Bearing in mind that there exists no universally accepted definition of the rule of law, this paper sets out to identify its commonly agreed core, and to expand it by adding substantive elements. While the core is not controversial, the second part of the rule of law framework, comprising social welfare rights, essentially aims to revisit classical accounts of the rule of law. The analysis involves the frequently ignored social dimension of the rule of law, defending the necessity of its translation into a substantive element of the definition. Some general arguments are offered explaining why social rights protection should be included in the definition of the rule of law.

Regardless of the times in which we live, the notion of truth blends with the notion of untruth, wisdom with stupidity, faith with unbelief, justice with injustice, and lawlessness with unrighteousness. Human attitudes appear to be permanent, although there are a number of instruments with which to change them. Because of mass media, law has entered every person's life. Good law can be corrupted and bad law can be repaired; the point is to be properly prepared for it and to take on such a challenge when required by a justified situation. Principles of the law, the less comprehensive and more understandable for the citizen, the better accepted by the society. The fewer ridiculous, stupid and nondescript verdicts, the closer the law to the judge and judge. Regulations, orders and prohibitions cannot be divorced from reality, they must keep up with the flow of time. Otherwise, law becomes lawlessness, justice becomes injustice, and the rule of law disappears. The quality of values will be whatever the demand is.

The rule of law of the state is beginning to be of particular and increasing importance in the current political situation. This requires a revision of views on the standards and expectations that one can have towards the law-abiding state and its apparatus. The scope of the issue thus determined requires reference to the constitutional concept of a democratic state governed by the rule of law and its role in determining imperatives in the activities of the state and its organs. It also raises the need to address the issue – is it sufficient for the existence of the rule of law in a state to only respect the supreme legal force of constitutional norms?

The paper starts with a review of literature focusing on links between democracy and environmental protection, pointing out a fair weight of scientific evidence that democratic societies on average enjoy a higher level of environmental quality than autocracies. It subsequently provides a quick insight into the recent trends in the state of democracy and the rule of law in Poland as well as a few examples of measures taken concerning environmental policy that have been undertaken after 2015. The paper concludes by expressing concern about certain negative patterns in the Polish environmental policy in the past few years, which seem to be connected to the deficiencies in the rule of law and democracy as observed in Poland. The shrinking space for civil society to participate in democratic governance concerning environmental issues and the excessive appetite of the current government for large infrastructural investments seem to be in contradiction with the European and global strive for sustainable development and tackling climate change. It remains to be seen if the recent negative trends in the Polish environmental policy will have a structural impact on the state of environment in Poland.

Promoting the rule of the law is a national responsibility. The obligation to ensure legality and advance human rights rests on the national government. This article analyzes how federalism, a system of distributing power among subnational entities, can promote this national goal. The article explores how states in the United States have played an important role in encouraging the federal government to enforce the law and safeguard rights. By means of resistance, cooperation, and redundancy, states have moved the United States closer to rule-of-law ideals. The state action sometimes takes the form of litigation, with states bringing suit against the federal government. Such suits have particular significance in challenging illegal inaction by the national government, as when the federal government fails to enforce environmental laws. Litigation by states may overcome standing barriers that would limit such suits by private individuals. States may also engage in direct action by pursuing their own policies that promote the rule of law. In these areas, the states may oppose the federal government, cooperate with the federal government, or act in an independent, parallel manner. What unites all of these modes and instruments of state-federal interaction is that the goal of states is to influence national policy. The state action may begin within the boundaries of a particular state, but what motivates the state initiative is a vision applicable to the nation as a whole. The ultimate aim of state action is not local divergence, but national uniformity. Federalism serves not as a license for local deviation from national norms, but instead as a means for states to engage actively in creating policy at a national level. In this way, independent state activity can indeed promote the national obligation to promote the rule of law throughout the country.

Although the rule of law is a normative notion, it requires a multidimensional approach. It speaks to important issues of law and politics, and its respect is essential for both legal and social security. It can be observed within the European Union (EU) where the issue of respect for the rule of law by its Member States has gained particular importance. The main goal of our study is to contribute to the academic discourse concerning the EU rule of law. The analysis particularly considers the approaches adopted by the EU institutions to the definition of this concept. Consequently, the first part of the article concentrates on difficulties in defining the rule of law. The second part presents the evolution of the Court of Justice approach toward this concept. The next part contains the analysis of the attitudes presented by other EU institutions in their documents. In the conclusions, it is underlined that although the approaches of the EU institutions towards the rule of have evolved, and they have tried to define it and indicate its main components, certain issues require clarification, e.g., the relations of the rule of law with other values.

The author analyzes and compares various meanings of the concept of equity such as they were conceived by prominent personalities of the history of the juridical, ethical and philosophical ideas in order to deduct their common contents. Having ethical and juridical connotations, the vision on equity and on applying its principles into the law-making process, into achieved the act of justice and in all kind of public authorities decision-taking process are differently designed at micro-groups level compared to the macro-social layer. The practical achievement of equity and justice is the privilege of the just person. The rightful person’s personality in the contemporary democratic societies may be considered as an ideal prototype which should be found in a larger extent, in the effective functioning of the institutions under the rule of law – at the level of human resources, with as much possible appropriate compliance with this prototype.

