The paper is a contribution to the in-depth research on the Russian local selfgovernment. The Author describes the process of formation and constitutional position of local self-government in the Russian Federation. He emphasizes that the process, at its initial stage at present, is related to the ongoing administrative reforms of the country and the creation of a single and effectively enforced nationwide legal area. He indicates the dilemmas both in the area of the material basis of existence of local self-government and its competences. The Author determines stages of self-government formation. Basing on normative solutions, he presents tasks of the Russian local self-government, its structure and authorities. He pays particular attention to the forms of citizens' direct participation in the management of local affairs.

The Internet is changing not only the functioning of the commercial media, but also local government media (issued, created by local governments, understood as offices, and not social organizations, local, etc.). The opportunity has arisen for municipalities to expand their communication with residents, tourists, investors through publications on their websites. They need to adapt to network media. To do this, local governments are creating their own editorial teams to prepare content to meet the needs of their customers, who are increasingly using mobile devices. Based on my own research I have tried to identify the environment of the media of local governments, what content they prefer (agenda topics), the tasks to be fulfilled by a municipal, urban contemporary website, and who creates it. An important element is preparing media for mobile devices, the use of which has a strong upward trend.

In the article two main issues are depicted: the evaluation of activities of voyts, mayors and also the evaluation of local government activities. In a research conducted from the end of 2018 until the beginning of 2019 we decided to verify 3 hypotheses. First one was: confidence towards the local government results from positive evaluations of voyts and mayors activities. The results were compared with the data from previous research. The second hypothesis assumes, that positive evaluation of local government activities is not connected to the activities of single executive body, but is connected to how the whole system of local government works. Third one, however, assumes that local government on the level of voivodeship is rated lower than city (commune) government. Relatively high level of satisfaction about the activities of voyts and mayors, that were recorded in 2012 research not only remained but even increased. This is the factor that strengthens confidence in local government and favors their positive evaluation. Also voivodeship governments are positively evaluated by the surveyed, however, the level of satisfaction is lower than those of other local authorities.

The article describes the role financial planning, in particular the role of multiannual financial forecasts, in the debt management process in the local government units. Theoretical and methodological considerations are supplemented by study of changes in budget categories related to local government debt, which took place between the multiannual financial forecasts prepared for the years 2013 and 2014. The analysis was performed for all units in general and more specifically for the voivodships. The article postulates that local authorities should ensure greater accuracy and continuity of their financial plans

The purpose of this paper was to present ideas related to the creation of a self-government party in Poland, bringing together representatives of local authorities, community activists and all those for whom the idea of local self-government built „from the bottom up” was close to their hearts. The idea of creating a local government party appeared several times in discussions of members of Liga Krajowa association, which was an active entity on the political scene, a member of Electoral Action Solidarity of the Right, from the list of which League had its parliamentary representation. These concepts first appeared at the basis of the association's formation and then had a close connection with its further presence on the political scene. The local government party was supposed to be an electoral platform with a specific right-wing and centre-right political orientation, as well as to be the most important support for representatives of local authorities, but all efforts in this regard failed.

This article presents, on the basis of the classification of actors of public policy presented by Suwaj and Wenclik, local government entities involved in the implemen-tation of public policies. Through examples of the functioning in practice, the image of the participants in local government is shown as “those that directly affect the shape of the (national) public policy, are directly involved in its creation”, a fact which results from belonging to the category of public administration. In turn, the remainder of the image is presented as local government entities “who are not directly involved in mak-ing decisions about the shape of public policy, although their opinions may be impor-tant in its shaping”. Such a view leads to the perception of municipalities, counties and provinces as entities “suspended” between the central authorities and the specific interests determined by local communities and the broadly understood local govern-ment sector.

From 20 to 21 April 2009, in the cinema room of the Town Hall in Toruń, there was a two-day National Academic Conference entitled “Local Government: What it Should be Like?”. The conference was organised by the Institute of Political Studies at the University of Nicolaus Copernicus (UMK). The session’s initiator, as well as the academic director, was Prof. PhD (Prof. Dr Hab.) Alfred Lutrzykowski, a specialist and an expert of the subject of local governments. The organiser of the session chose as his main goal to explain the idea of local government in a state, as well as to define the direction of local governments development in Poland and in the world. Local government is an important and inseparable element, which decides about the level of democracy of both society and the state. It constitutes an arena, on which both smaller and bigger interests of various social groups are defined, but it is also an area in which the interests can be fully presented.

