Opis:

DP vessels have a possibility to maintain their position or heading by using thrusters and propellers but the heave compensation is not possible that way. Heave compensation is a technique used to reduce the influence of waves on a hull or only a part of an equipment inside the hull. There are two types of heave compensation: passive (PHC) and active (AHC). Due to limit, the energy demand the hybrid heave compensation (HHC) is often in use. The offshore activities needed the compensation to some extend (level) could be drilling, handling loads in cranes or pipe laying. Different types of Heave Compensator Systems (HCS) are used to compensate for these movements. Safety of these offshore activities is so important that the area of power (using external energy) and non-power (using only the energy of wave movement) drives are quickly developed. The heave compensators allow increasing the weather window and better making use of the offshore vessels. The expected level of decreasing the vessel heave in compare to work equipment is from 5 to 50 times. Active compensation by hydraulic motor needs its active run for motion compensation and the system ought to be equipped with accelerometer senses of ship movement. Computing algorithms and the choice of control method are principal in HCS performance. In the article, it was shown examples of different types of compensators with their advantages and disadvantages and their utilization.

In Poland, patients’ rights are protected by the instruments included in the Act on Patient Rights and the Patient Ombudsman. This law provides for a procedure for dealing with medical negligence claims, which are referred to as medical event. Other types of proceedings related to a claim arising from a medical error include civil proceedings, proceedings relating to the professional liability of a person performing a medical profession and criminal proceedings in a criminal case. As a rule, it can be concluded that the initiation of one of the proceedings excludes the possibility of using another form of applying for a claim.

The issue of pursuance of claims connected with damage inflicted by defective administrative decision was regulated by section 160 of the Administrative Procedure Code (APC) until 1 September 2004. The section was the basis for pursuance of claim in connection with ascertaining invalidity of administrative decision or a decision issued with breach of the law. However, since 1 September 2004, i.e. after the amendment of the Civil Procedure Code(CPC) came into force, the basis for liability for damage caused by final administrative decision issued before 1 September 2004 – even if its invalidity or issuing with breach of law were established after that date – constitutes section 160 of the APC - but only in the aspect of determining the wrongful act or premisses of responsibility (clauses 1–3) and also prescription of claim (clause 6). It is not applicable to the procedure (mode) of pursuance of claim (clause 4&5). In the present law, regardless of the date of issue of decision, the appropriate and only way of pursuance of claim is a lawsuit in court. This means that the administrative mode has been excluded, regardless of the basis of responsibility arising from section 160 of the APC or section 417(clause 2) of the CPC. The range of responsibility for defective decision issued before 1 Sept 2004 has also been differentiated, since the party claiming damage can demand compensation for sustained losses and lost benefits on the basis of section 160 of the APC – if the damage was caused between 17 Oct 1997 and 31 Aug 2004. If the damage was caused before 17 Oct 1997, the party can only demand compensation for sustained losses.

The article is conceptual and harmonizing in character. It is a voice in the discussion about the axiological foundations of the creation of compensation systems. It is based on the idea that justice is one of the most important characteristics of compensation, one which determines whether that compensation is positively assessed. Compensation that is seen to be fair is an indicator that an employer treats the worker honestly and considers him a partner which, in turn, acts as a strong motivational factor. The article contains the results of analyses of philosophical concepts of justice presented by Rawls and Nozick and indicates the implications of these theories in the practice of compensation management.
Artykuł ma charakter koncepcyjny i syntetyzujący. Stanowi głos w dyskusji nad aksjologicznymi fundamentami kształtowania systemów wynagrodzeń. Opiera się na założeniu, że jedną z najważniejszych cech wynagrodzenia decydujących o pozytywnej ocenie dokonanej przez pracowników jest sprawiedliwość. Wynagrodzenie oceniane jako sprawiedliwe stanowi wskaźnik uczciwego i partnerskiego traktowania przez pracodawcę i ma silną moc motywującą. Artykuł zawiera wyniki analizy filozoficznych koncepcji sprawiedliwości J. Rawlsa oraz R. Nozicka oraz wskazuje implikacje tych teorii dla praktyki zarządzania wynagrodzeniami.

This paper presents the fundamental properties and dependences describing the UPQC (Unified Power Quality Conditioner) arrangements. The UPQC devices simultaneously permit to fulfill the following functions: voltage and current harmonics compensation, network voltage and load current symmetrization as well as network voltage stabilization and power flow control. The selected results of the experimental investigations conducted on the small power laboratory model have been described. Applied method for DC link capacity selection was talked over in details and confirmed with experimental results. Results of experimental investigations, including operation of the UPQC arrangement in case of thyristor rectifier load were also introduced.

The new Penal Code chapter Va collects forfeiture and compensation measures: an obligation to remedy damages and exemplary damages. These measures were deprived of formal qualification for punitive measures. Underlining the compensatory nature of the obligation to repair the damage, and at the same time depriving it of certain elements in the field of retributive and protective functions, allows to make criminal law more comprehensive response. Maintaining an artificial and rigid separation between criminal law and civil law does not seem justified. However, the separation causes also some doubts. Particularly, doubts may be raised by insufficiently precise regulation of obligation to pay remedy damages and exemplary damages. It does not seem at all clear whether the rules on civil liability could be fully applicable when deciding the duty of art. 46 of Penal Code. The following issues should be decided: the ability to adjudicate interest when remedy and exemplary damages are ruled, the ability of insurance company to apply for remedy damages in criminal trial. Extending the scope of the impact of substantive civil law to criminal law should be followed by the consideration of the need for changes in the criminal procedure, by better adapting it to rule in matters essentially belonging to the civil law.

Purpose: The paper presents a review of the latest research on executive compensation and indicates the main problems and weaknesses of the existing solutions as well as trends for the future. Methodology: In the analysis executive compensation constitutes a crucial element of corporate �governance. The analysis is based on a review of the latest studies and research on the effectiveness of executive compensation referring to its size, structure and disclosure. Findings: The paper presents the latest fi ndings in the practice of executive compensation and it points to the extension of the period of time giving rise to the payment of cash bonuses, the introduction of a range of different indicators, based on which executives are evaluated, simplifying compensation packages, the implementation of deferred payments, the introduction of the “say on pay” rule and clawbacks. Practical implications: The analysis points out the main weaknesses of executive compensation, which were particularly emphasized in research studies on companies affected by the fi nancial crisis. The paper presents a wide range of suggested solutions that could be implemented in the fi eld of executive compensation in order to provide for a better alignment of the interests of executives with those of shareholders and for the increase in shareholder value. Originality/value: The paper attempts to identify the most severe corporate governance problems with reference to executive compensation and to confront them with research results as well as the recently proposed and implemented reforms and recommendations.

This article takes up a topic rarely covered in Polish political science. During the period 1948–1971 the Polish Government signed 12 bilateral indemnity agreements with Western European states as well as the United States of America and Canada. These agreements applied to property and financial interests of foreign natural and legal persons that, following World War II, were nationalized in Poland. The Polish Government en-tered into these agreements mostly for economic (e.g. strengthening of export incl. hard coal, demand for capital) and political reasons (threat of international isolation). Based on these agreements, the Polish Government transferred to the governments of foreign states lump-sum compensations to settle their claims. Countries which entered into these agree-ments with Poland assumed full responsibility for setting up claiming procedure as well as for the payment of compensation to their citizens. Thanks to indemnification agreements Poland is released from any obligation under international law for the nationalization of property and financial interests that belonged to foreign citizens of these countries.

In the opinion of the author of the Sejm’s position limiting the possibility of obtaining the right to compensation only to the heirs of an owner of a real estate left outside the current borders of the Republic of Poland who possess a Polish citizenship is consistent with the Constitution. The executive compensation issue continues to cause protest due to the increasing number of cases of an unjustifiably high level of pay. The main conflict arises from the misalignment of interests between the short-term expectations of the manager and long-term needs of the shareholders. Since there are no universal rules on how to price the executive performance companies reach for different means of establishing the CEO’s compensation and ascertaining manager’s commitment towards maintaining a company’s value. The issue becomes more complex once the compensation rules are not a direct effect of the market power game but are additionally restricted by government. The aim of the paper is to discuss corporate government policies introduced in Israel and their impact on executive compensation level and structure. Israel is amongst those countries that partially regulate CEO compensation and thus the Israeli experience can add to the understanding of the effectiveness of modern corporate governance.

This commentary refers to the assessment of the situation in which there are grounds conditioning the reduction of compensation due to an underage, who contributed to the injury, and because of his age is not responsible, and is it possible when required by the principles of community life – to apply by analogy Art. 428 of the Civil Code. The author agrees with the Supreme Court, that in the factual situation of the case it can be applied by analogy with the said provision.
Glosa dotyczy problemu oceny, w jakiej sytuacji zachodzą przesłanki warunkujące obniżenie odszkodowania należnego małoletniemu, który przyczynił się do powstania szkody, a ze względu na swój wiek nie ponosi odpowiedzialności, oraz czy można, gdy wymagają tego zasady współżycia społecznego, stosować przez analogię art. 428 k.c. Autorka podziela pogląd SN, że w sytuacji faktycznej przedmiotowej sprawy można stosować przez analogię wspomniany przepis.

