    Agri-food sector is one of the traditionally well-developed sectors in Bulgaria. The export picture of Bulgarian food industry has been changed after the full EU membership of the country in 2007. Thus, the food import exceeds the food export more than twice nowadays. The aim of the paper is to reveal why Bulgarian food producers have lost their competitive advantages so fast, what kind of factors drives the food producers to worsen their production in comparison with other food-market players? The analyse showed that the food producers do not use effi ciently inter-business competitive factors (technology development and transfer as well as package design and service development). On the sectorial level, the food producers focus on to the resource management and they miss to enlarge their competitiveness by cooperation with suppliers, consumers or other food processors.
    Sektor rolno-żywnościowy jest jednym z tradycyjnie dobrze rozwiniętych sektorów w Bułgarii. Obraz eksportu bułgarskiego przemysłu żywnościowego zmienił się po uzyskaniu pełnego członkostwa kraju w UE w 2007 roku. Celem niniejszego artykułu jest odkrycie, dlaczego bułgarscy producenci żywności stracili tak szybko swoje przewagi konkurencyjne, jakie czynniki spowodowały pogorszenie się produkcji producentów żywności w porównaniu z innymi uczestnikami rynku żywnościowego? Z przeprowadzonej analizy wynika, że producenci żywności nie stosują efektywnie takich środków poprawy konkurencyjności, jak rozwój i transfer technologii, rozwój wzornictwa opakowań czy usług. Na poziomie sektora producenci skupiają się na zarządzaniu zasobami, a nie dostrzegają możliwości poprawy konkurencyjności poprzez współpracę z dostawcami, konsumentami czy innym przetwórcami.

    The article aims to analyse legal issues related to the protection of compettion in agriculture within the context of EU legislation. The conducted research was aimed at identifying motives justifying the sectoral approach adopted by the EU legislator to tackle the issue of protecting competition in agriculture, identifying adopted preferences and ways of determining the relationship between the objectives of the Common Agricultural Policy (CAP) and the competition policy within the scope of their impact on EU agriculture, as well as clarifying the content of rules of competition in agriculture derived from Art. 42 TFEU and secondary legislation established on its basis. Also the article aims to presentation new aspectes in the field of protection competition in agriculture wich express European Commission’s proposal for a divective on unfair trading practices in business-to-business relationships in the food supply chain.

    The article presents selected planned legal instruments for the implementation of the Common Agricultural Policy after 2020. Special legal analysis has been made of mechanisms to increase the competitiveness of agriculture and preserve the elements of impact on the environment and climate. The analysis by observing the current evolution of the CAP and the effects of choosing individual legal instruments to implement it has been made. Recommendations regarding possible legal solutions on the basis of Polish law in the area of possible needs of farmers has been also included.

    W pracy przedstawiono model doświadczenia polowego w badaniach nad konkurencją wzajemną pomiędzy rośliną uprawną a chwastami w agrofitocenozie. Zaproponowano wskaźniki służące ocenie skutków tych oddziaływań. Wskaźniki te oparte są na względnych różnicach liczby osobników, ilości biomasy i wielkości cech biometrycznych roślin. Pozwalają zatem określić i porównać reakcje rośliny uprawnej na zachwaszczenie, reakcje poszczególnych gatunków i zbiorowiska chwastów na konkurencję rośliny uprawnej oraz ocenić konkurencję wzajemną rośliny uprawnej i chwastów w danej agrofitocenozie. Sposób określania poszczególnych wskaźników oddziaływania konkurencyjnego umożliwia porównanie efektów tych wpływów u różnych gatunków, w różnych fazach rozwojowych i na różnych organach rośliny.
    The paper presents a field experiment model to investigate the competition between the crop and weeds in agrophytocenosis. Indicators were proposed to be used to evaluate the effects of these interactions. The indicators are based on the relative differences in the number of individuals, amount of biomass and the value of biometric characters of the plants, thus allowing us to define and to compare the reactions of the crop to weed infestation, reactions of respective weed species and weed communities to the competition from the crop and to evaluate the competition between the crop and weeds in a given agrophytocenosis. The method of defining respective indicators of competitive effects makes it possible to compare these effects in different species, at different development stages and for different plant organs.

