As early as at the beginning of the last century, the Polish-Jewish educator, children›s author, and pedagogue Janusz Korczak called for the right of child to happy childhood. This revelatory vision was accompanied by Hellen Key, who proclaimed 20th century as the century of the child, publishing book of such title and calling for the rights of children to free growth. Unfortunately, the history of the modern world added to these humane ideas rather pessimistic post scriptum, involving children in the armed conflicts and totalitarian regimes, making them the victims of adult cruelty to an unimaginable extend. In such context, the “War Childhood” book provides a very important and exceptional pedagogical and sociological study, for it induces readers to ponder over the position and status of children in armed conflicts, with the biographical, psychological and social repercussion of the latter.

Despite the ratification of the Convention on the Rights of the Child by Poland, as well as the presence of a number of provisions concerning them in the documents regulating the functioning of the education system in our country, school reality leaves much to be desired in the context of realizing the rights of children. A certain picture of this issue is provided by the research presented in the article. The survey was conducted among students of pedagogy at the University of Rzeszów, using the author's questionnaire. The surveyed students were optimistic about the implementation of children's rights in Polish schools, considering them to be generally implemented. They expressed their conviction that Polish children are guaranteed the right to learning and to education. In our country, the principle of universality and free of charge of teaching, equality in access to education is respected, as well as the right to recognize and preserve the national identity of students during schooling. On the other hand, the right to express opinions, to respect the child's own views was more often considered to be unrealized than realized, while the right to free expression and information was not much more often implemented than unrealized. As quite positive, students' experiences related to their rights as pupils can be assessed in the past. All of the rights presented to them were more often considered to be implemented than as unrealized. However, they gave examples of breaking their student rights (in the past). The perpetrators in such situations were usually teachers. The schools that the current students of pedagogy used to attend in the past played a rather small role in their education regarding children's rights. From the research, the picture of the school emerges, in which children's rights are violated by the persons appointed to perform them - teachers, and the right to express one's own opinion and respect for his views is the most often infringed and at the same time the most desirable good.
Pomimo ratyfikacji przez Polskę Konwencji o Prawach Dziecka, a także szeregu dokumentów regulujących funkcjonowanie systemu oświaty w naszym kraju, szkolna rzeczywistość w kontekście urzeczywistniania praw dzieci – uczniów – pozostawia wiele do życzenia. Pewnego obrazu tej kwestii dostarczają zaprezentowane w artykule badania. Przeprowadzono je wśród studentów pedagogiki Uniwersytetu Rzeszowskiego, wykorzystując autorski kwestionariusz ankiety. Badani studenci optymistycznie odnosili się do urzeczywistniania w polskich szkołach praw dziecka, uznając je za generalnie realizowane. Wyrażali przekonanie, że polskim dzieciom gwarantuje się prawo do nauki, edukacji. W naszym kraju respektuje się zasadę powszechności i bezpłatności nauczania, równości w dostępie do oświaty, a także prawo do uznania i zachowania w trakcie nauki szkolnej tożsamości narodowej uczniów. Natomiast prawo do wyrażania swoich opinii, do szacunku dla własnych poglądów dziecka częściej było uznawane za nierealizowane niż realizowane, prawo zaś do swobody wypowiedzi i informacji niewiele częściej za realizowane niż nierealizowane. Jako dość pozytywne można ocenić doświadczenia studentów związane z ich prawami jako uczniów – w przeszłości. Wszystkie przedstawione im prawa częściej uznawali za realizowane niż za nierealizowane. Podawali jednak przykłady łamania ich uczniowskich praw (w przeszłości), zwykle przez nauczycieli. Szkoły, do których uczęszczali w przeszłości obecni studenci pedagogiki, raczej niewielką rolę odegrały w zakresie ich edukacji dotyczącej praw dziecka. Z przeprowadzonych badań wyłania się obraz szkoły, w której zdarzają się przypadki naruszania praw dzieci przez osoby powołane do ich realizacji – nauczycieli, a prawo do wyrażania własnego zdania, szacunku dla jego poglądów jest najczęściej naruszanym, a równocześnie najbardziej pożądanym, dobrem.