At least once a quarter Polish media discourse is dominated by successive corruption scandals. Media and scholars are mainly interested in public power abuse on government level, whereas problem of corruption afflicts lower levels of authority, as well. Therefore, the author is going to analyze corruption threats which occur in Polish local government. The author will examine phenomena such as: officials’ corruption (man as the weakest part of the system), maladministration of European Union funds, embezzlement in infrastructural projects, machinations in the implementation of IT solutions and threats coming from unofficial arrangements between subjects participating in public auctions.

Local government is not free from dilemmas arising from ethical but illegal actions as well as legal, however, unethical ones. This breeds situations in which officials must decide whether to be loyal to the government authorities or citizens, whom they are obliged to serve. For instance, they must decide whether to accept the policy imposed by the district council making them change their clerical rules of conduct which, in their opinion, will be less favourably inclined to citizens. Consequently, they will be obliged either to take or refrain from taking certain actions, which stems from the inner imperative. At the root of this dilemma frequently lies a discord between law and ethics. The choice to be made leads to a moral dilemma. What is associated with this matter indeed is the question of revealing the truth about unethical, illegal, immoral or unlawful behaviour in the government that occurs with the employer’s silent approval. The so-called whistleblowing is the means to achieve it. The process is based on informing people or organizations who have the power to influence actions of the criticized individuals or organizations. This creates situations in which officials can no longer take advantage of two values and are made to choose only one of them.

The article provides an analysis of the essence, scope and basic determinants of the revenue autonomy of local government units in Poland. The considerations are theoretical, based on a critical review of the relevant literature and on the analysis of the most important legal acts determining the Polish legal and financial system of local government. What is worth emphasizing is that autonomy is the paramount value of local government. In accordance with Polish constitutional law, local government bodies participate in the exercise of public authority, perform public tasks in their own name and under their own responsibility, and require autonomy that is subject to judicial protection. The autonomy of local government units is a complex and multifaceted issue. It can and should be considered with regard to legal, organizational, political, property, economic and financial aspects. Financial autonomy, especially in terms of revenues, plays a significant role in activities and development prospects of local government units.

This part of the report describes two problems: evaluation of the activities of reeves, mayors and presidents of cities and the problem of representing the interests of the residents by local governments. In a survey conducted in late 2012, we decided to verify two hypotheses. By the first, trust in local government results from the positive evaluation of reeves, mayors and presidents of cities activities. Second hypothesis assumes that trust is founded by the belief of the local community members, that the local governments represent their interests. The results indicate that the majority of the respondents are restrainedly satisfied with the activities of their reeves, mayors and presidents of cities. However, the majority of respondents said that local governments do not represent their interests.

The recent economic crisis had a significant influence on the activities of public sector entities at both central and local levels. This research paper shows an analysis of changes in investments, debt and productivity of local governments in European Union countries in the years 2003-2012. During the crisis period, local governments performed a visibly positive role from the perspective of the countercyclical policy of the public sector. In the years 2009-2010, the share of local government investments in total investments (GFCF) grew to 10%. The active investment policies of local governments resulted in their higher indebtedness. Average annual net borrowing amounted to 0.5% of GDP per country during the crisis period. Although the borrowing was for purely investment activities, it was not noticeably correlated with an increase of productivity. In addition, after productivity growth in the 2008-2009 period, the subsequent years experienced an overall decrease of local government sector productivity. Further analysis showed a relative deterioration of the financial position of local governments regardless of their productivity profile. Taking into consideration the lasting fiscal strains, further stimulation of the economy with debt instruments appears an unsustainable policy for local governments, both in the context of future debt repayments, as well as the failure to lead to increased productivity.

Creation of new foundations for local government after regaining independence covered in practice only the former Russian partition. In remaining areas of the Reborn Republic of Poland, it was decided to temporarily preserve the administrative structures remaining after the former partitioners, adapting them only to the extent necessary. The first legal actions were the decree of the Head of the Polish State of 27-th November 1918 on the establishment of municipal councils in the area of former Congress Kingdom. There were two levels of self-government – rural communes and municipalities and the poviat. In the Prussian partition there were three levels of self-government – municipal (rural and urban), poviat, and at the highest level, there was a provincial council with an executive body. Structure of self-government in the area of former Austrian partition varied depending on the Crown Country. In Galicia and in Cieszyn Silesia showed many similarities.
Tworzenie nowych podstaw samorządu terytorialnego po odzyskaniu niepodległości objęło w praktyce jedynie były zabór rosyjski. Na pozostałych terenach odrodzonej Rzeczypospolitej zdecydowano się na czasowe zachowanie struktur administracyjnych, pozostałych po byłych zaborcach, dostosowując je jedynie w niezbędnym zakresie. Pierwsze działania prawne stanowił dekret Naczelnika Państwa Polskiego z 27 listopada 1918 r. o utworzeniu rad gminnych na obszarze byłego Królestwa Kongresowego. Funkcjonowały dwa szczeble samorządu – gmina wiejska i miejska oraz powiat. W zaborze pruskim istniały trzy szczeble samorządu – gminny (wiejski i miejski), powiatowy, a na najwyższym szczeblu sejmik prowincjonalny. Struktura samorządu na terenie byłego zaboru austriackiego była zróżnicowana w zależności do kraju koronnego. W Galicji i na terenie Śląska Cieszyńskiego wykazywał wiele podobieństw.

