Construction industry is one of the branches of industry with the greatest accident hazard, and this is confirmed by the statistics of the State Labour Inspection (PIP) and the Statistical Office (GUS). The number of accidents in construction industry grows from year to year. Considering the accident figures in the construction industry, changes have to be introduced in the work safety management system immediately using modern ways. The work safety management system developed by EkoLan, a developer operating in the Tricity of Gdansk, Sopot and Gdynia, is an interesting solution. At EkoLan, an original work safety management system has been implemented for many years at construction sites managed by that company. The article presents and discusses both the principles of operation of the system and the results from two summers of research on the systems in practical conditions.
W artykule przedstawiono nowatorski sposób zarządzania bezpieczeństwem pracy opracowany i wdrożony przez trójmiejskie przedsiębiorstwo deweloperskie Ekolan. Prezentowany model zarządzania został wdrożony na budowach prowadzonych przez firmę Ekolan na terenie Trójmiasta. Model jest oparty na założeniach PN-N-18001 z tą różnicą, że jest on mniej sformalizowany. Jego założenia są oparte w głównej mierze na spełnianiu wymagań prawnych i identyfikowaniu zagrożeń u źródła oraz szybkim reagowaniu na zidentyfikowane zagrożenia i ich eliminacji lub ograniczeniu. Rdzeniem systemu jest interaktywna lista zagrożeń, z której wykorzystaniem prowadzi się audyty na budowie oraz dokonuje się kwalifikacji zagrożeń.

The article aims to show selected issues related to safety management system with particular reference to its legal aspects. It is composed of seven parts. The first one outlines the general overview on the problem of aviation safety. In the following passage, substance of safety management in civil aviation is presented. Third part describes key factors determining safety in aviation. In the fourth subtitle, selected issues regarding international regulations concerning safety management systems are discussed with reference to Chicago Convention and Annex 19 which established detailed arrangements for safety management. Subsequently, the author describes the EU legislation related to subject matter as well as major institution in charge of ensuring safety like European Aviation Safety Agency. The las but one subtitle refers to some legal aspects of safety management in civil aviation in Polish law. The summary contains conclusions drawn from the analysis of the both international and polish regulations.Purpose - The paper’s main purpose is to present legal framework of aviation safety management at the level of international, European and polish law. The author also investigates the role of legal regulations in the process of keeping aviation safe with reference to other factors which have a negative influence on aviation safety. Design/Methodology/Approach - A comprehensive analysis of legislation was conducted along with literature review including international publications focused both on the area of management and law. The reference list was selected in such way to show an objective and impartial approach to the subject matter.Findings - The laws regarding safety management in aviation are subject to harmonization but we can observe that the regulations are becoming more and more technical and complex.Research limitations/implications - The limitations of this paper lie in the lack of review of the studies of practical part of the safety management system regulations.Practical implications-The review shows a profound review of legislation which may be used by both managers and lawyer from aviation industry. Moreover, some statistical data is provided in order to emphasize the importance of safety management in the current world.Originality/Value-The article presents analysis carried at three levels of legal regulations, i.e. international, European and local (Polish) which is the best way to show similarities and point out differences.

The article aims to support the Safety Management System's implementation in the Visegrad Four (V4) countries by introducing supporting documentation at the national level or national legislation. The research subjects are the V4 countries (Poland, Hungary, the Czech Republic, Slovakia), where 39 air carriers operate. Safety management in today's world is already necessary, yet introducing a Safety Management System (SMS) is voluntary in many areas, including some transport modes. In air transport, it is mandatory, and the general principles and guidelines of this system are set out in the International Civil Aviation Organization (ICAO), which has issued several regulations and recommendations. The lists of ICAO standards and essential translations can be considered a minimum, which is also approached by different authorities. The article points out the primary differences in SMS in individual V4 countries and presents which country provides the strongest support in implementing this system.

As air traffic is continously growing and the number of potential hazards for safety is also rising, improvement of management systems is required to ensure an adequate level of safety. The management of change constitutes an important part of the safety management system (SMS) defined in Annex 19 to the Convention on International Civil Aviation. It is one of twelve elements of SMS found in the ‘Safety assurance’ component. The management of change put in place in an aviation organisation demonstrates the considerable development of an SMS. This process is essential for managing safety in an efficient way. The article reports on the state of implementation of the management of change in selected civil aviation organisations and also points out the difficulties related with carrying it out in everyday life. The paper focuses on managing changes of certified aerodromes and air navigation service providers. In the conclusions, tools are proposed that enable the reader to improve the process.