Celem artykułu jest przedstawienie zagadnienia ochrony praw dziecka w świetle regulacji prawa polskiego i międzynarodowego. Rozważania dotyczące podstaw prawnych ochrony praw dziecka podzielono na cztery podpunkty. W pierwszej kolejności zostało omówione prawo do wychowania w rodzinie, która jest podstawową jednostką społeczną. Kolejny podpunkt traktował o prawie do godziwych warunków socjalnych. Następne rozważania dotyczyły prawa do nauki jako prawa kulturalnego przysługującemu każdemu dziecku. Poruszono także zagadnienie prawa do życia, które jest niezbywalne i nieodzownie połączone z prawem do ochrony zdrowia.
The purpose of this article is to present the protection of children's rights in the light of Polish and international legal regulations. Considerations regarding the legal basis for the protection of children's rights were divided into four parts. The right to be brought up in the family as a basic unit of society was discussed first of all. The next part elaborates on the right to decent social conditions. And the following deliberations are related to the right to education as the right to culture to which each and every child is entitled. The right to live as the inalienable right which is inevitably combined with the right to health protection was described as well.

SHOCK, as a recurring category that has been present for many years in the discourse on the right of the child/human to freedom from all forms of violence, becomes the focal point around which the considerations of this article are focused. The inspiration for the use of the shock category in education was the process of studying Anton Siemionowicz Makarenko’s Pedagogical Poemate and the analysis of the educational system he created along practical directives for parenting and its pedagogical implications. In the text, a fundamental question is raised about how Makarenko used SHOCK as a tool in the educational process? The text presents an analysis of the SHOCK category based on the behavior of violence against a child and analyzes their pedagogical implications.

In the article premises for hearing a minor are presented, as well as organizational issues related to it. The analysis of the provisions in force leads to the conclusion that the role a psychologist plays in a hearing of a minor is still not adequately appreciated. There are no regulations providing for the obligatory participation of a psychologist in a hearing of a child. It is therefore necessary to change the provisions in this respect, so as to determine the competence of a psychologist in a hearing, establish whether a hearing is held by a single-member court or a court in collegiate composition, where a hearing takes place: in the course of divorce proceedings or before the appeal court. Moreover, the issue of frequency of hearing a minor should be clarified.

Artykuł porusza problem praw dziecka w obrazie współczesnego dzieciństwa w zderzeniu z wizją praw dziecka według Janusza Korczaka. Obecnie mimo szeroko rozbudowanej działalności wielu fundacji, organizowanych akcji humanitarnych, prawa dziecka są w dalszym ciągu łamane. Dziecko musi w elastyczny sposób dostosowywać się do szybkich zmian w rzeczywistości oraz stawianych mu wymagań. Mimo wielu różnic między okresem życia Janusza Korczaka a współczesnym obrazem rzeczywistości, można dostrzec wiele podobieństw oraz przesłań, które wpisują się do obecnych realiów. W swojej pracy pragnę oprzeć się na kilku tekstach Janusza Korczaka, w których porusza on problem praw dziecka, m.in. Prawo dziecka do szacunku, Jak kochać dziecko. Dziecko w rodzinie, Prawidła życia, oraz kilku pismach wybranych. Z powyższych prac wyłoniłam następujące prawa dziecka: prawo do życia i prawo dziecka do bycia, tym czym jest, prawo do własności, własnego zdania, zabawy oraz wolnego czasu. Wskazane teksty poddałam analizie, a następnie zestawiłam ze współczesną wizją dzieciństwa oraz prawami dziecka zawartymi w Konwencji o Prawach Dziecka.
The article discusses the issue of children’s rights in the image of modern childhood against a collision with the vision of children’s rights by Janusz Korczak. Currently, despite the widely extended activity of many foundations, organized humanitarian aid, children’s rights continue to be violated. The child has enough flexibility to adapt to rapid changes in the surrounding reality and the many requirements it faces. Despite the many differences between the age J. Korczak lived in, and present times there can be seen many parallels and messages that apply to the reality of our times. In my work, I would like to rely on several texts of J. Korczak, addressing the issue of children’s rights, among others: Prawie dziecka do szacunku (The Child’s Right to Respect), Jak kochać dziecko. Dziecko w rodzinie (How to Love a Child. The Child in the Family), Prawidłach życia (Regulations of Life) and selected writings. In these works the following children’s rights are prevalent the right to life and the right of the child to be what it is, the right to property, its own opinion, fun and leisure. I analyze and present them in a context of contemporary vision of childhood and children’s rights contained in the UN Convention.

