The considerations carried out in this study serve to answer the question on the level of implementation of selected agri-environmental instruments in individual EU countries in the opinion of the European Court of Auditors. The aim of the article is to analyze and evaluate ECA judgments on compliance with applicable regulations, as well as recommendations for future directions of changes in the impact of agriculture on the environment, currently proposed in various options for the next stage of CAP development after 2020.

The article presents the basic legal mechanisms shaping modern agriculture through the Rural Development Programme 2014−2020. It discusses the main problems of juridical character, which could be an obstacle in the use of financial resources by farmers. It also underlines the importance of the existing support mechanisms due to the size of allocated grants for Poland. At the same time it draws attention to the possible CAP reform after 2020 and the resulting possible restrictions in financing the Community policy in agriculture.

Artykuł przedstawia wyniki badania ankietowego diagnozującego potrzeby szkoleniowe środowiska naukowego Szkoły Głównej Gospodarstwa Wiejskiego w Warszawie (SGGW) w zakresie otwartej nauki. Głównym narzędziem badawczym był kwestionariusz ankiety rozesłany w wiadomości skierowanej do pracowników naukowych i doktorantów SGGW. Celem badania było określenie stopnia znajomości tematu otwartego udostępniania publikacji naukowych i danych badawczych wśród autorów afiliowanych do SGGW oraz dostosowanie programu szkoleń stanowiącego jeden z elementów przygotowań do przyjęcia w SGGW polityki otwartego dostępu. W pierwszej części artykułu przybliżono zagadnienia związane z otwartą nauką, w tym przedstawiono działania podejmowane na szczeblach europejskim, krajowym i instytucjonalnym związane z wdrażaniem polityk mających zdynamizować proces otwierania nauki. W drugiej części omówiono wyniki ankiety, które pozwoliły określić obszary tematyczne wymagające przeprowadzenia szkoleń. Rozpoznanie poziomu znajomości problematyki otwartej nauki wśród środowiska naukowego SGGW oraz jego nastawienia do otwartego udostępniania stanowi wsparcie dla prac nad kształtem instytucjonalnej polityki otwartego dostępu na tej uczelni, a co z tym związane sytuuje ją w szerszym planie perspektywy otwierania nauki w Polsce.
Open science and the scientific community of Warsaw University of Life Sciences The paper presents the results of a survey diagnosing the training needs of the scientific community of Warsaw University of Life Sciences (WULS) in the field of open science. The main research tool was an electronic questionnaire distributed in a message addressed to researchers and doctoral students at WULS. The aim of the survey was to determine the level of familiarity with the topic of open access to scientific publications and research data among the authors affiliated with WULS and, as a result, to adapt the training programme, which is one of the elements of preparation for the adoption of the open access policy at WULS. The first part of the paper introduces issues related to open science, including actions taken at the European, national and institutional level related to the implementation of policies designed to boost the process of opening science. The second part discusses the results of the survey, which allowed to identify thematic areas in need of training. Recognising the level of familiarity with the issues of open science among the scientific community at WULS and their attitude towards open access supports the works on the institutional policy of open access at this university, and thus situates it within a broader perspective of opening science in Poland.