Opis:

Punishment with imprisonment and the security measureof detention on remand, are among the most severe sanctions and convictions provided by the albanian criminal legislation. The unjust serving of such measures or punishments implies serious psychological and economic consequences for both the convicted person and his/her family members. Similar to the infringement of any right and freedom, the unjust infringement of the right to liberty, induces the obligation to return the person in the previous state and to provide compensation for related consequences. Besides the right to effective remedy, the international human rights acts provide, specifically, for the right to compensation of the person in cases of an unlawful arrest or detention, as well as in the case of serving an unjust punishment as a result of the miscarriage of justice. In both hereof mentioned cases, these acts acknowledge the right to compensation for unjust imprisonment, while leaving it to the member states to establish a special mechanism under the domestic legislation which would enable actual fulfillment of such right for the citizens of the said country. This paper is an attempt to present an overview of the Albanian legislation regarding the mechanism established toward the effective implementation of the right to compensation, in the case of decisions of the respective state institutions causing the unlawful or unjust imprisonment, from the point of view of respective international obligations.

We have developed a probe of a nuclear magnetic resonance (NMR) magnetometer for measurement of a fluctuation of an AVF cyclotron field. The stability of the magnetic field of the JAERI AVF cyclotron, measured with the NMR probe, was within 1 × 10-5. A field-measurement accuracy of the order of 1 × 10-6 was achieved using a set of field-compensation coils and optimizing the probe position to obtain enough homogeneity of the magnetic field around the probe for measuring the cyclotron field with a high gradient. To eliminate a major bottleneck in the field measurement inside the cyclotron, the probe was specially produced with the cable shielding against RF noises and proper materials applied.

Opis:

In this paper a cross-shaped isolator consisting of cuboidal magnets and a cylindrical isolator are compared by resonance frequency to volume ratio and shape. Both isolators are capable of obtaining a low resonance frequency, i.e. 0.15 Hz and 0.01 Hz for the cross and cylinder, respectively. The volume of both isolators is comparable, only the shape is different, resulting in a tall structure with a small footprint for the cross and a flat with a large diameter cylindrical structure. A sensitivity analysis shows that due to the large amount of magnets, the cross-shaped isolator is less sensitive to manufacturing tolerances.

Article 7 of the Act of 6 July 2001 on the preservation of the national character of the country’s strategic natural resources alone does not determine the rules for determining and paying compensation. The provisions of Article 7 of the Act cannot constitute a binding basis for an investigation in the way of civil damages for loss of property stocks listed in Article 1 of the Act. Despite the use of Article 7 of the Act the term “claim” in current law, to any entitlements to the beneficiaries named in Article 7 of the Act, civil law concept of limitation is not in general use.

In both the Polish and German languages, the term ‘reparations’ is almost exclusively associated with the compensation for wartime losses incurred by a state as a result of unjustified military aggression on the part of another, ultimately defeated state. The term ‘compensation’ has the broadest scope in both languages. Therefore, this term used in the parliamentary resolution of October 2022 concerning reparations from the Federal Republic of Germany seems appropriate, as the material and non-material losses of the Polish state and its citizens in 1939, caused by the Nazi Germany, are evident and easily demonstrable.

In the light of applicable regulations former owners of real estates or their legal successors have the right to demand the return of real estates taken over by the State Treasury pursuant to provisions of the Decree of 27 July 1949 or have the right to claim compensation only if, in the course of supervisory control, the voivode states that the decision of the Presidium of the Poviat National Council, on the basis of which the loss of property occurred, is invalid or considers, that the decision was made illegally. In the current legal situation former owners or their legal successors have no legal instruments to enforce any reprivatisation claims they may have: the return of real estate or compensation.

The opinion presents legal grounds regarding the application of quarantine and liability for damages of the State Treasury. Simultaneously, the conditions required for the State Treasury to be liable for damages in a specific case of quarantine were indicated and discussed. In addition, the opinion highlights the possibility of pursuing claims for infringement of moral rights if the quarantine is unlawfully applied (e.g. by a wrong authority or in the absence of legal grounds for its application to a specific person).

Opis:

This paper presents the compensation tasks performed by a shunt active power filter, including compensation of harmonic currents, reactive power, and an unbalanced load current. The paper demonstrates novel control of the shunt active power filter in a closed-loop system. The control algorithm was verified by performing simulations and compared the simulated results with those obtained in an open-loop control system. All simulations were conducted in the PLECS program using a control algorithm written in C programming language.

Energetyka wiatrowa w Polsce zaczęła się rozwijać na początku lat 90 XX wieku, jednak jej dynamiczny wzrost można zaobserwować w kolejnych latach. Pod koniec 2014 roku łączna moc zainstalowana w farmach wiatrowych w Polsce wynosiła ok. 3 800 MW i nadal rośnie. Budowa oraz instalacja farm wiatrowych o dużych mocach niesie za sobą szereg problemów związanych z kompensacją linii kablowych 110 kV, wyprowadzających moc z farmy wiatrowej o znacznych długościach oraz właściwym doborem urządzeń kompensacyjnych. W artykule opisano zagadnienia związane regulacją mocy biernej w farmach wiatrowych oraz dokonano analizy poszczególnych urządzeń kompensacyjnych wykorzystywanych w energetyce wiatrowej.
Wind energy in Poland began to develop in the early 90s of the twentieth century, but its dynamic growth can be observed in subsequent years. At the end of 2014, the total installed capacity in wind farms in Poland amounted to 3 800 MW and continues to grow. The construction and installation of wind farms with high power brings with it a number of problems related to the compensation of the 110 kV cable lines of considerable length and the right type of compensation equipment. The article describes issues related to regulation of reactive power in wind farms and an analysis of individual compensation equipment used in wind energy.

Opis:

Epilepsy in children leads to disorders in their psychomotor development or the loss of their acquired skills. Successful pharmacological treatment of epilepsy provides grounds for effective therapeutic measures. The goal of this article is to present the dynamics of neurodevelopmental disorders in the course of the severe symptomatic epilepsy with status epileptici which affected a 10-year-old girl. As a result of longitudinal studies, four stages were distinguished which determined the dynamics of development of the disease: 1) up to the age of 10, when the child’s psychomotor development proceeded correctly, 2) between the ages of 10 and 15, when, because of epilepsy, the disorders in the cognitive, linguistic, emotional, behavioural, motor, and vegetative spheres occurred, which assumed the form of profound dementia, 3) between the ages of 16 and 17, when the balance of the bioelectric activity of the brain was achieved owing to the optimisation of pharmacological treatment, 4) between the ages of 17 and 25, when, after the multi-specialist therapy, there was a significant improvement in the functioning of all the disordered spheres, which enabled the patient to finish junior and senior high school, apply to a university, obtain very good results in learning, and to achieve spectacular successes in sport.

Based on these agreements Polish government transferred to the governments of foreign states lump-sum compensations to satisfy the claims of entities referred to above (exceptions: Norway – mutual compensation agreement offsetting claims, France – indemnization in the form of hard coal deliveries). W artykule omówiono teoretyczne podstawy kompensacji mocy biernej według teorii mocy chwilowej p-q. Na bazie tej teorii zbudowano modele symulacyjne i przeprowadzono modelowanie (przy użyciu MATLAB'a) procesu kompensacji mocy dla różnych odbiorników liniowych i nieliniowych, przy obciążeniu symetrycznym i niesymetrycznym, dla różnych wartości obciążeń oraz różnych wymuszeń. Została zaprezentowana metoda regulacji prądu dodawczego, wykorzystująca do tego celu (w sensie realizacji technicznej w obwodzie silnoprądowym) idealny falownik prądowy, w celu uzyskania szybkiej i płynnej kompensacji mocy biernej. Sformułowano wnioski wynikające z uzyskanych wyników badań symulacyjnych.
The article describes theoretical foundations of reactive power compensation according to the momentary power theory p-q. On the basis of this theory simulation models were built and the modelling (with MATLAB) of the reactive power compensation process was carried out for different linear and non-linear receivers, at balanced and unbalanced load, for different load values and different excitation values. The authors presented the boost current regulation method which makes use of an ideal current inverter with a view to obtain quick and fluent reactive power compensation. Finally, conclusions were formulated based on the obtained simulation tests results.

