Purpose: The paper presents a review of the latest research on executive compensation and indicates the main problems and weaknesses of the existing solutions as well as trends for the future. Methodology: In the analysis executive compensation constitutes a crucial element of corporate �governance. The analysis is based on a review of the latest studies and research on the effectiveness of executive compensation referring to its size, structure and disclosure. Findings: The paper presents the latest fi ndings in the practice of executive compensation and it points to the extension of the period of time giving rise to the payment of cash bonuses, the introduction of a range of different indicators, based on which executives are evaluated, simplifying compensation packages, the implementation of deferred payments, the introduction of the “say on pay” rule and clawbacks. Practical implications: The analysis points out the main weaknesses of executive compensation, which were particularly emphasized in research studies on companies affected by the fi nancial crisis. The paper presents a wide range of suggested solutions that could be implemented in the fi eld of executive compensation in order to provide for a better alignment of the interests of executives with those of shareholders and for the increase in shareholder value. Originality/value: The paper attempts to identify the most severe corporate governance problems with reference to executive compensation and to confront them with research results as well as the recently proposed and implemented reforms and recommendations.

Executive functions in older adults of various level of educational needs In old age the decrease of cognitive performance connected with natural ageing processes is observed. The deterioration primarily affects memory and attention functions (Jagodzińska, 2008; Oberauer, 2006). It was indicated that the level of cognitive competences is strongly connected with learning (Brooks, Weaver, Scialfa, 2006). People in old age who are more intellectually active have less problems in cognitive functioning (Jagodzińska, 2008). The article presents results of studies conducted to verify hypothesis concerning the relation between the level of educational needs and efficiency of their executive functions. 25 people, aged 71-88, participated in the study. Educational needs and four aspects of executive functions: plasticity, inhibition, working memory and planning were measured. Results confirms the relationship between educational needs of seniors and two aspects of executive functions: plasticity and working memory, while the most significant relations concerns plasticity.

We predicted that short-term training of executive control would improve both cognitive control itself (Hypothesis 1) and general fluid intelligence (Hypothesis 2). We randomly assigned 120 high school students to the experimental and control groups. The former underwent a 14-day training of four executive functions: interference resolution, response inhibition, task switching, and goal monitoring. The latter did not train anything. The training significantly improved cognitive control and IQ. The control group also improved their IQ scores but gained less than the experimental one. However, the amount of IQ scores enhancement did not correlate with the majority of indices of the training effectiveness, thus justifying the supposition that such enhancement resulted from the general effect of participation in the training rather than from the improvement of executive functions underlying Gf.

The author indicates that the provision of the aforementioned law is inconsistent with the provisions of the Constitution and the Convention for the Protection of Human Rights and Fundamental Freedoms. This provision includes the power of a executor who executes mortgage foreclosure, who is obliged to remove an indebted and his household members, where no premises for relocation were indicated to the indebted, or where he is unable to meet his own housing needs. The applicant questioned the constitutionality of legislative omissions, in the result of which there is a possibility of conducting executive proceedings in the administration regarding eviction from residential premises “on the street”.

Wynagrodzenie najwyższej kadry menedżerskiej zalicza się do najważniejszych mechanizmów nadzoru korporacyjnego i, rekomendując określoną wielkość, strukturę i rolę poszczególnych komponentów płacy, odgrywa istotną funkcję motywacyjną. Pomimo iż dorobek płacy menedżerskiej wraz z jej funkcją motywacyjną stanowi jedno z najistotniejszych osiągnięć dla łagodzenia konfliktu między pryncypałem a agentem, praktyki przedkryzysowe wskazują na poważne słabości stosowanych rozwiązań. Słabości dotyczące kwestii wielkości pakietów wynagrodzenia, polityki przyznawania premii, konstrukcji programów motywacyjnych i udziału komponentu ruchomego są uznawane za czynniki, które przyczyniły się do wybuchu kryzysu finansowego. Celem artykułu jest zidentyfikowanie głównych słabości praktyki wynagrodzenia najwyższej kadry menedżerskiej oraz odniesienie ich do aspektów etyki biznesu. Intencją autorki jest wykazanie, iż nieodpowiednia implementacja rozwiązań w zakresie płacy menedżerskiej stanowi nie tylko problem nadzoru korporacyjnego, lecz także obejmuje poważne dylematy etyczne i kwestionuje fundamentalne założenie funkcjonowania przedsiębiorstwa.
Executive compensation is one of the most important corporate governance mechanisms which plays an incentive function suggesting the adequate size, structure and various components of the pay. Despite the fact that the evidence of executive remuneration motivational function is viewed as the crucial solution to the principal agent conflict, its pre-crisis practice indicated severe shortcomings. The inefficiencies of executive compensation practice related to the package size, bonus policy, incentive programs and the proportion of the variable component are viewed as the significant contributor to the outbreak of the financial crisis. The aim of the paper is to identify these elements of executive compensation which proved to be detrimental for shareholders and to relate them to business ethics. The article intends to show that that the misuse of executive remuneration is not only the corporate governance problem but incorporates severe ethical dilemmas questioning the fundamental assumption of the company functioning.

