The provisions subject to the assessment of the Constitutional Tribunal concern the extent to which the rightholder, whose copyrights have been infringed, may require the person who infringed those rights to repair the damage by payment of a sum of money in the amount equivalent to two times of an appropriate salary, which would be due because of the authorized person’s consent to use the work. In its question of law, the Supreme Court questioned the claimed a nonconformity to the Constitution of provisions of the Act to the extent that it “imposes an obligation to pay twice the appropriate remuneration to the entity entitled under the economic copyright”. In the draft position of the Sejm it has been claimed, that the provision mentioned above conforms to the Constitution.

‘Legitimacy’, ‘reputation’ or ‘institutional trust’ inspired by judicial institutions constitutes an important aspect of the rule of law. Consequently, scholars developed survey-based methods to quantify ‘legitimacy’ as understood in the Weberian sense. Thereby, the survey response quality can meaningfully impact the obtained results. Moreover, one can expect, that sharpening political polarization observed in various countries could amplify such measurement problems. The goal of this paper is to examine the assessments of the Polish Constitutional Tribunal (CT) using two distinct surveys carried out in March 2022 by CBOS (Public Opinion Research Center). Both asked about the overall assessment of the CT performance, as well as electoral preferences (voting intent and preferred political party), frequency of religious practices, self-assessment of economic conditions and included a battery of standard demographic controls. Both overall assessment levels as well as individual-level determinants of the CT assessment (using probit models) had been compared. The findings document that, regardless of the survey data collection mode, controlled for demographic factors, the assessment of CT depends upon variables representing political polarization. This finding can be interpreted as an indication of its political de-legitimization. Moreover, five years after the constitutional crisis, and nearly one and a half years since the abortion verdict, over 40 per cent of respondents of the Allerhand Institute Survey admitted they ‘don’t know precisely’ the task of the CT or even ‘haven’t heard’ about it, indicating a substantial lack of knowledge. The second group of findings documents differences between CAPI and CAWI polls. According to the authors’ knowledge, it is the first attempt to examine respondent-level determinants of CT assessment, and test their sensitivity to the survey data collection mode, thereby contributing to our understanding of the Polish CT legitimacy five years after the constitutional crisis, and methodological aspects of such measurements in general.

A court expert shall be the expert. If he is not, then he might prepare an incorrect opinion. It happens in at least in three situations. The first – a court expert is an expert, he has a special knowledge, but the does not use appropriate research methods, according to the current state of science or art. The second – a court expert is an expert, believes that he possesses a special knowledge, but actually he cannot demonstrate profesional knowledge and experience with the specified field. The third – a court expert is not an expert, he does not possess a special knowledge and he does not know appriopriate research methods. The expert has the freedom to choose research methods used in the opinion, and the court is considering comprehensive all evidence material on the basis of the principle of freedom to assess the evidence. So far, the ignorance of an expert shall not be disclosed by the parties or the Court before closing the hearing, the result may be a judgement based on flawed legal basis.

Under the provisions of Act I of 2017 on the Code of Administrative Court Procedure, a brand new institution has been introduced in Hungary: as of 1 January 2018, in administrative court proceedings, the judge may, with the agreement of the parties, allow for a court mediation procedure in the cases in which the law does not preclude it. The primary method to approach the topic is the review of the relevant primary legal sources [actual law in the form of the constitution (Fundamental Law of Hungary), acts, governmental decrees, orders of the President of the National Office, court cases, etc.] and secondary legal sources (Hungarian and international scientific literature explaining the primary sources, the legal practice and also the specific circumstances determining the broader social environment) through which we may define relevant scientific problems, create our own definitions and prepare a catalogue of practical problems, specifically for Hungarian issues regarding the topic. Moreover, this article tries to build on the results of the interviews with judges, representatives of different defendants (administrative authorities) and others. Qualitative interviewing, including the interviewing of judges and other participants of such proceedings, is a relatively new method in the field of legal studies, at least in Hungary.

The main topic discussed in the article is the question of the dignity of the post of judge of the common courts of law. The authoress, on the basis of the law and the jurisdiction of the disciplinary court, in that regard, sought to determine the scope of the concept of “dignity of the post of judge”. She tried to answer the question, what specific requirements should meet the judge, and how he should behave, or how he should not behave, to make his duties in dignified way? The answer was constructed by identifying the normative responsibilities, basing on the Constitution of Poland, content of the oath of judges, articles 82. and 82., points “a” and “b” of the act of the Law of the Common Court and “The Rules of Professional Ethics of Judges”. Then, under the jurisdiction of the disciplinary court of the Supreme Court was compiled the list of behaviors which affront to the dignity the post of judge.

This paper presents information from a nationally representative Polish survey in 2014 on the types of dispute resolution preferred by the respondents. It places the findings in the conceptual background of studies conducted since the mid-1970s in Polish sociology of law on the subject of disputes and the use of the courts. The purpose of the analysis was to identify the more general types of dispute settlement preferred in the popular legal culture in Poland, and the socio-demographic variables that correlate significantly with these preferences. The significance of social position, as measured by a version of the Center-Periphery index, has also been confirmed.