Problematyka odpowiedzialności organizatora imprezy turystycznej z tytułu niewykonania lub niewłaściwego wykonania umowy może przysparzać w praktyce znacznych trudności, do czego przyczynia się w szczególności sam charakter świadczenia, skierowanego głównie w kierunku sfery przeżyć psychicznych konsumenta. W obowiązującym stanie prawnym podstawę odpowiedzialności stanowi art. lla ustawy o usługach turystycznych. Odpowiedzialność ta obejmuje zarówno wyrównanie szkody majątkowej, jak i szkody niemajątkowej w postaci tak zwanego zmarnowanego urlopu polegającej na utracie oczekiwanej przyjemności podróży i towarzyszącej temu frustracji. Naprawienie szkody niemajątkowej następuje poprzez zapłatę stosownej kwoty pieniężnej.
The problem of the tour operator’s liability for non-performance or valid performance of the contract brings in practice significant difficulties. To this contributes special nature of the service, directed mainly towards the consumer’s psychological experience. Under the current law, the basis of liability is art. 11a of the Act on tourist services. This liability covers both compensation of material damage and non-material damage in the form of so-called wasted vacation consisting in losing the expected pleasure of travel and the accompanying frustration. The non-material damage is repaired by paying the appropriate amount of money.

A dynamic weighing system or a checkweigher is an automated inspection system that measures the weight of objects while transferring them between processes. In our previous study, we developed a new electromagnetic force compensation (EMFC) weighing cell using magnetic springs and air bearings. This weighing cell is free from flexure hinges which are vulnerable to shock and fatigue and also eliminates the resonance characteristics and implements a very low stiffness of only a few N/m due to the nature of the Halbach array magnetic spring. In this study, we implemented a checkweigher with the weighing cell including a loading and unloading conveyor to evaluate its dynamic weighing performances. The magnetic springs are optimized and re-designed to compensate for the weight of a weighing conveyor on the weighing cell. The checkweigher has a weighing repeatability of 23 mg (1σ) in static situation. Since there is no low-frequency resonance in our checkweigher that influences the dynamic weighing signal, we could measure the weight by using only a notch filter at high conveyor speeds. To determine the effective measurement time, a dynamic weighing process model is used. Finally, the proposed checkweigher meets Class XIII of OIML R51-1 of verification scale e 0.5 g at a conveyor speed of up to 2.7 m/s.

The article examines the claim for damages as regulated in Art. 79 section 1 point 3 letter b) of the Copyright Act and contains an assessment thereof presented against the background of European law. The claim for damages in the case of infringement of copyright is currently provided for in two variants: as compensation falling under general principles of liability for damages and, alternatively, as compensation taking the form of a lump sum. As far as the lump-sum compensation is concerned, it is not necessary for the claimant to prove actual damage. The amount of compensation in this form is set as a double amount (in the absence of culpability on the part of the infringer) or a triple amount (when the infringing conduct is culpable) of an “appropriate royalty”. Such a severe liability violates the civil law standards pertaining to the redress of damages, in particular it interferes with the compensative function of liability for damages. It simultaneously distorts the balance between the claim for a lump-sum compensation and other claims available to right holders in the case of infringement of copyright and, in wider perspective, the balance within the entire system of intellectual property law. It appears dubious whether the legal regulation of the claim for a lump-sum compensation contained in Art. 79 section 1 point 3 letter b) of the Copyright Act is in compliance with the Directive 2004/48/EC on the enforcement of intellectual property rights. Arguments in support of this view have been put forward in the article. Doubts which been expressed in that regard will most likely be clarified by the Court of Justice in its future response to the request for a preliminary ruling, which was made by the Supreme Court.

It is obvious that the doctor will be responsible for the damage resulting from the baby’s fault. It is to be seen a situation where a doctor’s negligence was the only admission to the birth of the child, and not contribute to the injury to his health. And in this case, there is the emergence of claims for wrongful birth or so-called bad birth. More and more often in courts around the world, including Poland, there are actions for damages for the conception and birth of a child, which “caused the injury.” Initially, the courts denied the possibility of recognizing the child as a loss. However, later in the Constitutional Court considered the admissibility of the claims of parents of unplanned or handicapped child is without prejudice to the Constitution. The claim for compensation in a wrongful birth in the Polish case law is rare. One of the reasons is the reluctance to bring such actions which probably translates into a moral issue.
Jest oczywiste, że lekarz będzie odpowiedzialny za uszczerbek zdrowia dziecka powstały z jego winy. Należy jednak rozpatrzyć też sytuację, w której niedbalstwem lekarza było jedynie dopuszczenie do narodzenia dziecka, a nie przyczynienie się do szkody na jego zdrowiu. I właśnie w takiej sytuacji dochodzi do pojawiania się roszczeń z tytułu wrongful birth, czyli tzw. złego urodzenia. Coraz częściej na wokandach sądowych całego świata, także w Polsce, pojawiają się powództwa odszkodowawcze dotyczące poczęcia i urodzenia dziecka, które „wywołało szkodę”. Początkowo sądy negowały możliwość uznania dziecka jako szkodę. Jednak w późniejszym okresie Trybunał Konstytucyjny wyraził pogląd, że dopuszczalność roszczeń odszkodowawczych rodziców nieplanowanego lub upośledzonego dziecka nie narusza przepisów Konstytucji. Przedstawione roszczenie odszkodowawcze typu wrongful birth w polskim orzecznictwie występuje rzadko. Jedną z przyczyn jest niechęć do wytaczania tego typu pozwów, co zapewne przekłada się na aspekt moralny.

Polish expropriation law introduces a compensation system based on the socalled “benefit principle”. This principle assumes estimating the value of the property based on its intended use if it results in a greater value. The problem of considering the intended purpose of expropriation and, consequently, the application of the benefit principle is widespread in compensation proceedings relating to road investments. The research objective of this paper is an attempt to answer the question of whether the benefit principle should be maintained in the real estate appraisal procedure in order to determine compensation, i.e. whether the intended use resulting from the purpose of expropriation should be taken into account if it increases its value. The research also focuses on identifying those factors that should be considered instead of the benefit principle in order to estimate fair compensation for expropriated real estate. Part of the study is also devoted to the assessment of planned changes in legal regulations regarding compensation proceedings. The subject of the research are procedures and regulations for determining compensation for real estate expropriated for road investments in Poland. The analysis covers the stages of the compensation procedure and the factors affecting the amount of compensation. These procedures were compared with those in force in other countries in the context of applying the benefit principle. The results of the analysis lead to the conclusion that the amount of compensation should be independent of the intended purpose of expropriation. This is because planning classification for public purposes cannot be treated as a criterion which increases the market value of the expropriated property.

A dynamic weighing system or a checkweigher is an automated inspection system that measures the weight of objects while transferring them between processes. In our previous study, we developed a new electromagnetic force compensation (EMFC) weighing cell using magnetic springs and air bearings. This weighing cell is free from flexure hinges which are vulnerable to shock and fatigue and also eliminates the resonance characteristics and implements a very low stiffness of only a few N/m due to the nature of the Halbach array magnetic spring. In this study, we implemented a checkweigher with the weighing cell including a loading and unloading conveyor to evaluate its dynamic weighing performances. The magnetic springs are optimized and re-designed to compensate for the weight of a weighing conveyor on the weighing cell. The checkweigher has a weighing repeatability of 23 mg (1σ) in static situation. Since there is no low-frequency resonance in our checkweigher that influences the dynamic weighing signal, we could measure the weight by using only a notch filter at high conveyor speeds. To determine the effective measurement time, a dynamic weighing process model is used. Finally, the proposed checkweigher meets Class XIII of OIML R51-1 of verification scale e 0.5 g at a conveyor speed of up to 2.7 m/s.

Opis:

In this paper a technique of modelling mechatronic systems is investigated. Such technique is developed in order to build an integrated model of workpiece-fixture system additionally equipped with active deformation compensation system. The analysed type of workpieces is flexible, thin-walled parts under mechanical and non-mechanical loads. The model has been implemented in ABAQUS/Standard FEM code where the behaviour of actuator drives and a control system has been emulated with user subroutines. Model simulation data is confronted against data from experimenta investigations and theoretical calculations. Additional multi-domain simulations with the use of temperature-displacement calculation scheme, utilising the analogous deformation compensation method are described. Finally, results are discussed and conclusions are drawn.

The article presents a new discretization method of a continuous-time linear model of sensor dynamics. It can be useful to reduce measuring errors related to the inertia of the sensor. For example it is important in the measurement of rapid processes as temperature changes in combustion chambers, or for shortening the time needed to establish the sensor readings in a transition state. There is assumed that sensor dynamics can be approximated by linear differential equation or transfer function. The searched coefficients of equivalent difference equation or discrete transfer function are obtained from Taylor expansion of a sensor output signal and then on the solution of the linear set of equations. The method does not require decomposition of sensor transfer function for zeros and poles and can be applied to the case of transfer function with zeros equal to zero. The method was used to compensate the dynamics of sensor measuring fast signals. The Bode characteristics of a compensator were compared with others derived using classical methods of discretization of linear models. Additionally, signals in time were presented to show the dynamic error before and after compensation.

