskich i białoruskich. Konta agend polskiego rządu, takich jak Straż Graniczna, miały przewagę w liczbie obserwujących nad kontami organizacji pozarządowych takich jak Grupa Granica. Zakaz wstępu dziennikarzy do strefy przygranicznej, wprowadzony przez polskie władze, spowodował, że w obiegu międzynarodowym (np. w BBC i CNN online) pojawiły się przekazy wizualne pochodzące z białoruskich mediów i agencji informacyjnych. W badanym przypadku platformy internetowe były z powodzeniem wykorzystywane przez aktorów politycznych i jako takie pełniły rolę pośredników cyfrowych, nie ingerując w przepływ informacji.
The purpose of the study was to identify sources of information about the migration crisis on Poland's eastern border in 2021. Since the Polish government imposed a state of emergency in the border area and banned journalists from entering it, an emergency situation arose that is particularly suitable for studying the sources and directions of information flow. The 2021 Polish-Belarusian border crisis is an example of a global problem (migration) with a local context that limited the power of online platforms and portals due to geographic location and geopolitical considerations. Research methods: the study was conducted during the crisis (September-December 2021); therefore, the ethnographic method, meta-analysis of reports on the crisis, and quantitative analysis of Facebook and Twitter accounts and websites of selected media were used. The results showed that online platforms acted as communication channels for government sources – Polish and Belarusian – during this crisis. Accounts of Polish government agencies, such as the Border Guard, had an advantage in the number of followers over accounts of NGOs such as Grupa Granica (Border Group). The Polish government's ban on journalists entering the border zone resulted in visual messages from Belarusian media and news agencies being circulated internationally (e.g., BBC and CNN online). In the case studied, online platforms were successfully used by political actors and as such acted as digital intermediaries without interfering with the flow of information.

Both the Covid-19 pandemic as well as the political and social discussions it forced upon liberal Western democracies on limitations of fundamental rights provide me with the framework for this paper’s topic. I will address it through the question of how German artists – in this case mostly TV actors – with the social Media campaign #allesdichtmachen drew attention to their situation in times of widespread lockdown and contact restrictions in spring 2021. The question will be whether the constraints of free expression felt by these artists, or the public reactions to their voicing a sense of being unheard, can be captured by the vocabulary of censorship in the narrower or broader sense.

Freedom of speech as an important human right is diminished when speaking out for Palestinian rights. The paper examines this assertion through three case examples from Australia. These are academic freedom, media freedom and freedom of political representation and expression. To provide context to the free speech debates, an overview is presented of the conflict as well as an outline of the Boycott, Divestments and Sanctions campaign.
Wolność słowa jako ważne prawo człowieka zostaje ograniczona, gdy przemawia się za prawami Palestyńczyków. W artykule przeanalizowano powyższe twierdzenie na podstawie trzech przykładów przypadków z Australii. Są to: wolność akademicka, wolność mediów oraz wolność reprezentacji politycznej i wypowiedzi. W celu zapewnienia kontekstu debatom na temat wolności słowa przedstawiono przegląd konfliktu, a także zarys bojkotu oraz kampanii sankcji.

Nordic countries have been on top of transparency and freedom of expression indexes for years. Denmark topped Transparency International list for 2016 while Finland took first place on World Press Freedom Index 2017. However, it does not mean that Nordic politicians never try to interfere with media content. The purpose of this article is the analysis of pressure that politicians put on Nordic public service media. Serving as a showcase are the events that have recently taken place in Finland. Some elements of the Nordic political culture are also presented, as they can influence the society’s perception of political pressure on media.

