An analysis of the amendments to the Act is focused on the introduction to the Polish labour law of a prohibition against issuing promissory notes, a declaration of submission to enforcement procedure and acknowledgment of debt as means to secure the claims of the employer against an employee arising from the employment relationship. The author gives a positive opinion on the general direction of changes proposed in the bill, due especially to the need to achieve axiological coherence of the legal system. However, he calls into question the relevance of the choice of instruments to be used for this purpose, According to the author, particularly, the acceptance of the effect in the form of invalidity of a promissory note issued by an employee to secure future claims of the employer would constitute a breach of the Convention, binding the Republic of Poland, providing a Uniform Law for Bills of Exchange and Promissory Notes.

The suggested amendment to the Labour Code aims to introduce a provision obliging employers to include periods of non-agricultural activity in the periods on which employee benefits or rights depend. The provision is to be placed in the chapter declaring fundamental principles of labour law. The author states that there is no systemic justification for including this type of norm among the basic principles of labour law, without taking into account the currently used differentiation of the position of employees in specific situations. In her opinion, the proposed regulation raises doubts from the perspective of the constitutional principle of equality, especially in the context of adequacy and proportionality to the assumed goal.

Currently, in the workplaces, the issues of behaviours classified as unethical or a violation of an employee’s dignity and personal rights are on the rise. Mobbing is one of the manifestations of such behaviours, described in the provisions of the Labour Code. The phenomenon of mobbing refers to the quality of interpersonal relationships at work and affects the operation of the entire organizational structure. This is a severe example of the violation of personal rights because such harassment is no less than a psychological terror affected by one or more persons against (typically) a single individual. The aim of this study is an analysis of mobbing, especially as regards the employer’s obligation to oppose mobbing practices. Ethical behaviour towards staff is not only a condition for observing the principles of community life in the work environment but it is the building block for creating a positive image of the employer in the business community. Mobbing behaviour impacts an organization’ image and poses several financial costs.

This study concerns the ethical problems of personal data protection at work. The aim of this project is the analysis of the law structures, which determine the range of protection personal data of the employee and the candidate to work and the rights of data collecting and processing by the employer. The employee privacy protection at work is the principle of labour law expressed in Article 11 of the Labour Code. However personal data protection problem is directly regulated by Article 22 of the Labour Code, which entitle employers to demand certain personal data from the employees and the candidates to work. The regulation determine the list of data, which may be the subject of legal actions by employer in the field of collecting and processing of personal data. The most important issue is connected with the treatment of sensitive information, such as health data, drug testing and genetic testing, sex life, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership. Personal data protection means the necessity of cooperation between the employee and the employer not only in the field determined by the law but on the basis of ethical values as well. Hence the employer’s obligation to keep from actions which directly interfere in employee’s protected personal effects. But the employee is obliged to give true information about himself in order to protect his health and life at work.

Currently, in the sphere of relationships at work, the issue of behaviours classified as unethical, which cause the violation of the employee’s dignity and other personal rights, is increasing. Mobbing is one of the manifestations of such behaviours described in the provisions of the Labour Code. The phenomenon of mobbing refers to the quality of interpersonal relationships at work and affects the operation of the entire organisational structure of the employer. This is the most severe example ofthe violation of personal rights because this is a kind of harassment, namely psychological terror effected by one person or more against (typically) one person. Thus, the subject of the study is an analysis of mobbing especially with regards to the employer’s obligation to oppose mobbing practices. Ethical behaviour towards staff is not only the condition of observing the principles of community life in the work environment, but is a building block for creating a positive image ofthe employer in business. Therefore, such behaviours as mobbing, which endanger that image, pose a significant problem for the employer and bring about severe effects, also for finance.

The article was made to analyze the causes as the basis for the introduction of the appointment of an employment relationship to the Polish legal system and the evolution of its subjective scope. Launched in the era of communist organization as a basis for the establishment of Staff Employment, taking into account the personal scope of its application and the content of the employment relationship has come a long way. At the same time, it is clear that he still works in the institutions and bodies whose characteristic activity is back on the tried and trusted people and the possibility of taking an immediate decision on the removal of the employee from his tasks. The article indicates groups of positions covered by appointment and justification for leaving the base of the employment relationship in the Labour code in spite of far-reaching political changes.
W artykule została podjęta analiza przyczyn wprowadzenia do polskiego porządku prawnego powołania jako podstawy nawiązania stosunku pracy oraz ewolucja jego zakresu podmiotowego. Zapoczątkowana w epoce PRL instytucja powołania jako podstawy pracowniczego zatrudnienia, biorąc pod uwagę zakres podmiotowy jej stosowania i treść stosunku pracy, przebyła długą drogę. Jednocześnie należy stwierdzić, że wciąż sprawdza się w instytucjach i organach, których cechą charakterystyczną działania jest oparcie na sprawdzonych i zaufanych osobach oraz możliwość podjęcia natychmiastowej decyzji o odsunięciu pracownika od powierzonych mu zadań. W artykule wskazano grupy stanowisk objętych powołaniem oraz uzasadnienie pozostawienia tej podstawy nawiązania stosunku pracy w Kodeksie pracy, pomimo daleko idących zmian ustrojowych.

The proposed bill contains a new solution regarding “including information on the proposed amount of gross salary” (or indicating the so-called pay range) in the offers of employment for an employee in a given position. In the author’s opinion, proposals regarding levelling rights of employees – other members of close family taking maternity leave (or parental one) – with rights of an employee – father raising a child, extending deadline for an employee to apply for correction of a work certificate, and applying to a labour court for correction of this document are justified. Significant doubts are related to introduction of the possibility of issuing by the court a decision replacing the certificate of employment. Finally, a positive opinion concerns the proposed amendment to Article 1050 of the Code of Civil Procedure, consisting introduction of the principle that enforcement of non-pecuniary benefits in the field of labour law, may be carried out before a court of an alternating jurisdiction, what will facilitate a lawyer submission of an application for such enforcement.

Rest leave regulations have significantly changed during the 40 years of the Labour code validity. The necessity of adapting the law to the free – market economy requirements and European Union law standards have been the foundation of those changes. The aim of the article is to present the general characteristics of the new legal provisions concerning acquiring the right to rest leave and its length as well as the principles and the procedure for granting and using rest leave.
W ciągu 40 lat obowiązywania Kodeksu pracy regulacje prawne dotyczące urlopów wypoczynkowych uległy dość istotnym zmianom. Ich podłożem była przede wszystkim konieczność dostosowania przepisów tego aktu do wymagań gospodarki wolnorynkowej oraz do standardów wynikających z prawa unijnego. Celem artykułu jest ogólna charakterystyka nowego kształtu unormowań odnoszących się do nabycia prawa do urlopu wypoczynkowego i jego wymiaru oraz zasad i trybu udzielania i wykorzystywania urlopu wypoczynkowego.