The challenge to be addressed by this paper is to extend the common machine tool thermal compensation models considering only internal heat sources to include the effects of the cutting process. Although real-time software compensations of thermal errors exist, the majority of these models only presume machine tools under load-free rotation of the main spindle without any reference to rough machining. The machining process is completely neglected in spite of the fact that it represents a significant heat source and causes workpiece inaccuracy. This paper presents a real-time compensation of three-axis vertical milling centre thermal errors including the cutting process effect. The simulation is based on dynamic modelling using transfer functions. The model was implemented into a standard CNC controller of a three-axis vertical milling centre to compensate for thermal errors in real time. The inputs of the compensation algorithm are the spindle rotational speed, the 5 temperatures of the machine structure and spindle power. A reduction of thermal errors achieved by using the new approximation TF model including cutting process impact is up to 79% for steel cutting tests with different cutting conditions.

Opis:

The compensation of thermal errors in machine tools is one of the major challenges in ensuring positioning accuracy during cutting operations. There are numerous methods for both the model-based estimation of the thermal tool center point (TCP) deflection and for controlling the thermal or thermo-elastic behavior of the machine tool. One branch of thermal error estimation uses regression models to map temperature sensors directly onto the TCP-displacement. This can, e.g., be accomplished using linear models, artificial neural networks or characteristic diagrams. One of the main limitations of these models is the poor extrapolation behavior with regard to untrained load cases. This paper presents a new method for updating characteristic diagram based compensation models by combining existing models with new measurements. This allows the optimization of the compensation for serial production load cases without the effort of computing a new model. The new method was validated on a 5-axis machining center.

Opis:

Process of metal forming in automotive parts construction becomes more and more demanding due to tightened up tolerance and trials to realize very complex and in many cases unworkable design in mass production. Moreover, it is required to cut and limit costs of die production and simultaneously keep high quality. Furthermore, construction elements are more often produced from materials which belong to High Strength Steel or Ultra High Strength Steel. Application of this kind of materials considerably reduces construction mass due to high durability. Nevertheless, it results in appearance of springback effect. Springback value depends mainly on used material as well as part geometry and in extreme cases deviation value from target part might reach in some areas high level. Designing of dies requires using of appropriate Finite Element Method software to make them more economic and less timeconsuming. Therefore, analysis of forming process alone is not enough to be taken into account. During the design process, it is needed to include the die compensation to reach optimized blank sheet. Prediction of springback effect by tryout method and then correction of deviation is difficult arduous and painstaking. Virtual compensation methods make it possible to receive precise result in a short time. This way gives a huge economic advantage eliminating useless milling and allows producing of die just in time. Optimization process can relate to individual operation as well as take into consideration intermediate stages in the final result, at the same time increasing the accuracy. Die compensation with software application was experimentally verified by prototype die.

Problem of best input signal for identification choice is considered in the article. Applying nonlinear sensors the same object can be identified more or less accurately depending on input signal constant component absolute value. Signal processing quality in distorting signal presence while applying compensation structure is also studied. Different sensors sensitivities cause interaction between additive and multiplicative errors. Total error value can be decreased or increased applying compensation structure. Mathematical analysis of problem and experiments are presented.
W artykule rozważany jest problem doboru najwłaściwszej wartości bezwzględnej składowej stałej sygnału dla identyfikacji. Przy zastosowaniu nieliniowych przetworników ten sam obiekt może zostać zidentyfikowany bardziej lub mniej dokładnie w zależności od wartości bezwzględnej składowej stałej sygnału wejściowego. Przeanalizowano również jakość przetwarzania sygnałów w obecności sygnału zakłócającego przy zastosowaniu struktury kompensacyjnej. Różne wartości wrażliwości przetworników zastosowanych w strukturze powodują interakcje pomiędzy błędem addytywnym i multiplikatywnym. Błąd całkowity może zostać zmniejszony lub zwiększony przez zastosowanie struktury kompensacyjnej. Przedstawiono analizę matematyczną problemu oraz weryfikację eksperymentalną.

The notion of Bug River property regards the property abandoned within the territory of the Republic of Poland within its pre–war borders which after the year 1945 were abandoned outside the present–day territory of the Republic of Poland. For objective reasons, and because of the lack of the concept providing the final solution, only in 2005 an act to ensure comprehensive regulation and procedure of awarding compensation for movable property abandoned outside the present–day borders of the territory of Poland was passed. In the Act of 2005 the Bug River People were granted a right to compensation for the property left beyond the Polish borders. The entitlement to have the value of property abandoned outside the present–day Polish borders offset is affirmed by the voivodship offices competent with regard to the place of residence of the applicant – the property’s owner and in case of inheritors – with regard to the last place of residence of the property’s owner. The voivod’s decision confirming the right to compensation determines persons eligible for this right, the value of abandoned property, the amount of compensation and the form of its implementation. The right to compensation may also be implemented through allowing the value of property left by Polish nationals beyond the Bug River to be offset against the price to be paid for State–owned land

Opis:

Remuneration of executives is a  subject of much debate and controversy. This article analyzes the level of remuneration and tries to correlate it with indicators of the Z-Score and TSR. It has been shown that only in a  few banks there is a  statistically significant relationship between these variables. The controversy may raise (in many cases) due to negative index of directional correlation of these variables, which may indicate that the executive salaries are forming in an irrational way.

In the Sejm’s draft position, concerning the application of the National Council of Agricultural Chambers, the author claims that rules of the Hunting Law, so far as they do not provide obligatory permit from a farmer – who is an owner of land included in a hunting zone – to lease that land forming a hunting district, are compatible with the Constitution. However, provisions regarding compensations for hunting damages are considered unconstitutional.

Opis:

One of the leading models of successful aging is the life-span model of Selective Optimization with Compensation (SOC) developed by Baltes & Baltes (1990). SOC strategy outlines the best adapting mechanisms to age-related changes and its usefulness was proved in many empirical studies. For the first time the present study examines how SOC is associated with subjective indicators of successful aging in Polish seniors. Three variables served as outcome measures of successful aging: positive emotions (measured by PANAS), satisfaction of life (SWLS) and absence of feelings of loneliness (Loneliness Scale de Jong Gierveld). All scales used were in Polish version. Polish adaptation of the SOC Questionnaire was accomplished by the first author. 80 elders (between 64–85 years old) participated in the study. The results indicate that there is a statistically significant positive correlation between SOC strategy and widely used measures of successful aging which confirms the data of previous authors and means that SOC strategy does not depend of socio-cultural context.

Opis:

In this paper, transient stability of IEEE 9- bus system combined with Unified Power Flow Controller (UPFC), has been accomplished. UPFC based on Voltage Source Controller (VSC) has a higher switching frequency, an obvious voltage harmonic and a lower voltage level. Under a symmetrical three-phase short circuit with a different fault locations were used and the load angle variation also studied to test the control performance. The multi machine system combined with UPFC controller, perform outstanding to reduce damping oscillation in power system observed in results of simulation.

Unlike the Canon law texts available in the Romanian principalities – Moldavia and Wallachia – falling under the Slavic influence, the first legal acts which are subscribed to the secular law and which appear in 1646 [“Carte Românească de Învățătură” (en. Romanian Book of Learning) or “Pravila lui Vasile Lupu” (en. Vasile Lupu’s Code of Laws)] and in 1652 [“Îndreptarea legii” (en. The Law’s Rectification) or Pravila lui Matei Basarab (en. Matei Basarab’s Code of Laws)] fall under the Greek-Byzantine influence. The present article aims to provide some information regarding the translation mechanisms applied by the Moldavian and Wallachian scholars of the 17th century who aimed at transposing the Byzantine Legal Standard to the everyday life of the two above mentioned Romanian principalities by means of fundamental procedures, such as “analysis (with the underlying meaning determination), transfer, restructuring, and testing” (Nida, 2004: 85) of the source message. The most precious information related to the translation process of those times is provided by the cases of untranslatability generated by the legal and terminological gap between the Receiver and the Transmitter. The identification and classification of these cases, but also the highlighting of the solutions the translator found to solve them, represent important steps in understanding the equivalenting process of two unequal legal systems that took place centuries ago in Eastern Europe, as illustrated by the case of the two Romanian principalities and the Greek-Byzantine one.

Opis:

Single-branch filters are still popular and are commonly used for power quality improvement purposes. Analysis of a single-branch filter is a relatively simple task. Although individual filters tuned to specific harmonics can be easily designed, after connecting them into a group it turns out that the capacitance and inductance mutually influence each other, distorting the resulting frequency characteristics. This article presents a matrix method for design a group of single-branch filters, so that the resultant frequency characteristic satisfies the design requirements including the requirements for location of the frequency characteristic maxima. Designer indicates the frequencies of the parallel resonances.