Subject and purpose of work: The subject of the analysis is the concept of rural development in the European Union countries and its connection with the evolution of the common agricultural policy and the transformation of the cohesion policy. The aim of the study is to discover and assess the scale and method of supporting the rural development in the European Union countries through common agricultural policy and to present the underlying theoretical-cognitive and political-practical premises for shaping rural development strategies. Materials and methods: The official documents and subject literature are submitted for critical analysis and evaluation by authors. Results: This paper presents methods of defining and classifying rural areas and rural development through common agricultural policy and cohesion policy. It specifically outlines the concepts of multifunctional and intelligent development linked to the Europe 2020 strategy and the Cork political declarations. The new concept of smart villages and rural-urban partnership is also presented. Conclusion: The processes of rural policy separation and the need for creating national methods of the coordination of community policies and the use of European funds are indicated.
Przedmiot i cel pracy: Przedmiotem analizy jest koncepcja rozwoju obszarów wiejskich w krajach Unii Europejskiej i jej powiązanie z ewolucją wspólnej polityki rolnej i przekształceniem polityki spójności. Celem opracowania jest poznanie i ocena skali i sposobu wspierania rozwoju obszarów wiejskich przez wspólną politykę rolną oraz przedstawienie leżących u podstaw tego wsparcia koncepcji teoretyczno-poznawczych i polityczno-praktycznych przesłanek kształtowania strategii rozwoju obszarów wiejskich. Materiały i metody: Wykorzystano oficjalne dokumenty, literaturę problemu, poddano krytycznej analizie i ocenie autorskiej. Wyniki: W pracy przedstawiono sposoby definiowania i klasyfikacji obszarów wiejskich oraz sposoby wsparcia rozwoju obszarów wiejskich przez wspólną politykę rolną i politykę spójności. Zarysowano szczególnie koncepcje wielofunkcyjnego i inteligentnego rozwoju powiązane ze strategią Europa 2020 oraz politycznymi deklaracjami z Cork. Przedstawiono także nową ideę inteligentnych wsi i partnerstwa wiejsko-miejskiego. Wnioski: Wskazano na procesy wyodrębniania się polityki rozwoju obszarów wiejskich i potrzebę kształtowania racjonalnego jej modelu przez koordynację polityk wspólnotowych i regionalne wykorzystanie funduszy europejskich.

The article presents the range of decisions made by the member-states of the European Union about the optional support given to production. Since 2015 it has been an element of the first pillar of the Common Agricultural Policy. The article provides an overview of the production support instruments implemented in Poland (indicating the essence of changes introduced in 2017). It also compares trends and the amount of support provided as part of this instrument in individual EU member-states. The research showed that the EU member-states showed big interest in the support offered to production. It was manifested both by the multitude of payments made and the considerable use of the maximum financing limit.

The article presents basic rules regarding to the evolution of legal mechanisms affecting the competitiveness of agriculture in Europe. Market mechanisms such as agricultural intervention, private storage subsidies or emergency aid measures have been analyzed. Author also pointed out the mechanisms whoch influence the profitability of agriculture, the level of unemployment, or the possibility of creating groups of agricultural producers. A possible framework was also defined for making analysis of the need to participate in the definition of European agricultural policy after 2020. It was pointed out that competitiveness and selection of legal mechanisms which can improve it, still would be one of the more important in this process.

The article presents selected planned legal instruments for the implementation of the Common Agricultural Policy after 2020. Special legal analysis has been made of mechanisms to increase the competitiveness of agriculture and preserve the elements of impact on the environment and climate. The analysis by observing the current evolution of the CAP and the effects of choosing individual legal instruments to implement it has been made. Recommendations regarding possible legal solutions on the basis of Polish law in the area of possible needs of farmers has been also included.