The article examines the key aspects of a debate on the concept of the state and the relationship between freedom and the rule of law in economic studies. On the basis of selected research reports, the authors discuss the results of studies on the influence of economic freedom and the rule of law on prosperity. The paper reviews the most common definitions of economic freedom and the rule of law and methods for measuring them. It follows up with a description of the results of studies on how economic freedom and the rule of law influence economic growth. The analysis made in the paper shows that economic freedom and the rule of law are indispensable for sustained economic growth. They have a major positive influence on the rate of growth. Economic freedom promotes innovation in business and prosperity. However, the government tends to limit economic freedom and forces businesses to behave in a specific way to benefit the economy and the public. This works when the government acts in keeping with the rule of law, the authors say. The rule of law promotes business efficiency and leads to lower transaction costs, which results in faster economic growth, the authors conclude.

The aim of the article is to define a rule of law for a proper functioning of the state, especially in the context of the provision of legal freedoms and guarantees to constitutional units. The determination of the was presented consequences of a breach of the rule of law which governs the complex acquis. The study will consist of attempts to define the rule of law, starting from the scope of this rule, on the basis of a doctrinal interpretation. The specificity of the functioning of the European Union system requires to consider in this context the relationship between national and EU law on the regulation of the rule of law at the Community level. For the topic addressed, it is equally important to refer to the mechanisms provided by EU law to enforce Member States to respect common principles and values. The method used to implement the previously articulated objectives legal text interpretation.

The article proves that law is an effective means of regulation only in the rule of law. The rule of law underpins the work of the United Nations and other international organizations, as well as the political institutions of modern developed nations. It is shown that the concept of “rule of law” is lexically close to one of the basic elements of the positivist doctrine of law in the form of the concept of “rule of law”, which led to the identification of these concepts. It is substantiated that the Ukrainian vision of the rule of law is not limited to legislation as one of its forms, but also includes other social regulators, including morals, traditions, customs, etc., which are legitimized by society and conditioned with historically achieved cultural level. It is confirmed that justice is one of the basic principles of the law, decisive in defining it as a regulator of social relations, one of the universal dimensions of the law. It is proved that justice is considered as a property of the law, expressed, in particular, in the equal legal scale of behavior and in the proportionality of legal responsibility for the offense. In the field of the law enforcement, justice is manifested, in particular, in the equality of all before the law, the conformity of crime and punishment, the goals of the legislator and the means chosen to achieve them. In the article, that right, comes forward as effective means of adjusting only in the conditions of supremacy of thelaw. Principle of supremacy of right is the basis of activity of United Nations and other international organizations, and also political institutes of the modern developed states. It has been shown that a pan-European understanding of the concepts studied takes into account the main aspects of the concept of “rule of law”: all persons, whether public or private, must be bound by law and have the right to enjoy it. It is shown that modern society has developed an effective mechanism for ensuring the rule of law, which includes: the existence of the basic law of the country – the Constitution or its equivalent; clear and consistent system of legislation; institutions of justice, administration and security, which have the means and capabilities to ensure the application of legislation; legal culture. In the absence of equal law for all, the progressive development of society is impossible. Where there are groups above the law, as well as the practice of selective application of the law, incentives for development disappear. It is substantiated that the rule of law should be identified and implemented at the stage of law enforcement and the first step towards this is to increase the role of law as the main and primary regulator of public relations.
У статті доведено, що право виступає ефективним засобом регулювання лише в умовах верховенства закону. Принцип верховенства права лежить в основі діяльності Організації Об’єднаних Націй та інших міжнародних організацій, а також політичних інститутів сучасних розвинених держав. Показано, що поняття «верховенство права» лексично є близьким до одного з базових елементів позитивістської доктрини права у вигляді поняття «верховенство закону», що призвело до ототожнення цих понять. Обґрунтовано, що українське бачення верховенства права не обмежується лише законодавством як однією з його форм, а включає й інші соціальні регулятори, зокрема норми моралі, традиції, звичаї тощо, які легітимовані суспільством і зумовлені історично досягнутим культурним рівнем суспільства. Підтверджено, що справедливість є однією з основних засад права, вирішальною у визначенні його як регулятора суспільних відносин, одним із загальнолюдських вимірів права. Доведено, що справедливість розглядають як властивість права, виражену, зокрема, в рівному юридичному масштабі поведінки й у пропорційності юридичної відповідальності вчиненому правопорушенню. У сфері реалізації права справедливість проявляється, зокрема, у рівності всіх перед законом, відповідності злочину й покарання, завданнях законодавця і засобах, що обираються для їх досягнення. Доведено, що загальноєвропейське розуміння досліджуваних понять враховує головні аспекти поняття «верховенство права»: всі особи, чи то публічні, чи то приватні, повинні бути пов’язані законами і мати право користуватися ними. Показано, що сучасне суспільство виробило дієвий механізм забезпечення верховенства права, який включає наявність основного закону країни – Конституції чи її еквіваленту; чітку і послідовну систему законодавства; інститути правосуддя, управління і безпеки, що мають засоби й можливості забезпечити застосування законодавства; правову культуру. За відсутності рівного для всіх закону поступальний розвиток суспільства не є можливий. Там, де існують групи, що перебувають вище за закон, а також практика вибіркового застосування права, стимули для розвитку зникають. Обґрунтовано, що верховенство закону має бути виявлено і реалізовано на стадії правозастосування і перший крок до цього – підвищити роль закону як основного і первинного регулятора суспільних відносин.