Opracowanie dotyczy instytucji zadośćuczynienia, stanowiącego jeden ze sposobów naprawienia szkody niemajątkowej. Przyznana suma pieniężna ma wynagradzać doznane cierpienia fizyczne i psychiczne, a co za tym idzie ma stanowić pewnego rodzaju ekwiwalent poniesionej szkody niemajątkowej. Aby funkcja ta mogła być realizowana, wysokość zadośćuczynienia musi zostać należycie ustalona w oparciu o czynniki istotne dla danego stanu faktycznego. Uznanie, czy osobie, której została wyrządzona szkoda, należy się zadośćuczynienie i w jakiej wysokości należy do kompetencji sądu. W niniejszym artykule omówione zostały przykładowe czynniki, którymi sąd powinien kierować się przy określaniu wysokości należnego zadośćuczynienia. Wskazano, jak dużym wyzwaniem dla sądu jest orzekanie o kompensacyjnej funkcji zadośćuczynienia.
The study concerns the institution of compensation, which is one of the ways to compensate for non-pecuniary damage. The sum of money awarded is intended to compensate for physical and psychological suffering and consequently – to constitute a kind of non-pecuniary damage equivalent. In order to implement this function, the amount of compensation must be duly determined based on factors relevant to the facts. Determining whether the injured person should be compensated, and with what amount, is the competence of the court. This article discusses examples of factors which the court should use to determine the amount of compensation. At the same time, discussion of this issue outlines how challenging it is for the court to implement the compensatory function of this institution.

Opis:

The commonly applied electrical networks with an insulated neutral point in ships are not able to protect against electric shock, due to the presence of capacitance between phase wires and the hull, which increases the values of shock current. A new approach to solve this problem is presented. The new idea is based on active compensation of shock current using current sources inserted between the phase wires and the metallic hull. A four-leg transistor inverter controlled by a signal processor (DSP) and a logic programmable array (FPGA) was used as a set of current sources. The arrangement of the test stand obtained for the experimental checking of the concept compensation of shock current is presented together with the experimental results.
Powszechnie stosowane w okrętownictwie sieci elektryczne z izolowanym punktem zerowym z powodu występowania pojemności doziemnych (powodujących wzrost prądu rażenia) nie zapewniają ochrony przeciwporażeniowej. Autor prezentuje nowe podejście do rozwiązania tego problemu. Nowa idea aktywnej kompensacji prądu rażenia człowieka polega na włączaniu pomiędzy przewody fazowe a kadłub statku aktywnych źródeł prądu. W proponowanym rozwiązaniu jako źródła prądowe został wykorzystany falownik w układzie czteroprzewodowym. W referacie przedstawiono układ stanowiska badawczego, przeznaczonego do eksperymentalnego sprawdzenia koncepcji aktywnej kompensacji prądu rażenia w sieciach okrętowych niskiego napięcia, oraz wyniki badań.

Deprivation of an entity of acquired rights deriving from an administrative act is possible through the combined application of administrative provisions of substantive and procedural law. The limits of durability acquired under an administrative decision rights are the constitutional principle of the protection of acquired rights and the general principles of administrative procedure. The permanence of the right acquired by the administrative decision is not absolute. Repeal or change of the administrative decision is possible only in the mode provided in the law, since the administrative decision makes use of the presumption of regularity. The deprivation of administrative and legal powers in the area of public law takes place in the context of an assessment of the implementation of an administrative decision carried out by a state body. This assessment is possible with the use of two procedural institutions for the expiry of an administrative decision and a substantive institution for the withdrawal of rights. The body assesses whether the addressee of an administrative act has implemented the administrative decision not only in accordance with its content but also the provisions of the generally applicable law. The deprivation of a party of an acquired right is often accompanied by the need to award damages (grant compensation). The procedure and premises for claiming compensation liability have been regulated in the provisions of substantive administrative law. The principle of the effectiveness of public administration bodies is one of the basic principles of administrative law. Its application is not limited only to the creation of law, but also includes the application of law by public administration bodies. The problem of the efficiency of operations of state bodies is of particular importance not only in the area of enforceability of an administrative decision, but also its authorising function. The efficiency of operations of entities in the State structure is assessed through the prism of the implementation of a given administrative decision.

Despite several technical advances over the last decade, CNC controlled manufacturing still bases upon outdated paradigms: manufacturing data are generated and transferred along a heterogeneous and divided CAD/CAM/CNC data chain. The role of the NC controller is limited to the execution of tool paths generated beforehand and the possibility of online tool path adaptation is not planned in legacy NC controllers. In contrast, practical observations make this legacy approach quite inappropriate in an industrial framework. Significant geometrical variability is sometimes observed both prior and after milling in parts that belong to the same batch. In that context, the integration of online tool path adaptation strategies appears to be essential. In this paper, a methodology for correcting the tool path in real-time thanks to measurements provided by a laser scanner moving with the tool is introduced. The resulting local information is used to approximate the workpiece exact geometry by using a POD (Prosper Orthogonal Decomposition) snapshot technique and to adjust the path in accordance. This method has the great advantage of taking into consideration geometrical features such as curvature, twist but also additional parameters whose impact on the tool path is significant (unexpected initial setup of the part for example). This method has been implemented on the advanced CNC programming platform of the laboratory, which hosts in particular a high speed machining centre equipped with an open NC controller.

Opis:

The paper presents a concept of an active filter with energy storage. This solution can be used for the compensation of momentary one phase high power loads with discontinued power consumption (e.g. spot welding machines). Apart from the typical filtering capabilities, the system’s task is also the continuity of the input power from the feeder line and limiting its fluctuation. The proposed by the author’s solution can produce measurable economic benefits by reducing the rated power necessary to energize periodically operating loads and improving the indicators of electrical energy quality. The developed method of active power surges compensation enables a flexible approach to requirements concerning the rated power of the point to which the periodically operating loads with high peak current value are connected. The tests were conducted on a simulation model specially developed in Matlab & Simulink environment, proving high effectiveness of the presented solution.

After many years of intensive work the international experts from ISO TC 39 published the technical report called ISO TR 16907 "Machine tools - numerical compensation of geometric errors". This document defines the terminology, presents benefits and limitations of numerical compensation of machine tools' and measuring machines' errors. It gives machines manufacturers and users vital information about how to use numerical compensation. In the context of those types of compensation defined in ISO TR 16907, this article shows rules of selecting models of Volumetric Error for three-axis machine tools. What is more, this paper presents some principles of reduction of these proposed models because of the functional tasks for machine tools. One of the obtained results is an array of reduced models for three-axis machine tools. This array determines the degree of detail of the model and the experimental research program that needs to be carried out in order to determine the Volumetric Error distribution.

Opis:

The aim of the article is to discuss the issue of strength of the circumferential backlash compensating beam in a high-efficiency gear pump. Three geometric versions of the compensating beam structure differing in the wrapping angle are analyzed. The mechanical model is solved assuming the curved beam model supported at the contact points between the beam and the gear teeth. The assumed mechanical structure is statically indeterminate. In order to determine the reactions in the supports and in the beam fixing, the Menabrei and Castigliano theorems are used. Based on analytical calculation results, the cause of compensation structure damage during experimental tests of prototype units is identified and the most favorable variant of beam structure, from the mechanical strength point of view, is determined.

Opis:

Phase disturbances in electric power signals are neglected and only amplitude (envelope) distortions are discussed in a literature. Amplitude disturbances are interpreted as Amplitude Modulation (AM) of main 50 Hz frequency. Detailed analysis of all disturbances and their sources are presented in the paper. It is shown that AM and narrow band PM (phase modulation) take place in power network simultaneously and those two modulations interact with each other. Voltage variation is proposed as disturbances measurement. Theoretical results are verified by field experiments and their results are presented.

Real estates owned by units of territorial self - government of their unions or by individuals can be expropriated for realization of public purposes. The authority conducting expropriation (eminent domain, compulsory purchase or compulsory acquisition) proceedings is obliged to specify precisely the purpose of expropriation on the ground of a concrete legal provision. Authors of this paper have presented the legal procedures of expropriation and principles of calculating of compensation for real estate expropriation in Poland. They presented their view on this problem and some remarks published by FAO as a result of examining this subject through the many countries.
Nieruchomości stanowiące własność jednostek samorządu terytorialnego lub osób prywatnych mogą być wywłaszczone na rzecz realizacji celów publicznych. Instytucja przeprowadzająca procedurę wywłaszczeniową jest zobowiązana do uzasadnienia celu wywłaszczenia na gruncie obowiązujących przepisów prawa. Odszkodowanie za wywłaszczenie wartości rynkowej lub odtworzeniowej nieruchomości zgodnie z Konstytucją RP musi być odszkodowaniem słusznym. W artykule przedstawiono procedury prawne wywłaszczenia oraz zasady ustalania wysokości odszkodowania na gruncie polskich przepisów prawa. Zwrócono również uwagę na konieczność pewnych zmian i uściśleń w tym zakresie oraz przytoczono niektóre wnioski opublikowane przez FAO, będące rezultatem badań przeprowadzonych przez tę organizację.

Opis:

Results of analysis of drift influence on operation and efficiency of optimal analog adaptive communication systems with feedback and a new approach to drift compensation in these systems are presented in the paper. The proposed approach is based on application of the extended multidimensional adaptive algorithm that estimates simultaneously the value of a transmitted sample and the value of an unknown drift rate. The knowledge of the drift rate enables drift compensation and improves transmission efficiency of systems suffering problems related to drifts.