This paper aims to demonstrate the main aspects and weaknesses of children's rights in Sudan and describe how to work towards enhancing the immediate response to violations against children. This discussion will help develop future plans to strengthen the enforcement of children’s rights in Sudan and create an environment that protects children's rights against all kinds of violations. This paper presents the current situation of children’s rights violations in Sudan and factors that have a great and direct impact on these situations, especially social and cultural factors concerning female circumcision, genital mutilation, and marriage of underage girls; and laws that violate the dignity of Sudanese children, such as laws related to flogging, imprisonment, and death. The article also addresses issues of wars and internal conflicts and their impact on children, including their recruitment and trafficking. It also discusses the weaknesses of laws in place to protect children in Sudan and the changes these laws have undergone in recent years, especially the fundamental changes following the revolution that broke out in Sudan in 2018, which replaced the dictatorial military regime with Islamic orientations and trying to find objective solutions.

Koncepcja praw dziecka narodziła się w XVII i XVIII wieku. Jako instytucja prawna uznana na całym świecie, prawa dziecka pojawiły się na przełomie XIX i XX wieku. Obecnie obserwujemy rozległy i stale rosnący, zarówno na poziomie krajowym, jak i międzynarodowym, proces ich kodyfikacji. Uchwalono dziesiątki wiążących umów międzynarodowych, wiele dokumentów międzynarodowych o charakterze niewiążącym oraz wiele krajowych aktów prawnych dotyczących praw dziecka i wyznaczających standardy w zakresie ich ochrony. Poszczególne jednostki, instytucje i państwa są zobowiązane do ich implementacji i poszanowania.
The idea of children’s rights emerged in the seventeenth and eighteenth centuries. As a legal institution recognized around the world, children’s rights appeared at the turn of the nineteenth / twentieth century. Nowadays, we observe the large and ever growing process of their codification, both at the national and international level. One can find dozens of binding international agreements, numerous documents belonging to the so-called “soft law” and many domestic law acts regarding child rights issues and defining standards for their protection. Individual units, institutions and states are committed to their implementation and respect. The article presents the normative universal definition of childhood, the concept of children’s rights, the evolution and codification process of children’s rights and the means of their protection.

The aim of the article is to outline the specifics of places and spaces – refugee camps and centers, where children constitute the majority. Through reference to activities implemented there and oriented towards children, we discuss their problematic character connected with e.g. the absence of participatory, rights-based approach (art. 12 CRC) that serves children’s emancipation and equality. In the second part of the article, we propose the implementation of Janusz Korczak’s methods – solutions for participatory work with children (“underprivileged” groups), which seem both timeless and universal. An ethical and contextual adaptation or inspiration based on Korczak’s methods in work designed for backgrounds connected with children remaining in closed and semi-closed systems, provides a chance for children’s basic participation in decision-making in matters that concern their lives. At the same time, it is an opportunity to learn children’s opinions and an expression of respect for the child as a per-son who functions here and now, in the place and space of his or her temporary stay – a refugee camp, where an international protection system for children and adults is far from effective.

