The situation in the job market and specific expectations of job applicants lie at the heart of a peculiar “career” that has recently been experienced in refusal letters. Additional elements influencing their form and content are German law regulations. Aperitif-Briefe, Eisschreiben, and refusal letters proper are the three main variants of this text genre which has undergone noticeable evolution in the investigated period of 2001–2012. The aim of this article is to indicate the development stages of this text genre, paying special attention to the aids offered to refusal letter authors by developing technology, especially by media.

The aim of a refusal letter as an answer to a job application is to communicate negative information to the person who is trying to obtain a job. For the reason of the necessity to save face as well as an inconvenience of the situation, authors of refusal letters apply various strategies aiming at mitigation of the formulated refusal. Das ABSAGEN gehört zweifelsohne zu den konfliktiven Sprechakten, da es das Gesicht des Empfängers bedroht und gegen seine Erwartungen gerichtet ist. Aus diesem Grund werden die Sprechakte, die auf die Erteilung der Absage ausgerichtet sind, von weiteren Sprechakten begleitet, die den Empfänger auf den Erhalt einer Absage vorbereiten und die Auswirkungen der Absage abmildern sollen. Ziel des Beitrags ist die Analyse von Handlungsmustern des ABSAGENS in den deutschen Absageschreiben für Bewerbungen. Auf der Grundlage der Analyse wird der Versuch unternommen, eine Typologie der sprachlichen Handlungsmuster zu erstellen, die bei der Durchführung dieses Aktes auftreten. Es handelt sich dabei um verschiedene Kombinationen von anderen Sprechakten (DANKEN, SICH ENTSCHULDIGEN, BEDAUERN, BITTEN, AUFFORDERN, BESTÄTIGEN, EMPFEHLEN, BEGRÜNDEN u. a.), die vor dem Erteilen der Absage, direkt danach oder sowohl vor als auch nach diesem Sprechakt realisiert werden. Die Grundlage für die Analyse bilden authentische Absageschreiben aus dem Zeitraum 2012–2018. Anhand des gesammelten empirischen Materials wird auch die Vorkommenshäufigkeit bestimmter den Sprechakt ABSAGEN begleitenden Sprechakte untersucht und auf dieser Grundlage ihre Funktion diagnostiziert. Zum Schluss wird versucht, eine Hierarchie der mit dem Sprechakt ABSAGEN vorkommenden Sprechhandlungen zu erstellen und das mit dem Ziel, einen Beitrag zur Erstellung der Absageschreiben zu leisten.
REFUSAL is undoubtedly a conflictual speech act, as it threatens the recipient’s face and is directed against their expectations. For this reason, speech acts aimed at issuing a refusal are accompanied by other speech acts that are intended to prepare the recipient for receiving a refusal and to mitigate the effects of the refusal. The aim of the article is to analyze the patterns of action of refusing in German refusal letters for job applications. On the basis of the analysis, an attempt is made to create a typology of the linguistic action patterns that occur when this act is performed. This involves various combinations of other speech acts (THANKING, EXCUSE, CONDEMN, REQUEST, CONFIRMATION, SUGGESTION, REASONING, etc.), which are realized before the refusal is issued, directly afterward or both before and after this speech act. Authentic refusal letters from the period 2001–2012 form the basis for the analysis. Using the collected empirical material, the frequency of occurrence of certain speech acts accompanying the REFUSAL speech act is also examined and their function is diagnosed on this basis. Finally, an attempt is made to create a hierarchy of speech acts occurring with the REFUSAL speech act with the aim of contributing to the creation of the rejection letters.

Odmowa to akt mowy, należący do tzw. krytycznych aktów mowy. Jego realizacja powoduje zagrożenie dla równowagi interakcyjnej między nadawcą i odbiorcą. Z tego też powodu użytkownicy języka stosują różne werbalne i niewerbalne strategie związane z realizacją ODMAWIANIA. Szczególnym przypadkiem realizacji tego aktu mowy są listy odmowne na podania o pracę, w których powinna – pośrednio lub bezpośrednio – zostać wyrażona odmowa. Nadawcy wskazanego gatunku tekstu formułują ją w różny sposób. Przedmiotem artykułu są formy realizacji aktu mowy ODMAWIANIE w języku niemieckim na podstawie wskazanego gatunku tekstu. Celem jest skierowanie uwagi na strategie stosowane w realizacji tego aktu mowy oraz próba stworzenia typologii form używanych w językowej realizacji ODMAWIANIA.
A REFUSAL is an act of speech that belongs to the so-called critical speech acts. Its implementation poses a threat to the interaction balance between the sender and the recipient. For this reason, language uses resort to a variety of verbal and non-verbal strategies related to REFUSAL. A special case of the implementation of this speech act are letters of rejection for job applications, in which the refusal should – directly or indirectly – be expressed. Senders of this genre of texts formulate the refusal in different ways. This article examines the forms in which the speech act REFUSAL is implemented in German, drawing from the aforementioned genre. The aim is to identify strategies used in the realization of this speech act and to create a typology of forms used in the linguistic uses of REFUSAL.

