The liability of Member States for damages caused by the issuance of a judicial decision in breach of EU law has been shaped in the jurisprudence of the CJEU, as a mechanism to ensure effective legal protection of EU citizens. Its primary purpose is to ensure that in a situation where a court of a Member State causes damage to a citizen by violating EU laws by its ruling, the citizen has a legal remedy to obtain compensation for such a violation. Based on the principle of procedural autonomy of the Member States, such claims can be asserted on the grounds of national procedural rules under the substantive legal grounds laid down by the CJEU in its case law.Research conducted by the authors of the article indicates that despite more than 18 years of Poland’s presence in the European Union, it is extremely difficult to find rulings on liability for damages for breach of EU law by Polish courts. It seems that such a state of affairs may be caused by ambiguities and interpretative doubts that arise on the grounds of Polish procedure in the case of claims for damages for breach of EU law by the courts. Both in the doctrine and case law there are far-reaching divergences as to whether the pre-judgment provided for in the Polish Civil Code should apply to claims for breach of EU law, and if so, when it should be applied. These doubts are reflected in the scant judicial case law on the issue in question. It seems that the indicated procedural doubts and lack of clarity as to the proper procedure in pursuing such claims may deter parties from more frequent initiation of proceedings to obtain compensation for breach of EU law by a national courts in the Polish context.

This commentary on the Court of Justice’s ruling in the Pawlak case concentrates on questions of the judicial application of EU law, in particular EU Directives. On the basis of the recent jurisprudence of the Court the authors present three issues: 1) the incidental effects of EU law for the procedural provisions of Member States; 2) the inability to rely on an EU directive by a member state’s authority in order to exclude the application of national provisions which are contrary to a directive; 3) the limits of the duty to interpret national law in conformity with EU law from the perspective of the Court of Justice and the referring court. Further, the article presents the judicial practice of the Polish Supreme Court, and in particular the follow-up decision of this Court not only taking into the account the ruling of the ECJ but also showing how the limitation of a conforming interpretation can be overcome in order to give full effect to EU law. In the authors’ view, this case is worth noting as an example of judicial dialogue in the EU.

In this article we examine the notion of ‘harmonisation’ in its interplay with the application of provisions on the free movement of goods. Due to the introduction of the European unitary patent protection system, we are witnessing the first cases of adopting enhanced cooperation in the internal market. This fact raises new, systemic questions concerning the concept of ‘harmonisation’ in European Union law. Are only legal, substantive aspects covered by its definition or should the territorial range of a legal act be taken into account? If yes – to what extent? Since the adoption of enhanced cooperation covers the field of intellectual property rights, the above questions concern the relationship between exercising those rights on the one hand and the principle of free movement on the other. A closer look at this matter leads to the conclusion that the unitary patent might not provide the solution to one of the problems that created for. More generally, in this article we conclude that when defining the concept of ‘harmonisation’, one should take its territorial scope into account narrowly, so as not to infringe the principles of EU law.

The aim of this paper is to analyze the effectiveness of the EU Package Travel Directive during the COVID-19 pandemic. First, the paper depicts the legal regime under Council Directive 90/314/EEC of 13 June 1990 on package travel, package holidays and package tours as well as Directive (EU) 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements. The comparison of both EU Package Travel Directives shows both some similarities and differences from the perspective of travellers’ rights. Furthermore, the paper offers justification of the actions taken by the EU Member States in the face of COVID-19 pandemic, using the EU report on the application of the 2015 Package Travel Directive. Finally, the paper exhibits case law relating to tourism that evolved as a consequence of the COVID-19 pandemic. The reported cases are pending before the Court of Justice of the European Union, which means that all EU Member States are still waiting for the final judgement. The author supports the views presented by Advocate General Laila Medina and strongly believes that the protection of tourists will be continued.

In 2022, upon the unexpected activation of the Temporary Protection Directive (TPD) by the Council Implementing Decision 2022/382, the Member States had to revive the EU law that had not been used for over 20 years. Poland adopted a new law that was aimed at offering extended rights to Ukrainian nationals and their family members. Other persons enjoying temporary protection under EU law were offered general protection available in Poland since 2003. This contribution sets out to answer the question of whether Poland followed the TPD and the Council Implementing Decision 2022/382 in its two-way response to the Russian invasion of Ukraine. The article is based on a comparative analysis of Polish and EU law, doctrinal views concerning temporary protection and available information about domestic practice. It focuses on the following areas of interest: eligibility for temporary protection, residence permits, accommodation, family reunification, returns and measures after temporary protection ends, and remedies. The analysis conducted showed that Polish law on temporary protection is not fully compatible with the respective EU law. In the selected areas of interest, Poland either did not thoroughly follow the Council Implementing Decision 2022/382 or did not meet the minimum standards arising from the TPD.

