Artykuł dotyczy problematyki związanej z dokonaną w ostatnim czasie nowelizacją przepisów kodeksu postępowania cywilnego w zakresie postępowania w sprawie wniosku o wydanie dziecka złożonego na podstawie konwencji haskiej. Ustawa ta dokonuje zmiany właściwości rzeczowej sądu w tych sprawach, przenosząc je z poziomu sądu rejonowego do wybranych sądów okręgowych, a w postępowaniu odwoławczym jako jedyny właściwy określa Sąd Apelacyjny w Warszawie. Ustawa wprowadza także możliwość złożenia skargi kasacyjnej od postanowienia sądu drugiej instancji. Jak wprost przyznaje Ministerstwo Sprawiedliwości, będące autorem projektu ustawy, jej celem jest „ochrona polskich dzieci”. Powoduje to, że ustawie towarzyszą pozaprawne emocje. Mając to na względzie, a przede wszystkim patrząc na cel konwencji, jakim jest dobro dziecka, ocena dokonanych zmian powinna być dokonywana z dużą ostrożnością.
The article discusses issues related to the recently amended provisions of the Code of Civil Procedure with regard to proceedings in the case of an application to return a child filed under the Hague Convention. The amended Act changes the jurisdiction of a court in these matters, transferring it from the level of a lowest regional court to selected district courts, and in appeal proceedings, the only competent court is the Court of Appeal in Warsaw. The Act also introduces the possibility of lodging a cassation appeal against the decision of the second-instance court. As the Ministry of Justice, the author of the Bill, directly claims, the aim of the regulation is to ‘protect Polish children’. As a result, the Act raises extralegal emotions. With this in mind, and primarily considering the purpose of the Convention, which is the best interests of the child, the assessment of the amendments should be made with great caution.

This article provides a response to David Hume’s argument against the plausibility of miracles as found in Section 10 of his An enquiry concerning human understanding by means of Charles Sanders Peirce’s method of retroduction, hypothetic inference, and abduction, as it is explicated and applied in his article entitled A Neglected Argument for the Reality of God, rather than focusing primarily on Peirce’s explicit reaction to Hume in regard to miracles, as found in Hume on miracles. The main focus will be on Peirce’s neglected argument rather than his explicit confrontation with Hume on the issue of miracles, because his criticisms of Hume demands a methodological approach appropriate for scientifically analysing surprising phenomena or outliers, of which miracles or the reality of God would be but two examples amongst many. This article, then, consists of an attempt to construct this method as one that draws inferences neither a priori nor a posteriori, but per posterius, because such a method is capable of rigorously questioning rogue or surprising phenomena, e.g. miracles.

To take Confucius himself as a concrete example, we would have to allow that he is corporate in the sense that the lines of divergence and convergence that constitute his focus and meaning move throughout the entire field of the Chinese cultural tradition. Confucius is both focus and China as a focused field.

The Hague Convention on the Civil Aspects of International Child Abduction provides no fixed definition of its central term of habitual residence of a child. Recently, in Monasky v. Taglieri the U.S. Supreme Court reviewed the determination of an abducted child’s habitual residence, resolved a split among circuit courts regarding the focus of habitual residence inquiry as to whether habitual residence should be determined using objective evidence of the child’s perspective, subjective evidence of parental intent and established the new “totalityof-the-circumstances” standard of review. As this is quite a different position as compared to the position of the Polish Supreme Court who decided that the intentions of caregiving parents are not relevant considerations in determining a child’s habitual residence, this article analyses recent US developments arguing that the Polish Supreme Court position should be changed.

The interests of children are of paramount importance, therefore it is sometimes necessary for the authorities to interfere in matters relating to their custody, when a child is likely to have been wrongfully removed or retained in breach of the rights of custody attributed to a person, an institution or any other body (child abduction). Therefore a number of international and European Union legal acts impose on national legislators the obligation to introduce mechanisms involving central authorities into cooperation with each other and promoting cooperation amongst the competent authorities in their respective states to make proper discoveries to secure the prompt return of children. For this purpose, the Law of 26 January 2018 on the exercise of certain acts of the central authority in family matters relating to legal transactions under European Union law and international agreements was adopted. Pursuant to its provisions, Police offi cers shall, by virtue of their specifi c powers, assist the central authority and the courts on matters relating to the abduction of minors abroad. Their role is mainly linked to providing the authorities with relevant information, assisting the probation offi cer, and searching the place where the minor is presumed to be living.

