    Opis:
    The article discusses problems of enforceability of regulatory decisions issued by the Polish regulatory authority – the President of the Office of Electronic Communications (UKE) in the context of the protection of the rights of electronic undertakings. The author refers to the standards for implementing decisions and provisional protection developed in the law of the Council of Europe and Community legislation, including Framework Directive 2002/21/EC. He also analyses Polish legal regulations which introduce European solutions, including regulations implementing Community framework for electronic communications, into the national legal order. Special attention is devoted to the competence of Polish administrative courts and the Court of Competition and Consumer Protection in suspending the enforcement of contested regulatory decisions. The author also points to significant gaps in existing national regulations and postulates the introduction of necessary legislative changes to better protect the rights of telecommunications undertakings.

    Opis:
    The energy sector is a strategic industry of each state. Energy industry is one of the most important regulated fields at the EU level and a crucial direction of cooperation between the EU and Ukraine. EU legislation, primarily directives and regulations from the Third Energy Package, prescribe requirements in respect of the legal status of national regulatory authorities in the fields of energy and natural gas. Ukraine, as a full-fledged member of the Energy Community, as well as in line with the EU‒Ukraine Association Agreement, shall institute laws and regulations necessary for the implementation of those requirements. In particular, EU legislation stipulates requirements with regard to the independence of national regulatory authorities from other state authorities during the exercise of their regulatory powers. In recent years, Ukrainian public authorities have undertaken steps to develop and approve a legal framework in order to implement the requirements of EU energy legislation, in particular those related to the legal status of national regulatory authorities. The approval of the Law of Ukraine on the National Energy and Communal Services Regulatory Commission in 2016 was one of the critical achievements in this direction. However, the new Law has not solved the problem of the constitutional legal status of the energy regulator. The Constitution of Ukraine’s provisions specifying the powers of the President of Ukraine and the Verkhovna Rada of Ukraine as against permanent independent regulatory authorities (e.g., pertaining to the establishment, appointment and dismissal of members, accountability) shall be amended in order to bolster the principle of independence of national regulatory authorities in the energy sector as prescribed by EU legislation.

    The European Commission (EC) and the European Courts have being reaffirming in the Deutsche Telekom and Telefónica cases that guide-prices established by sector regulators upon electronic communications incumbents cannot per se exclude that conducts with anticompetitive foreclosure effects, such as margin squeeze undertaken within the boundaries of those pre-established prices, can be considered abusive under Article 102 TFEU. The paper aims to show that the reasoning put forward by the EC and Courts not only dismantles the defensive reasoning put forward by the incumbents before the EC and on appeal before the Courts but actually reaffirms the centrality of the enforcement activity of the EC. The paper examines the reasoning behind the “regulatory authority’s instructions defence” – the argument of the incumbents stating that their actions were justified because they had set their wholesale access prices and retail prices in line with the guidelines imposed by the sectorial regulators. Recalled in this context were also the principles of proportionality, subsidiarity and fair cooperation between the EC and individual Member States. The affirmation of the “heliocentric” doctrine that puts the EC at the hearth of competition law enforcement vis á vis national regulators and domestic legislation (provided decisions of the regulatory authorities can be considered secondary law sources) should take into consideration the important precedent of Consorzio Industrie Fiammiferi. The latter affirms that competition authorities can automatically put aside legislation that goes against Article 101 TFEU. However, they cannot impose pecuniary fines when certain behaviours are imposed by national legislation (while they can impose fines if those behaviours were suggested or facilitated by national legislation).
    La Commission européenne (CE) et les juridictions européennes ont réaffiré dans les cas de Deutsche Telekom et Telefonica que les prix-guides établis par les organismes de réglementation du secteur sur les titulaires de la communication électronique ne peuvent pas en soi exclure ces pratiques avec des effets d’éviction anticoncurrentielle, tels que la compression des marges réalisée dans le limites de ces prix pré-établi. Les prix-guides peuvent être considérés comme abusifs vertu de l’article 102 du TFUE. L’article vise à montrer que le raisonnement présenté par la CE et les juridictions européennes ne démonte que le raisonnement défensif avancé par les titulaires auprès de la CE et en procédure d’appel devant les tribunaux, mais réaffirme en fait la centralité de l’activité de l’application accomplie par la CE. L’article examine le raisonnement derrière « la défence des instructions de l’autorité réglementaire» – l’argument des titulaires affirmant que leurs actions étaient justifiées parce qu’ils avaient mis leurs prix d’accès de gros et les prix de détail en ligne avec les directives imposées par les régulateurs sectoriels. Les principes de proportionnalité, de subsidiarité et de coopération équitable entre la CE et les États membres sont également rappelés dans ce contexte. L’affirmation de la doctrine «héliocentrique» qui place la CE dans le foyer de l’application des lois de la concurrence vis-à-vis des régulateurs nationaux et la législation nationale (à condition que les décisions des autorités réglementaires peuvent être considérées comme des sources secondaires du droit ) devrait prendre en considération le précédent important du cas Consorzio Industrie Fiammiferi. Ce jugement affirme que les autorités de la concurrence peuvent automatiquement ettre à côté une loi qui va à l’encontre de l’article 101 TFUE. Toutefois, ils ne peuvent pas imposer des amendes pécuniaires lorsque certains comportements sont imposés par la législation nationale (alors qu’ils peuvent infliger des amendes si ces comportements ont été suggérés ou facilités par la législation nationale).