Nowadays, the concept of digital media, is nothing new. The article refers to the conditions of legal change implied by the vast progress and revolutionary digital transformation that has taken place when the media, which are an integral part of the communication process, have entered the realm of image culture, a sphere where they obliterate traditional modes of communication, creating a new sphere of influence, without a clear separation between the sender and the receiver. Hence, digital content has become the basis for the construction of a new system of axiology, so relevant in terms of constitutional values.
Media cyfrowe zmieniają cały świat, nakierowując jego działania na rozwój szeroko pojętej komunikacji, wykorzystującej najnowsze technologie cyfrowe. Artkuł odnosi się do warunków zmian prawnych podyktowanych ogromnym postępem i rewolucyjną zmianą cyfrową, które dokonały się w momencie gdy media, będące składową procesu komunikowania, wkroczyły w obszar kultury obrazkowej, w sferę gdzie zacierają dawne sposoby przekazu, tworząc nowy obszar oddziaływania, gdzie użytkownik jest jednocześnie inicjatorem i konsumentem danej informacji, bez wyraźnego podziału na nadawcę i odbiorcę. W ten sposób treści cyfrowe stały się podstawą budowania nowego systemu aksjologii, tak istotnej z punktu widzenia wartości konstytucyjnych. Ich blokowanie wkracza w obszar jednej z najważniejszych reguł dla państwa demokratycznego – wolności słowa.

The constitutional system in Poland covers one of the most important values which is freedom of speech. Due to the regulatory dualism treating the media market also as an important element of the creative industry, freedom of economic activity becomes important in this area. Currently, the implementation of both of these values is influenced by the development of new technologies, which determine the need to adapt legal regulations to them. The basis for the operation of the media is the freedom of speech referred to in the Art. 14 and 54 of the Constitution of the Republic of Poland3. The exercise of these freedoms may be limited in strictly defined situations and must be provided for by law (Art. 31 (3) of the Polish Constitution). Therefore, one cannot speak of an unhampered freedom of action by the media. However, is this rule relevant to the challenges of the changing world and developing virtual reality? In view of modern changes in the principles of creating and using information, the existing rules of media functioning should be verified, without excluding legal instruments which task is to ensure a balance in the relationship between the use of freedom of speech and the protection of its beneficiaries against unauthorized actions. The article presents the issue of the application of the legal instrument of the press title register on the example of a blog4.
System konstytucyjny w Polsce obejmuje swoim zakresem jedną z najważniejszych wartości jaką jest wolność słowa. Ze względu na dualizm regulacyjny traktujący rynek mediów także jako ważny element przemysłu kreatywnego istotna staje się w tym obszarze wolność działalności gospodarczej. Obecnie na realizację obu tych wartości wpływa rozwój nowych technologii, które determinują potrzebę dostosowania do nich regulacji prawnych. Podstawą działania mediów jest wolność słowa, o której mowa w art. 14 i 54 Konstytucji RP. Korzystanie z tych wolności może podlegać ograniczeniom w ściśle określonych sytuacjach i musi być przewidziane przez ustawę (art. 31 ust. 3 Konstytucji RP). Nie można zatem mówić o nieskrępowanej swobodzie działania mediów. Jednak czy ta reguła jest aktualna wobec wyzwań zmieniającego się świata i rozwijającej rzeczywistości wirtualnej? Wobec współczesnych zmian w zasadach tworzenia i korzystania z informacji należy poddać weryfikacji dotychczasowe reguły funkcjonowania mediów, nie wykluczając instrumentów prawnych, których zadaniem jest zapewnienie równowagi w relacji korzystania z wolności słowa i ochrony jej beneficjentów przed nieuprawnionymi działaniami. W artykule zaprezentowano zagadnienie stosowania instrumentu prawnego, jakim jest rejestr tytułu prasowego na przykładzie bloga.

In the face of technological development, the relationship between freedom, including freedom of speech, and security – especially its digital variety, namely cybersecurity – is a particularly difficult relation. It should be pointed out that the international plane is an indispensable dimension of human rights protection, since it is in the international plane that new standards in the field of human rights are created, which are then brought into the system of domestic law and the practice of states. Meanwhile, the existence of international legal regulations increasingly often becomes a guarantee of the effectiveness of domestic legal systems. International institutions often become the institution of appeal for individuals and a lever to force state governments to respect fundamental human rights and freedoms. Support for individuals, communities or nations fighting for their rights, and their success in this struggle, contribute to the formation of a new democratic international order.