    Przedmiotem artykułu są sprzeczności w ewolucji Wspólnej Polityki Rolnej. Celem rozważań jest określenie tych sprzeczności i pokazanie ich negatywnych konsekwencji. Autor wychodzi od osobliwości popytu na produkty rolne, omawia znaczenie Wspólnej Polityki Rolnej i prezentuje sześć kolejnych faz jej rozwoju. W konkluzji dokonuje syntezy sprzeczności ewolucji WPR i ich negatywnych konsekwencji. Formułuje pytanie, czy możliwe byłoby poddanie działalności handlowej w rolnictwie, podobnie jak w innych sektorach gospodarki, wolnej konkurencji między grupą państw lub globalnie, przy założeniu, że byłaby ona wzajemna i podlegała tym samym standardom jakości i bezpieczeństwa żywności.
    The subject of this article is contradictions in the evolution of the Common Agricultural Policy. The considerations aim to identify these contradictions and their negative consequences. Starting from the peculiarities of the demand for agricultural produce, the author discusses the importance of the Common Agricultural Policy and presents six successive phases of its development. He concludes with a synthesis of the contradictions of the CAP evolution and their negative consequences. He also raises a question as to whether it would be possible to subject commercial activity in agriculture, like in other sectors of the economy, to free competition among a group of states or globally, on the assumption that such competition would be reciprocal and subject to the same standards of quality and food safety.

    Celem artykułu jest zaakcentowanie kilku podstawowych wątpliwości związanych z wejściem w życie ustawy z dnia 15 grudnia 2016 r. o przeciwdziałaniu nieuczciwemu wykorzystywaniu przewagi kontraktowej w obrocie produktami rolnymi i spożywczymi, a zaakcentowanych już w doktrynie w trakcie krótkiego czasu obowiązywania ustawy. Ustawa, pomimo ambitnych celów ochrony interesu publicznego oraz słabszej strony relacji handlowych w istotnym dla wszystkich konsumentów sektorze rolno-spożywczym, budzi szereg problemów interpretacyjnych, zwłaszcza dla przedsiębiorców będących adresatami ustawy oraz wprowadzonych w niej rozwiązań.
    The aim of this paper is to underline some essential doubts indicated by some authors and related to the Act on counteracting unfair use of superior bargaining power in the trade in agricultural and food products. Despite ambitious goals concerning protection of public interest and weaker parts in trade relations in agricultural and food sector the Act is considered as a source of interpretative problems, especially for entities to which it is addressed.

    The article presents selected provisions contained in the Act of 15 December 2016 on counteracting the unfair use of superior bargaining power in the trade in agricultural and food products, which has been prepared by the Ministry of Agriculture and Rural Development. The Act provides for an administrative fine for the unfair use of superior bargaining power. A proceeding of this nature shall be initiated by the President of UOKiK ex officio, rather than by request of any party to such proceeding. However, any entrepreneur with a reasonable suspicion of being the subject to a practices involving the unfair use of superior bargaining power may submit a complaint to UOKiK. It is the intention of the author to present a brief description of what are believed to be the key provisions contained in the new Act and show some difficulties that entrepreneurs may face when evaluating their activities for compliance with the provisions of this Act.
    Artykuł prezentuje wybrane regulacje zawarte w ustawie z 15 grudnia 2016 r. o przeciwdziałaniu nieuczciwemu wykorzystywaniu przewagi kontraktowej w obrocie produktami rolnymi i spożywczymi przygotowanej przez Ministerstwo Rolnictwa i Rozwoju Wsi. Ustawa dotyczy wprowadzenia pieniężnych kar administracyjnych za nieuczciwe wykorzystywanie przewagi kontraktowej. Postępowanie będzie wszczynał z urzędu Prezes UOKiK, a zawiadomienie dotyczące podejrzenia stosowania tych praktyk będzie mógł zgłosić przedsiębiorca, jeżeli podejrzewa stosowanie takich praktyk wobec siebie. Autorka podejmuje próbę przedstawienia zwięzłego opisu najistotniejszych – w jej ocenie – postanowień zawartych w ww. ustawie. Jednocześnie wskazuje na pewne trudności, z jakimi mogą spotkać się przedsiębiorcy przy ocenie swoich działań pod kątem zgodności z przepisami omawianej ustawy.

