The article is about the development of the legal regulation in the matter of the registration of law of estate on estate property beginning from the Kyiyv Rus times till nowadays. The registration of rights on estate property is a newish phenomenon for the majority of governance systems and whereas it was unmethodical and unsystematic before the early 20th century, in the beginning of the 20th century the state registration of rights, objects or transactions is complied as a fully functional institution. Besides the main historic periods of development of the systems of legal regulation in the matter of the state registration of the rights on the estate property is reviewed.

In international trade, it is essential to determine the scope of the law applicable to property rights, i.e. the law applicable to the assessment of rights in rem. Article 41 of the Polish Private International Law Act uses the connecting factor of the situs rei. The competence of legis rei sitae regarding rights in rem should not be challenged when the subject of rights in rem is tangible property. If, however, the subject of rights in rem is not a tangible object but in a claim or other type of a right, then there is an urgent need to seek other ways of establishing the law applicable to the formation of such rights. In addition, there is a recurrent problem with the proper delimitation with the laws applicable to other issues, i.e. the determination of the law applicable to the assessment of the effectiveness of the acquisition of a limited right in rem, and the question of the so-called adaptation and qualification. The purpose of the present study is to determine the law applicable to the establishment of limited property rights. Using the dogmatic-legal, comparative and complementary historical methods, the provisions of Article 41 of the Private International Law Act are evaluated, and conclusions are drawn de lege ferenda.

The aim of the present study was to determine va-rious physical, mechanical, and structural characteristics of seed of pepper cultivars Yağlık Kapya, Demre Sivri, Yalova Carliston, Kandil Dolma, and Cin Sus Yediveren, which are grown extensi-vely in Turkey, with initial moisture content ranging between 7.03 and 7.21% (w.b.). Width, length, and thickness were found to be in the range of 3.00-3.72, 3.43-4.40, and 0.66-0.82 mm, respectively. It was revealed that sphericity of the seeds of Yağlık Kapya, Demre Sivri, Yalova Carliston, Kandil Dolma, and Cin Sus Yediveren were 51, 57, 56, 51 and 57%, respectively. In terms of the roundness which ranges between 76 and 85% depending on pepper cultivars. The aspect ratio of Yağlık Kapya, Demre Sivri, Yalova Carliston, Kandil Dolma, and Cin Sus Yediveren were determined to be 84.60, 88.04, 94.43, 85.55, and 87.67%, respectively.It was also noted that the porosity of the pepper seeds was in the range of 44.94-49.61%. Besides, we found that as the weight of pep-per seeds increased, their terminal velocity increased accordingly, and thus terminal velocities were found to be 2.87-4.66 m s-1. In the current study, the static friction angle and coefficients of the cultivars were determined by means of six different plates including aluminium, stainless steel, galvanized iron, rubber, glass, and plywood. The plywood plate was found to be the least slippery; consequently, the static friction angle and coefficient were determined to be the highest for the plywood plate.

We introduce a subclass of the family of Darboux Baire 1 functions f : R → R modifying the Darboux property analogously as it was done by Z. Grande in [On a subclass of the family of Darboux functions, Colloq. Math. 17 (2009), 95–104], and replacing approximate continuity with I-approximate continuity, i.e. continuity with respect to the I-density topology. We prove that the family of all Darboux quasi-continuous functions from the first Baire class is a strongly porous set in the space DB1 of Darboux Baire 1 functions, equipped with the supremum metric.

The principle of this article was not only the legal analysis of the content of the agricultural property lease agreement concluded by Agricultural Property Agency but, above all, positioning of this Agency in the process of concluding the abovementioned agreement. The necessity of looking into this matter again resulted from large scale changes in the Act dated 19 October 1991 on the management of agricultural properties owned by the Treasury and accompanying acts, introduced by the amending Act dated 16 September 2011 which came into effect as of 3 November 2011. The changes largely concerned the lease of agricultural properties owned by the Treasury. The basis of the article constituted also a lawsuit, during which the Agency was a party. The lawsuit caused changes in the property sale and lease procedure. The article also presents the basic legal requirements for the functioning of Agricultural Property Agency. The introduced legislative changes exposed the monopolistic position of the Agency. The statutory tendency to liquidate lease of the state–owned agricultural properties was also clearly presented, what met with criticism in the doctrine. Moreover, concerns were also aroused due the fact that the amended Act on the management of agricultural properties owned by the Treasury introduced legal instruments which allow for the unilateral interference in the content of lease agreements concluded for a definite period of time. Undoubtedly, the tenant of the state–owned agricultural property, in case of the greement concluded for a definite period of time, should receive a far–reaching legal protection. Only this type of protection guarantees achievement of the economic objective and allows for the permanence of management of the land held under lease. The amended act questions this permanence.

