Opis:
Regardless of when and where migration takes place, the situation of a child-migrant is similar. In the context of migration a child of school (or even preschool) age commonly encounters problems associated with relationships with people in specifi roles. Children are in contact with their peers belonging to the “indigenous” national community, and (possibly) also with peers of other nationalities, including other emigrants, the teaching staff, and the school system as a whole. A study of the situation and problems of immigrant children in one country can therefore provide valuable information on the possible directions of research, research methods and techniques, and the range of problems that such a study should take into account. Researchers of Polish emigration to Western Europe (especially of post-accession emigration) have already stressed the need to pay attention to the situation of the child-migrant. In this article I present some of the problems faced by child migrants and their families using case studies researched in Poland.

The work presents the results of the preliminary research on the employment of foreigners’ that were conducted among Polish banking institutions being the international corporations with a global reach. The initial results of the analysis shows the potential impact that specific employment policies exert on personal attitudes of foreign executives and operations of the companies in which they are employed. The analysis described in this work identifies the most important elements which hinder the development of those banks whose employment policies are based on the assumption that hiring foreigners is more beneficial than taking on local managers regardless of their familiarity with Polish market mechanisms. The qualitative research that were conducted in the form of the scenario-based interviews, were carried out with both, a group of managers (mainly heads of HR departments and senior executives) cooperating with the foreigners on everyday basis, and the foreigners themselves. The preliminary studies have revealed a number of trends and phenomenon that were described within this work.

Goal – the article analyses the most important legal acts regulating the employment of foreigners in Poland. The article aims to evaluate the adequacy of the introduced legal changes to the needs of the Polish labour market. The assumed hypothesis was that the legal regulations on the employment of foreigners in Poland are adjusted to the changes in the economic reality. Research methodology – the article includes an analysis of the available literature and the current legal acts that regulate the studied problem. Moreover, observations con cerning the adaptation of Polish legal regulations to the constantly growing interest of foreigners in the Polish labour market were made in the article. Score/results – the conducted analysis allowed us to verify the research hypothesis positively. It has been acknowledged that the provisions of Polish law in the field of employment of foreigners have been adapted to the changing economic conditions, al though the procedure for obtaining work permits for foreigners remains complicated. Originality/value – the article shows a cross-section of changes that have taken place in Polish labour law in the field of employment of foreigners in recent years.Changes in the Polish labour law have been presented chronologically, which helps to organize the knowledge on the topic. Moreover, it also considers the current problem of the COVID-19 pandemic and its impact on legal aspects of employment of foreigners in Poland.

Opis:
Forced migration is a phenomenon affecting various parts of the world. Throughout history, people have been forced to leave their own country due to wars, conflicts, persecution and poverty in search of safety and livelihood. The events of recent years that Poland has been experiencing (including the COVID-19 pandemic, the Poland-Belarus border crisis, Russia’s invasion of Ukraine and the earlier migration crisis of 2015/2016) have led to changes in the pattern of migration, migration policy, as well as law in this regard. Poland is becoming a destination for an increasing number of refugees. Crises have put to the test Poland’s current migration and refugee policy. It has become apparent that the existing institutional and legal solutions are insufficient. In addition, it is not easy to cooperate and present a united front on the European Union forum in the face of potential threats resulting from successive migration waves. The purpose of this article is to present the institutions dealing with international protection of foreigners in Poland, describe their scope of competence, as well as discuss the need for new solutions. An aspect of particular importance is the ability to correctly identify a given situation and needs in order to grant (or refuse) a specific form of protection accordingly.
Вынужденная миграция представляет собой явление, затрагивающее различные части мира. На протяжении всей истории люди были вынуждены покидать свою страну из-за войн, конфликтов, преследований и нищеты в поисках безопасности и средств к существованию. События последних лет, которые переживает Польша (в том числе пандемия COVID-19, пограничный кризис между Польшей и Беларусью, вторжение России в Украину и более ранний миграционный кризис 2015/2016 гг.), привели к изменениям в модели миграции, миграции политики, а также законодательства в этом отношении. Польша становится местом назначения для все большего числа беженцев. Кризисы подвергли испытанию текущую миграционную политику Польши и политику в отношении беженцев. Стало очевидно, что существующих институциональных и правовых решений недостаточно. Кроме того, нелегко сотрудничать и выступать единым фронтом на форуме Европейского союза перед лицом потенциальных угроз, возникающих в результате последовательных волн миграции. Цель этой статьи – представить учреждения, занимающиеся международной защитой иностранцев в Польше, описать сферу их компетенции, а также обсудить необходимость новых решений. Особенно важным аспектом является способность правильно определить данную ситуацию и потребности, чтобы соответственно предоставить (или отказать) конкретную форму защиты.

The SARS-CoV-2 pandemic affected almost all the inhabitants of the globe, and mi-grants were among those who felt it particularly hard. Their problems were largely related to numerous limitations in the international movement of persons. As part of the fight against these effects, national governments have initiated a discussion on the idea of launching vaccine certificates, sometimes called “Covid passports”. The concept has been developed and has led to the adoption of specific solutions in various countries, as well as on a wider, regional scale, in particular in the form of the EU digital COVID certificate. In the paper, the authors outline individual concepts and consider whether a vac-cine certificate does indeed bear the features of a travel document and whether it is justified to use this term. They go on to contrast the idea of issuing such certificates with national, EU and regional law. Finally, they reflect on what formal and material conditions must be met by such a document in order to enable the holder to cross borders, and whether such tools can be reused in the event of future pandemics. The research allows several conclusions to be formulated. The EU digital COVID certificate or other certificates cannot be regarded as travel documents, in particular, they cannot be called passports. Vaccine certificates are not meant to be a privilege or a restriction, but only an instrument that allows possible restrictions in the international movement of persons to be waived for the holder of the document (assuming that the restrictions themselves are not illegal). They should be consid-ered a temporary measure, applied in extraordinary circumstances as an instrument in the hands of states or state organizations, not private entities. In such a formula, they can also be used in the event of similar epidemic threats in the future.

In the paper, the author outlines the subject of crime among foreigners of Vietnamese origin in Poland. The Vietnamese residing in Poland were characterised as an introduction. Subsequent waves of immigration, their causes, problems of integration with the society, feeling of dissimilarity, and general features of this minority were analysed. Basic statistical data regarding the size of this group, regulations regarding the legality of their stay, and other important information were presented. Work performed in Poland, carrying out business activities, and everyday life were taken into account. In the second part of the paper, crime among the citizens of Vietnamese origin was analysed. The analysis was based mostly on figures extracted from police, penitentiary, and judicial statistics. Data on the number of persons of Vietnamese nationality in prisons and detention centres, the amount of crime related to irregular crossing of an external border, and other data characterising criminal behaviours of this group were presented. Moreover, examples of illegal activities including areas particularly at risk were given. The author emphasised that the Vietnamese are suspected of illegal crossing of external borders, smuggling, drug offences, and unlawful acts related to the widely understood commerce. A statistic regarding the Vietnamese convicted by a final court judgement in 2014 in view of the full extent of crime was demonstrated. In this case, penalties and penal measures ordered by the Polish judicial system and the categorisation of offences compliant with the legislation in effect. To conclude, the crime dynamics in Poland in 2003–2005 was presented.