Spośród wielu niejasności dotyczących rządów prawa centralnymi są te, które zostały wskazane w tytule artykułu. Pierwsza część tekstu zawiera wstępne uwagi oraz próbę odpowiedzi na pierwsze z tytułowych pytań. Próba to jest oparta na rozróżnieniu dwóch sposobów rozumienia, czym są rządy prawa. Zgodnie z pierwszym z nich, rządy prawa są pojęciem celowościowym, tj. by wiedzieć, czym one są, trzeba znać ich cel. Drugi ze sposobów, określony jako anatomiczny, wskazuje, że najważniejszym dla zrozumienia omawianego pojęcia jest poznanie reguł i instytucji, które zazwyczaj postrzega się jako składowe rządów prawa. Autor stoi na stanowisku, że tylko pierwsza droga jest właściwa oraz proponuje własną interpretację celów rządów prawa. Celem tym jest prawne ograniczenie możliwości arbitralnego sprawowania władzy. To natomiast związane jest z czterema ważnymi redukcjami: dominacji, strachu, upokorzenia i niepewności.
Central among the many obscurities that attend the rule of law are those named in the title of the article. The first part contains some preliminary remarks and attempt to answer the first question. This attempt is based on distinguishing two ways of understanding what rule of law is. By the first way rule of law is a theological concept, i.e. to know what it is we have to know its aims and by the second, anatomical one, the most important thing to understand it are rules and institutions that are usually conceived as its part. The author holds a position that only the first way is appropriate and gives his own interpretation of aims of rule of law. This aim is legal reduction of the possibility of arbitrary exercise of power that is connected with four important reductions – of domination, of fear, of indignity, and of confusion.

The authors holds a position that only the first way is appropriate and gives his own interpretation of aims of rule of law. This aim is legal reduction of the possibility of arbitrary exercise of power that is connected with four important reductions – of domination, of fear, of indignity, and of confusion.

This paper shows that corruption constitutes a threat to the rule of law in a democratic law-observing state, destroying it from within and ridiculing it outside. It destabilises social relations in such a state, which adversely affects the political system as well as the development of legislation and economy. The paper also reminds that corruption erodes social relations, causing demoralisation and slackening of morals in society. Corruption may also be a threat to the life, health and property of citizens. The author tracks views about corruption using the method of theoretical analysis of the notions (critical analysis of secondary sources); the statistical method, mainly analysing the latest Corruption Perceptions Index (2019); and the dogmatic-legal method. He concludes that corruption destabilises multiple areas of the functioning of a democratic law-observing state, disrupting the political space, spoiling the law, and causing destructive phenomena in the economic as well as in the moral sphere. It ultimately destabilises state structures, rendering them dysfunctional and perverting the principles of democracy. Corruption interacts with legality acting as a feedback loop, as it destroys the rule of law and democracy, which in turn deepens corruptive phenomena.

One of the manifestations of the systemic crisis in Poland is progressive centralization in the management of local affairs. The causes of the phenomenon under analysis can be justifiably traced to three factors that are complementary to each other. First, in a constitutional model of the local government which assumes that the legislator has a decisive influence on the scope of tasks entrusted to local government units as well as on the degree of independence of their execution. A consequence of a crisis around the agencies of the third estate is also the weakening of the efficiency of judicial measures of protection of that independence. Secondly, a considerable influence upon the phenomenon under analysis is exerted by the strategy for fighting the pandemic adopted by the public authorities based upon the construction of a ‘hybrid’ state of emergency where the dominant role is played by the central public authorities. The aim of the article is to outline the relationship between the rule of law and civic engagement in the public sphere and to attempt to answer the question whether the rule of law can be an effective tool in preventing the transformation of democracy in a tyranny of the majority; whether it can also create optimal conditions for democracy to develop. In other words, does the rule of law serve democracy and political engagement or does it rather limit the spontaneity of civic activity because stability cannot be reconciled with the freedom of citizens? The current “juridification” of the public domain (the expansion of law into various areas of social existence) marginalises the validity and scope of civic presence in the decision-making process in the name of law-abidingness and the neutrality of instruments of control and of choices made by the ruling power. Can the effective solution to this situation be the opening of the concept of the rule of law to the idea of political nature and the expansion of the domain of grassroots participation?
