    This issue of “Contributions to Humanities” presents various aspects of transitions to retirement in Europe, particularly in post-communist countries. The process of retirementis analysed from various points of view; to name afew: the political perspective and the challengesfaced by current public pension systems in ageing societies, the macro perspectivewhich analyses the structural reasons for (early) retirement, and the micro perspective ofindividuals and their ways of experiencing and dealing with exit from the labour market.Therefore, for this issue we sought out an array of papers that extensively discuss the problemof retirement, and inevitably the problem of aging, in Eastern and Central Europe. Obviously,this publication examines only afraction of this broad problem and is by no means exhaustive,thus we hope that it will serve to stimulatethe further discussion.

    Opis:
    Early retirement scheme (Landabgaberente) has a long tradition in German law and was in operation in Germany until 2006. Its original construction is worth deeper analysis, which could be significant for the doctrine of law. The German law provides for a range of obligatory conditions, which must be fulfilled in order for a farmer to be granted an early retirement. The most interesting provisions which characterise the instrument in German law are the short period of time foreseen for application of the instrument, the variety of legal forms of land transfer, the special regulation for disabled farmers, the obligatory transfer for the purpose of improvement of agricultural structures as well as accessibility of the land for promising and well–operating agricultural holdings. Farmers fulfilling the necessary conditions have a claim for the scheme, and thus granting of financial assistance can not be limited by the State financial means currently at the disposal. The effectiveness of the early retirement scheme in Germany was reinforced by supplementary instruments such as the production–giving–up–pension (Produktionsaufgaberente) and the compensation aid (Ausgleichgeld).

    Early retirements from farming is one of the instrument of agricultural structure improvement and generation change acceleration introduced to the EU legislation by the Council Regulation (EEC) No 2079/92 and 1257/99, transferred to the Polish law. In the article the EU and the Polish binding legal solutions in the field of early retirements from farming were analyzed. The Author pointed out advantages and disadvantages as well as provided an assessment of impact possibilities that early retirements can have on agricultural area structure improvement and on generation exchange acceleration due to 2004 regulation. It was pointed out that early retirements introduced by this regulation played rather social role as they influenced on the generation exchange acceleration but they did not have any relevant effect on the farm structure improvement.

    This article is devoted to the question of retaining people that reached retirement age on labour market, what is essential for European economies in the light of ongoing demographic changes. Then, the author examines why the rate of the older population aged 50–64 that are working in Poland is one of the lowest among OECD countries. In the last section the author focuses on various measures directed at enabling senior citizens to continue working, including government programs.