The priority of the maritime transport operation is a high level of security, which must be constantly monitored by shipowners with a security management system. The origin of the International Code for the Management of Safe Ship Operations and Pollution Prevention and the revised guidelines for the administration of the ISM Code by administrations, the first formal mandatory standard for safety management and pollution prevention goes back to the early 1980s. Arrangement of safe ship management and operation and consequent minimization of errors human being by far the most common cause of marine disasters is its main. The shipowner's and ship's certification procedure for the Safety Management System (SMS) is in line with Regulation (EC) No 336/2006 [1] of the European Parliament and the Council of Europe of 15 February 2006 on the implementation of the ISM Code in the Community, together with the Commission's amendment European Union of June 16, 2008. The documentation contains a developed Safety Management System adapted to the conditions of a given shipowner. All elements of the system must be documented, and, above all, the duties must be described in the organizational structures. Documentation must indicate how management supervises activities at various levels, employee participation and individual management representatives in individual processes, and how the safety management system is constantly improved. The shipowner maintains a security management system in line with the requirements of the Code and complies with the requirements of the certification system. The amount of information and the speed of changes taking place in the environment makes it necessary to introduce a system of information management and channels of their flow not only within the organization, but also in communication with third parties. Proper management of information resources increases the efficiency and effectiveness of the system. In the publication, the possibility of a formalized description of information flow in a well-functioning shipowner's safety management system.

This study assesses the operational safety and security of a category one airport in Nigeria, using the Nnamdi Azikiwe International Airport, Abuja (NAIA) as the case study airport. Data were sourced using structured questionnaire and oral interviews. A total of 180 questionnaires were administered and 165 questionnaires were retrieved, amounting to a 91.7% rate of response. The structured questionnaire used aimed at identifying various safety and security parameters in the study area. This study examined the trend of the effectiveness of safety and security variable in airport operations, safety and employee’s attitude towards safety risk management using the Multicriteria Decision Analysis model to achieve this objective. The results show the weighty level, satisfaction index and effective index of the safety and security parameters used in the analysis with their score and effective index graph. Recommendation on how to improve the airport safety operations were made following policy implication on how to improve the safety management system of the airport.

Analyzing the level of Polish transport safety culture can be seen that it is now dependent on the culture of safety management within the organization and the requirements and recommendations of law in this field for different modes of transport (air, rail, road, water). Of the four basic types of transport requirements are widely developed in the aviation, rail, and water – the sea. In order to harmonize the requirements for transport safety so it appears advisable to develop a platform for exchange of safety information for different modes of transport, and the development of good practices multimodal offering the possibility of improving Polish transport safety. Described in the publication of the proposal in addition to the alignment platform experience and knowledge in the field of transport safety in all its kinds, it can also be a tool for perfecting new operators of public transport.
Analizując poziom kultury bezpieczeństwa transportu Polski, można zauważyć, że jest on obecnie zależny od kultury zarządzania bezpieczeństwem w organizacji oraz od wymagań i zaleceń prawa w tym zakresie. Z czterech podstawowych rodzajów transportu (lotniczy, kolejowy, drogowy, wodny) wymagania te są szeroko rozwinięte w transporcie lotniczym, kolejowym i wodnym – morskim. W celu ujednolicenia wymagań bezpieczeństwa transportu zasadne wydaje się więc opracowanie platformy umożliwiającej wymianę informacji w zakresie bezpieczeństwa dla różnych gałęzi transportu oraz opracowanie multimodalnego systemu dobrych praktyk dających możliwość poprawy bezpieczeństwa transportu Polski. Opisana w artykule propozycja platformy, oprócz wyrównania doświadczeń i wiedzy w zakresie bezpieczeństwa transportu we wszystkich jego rodzajach, może być również narzędziem doskonalenia nowych operatorów transportu zbiorowego.

This paper addresses the importance of the development of maritime safety culture, in terms of sustainable shipping through continuous improvement of the safety management system (SMS) that enables a shipping company’s personnel to effectively implement the company’s safety and environmental policy. The main aim of the International Management Code for the Safe Operation of Ships and for Pollution Prevention (International Safety Management Code – ISM Code), which was adopted by the International Maritime Organization (IMO) and became mandatory, by virtue of its entry into force on the 1st of July 1998, in SOLAS Chapter IX on the Management for Safe Operation of Ships, is to provide an international standard for the safe management and operation of ships as well as pollution prevention. Thus, compliance with the ISM Code and its effective enforcement is necessary to ensure adequate standards of safety and pollution prevention. The purpose of this paper is to show that the internationally unified legal measures that have been developed under the IMO in the ISM Code are an instrumental consequence of maritime safety values, and allow them to be achieved in practice. The result of this research is the justification of the thesis concerning the need to create a safety culture as a condition for sustainable shipping, including the safe operation of ships in the environment.

All seafarers I have met are concerned with their own safety and all serious shipping companies, national regulatory authorities, unions and larger shipping clients work to improve safety at sea. Formalised risk management systems are at the heart of these efforts, and there is good reason to believe that they have been very successful. One would therefore expect that seafarers had a positive attitude and were committed to their implementation. Empirical data suggests the opposite. During observational fieldworks over the last two and a half years, on eight different ships in Norway, Australia and Malaysia, not one of the observed seafarers expressed mainly positive opinions about the safety management systems imposed on them. The great majority of seafarers whose opinions have been recorded expressed massive negative sentiments. Assuming a Weberian perspective this paper explores how the bureaucratic implementation of such risk management systems may contribute to this picture.