The article makes a presentation of the relation between legal acts belonging to the so-called foreign orders and the national law at the level of regulation contained in the Constitution of the Republic of Poland and the problem of application of the EU law by the Polish administrative authorities. The ratified international agreements and acts of the EU law are sources of administrative law and must be applied by the public authority of Member States. The article deals with two issues: the relationship between the international law and national law in the light of the Polish Constitution and application of the EU law by public administration in Poland. These issues can be dealt with separately but have a number of tangent points. The author does not aspire to present a comprehensive discussion of these issues, but intends to point out some aspects. It has been argued that the standard of application of international law by public administrations (which is also the accession treaties) and the EU law depends on how the constitution regulates the issue of international law relation to the domestic law. In Polish jurisdiction (the Constitutional Court and the Polish Supreme Administrative Court) the practice of respecting the principle of primacy of the EU law as well as the principle of a community of interpretation of this law has been established.

This article analyses the relationship between the Court of Justice and other international jurisdictions. In particular, it addresses the following question: To what extent is the Court of Justice ready to accept that some aspects of EU law are subject to the jurisdiction of an international body? The answer to this question requires analysis of the precise scope of the principle of autonomy of EU law as this principle could potentially constitute grounds on the basis of which the Court of Justice excludes the transfer of judicial competences to external bodies. For this reason, the article refers to the most important decisions in the field: Opinions 1/91 and 1/92, Opinion 1/09, Opinion 2/13, judgment in C146/13 Spain v. Parliament and Council and judgment in C284/14 Achmea. It also discusses the consequences of the application of Article 344 TFEU.

Orientation sentences for the remark 1. In the case of non-fully harmonised EU law, the fundamental rights of the Basic Law constitute the primary standard of assessment. Within the diversity of fundamental rights provided for by European law, the presumption is that the fundamental rights of the Charter of Fundamental Rights of the European Union (GrCh) are co-guaranteed by those of the GG(German Constitution). That presumption can only be rebutted if there is concrete and sufficient evidence to support it. 2. Threats from the dissemination of personal reports and information as part of public communication affect the scope of protection of the expressions of general personality law, not that of the right to informational self-determination. 3. The general right of personality does not give way to filtering and restricting publicly available information about one’s own person according to his own ideas. The unlimited public confrontation with previous positions, statements and actions, on the other hand, is not appropriate. 4. On the contrary, it is necessary to strike a balance with the interests of the content provider, with specific emphasis on the temporal aspect, availability and context of the information in relation to the communication conditions of the Internet.

This article concerns constitutional problems related to the implementation of EU directives seen from both the legal and comparative perspectives. The directives are a source of law which share a number of characteristic features that significantly affect and determine the specificity of Member States’ constitutional review of the directives as well as the legal acts that implement them. The review of the constitutionality of EU directives is carried out in accordance with the provisions of national implementing acts. Member States’ constitutional courts adopt two basic positions in this respect. The first position (adopted by, inter alia, the French Constitutional Council and German Federal Constitutional Court) is based on the assumption of a partial “constitutional immunity” of the act implementing the directive, which results in only a partial control of the constitutionality of the implementing acts, i.e. the acts of national law implementing such directives. The second position, (adopted, explicitly or implicitly by, inter alia, the Austrian Federal Constitutional Court, Czech Constitutional Court, Polish Constitutional Court, Romanian Constitutional Court and Slovak Constitutional Court) concerns the admissibility of a full review of the implementing acts. This leads to the admissibility of an indirect review of the content of the directive if the Court examines the provision as identical in terms of content with an act of EU law. Another issue is related to the application of the EU directives as indirect yardsticks of review. The French Constitutional Council case-law on review of the proper implementation of EU directives represents the canon in this regard. Nonetheless, interesting case studies of further uses of EU directives as indirect yardsticks of review can be found in the case law of other constitutional courts, such as the Belgian Constitutional Court or Spanish Constitutional Court. The research presented in this paper is based on the comparative method. The scope of the analysis covers case law of the constitutional courts of both old and new Member States. It also includes a presentation of recent jurisprudential developments, focusing on the constitutional case-law regarding the Data Retention Directive and the Directive on Combating Terrorism.

