Opis:
Regardless of when and where migration takes place, the situation of a child-migrant is similar. In the context of migration a child of school (or even preschool) age commonly encounters problems associated with relationships with people in specifi roles. Children are in contact with their peers belonging to the “indigenous” national community, and (possibly) also with peers of other nationalities, including other emigrants, the teaching staff, and the school system as a whole. A study of the situation and problems of immigrant children in one country can therefore provide valuable information on the possible directions of research, research methods and techniques, and the range of problems that such a study should take into account. Researchers of Polish emigration to Western Europe (especially of post-accession emigration) have already stressed the need to pay attention to the situation of the child-migrant. In this article I present some of the problems faced by child migrants and their families using case studies researched in Poland.

Goal – the article analyses the most important legal acts regulating the employment of foreigners in Poland. The article aims to evaluate the adequacy of the introduced legal changes to the needs of the Polish labour market. The assumed hypothesis was that the legal regulations on the employment of foreigners in Poland are adjusted to the changes in the economic reality. Research methodology – the article includes an analysis of the available literature and the current legal acts that regulate the studied problem. Moreover, observations con cerning the adaptation of Polish legal regulations to the constantly growing interest of foreigners in the Polish labour market were made in the article. Score/results – the conducted analysis allowed us to verify the research hypothesis positively. It has been acknowledged that the provisions of Polish law in the field of employment of foreigners have been adapted to the changing economic conditions, al though the procedure for obtaining work permits for foreigners remains complicated. Originality/value – the article shows a cross-section of changes that have taken place in Polish labour law in the field of employment of foreigners in recent years.Changes in the Polish labour law have been presented chronologically, which helps to organize the knowledge on the topic. Moreover, it also considers the current problem of the COVID-19 pandemic and its impact on legal aspects of employment of foreigners in Poland.

The work presents the results of the preliminary research on the employment of foreigners’ that were conducted among Polish banking institutions being the international corporations with a global reach. The initial results of the analysis shows the potential impact that specific employment policies exert on personal attitudes of foreign executives and operations of the companies in which they are employed. The analysis described in this work identifies the most important elements which hinder the development of those banks whose employment policies are based on the assumption that hiring foreigners is more beneficial than taking on local managers regardless of their familiarity with Polish market mechanisms. The qualitative research that were conducted in the form of the scenario-based interviews, were carried out with both, a group of managers (mainly heads of HR departments and senior executives) cooperating with the foreigners on everyday basis, and the foreigners themselves. The preliminary studies have revealed a number of trends and phenomenon that were described within this work.

Opis:
Forced migration is a phenomenon affecting various parts of the world. Throughout history, people have been forced to leave their own country due to wars, conflicts, persecution and poverty in search of safety and livelihood. The events of recent years that Poland has been experiencing (including the COVID-19 pandemic, the Poland-Belarus border crisis, Russia’s invasion of Ukraine and the earlier migration crisis of 2015/2016) have led to changes in the pattern of migration, migration policy, as well as law in this regard. Poland is becoming a destination for an increasing number of refugees. Crises have put to the test Poland’s current migration and refugee policy. It has become apparent that the existing institutional and legal solutions are insufficient. In addition, it is not easy to cooperate and present a united front on the European Union forum in the face of potential threats resulting from successive migration waves. The purpose of this article is to present the institutions dealing with international protection of foreigners in Poland, describe their scope of competence, as well as discuss the need for new solutions. An aspect of particular importance is the ability to correctly identify a given situation and needs in order to grant (or refuse) a specific form of protection accordingly.
Вынужденная миграция представляет собой явление, затрагивающее различные части мира. На протяжении всей истории люди были вынуждены покидать свою страну из-за войн, конфликтов, преследований и нищеты в поисках безопасности и средств к существованию. События последних лет, которые переживает Польша (в том числе пандемия COVID-19, пограничный кризис между Польшей и Беларусью, вторжение России в Украину и более ранний миграционный кризис 2015/2016 гг.), привели к изменениям в модели миграции, миграции политики, а также законодательства в этом отношении. Польша становится местом назначения для все большего числа беженцев. Кризисы подвергли испытанию текущую миграционную политику Польши и политику в отношении беженцев. Стало очевидно, что существующих институциональных и правовых решений недостаточно. Кроме того, нелегко сотрудничать и выступать единым фронтом на форуме Европейского союза перед лицом потенциальных угроз, возникающих в результате последовательных волн миграции. Цель этой статьи – представить учреждения, занимающиеся международной защитой иностранцев в Польше, описать сферу их компетенции, а также обсудить необходимость новых решений. Особенно важным аспектом является способность правильно определить данную ситуацию и потребности, чтобы соответственно предоставить (или отказать) конкретную форму защиты.