The continuous development of technology actually does not allow for the creation of a uniform definition of the media, but the redefinition of the notion of media is necessary. The broadcasters – institutions that have played an essential role have lost their importance as a major player in the media market. They take the position of content providers, and the media users (the auditorium, as widely defined today) and they also do not limit their position to the role of the consumers of the content. Through the availability of various materials, the recipients do not have to be limited now to one broadcaster who can affect the perception of the problem or event. This change was caused by the opportunity of the interaction between the broadcaster and the user. The recipient does not feel just a passive listener, but can actively participate in the creation of media content and thereby substantially influence the content transmission. This issue is important in the situation where the media are required for specific actions, eg. in case of threats and emergencies. The question which arises here is what kinds of media should fullfil such obligations and to what extent you can limit the freedoms and fundamental rights of individuals in the area of communication.

Przeciwnicy szczepień od ponad dwustu lat wyrażają swoje obawy dotyczące niepożądanych skutków wakcynacji. Kierują się powodami wyznaniowymi i światopoglądowymi, odmawiając zaszczepienia siebie i dzieci. Argumentują, iż obowiązek szczepień to ograniczenie ich praw człowieka. Ruch antyszczepionkowy obecny jest w sferze społecznej od XIX w., jednak dopiero po publikacji artykułu Andrew Wakefielda z końca XX w. na temat domniemanego związku pomiędzy szczepieniem a autyzmem – ruch zyskał dużą popularność i przyczynił się do znacznego wzrostu liczby dzieci niezaszczepionych. Współcześnie w erze elektronicznej, masowej komunikacji wydaje się, iż przed badaczami zarówno nauk medycznych, jak i społecznych stoją nowe wyzwania związane z rozpowszechnieniem ruchu. Obecne w cyberprzestrzeni mowa nienawiści, fake news i dezinformacje wzmacniają i utrwalają postawy antyszczepionkowe. Fenomen Facebooka sprawia, iż każda informacja może być kilka tysięcy razy udostępniona innym internautom – nawet ta nieprawdziwa i wprowadzająca w błąd.
The opponents of vaccinations have been expressing their concerns about the undesirable effects of vaccinations for more than two hundred years. They are guided by religious and ideological reasons and refuse to immunize themselves and children. They argue that the obligation to vaccinate is a limitation of their human rights. The vaccination movement has been present in the social sphere since the 19th century, however after the publication of Andrew Wakefield’s article on the subject of the alleged connection between vaccination and autism – the movement became very popular and contributed to a significant increase in the number of unvaccinated children in some countries. Nowadays, in the cyberspace and mass communication, it seems that both medical and social sciences face new challenges related to the spread of the movement. Hate speech, fake news and disinformation present in cyberspace strengthen and consolidate anti-vaccine attitudes. The phenomenon of Facebook means that every information can be made available to other users a few thousand times – even the untrue and misleading.