The aim of this article is to analyse the impact of dual executive with the president elected by popular vote on the democratic transformation of post-communist countries of Europe and Eurasia. For this purpose following hypothesis was investigated: the system of government based on dual executive is a threat to democratization. Accepting that this process consists of three parallel transitions (political, economic and social), the author examined the impact of dual executive on the results of post-communist countries of Europe and Eurasia in two indexes: Revised Polity Score and Economic Freedom of the World. Thanks to this study some conclusions could be drawn pertaining to the impact of the system based on dual executive on the effects of the democratization of selected countries in political and economic areas. This allowed following question to be an-swered: is it a fact that a system of government based on dual executive with a president elected by popular vote is a threat to democratization?

Cognitive problems and a deepening dependence on one’s immediate environment inherently accompany Duchenne Muscular Dystrophy (DMD). The disease is progressive, and the size of the dystrophin gene determines the extraordinary complexity of the causes of this disease at the genetic and molecular level. The aim of the study was to characterize the cognitive problems and the extent of independence of patients with genetically confirmed DMD. An attempt was also made to reconstruct the patient's life history in three periods: before the appearance of the first symptoms, during the search for a diagnosis and after confirming the diagnosis of DMD. The study group consisted of male patients between 10 and 13 years of age (N = 14). The Diagnosis of Cognitive Functions Battery - PU1 and an experimental tool for studying autonomy were used. Information on the condition of the attention, memory and executive functions of patients was obtained. The study of autonomy measurably supplemented knowledge in terms of the degree of the patients’ dependence on the environment with regard to everyday functioning. The best functioning component of attention in the examined patients is orientation (o) (13 patients achieved average results in this aspect). Selectivity (s) turned out to be the weakest component, as only five patients obtained average results (the others obtained low results) in this aspect. Autonomy results (AU) indicate group diversity and inter-subject variability in the disease progression (subjects scored from 6 to 47 points). The clinical picture of the disease is not homogeneous. Patients, despite their similar age, differ in the progression of the disease and the resulting effects. This induces the need for an individual approach to each patient and the preparation of a unique set of therapeutic interactions for each of them.

Different authors at different times have given an unequal definition to the term of public administration compared to what it is used today. The author Georges Vestel has defined the public administration as “the set of activities aimed at maintaining the public peace and meeting other needs of the general interest. This definition corresponds to the etymology of the term administration - “administration” which means “to serve”. But Jean-Jacques Rousseau in his work, Social Charter, defined the public administration under the government term. He stated that: “I call a government or a supreme administration the legitimate exercise of the executive power. Some authors use “administrative” and “executive” terms in an alternate way, with the same meaning. Other authors make a clear distinction between terms. They define the state administration as “an activity which is carried out for the concrete fulfilment of the functions of the state and the duties of the organs of the state administration”. So these authors distinguish the state administration from the executive activity which the executive bodies perform. The paper aims to suggest a set of strategies and improvements by starting from a theoretical background of the definition of power balance and separation in public administration and governing bodies and its evolutionary definition over time, and by reflecting those findings as a set of suggestions, by considering the actual Albanian Code of Administrative procedures, strategies and practices.

Individual differences in second language acquisition (SLA) encompass differences in working memory capacity, which is believed to be one of the most crucial factors influencing language learning. However, in Poland research on the role of working memory in SLA is scarce due to a lack of proper Polish instruments for measuring this construct. The purpose of this paper is to discuss the process of construction and validation of the Polish Listening Span (PLSPAN) as a tool intended to measure verbal working memory of adults. The article presents the requisite theoretical background as well as the information about the PLSPAN, that is, the structure of the test, the scoring procedures and the steps taken with the aim of validating it.