W artykule omówiono problemy dochodzenia przez pasażerów roszczeń z tytułu zryczałtowanych odszkodowań, przewidzianych rozporządzeniami unijnymi. Wskazano nieprawidłowości w procesie wyznaczania organów odpowiedzialnych za egzekucję przestrzegania przepisów ww. rozporządzeń. Jednocześnie zwrócono uwagę na problemy związane z dochodzeniem roszczeń z ww. tytułów zarówno przed odpowiednimi organami, jak i sądami. Problemy te wynikają z nieuwzględnienia w obowiązujących w Polsce procedurach sytuacji, w których kompetencja do rozstrzygania tej samej sprawy powierzona została różnym organom.
The article discusses problems of recovery of claims in respect of lump-sum compensation for passengers provided by EU regulations. The authoress shows irregularities in the designation of administrative bodies responsible for enforcement of compliance with the provisions of the above regulations. She also points to problems that arise from the possibility of recovery of passengers claims before administrative bodies and courts at the same time. These problems result from the lack of provisions which regulate the situation when the competence to decide the same case was entrusted to different bodies.

Opis:

In order to guarantee the accuracy of turntable angle measurement, a real-time compensation method for turntable positioning precision based on harmonic analysis is proposed in this paper. Firstly, the principle and feasibility of the real-time compensation method are analysed, and a detailed description of harmonic compensation is provided herein. Secondly, we analyse the relationships between the surface number of the polygon with the compensation order of the harmonic function and its corresponding compensation accuracy. The effects of the iterations number and the data width on calculation accuracy in the coordinate rotation digital computer (CORDIC) algorithm are analysed and the quantization models of the approximation error and rounding error of the CORDIC algorithm are established. Then, the calculation of the harmonic error function and real-time compensation processes are implemented on a field programmable gate array (FPGA) chip. The resource occupation and time delay of the phase angle calculation and the harmonic component calculation are discussed separately. Finally, the validity of the harmonic compensation method is proven through comparing the compensation effect with that of linear interpolation and the polynomial compensation method. The influences of the compensation order, the iterations number and the data width on the compensation results are demonstrated by simulation. A test platform with a laboratory-made FPGA circuit is built to evaluate the effect of real-time compensation with the harmonic function and the positioning error compensation can be performed within 760 ns. The results confirmed the effectiveness of the harmonic compensation method, revealing an improvement of the positioning precision from 54.21ʹʹ to 1.63ʹʹ, equivalent to 96.99% reduction in positioning error.

The absorption of sound in air represents one of the main problems of the scale model measurements. This absorption, especially at higher frequencies, is considerably greater than the value determined by the law of acoustical similarity between the full scale and the scale model. Different alternatives are applied for compensation of the excess air absorption including a numerical compensation. In this paper, a modified approach to numerical compensation is proposed. It is based on compensation of the sound decay only, and not background noise. As a consequence, there is no an increase of background noise in the compensated impulse response. The results obtained by the proposed procedure are compared to the corresponding ones obtained by the other procedures.

Opis:

In this article, we propose two model free control schemes that are based on pulse height modulation using low frequencies with the goal to compensate normal friction effects in drive trains that negatively influence the performance of e.g. a standard PID controller. The first control scheme uses pulse height modulation to especially compensate stick slip effects but increases vibration and noise in the drive train. To reduce such side effects a modified phase shifed pulse height control scheme based on multiple actuated joints is introduced. Both control schemes are compared with a standard linear controller as reference and evaluated by using six quality criteria.

The paper shows that the low energy efficiency exploitation of technical systems to a large extent determines their negative impact on the environment and humans. On the basis of the energy balance equation shows that the decrease in efficiency due to the loss of energy during its conversion and the transmission and power factor with reduced electrical devices technical systems. Reduced power factor due to the fact that the technical system operation the power consumption of the drive motor on the shaft of these systems much less than its nominal value. Loss of energy and reducing power factor leads to contamination of the environment and reduction of human security in the operation of technical systems. The most effective way to improve the energy efficiency of operation is to improve the power factor by compensating the phase shift, which reduces the current consumption due to compensation of the reactive component of it. Experimental research in machine tool technology systems have shown that the application of the method of compensation of phase shift can significantly improve the energy efficiency of the operation of these systems. This significantly reduces the amount of power consumption, the value of its reactive component and the input current and greatly increasing the power factor of technical systems in their operation.

The article constitutes a legal and economic discussion of the economic factors which may and should be taken into account while calculating the benefits compensating the loss of income of the injured and of their families in case of death. The analyzed benefits are an important element of compensation of economic loss in personal injury cases where the compensation is the duty of the perpetrator (or the entity responsible for him/her) within the system based on tort liability. In light of the ubiquitous nature of TPL insurance, the payer is usually the insurance company liable under the granted guarantee. The scope of such cover results from the contract and/or legal acts. The subject calculation was based on an actuarial annuity which also takes into account the likelihood of the claimant and his/ her relatives living until the subsequent periodical payments. The applied calculation is of an illustrative nature with regard to the considerations of the relevant economic assumptions made at the time of loss calculation. The discussion carried out in the article concerns the size and value of the economic factors that can be used in this model.

The subject matter of this work is the functioning of a specific market of undeveloped real estate intended for cemeteries. There is a need in Poland not only to expand the existing cemeteries but also to establish new ones. However, such investments are successfully made only in a few gminas, not to mention big cities, where they seem even harder to be carried out. The aim of this article is to outline the issues of negotiations, expropriation and compensation in the process of investment implementation in Poland. In the negotiation process between a gmina (commune) and a private entity, carried out for the purchase of land intended for cemeteries, it has been proved that the gmina must assume the cost of the investment at approximately 55% of the purchase price of land intended for single-family housing on a given local market. Additionally, the author indicates the limitations associated with the location of investments in local spatial development plans as well as the limitations in terms of conducting effective negotiations for purchasing land intended for cemeteries by means of an agreement. The main problem indicated in the work is the location damage (suffered or not), which has largely contributed to blocking the contractual purchase of land and substantially complicates and delays termination of the expropriation procedure.
W opracowaniu podjęto problematykę funkcjonowania nietypowego rynku nieruchomości niezabudowanych przeznaczonych pod cmentarze. W Polsce występuje potrzeba powiększania i zakładania nowych cmentarzy. Nieliczne gminy potrafią skutecznie przeprowadzić takie inwestycje. Największe trudności występują w miastach. Celem niniejszego artykułu było zarysowanie problematyki negocjacji, wywłaszczeń i odszkodowań w procesie realizacji inwestycji w Polsce. W procesie negocjacji pomiędzy gminą a podmiotem prywatnym realizowanym dla nabycia gruntów przeznaczonych pod cmentarze dowiedziono, że gmina musi zakładać koszt realizacji inwestycji na około 55% ceny zakupu gruntów, przeznaczonych pod zabudowę mieszkaniową jednorodzinną na danym rynku lokalnym. W opracowaniu wskazano na ograniczenia związane z lokalizacją inwestycji w miejscowych planach zagospodarowania przestrzennego oraz ograniczenia w zakresie efektywnego przeprowadzenia rokowań o nabycie gruntów przeznaczonych pod cmentarz w drodze umowy. Wskazano, że głównym problemem jest szkoda lokalizacyjna (zaistniała lub nie), która w znacznym stopniu przyczynia się do zablokowania trybu umownego wykupu gruntu i zasadniczo komplikuje i przeciąga w czasie zakończenie procedury wywłaszczeniowej.

The article analyses the claims based on Article 446 Civil code in case of a suicide assassination. At the beginning it shows the issues of inheritance of property rights and obligations in case of death of a decedent. Next, it focuses on the possibility of inheritance property obligations of the suicide assassin towards the next of kin of the victim of the assassination. At the end it presents a solution for the case where claims under Article 446 Civil code are not satisfied.

Objectives Good communication between seafarers and their families at home is essential to compensate for the work-related strain experienced on board ships. This paper presents the needs and possibilities for communication with home in seafaring. Material and Methods In total, 323 seafarers were interviewed during their work assignments on board (the participation rate of 88.5%). The results were stratified by cultural background, family ties, rank groups and shipping routes. Results The average stay of the officers on board the current vessels lasted 4 months and that of the ratings 9 months (p < 0.001). About a third of the officers and a half of the ratings evaluated these lengths of stay as too long. In the study, only 50 participants (15.5%) mentioned that the Internet on board their previous vessel was available for private use. Only 40.6% of these crew members stated that they had used it on a daily basis. Particularly the seafarers assigned to worldwide destinations and crew members without children experienced the insufficient possibilities for telecommunication as work-related strain (OR 1.87, 95% CI: 1.15–3.04 respective OR 2.00, 95% CI: 1.03–3.88). The average amount of time spent on telecommunication amounted to more than 2.5 h/week (which equals approximately 20 min/day). The average cost of about USD 30/week for telecommunication was considered by 24.7% of the seafarers as “much too high.” Conclusions The fact that several crew members considered the time spans of their assignments as too long should lead to certain adjustments. In view of the importance of good options for shipboard telecommunication, this study makes an essential contribution to understanding the crews’ needs. Measures should be taken to improve communication by allowing an easier access to information and communication technology (ICT) (on board and ashore), by offering cheaper fees, and by providing Internet access in their cabins. The opinion states that suing the State Treasury of a local government unit is possible in case of failure to enact relevant provisions required by: the Constitution, statutes, the European Union rules and ratified international agreements. Additionally, suing local government unities is possible in case of the lack or an abandonment of the control regarding compliance with the provisions by citizens and economic entities. Legal basis for filling such a claim are provisions of the Civil Code.