Artykuł podejmuje problematykę jezuickich źródeł myśli Jakuba Arminiusza. W pierwszej części autor przedstawia argumenty uczonych (Eefa Dekkera, Richarda A. Mullera), którzy zaproponowali suárezańsko-molinistyczną interpretację Arminiusza. Głównym powodem ich poglądów są podobieństwa pomiędzy holenderskim reformatorem i jezuickimi teologami. Owe podobieństwa odnoszą się zasadniczo do próby pogodzenia ludzkiej wolności z Bożą wiedzą. Na drodze tego zabiegu lejdejski profesor miałby zwrócić się ku koncepcji scientia media. W drugiej części zaprezentowano niemolinistyczne odczytanie Arminiusza. Ta perspektywa wychodzi od tomistycznej doktryny Boga i teologii stworzenia holenderskiego reformatora (William G. Witt), dowodząc, iż molinizm jest z nimi sprzeczny, zwłaszcza przez wzgląd na chęć uniknięcia teologicznego determinizmu przez Arminiusza. Innym ważnym faktem, zauważonym przez F. Stuarta Clarka, jest soteriologiczny personalizm lejdejskiego profesora, objawiający się w jego rozumieniu w relacji łaska – wolna wola czy też Duch Święty – człowiek. Ten personalizm nie został wywiedziony z nauczania Suáreza i Moliny, tak więc dość niepewne jest to, że odzwierciedlał ich opinie na temat zgodności łaski i wolnej woli. Wszystko to prowadzi do konkluzji, iż Arminiusz powinien zostać uznany za semimolinistę.
The article undertakes the issue of Jesuit’s sources of Jacob Arminius’ thought. In the first part, the author presents arguments of scholars(Eef Dekker, Richard A. Muller), who proposed the suárezian-molinist interpretation of Arminius. The main reason of their views lays in the similarities between the Dutch reformer and the Jesuit’s theologians. These similarities mainly relate to an attempt to reconcile human freedom with God’s knowledge. On the way of this exertion, the Leiden professor would have to turn toward the concept of scientia media. In the second part the author shows a non-molinist understanding of the Arminius’ thought. This perspective is coming from the Thomistic doctrine of God and theology of creation of Dutch reformer (William G. Witt), proving that molinism contradicts with them. Especially for the sake of Arminius’ desire to avoid the divine determinism. Another important fact, noted by F. Stuart Clarke, is the soteriological personalism of the Leiden professor, which is revealed by his comprehension of the relation grace-free will or Holy Spirit-man. This personalism was not derived from the teaching of Suárez and Molina, so it is quite uncertain whether it reflects their opinions about concordance of grace and free will. All of this leads to a conclusion that Arminius should be considered as semi-molinist.

Opis:
The paper contains an attempt to reconstruct Tomasz Goban-Klas´ views on the ethics of journalism and media. What was first discussed was the central element of the theoretical construction of the ethical field of the media - the triangle: freedom, responsibility and professionalism. Then the evolution of this idea in the context of evolution and social-communication metamorphosis of the media was traced. It has been found that subjectivity of the human being and media institutions has currently changed to such an extent that the most appropriate description and assessment of media ethics will be to show it in the logic of non-zero-sum games as referred to the collective entity creating the media communication system.

Istotne jest by rozwiązania przyjęte w ramach danego systemu prawnego gwarantowały swobodne korzystanie z wolności słowa. Trzeba jednak mieć na uwadze, że wolność słowa nie ma charakteru absolutnego i dopuszcza się jej ograniczanie, zwłaszcza w zakresie, w jakim wymaga tego ochrona innych praw i wolności. Jak jednak słusznie podkreśla się w doktrynie zwłaszcza w przypadku radia i telewizji limitowanie wolności słowa należy poddać szczególnemu reżimowi. W jego ramach ograniczanie tej wolności powinno następować w wyjątkowo „ostrożny” sposób sprowadzający się do niezwykle drobiazgowej kontroli przyczyn takiego ograniczenia. Organem powołanym do ochrony wolności słowa w radiofonii i telewizji jest Krajowa Rada Radiofonii i Telewizji. Jednocześnie do jej zadań należy stanie na straży interesu publicznego w radiu i telewizji, a więc ochrona również innych praw i wolności. KRRiT nie znajduje się więc w łatwej sytuacji. Nie dość bowiem, że działa w specyficznym sektorze, to jeszcze w jego ramach powinna realizować trudne zadania polegające na ochronie wolności słowa z jednej strony, z drugiej zaś na ochronie innych praw i wolności stanowiących granicę wolności słowa. Ze względu na to, że działania KRRiT mogą prowadzić do ograniczania konstytucyjnych praw i wolności każda z jej decyzji powinna zawierać szczegółową analizę dotyczącą potrzeby wprowadzanego ograniczenia.
National Broadcasting Council is the regulatory body competent in radio and television broadcasting. The National Broadcasting Council aims are described in the Constitution and they concern safeguarding the freedom of speech, the right to information as well as safeguarding the public interest regarding radio broadcasting and television (Article 213 [1]). These are three interests the National Broadcasting Council is obligated to protect. The provisions of Constitution find their reflection in the Broadcasting Act that repeats that the National Broadcasting Council safeguards the freedom of speech in radio and television broadcasting, protects the independence of media providers and the interests of the public, as well as ensures an open and pluralistic nature of radio and television broadcasting (Article 6 [1]). The way of carrying out the above-mentioned tasks by the National Broadcasting Council causes that this body is described as a censor. It is criticized for carrying out its functions in an excessive way that is by commencing unnecessary proceeding against broadcasters. Such way of interpreting provisions of the Broadcasting Act by the National Broadcasting Council creates uncertainty of broadcasters and their conviction of the necessity of moderating the mode of expression or avoiding some subjects which they consider as being more controversial. It is also emphasized in case the National Broadcasting Council politicization its control tasks can be carried out in order to impose a specific concept of morality upon broadcasters.

