In spite of widespread support from the population of most member countries for European Union policy, including support for sustainable development, in many EU countries, the levels of acceptance of new environmental protection programmes have been and, in particular in new member states, still are considerably low. The experience of the countries which were the first to implement union directives show that they cannot be effectively applied without widespread public participation. The goal of this study was, using the example of Poland, to assess public acceptance of the expansion of nature conservation in the context of sustainable development principles and to discover whether existing nature governance should be modified when establishing new protected areas. The increase in protected areas in Poland has become a hotbed of numerous conflicts. In spite of the generally favourable attitudes to Nature that Polish people have, Nature 2000 is perceived as an unnecessary additional conservation tool. Both local authorities and communities residing in the Natura areas think that the programme is a hindrance, rather than a help in the economic development of municipalities or regions, as was initially supposed. This lack of acceptance results from many factors, mainly social, historic and economic. The implications of these findings for current approach to Nature governance in Poland are discussed.

Opis:
Large-scale investment is routinely believed to be the main danger to urban heritage. The measures designed to sustain heritage thus traditionally focus on steering investment into respectful ways of real-estate development. The majority of Czech built heritage is, however, located in towns and villages that rather face economic decline. Losses of objects of heritage in such places are often due to lack of maintenance. The case study of this article discusses the issues of heritage protection and restoration of the Enlisted town zone of Mšeno, where affordability and communication of values are the key issues in heritage protection.

Opis:
The issues of civic participation in configurations of movements, associations, organizations and associations as a potential catalyst of democratic transformation of democratic processes in modern Ukraine are examined in the article. Civic participation is understood as the methods and means of communication in the form of exchanges outlined by institutional and value ordering system. It is studied that an important incentive for a citizen’s participation in social and political life is trust/distrust, which acts as a catalyst, a specific type of communication links that makes development of socio-political sphere more dynamic. Distrust is the special type of communication links, which creates political control and demand of accountability from institutions of political power. It was investigated that civic participation through displays of communication capacity, has an ability to implement the national practice of the three-phase model of socio-political transformation, liberalization, democratization, democratic consolidation. Unfortunately, in modern terms this process is reduced to the functions of «mass suggestion ritual», which aims to «convince citizens in their involvement» in the political process.

Changes in the attitude of local authorities towards the public participation in the decision making processes have prompted development of new methods of such involvement. As far as the urban planning is concerned, of particular potential is the so-called Public Participation Geographic Information Systems (PPGIS). One of the tools used for the purpose is a geo-questionnaire, combining the benefits of a standard questionnaire and a map, which permits collecting information on particular sites and on the respondents’ ideas on localisation of new objects and functionalities.Within the project “Geoportal supporting public participation in urban planning”, in the years 2015–2016, a study was undertaken to explore the effectiveness and usefulness of the geo-questionnaire. Five pilot studies were performed in the Poznań and Łódź agglomerations. The geo-questionnaires concerned the local spatial management plan in Rokietnica (Poznań agglomeration), landscape protection in Łódź, conception of the transportation system development in Łódź, conception of urban design of the Łazarski Market in Poznań, and the Map of Local Needs in the city center of Poznań. The aim of the study was to present the preliminary results of the initial implementations of geo-questionnaire developed within the project Geoportal supporting public participation in urban planning. The applications of geo-questionnaire have been analysed taking into account the characteristics of implementation areas, characteristics of users, the effectiveness of recruitment methods and opinions about the tool from two points of view: the respondents and the recipients of results.

Judicial control of the conformity of law to the constitution nowadays serves as one of the basic guarantees of the observance of the constitution. In majority of continental European states it is performed by a particular body a constitutional court. So the same is true in Poland, however it seems still to be one of the least understood aspects of the functioning of our political system. And especially with regard to the opportunities offered by that for nonpublic entities to protect their rights and to influence the public decision making process. The awareness in this respect seems to be on a very low level. That is why the aim of the author is to verify a research assumption that the Constitutional Court jurisdiction has a serious social dimension, noticeable for Polish nonpublic actors.