    Przemiany własnościowe i strukturalne w sektorach infrastrukturalnych polskiej gospodarki ostatniego trzydziestolecia, przy motywowanym interesem publicznym (art. 22 Konstytucji) i zasadą społecznej gospodarki rynkowej (art. 20) oddziaływaniu państwa na te sektory, uzasadniają potrzebę refleksji prawno-konstytucyjnej nad statusem działań organów regulacyjnych w tych sektorach. Akcesja do Unii Europejskiej ulokowała te działania na szlaku przedsięwzięć integracyjnych Unii, nakierowanych na „horyzontalną” integrację sektorów infrastrukturalnych państw członkowskich. Najczęściej stosowanym narzędziem prawnym wdrażania unijnych inicjatyw integracyjnych są sektorowe dyrektywy Parlamentu Europejskiego i Rady Unii. Polskie organy regulacyjne, z atrybutami ich niezależności, profesjonalizmu i merytoryki działania, znalazły się w polu, gdzie krzyżują się dwa nurty oddziaływań: ku unijnej integracji sektorowej oraz wiodącego od Rady Ministrów RP i właściwych ministrów nurtu polityki krajowej wobec sektorów infrastrukturalnych. Autor, identyfikując elementy tego usytuowania, wskazuje na konstytucyjno-prawne niejasności (wręcz: dylematy) w odniesieniu do relacji: Rada Ministrów (i jej Prezes)/ministrowie – organy regulacyjne.
    Ownership and structural changes in the infrastructural sectors of the Polish economy in the last three decades, while maintaining the public interest (art. 22 of the Constitution) and the implementation of the “social” market economy principle (art. 20) of the state’s influence on these sectors, justify the need for a legal and constitutional reflection on the status of activities of regulatory bodies in these sectors. The accession to the European Union has placed said activities on the path of the Union’s integration policies, aimed at “horizontal” integration of the infra-structural sectors of the EU member states. A typical and most commonly used legal tool for implementing EU integration undertakings are sectoral directives of the European Parliament and the Council. The Polish regulatory authorities with their postulated attributes of independence, professionalism and objectivity, have found themselves in the field where two routes of the addressed impacts cross: the EU sectoral integration route and the route of implementation of national policy toward infrastructure sectors (steaming from the Polish Council of Ministers and from relevant ministries). The author, identifying the elements of such use, points out the constitutional and legal uncertainties (even: dilemmas) in regard to the relationship between the Council of Ministers (and the Prime Minister)/relevant ministries and the state sectoral regulatory bodies.