Planning and spatial management are very often associated with the best providing human needs that require adjustment to environmental conditions. Thus interpreted, the rational spatial management brings many benefits to the local community, often the price of it is the degradation of the environment. System solutions reduce the negative effects of the investment on the environment and society. As a part of that, an investment in the implementation of apply optimal solutions in terms of environmental and social protection are procedures for environmental impact assessments (EIA). The aim of this study was to determine the operations to minimize negative environmental impacts and methods of environmental compensation in EIA procedures in the planning and implementation of the linear investments in Poland on A2 highway from Stryków I to Konotopa section ‚E' case study. To determine the most effective mitigation methods the negative impact of the highway and activities in terms of environmental protection, simplified EIA was carried out. The most threatened elements of the natural and social environment were identified: groundwater, soil, human health, acoustic climate.

Spatial characteristic of triggering radius of the damaged probe for the CNC machine tools has been presented. In such case a clear distortion of the probe performance characteristic and a significant increase in probe errors have been observed. Then, to such a damaged probe, a variable speed correction method of systematic errors was used. By setting proper measurement speeds, varying for different measurement directions, errors of the probe can be significantly reduced.

In order to meet the application requirements of high-power mobile inductivelycoupled power transfer (ICPT) equipment, the structure of the dual transmitter and pickup can be used to improve the transmission power of the ICPT system. However, this structure cannot easily describe the change of the mutual inductance parameter in the moving state, making the mathematical model difficult to establish. The change of load parameters during the movement will affect the current and voltage at the transmitter and pickup coils. Aiming at these problems, this paper proposes a dual transmitter and pickup ICPT system based on inductor-capacitor-inductor (LCL) compensation network, and analyzes its power transmission efficiency. By setting the shape and size of the coil, the influence of the change of the mutual inductance parameters on the system efficiency during the movement is reduced. The changes of the mutual inductance parameters of the ICPT system under the moving state are simulated by changing the coupling coefficient in the PSpice software. The results show that the structure of the ICPT system used in this paper can improve the output power and reduce the influence of the system when the load changes.

The question of compensation of loss of a chance is relatively rarely debated in the Polish doctrine of the law of tort. One reason for such a state of affairs may be the virtually unanimous opinion of both courts and academic comment-ators with regard to the permissibility of granting damages for loss of a chance of obtaining a benefit – loss of a chance, traditionally defined as potential harm, does not give rise to damages and falls beyond the scope of Article 361 § 2 of the Polish Civil Code. The paper attempts to show, by reference to the latest experiences of common law jurisdictions, that there exist rational bases for an extension of the notion of harm so that it encompasses loss of a chance where a potential acquisition of a benefit is contingent upon an action of a third party or force majeure, on which the victim has no bearing, subject to the caveat that the victim put an effort into generating the chance in question. In the course of the analysis an attempt will be made to demonstrate, with reference to a selec-tion of factual scenarios considered by Polish courts, that it would be possible to achieve fairer results (whilst avoiding placing unfair compensatory burdens upon the other party) to recognize liability for loss of a chance where the victim put a significant effort into making the chance viable, material, and where, based on ordinary life experience, materialization of such a chance may be considered a natural course of events.

The present study aims to explain and predict the monetary amount awarded by courts as compensation for harm suffered. A set of machine-learning algorithms was applied to a sample of decisions handed down by the Polish common courts. The methodology involved two steps: identification of words and phrases whose counts or frequencies affect the amounts adjudicated with LASSO regression and expert assessment, then applying OLS, again LASSO, random forests and XGBoost algorithms, as well as a BERT approach to make predictions. Finally, an in-depth analysis was undertaken on the influence of individual words and phrases on the amount awarded. The results demonstrate that the size of awards is most strongly influenced by the type of injury suffered, the specifics of treatment, and the family relationship between the harmed party and the claimant. At the same time, higher values are awarded when compensation for material damage and compensation for harm suffered are claimed together or when the claim is extended after it was filed.

The article presents the prospects for application of wireless power supply in electronic devices. A short description of advantages of using this technology including the principle of its operation and construction of typical systems applied in devices of everyday use was provided. Two types of resonance systems used for wireless transmission of energy were presented. Also, advantages and disadvantages of using each of these systems were listed. Furthermore, the impedance and performance analyses of the wireless electric energy transmission systems were discussed. The performance characteristics were presented depending on several parameters in the three–dimensional form. The minimum quality factor of the resonance system, which allows the achievement of the high system performance at low interface between the primary and secondary coil winding was demonstrated. Two tested circuits were compared and the areas of application were determined for each of them. Difficulties related to maintenance of the circuit in resonance and to limitation of losses were determined.

The passive forces acting against the drive force are phenomena that influence dynamical properties and precision of linear axes equipped with feed drives. Covers are one of important sources of passive forces in machine tools. The paper describes virtual evaluation of cover passive forces using the cover complex model. The model is able to compute interaction between flexible cover segments and sealing wiper. The result is deformation of cover segments and wipers which is used together with measured friction coefficient for computation of cover total passive force. This resulting passive force is dependent on cover position. Comparison of computational results and measurement on the real cover is presented in the paper.

With the increasing penetration rate of grid-connected renewable energy generation, the problem of grid voltage excursion becomes an important issue that needs to be solved urgently. As a new type of voltage regulation control method, electric spring (ES) can alleviate the fluctuations of renewable energy output effectively. In this paper, the background and basic principle of the electric spring are introduced firstly. Then, considering the influence of an electric spring on noncritical load voltage, noncritical loads are classified reasonably, and based on the electric spring phasor diagram, the control method to meet the noncritical load voltage constraint is proposed. This control method can meet the requirements of voltage excursions of different kinds of noncritical load, increase the connection capacity of the noncritical load and improve the voltage stabilization capacity of the electric spring. Finally, through the simulation case, the feasibility and validity of electric spring theory and the proposed control method are verified.

In order to improve the accuracy of machine tools, the use of additional active modules meeting the requirements of the “Plug & Produce” approach is focused. In this context one approach is the installation of a high precision positioning table for online compensation of machine tool deflections. For the model-based determination of the deflection, the knowledge of the effecting process force is crucial. This article examines the use of displacement sensors for force estimation in a piezoelectric system. The method is implemented on a high precision positioning table applicable in milling machine tools. In order to compensate nonlinear effects of piezoelectric actuators, a hysteresis operator is implemented. Experimental investigations are carried out to quantify the influence of preload stiffness, preload force and workpiece weight. Finally, a resolution d ≤ 78 N could be achieved and further improvements to meet the requirements for online compensation of machine tool deflection are discussed.

In recent times the aspects of electrical energy quality and cost related to operation of electrical networks get the higher importance. For the markets of electrical energy generation, transmission and distribution operating in competition environment it is crucial to secure the effectiveness of the energy supply process, especially when the fuel prices and charges for emission are significantly rising. Shunt reactors which are installed in electrical networks to increase the power factor and hence to minimize the loss related to Energy transmission. It is also essential to secure that compensation is adequate to the current state of a network and follows its changes. The paper describes the variants of shunt reactors recently introduced for production and operation which allow to compensate the reactive power in follow-up and effective way.
W ostatnim czasie coraz większego znaczenia nabierają aspekty jakości energii elektrycznej, jak i minimalizacji kosztów związanych z użytkowaniem sieci. W obliczu konkurencji występującej również narynku wytwarzania, przesyłu i rozdziału energii elektrycznej, szczególnie przy znacząco rosnących cenach surowców jak i kosztach związanych z emisją zanieczyszczeń, zagadnienia jak najefektywniejszego procesu dostarczania energii są kluczowe dla zabezpieczenia swej pozycji rynkowej. Dławiki kompensacyjne instalowane w sieciach mają za zadanie poprawę współczynnika mocy, a tym samym obniżenie strat powstających podczas przesyłu energii. Istotne jest także zapewnienie, by kompensacja była odpowiednia do aktualnego stanu sieci i nadążała za jej zmianami. Artykuł opisuje warianty dławików wprowadzonych ostatnio do produkcji i eksploatacji pozwalające na nadążną i efektywną kompensację mocy biernej.

