Before a young person is placed in a correctional facility, a series of interventions are undertaken towards him or her, which have the potential to stop criminogenic behaviour and break the causal chain leading to crime. In this paper, a qualitative analysis of the biographies of 60 minor offenders was carried out using the case study method while they were in rehabilitation facilities (correctional institutions or minor shelters). The personal documents collected by the rehabilitation institutions contain a large quantity of information (interviews, diagnoses, and expert opinions) about minors against whom several systemic interventions were previously applied in the course of their lives. The results show the large number and variety of interventions made towards minors, which ultimately did not prevent their placement in rehabilitation facilities because they were usually made too late.

The present paper focuses on foreign minors: between family and school in a pedagogical perspective. Themes and problems are presented in four main areas: the foundational framework of interculture in a pedagogical perspective; the family as the main observatory and migration project, characterized by development and education tasks involving all its members, with particular attention to their roles and functions, and the role of family and parenting support services; the processes of education / literacy and socialization / education as practices that affect the school curriculum (in its different orders and degrees), addressing also the issues of language and work as the main means of cultural and social integration and inclusion; the professional figures (in initial training and in-service), with specific reference to the educational care provided by teachers, socio-pedagogical professional educators and pedagogists. The paper adopts the perspective of general and social pedagogy, considering also intercultural factors and Adult Education. Moreover, it incorporates the contributions of educational sciences. In terms of sources, it is based on the studies, research and projects in the field, while, at a methodological level, it stems from an investigative approach centered on the dialogue between theory and praxis. Its aim is to offer possible lines of evolution and unchartered bases for educational planning.

Opis:
Migration, as a global phenomenon has a long history also in the Slovak Republic. Most of the migrants come, or are passing through its territory legally. There are still cases of illegal migration, too. The reasons for this form of state borders crossing are diverse. Part of illegal migrants are also people who are belonging to vulnerable groups, including unaccompanied minors. Since this is a specific and particularly vulnerable group of migrants, the European Union and subsequently the Slovak Republic adopted several legislative measures in the area of migration and asylum. Their aim is to adjust the status of unaccompanied minors and to contribute to finding lasting solutions to their current situation, taking into account their best interests.

The main subject of the analysis is the question of conformity with Poland’s Constitution of the possibility of carrying out clinical trials on minors. The author concludes that the provisions of Article 31 of the proposed regulation of the European Parliament and of the Council on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC, providing for the possibility of conducting clinical trials on minors, which are not aimed to be delivered for health benefit of those persons, are inconsistent with Article 39 of the Constitution of the Republic of Poland.

The uncontrolled wave of immigrants to the European Union countries, which reached its peak in 2015, challenged not only the well-established system of asylum policies in the Member States but also revealed the fundamental differences among them concerning the so-called “immigration issue”. The article focuses on the mechanisms and institutions which evolved during the different waves of immigrants in Belgium and the Netherlands. It also looks for an answer to the question: is mass immigration to Europe a threat or an opportunity? Depending on one’s attitude to the topic, the answer may be positive or negative.

The author of the article presents the influence of physical activities on socially maladjusted youth, on the basis of desk research analysis, as well as using personal observations conducted during serving as a probation officer for a period of two years. The observations were conducted on a group of 11 male and female minors advised physical activities, as one of the means of influence in the process of resocialization. The article focuses on two social environments, where the resocialization process may take place – the open environment and the institutional environment. The author presents the process of resocialization, its goals, methods used in it, and the reasons why this process is so significant. The aim of the article is to show the changes occurring in the behaviour of young and socially maladjusted people as a result of participating in sports activities. The author’s final conclusions indicate the positive effects of physical activity as a means of influence.

