The subject matter of the essay is the tasks of the President of the Energy Regulatory Authority in relation to energy policy in Poland. The essay is divided into two parts. The first part presents basic information about the national regulatory authority, regulation and kinds of energy policy. The second focuses on the tasks of the President of the Energy Regulatory Authority in various areas, such as: energy effectiveness, energy security, renewable forms of energy and competition in the energy market. The article examines the tasks carried out by the President in the past and those which must come into force in the future to modernize the Polish energy market. Finally, the author thrashes out the legal relations between the functions of the President of the Energy Regulatory Authority and the aims mentioned in Polish energy policy. The author pays special attention to the problems of liberalisation in the energy market in Poland.

This article presents problems associated with the development of competition on the Polish energy market in the context of tariffs and pricing. National standards are set against the background of European legislation and the activities of the Energy Regulatory Office. The thesis is that the tariffs concerning distribution should be approved by the President of this authority because it is a natural monopoly, something the authors demonstrate in the following part of the article. However, the tariffs concerning selling should be free from confirmation even for households because this is a typical market. The authors do not ignore legal analysis and practical issues.
Cet article présente les problèmes associés avec le développement de la concurrence dans le marché de l’énergie en Pologne, dans le contexte des tarifs et des prix. Les standards nationaux sont présentés dans le contexte de la législation européenne et des activités de l’autorité de régulation de l’énergie (ERA). La thèse est que les tarifs concernant la distribution devront être acceptées par le Président de l’ERA, parce que c’est un monopole naturel, ce qui sera expliqué par les auteurs dans la partie suivante de l’article, mais les tarifs concernant la vente devront être libre, même pour les ménages, parce que c’est un marché typique. Les auteurs n’ignorent pas l’analyse de la loi et les aspects pratiques.

This article presents the task of municipal government involving the provision of heat, electricity and gaseous fuels for the local inhabitants. First of all, the notion of municipal task is outlined. Then, the task of municipal supply is analysed in some detail, its various interpretations in doctrine and attempts at qualifying it. Further, the article discusses the various legal instruments municipal government uses to accomplish the said task. In this part, our attention is drawn mainly to the role of municipal government in the supply process as well as that of electrical companies which support the municipality in this task. Electricity undertakings perform significant tasks in this process, resolving technical issues in particular, while the role of the municipality is limited mostly to planning and organisation of energy supplies. It is important to distinguish between the tasks of local government and those of electricity undertakings.

The opinion presents major differences in the legal situation of clients- entrepreneurs in relation to (legally privileged) recipients being household owners and consumers. Moreover, the author presents legal arguments for an extension of the protection standard regarding privileged entrepreneurs to micro-entrepreneurs and small entrepreneurs under the European Union legislation and in compliance with the national one. The opinion contains arguments for a specific national legislation, which would provide content to the state obligation to provide assistance to the development of entrepreneurship, in particular the micro-entrepreneurs, and which would facilitate an effective use of liberties of a uniformed EU market in the trans-border dimension.

The Agency for the Cooperation of Energy Regulators (ACER) has been established in 2009 in the Third Liberalization Package of Energy Sector. The Agency became fully operational in 2011. After 5 years of its functioning the Author presents his opinion on general issues like legitimacy of the European Union regarding the tendency of creating new European agencies (among them ACER) and the problem of the common belief in rule of experts in the typical field of politics. Subsequently the paper handles the history of setting up the Agency and the description of its bodies and competencies in order to present the achievements of ACER within 5 years of its work. The Author concludes with positive statement: ACER meets its goals, encompassing the principle of subsidiarity and helping the Commission and National Regulatory Authorities in realizing the aim of establishing the common energy market in European Union.

The functioning of the energy industry is largely based on legal norms and energy policies, which set the direction and development of business opportunities. The everchanging energy law creates opportunities for manufacturers operating in the renewable energy sector to adapt quickly to new conditions. The article presents the influence of changes in the field of energy law – the Act on Renewable Energy Sources – on the need to change business models of companies (renewable energy producers) determining their strategy in the energy market. Due to numerous legal changes in Poland in recent years, entrepreneurs have been forced to update existing business models. This paper analyzes the impact of legal aspects on renewable energy business models by presenting their variants in the light of the changing energy law, the scale needed to introduce model changes and strategies for further effective functioning on the energy market, and above all adaptation to new regulatory requirements.