In the Hungarian legal system, the anti-hate speech rules of media law provide an ad-ditional (administrative) proceeding for the media authority in parallel with proceedings under criminal law and civil law. The media authorities, over the past twenty years, have consistently set media law sanctions at a lower intervention threshold than criminal law did, and in many cases, they established media law violation in cases where criminal proceedings for incitement against a community were not initiated or ended in acquittal. The fundamental aim of media law regulation is to shape media content and the edit-ing practices of media players with a view to ensure respect for human dignity, and to prevent media from becoming an ‘amplifier’ of hateful communications. In the first four-teen years of the Hungarian media regulation, the scope of interpretation concerning anti-hate speech media law restrictions developed gradually. The authority reacted not only to individual cases, and individual communications, but also carried out targeted investigations in cases that can be described as a phenomenon in the media coverage. Besides reviewing news and information programmes, it also acted against hateful con-tents of the entertainment programmes. The new media regulation, which entered into force in 2011, partially amended the content of the former anti-hate speech regulation: in addition to the provisions of “incitement to hatred”, the former category of “offending or prejudiced content” was replaced by the prohibition of “exclusion”. The practice of the media authority has not changed as regards the assessment of the media law standard, as the authority has continued to apply it differently from the criminal law standard, con-sidering it as a lower intervention threshold. However, in comparison with pre-2010 practice, the authority initiated considerably fewer proceedings and its approach in terms of law enforcement became less characterised by adjudicating problems that can be de-scribed as phenomenon in the media coverage, no targeted proceedings of this kind were initiated. Its practice can be characterised by a couple of high profile cases with extreme sanctions, which attract great attention. These cases are important as they designate the boundaries of public communications, but in this way, media law measures are not really suitable for making any substantial changes to the characteristics of the media coverage.

Celem niniejszego artykułu jest analiza sposobu korzystania przez dziennikarzy z prawa do anonimatu. Autora interesuje nie tylko samo pierwotnie zakładane przeznaczenie tego prawa (perspektywa teoretyczna), ale przede wszystkim porównanie, na ile obecne zachowanie dziennikarzy w tym zakresie jest zgodne z założeniem, jakiemu prawo to prymarnie miało służyć. Podstawą udzielenia odpowiedzi na zadane pytanie są wyniki badań przeprowadzonych przez autora – przede wszystkim jakościowych (obserwacja uczestnicząca i wywiady pogłębione), ale również ilościowych (sondaż). W tekście odniesiono się także do poszczególnych przypadków skorzystania przez dziennikarzy z prawa do anonimatu (case-study). Analiza danych wskazuje, że sposób, w jaki dziennikarze decydują się używać współcześnie prawa do anonimatu, może budzić wątpliwości choćby natury etycznej. Dlatego naturalne staje się pytanie, czy prawo do anonimatu w ogóle obejmuje swoim zakresem tego typu działania.
This paper seeks to analyze (research) the way journalists use the right to anonymity. Importantly, the author is interested not only in the original purpose of the relevant regulation (theoretical perspective), but rather in to what extent journalists’ behavior is consistent with the original assumption of the right to remain anonymous. The basis for answering this question is the results of the research carried out by the author – in particular with the use of qualitative (participatory observation, in-depth interview) and quantitative research (survey) methods. This paper also analyzes real situations where journalists used the right to anonymity (case study). Based on the data gathered, it should be underlined that the way how journalists use the right to anonymity raises at least ethical doubts. In this context, the major question is whether the described activities fall within the scope of the right to anonymity.
