    Opis:
    Ukraine has become a candidate country for the European Union membership, which brings challenges, including those of a legal nature. One of such challenges is the regulation of the institution of mediation, which is a subject of interest to European institutions (both within the Council of Europe and the European Union) that actively promote methods of alternative dispute resolution (ADR methods). The aim of the article is to compare the current development of mediation in Poland and Ukraine, as well as to determine to what extent there are similarities in successes and challenges and to what extent the Polish experience could be helpful for the development of mediation in Ukraine. The essence of the problem is whether Ukraine shall follow Polish solutions in this area.
    Ukraina ma obecnie status państwa kandydującego do uzyskania członkostwa w Unii Europejskiej, co niesie za sobą wyzwania, w tym natury prawnej. Jednym z takich wyzwań jest uregulowanie instytucji mediacji, będącej przedmiotem zainteresowania instytucji europejskich (zarówno w ramach Rady Europy, jak i Unii Europejskiej) aktywnie promujących alternatywne metody rozwiązywania sporów (ADR). Celem artykułu jest porównanie obecnego rozwoju mediacji w Polsce i Ukrainie, a także określenie skali podobieństw w zakresie sukcesów i wyzwań oraz udzielenie odpowiedzi na pytanie, na ile doświadczenia polskie mogą być pomocne dla rozwoju mediacji w Ukrainie. Istotą problemu jest to, czy Ukraina będzie podążać za polskimi rozwiązaniami w tym zakresie.

    The text starts with an outline of symbolic context defining the cognitive specificity of the philosophical approach. Next comes an introduction of the four positions model for authority location: between difficulty and impossibility. Then it is emphasized the necessity to perceive parents situation within process perspective requesting their adaptive changes as the development of competences. It leads towards underlining of child’s resistance and the challenges linked with parents’ responsibilities. This is a background for the perspective of striving towards a specific pedagogical mediation.
    Tekst na wstępie zarysowuje konteksty symboliczne określające podejście filozoficzne i jego specyfikę poznawczą. Następnie przedstawiony jest model autorytetu w czterech pozycjach: między trudnością i niemożliwością. Z kolei akcentuje się konieczność ujmowania sytuacji rodziców w perspektywie procesu wymuszającego ich zmiany adaptacyjne jako rozwój kompetencji. Prowadzi to do uwypuklenia zjawiska oporu dziecka oraz związanych z tym wyzwań w zakresie odpowiedzialności rodzicielskiej. Na tym tle zarysowana jest perspektywa dążenia do specyficznej mediacji pedagogicznej.

    In order to determine the initial level of formation of professional and legal competence of the future social workers were used methods adapted by the author “Motivation of professional activity” by Zamfyr (Рамендик, 2013, p. 123) (in modification of Rean), which gave us the opportunity to diagnose the students‟ motivation for professional activity. It is based on the concept of internal and external motivation. We can talk about the internal type of motivation if the activity in itself is significant for the individual. And if in the basis of professional activity motivation lies the aspiration to satisfy other needs (in particular, reasons of social prestige, salary, etc.), in this case we can talk about the external motivation. External motives differentiated on external positive and external negative.

    Koncepcje z obszaru psychologii rozwojowej, takie jak strefa najbliższego rozwoju L. S. Wygotskiego czy epizody wspólnego zaangażowania H. R. Schaffera wniosły nową perspektywę do rozumienia procesu nauczania i rozwoju, charakteryzując wnikliwie sytuację nabywania kompetencji w relacji społecznej. Wymienione koncepcje opierają się na wierze w potencjał rozwojowy człowieka, a nauczanie widzą jako zorientowane na przyszłość. Założenia te charakterystyczne są również dla coachingu i mentoringu, będących coraz popularniejszymi formami rozwoju w miejscu pracy. Stąd próba znalezienia analogii. Wykonane porównanie przyczynia się do poszerzenia teoretycznych podstaw „rozwojowych relacji współpracy”, jak określa się wspólnie coaching i mentoring.
    Some developmental psychological concepts, such as L. S. Vygotsky’s zone of proximal development or H. R. Schaffer’s joint involvement episodes, gave a new perspective in perceiving the process of teaching and development, by providing very detailed characteristics of the situation of acquiring competence in social relations. The mentioned concepts are based on a belief in the developmental potential of humans, and they perceive teaching as future-oriented. These assumptions are also characteristic for coaching and mentoring which are nowadays becoming more and more popular forms of development in work places; hence an attempt to find some analogy between them. The prepared comparison contributes to extending the theoretical bases of “development cooperation relations,” as coaching and mentoring are jointly referred to.

    The original concept, theory-method of Lev S. Vygotsky, the innovative nature of his views allows to adopt new theoretical and methodological tools to describe the process of development and learning of a child, reconstruct what is happening in the classroom and in the students’ minds. For many years the interest in Vygotsky’s concept has been experiencing a renaissance all over the world, also in Poland. The cognitively sophisticated concept has original terminology. Unfortunately, in the discourses, frequent borrowings and loose usage of terms have been observed, as well as the reproduction of Vygotsky’s words without discovering the meaning or giving them a deeper meaning. As a consequence, this brings the risk of distortion of the idea and the apparent change of school culture, its opening to a new quality (socio-cultural constructivism). In this article I share my reflection on: research and Research and Development (R&D) activities based on the theory-method of L.S. Vygotsky, applying his ideas to pedagogical research, and educational implications for changing everyday teaching practice.