Montesquieu’s idea of the tripartite system already expressed a concern with preventing one power from dominating excessively. Another argument for the collegial nature of power is the concern with the continuation of state authorities at the time of crisis (e.g. the tragedy in Smoleñsk). The idea of collegial executive power emerged already in antiquity as evidenced by the two kings in Sparta, the collegiums of archons in Athens, two consuls in the Roman Republic, or the system of tetrarchy, initiated by Diocletian. At present we have the ‘rotating presidency’ in Bosnia or the French principle of ‘cohabitacion’.

The study assessed whether students who contracted COVID-19 and did not fall ill differed in coping strategies. The study comprised 111 participants, including 55.9% who were infected and 44.1% who were not. It consisted of online (49.5%) and blended mode learners (50.5%) aged 19 to 31. We used the Brief COPE Inventory to assess ways of coping with stress. Among online students, 65.5% fell ill, while less than half of blended mode learners got sick. Students who contracted COVID-19 were more likely to use maladaptive coping strategies, and respondents who did not become ill were more likely to use adaptive strategies.

Cerebral stroke is the very common cause of executive dysfunctions, such as disinhibition and inability to switch of attention. The aim of this longitudinal study was to determine a clinical characteristic of executive dysfunctions in light of the neuropsychological examinations. Forty-four patients who had ischemic stroke were examined twice with a twelve-month interval. At each session executive functions were measured on the same patients. Executive functioning was measured by three popular tasks, i.e. an experimental version of the Stroop Color- Word Interference Test, Verbal Fluency Test, and Trail Making Test. Twenty-five healthy volunteers were examined once only to transform patients’ results of neuropsychological testing into standardized form. Executive impairment was found in 24 patients (i.e. 65% of the clinical group), who failed to complete at least one of the three tests. Patients manifested executive dysfunctions which were highly heterogeneous with respect to character, severity and their prevalence. Overall, there was clear evidence that executive functions showed substantial recovery. Timecourse of distinct executive dysfunctions was similar.

The paper delineates a study of executive functions (EFs), construed as procedural working memory (WM), from a motivational perspective. Since WM theories and motivation theories are both concerned with purposive activity, the role of implicit evaluations (affects) observed in goal pursuit can be anticipated to arise also in the context of cognitive control, e.g., during the performance of the Stroop task. The role of positive and negative affect in goal pursuit consists in controlling attention resources according to the goal and situational requirements. Positive affect serves to maintain goals and means in the scope of attention (EF1), whereas negative affect activates the inhibition of non-functional contents, e.g., distractors and irrelevant objects (resulting in attention disengagement; EF2). Adaptation to conflict proceeds via sequential triggering of negative and positive affect (EF3). Moreover, it was demonstrated that the focus on action or reflection changes the scope of contents subjected to implicit (affective) control. Therefore, I suggest that the motivational system, to a large extent, plays the role of the Central Executive. The paper opens a discussion and proposes studies on affective mechanisms of cognitive control.

Theory of mind (ToM) refers to the ability to represent the mental states of others. The Executive Function (EF) refers to higher-level cognitive processes encompassing planning, inhibition, coordination, shifting, and coordination of action sequences. Current studies on ToM and EF suggest that these two cognitive abilities might be functionally or anatomically linked. Although the relation between ToM and EF has been widely investigated, the results remain inconclusive particularly when considering the functional architecture of a mature brain system. The present study aims to seek this lacuna with the use of neuropsychological methodology. The pattern of ToM and EF defi cits within patients with brain injury were investigated. We compared the performance of four patients with a set of tasks examining theory of mind abilities and the Wisconsin Card Sorting Test (WCST) assessing EF functioning. Results yielded a dissociation between ToM and EF, suggesting that in an adults’ brain executive functions are not necessary for inferring the mental states of others.

Assessment of executive function in an aging populationThe aim of this article is to review the literature about changes in brain and behavior that occur in later life, with particular implications for age changes in executive function, which comprises those capacities that enable a person to engage successfully in organized, goal-directed, flexible behaviour. Neuropsychological evaluation is emphasized because brain changes play a prominent role in the behavioural disturbances in an aging population, i.e. over 65-year old. The article provides an overview of selected aging processes, i.e. executive control, efforful inhibition of motor or cognitive response, and set shifting. There is wide agreement that the neural systems of the prefrontal cortex underlie age differences in cognitive decline, both general and specific to planning and control processes. It has also been argued that the volume of the frontal lobes decrease more than other cerebral areas with age. Some distinguishing features of both normal aging and cerebral pathology (e.g., Parkinson’s disease) are descibed in order to present a neuropsychological picture of these conditions, which is essential for the process of differential diagnosis. Moreover, the importance of “ecologically” valid evaluating of executive function in older patients was underscored, since it may be valid indicators of outcome and behaviour in everyday life. A fundamental thesis is that the complexity of demands imposed by everyday life can lead to significant dysfunction even when fairly good performance is observed during formal neuropsychological testing.