Il lavoro indaga sulle linee evolutive del diritto agrario nella prospettiva europea, ponendo in evidenza le sfide e le criticità che nel XXI secolo hanno connotato le scelte operate nell’ambito della politica agricola comune. All’interno di questa prospettiva, specifica attenzione è assegnata ai temi dell’impresa agricola e della stessa perimetrazione dell’attività agricola; temi risalenti nell’ordinamento italiano, ma rilevanti anche nell’ordinamento polacco, come sottolineato più volte negli studi di Roman Budzinowski. L’analisi investe in particolare le riforme di questo secolo, dalla MTR del 2003 alle riforme del 2013 e del 2021 con la riscoperta dell’agricoltura come attività produttiva, sottolineando l’emergere di nuovi modelli sistemici, che finiscono per costruire Codici europei dell’agricoltura. Vengono poi richiamate le ultime novità introdotte dal Trattato di Lisbona, da alcuni recenti regolamenti in tema di controlli ufficiali e dai documenti della Commissione sul Green Deal europeo, con la connessa attenzione ai temi del benessere animale e della tutela di ogni forma di vita e dell’ambiente nella sua complessità e unità, per concludere che le complesse vicende di questi due primi decenni del XXI secolo si caratterizzano per la crescente attenzione verso le scienze della vita come elemento essenziale e connotante dell’attività dell’impresa agricola in tutte le sue diverse declinazioni.
The article focuses on the evolutionary trends of agricultural law in a European perspective, highlighting the challenges and problematic issues that have accompanied the choices made in the context of the Common Agricultural Policy in the 21st century. In this perspective, particular attention has been paid to the issues of the agricultural business and the subject of the limits of agricultural activity; these are issues raised in the Italian legal system, but also relevant to the Polish legal system, as Roman Budzinowski has repeatedly stressed in his works. The analysis considers in particular the reforms of the present century, from the Mid-Term Review 2003 to the reforms of 2013 and of 2021, when there occurred a rediscovery of agriculture as a productive activity; it also highlights the emergence of new systemic models that eventually formed the European agricultural codes. Then, the most recent innovations introduced by the Lisbon Treaty are recalled, starting from some recent regulations on official controls and Commission documents on the European Green Deal and animal welfare, to the protection of all forms of life and the environment in its complexity and unity, which leads to the conclusion that the complex events of the first two decades of the 21st century are marked by an increasing attention directed towards the life sciences seen as an essential and distinctive element of the activity of an agricultural enterprise in all its forms.
W artykule przedstawiono ewolucję prawa rolnego w perspektywie europejskiej, ukazując wyzwania i problemy, które towarzyszyły decyzjom podejmowanym w ramach Wspólnej Polityki Rolnej w XXI wieku. Szczególną uwagę zwrócono na zagadnienia przedsiębiorstwa rolnego oraz granic działalności rolniczej; są to ważne kwestie we włoskim prawie, ale istotne także dla prawa polskiego, co w swoich pracach wielokrotnie podkreślał Roman Budzinowski. W analizie uwzględniono reformy przeprowadzone w XXI wieku, od śródokresowego przeglądu z 2003 r. po reformę z 2013 r., gdy ponownie dostrzeżono w rolnictwie działalność produkcyjną, uwidoczniono także kwestię powstania nowych modeli systemowych, które doprowadziły do stworzenia europejskich kodeksów rolnych. W dalszej kolejności ukazano ostatnie zmiany wprowadzone przez Traktat z Lizbony, wychodząc od niektórych niedawnych rozporządzeń dotyczących kontroli urzędowych oraz dokumentów Komisji w zakresie Europejskiego Zielonego Ładu, z uwzględnieniem kwestii dobrostanu zwierząt, a także ochrony wszystkich form życia i środowiska w jego złożoności i jedności. Pozwoliło to stwierdzić, że wydarzenia pierwszych dwóch dekad XXI wieku skierowały uwagę na nauki o życiu jako ważny element działalności przedsiębiorstwa rolnego we wszystkich jego aspektach.

The research work on multifunctionality in France is being carried on by a variety of epistemologic communities, with a wide range of research questions and methods. The purpose of this state of the art report is to identify these communities, their different uses of the concept of multifunctionality, and the types of agriculture it refers to. The functions to be promoted and the way to enhance them can be related to the theoretical framework used. Six main types of epis-temic communities are identified in the French literature, which highlight a common view on the functions of agriculture, and the scientific approach. Some research gaps in the French literature are suggested. The way to convert the principles of multifunctionality or the principles of sustain-able development into farm policy principles in particular is a matter of interest. More empirical research is also needed to characterize multifunctionality, including divergent perceptions and valuations by different stakeholder groups. 
Badania dotyczące wielofunkcyjności we Francji są prowadzone przez różne grupy badawcze w szerokim zakresie analitycznym i metodycznym. Celem artykułu było zidentyfikowanie tych grup, zdefiniowanie różnic pomiędzy koncepcjami w odniesieniu do typu rolnictwa. Funkcje przypisywane koncepcji wielofunkcyjności nawiązują do teoretycznych podstaw. W badaniach zidentyfikowano sześć głównych nurtów badawczych realizowanych we Francji, jednocześnie wskazano na obszary badawcze wymagające dalszych badań. Dodatkowo określono zakres implementacji idei wielofunkcyjności lub zrównoważonego rozwoju polityki rolnej.