Georgia signed an Association Agreement with the European Union in 2014, and this launched a process of approximation and harmonization with EU law. Energy law is one of the most important areas, which has to be developed and modified in accordance with the EU directives, regulations and rules of the Energy Community. Georgia took responsibility for establishing the energy exchange system and reorganizing the Georgian electricity market on a new model. In fact, these issues have not been studied, as they require, on the one hand, a very in-depth, practical knowledge of the issue and, on the other hand, erudition in the issues of legal approximation and information about the obligations assumed by the association agreement. The purpose of the article is to review the legislative regulations on the Georgian electricity market, the legal framework that defines the main principles of the market, the basis of operation, and sociopolitical and legal mechanisms of market stability. In the article, special attention will be paid to the status of the energy exchange in Georgia, its concept, its legal basis, problematic issues related to its implementation, and the future perspective. As a result of the analysis of the issues, based on the evaluation of the existing problems, the necessary legal ways of the development of energy law and the mechanisms promoting harmonization with the laws of the European Union are determined.

The subject of the research is a presentation of the right to compensation in vertical relationships due to unfair practices under international agreements and the Gas Directive. The thesis centres on the presentation of proof that Gazprom abuses its dominant position. The paper presents the multidimensional content of Gazprom’s dominant activities, which significantly distorts the European energy market. Initially, the author indicates the history of Gazprom’s activities and economic way of transparency in pricing based on the latest American research. The matrix of research is a presentation of proceedings before the Court of Justice of the European Union and the Arbitrage Tribunal in Stockholm. In the last part of paper, there is clarification of the doctrineof direct effect and the procedure of an action for damages.The Gas Directive provisions are subject to the direct effectprinciple and in vertical relation, the individuals may bring an action for damages. In fine, the appearance of dominant and unfair practices means that individual proceedings against a country will constitute a majority in the future in the scope of energy law in the European Union. In this dogmatic study, the tools were criticisms, heuristics, hermeneutics and experiments.

Artykuł opisuje wpływ nowelizacji ustawy Prawo energetyczne na sprawozdawczość finansową spółek prowadzących działalność energetyczną. Nowelizacja wymaga od spółek dodatkowych ujawnień w sprawozdaniu finansowym – konieczne jest wyszczególnienie aktywów i pasywów oraz przychodów i kosztów dotyczących bezpośrednio poszczególnych typów działalności. Dodatkowo zweryfikowano ujawnienia zamieszczone w sprawozdaniach finansowych największych polskich producentów energii: Tauron Polska Energia S.A., Polskiej Grupy Energetycznej S.A. (PGE S.A), ENEA S.A. i Energa S.A. oraz pozostałych polskich spółek notowanych na Giełdzie Papierów Wartościowych w Warszawie. Badanie przeprowadzono w celu sprawdzenia, w jaki sposób poszczególne spółki i ich audytorzy poradzili sobie z przygotowaniem i zbadaniem ujawnień wymaganych przez nowelizację. Jednocześnie przedstawiono możliwości zaprezentowania wymaganych ujawnień i procedury związane z przygotowaniem osobnego bilansu i rachunku wyników.
The article describes the impact of the amendment to the Energy Law on the financial reporting of companies operating in energy’s sector. The amendment requires additional disclosures in the financial statement- it is necessary to present the assets, liabilities, revenues and expenses related directly to specific types of activities (specified in Energy Law). In addition information included in the financial statements of the biggest polish producers of energy: Tauron Polish Energy SA, the Polish Energy Group SA (PGE), ENEA SA. and in addition other Polish companies listed on Warsaw Stock Exchange, have been verified, to check how particular companies and their auditors have managed to implement those requirements. In the article possibilities of presentation the required disclosures have been presented together with potential ways of preparing a separate balance sheet and income statement.