Aim/purpose–General real estate taxation is a process regulated, inter alia, by the Real Estate Management Act. It is intended to establish a tax base for real estate in the event of a change in real estate tax base. General taxation is one of several applications of mass valuation of real estate, which enables valuation of many properties at the same time and with a uniform approach. One of the methods of mass valuation of real estate already applied in practice is the Szczecin Algorithm of Real Estate of Mass Appraisal (SAREMA). One of the immanent features of general taxation and the algorithm itself is the division of a selected area into possibly homogeneous areas called taxing zones with-in the general taxation terminology and, more broadly, elementary areas, according to the nomenclature used in the SAREMA. The paper presents the results of the studies on the measurement of elementary areas homogeneity on the example of land plots located in Szczecin. It is important to assess whether the designated sub-areas ofvaluation cover properties similar to each other in terms of their specific characteristics. If so, it will help to obtain more accurate mass valuation results.Design/methodology/approach–The paper proposes to use a modified entropy measure to establish whether the designated areas are homogeneous in terms of the specified properties of real estate. The database of real estate includes more than 1.5 thousand urbanised land plots located in Szczecin. The measurement of entropy will be preceded by the specification of elementary areas. The available methods include the application of an expert approach, under which land boundaries will be indicated by property valuers. Findings –The main conclusion of the study is that a modified measure of entropy en-sures a better indication of the degree of indefiniteness of valued sub-areas and thus it offers a better way of supporting the delimitation of these sub-areas in comparison to the classical measure of entropy.Research implications/limitations–The delimitation of valuation sub-areas constitutes an important element of mass valuation. Proper execution of this process enables obtain-ing much more precise valuations. An objective measure of homogeneity gives a chance to compare different approaches to the creation of the above-mentioned sub-areas and to choose the best of them.Originality/value/contribution–The main achievement of the study is a proposal to modify the classical entropy measure, thanks to which it better reflects the specificity of the assessment of homogeneity of the areas valued in terms of property market analysis.

An alternative to the Dunford-Pettis Property, called the DP1-property, is introduced. Its relationship to the Dunford-Pettis Property and other related properties is examined. It is shown that $ℓ_p$-direct sums of spaces with DP1 have DP1 if 1 ≤ p < ∞. It is also shown that for preduals of von Neumann algebras, DP1 is strictly weaker than the Dunford-Pettis Property, while for von Neumann algebras, the two properties are equivalent.

The description consists of two documents depicting the state of real property, size of the area and the income of the parish in Szadek in 1858. These documents were drawn up under a decree of the government of the Polish Kingdom. The first of them describes the church and the buildings belonging to the parish. It lists in 19 points the real estate comprising the church property. Each description states the size of a building, its condition, material that it was built of and the value of insurance in case of fire. The second document describes the parish land in Szadek, Bobownia and Ogrodzim. It contains information about the size of each piece of land, its character, and type of land use (e.g. arable land, meadow, vegetable and fruit garden, waste land, road, water reservoir, built up area). The presented documents enrich our knowledge about the history of the Szadek parish, providing information on its possessions in the middle of the 19th century.

A property of graphs is any isomorphism closed class of simple graphs. For given properties of graphs ₁,₂,...,ₙ a vertex (₁, ₂, ...,ₙ)-partition of a graph G is a partition {V₁,V₂,...,Vₙ} of V(G) such that for each i = 1,2,...,n the induced subgraph $G[V_i]$ has property $_i$. The class of all graphs having a vertex (₁, ₂, ...,ₙ)-partition is denoted by ₁∘₂∘...∘ₙ. A property is said to be reducible with respect to a lattice of properties of graphs if there are n ≥ 2 properties ₁,₂,...,ₙ ∈ such that = ₁∘₂∘...∘ₙ; otherwise is irreducible in . We study the structure of different lattices of properties of graphs and we prove that in these lattices every reducible property of graphs has a finite factorization into irreducible properties.

The aim of the article is to compare the layered property ownership right and the heritable building right as potential solutions that could fill the gap in Polish law. Currently, there is no legal institution that would encourage commercial investors to implement investments on or below the ground. In Poland, there are many undeveloped properties located over railway tracks, tunnels or underground car parks. For years, there has been a public debate on the possibility of introducing layer ownership in Poland. The subject of discussion are the solutions used in other countries. The article discusses the draft law introducing the heritable building right. The heritable building right was also compared to the right of perpetual usufruct functioning in Polish law system. An analysis of the currently applicable legal standards was also made in the context of the possibility of introducing three-dimensional properties.