The SARS-CoV-2 pandemic affected almost all the inhabitants of the globe, and mi-grants were among those who felt it particularly hard. Their problems were largely related to numerous limitations in the international movement of persons. As part of the fight against these effects, national governments have initiated a discussion on the idea of launching vaccine certificates, sometimes called “Covid passports”. The concept has been developed and has led to the adoption of specific solutions in various countries, as well as on a wider, regional scale, in particular in the form of the EU digital COVID certificate. In the paper, the authors outline individual concepts and consider whether a vac-cine certificate does indeed bear the features of a travel document and whether it is justified to use this term. They go on to contrast the idea of issuing such certificates with national, EU and regional law. Finally, they reflect on what formal and material conditions must be met by such a document in order to enable the holder to cross borders, and whether such tools can be reused in the event of future pandemics. The research allows several conclusions to be formulated. The EU digital COVID certificate or other certificates cannot be regarded as travel documents, in particular, they cannot be called passports. Vaccine certificates are not meant to be a privilege or a restriction, but only an instrument that allows possible restrictions in the international movement of persons to be waived for the holder of the document (assuming that the restrictions themselves are not illegal). They should be consid-ered a temporary measure, applied in extraordinary circumstances as an instrument in the hands of states or state organizations, not private entities. In such a formula, they can also be used in the event of similar epidemic threats in the future.

In the paper, the author outlines the subject of crime among foreigners of Vietnamese origin in Poland. The Vietnamese residing in Poland were characterised as an introduction. Subsequent waves of immigration, their causes, problems of integration with the society, feeling of dissimilarity, and general features of this minority were analysed. Basic statistical data regarding the size of this group, regulations regarding the legality of their stay, and other important information were presented. Work performed in Poland, carrying out business activities, and everyday life were taken into account. In the second part of the paper, crime among the citizens of Vietnamese origin was analysed. The analysis was based mostly on figures extracted from police, penitentiary, and judicial statistics. Data on the number of persons of Vietnamese nationality in prisons and detention centres, the amount of crime related to irregular crossing of an external border, and other data characterising criminal behaviours of this group were presented. Moreover, examples of illegal activities including areas particularly at risk were given. The author emphasised that the Vietnamese are suspected of illegal crossing of external borders, smuggling, drug offences, and unlawful acts related to the widely understood commerce. A statistic regarding the Vietnamese convicted by a final court judgement in 2014 in view of the full extent of crime was demonstrated. In this case, penalties and penal measures ordered by the Polish judicial system and the categorisation of offences compliant with the legislation in effect. To conclude, the crime dynamics in Poland in 2003–2005 was presented.

The historical fate of one of the most critical regions, Southwestern Georgia, is indeed remarkable. This powerful centre of Georgian civilisation, with its historical plight, was forcibly torn off a mother’s bosom and became a part of another state. However, its inhabitants managed to preserve the love and respect for their native language. As a result of the war between Russia and Turkey (1877–1878), the region was reunited with its native land. Still, this time the Caucasian administration of the Russian Empire began to impede its development and tried to set this side against the rest of Georgia. According to Russian officials, it was to become an essential military outpost of Russian expansion in the Middle East and a springboard for the far-reaching plans of the empire. Foreigners were also interested in this region of Georgia. They repeatedly visited this area and left us remarkable materials about the political, social, economic, cultural and educational life of South-West Georgia of that time (i.e., 19th centuries).