Authentic interpretation of laws is an interpretation of legal provisions that, due to their lack of clarity or misinterpretation in their application, is provided by the parliament. Unlike the legislative procedure, which is conducted, as a rule, in two (exceptionally three) readings, a proposal for giving an authentic interpretation is discussed in one reading. Starting from the understandings of some authors that the act of authentic interpretation of laws is contrary to the principle of democratic pluralism, and that it lacks the necessary level of democratic control and citizen participation, the author examines whether the Croatian parliamentary law enables public participation in the procedure for authentic interpretation of laws and, if so, what legal instruments can be used to implement it in parliamentary practice. To this end, the paper analyzes several relevant constitutional, legal, and procedural provisions of the Croatian parliamentary law, with reference to a parliamentary practice. Given the fact that the procedure for authentic interpretation in the Republic of Croatia, the Republic of Northern Macedonia, the Republic of Slovenia and the Republic of Serbia is regulated in a similar way by the rules of procedure of their respective parliaments, the relevant regulations of the latter three countries on the possibility of public participation in this procedure are analyzed as well. It was concluded that Croatian parliamentary law enables public participation in the procedure for authentic interpretation, through the instruments of petition, information and involvement in working groups and working bodies, and the same instruments, with certain specifics, are recognized in the parliamentary law of the latter three countries.

A crisis of contemporary democracy, long proclaimed by political analysts, and the growing discontent with its practice have given a stimulus for various remedial actions. One of these actions is the idea of deliberative democracy. Deliberative democracy is not only a multi-facet theoretical project (outlined briefly in the present article) but also a practice of promoting community participation and of introducing various, even non-standard, methods of participation. Such was the idea behind a presidential initiative in 2010 for setting up a platform for public discussion, Forum for Public Debate. The aims and objectives of the platform, its focus, underlying principles, as well as procedures in place and the results of what has been undertaken within its framework – they all show that the initiative is a clear manifestation of what is called deliberative democracy.

Recently, the issue of intercultural relations between immigrants and the host society has been widely discussed. Taking into account the increasing spatial mobility of non-EU foreigners, it seems highly important to examine their relations with the host community on the local level. This article presents the results of the qualitative study conducted in the first quarter of 2014 in the Lesznowola municipality (Mazowieckie province, Piaseczno district) in Poland. It aims at analysing the situation of the Vietnamese community and its engagement in the local life of the municipality and examine attitudes of both Vietnamese and Poles towards prospects for granting local voting rights to migrants in Poland. Through several years of successful business and social cooperation, the Vietnamese immigrants have become a recognisable part of the social landscape of the municipality. The degree of social and political participation at the local level on the part of the Vietnamese community has also increased, which can be observed, for example, through such practical indicator as cooperation with local educational institutions. Therefore, we can argue that the Vietnamese community has been transforming itself from a marginalised and self-sufficient homogeneous group into more and more self-aware and active socio-political group of actors.

The question of public responsibility for urban development grows to be among the major, contemporary issues of new urban governance. The urban responsibility discourse is being facilitated by local administration, but also investors and businessmen, media, researchers and the emerging social associations. The local power, traditionally based on the elected bodies (the council and the mayor) is recently being challenged by growing, often unstructured and informal urban movements. New powers have been renegotiating supremacy relations, using generally strong public and medial support, but some critics stress the lack of formal legitimacy. Public co-responsibility is associated with public co-governing; sharing responsibility is also sharing power. The main problem of social urban (ir)responsibilities lays in difficult compromises and individuality of various actors and narrow, sectoral or local perspectives.

The purpose of this article is to conduct an axiological and legal analysis of the most popular model of participatory budgeting in Poland (the plebiscite model), being a special form of public consultation that allows the residents to decide each year on a part of the commune’s budget expenditure by direct voting. According to the paper’s hypothesis, both the PB legal rules as well as the practice of its application in Poland are not axiologically neutral, which means that they have a positive or negative impact on certain public values, appropriately strengthening or violating them. In the research, the combination of three coherent methods was used: (i) a literature analysis, (ii) the dogmatic and legal method, and (iii) interviews conducted with three groups of PB participants, i.e. municipal officials responsible for the organization of PB procedure, municipal councillors, and residents. The research covers six Polish cities and bases on a catalogue of nodal public values including: human dignity, sustainability, citizen involvement, openness, secrecy, compromise, integrity, and robustness. The research leads to the conclusion that the plebiscite BP in Poland is not axiologically neutral, its rules have both a positive and negative impact on particular nodal public values, however the scale of negative impact is greater than the scale of the positive one.