W ostatniej dekadzie w wielu inicjatywach międzynarodowych widoczne są nawoływania do intensywnych, zdecydowanych działań na rzecz realizacji prawa dziecka do ochrony przed przemocą. Odwołują się one do swoistego kanonu, który można odczytywać w różnych instrumentach oraz dokumentach, które prawo dziecka do ochrony przed przemocą werbalizują oraz precyzują, przedstawiając prakseologiczną wykładnię kierunków i rodzajów działań, wypracowaną na bazie naukowego dyskursu badawczego oraz refleksji nad praktyką działań i ich skuteczności. W artykule podjęto próbę całościowego zaprezentowania głównych wyznaczników rozumienia tego prawa oraz jego aplikacji społecznej w perspektywie zarówno globalnej, jak i regionalnej.
Calls for intensive and distinct activities for child protection are clearly visible in the last decade in many international initiatives. They appeal mainly to a specific canon that can be read from various instruments and documents, where child’s right to be protected from violence is clarified and explained and they show praxeological interpretation of directions and forms of activities that are demanded and that are worked out on the basis of scientific background and the reflection on praxis and its effectiveness. The paper is an attempt of holistic presentation of the basic elements of understanding the right of the child to be free from all forms of violence and its social application in the global and regional perspective.

In 1997, Poland has ratified the Convention on the Rights of the Child, the project of which has been submitted in 1978 (UNICEF). Almost two hundred countries around the world have signed up the Convention, thereby committing themselves to respect the rights of the child in various dimensions of social life. The right to education is one of the fundamental rights of the child. It also concerns foreign children, who, as a result of migration, have settled down in Poland. The number of immigrants is not as high as in the countries that have built their empires on colonialism. Polish literature raising the issue of education and the rights of foreign children to it is not comprehensive and is based on the publications on the rights of children and cross-cultural education. The main aim of the dissertation is to approximate the literature of the subject with attention to their practical use.

The presented text focuses on the normative concept of the rights of the child. The inspiration to re-read this currently dynamic pedagogical and legal category is the persona and ideas of Jean- Jacques Rousseau. The presented reflections are an attempt at a new interpretation of the category of children’s rights in the context of pedagogical naturalism and the rationalism of a philosopher of the Enlightenment. This text may become an argument in defense of the concept of basing the relations between adults and children on the ideas of children’s rights. We are faced with the following question: To what extent does the category of children’s rights, as determined by positive law, and its ensuing implications in terms of children’s status and their relations with adults, result from the nature of man and society, and to what extent do they constitute a mere “pretence of decency”, becoming an enslaving category? Given the degraded nature of man, how can we justify the need to regulate children’s rights and develop education based on these rights, and to what extent do these rights in fact contribute to this degradation, becoming a source of children’s suffering? Contrary to appearances, the answers to these questions are not unequivocal. This text attempts to re-read and reanalyze the fundamental rights of the child set forth in the Convention on the Rights of the Child and the main legal regulations that form its basis with reference to the ideas of the Enlightenment philosopher. The defense of the contemporary concept of children’s rights with reference to the thought of J.J. Rousseau is also a critical voice in the debate on the assumptions, form, and implementation of children’s rights in modern society.

The aim of the text is to present the issue of school resistance and its relation to the children’s right to participation. School resistance is a concept investigated by critical pedagogy as one of the forms of expressing one's subjectivity. The complexity of the issue is the reason for many definitions and classifications of school resistance. Referring to the definition of school as an area of a clash between dominant and dominated culture, one can speak of resistance defined as action directed against the dominant subject. H. Giroux created a classification of this phenomenon, combining attitudes and behavior towards school (oppositional or accommodative). Types of resistance highlighted in this way provided a basis for subsequent classifications, including E. Bilińska Suchanek's, B. Babicka – Wirkus', and M. Nowicka's. All authors point to the greatest value of conscious resistance, often called transformative resistance. It is based on a disagreement about the real image of the school, while behaving correctly on its territory. In the first place, emancipation requires education that takes place in the school space. Resistance behaviors are related to the concept of participation. Pursuant to the Convention on the Rights of the Child, children and young people have the right to participate. Numerous pedagogical studies indicate that this right remains unrealized in Poland. A look at resistance behavior as a manifestation of the right to participation allows one to understand the potential of resistance – it can communicate the needs of children and young people. What adults interpret as resistance might be a message that requires dialogue and understanding. Respecting the right to participation can create such a space. Connecting the concepts of resistance and participation may contribute to increasing the democratic participation of children and young people in schools.
