Wprowadzone w latach 2019–2020 modyfikacje zasad odbywania zgromadzeń w spółkach kapitałowych, pomimo ich zasadniczo pozytywnej oceny, generują nowe problemy prawne. Jeden z nich dotyczy możliwości odbywania „w pełni zdalnych” zgromadzeń (tj. takich, w których każdy z uczestników bierze udział przy wykorzystaniu środków komunikacji elektronicznej). Przedmiotem artykułu jest analiza dopuszczalności przeprowadzania takich zgromadzeń w spółkach kapitałowych oraz próba odpowiedzi na kluczowe problemy praktyczne związane z omawianym zagadnieniem.
The modifications introduced in 2019–2020 with respect to the rules concerning general meetings in capital companies, in spite of their generally positive assessment, generate a number of new legal problems. One of them concerns the question of holding “fully remote” general meetings (i.e. the ones in which each participant takes part using electronic means of communication). The subject of this article is an analysis of admissibility of holding such general meetings, as well as an attempt to answer the key practical problems related to the discussed issue.

This article aims to show the vocation of the Priests of the Sacred Heart in the ecclesial context. In the light of reflection of Vatican Council II each and individual religious vocation, as well as all the religious life, is firmly inscribed in the life of the Church itself. In this context the vocation and the mission of the Congregation of the Sacred Heart shall be placed as well. At first, the figure of the Founder of the Congregation, of father Leo Dehon, is presented as of a man who in his vocation was fully loyal and committed to the Church. Then the ecclesial nature of the SCJ vocation is discussed on the base of the current Constitutions of the Congregation; and finally, the mission of Polish Priests of the Sacred Heart in the local and universal Church is presented. Outlined issues help us to state that the Congregation of the Sacred Heart, which was established primarily to address the needs of the Church of Fr Dehon’s times, even today, as it is clearly seen on the example of the Polish Province of the Congregation, through its own charism and ministry partakes in the Church’s evangelizing mission of our time. The Priests of the Sacred Heart are present in a wide circle of the Church’s mission, both in distant countries, as the mission ad gentes and in the areas of the new evangelization which embraces the countries of Eastern and Western Europe as well. Wherever the Congregation is present, it carries out its mission in a close cooperation and under the pastoral custody of the Shepherds of the local Churches. Also today, as it was in the time of the Founder, the Congregation enters into those areas of human life, which the most demand support and evangelization. In this way, it is naturally complementing the pastoral ministry of the diocesan churches.

Opis:
Mission Seminary of the Sacred Heart Fathers in Stadniki was established in 1964. One of the major difficulties, which the Seminary struggled with from the beginning, was inadequate staff of SCJ’s professors. Beside inner difficulties in the communist period of PRL in the life of Seminary appeared also same external problems, e.g. appointment to the army from different levels of seminarians. One of the most important events in the 50-years history of Mission Seminary was to sign an agreement on scientific cooperation with the Pontifical Faculty of Theology in Cracow in 1980 (actually the Pontifical University of John Paul II). In this way, the Sacred Hear students were given the great opportunity to complete their studies with the title of Master of Theology. The dynamic development of the SCJ Seminary connects to the significant increase in the number of students in the 80's. The large group of polish students joined the students from abroad mostly from the Eastern Europe. At that time, the students undertake an amazing variety of practice in the pastoral field. After the political changes in 1989 the involvement of the students on this field even more extended. Along with the new possibilities of travelling abroad and deepening of international cooperation with other provinces, the students were given the new opportunity to participate in foreign language courses in Ireland, France and Germany. Furthermore, it should mark that the development of the Seminary was made possible through the efforts and the work of the Management Boards, as well as professors, employees and lay people who financially supported the special work of education.

Celem artykułu jest zaprezentowanie sposobów konstruowania kobiecości przez siostry zakonne na podstawie analizy wywiadów biograficznych przeprowadzonych z mieszkankami jednego ze zgromadzeń zakonnych w Polsce. Zakonnice przyjmują styl życia zakładający między innymi wyłączenie z ról matki i żony - tradycyjnie postrzeganych jako centralne role kobiece. Dokonują one wyboru alternatywnej dla małżeństwa i macierzyństwa drogi życia, opartej na służbie Bogu. Za sprawą przyjmowanej roli są one wyłączane z kobiecości tradycyjnej, funkcjonując w szczelinie pomiędzy kobiecością a męskością. W nowym środowisku życia którym jest zakon, siostry nie podejmują próby wytworzenia alternatywnego modelu kobiecości. Korzystają natomiast z kategorii kobiecości tradycyjnej, dopasowuj ąc j ą do rzeczywistości monastycznej za pomocą retoryki opartej na idei ofiary. Poglądy badanych na kobiecość są zgodne z proponowaną przez Kościół rzymskokatolicki rolą kobiety w społeczeństwie.

The right to assembly is recognized as one of the key human rights. It is essential for the functioning of the community, it is also the foundation of the democratic state. The legal regulations of the law of assembly in Poland have a tradition dating back to the mid-nineteenth century, but this right was regulated by 1990. The authentic freedom in this respect can be discussed only in the period of the Third Polish Republic, although this freedom has never meant freedom and has always been subject to limitation. The standards, which have been improved for decades, have been broken by the 2015 act, while in 2017 the Polish legislator introduced a number of solutions that made the law inconsistent and problematic in application. This article is aimed at tracing the evolution of statutory regulations from 1918–2015 and evaluating new solutions, especially those introduced in 2017, against it.
Prawo do zgromadzeń jest uznawane za jedno z kluczowych praw człowieka. Ma ono istotne znaczenie dla funkcjonowania społeczności, jest też fundamentem państwa demokratycznego. Prawne regulacje prawa zgromadzeń w Polsce mają tradycję sięgającą połowy XIX w., przy czym prawo to było do 1990 r. reglamentowane. O autentycznej wolności w tym zakresie można mówić dopiero w okresie III Rzeczypospolitej, choć wolność ta nigdy nie oznaczała dowolności i zawsze podlegała limitacji. Doskonalone przez dziesięciolecia standardy w tym zakresie zostały przełamane ustawą z 2015 r., natomiast w 2017 r. polski ustawodawca wprowadził szereg rozwiązań, które uczyniły ustawę prawo o zgromadzeniach niespójną i problematyczną w stosowaniu. Niniejszy artykuł ma na celu prześledzenie ewolucji regulacji ustawowych z lat 1918–2015 i dokonanie na jej tle oceny nowych rozwiązań, zwłaszcza tych wprowadzonych w 2017 r.