I focus on the discursive strategies within Two Spirit events and groups that center the definition of ‘Two Spirit’ first and foremost as an Indigenous identity by using both unifying/mass terms (Native American, glbtiq) and culturally & community specific terms (specific tribe names, Two Spirit). Rather than selecting a “right” term, such conversations highlight the constant, simultaneous positionings negotiated by Two Spirit people in their daily lives, and the tensions between recognizability and accuracy; communality and specificity; indigeneity and settler culture; and the burden multiply marginalized people carry in negotiating between all of those metaphorical and literal spaces. Drawing on Simpson’s (2014) concept of the politics of refusal, I demonstrate how Two Spirit individuals utilize available categories of identity, not as either/or binaries but rather as overlapping concepts- differentiated along micro- and macro- scales- to refuse attempts to both reduce the Two Spirit identity to one that is based either in gender or sexuality, and the appropriation of the identity and movement by non-Indigenous individuals and groups within broader national and global queer movements.

Opis:
School refusal behaviour is a serious problem, compromising lives of many children and their families and leading to several immediate and long-term sequels. According to the functional model, school refusal behaviour is usually a result of one or more factors: 1. Avoidance of school-associated places which evoke anxiety or depressive mood; 2. Escape from unpleasant and/or evaluating social situations; 3. Desire to focus parental attention on self or separation anxiety; 4. Rewarding extrascholar experiences. These four causative factors of school refusal behaviour were evaluated using a revised version of the School Refusal Assessment Scale (SRAS-R), including distinct subscales for children and their parents. This questionnaire serves to assess four functional conditions for school refusal as seen by children and parents. The study revealed significant difference between children and parents in identifying causes underlying school refusal behaviour.
Odmowa chodzenia do szkoły jest poważnym problemem rzutującym na życie wielu dzieci oraz ich rodzin. Prowadzi do następstw zarówno natychmiastowych, jak i dalekosiężnych. Zgodnie z modelem funkcjonalnym zachowania unikające szkoły są uwarunkowane przez jeden lub więcej czynników: 1. Unikanie specyficznych miejsc w szkole budzących strach lub przygnębienie; 2. Ucieczka od nieprzyjemnych i/lub oceniających sytuacji społecznych; 3. Skupienie uwagi na sobie lub lęk przed rozstaniem (lęk separacyjny); 4. Nagradzające doświadczenia pozaszkolne. Czynniki te oceniano za pomocą wersji rewidowanej kwestionariusza School Refusal Assessment Scale-Revised (SRAS-R), osobnymi formularzami dla dzieci i rodziców. Kwestionariusz ten ocenia nasilenie czterech funkcjonalnych uwarunkowań unikania szkoły w opinii dziecka i rodziców. Zanotowano istotną różnicę w identyfikacji kategorii, które leżą u podłoża zachowań unikających szkoły, przez dziecko i rodzica.

Opis:
Treatment with blood and ’its substitutes is a common practice in surgical patients who bleed perioperatively; also, nonsurgical patients with chronic disease receive blood/blood components. However, some patients refuse blood because of personal or religious beliefs, like in the case of Jehovah’s Witnesses. Those patients may accept different artificial substitutes of blood components as well as some surgical techniques, that decrease the risk of bleeding or the volume of blood lost. It is extremely important to inform the patients about the risk of losing blood without its replacement and to get an informed consent, as well as to document which treatments and/or procedures the patient consents to and which they do not. Such patients must be correctly prepared for the operation with hematologic optimization. All drugs that influence hemostasis must be stopped preoperatively. There have been several interventions/methods of decreasing the need for transfusion developed. All surgeons and anesthesiologists must be familiar with indications and appropriate use of blood and blood components and their alternatives, but close liaison with hematology specialists and their local blood sciences laboratory is encouraged. Based on the latest guidelines, there are many options of preoperative preparations and treatment, very important for the surgical and anesthesiology team, described in the manuscript.