The paper discovers the presence of abduction in teachers’ activities and emphasises the role of trichotomous systems (abduction, deduction, induction) in discovering human reality. The paper focuses on the presence of abduction in education sciences research, and its main goal is to detect abduction in teaching activities and classroom interaction. Abduction is a type of reasoning requiring philosophical, logical, and psychological background, distinct from induction and deduction, and it contributes to a viewpoint in social research that strives to make research in human reality easier to understand. The qualitative study involved explores the presence of abduction in teachers’ communication based on unstructured observation. The observation was carried out in a primary school. The objects of observation were the Geography, Art, and PE classes of the same teacher. The data of the class observation were recorded verbatim. The records were processed using an inductive, data-driven method after the classes. The reliability of the process was ensured by intracoding. The results of the observations reflect the presence of abduction in classroom interaction. The results showed that abduction appeared in the Geography, Art, and PE classes observed, and every class witnessed right and wrong abductive conclusions. The paper is relevant to anybody interested in the appearance of abduction in education sciences research and aims at completing the arsenal of tools available for analysing teachers’ activities.

Marriage has always been a concern of the Church. Christian doctrine gave matrimonium sacred meaning and at the same time fully endorsed the concept of mutual consent which originated from Roman law. The act of abduction with its legal and ethical consequences was described in detail in the Decretum Gratiani. The punishment for the abductor was public penance and prohibition of marriage. If the fiancé was unwilling to take back the abducted bride he was allowed to marry another woman. However, if the fiancé and the bride wanted to get married afresh, they were to be both excommunicated until they had made their reparation. The Decretum Gratiani clearly indicated that the raptus puellae was an obstacle which prevented marriage. The reason was the duress of abduction, which was contrasted with free will, voluntarily consent and the approval of father, parents or guardians.

In light of recent developments in argumentation theory, we begin by considering the account that Aristotle gives of what he calls sophistical refutations (elenchoi sophistikoi) and of the usefulness of being able to recognise various species of them. His diagnosis of one of his examples of the grouping that he labels epomenon is then compared with a very recent account of the matter, which, like Aristotle, calls on us to attribute a mistake or confusion to anyone who uses this kind of argument. From examination of three other examples that Aristotle himself supplies of epomenon, it appears that there are cases of inferences of this kind that we need not, and perhaps cannot, avoid making. The suggestion is made that this is because the whole family of what Peirce calls abductions have important characteristics in common with epomenon.

This article advances the thesis that there is no threshold of the use of force. i.e. no level of the use of force which decides whether and which forcible actions undertaken by States are prohibited. The examples of actions discussed in the doctrine of law which supposedly would be ‘below’ such a threshold in fact either are regulated by other prin-ciples of international law, are not considered as regulated by ius ad bellum, or States deliberately resign from calling them a use of force for both legal and extra-legal reasons. Thus, the existence of such a threshold is not confirmed by States’ practice. This thesis will be explored using three examples: the cases of the evacuation of nationals, the extra-territorial and the Falklands/Malvinas Islands invasion of 2 April 1982. The article starts with a brief discussion of the opinions expressed in the doctrine of international law on the threshold, as well as the applicable case law.

This essay is an exploratory reflection on a theme drawn from the work of Pierre Hadot and Juliusz Domański regarding “philosophy as a way of life.” I approach the matter from the naturalistic outlook of classic pragmatism and its own limitations. This approach stresses the possible improvement of the analysis of normativity by way of some neglected contributions regarding the nature of history and the evolution of Homo sapiens applied to the formation of the human self or person. I take Hadot’s proposal seriously, therefore, as contributing to a mature conception of philosophy. But I deliberately restrict my own conjectures to naturalistic constraints, which begins to suggest an enlargement of pragmatism itself and an assessment of Hadot’s Greco-Roman and Christian themes.