    Objectives Current demographic trends, such as society aging, the spreading of chronic diseases, as well as early retirement choices, lead to the dwindling labor market population. Taking into consideration the foregoing tendencies and their consequences, the issue of the shrinking labor force resources seems to be the most important challenge for the labor market. In response to it, this paper identifies individual and institutional causes of withdrawal from the labor market, and explores the views of Polish stakeholders on existing strategies for the occupational re-integration of persons with chronic diseases (PwCDs). Material and Methods Polish results of 2 European projects: “Participation to Healthy Workplaces and Inclusive Strategies in the Work Sector” (the PATHWAYS project) and “The Collaborative Research on Aging in Europe” (COURAGE in Europe) complemented each other. The cross-sectional population data and data from stakeholders’ interviews were used. Results The authors identified several causes which could encourage people to withdraw from the labor market before attaining the official retirement age at 3 different levels: individual, occupational, and institutional. Although research has shown that the macro-level situation is crucial to staying occupationally active, in Poland stakeholders have reported the lack of effective coordination in the implementation of policies for the occupational re-integration of PwCDs. Conclusions A decision to cease work prematurely reflects a combination of many different factors, such as individual determinates, work characteristics, personal convictions, and systemic solutions. The study demonstrated that, despite the awareness of the dwindling resources of labor force, the employment-related challenges faced by PwCDs as well as people who are close to the retirement age remain unaddressed.     Wcześniejsze emerytury były przyznawane w specjalnych trybach przed osiągnięciem powszechnego wieku emerytalnego, skutkowało to obniżeniem wysokości przyszłego świadczenia wynikającego z prawa do emerytury powszechnej ze względu na pomniejszanie wysokości dostępnego zgromadzonego kapitału ubezpieczonej. Jednak w przypadku kobiet urodzonych w 1953 r. orzeczenie Trybunału Konstytucyjnego skutkowało – przynajmniej pod względem prawnym – zmianą ich statusu. Analiza wyroków wydawanych przez sądy powszechne w zakresie odwołań wniesionych przez niezadowolone z rozstrzygnięć Zakładu Ubezpieczeń Społecznych ubezpieczone wskazuje, że poszczególne jednostki przedstawiały znaczne rozbieżności w wykładni przepisów. Choć ustawodawca w ramach nowelizacji ustawy o emeryturach i rentach z Funduszu Ubezpieczeń Społecznych wprowadził do porządku prawnego nowe rozwiązanie, to do tego momentu (przez ponad rok) realizacja konstytucyjnych praw kobiet urodzonych w 1953 r. dokonywała się w obrębie orzecznictwa sądów powszechnych. Artykuł przedstawia, w jakim zakresie orzecznictwo jest rozbieżne, oraz wskazuje na główne argumenty przemawiające za uwzględnieniem poszczególnych linii orzeczniczych, w tym także na główne tezy przedstawione w wyroku Trybunału Konstytucyjnego, co może być wskazówką dla orzeczników.
    Early retirement pensions given to women born in 1953 under special procedures payable before reaching the universal retirement age and here upon the fulfillment of certain conditions, have resulted in a reduction of any future benefits with regard to the retirement pension as such, and here due to the reduction in the insurance capital accumulated. However, the ruling of the Polish Constitutional Tribunal has resulted in – at least in legal terms – a change in their benefit status. Analysis of court rulings shows numerous discrepancies between the said. Although the legislature has passed a new act to implement the Constitutional Tribunal judgment, hitherto (and here for over a year) courts were obligated to allow women born in 1953 to fulfill their constitutional rights yet within the jurisdiction of such courts. The article shows the extent to which courts iverge and presents the main arguments for the specific rulings themselves, indicating – at the same time – the main thesis advanced in the Constitutional Tribunal judgment, which may serve as a pointer for the judiciary.

    Przedmiotem rozważań zaprezentowanych w artykule są sformułowane dotychczas propozycje emerytur stażowych. Autor ocenia przyjęte w nich rozwiązania dotyczące rodzaju proponowanych świadczeń oraz przesłanek nabycia z perspektywy spójności z systemem emerytalnym. Pierwsza część artykułu, opublikowana w poprzednim numerze, była poświęcona problematyce nabywania nowego uprawnienia. W części drugiej natomiast autor analizuje wpływ wcześniejszego skorzystania ze świadczenia na jego wysokość, a także ustala moment, w którym korzyści z odłożenia w czasie emerytury przewyższą korzyści finansowe z tytułu przejścia na emeryturę stażową. Te ustalenia porównuje z prognozą dalszego trwania życia. Następnie omawia wpływ czynników niwelujących skutki wcześniejszego ustalenia emerytury w formule zdefiniowanej składki, tj. emerytury minimalnej, oraz możliwości wielokrotnego przechodzenia na emeryturę. Ostatni wątek dotyczy łączenia emerytury stażowej z pracą. W podsumowaniu autor proponuje odejście od koncepcji emerytury stażowej jako niespójnej z polskim systemem emerytalnym w jego obecnym kształcie. Zdaniem autora dla osób wyeksploatowanych wieloletnią pracą lepszym rozwiązaniem będzie scharakteryzowane również w podsumowaniu stażowe świadczenie przedemerytalne.
    The first article presents the current draft bills on seniority pensions and assesses their solutions in terms of the types of proposed benefits and the acquisition premises in terms of consistency with the pension system. In this article, the impact of the earlier use of the benefit on its value will be analysed. Following that, the point in time when the benefits of postponing retirement will outweigh the financial benefits of the seniority pension will be determined and applied to the future life forecast. At a later stage, the impact of factors removing the effects of early retirement pension determination in the defined contribution formula, i.e. the minimum retirement pension and the possibility of multiple retirement, will be explored. The final thread will discuss the solutions proposed thus far for combining the seniority pension and work. Following the summary, an alternative to the seniority pension will be presented, with the goal of protecting people who have been exhausted by years of work. The reasoning will be carried out using a dogmatic analysis of law as well as an economic analysis of law.