The aim of the study is to compare the institutional solutions and practical activities of the government and local government administration in two periods: the Second and the Third Republic of Poland. Because of the need to refer to the documents from the period of the Second Republic of Poland, it was necessary to refer to the historical method. The study is based on the comparison of two orders from different periods, therefore it was necessary to use the comparative method for the purpose of the analysis conducted. In the study also a system approach was applied to the analysis of institutional solutions. Decentralist and centralist concepts clashed both in the period of the Second Republic of Poland and during the political transformation. The beginnings of the political change were characterised by the predominance of naturalist tendencies, while in the further stages of the development of the Polish state there were growing tendencies to increase the omnipotence of the state.

Within the existing model of control in local government, the domineering position was held by a legislative and controlling body, realising its controlling functions mainly through an audit commission, other commissions and in pleno. Its control extended over the activity of the executive body, local government organisational units, and – within a municipality – auxiliary units. Within this model, a councillor did not have any statutory individual controlling competences. The Bill on Amending Certain Acts in Order to Increase the Participation of Citizens in the Process of Electing, Functioning and Controlling Certain Public Bodies (print no. 2001 of 10 November 2017; www.sejm.gov.pl) has given the councillors aset of competences in the area of controlling, which cannot be subject to clear assessment. Without any doubt, a positive aspect is giving the councillors the right to make major parliamentary questions and queries, which until now has only been granted in the bylaws of local governments. However, granting the councillors individual controlling rights shall be deemed negative. The basic drawbacks of this solution give us the basis to conclude that they will not have a negative impact on the image of a councillor as a member of a legislative and controlling body, and – in consequence – on the image of the local government among local communities.

As a part of the public administration, local government represents one of the forms of decentralization. It is primarily based on constitutional principle of subsidiarity, autonomy in realizing its tasks and responsibility for their realization. The basic units of the territorial administrative division under the Polish legislation, municipalities and cities, have an important role to play here. These units have legal personality, judicially protected independence, and receive funds from public income which makes them independent from other government bodies and from the state. Nevertheless, cities are not sovereign in decision taking or law making processes and they merely carry out state enforced tasks. This structure strengthens the supervisory role of the central administration which is primarily focused on verification. The modern world enforces decentralization processes. The development of cities is based on active adaptation of innovations offered by information societies. At the beginning of the XXI century, municipal governments were indirectly forced to introduce new forms of public and local management. The fundamental dimension of these forms is embodied in a symbolic transition “from administration to management”.

The author provides an analysis of the phrase “the closest municipality or district”, which appears in Article 90 para. 3 of the Act and points out – following the Supreme Administrative Court – that it has the traits of a vague concept and does not always have to mean a neighboring (the closest) municipality or district. It may also refer to the municipalities with similar demographic or economic characteristics. In addition, it was pointed out that the correction of the annual settlement of grants provided by the local government unit for a private school under the provisions of the Tax Code are not permitted.

The diversity and variability of the forms of local government in the United States is a function of the federal form of the state and the broad powers of state authorities towards their administrative units, but also flexible legal solutions that enable citizens to influence the form of local government and their pragmatic attitude towards institutional solutions. The types of units of local government in the United States were described. Particular attention was paid to municipal corporations and their institutional forms, which exemplify the paper’s topic.

The aim of the article is to assess the currently effective limiting mechanisms for debt incurrence capability of Polish local government units (LGU), which is based on the size of the generated operating surplus. Moreover, the article includes a verification of a hypothesis stating that from 2011, the level of operating surplus significantly influences the investment decisions of LGUs. The article also skeptically scrutinizes the introduction of the operating surplus generation imperative with reference to the LGU subsector (a legal ban of deficit in the current part for LGUs) without similar restrictions regarding the central subsector, which was responsible for about 93% of total public debt in 2001-2016. The methodology applied includes statistical data analysis, as well as a dogmatic-legal method. The dependence of debt incurrence capability on generated operating surplus is to be positively appraised – the financial ratio which incorporates the size of the surplus is an indicator that defines a safe level of debt and therefore accurately reflects the financial condition and credit capabilities of LGUs. This value determines, not only the formal, but also the real credit capability of the unit. The reform of the LGU finance system without any additional constraints on the central level will not lead to the general rejuvenation of the public finance.