The article tackles the problem of social courts and social conciliation commissions and jury existing in Poland and in other socialist countries, being the realization of a Marxist-Leninist theory of the state. These institutions provide accomplishment of constitutional rule of increasing the engagement of working classes in the governance of the state (with the broadest meaning of the “governance”, including justice administration). It is highlighted that the engagement of the citizens in the jurisdiction is an important feature of newly created society. As the participation of jury is an element of civil factor in the professional jurisprudence, the social courts are somewhere in the middle, between mediation and justice administration, and are purely social element with no professional background. As such the social courts may be seen as the realisation of communist idea of social self-governance.Short part of the article is devoted to the previous attempt of introduction of social courts and the reasons of its failure. Idea introduced by the Decree of the 2nd February 1946 on the law of citizen’s courts. It’s civil character was to be granted by the fact, that the non-professional citizen’s judges were to be elected by municipal national council. Unfortunately, the complexity and the formality of their functioning caused lack of interest in their foundation and finally their liquidation.Further part of the article analyses briefly the Law of the 30th March about social courts. They were created as a response to a social initiative in workplaces (social courts) or cities, communities and villages (social conciliation committees). The adopted regulation was modelled on the workers’ court in Wrocław and the conciliation commission functioning in Łódź. Their main function was to educate and prevent, and their effectivity was based on the moral authority and personal experience of their members. They were devoid of repressive function, and could apply only educative measures as: obligation to repair the damage, apology the victim, caution, reprimand or payment for a social aim (but very limited). The execution of the decision of the social court was voluntary. The model regulation of their functioning is proclaimed by the Front of National Unity’s National Committee and the Central Council of Trades Unions.In the next part of the article we can find a brief overview of the main sort of cases before the aforementioned institutions and the analysis of statistics of disputes gathered by the social conciliation committee in the countryside and in the cities. We can also find here the statistics concluding the functioning of the both institutions, their popularity and effectiveness.Author concludes that very important is lack of formal procedures what helps to resolve different kind of cases without reference to certain legal act. It also help to educate new society, free from the class conflict and introduce the mediation as the best way to resolve interpersonal conflicts.

Court packing greatly threatens democracy. This paper examines, compares and draws conclusions from two attempts: The PiS government is near to packing Polish courts; President Roosevelt tried but failed to pack the U.S. Supreme Court in 1937. In most democracies a head of government with a legislative majority and strong party control can pack courts, giving complete control. The United States escaped; Roosevelt lacked complete party control. Poland is unlucky; PiS is strongly controlled. Peaceful domestic protest is necessary, but Poland’s hope is from EU-level institutional pressure, supported by major democracies, to reverse packing and prevent further seizure of power.

The author asserts that the organization of judicial system in each country is a result of a long evolution triggered by political, economic, social and cultural developments. The Polish Supreme Court was created in 1917, but its current shape is an outcome of changes initiated in 1990s, most notably the entrance into force of the new Polish Constitution in 1997. The author analyses the notion of judicial power by juxtaposing a functional approach and a structural approach. Next, he remarks that the most important function of the Polish Supreme Court is to ensure the uniformity of jurisprudence by examining cassation complaints. Among other functions of the Supreme Court, the author enumerated examination of electoral protests, declaring the validity of elections of executive and legislative authorities, stating the validity of national referendums. The author emphasized that some specific duties of the Supreme Court are stipulated not only in the Constitution, but also in other legal acts. By presenting a wide range of attributes bestowed upon the Supreme Court, the author also invoked the duty of examining complaints against the excessive length of the proceedings, complaints for declaring a final judgment contrary to law, the appellate measures in disciplinary cases involving judges, prosecutors and legal advisors as well as appellate measures against the decisions of the National Judiciary Council. In addition to it, the author hinted at the Supreme Court’s obligation to control acts adopted by the authorities of self-governing bodies of attorneys, notaries, legal advisors and bailiffs. The author comes to the conclusion that the Supreme Court in Poland cannot be described as a typical cassation court. Although its principle role is to examine cassation complaints with a view to ensure uniformity of jurisprudence and its conformity with law, it also fulfils many other functions that are of great significance for the legal order in Poland.

In connect judgement, the Supreme Administrative Court granted right, a taxable person who has been refused the right of assistance thus also possibility of defending their position on the complaints about the decision of the tax authority concerning the multimillion tax liability. The Court of second instance states that the Provincial Administrative Court in assessing the reasons justifing the application of the law should help carry out simulations of the effects of incurring expenses related to legal entry to the assets of the taxable person and the people with him in the household. In addition, the Supreme Court stresses that in determining the value of the assets of the taxpayer must be taken into account only the assets – without excercising a taxable person claims and obligations. According to the author the vote decision is an example of a rational approach to the issue of the right of assistance in the case of taxable persons whose entire property subject to execution. It is essential that the courts processed the applications for the grant of the right in the help i.a. in the context of the possibility of payment of legal entry and real estate has the taxpayer. In the case entry of the Court is 100 000 PLN (maximum) and every taxable person whose tax liability would amount to tens of millions of zloty wouldn’t be able to pay such costs. This may not however prevent the implementation of the right to go to court against such taxpayer.