Pierwszym etapem prac nad przygotowaniem Konstytucji Rzeczpospolitej Polskiej z dnia 2 kwietnia 1997 r. było wniesienie projektów w trybie określonym w ustawie konstytucyjnej z dnia 23 kwietnia 1992 r. Ostatecznie wniesiono 8 projektów, przygotowanych przez prezydenta RP, członków Zgromadzenia Narodowego oraz grupę obywateli. W omawianych projektach przedstawiono różnorodne propozycje dotyczące pozycji rządu i funkcjonowania władzy wykonawczej. Natomiast odnośnie regulacji trybu powoływania ministrów, zakresu ich kompetencji oraz odpowiedzialności indywidualnej i solidarnej członków rządu zgłoszone projekty były zbliżone. W zasadniczej części treść omawianych projektów nie odbiegała od norm wyrażonych w Małej konstytucji, wprowadzała natomiast pewne modyfikacje istniejących rozwiązań. Główne różnice pomiędzy projektami dotyczyły kwestii trybu działania Rady Ministrów oraz określania kompetencji ministrów. Omawiane projekty były przedmiotem dalszych prac w Komisji Konstytucyjnej Zgromadzenia Narodowego i stały się podstawą do opracowania statusu ministra w Konstytucji RP z dnia 2 kwietnia 1997 r.
The first stage of work over the Constitution of the Republic of Poland passed on 2 April, 1997, was introducing the Constitution Projects according to procedure regulated in Constitution-Preparing Law of 1992. In result, there were 8 Constitional Projects, introduced by the President of the Republic of Poland, members of National Assembly and group of citizens. In those projects were many proposals of legal regulations concerning the government and the model of executive power. However the legal regulations included in those projects concerning appointing of ministers, their competences and form of individual ministerial responsibility as well as cabinet collective responsibility were similar. Most of the regulations concerning ministers included in those projects were not different from the rules of the Small Constitution of 1992, although some changes were introduced. The main issues were the way of government work and the way to determine the competences of ministers. Those projects were used in further works of Constitutional Commission and were the foundation for the process of forming the final Constitution regulations placing the minister in the Constitution of the Republic of Poland passed on 2 April, 1997.

The aim of the article is to analyze the constitutional position of the government in the Estonian political system. The parliamentary system determines the shape of the relation between the chief state authorities. A peculiar feature of Estonian governments is that they are usually formed as a coalition and are easily changed. Nonetheless, the whole political system should be regarded as stable. Currently Estonia is an example of a state that successfully applied information and communication technology to public administration. In particular the individual governments are actively working to mainstream the digitalization issue.

It includes the results of the poll conducted in the penitentiaries which was aimed at assessing how Polish criminal law copes with cultural diferences.

The purpose of this study is to discuss the struggle between the prime minister and the president to exercise legislative and executive power. According to the constitution of Romania, there is a clear division of power between the President and the Prime Minister. The Prime Minister is the head of government but the President also plays a key role in the country. There are many examples of interference in legislative work by the President of Romania. The paper discusses power sharing between the legislative and executive power of the Prime minister and the President of Romania. Because of the semi-presidential system in the country, the President of Romania has equal legislative power as the Prime minister. This has in practice led to major contradictions in the functioning of the Romanian political system. The paper analyses the substantial power that the Constitution vests the President with affects the Prime Minister’s role in the country. That is why Romania’s democratic journey has been one of power struggle between the President and the Prime Minister. Apart from the many conflicts between the President and Prime Minister, there is a massive debate on corruption which has also critically affected institution-building in this new democracy. There are discussions about the pillar of democratic bodies which is fragile and lacks trust in political institutions.

In the opinion of the author, the amendment contains a number of regulations improving and increasing the effectiveness of enforcement proceedings in administration. It introduces, among others, a new institution in such proceedings, i.e. sale of movables by the debtor with the consent of the enforcement authority and voluntary payment of the debtor. Rules on the distribution of the amount obtained from administrative enforcement adjust the enforcement procedure to the requirements of the EU law. One of the changes beneficial to the debtor is the exclusion from enforcement of, among others, „500+” benefits, following the example of the regulation contained in the provisions on court enforcement.