    The goal of the paper is to present the material jurisdiction of the Court of Competition and Consumer Protection in light of the constitutional principle of entity equality. The regulations of Art. 32 of the Constitution of the Republic of Poland include the principle of equality, which also covers entrepreneurs. In Poland, in addition to administrative courts that control the legality of administrative decisions, there is also the Court of Competition and Consumer Protection, which hears cases concerning administrative decisions from a material perspective. The analysis of the regulations indicates that the jurisdiction of this court has been determined without justification. The paper proves the thesis that the material jurisdiction of the Court of Competition and Consumer Protection has been determined arbitrarily by the legislator violating the constitutional principle of equality. The following methods were applied: dogmatic-legal and analytic-synthetic.
    Celem opracowania jest ukazanie właściwości rzeczowej SOKiK w świetle konstytucyjnej zasady równości podmiotów. W przepisach art. 32 Konstytucji RP została sformułowana zasada równości, która obejmuje również przedsiębiorców. W Polsce obok sądownictwa administracyjnego, które oparte jest na kontroli legalności decyzji administracyjnych, funkcjonuje SOKiK, który rozpatruje decyzje administracyjne pod kątem merytorycznym. Analiza przepisów wskazuje, że właściwość tego sądu została ustalona w sposób nieuzasadniony. W ramach artykułu będzie udowadniana teza, że właściwość rzeczowa SOKiK została określona arbitralnie przez ustawodawcę z naruszeniem konstytucyjnej zasady równości. Główną płaszczyzną prowadzonych rozważań są przepisy prawa polskiego oraz orzeczenia Trybunału Konstytucyjnego. Zostały zastosowane metody: dogmatyczno – prawna oraz analityczno – syntetyczna.

    The energy market is one of the network industries, where competition can not develop under natural conditions. The energy market in Poland is one of the sectors that are subject to regulation and reglamentation. Regulatory authority has been created to bring competition and provide universal services/essential facilities, on this part of monopolistic market. The regulator has a lot of law instruments to create a competition market where every entrepreneur will be able to effectively undertake an economic activity and prices will be shaped by the market. If the regulator will use all legal instruments, he must be independent of other private entities operating in the market. In particular he must be independent of the government, which is pursuing to implement particularistic policies of each Member State. How Polish regulator can be independent if the government can create a national energy policy? On the basis of European law and the rights of Polish, indicated that the regulatory authority should not implement government policy as a whole, but take into account only government general policy guidelines. Prime Minister or member of the government cannot impose resolution of the case in a particular way if regulatory authority performs his own regulatory duties and powers. However, Prime Minister supervises the regulator and he may issue him binding guidelines and recommendations, which do not apply, however, the regulatory tasks.

    Opis:
    W trakcie trwającej kadencji organów stanowiących jednostek samorządu terytorialnego zachodzi niejednokrotnie potrzeba przeprowadzenia wyborów uzupełniających. Do dnia 1 sierpnia 2011 roku kwestie związane z tego rodzaju wyborami regulowała Ordynacja wyborcza do rad gmin, rad powiatów i sejmików województw. Przepisy te nie były jednak doskonałe. Dlatego też postulowano wprowadzenie zmian w tym zakresie. Okazja ku temu pojawiła się w roku 2011, kiedy to ustawodawca w dniu 5 stycznia 2011 roku uchwalił nową ustawę Kodeks wyborczy, która zastąpiła m.in. Ordynację wyborczą. W niniejszym artykule dokonano analizy nowych regulacji prawnych dotyczących wyborów uzupełniających, a dokładniej – określających terminy, w jakich wybory te powinny zostać przeprowadzone. Szczególną uwagę zwrócono na to, kiedy terminy te rozpoczynają swój bieg oraz jaki jest ich charakter. Badania wykazały, że pomimo uchwalenia nowego aktu prawnego regulującego kwestie związane z przeprowadzaniem wyborów uzupełniających, nadal istnieje w tym zakresie wiele luk prawnych, a obowiązujące przepisy wciąż są nieprecyzyjne i mogą wywoływać wiele wątpliwości w praktyce.
    In the ongoing term of the governing bodies of local government there is often a need to conduct elections. By 1 August 2011, the issues involved in this election were governed by set of rules about municipal councils, county councils and regional councils. These rules were not perfect. Therefore, the changes were called for in this regard. The occasion came in 2011, when the legislature on 5 January 2011, passed a new law: The Election Code, which replaced, among others, Electoral law. In this paper, an analysis of the new regulations concerning elections and specifically defining the terms under which these elections should be conducted was made. Particular attention was paid to when these terms shall begin and what is their nature. Studies have shown that despite the enactment of new legislation regulating issues related to conducting elections, there still exist many loopholes in this area, and the applicable regulations are still vague and can cause a lot of concern in practice.