    This article contributes to the literature on early retirement transitions by testing a line of explanations of this phenomenon in a specific context of public sector employment. It utilizes waves 2006 and 2007 of a longitudinal data set of employment histories of Polish teachers (SIO). Standard structural explanations of early retirement transitions, i.e. labor force restructuring and devaluation of human capital of older workers do not find support in the data. Multilevel logistic regression models show instead that the considerable variance in early retirement risks found in the data can to some degree be explained by labour mobility of prime aged teachers, supporting the thesis of a labor market as generational figuration. The analyses identify two early emploment groups among Polish teachers: 49–54, and 55–59 year olds. Whereas retirement transitions in the younger group are to a greater extent attributable to individual pull factors (like work commitment), regional variation plays a greater role in the older “early retirees” group indicating higher risks of involuntary early retirement in this group.

    W artykule przedstawiono zasady przechodzenia na wcześniejszą emeryturę ze względu na warunki pracy w wybranych państwach UE i na tym tle rozwiązania przyjęte w prawie polskim. Z dokonanej analizy wynika, że nie tylko różne są zasady przechodzenia na wcześniejszą emeryturę ze względu na warunki pracy, ale też występują zasadnicze różnice w poszczególnych państwach dotyczące prac uzasadniających ubieganie się o wcześniejszą emeryturę jak i wiek, w jakim można z niej skorzystać.
    The paper presents the rules guiding early retirement due to working conditions m selected EU Member States and how they compare to the solutions applied in Poland. The review shows differences not only in the rules of early retirement due to working conditions but also considerably different approaches adopted by countries with respect to jobs that entitle workers to apply for early retirement and the eligible age.

    This study was to determine the main health-related reasons, age and occupation of those who took early retirement due to total work inability. This was done through an analysis of the data from Poland’s Social Insurance Institution (ZUS) from 2000 and 2001. An analysis of these data showed an increase in the number of certificates confirming total inability to work in people over 40 years old. Over 50% of certificates work were issued to workers in 2 age-groups: 45–49 and 50–54. Diseases of the circulatory system, musculoskeletal system and connective tissue as well as mental and behavioural disorders are the main causes of early inability to work. Approximately 70% of people who obtained certificates confirming total inability to work had blue- and blue-and-white-collar jobs.

    Sytuacja wnioskodawcy ubiegającego się o emeryturę z tytułu pracy w szczególnych warunkach, nieposiadającego wymaganego prawem świadectwa pracy potwierdzającego taką okoliczność, rodzi liczne wątpliwości interpretacyjne każdej ze stron postępowania. Określenie czy dana praca jest lub nie jest pracą w szczególnych warunkach, w oparciu o pośrednie dowody, to bardzo częste wyzwanie, jakie stoi obecnie przed sądami pracy i ubezpieczeń społecznych. W opracowaniu scharakteryzowano przesłanki, których łączne zaistnienie pozwala na przyjęcie, że daną pracę można uznać za wykonywaną w szczególnych warunkach. W oparciu o akty prawne, dotychczasowe stanowisko doktryny i judykatury, z uwzględnieniem specyfiki norm prawa ubezpieczeń społecznych, wskazano determinanty charakterystyczne dla pracy w szczególnych warunkach, których ustalenie ma kluczowe znaczenie dla nabycia przez wnioskodawcę prawa do emerytury z tego tytułu.
    The situation of the applicant applying for a retirement pension for work in a special conditions while not possessing the required work certificate confirming such a circumstance raises numerous interpretative doubts for each party to the proceedings. Determining whether a job is or is not a job in special conditions based on indirect evidence is a very common challenge which the Labor and Social Security Courts currently have to face. In this study I have characterized the premises whose combined existence allow for the assumption that a given work can be considered as performed in special conditions. On the basis of legal acts, the current position of doctrine and judicature, as well as taking into account the specificity of social insurance law norms, I indicate determinants characteristic for work in special conditions, the determination of which is crucial for the applicant’s acquisition of the right to retirement.

