- This papers presents the issues of the rights of wild animals and their property rights in terms of the idea of dereification. From the time of antiquity, animals had virtually no rights, and in terms of jurisprudence they were treated as things. A breakthrough in this respect was the theory of Jeremy Bentham, according to which animals were empowered in a way. This theory became the basis for the development of modern laws and codes. However, dereification itself did not really improve the fate of animals and should be treated in ideological rather, than legal terms. Nevertheless, the newly introduced regulations significantly influenced the human-animal relationship, and consequently strengthened, at least partially, the principles of humane treatment, and at the same time certainly contributed to the abolition of the practices of cruelty towards animals. The empowerment of animals however, did not change the categorization of their property, both in the free state and after recovery, regardless of its form.