The subject of the article is the media image of the local government elections of 2018, which allows to draw representative opinions of the media elites’ representatives and showing the mainstreams of the political dispute, which appeared during the election campaign. The research covered the most important opinion weeklies in Poland, i.e.: “Newsweek”, “Polityka”, “Wprost”, “Gazeta Polska”, “Do Rzeczy”, “Sieci”. Communication on the local government level may take place in different ways, using different channels. One of them is the press that is either created by local governments or through their order. The authoress has attempted to show this press from the media perspective. Analysing the selected titles, she has tried to show its content both from the sender’s and the recipient’s point of view. The linking of the content and the ways of its transmission turned out to be particularly interesting, and so – the possibility of the impact on the recipient, in combination with the editorial teams’ characteristics. The local government press came into being even before the first local elections in 1990. Then it seemed that it would not play a significant role in the entire press system. Over the time, it turned out that it had been developing dynamically, increasing the number of its titles every year. It has existed up till now to the disappointment of many circles. The publishing activity of local governments usually livens up during the election. It is obvious that the existing borough leaders, mayors, starosts want to present their achievements, to show the residents that they keep their promises. A large proportion of them do it very effectively, as evidenced by the elections won in subsequent terms. In shaping their own image and the image of local governments that they lead, they are helped by the appointed press spokesmen who used to be regional or local media journalists, or the workers subordinated to cultural institutions or local governments. It might seem that most reliable success would be guaranteed by professionals – editors who have many years’ work experience. However, it appears that such a simple relationship does not exist. The analysis of the content of messages indicates the selective information to recipients about local matters, mainly about the activities of the authorities. The overall image of the district, county, province emerging from the published material is definitely positive. One should not expect another vision if the press, in its assumptions, is designed to promote the region, county and province.

Reprezentacja interesów polskich regionów (województw) w Unii Europejskiej (Brukseli) nabrała istotnego znaczenia w aspekcie ekonomiczno-politycznym przede wszystkim w związku z akcesją Polski do tej organizacji międzynarodowej w 2004 r. i możliwością skorzystania z funduszy UE. Wyzwaniem prawno-organizacyjnym dla polskich jednostek samorządu terytorialnego było prawidłowe, zgodne z przepisami prawa, utworzenie przedstawicielstwa zagranicznego oraz jego funkcjonowanie. Celem artykułu było przedstawienie aktualnego statusu prawnego funkcjonujących przedstawicielstw zagranicznych polskich j.s.t. w Brukseli ze szczególnym uwzględnieniem regionów Polski Zachodniej. W artykule przedstawiono modele prawne tworzenia struktur regionów, w sytuacji gdy przepisy prawa krajowego i międzynarodowego publicznego nie odnoszą się wprost do tej problematyki. Analizy problemu dokonano przede wszystkim w oparciu o polskie przepisy ustaw ustrojowych dotyczących regionów, akty normatywne wewnętrzne, doktrynę oraz badania własne autora w postaci informacji publicznej.
Representation of the interests of Polish regions (voivodeships) in the European Union (Brussels) acquired significant importance in economic and political terms primarily in connection with Poland’s accession to this international organization in 2004 and the possibility of benefiting from EU funds. The legal and organizational challenge for Polish local government units was the correct legal compliance with the law of the establishment of a foreign representative office and its operation. The purpose of the article was to present the current legal status of the functioning foreign representative offices of Polish local government units in Brussels with particular emphasis on the regions of Western Poland. The article presents legal models for the creation of structures of regions in a situation where the provisions of national or public international law do not directly refer to this problem. The analysis of the problem was made primarily on the basis of the Polish provisions of constitutional acts concerning regions, internal normative acts, doctrine and the author’s own research in the form of public information.

Opis:
The article presents the issues of effective management of local government debt. Local government debt can be seen as an effect of accumulated budget inequality. The considerations in the article concern the analysis of the sources of financing the activities of local government units and the effectiveness of their use in the context of maintaining an appropriate level of liquidity and meeting statutory standards. For this purpose, financial data of local government units for the years 2010–2020 were examined. The study was enriched with the results of research on the budget policy of municipalities on which the authors worked in previous years. It made it possible to trace the tendencies in the field of debt policy in local government units and to establish the challenges faced by representatives of local government authorities.