The Opole Voivodeship (province) encompassed a vast majority of Polish–Czechoslovakian borderland. This particular part of the state border was characterized by lack of significant natural barriers. This circumstance created favorable conditions for escape attempts from a country ruled by communists. Odra River, a communication “spine” of the region, also offered a chance of flight to the West. Refusal to return after a legal trip abroad was a specific form of illegal immigration.

Einer Verweigerung der Ausstellung einer Heiratsurkunde können verschiedene formell-rechtliche Prämissen, die sich auf dieselbe Rechtshandlung beziehen, sowie daraus folgende verschiedene Behandlung von qualifizierten Zeugen der Eheschließung zu Grunde liegen.Ein Leiter eines Standesamts, der in diesem Bereich „unverzüglich”, d.h. ohne unbegründeten Verzug, handelt, kann praktisch ausschließlich im Fall einer Konkordatstrauung die Ausstellung einer Heiratsurkunde verweigern.Dies ergibt sich aus dem konstitutiven, d.h. legislativen Charakter der Ausstellung einer Heiratsurkunde gemäß dem polnischen Konkordat und dem Gesetz über Standesamtsurkunden.Der Gesetzgeber nimmt eine ganz andere Stellung zur Folgen einer Unterlassung der Pflicht, eine Heiratsurkunde auszustellen, wenn es ausschließlich eine Ziviltrauung betrifft, die einen deklarativen Charakter hat.In diesem Fall wird die Ehe sowohl vor dem Leiter des Standesamts als auch vor dem polnischen Konsul geschossen.

Private enforcement in Lithuania is still at the early development stage, as only a few infringement decisions of the national competition authority – the Competition Council of the Republic of Lithuania – have been followed on by private antitrust claims. Nevertheless, it might be observed that victims of competition law infringements tend to initiate standalone claims for compensation of damages in Lithuania. However, not all of those cases are successful. On 3 March 2017, the Court of Appeal of Lithuania rejected a damages claim for EUR 2.9 million brought by a company that claimed to have been refused infrastructure access (an essential facility) by the dominant state-owned telecommunication company; infrastructure access was necessary for the provision of its own services. The case is interesting and worth mentioning due to the complexity and interrelation of competition law and the regulation of electronic communications (such as the interrelation of dominance in competition law and significant market power under the regulatory framework). The case is also noteworthy becaouse of the lack of involvement by the Competition Council and the Communication Regulatory Authority as well as their position in the dispute. Of relevance is also a change made to the laws related to the dispute and further consequences of the dispute.

The ability to compete on numerous markets today depends on access to technological standards. When standards are protected by standard essential patents (SEP), a license to use such SEPs will be required. There have been numerous disputes in various jurisdictions over refusals to license SEPs. Most recently, disputes concern access to SEPs by the manufacturers of components. Some SEP holders deny access to their standard essential patents to component manufacturers and prefer to license end product producers. This practice has become a highly contentious issue around the world. In particular, manufacturers of components who are denied access to SEPs claim that such refusals amount to violations of competition rules. The author examines this highly contested practice is an attempt to show when denying access to an SEP license could harm competition.

W związku z tym analizie poddano zakres uprawnień strony w postępowaniu podatkowym oraz charakter postępowania w przedmiocie zwrotu podatku od towarów i usług. Na jej podstawie stwierdzono, że postanowienie o odmowie wszczęcia postępowania, wydane w myśl art. 165a § 1 o.p., dotyczy wyłącznie postępowań wszczynanych na wniosek. Nie jest zatem dopuszczalna odmowa wszczęcia postępowania w sprawie o zaliczenie zwrotu podatku na poczet wskazanych przez podatnika zobowiązań.
The article is a criticism of the Supreme Administrative Court (NSA) Judgment concerning the issue of ruling on a refusal to initiate proceedings, in proceedings commenced at the request of the party. Therefore, the scope of the party's rights in tax proceedings and the nature of the proceedings regarding the refund of value-added tax were analysed. On their basis, it was found that the refusal to initiate proceedings, issued according to Article 165a § 1 of the Tax Ordinance Act, applies only to proceedings inaugurated at the request of the party. Accordingly, it is not authorised to refuse to instigate the proceedings to credit the tax refund towards the liabilities indicated by the taxpayer.