Celem artykułu jest próba odpowiedzi na pytanie, czy w świetle obowiązujących przepisów prawa wspólnotowego i krajowego dopuszczalne jest wprowadzanie do obrotu przez uznane grupy producentów rolnych produktów dostarczonych przez członków lub podmioty spoza tego grona po ich przetworzeniu. Problem nie był dotąd podejmowany w literaturze, a ma istotny walor praktyczny. Kwestia przetwarzania produktów rolnych przez grupy uznane na podstawie ustawy o grupach producentów rolnych i ich związkach ma bezpośredni wpływ na ocenę spełniania przez grupy warunków uznania, a także utrzymania lub utraty tego statusu i co za tym idzie – przywilejów z nim związanych w postaci pomocy finansowej ze środków UE, zwolnień podatkowych czy dopłat do kredytów preferencyjnych. W artykule dokonano analizy prawa wspólnotowego pierwotnego i wtórnego oraz przepisów dotyczących pomocy finansowej ze środków Unii Europejskiej, a także wyroku Trybunału Sprawiedliwości. Wnioski prowadzą do twierdzącej odpowiedzi na postawione pytanie.
L’articolo si propone di rispondere alla domanda se permettere, alla luce della vigente normativa dell’Ue e di quella nazionale, ai gruppi riconosciuti di produttori agricoli di immettere in commercio i prodotti trasformati, forniti loro da soci o soggetti al di fuori del gruppo. Finora il problema non è stato discusso in letteratura, nonostante una significativa dimensione pratica. La questione di come i prodotti vengano trasformati ha un impatto diretto sul processo in cui si valuta se i gruppi di produttori agricoli (che conseguono il riconoscimento ai sensi della legge sui gruppi di produttori agricoli e le loro associazioni) continueranno a soddisfare i criteri per il riconoscimento accordato, e di conseguenza se riusciranno a mantenere lo status assegnato, e in realtà i relativi privilegi, quali aiuti finanziari provenienti da fondi dell’Ue, esenzioni fiscali, agevolazioni sui prestiti preferenziali. L'autore analizza il diritto comunitario primario e secondario, nonché le disposizioni concernenti il contributo finanziario proveniente da fondi dell'Unione europea, come anche la sentenza della Corte di giustizia. Le conclusioni portano a dare una risposta affermativa alla domanda posta.
The aim of the article was an attempt to answer the question whether, in the light of the current provisions of EU law and Polish law, it is possible for recognised groups of agricultural producers to market products supplied by their members as well as entities from outside the group. This issue has not been addressed in the literature but it is of a significant practical value. The processing of agricultural products by groups recognised as such pursuant to the Act on agricultural producer groups and their associations has a direct impact on the assessment whether these groups have satisfied the conditions for recognition, which means whether they will retain or lose this status and, therefore the privileges related to it in the form of financial aid from the EU funds, tax exemptions or subsidies to preferential credits. The primary and secondary European Union law and regulations concerning financial aid from EU funds, as well as the relevant judgment of the Court of Justice in the matter in question have been analysed with a conclusion leading to an affirmative answer to the question posed.

In the research on this problem, construction of the tools and models for the estimation of farms sustainable development level is necessary – the paper presents mythological trial of systematization of the principal indicators groups on this estimation.
Rozwój rolnictwa po II wojnie światowej, oparty na intensyfikacji produkcji rolnej – przynosząc znaczne sukcesy – doprowadził do wielu negatywnych zjawisk (nadprodukcja, poważne zagrożenia dla ekosystemu, pogorszenie jakości produktów itp.). W ostatnich latach podjęto wiele działań modyfikujących Wspólną Politykę Rolną. Zmierzały one do ekstensyfikacji produkcji rolnej oraz do opracowania systemu bodźców ekonomicznych stymulujących technologie, zmniejszające zagrożenie dla środowiska. Wymienione wyżej działania nie zakończą się sukcesem, o ile nie zostaną oparte na szerokiej systemowej koncepcji ochrony środowiska i rozwoju społeczeństwa. Jest nią propagowana koncepcja trwałego i zrównoważonego rozwoju. W artykule przedstawiono rys historyczny i teoretyczne aspekty zrównoważonego rozwoju (koncepcja, definicja i cele, dominujące tendencje w rolnictwie Unii Europejskiej). W dalszych badaniach nad tą problematyką kluczowym i niezbędnym elementem staje się wypracowanie metod służących ocenie stopnia zrównoważenia gospodarstw rolnych. Praca przedstawia metodologiczną próbę systematyzacji podstawowych grup wskaźników i kryteriów takiej oceny.