Pojęcie demoralizacji od zawsze było obecne wśród młodzieży. Jedną z form dzisiejszej demoralizacji jest tzw. happy slappinng, zjawisko polegające na filmowaniu osób w upokarzającej sytuacji, a następnie publikacja nagranych materiałów w Internecie. Tego typu działania są bardzo popularne wśród dzisiejszej młodzieży. Stanowią połączenie przemocy tradycyjnej z przemocą wirtualną. Atrakcyjność tego typu zachowań jest wzmacniana poprzez poczucie anonimowości i bezkarności w wirtualnym świecie. Prawa jednostki chronione są zarówno na poziomie międzynarodowym, jak i krajowym. Zarówno przepisy ustawy zasadniczej, jak i inne gałęzie prawa wprowadzają standardy ochrony jednostki przed ingerencją ze strony osób trzecich. Obecnie obowiązujące przepisy prawne nie nadążają jednak za tą formą przestępczości i powinny zostać znowelizowane w postaci wprowadzenia do przepisów kodeksu karnego odrębnego przestępstwa penalizującego to zjawisko. Dzięki temu możliwe byłoby sprawne prowadzenie postępowań w takich przypadkach, a ofiary zyskałyby skuteczniejszą ochronę.
The concept of demoralisation has always been present among young people. One of the forms of today’s demoralisation is the so-called happy slappinng, a phenomenon involving filming people in a humiliating situation, and then publishing the recorded material on the Internet. These actions combine traditional violence with virtual violence. The rights of the individual are protected both at the international and national levels. The provisions of the constitution and other laws introduce standards for the protection of an individual against interference by third parties. Current legal regulations do not keep up with this form of crime. Therefore, the provisions of the Penal Code should be amended and activities such as happy slapping ought to be penalised as a separate type of a crime. This would enable efficient proceedings in such cases and provide more effective protection for the victims.

In June 2014, the border between Mexico and the United States (US) witnessed the arrival of more than 50,000 unaccompanied children from Central America trying to get to the US in order to join their parents, escape from different types of abuse and violence, or find new opportunities. The growing numer of children in the border has developed a humanitarian crisis involving many actors, such as the children, the American government, the US border state governments, the Mexican government, the governments of Central America and many NGOs concerned by the problematic situation. The current paper seeks to analyze the origin and development of the crisis, as well as its consequences, and the actions that the actors mentioned above have taken, or not.

Współcześnie wiele osób, a zwłaszcza młodzi ludzie, nie wyobraża sobie już świata bez nowoczesnych technologii. Dzięki nim mogą bez wychodzenia z domu robić praktycznie wszystko na co mają ochotę (nawet działać nie do końca zgodnie z prawem). Jednakże to przywiązanie do cyfrowego świata niesie szereg zagrożeń. Dzieci i młodzież ze względu na swoje przywiązanie do urządzeń, relacji w sieci i często lekkomyślności mogą stać się łatwym celem przestępców w cyberprzestrzeni. Mogą oni również stać się sprawcami, a to za sprawą złudnej anonimowości w sieci. Z tego też względu autor podjął próbę głębszego spojrzenia na zjawisko cyberprzestępczości wśród nieletnich prezentując między innymi jego skalę.
Nowadays, especially young people, cannot imagine the world without modern technologies. Thanks to them they can do practically everything they want without leaving home (even things that are not entirely legal). However, this attachment to the digital world carries a number of risks. Children and young people, because of their attachment to devices, online relationships and often recklessness, can become easy targets for criminals in cyberspace. They may also become perpe-trators due to the illusory anonymity in the network. For this reason, the author has attempted to take a deeper look at the phenomenon of cybercrime among minors by presenting, among other things, its scale.

Opis:
Dom rodzinny powinien być miejscem, do którego dzieci i młodzież chce wracać, a rodzice powinni być osobami, do których zawsze mogą zwrócić się o pomoc. Brak właściwych relacji z rodzicami niekorzystnie wpływa szczególnie na młodzież. Dlatego celem przeprowadzonych badań było określenie, jak nieletni z ośrodków kuratorskich funkcjonują w środowisku rodzinnym. Badania zostały przeprowadzone wśród nieletnich z ośrodków kuratorskich funkcjonujących przy Sądzie Okręgowym w Lublinie. Uzyskane wyniki wskazują, że badani nieletni nie mają poprawnych relacji z rodzicami i konieczne jest w ich przypadku prowadzenie działań profilaktyczno-wychowawczych, zarówno dla nich jak i ich rodziców.
The family home should be the place where children and youth want to return, and parents should be people to whom they can always turn to for help. Lack of proper relationships with parents in particular adversely affects youth. Therefore, the aim of the research was to determine how minors from probation centers function in a family environment. The study was conducted among minors from probation centers operating at the District Court in Lublin. The results obtained show that the examined minors do not have appropriate relationships with parents and it is necessary in their case to carry out preventive and educational activities both for them and their parents.