Linear accelerators such as Free Electron Lasers (FELs) use superconducting (SC) resonant cavities to accelerate electron beam to high energies. TESLA type resonators are extremely sensitive to detuning induced by mechanical deformations - Lorentz force detuning (LFD), mainly due to the extremely high quality factor (Q) of the 1.3 GHz resonance mode, in the range of 10 6. The resulting modulation of a resonance frequency of the cavity makes power consumption and stability performances of the Low-Latency Radio Frequency (LLRF) control more critical. In order to minimize the RF control efforts and desired stabilities, the fast piezoelectric actuators with digital control systems are commonly used. The paper presents a novel approach for automatic control of piezoelectric actuators used for compensation of Lorentz force detuning, the practical application and carried out tests in accelerating module ACC6 in Free-Electron Laser in Hamburg (FLASH).

The assumption was verifi ed that for patients suffering from cancer levels of anxiety and self-esteem differ compared to other patients before surgery. 120 patients of urology were assigned to subgroups according to diagnosis (cancer vs. non-cancer) and the duration of hospitalization (5 days vs. 1 day). Patients suffering from cancer declared higher anxiety than other patients. Longer hospitalization was connected to higher anxiety. A threat-congruent difference in explicit self-esteem was revealed only between two groups: 1. cancer and long hospitalization and 2. non-cancer and short hospitalization. For implicit self-esteem the phenomenon of implicit compensation of self-esteem was predicted and confi rmed: among cancer-sufferers the Name Letter Effect was greater than among other patients. Also, in the cancerpatients group, the result of Rudman et al. (2007) was replicated: increasing anxiety was connected with increasing implicit self-esteem.

Directive 2014/104/EU on private antitrust enforcement opted for the exclusion of punitive damages from the category of recoverable damages following a violation of antitrust law. This article will outline the concept of punitive damages and analyse the relevant case-law of the courts of the Member States, of the ECtHR and of the ECJ. Then, it will examine the regime laid down in the Directive and consider the possible reasons why the European legislator opted for this exclusion. Thus, the opportunity to introduce such a provision into the European legal system will be evaluated, taking into consideration the problem of overdeterrence, the problem of the division of functions between public and private enforcement, and making a comparison with the relevant provisions of Directive 2004/48/EC on the enforcement of intellectual property rights. Finally, a possible modification of Article 3(3) of the Directive will be suggested, in the framework of the review that the Commission is required to undertake by December 27, 2020
La Directive 2014/104/UE sur l’application privée du droit de la concurrence a opté pour l’exclusion des dommages-intérêts punitifs de la catégorie des dommages recouvrables suite à la violation du droit de la concurrence. Cet article décrira la notion de dommages-intérêts punitifs et analysera la jurisprudence pertinente des tribunaux des États membres, de la CEDH et de la CJUE. Ensuite, il examinera le régime prévu par la Directive et examinera les raisons possibles pour lesquelles le législateur européen a opté pour cette exclusion. Donc, l’opportunité d’introduire une telle disposition dans le système juridique européen sera d’évaluée en prenant en considération le problème de la dissuasion excessive, celui de la répartition des fonctions entre l’application publique et privée du droit de la concurrence et en faisant une comparaison avec les dispositions pertinentes de la Directive 2004/48/ EC relative au respect des droits de propriété intellectuelle. Enfin, une éventuelle modification de l’article 3, paragraphe 3, de la Directive sera d’envisagée, dans le cadre d’une révision de la Directive que la Commission doit faire au plus tard le 27 décembre 2020

Opis:

Introduction: CO2 laser endoscopic cordectomy is the method of laryngeal cancer treatment. The type of cordectomy (I–VI) depends on the extent of the tumor. Endoscopic laser surgery provides more satisfactory phonation conditions in comparison to open surgical procedures. The aim: The aim of the study was to classify phonatory compensation mechanisms after CO2 laser cordectomy using the HSDI. M aterial and methods: The study included 30 men treated and diagnosed at the Department of Otolaryngology and Department of Clinical Phonoaudiology and Logopedics, Medical University of Bialystok. The control included 30 men with no pathological changes in the larynx. Type III, IV and Va CO2 laser cordectomy have been for glottis cancer treatment. Postoperative evaluation has been conducted 6 months after the surgery. HSDI has been used in larynx visualization. R esults: Type I compensation occurs most frequently in patients after type III cordectomy. Advanced glottis cancer, as an indication for type IV and V cordectomy, leads to epiglottic hyperfunction and phonation involving vestibular folds – type II and III compensation. Type IV compensation is most frequent in type IV cordectomy. C onclusions: The type compensation is connected with the extent of glottis resection. In cordectomy including anterior commissure and the part of opposite fold (type Va), supraglottic hyperfunction with the participation of vestibular folds (type II and III compensation) has been recorded. Transmuscular cordectomy (type III) most often resulted in type I compensation. Type III-Va cordectomy caused reduction or absence of MW, decrease in amplitude and aperiodicity of vibrations in HSDI.

Opis:

Microelectromechanical systems (MEMS)-based strapdown navigation systems offer advantages such as small size, low cost and minimal power consumption. However, MEMS sensors are prone to significant low-frequency noise and poor bias repeatability, which can lead to navigational errors over time. These errors make them unsuitable for autonomous navigation applications, even with frequent recalibration. One way in which to solve this problem is by using the rotation modulation (RM) method. This approach is widely recognised but has only been successful with precise laser and fiber optic gyroscopes equipped with precise rotating platforms. This article focuses on the potential of adapting the RM method for the case of inexpensive MEMS sensors that can significantly improve navigation performance, while maintaining the benefits of microelectromechanical technologies. Potential issues of implementation were discussed, and corresponding requirements were formulated. The proposed optimal computation scheme was verified during static tests of the developed inertial measurement unit (IMU). Further steps in studying the adaptation of the RM method for MEMS sensors have also been outlined.

Opis:

Discontinuation of proceedings under Article 59a of the Criminal Code is a new institution in Polish criminal law. This article discusses selected issues relating to the premises for the application of Article 59a of the Criminal Code in practice. In view of the use by the legislator in Article 59a of the Criminal Code of concepts with vague meanings, their possible interpretations were proposed. It has been suggested that a rephrasing of the provision in question should be considered, in order to ensure the possibility of applying the said institution to a wider range of misdemeanours, as compensatory discontinuation is intended by the legislator to fulfil the redress function of proceedings and ensure the effectiveness and speed of criminal proceedings

The Constitution of the Republic of Poland, in Art. 21, par. 2, permits constitutional expropriation only if this is made for public purposes and with just compensation. It is the highest degree of interference in the ownership of the individual and, therefore, it is important to ensure that the proceedings which are legally carried out implement the basic principles of the administrative procedure and are run in accordance with the provisions of the Act on Real Estate Management. Due to the guarantee of protection of the individual, special attention should be focused on the conditions determining the initiation and conduct of expropriation proceedings in the form of public purpose execution, negotiations to conduct an administrative hearing, determination of “just” compensation, and return of property in cases specified in the Act.

Opis:

Non-uniform conditions on the modules of the PV array, especially, partial shading reduces the output of the PV array to a large extent. The shaded module in a string limits the current of the entire string and hence, the output power of the string. The output power under such conditions is reported to be higher for total-cross-tied (TCT) configuration. This paper describes two different approaches, one based on current compensation (current equalization) and another based on voltage equalization, to extract higher power from the partially shaded total-cross-tied photovoltaic array. The TCT configuration is considered to minimize the number of converters, sensors, cost and complexity involved. The additional converters in the two distinct approaches evaluated here operate only when the partial shading occurs and are controlled to minimize the current and voltage miss-matches. The analysis and the control algorithm are presented. Simulation results obtained in MATLAB/Simulink are included to demonstrate the effectiveness of both methods and the relative merits and demerits of these approaches are highlighted.

Opis:

Heeling is unsafe for ship, its machineries and people on board. It is known the main reasons of vessel’s heeling such strong winds, hard and speedy turns, uneven cargo loading. The most dangerous for vessel should be the shift of cargo at sea due to faults during port cargo loading. During cargo operations, the vessel’s heel may change and ought to be under control. Some offshore vessels, pipe-lay, crane, heavy lift, container or ro-ro vessels ought to have the anti-heeling systems to prevent too high heels during port or offshore operations. They are needful for the vessel and cargo safety. It was presented chosen examples of such systems showing the solutions, elements of anti-heeling (A-H) systems, method of vessel’s heel visualization, ways of utilization etc. The proper utilization of A-H systems is the base of correct, save time and safe operations to minimize the risk of vessel’s tilting or capsizing. It was mentioned some problems during operation and some malfunctions of A-H systems creating the risk of vessel’s accidents. Some examples of famous and serious vessel’s accidents were shown. It was discussed what may be done for improving these systems during the cargo operation especially in open sea particularly necessary for offshore vessels.