    Opis:
    The Polish Act on Counteracting the Unfair Use of Superior Bargaining Power in the Trade in Agricultural and Food Products was adopted on 15 December 2016 and entered into force on 12 July 2017. The new legal framework resembles, in some places, the legal rules contained in the 2007 Act on Competition and Consumer Protection, elsewhere resembles the 1993 Act on Combating Unfair Competition. Therefore, the article reviews the new Polish provisions taking into account the previous system including the prohibition of the abuse of a dominant position and the prohibition of unfair competition. This publication is intended to point out the peculiarities that characterize the new provisions. Readers will find here an assessment of recent Polish developments and suggestions for further development of the Polish legal framework in the EU context. In particular, the review critically analyses some solutions of the 2018 EU draft Directive on unfair trading practices in business-to-business relationships in the food supply chain and shows what amendments to the Polish legal framework will be needed, if the Directive is adopted in the current version.
    La loi polonaise sur la lutte contre l’utilisation déloyale du pouvoir de négociation supérieure dans le commerce des produits agricoles et alimentaires a été adoptée le 15 décembre 2016 et est entrée en vigueur le 12 juillet 2017. Le nouveau cadre juridique ressemble, à certains endroits, aux règles juridiques contenues dans la loi de 2007 sur la concurrence et la protection des consommateurs, qui ressemble d’ailleurs à la loi de 1993 sur la lutte contre la concurrence déloyale. Par conséquent, l’article examine les nouvelles dispositions polonaises en tenant compte du système précédent, notamment l’interdiction de l’abus de position dominante et l’interdiction de la concurrence déloyale. Cette publication est censée mettre en évidence les particularités qui caractérisent les nouvelles dispositions. Les lecteurs trouveront ici une évaluation des développements récents en Pologne et des suggestions pour le développement du cadre juridique polonais dans le contexte de l’UE. En particulier l’article analyse de manière critique certaines solutions du projet de directive de l’UE de 2018 sur les pratiques commerciales déloyales dans les relations interentreprises au sein de la chaîne d’approvisionnement alimentaire et indique quelles modifications dans le cadre juridique polonais seront nécessaires si la directive soit adoptée dans la version actuelle.

    Opisując dzieje tego pierwszego klubu zapaśniczego na Śląsku Opolskim, autor na początku przedstawił sport w środowisku wiejskim na ziemi opolskiej po zakończeniu II wojny światowej. Okres ten był niezwykle trudnym, wynikającym między innymi z odziedziczonej traumy po działaniach wojennych, jak również niepewności jutra tych ziem, które po 1945 r. znalazły się pod administracją polską. Od samego początku młodzież wiejska garnęła się do uprawiania sportu. Powojenny wyż demograficzny, wielki zapał lokalnych działaczy, jak również ochota i ciekawość samej młodzieży spowodowały, że ten projekt, mający na celu uczestnictwo we wszelkiego rodzaju formach aktywności fizycznej, udało się zrealizować. W Brzeźnicy natomiast dyscypliną wiodącą stały się zapasy. Klub od samego początku, dzięki konsekwencji w działaniu, systematycznie się rozwijał. Warto podkreślić, że przez cały okres działalności sprawą niezwykle ważną dla klubu było szkolenie dzieci i młodzieży. Należy przypomnieć, że przez cztery lata funkcjonowania, a było to w latach 1971-1975, będąc jeszcze w starych granicach administracyjnych województwa opolskiego, klub otrzymywał znaczące wsparcie finansowe od lokalnego sponsora, którym było Państwowe Gospodarstwo Rolne w Kietrzu.
    By describing the history of the first wrestling club in the Opole Silesia, the author started from presentation of the sport in the rural areas in the Opole area after the 2nd World War. The period was dramatically difficult especially given the inherited trauma of war operations and uncertainty about the future of the land which after 1945 came under Polish administration. From the very beginning, the youth in the rural areas became very much attracted to sporting activities. The post-war population boom, great enthusiasm of local activists and eagerness and curiosity of the very youth caused that the project which was aimed at promoting participation in different kinds of physical activity, became a success. In Brzeźnica, wrestling became the leading discipline. From the very beginning the Club, thanks to determination of its activists, developed gradually. It is worth stressing that during the whole period of its operations the priority of the Club was to train children and the youth. It is worth reminding that during the four years of operations, i.e. years 1971-1975, at that time within the administrative limits of the Opolskie Province, the Club received significant financial support from a local sponsor – State Agricultural Enterprise in Kietrz.

    Opis:
    Bolesław Bierut’s paper The task of the party in the struggle to raise the standard of living of working people in the current period of socialist construction presented at the 9th Plenary Convention of the Central Committee of the PUWP (29-30 October, 1953) became the basis for formulating the thesis published prior to II Congress of the PUWP (16 January, 1954). In the struggle for the growth of agricultural production and for the socialist reconstruction of the countryside, the whole society needed to participate; the librarians played an important role in popularizing the agricultural and technical literature. The author enumerated activities and commitments undertaken in this area throughout the country, focusing in particular on the commitments undertaken by public libraries of the Wrocław voivodeship. The basis for the study were archival materials from the Presidium’s of the Provincial National Council Department of Culture (1953-1954) available at the State Archives in Wrocław.