Artykuł analizuje prawne aspekty tworzenia i udostępniania materiałów pornograficznych przez osoby poniżej 18 r.ż., czynione wobec odbiorców z którymi pozostają w romantycznej relacji, jak i wobec osób anonimowych, za opłatą. Dodatkowo w artykule poruszono kwestię dostępu osób małoletnich do treści pornograficznych.
The development of the information technology has enabled the rapid progress of the societies but has also created some negative social phenomena, for example, the exposure of minors to the sexual activity too early, in inappropriate forms and without parental control. The article analyses the legal aspects of creating and making available pornographic materials by a person under 18 years of age, then sent to a recipient with whom he or she is involved in a romantic relationship, as well as to other people, to monetize on it. Additionally, the article analyses the issue of access to pornographic content by minors.

The main causes of leave behind their home for unaccompanied minors are fear of persecution, human rights violations, armed conflicts and civil unrest, sexual exploitation, domestic violence, abuse, severe deprivation, gender-based discrimination, forced military service, search for new opportunities, the intention of joining the family already staying in Europe. The main aim of the study is to give a short present of the asylum procedure the minors are passing through. Summarizes the barriers to access to asylum procedures, the role of the guardian, the legal, medical and social assistance system for asylum seeker minors and the possible outcomes of the procedure and opportunities of appeal.
Głównymi przyczynami pozostawienia domu za życia dla małoletnich bez opieki są obawa przed prześladowaniem, łamaniem praw człowieka, konfliktami zbrojnymi i niepokojami społecznymi, wykorzystywaniem seksualnym, przemocą w rodzinie, znęcaniem się, poważną deprywacją, dyskryminacją ze względu na płeć, przymusową służbą wojskową, poszukiwaniem nowych możliwości, zamiar dołączenia do rodziny już przebywającej w Europie. Głównym celem badania jest krótkie przedstawienie procedury azylowej, którą przechodzą małoletni. Przedstawia bariery w dostępie do procedur azylowych, rolę opiekuna, system pomocy prawnej, medycznej i społecznej dla osób nieletnich ubiegających się o azyl oraz możliwe wyniki procedury i możliwości odwołania.

This article deals with the legal processing of a serious problem regarding societal security, human rights and the rights of minors, i.e. child abduction. The procedure of the returning of an abducted child is one of the most challenging types of court proceedings. Courts decide within the statutory time limit of six weeks after filing the petition. There is a foreign element in the proceedings, embodied either by the parties to the proceedings or by the necessity of clarifying the child’s habitual residence. Translators or interpreters are recruited to guarantee the parties’ right to act in their mother tongues. The court, as a rule, executes and orders expert evidence within a short period of time, for example to determine the circumstances that rule out the return of the minor to his/her country. As a rule, hearings take place all day or several days in a row. Courts apply international treaties and EU law when making decisions. The difficulty of bringing proceedings is additionally increased by frequent requests from the court hearing the authorities of the Member State of the habitual residence of the minor. The return of the child is usually accompanied by tensions between the parties, emotions and stress.

Przedmiotem artykułu jest problematyka przesłuchania małoletniego świadka, ze szczególnym uwzględnieniem ewentualnego wpływu sugestii na treść dziecięcej relacji. Wskazanie, czym jest sugestia, i ocena, czy w istocie, zgodnie z utartym przekonaniem, małoletni są bardziej podatni na sugestię niż dorośli, stanowić będzie główny zakres rozważań prowadzonych w ramach niniejszej publikacji. Nadto w artykule podniesiona zostanie kwestia weryfikacji ewentualnego wpływu sugestii na treść dziecięcych zeznań, co będzie się wiązało z ustaleniem, czy w każdym przedziale wiekowym małoletni w równym stopniu podatni są na sugestię. Wreszcie podjęta będzie próba wskazania wytycznych procesowo-kryminalistycznych, które pozwolą prowadzącym przesłuchanie uniknąć ryzyka mniej lub bardziej sugestywnego oddziaływania na małoletniego świadka, umożliwiając uzyskanie wiarygodnej dziecięcej relacji. The article addresses the issue of hearing a minor witness, with particular emphasis on the possible impact of the suggestion on the content of the children’s reports. The main scope of this publication will be to indicate what a suggestion and assessment are and whether minors are in fact, according to the common belief, more susceptible to suggestions than adults. Moreover, the issue of verifying the possible impact of the suggestion on the content of children’s statements will be addressed, which will involve determining whether minors are equally susceptible to suggestion in all age groups. Finally, an attempt will be made to identify procedural and forensic guidelines that will allow interviewers to avoid the risk of more or less suggestive influence on the minor witness, enabling a credible child’s report to be delivered. All the considerations will be supported by references to literature and research, mainly U.S. – based, on the psychology of testimony, as this knowledge is essential for the effective and suggestion free hearing of a minor witness.