The aforementioned provision shall not apply when the duty to release the property results from tort or in the case of returning the property which have been leased, rented or loaned for use.1 Hence the question about the possibility of applying an analogy to the exclusions to retention right listed in Article 461§2 CC in a situation where after the termination of the marriage (for example: by divorce) the former spouse resides on the property constituting the personal property of the other spouse, against their will, invoking the duty of reimbursement of the expenditures from the common property to the personal property of the other spouse. The author has applied a dogmatic method to the issue outlined above, analysing the current legal situation and concluding that it is permissible to extend exceptions to the right of detention. There are the following premises for application of analogy in the civil law: similarity due to important features and loophole in the law. The use of the real estate property of the ex-spouse, contrary to the will of the other spouse, fulfils all the premises for application of analogy. The ex-spouse residence on the real estate belonging to another spouse, contrary to the others spouse’s will, is reprehensible enough to be qualified as tort and cessation of the family law title to the apartment, referred to in Article 281 FGC – similarity to the cessation of continuous legal relationships, such as lending. As proved, in accordance with applicable law it is admissible to create the analogy to Article 461§2 CC, so that the ex-spouse using the real property of another spouse upon termination of marriage could not invoke the retention right. As for the future, the statutory extension of the scope of the exceptions to the retention right should be suggested.

It is important to characterize boron containing minerals because of their uses in a wide range of applications. The purpose of this study is to characterize Espey colemanite by minerological, petrographical and thermal means and to investigate the variation of its physical properties with temperature (up to 600 °C). Colemanite, having a non-porous crystalline structure, was found to consist of 35.8% B2O3 and 30.5% SiO2. The thermal decomposition of colemanite occurred within the temperature range of 300–600 °C. It was found that calcination, a thermal treatment method, influenced the physical properties of colemanite. The highest surface area, 131.9 m2/g, was obtained at 500 °C. The physical properties were found to have high statistical relation.

The electronic, magnetic, and optical properties of PtCoBi half-Heusler compound [001] surfaces and its bulk state have been investigated in the framework of density functional theory using GGA approximation. The half-metallic behaviors of CoBiterm, CoPt-term and PtBi-term decrease with respect to its bulk state. The spin polarization at the Fermi level is 73.2% for the bulk state, and it is -64.4% and -64.1% for the CoBi-term and PtBi-term, respectively while less polarization has been observed for the CoPt-term. All terminations have given almost similar optical responses to light. Plasmon oscillations for the terminations occur in the range of 12.5 to 14.5 eV (21 to 22 eV) along xx (zz), and it occurs at 23 eV for the bulk state. The refractive index for the bulk and all three terminations is very high in the infrared and visible areas, meaning a very strong metallic trend in these compounds. The phenomenon of super-luminance occurs for the incident light with energy exceeding 5.5 eV for all three terminations, and it occurs in the range of 10 eV for the bulk mode. These terminations show transparent behavior after the energy of 10 eV.

Nowadays, there is a noticeable trend aimed at ensuring broad protection of the natural environment – both for the sake of preserving biodiversity and the quality of life of the future generations. However, the related activities of public authorities and private entities often involve limiting the rights of property owners. The Polish Constitutional Tribunal has ruled on the conflict between property rights and conservation of nature. The Tribunal has pointed out that the principles of sustainable development require an appropriate balance between environment protection on one hand and social and civilizational development on the other. In accordance with the previous jurisprudence of the Tribunal, the article will present the limits set for the state's environment policy in certain specific areas by the Constitution. It is acceptable to establish mechanisms to control the exploitation of plantings belonging to real property. Property owners may be required to obtain permits for their removal, and in the absence of such permits, they may be punished with forfeiture of timber or a fine. However, it is incompatible with the principle of proportionality and infringes the right of owners by arbitrary restrictions or imposed automatically sanctions, without the possibility of taking into account the circumstances. Moreover, the Tribunal has pointed out that the Constitution does not allow disproportionate narrowing down of the possibility to seek compensation for restrictions in the use of real property for the sake of environment protection. Only the two-year deadline for submitting claims in this respect has been considered too painful – too short and impossible to be reinstated for justified reasons.

We prove some results concerning the WORTH pro\-perty and the Garc\'{i}a-Falset coefficient of absolute sums of infinitely many Banach spaces. Also, the Opial property/uniform Opial property of infinite \(\ell^p\)-sums is studied, and some properties analogous to the Opial property/uniform Opial property are discussed for Lebesgue\polishendash Bochner spaces \(L^p(\mu,X)\).