The aim of the text is to present the issue of school resistance and its relation to the children’s right to participation. School resistance is a concept investigated by critical pedagogy as one of the forms of expressing one's subjectivity. The complexity of the issue is the reason for many definitions and classifications of school resistance. Referring to the definition of school as an area of a clash between dominant and dominated culture, one can speak of resistance defined as action directed against the dominant subject. H. Giroux created a classification of this phenomenon, combining attitudes and behavior towards school (oppositional or accommodative). Types of resistance highlighted in this way provided a basis for subsequent classifications, including E. Bilińska Suchanek's, B. Babicka – Wirkus', and M. Nowicka's. All authors point to the greatest value of conscious resistance, often called transformative resistance. It is based on a disagreement about the real image of the school, while behaving correctly on its territory. In the first place, emancipation requires education that takes place in the school space. Resistance behaviors are related to the concept of participation. Pursuant to the Convention on the Rights of the Child, children and young people have the right to participate. Numerous pedagogical studies indicate that this right remains unrealized in Poland. A look at resistance behavior as a manifestation of the right to participation allows one to understand the potential of resistance – it can communicate the needs of children and young people. What adults interpret as resistance might be a message that requires dialogue and understanding. Respecting the right to participation can create such a space. Connecting the concepts of resistance and participation may contribute to increasing the democratic participation of children and young people in schools.

The paper presents a review of contributions to the scientific discussion on modern methods and tools for public participation in urban planning. This discussion took place in Obrzycko near Poznań, Poland. The meeting was designed to allow for an ample discussion on the themes of public participatory geographic information systems, participatory geographic information systems, volunteered geographic information, citizen science, Geoweb, geographical information and communication technology, Geo-Citizen participation, geo-questionnaire, geo-discussion, GeoParticipation, Geodesign, Big Data and urban planning. Participants in the discussion were scholars from Austria, Brazil, the Czech Republic, Finland, Ireland, Italy, the Netherlands, Poland, the United Kingdom, and the USA. A review of public participation in urban planning shows new developments in concepts and methods rooted in geography, landscape architecture, psychology, and sociology, accompanied by progress in geoinformation and communication technologies. The discussions emphasized that it is extremely important to state the conditions of symmetric cooperation between city authorities, urban planners and public participation representatives, social organizations, as well as residents.

Information society is characterized by self-organization and distributed information processing abilities. At the same time there is an increase in demand for participation in local decision processes. To meet these new expectations the authors present new, alternative framework for management of cities, in which local authorities are moderators, consultants and managers, whereas all stakeholders participate in decision making within purposely created networks and groups. In the article authors also indicate selected city infrastructure elements, which ownership and management could be transferred into “city cloud”.

W artykule zaprezentowany wyniki analiz dotyczących sposobu i zakresu przyjmowania w społecznościach lokalnych idei partycypacji upowszechnianej przez UE. Sposób wdrażania oraz nastawienie środowisk lokalnych wobec idei partycypacji wyrażone zostało w państwach członkowskich UE w prawie lokalnym, które wyznacza ramy dla współdecydowania mieszkańców o lokalnych politykach oraz kierunkach zmian w społecznościach, do których należą. Kluczowe dla artykułu pytania dotyczą warunków dla udziału członków społeczności lokalnych w podejmowaniu decyzji tworzonych przepisy prawa lokalnego, różnic w adaptacji idei partycypacji w prawodawstwie gmin pogranicza polsko-niemieckiego oraz roli partycypacji w zarządzaniu lokalnym. W celu odpowiedzi na pytania stawiane w niniejszym artykule zastosowano analizę zawartości dokumentów prawnych kształtujących warunki dla włączania mieszkańców pogranicza polsko-niemieckiego, ustanawianych lokalnie. W zakończeniu zaprezentowano wnioski mówiące o komplementarności mechanizmów partycypacji wobec działalności instytucji publicznych gmin niemieckich oraz instrumentalnym stosowaniu form partycypacji w gminach polskich.
The paper presents how and to what extent the participation idea, promoted by the EU, has been implemented in local communities. The way of its implementation and the attitude of local communities are reflected in the local legislation adopted in the member states, which determines the framework for inhabitants’ involvement in making decisions regarding local policies and the directions for changes in their communities. The key questions in the article focus on the conditions for members of local communities to participate in the decision-making process, indicated in the local legal provisions, on the differences in adapting the participation idea in the legislation of the municipalities in the Polish-German border region, and on the role of participation in local management. To answer these questions, the author analyses legal documents, adopted locally, which influence the conditions for the involvement of inhabitants in the Polish-German region. The last part of the paper presents the conclusions: in German municipalities, participation mechanisms show complementarity to the activities of public institutions, whereas in Polish municipalities, forms of participation are used instrumentally.