In the paper, there were presented reasons for the EU policy in the context of operations financing by the EU budget. There were displayed principles in the field of introduction of a new source of EU income in a form of a tax on financial transactions as well as a simplification in the VAT calculation. The author presented also an assessment of budget changes concerning possibilities of realization of the objectives for the period 2014-2020.

Efektywność i skuteczność instrumentów Polityki Rolnej w ochronie zasobów zależy w dużej mierze od przeprowadzenia wiarygodnej oceny potencjału ich oddziaływania na środowisko. Przedstawiony w pracy przegląd wskaźników i analiza mechanizmów wdrażania instrumentów WPR w kontekście ochrony wód i bioróżnorodności, wskazuje na znaczący potencjał WPR we wdrażaniu polityki adaptacji i przeciwdziałania zagrożeniom wód i zaniku bioróżnorodności. Do praktyk rolnych posiadających największy wpływ na ochronę zasobów wodnych należy zaliczyć: zalesianie gruntów ornych, zachowanie naturalnych siedlisk, wprowadzanie uprawy konserwującej, systemów rolno-leśnych, zadrzewionych i zadarnionych elementów krajobrazu oraz optymalizacja obsady zwierząt i wypasu. Znaczącą redukcję wymycia biogenów z pól można również osiągnąć poprzez optymalizację aplikacji nawozów. Istotne oszczędności z tytułu użytkowania wody można uzyskać poprzez zastosowanie kroplowych instalacji nawadniających, sterowanych komputerowo. Szczególnie ważne jest wpieranie wielokierunkowej produkcji w gospodarstwach oraz działań, poprawiających jednocześnie świadczenie kilku usług ekosystemowych.
The effciency and effectiveness of Common Agricultural Policy instruments for resources protection depends primarily on reliable assessment of their potential environmental impact. Overview of the environmental indicators, presented in the paper shows significant potential of the CAP instruments for climate change adaptation policies, sustainable management of water and biodiversity loss prevention measures. The most important positive effects are the following practices: afforestation of arable lands, conservation of natural habitats, conservation tillage, agroforestry systems, landscape elements such as meadows or woodlands, stocking density and grazing management. The significant reduction of nutrients leaching can be achieved by optimized application of fertilizers. Water use efficiency is improved in computer-controlled drip-irrigation systems to a considerable extent. It is of great importance to support multifunctional agriculture and mixed farming, which can increase synergies among ecosystem services, provided by farmers.

Artykuł omawia problematykę koncepcji systemów rolno-leśnych w Polsce w kontekście Wspólnej Polityki Rolnej Unii Europejskiej oraz reguł ustalonych przez Ministerstwo Rolnictwo i Rozwoju Wsi. Analizuje główne szanse i zagrożenia dla rozwoju systemów agroleśnictwa w polskim rolnictwie. Pomimo rozbieżności zapisów w zakresie prawodawstwa zadrzewień w UE jak i w Polsce, które w obliczu pogłębiających się problemów środowiskowych i procesów globalizacyjnych zagrażają racjonalnemu rozwojowi obszarów wiejskich, właściwie zaplanowane zadrzewienia (w tym systemy rolno-leśne) są kluczowym elementem zintegrowanego i zrównoważonego zarządzania gruntami zgodnie z koncepcją biogospodarki, wprowadzają eko-innowacyjne rozwiązania oraz dostarczają drewna i biomasy energetycznej przez co wspierają lokalny rozwój a także wzmacniają poczucie lokalnej społeczności.
The paper is an attempt to discuss problems of trees outside forest in the light of agroforestry, Common Agricultural Policy and the rules established by the Ministry of Agriculture and Rural Development in Poland. Among other things, it looks at the opportunities and threats for agroforestry development in Polish agriculture. Given wide discrepancies between legal definitions concerning agroforestry, trees outside forest and woodlands within EU CAP policy as well as within Polish legislation, this fact threatens the sustainable development of rural areas, in particular where environmental and globalization problems are increasing. In view of these challenges, trees outside forest are the key element of integrated and sustainable land management and fully conform with the concept of bio-economy. This approach implements eco-innovative solutions and can be used in order to produce timber or wood for bioenergy. This supports also local development and reinforce the sense of belonging to the community.