Subject and purpose of work: The publication comprises the analysis of the most important legislation governing the employment of foreigners in Poland and the data of significance to developing legal solutions in this area. The purpose of the paper is to evaluate the suitability of the adopted solutions to the needs of the labour market. Materials and methods: The performed legal analysis is closely related to the statistical analysis of the transformations of the Polish labour market which have taken place over the last 6 years, with particular attention to demographic and economic data. The authors also applied qualitative methods in the form of observations concerning the adaptation of Polish laws to the demand for hiring foreigners, as well as the presentation of the results of surveys analysing the opinions and sentiments of labour market participants, labour market forecasts published on a regular basis, and inspections carried out by authorised entities. Results: The systematic decrease in the Polish population and increasing staff deficits reported by employers are among the most important challenges. The deficits are largely supplemented by Ukrainian employees, yet there are growing concerns that difficulties in acquiring new staff may aggravate, as the competition in attracting foreign staff is becoming increasingly perceptible. In Poland, relevant legal instruments concerning the employment of foreigners are mostly stipulated in the Foreigners Act, the Act on employment promotion and labour market institutions, and in secondary legislation to these Acts. The laws are very complex, they lack comprehensive solutions in the field of foreigner employment policy, while competent offices and authorities experience difficulties in fulfilling their tasks. Conclusions: It is necessary to develop and implement a comprehensive strategy as part of employment policies, taking into account the urgent and actual demand of the labour market for foreigners’ work.
Przedmiot i cel pracy: Publikacja zawiera analizę najważniejszego ustawodawstwa dotyczącego zatrudnienia cudzoziemców w Polsce oraz danych istotnych dla kształtowanych rozwiązań prawnych w tym obszarze. Celem pracy jest dokonanie oceny adekwatności przyjętych rozwiązań do potrzeb rynku pracy. Materiały i metody: Dokonana analiza prawna związana jest ściśle z analizą statystyczną zmian zachodzących na polskim rynku pracy na przestrzeni ostatnich 6 lat, ze szczególnym uwzględnieniem danych demograficznych i gospodarczych. Autorzy zastosowali również metody jakościowe w postaci obserwacji dotyczącej adaptacji polskiego ustawodawstwa do zapotrzebowania na pracę cudzoziemców, jak również prezentacji przeprowadzonych badań opinii i nastrojów uczestników rynku pracy, publikowanych cyklicznie prognoz dla rynku pracy i zrealizowanych przez uprawnione organy kontroli. Wyniki: Jednym z największych wyzwań jest systematyczny spadek populacji Polski oraz wzrost deficytów kadrowych zgłaszanych przez pracodawców. Deficyty te w głównej mierze uzupełniają pracownicy z Ukrainy, jednak rosną obawy, że trudności w rekrutowaniu kadr mogą się pogłębiać, ponieważ coraz bardziej odczuwalna jest rywalizacja pomiędzy państwami o pracowników zza granicy. W Polsce odpowiednie instrumenty prawne dotyczące zatrudniania obcokrajowców zawarte są przede wszystkim w ustawie o cudzoziemcach, ustawie o promocji zatrudnienia i instytucjach rynku pracy, a także w aktach wykonawczych do tych ustaw. Przepisy te są bardzo skomplikowane, brakuje kompleksowych rozwiązań w zakresie polityki zatrudniania cudzoziemców, a właściwe urzędy i organy nie radzą sobie z powierzonymi im zadaniami. Wnioski: Konieczne jest przyjęcie i wdrożenie kompleksowej strategii w ramach polityki zatrudnienia, uwzględniającej pilne i realne zapotrzebowanie polskiego rynku pracy na pracę cudzoziemców.

Opis:
The article analyzes the fundamental problems of special (separate) administrative proceedings in the cases regulated by the Act on Foreigners and the Act on Granting Protection to Aliens on the territory of the Republic of Poland. The essential differences in the area of administrative process institutions are presented and discussed. All considerations are illustrated with relevant examples of the analyzed statutory provisions, which introduce modifications in relation to the Administrative Procedure Code.

The article is a qualitative study of the selected aspects of the systemic transformation in Poland experienced by foreigners who lived there. Its goal is show the processes which have been the subject of discussions and debates in Poland for more than 20 years through the eyes of „the stranger”. The research consists of 19 biographical interviews. In the article I reconstruct the ways of political thinking and attitudes towards systemic changes. I pay particular attention to the factors which shaped them – both determinants rooted in the period before the migration (such as: social origin, political views etc.) and experiences from Poland. Differences in perception of the time of so-called „Carnival of Solidarity” and the transformation in 1989 and their sources will be illustrated.

The article presents the outcome of the research of Polish Measurement of Attitudes and Values (PPPiW) on the attitudes of the Poles towards foreigners carried out in 2009 and 2010. The Bogardus Social Distance Scale was used in the analyses in order to describe the social distance between the Poles and the foreigners. The outcome facilitates the comparison at the local (Warsaw) and the national level together with the description of different perspectives towards strangers. According to respondents, immigrants should integrate themselves into the society by learning Polish and by accepting local axiomatic and normative rules. Although the Poles are likely to accept foreigners as their neighbours or work colleagues, they are less keen on them as potential partners of their children. According to the acquired data, Polish citizens express positive feelings towards „different” cultural groups but think in stereotypes.