    Opis:
    The aim of the paper is to determine to what extent fluctuations in the level of unemployment in Poland in the last two decades have depended on changes in labor demand and labor supply. To this end, the contribution of labor demand and labor supply to changes in the unemployment rate is examined and then trends in labor demand and labor supply and their key determinants are analyzed. The study finds that changes in labor demand were the main determinant of unemployment fluctuations. A decrease in labor demand contributed to strong unemployment growth at the beginning of the 1990s and at the turn of the century, when the economic slowdown was associated with transformation and pre-accession restructuring respectively. An increase in labor demand caused by economic recovery after EU accession was behind the subsequent fall in unemployment. For most of the time span of the analysis, labor supply was a factor alleviating negative developments on the labor market due to the possibility of early retirement, easy access to disability pensions and labor force migration. Growing labor supply contributed to a rise in unemployment only at the end of the last decade. The fact that labor demand had a stronger impact on the level of unemployment than labor supply indicates that labor market policy should focus on job creation, not on “manipulation” of labor supply, the author concludes.
    Celem artykułu jest odpowiedź na pytanie: w jakim stopniu obserwowane w ciągu ostatnich dwóch dekad fluktuacje w wysokości polskiego bezrobocia były wywołane wahaniami popytu na pracę, a w jakim podaży pracy. W celu uzyskania odpowiedzi zdekomponowano zmiany w stopie bezrobocia na wywołane popytem na pracę i podażą pracy a następnie przeanalizowano zmiany w popycie na pracę i podaż pracy oraz determinanty tych zmian. Z badań wynika, że główną przyczyną wahań w polskim bezrobociu były zmiany w popycie na pracę. Jego spadek wywołał silny wzrost bezrobocia na początku lat 90. XX wieku oraz na przełomie wieków, kiedy to spowolnienie gospodarcze zbiegło się z transformacyjnymi i przedakcesyjnymi przeobrażeniami strukturalnymi. Natomiast po wejściu do UE wzrost popytu na pracę, wywołany przyspieszeniem gospodarczym, doprowadził do spadku bezrobocia. Podaż pracy przez większość analizowanego okresu była czynnikiem łagodzącym sytuację na rynku pracy dzięki możliwości wcześniejszej dezaktywizacji zawodowej oraz migracjom zarobkowym. Większa podaż pracy doprowadziła do wzrostu bezrobocia dopiero pod koniec ostatniej dekady. Silniejszy wpływ popytu na pracę niż podaży pracy na bezrobocie wskazuje, że polityka ograniczania bezrobocia winna się skupiać na kreowaniu miejsc pracy a nie na „manipulowaniu” podażą pracy.

    Opis:
    Celem artykułu jest próba kompleksowego przedstawienia instrumentów prawnych służących zmianie generacyjnej właścicieli indywidualnych gospodarstw rolnych w Polsce w ramach Programu Rozwoju Obszarów Wiejskich 2007–2013. Uwzględnione zostały dwa działania w ramach osi „Poprawa konkurencyjności sektora rolnego i leśnego”, tj „Ułatwianie startu młodym rolnikom” oraz „Renty strukturalne”. W publikacji poddano analizie w szczególności definicje ustawowe beneficjentów, ukazano prawne aspekty ubiegania się o wsparcie w ramach niniejszych działań, w tym kryteria dostępu, formę i wysokość pomocy. Zaprezentowano kierunek i wpływ orzecznictwa unijnego i krajowego na wykładnię przepisów prawnych regulujących przedmiotowe działania.
    The aim of this article is to attempt to provide a comprehensive analysis of the legal instruments which lead to the generative change of individual farm owners in Poland under the Rural Development Programme 2007–2013. With regards to “improving the competitiveness of the agricultural and forestry sector”, two actions will be looked at, mainly, “setting up of young farmers” and “early retirement of farmers and farm workers”. The publication scrutinizes briefly the legal definitions of beneficiaries and aspects of joining the aforementioned programes, including, entry criteria and the type and value of a subsidy. The influence of EU and national jurisdiction on the legal norms regulating these activities is described.
