    Opis:
    The proposed liquidation of the Church Fund is justified, among other things, by high amounts that churches and other religious associations receive from the state budget and the thesis that the Church Fund makes Poland a confessional state. The author verifies the above arguments on the basis of quoted statistical data on funds spending from the Church Fund in the 21st century and the analysis of the nature and purpose of the establishment of the Church Fund. The data include the budget of the Church Fund and sums transferred for individual purposes and their share in the budget of the Fund. The article also touches on the location of the Church Fund in the Polish system of financing churches and other religious associations and the evolution of its goals.

    Fundusz Kościelny ustanowiony na mocy ustawy z dnia 20 marca 1950 r. o przejęciu przez Państwo dóbr martwej ręki, miał stanowić masę majątkową utworzoną z dochodów z dóbr kościelnych, przejętych przez państwo od kościołów i innych związków wyznaniowych. Jednakże Fundusz ten do dziś jest finansowany z budżetu państwa, co w kontekście rozwiązań przyjętych w innych państwach europejskich stanowi pewien anachronizm finansowania instytucji kościelnych. Chcąc rozwiązać Fundusz Kościelny należy zachować zasadę bilateralności, wynikającej z art. 25 ust. 4 i 5 obowiązującej Konstytucji oraz art. 22 ust. 2 Konkordatu. Jako potencjalny wzorzec wskazuje się model włoski, z zachowaniem odpowiednich zmian dostosowując do warunków polskich. Jednak do czasu wypracowania rzetelnego i kompletnego modelu finansowania instytucji kościelnych w Polsce, należy zachować dotychczasowe działanie omawianego funduszu, ponieważ jest on formą rekompensaty za zabrane i niezwrócone dobra. Ponadto próba wypracowania całościowego systemu finansowania instytucji kościelnych w Polsce winna doprowadzić do przyjęcia regulacji prawnych odpowiadających w szczególności ustrojowym zasadom: poszanowania autonomii, niezależności, sprawiedliwości społecznej oraz współdziałania dla dobra człowieka i dobra wspólnego.
    The Church Fund was established under the act of the 20th of March 1950, to acquire the property from dead hands. It had a mass of property made up of income from church property acquired by the state, from churches and from other religious associations. Today however, the Fund is financed from the state budget which in the context of the solutions adopted from other European countries is an anachronism of financing ecclesiastical institutions. In order to solve the Church Fund, it is necessary to retain the principle bilateral resulting from the article. paragraph 25. 4 and 5 of the existing Constitution and art. paragraph 22. 2 Concordat. Potentially a good example is the Italian model with appropriate changes and adapted to polish conditions. However, until a fair and comprehensive financing model of ecclesiastical institutions is put in operation in Poland the current operation of the fund should be kept because it is compensation for goods received and not taken. In addition, an attempt to develop a comprehensive financing system of ecclesiastical institutions in Poland should lead to the adoption of the corresponding legal regulations and in particular the systemic principles: respect for autonomy, independence, social justice, and cooperation for the individual and the common good.

    Artykuł opisuje nieznany dotąd aspekt finansowania budownictwa sakralnego w okresie PRL. Prezentowane zagadnienie ma na celu wypełnienie luki w dotychczasowej historiografii. Żadna z powstałych dotąd publikacji nie odnosi się do badanego problemu widzianego z perspektywy stosunków państwo–Kościół po 1945 r. Niniejsza praca ukazuje zatem trudności związane z pozyskiwaniem funduszy na budowę nowych świątyń w okresie hamowania lub zwalczania przez władze tzw. Polski Ludowej wszelkich inwestycji sakralnych. Represyjne i dyskryminujące stronę kościelną przepisy prawne miały na celu utrudnianie wznoszenia miejsc kultu religijnego, co pośrednio miało także przyczynić się do zniechęcenia duchownych do podejmowania tego rodzaju działalności. Z kolei „usłużnych” księży nagradzano za ich lojalną postawę wobec rządzących przydzielaniem na drobne prace budowlane subwencji z powołanego m.in. na ten cel Funduszu Kościelnego, będącego pod kontrolą Rady Ministrów. Wszystkie te czynniki powodowały, że największy koszt budowy kościołów ponosili świeccy katolicy, organizujący na własną rękę zbiórki publiczne, narażając się tym samym na karę grzywny. Trud ponieśli także księża parafialni, którzy wykorzystując zagraniczne znajomości zdobywali pieniądze na kontynuowanie prac budowlanych.
    The article describes unknown aspect of financing sacral building industry in the period of PRL (Polish People’s Republic). Presented issue is aimed at filling the gap in the existing historiography. None of the publications that have been published does not addresses the problem, seen from the perspective of the relations state–Church after the year 1945. This work therefore shows the difficulties associated with raising funds for the construction of new temples in the period of inhibition or fighting with any sacred investments by the authorities of Polish People’s Republic. The repressive and discriminatory for the Church legal provisions aimed at obstructing the construction of places of worship, which was also supposed to discourage clergymen from undertaking this type of activity. In turn, the „service-minded” priests were rewarded for their loyal attitude towards those in charge of allocating subsidies for minor construction works from the Church Fund, which was under the control of the Council of Ministers. All these factors meant that the greatest cost of building churches was borne by lay Catholics who organized public collections on their own, thus risking a fine. Also the parish priests also faced difficulties, while gaining money to continue construction works by using foreign contacts.

    Opis:
    This article analyses the contemporary legal situation of the churches and religious societies position in the Czech Republic, in the context of the newly approved Law No 428/2012 Coll., the property settlement with churches and religious societies of 2012/12/5, which came into effect on 2013/1/1. The process to this law was very difficult and lengthy. The law itself contains a natural restitution and a financial compensation as well. Newly configured model is based on a combination of a law and agreements with individual churches. This model tries to resolve a historic church property and also separate the churches and religious societies financial holding from the state in the future, and enable a churches financial self-sufficiency. Also, the article analyses new specific instruments of the Catholic Church, which are established for the management of its property in the Czech Republic.

    The Church Fund is an important institution in the history of Church–State relations in the period of the Polish People’s Republic. The book under review analyzes a broad range of so far under-researched documents of the Office for Religious Denominations and presents the functioning of the Church Fund in the period 1950–1989. The study reports previously unpublished data regarding specific financial operations of the Church Fund, demonstrating that the Church Fund was used instrumentally and its funds were used for non-statutory purposes. The book is a compendium of knowledge about the regulations concerning the Church Fund between 1950 and 1989 and its activities during that period, valuable both for readers who would like to learn about the institution of the Church Fund, but also for experts looking for the relevant detailed information.