Wiele uwagi poświęca się dziś negatywnym zjawiskom, które towarzyszą offshoringowi. Wskazuje się na presję cenową wobec dostawców i nieuczciwe praktyki wielkich odbiorców. Poszukuje się sposobów zmniejszania tych zjawisk, jako że prowadzą one oczywiście do nieefektywnego rynku. Wpierw jednak trzeba odpowiednio opisać i przeanalizować procesy dominacji w łańcuchach dostaw. Dobrym rozwiązaniem wydaje się zastosowanie rozumowania abdukcyjnego. Powodzenie takiego podejścia każe zwrócić większą uwagę na przydatność abdukcji.
Nowadays much attention is paid to the negative phenomena, which are referred to offshoring. The price pressure on suppliers and unfair practices of large consumers are pointed. The methods for reduce these phenomena are searching because of the fact that they really lead to an inefficient market. However in the first place the processes of domination in the supply chains should be described and analysed. The abductional approach seems to be a good solution. The success of this approach makes the usefulness of abduction more distinct and leads to pay more attention to the phenomenon.

The international child abduction is regulated in the Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction, in the Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000 (Brussels II bis), and in the domestic law - in the Code of Civil Procedure. In the recent years the Regulation Brussels II bis was subject to review. As a result drawbacks were indicated and amendments have been proposed, in particular with a view of simplifying the procedures. The changes were triggered by the increasing number of cases in which one of the parents removes the child without a consent from the other. The Ministry of Justice does not provide any data on the amount of cases taking place in Poland. It is nevertheless certain that this amount has increased in comparison to previous years. Moreover, it is acknowledged that contrary to the Hague Convention and the EU Regulation, many children abducted by their parents are retained in Poland. The amendments to the Code of Civil Procedure seem to address this situation and streamline the process of the return of the children. The question remains: do the proposed amendments to the EU Regulation and those already enacted in the Code of Civil Procedure warrant to a sufficient degree that the welfare of a child - being one of the determinants of these regulations - is safeguarded?

Reasoning is a significant feature of humans and it might be one of the main reasons for their evolutionary success. Reasoning is a broad concept and can be divided into types (according to a classification system). Logical classifications propose to distinguish inductive, deductive and abductive reasoning.I try to investigate at which point of human evolution particular types of reasoning arose and why. The study presents deliberation on changes in human lifestyle and their impact on reasoning. It also presents possible hominid activities, which evidence usage of different types of reasoning at different stages of human evolution. Early stages (passive scavengers) suggest no need for creative reasoning. It seems induction was sufficient for hominids to perform their activities. However, some strategies of food foraging applied by hunter-gatherers suggest the usage of abductive reasoning. Social interactions need transitive reasoning to occur and this is an indication of deductive reasoning. I put forward a hypothesis that abduction is necessary to create beliefs, so the ability to abduct arose when humans started to consider afterlife at the latest. I also suggest that abductive reasoning is one of the newest achievements in human evolution.

This experiment was designed to know the effect of upper limb postural deviations on grip strength and grip endurance time. A full factorial design of experiment, i.e., 3 (0°, 45°, 90° abduction angles of upper arm) ´ 3 (45°, 90°, 135° angles of elbow flexion) ´ 3 (0°, –60° prone, +60° supine angles of forearm rotation) was used to find the effect of 27 combinations of postures on maximum voluntary contraction (MVC) grip strength and grip endurance time. The results showed that none of the main factors were significant on MVC grip, although there was a change in MVC grip. Grip endurance time significantly decreased with an increase in upper arm abduction. Also, grip endurance significantly increased with the elbow flexion angle and decreased with forearm rotation from neutral. These data will help designers and engineers to improve the workplace and tools to reduce the risk of injuries.

The paper seeks to explore the concept of the secondary world as developed in Susanna Clarke’s 2020 fantasy novel Piranesi. The analysis is conducted in the context of the evolution of the literary motif of fairy abduction between the classic medieval texts and its current incarnations in modern speculative fiction. The argument relates the unique secondary world model found in Clarke’s novel to the extensive intertextual relationship Piranesi has with the tradition of portal fantasy narratives, and discusses it in the context of the progressive cognitive internalisation of the perception of the fantastic which has taken place between the traditional medieval paradigm and contemporary fantasy fiction.