The paper discusses selected results of a study carried out among 263 enterprises in the Opole Province. The study involved, among others, non-salary employment conditions the enterprises offer or would be willing to offer to foreigners. These included e.g. housing, meals, payment for travel costs. The issue of non-salary employment conditions is part of studies focusing on economic migration as employment of foreign labour often involves additional costs and obligations for employers. It was determined that, when asked about additional employment conditions that they would be willing to offer to foreign workers apart from the salary, more than 1/3 of the enterprises mentioned the help in finding housing. However, a similar number (27.5%) of respondents also claimed they did not intend to offer (or did not offer) any additional conditions. More than 9% would offer free or subsidised meals, while a similar group (8.9%) – free housing. 7.6% of respondents would fully (or partially) pay for travel costs of foreigners coming to Poland.

Although it was not before 1989 that Warsaw gradually became a genuinely multiethnic environment, a group of aliens had inhabited the city in 1945–89. Somewhat paradoxically, the Polish capital city’s foreigner landscape proved to be the most variegated, diverse and vivid in the first post-war decade. The Russians, Germans, Englishmen, Frenchmen, or Italians already residing in Warsaw were joined, as part of post-war voluntary and forced (political-refugee) migration, by nationals of Spain, Greece, Korea, Persia, Yugoslavia, or even Canada. The article shows the ways along which they reached Poland and Warsaw, and the various aspects of everyday life of those aliens: work, assimilation, and political entanglements.

Phraseological Education of Foreigners

The article reviews a computer programme called Frazpol which is a teaching aid designed especially for foreigners. The name comes from the phrase “Frazeologia polska” (Polish phraseology). The author begins with some observations on the significance of teaching phraseology of a foreign language. The aim of this article is to discuss selected results of research conducted in Opole Province among foreigners working legally in Poland. One of the key tasks was to establish the salaries earned by foreigners taking up regular employment. Respondents were divided according to the theory of dual labor market by M. Piore on representing the primary and second segment of the labour market. The study involved 29 people working in the primary labour market (including foreign languages, teachers, managers of foreign companies, medical staff), and 188 people from the secondary labour market (skilled and unskilled workers). During the study it was found that the average wage in the primary labour market are little more than 5303 PLN net, while the secondary labour market is the amount of nearly 3,000 PLN net. It also specifies that there are differences in performance pay between men and women - men attain higher salaries than women, and the difference is greater for primary than for secondary labour market. The study also made it possible to obtain information that the highest salaries receive foreigners employed in services, while the lowest people who work in agriculture.

In view of the challenges faced by the Polish labour market and the growing role of foreign labour force, it seems to be necessary to verify the factors stimulating and hindering the use of foreign workers. This article aims to present the factors from the perspective of employers and employees. Establishment of incentives for employment and impede the use of foreign labour force is crucial in the perspective that may appear on the Polish labour market. Already is observed a lack of manpower in certain industries and occupations (e.g. construction, agriculture), which is related to one side of the international migration of native labour force, on the other by mismatch of skills of Polish workers to labor market needs. The article uses the results of studies conducted in the Opole Voivodeship among employers of foreigners and among foreign workers. Employers as barriers of employment of foreigners pointed formal and legal conditions. However, for foreigners the biggest hurdle was the lack of knowledge of Polish language. Among the demands of changes that may facilitate the use of foreign workers, employer pointed reduce of formality and foreigners have mentioned whiling away the time needed for obtaining visa.

W artykule prezentujemy analizę zbiorowości cudzoziemców podejrzanych o popełnienie przestępstwa w Polsce w latach 2013–2016, na podstawie policyjnej statystyki przestępczości. Analizujemy obywatelstwo podejrzanych cudzoziemców, płeć, strukturę ich przestępczości, miejsce popełnienia przestępstwa w podziale na województwa. Odwołujemy się do analizy zbioru danych w policyjnych statystykach przestępczości za lata 2004–2012. Podejrzani cudzoziemcy w Polsce, w latach 2013–2016 to 1% zbiorowości podejrzanych ogółem.
The article presents an analysis of the foreigners population suspected of commited crimes in Poland in 2013–2016 years, on the basic of police crime statistics. We analyze the citizenship and sex of suspected foreigners, structure the crime they committed but also place where the crime was commited (divided into voivodships). We refer to the analysis in the set of crime police statistics forthe 2004–2012 years. Suspected foreigners in Poland, in 2013–2016 years, was 1% of the total population of suspects.