At the turn of the twentieth and twenty-first century, a partnership gained considerable popularity in many jurisdictions. Adjusting the present company was different in different national, but there is one thing in common. It is the responsibility of the other limited partners for the obligations of professional partners arising out of the profession in that performs in a joint partnership. Adoption of a partnership under Polish law is a consequence of the work on the reform of the Polish commercial law and try to connect it with the EU law, as a result of the adjustment process to the conditions of Polish EU. Company law on the basis of the existing Commercial Companies Code of 2000 was introduced to the company in legal partnership, bringing together representatives of the professions, as a new type of company. Polish limited partnership structure has many of the characteristics of originality and independence, but to a large extent is based on solutions that come with French law, Austrian, Swiss, but most of all, you can fi nd patterns of German and American.

The paper will focus on requirements and thresholds set for the judiciary by the Damages Directive. Answered will also be questions on the specialization of courts and its application in Central and Eastern European (CEE) Member States of the EU, as well as on the involvement of national competition authorities (NCAs) in court proceedings. The paper provides also general thoughts regarding the specialization of courts and confronts them with the judiciary structure in CEE Member States in the context of private enforcement of competition law. While there is no uniform model of a judicial system, the paper provides a critical analysis of the centralization, specialization and decentralization of private enforcement models, taking into account also the importance of the training of judges. The relationship between NCAs and courts will be discussed whereby the role of NCAs in private enforcement defines the responsibility of the given public authority in private enforcement as a country’s policymaker.

The article analyses taxes on digital services adopted in the United Kingdom, France, Austria, and Italy. The article tries to identify the architectural features of these taxes that could conflict with obligations according to international tax treaties and EU laws. The article also presents OECD “Unified Approach” which is based on multilateral agreement. The main hypothesis of the article is that this approach represents a better solution for the taxation of digital services than unilateral national taxation of digital services. In the presented analyses, mainly horizontal comparative method, method of logical analysis and synthesis are employed.

The article presents the impact of European Union law on the development of supra-local self-government structures in Poland. In the literature, it is estimated that the self-governmental reform of 1998 assuming the establishment of self-government voivodships and poviats enabled Poland to effectively join the implementation of regional development policy. The voivodship self-government and poviat became the basis of the institutional infrastructure together with the commune, enabling efficient acquisition of the Structural Funds and the EU Cohesion Fund.

The aim of this paper is to critically analyze the manner of harmonizing private enforcement in the EU. The paper examines the legal rules and, more importantly, the actual enforcement practice of collective consumer actions in EU Member States situated in Central and Eastern Europe (CEE). Collective actions are the key method of getting compensation for consumers who have suffered harm as a result of an anti-competitive practice. Consumer compensation has always been the core justification for the European Commission’s policy of encouraging private enforcement of competition law. In those cases where collective redress is not available to consumers, or consumers cannot apply existing rules or are unwilling to do so, then both their right to an effective remedy and the public policy goal of private enforcement remain futile. Analyzing collective compensatory actions in CEE countries (CEECs) places the harmonization process in a broader governance framework, created during their EU accession, characterized by top-down law-making and strong EU conditionality. Analyzing collective consumer actions through this ‘Europeanization’ process, and the phenomenon of vertical legal transplants, raises major questions about the effectiveness of legal transplants vis-à-vis homegrown domestic law-making processes. It also poses the question how such legal rules may depend and interact with market, constitutional and institutional reforms.

La doctrine a déjà beaucoup écrit sur les implications pratiques de l’entrée en vigueur du Digital Markets Act, c’est pourquoi le présent article vise à ramener la discussion au niveau théorique, en essayant d’identifier les racines de cette proposition de règlement, a travers une analyse du contexte dans lequel il s’inscrit, des principes et valeurs de l’UE sur lesquels il repose, des objectifs qu’il entend poursuivre et des théories juridico-économiques qui le sous-tendent.

Przystąpienie Polski do Unii Europejskiej wpłynęło na kształt systemu prawnego państwa. Podjęcie decyzji o uczestnictwie w tej organizacji ponadnarodowej wiązało się z wyrażeniem woli do przyjęcia całości rozwiązań prawnych wypracowanych przez wspólnoty europejskie jako prawo obowiązujące w kraju. Zawarcie traktatu akcesyjnego wiązało się m.in. z przekazaniem niektórych kompetencji władz krajowych na rzecz Unii. Polityka transportowa ze względu na swoje znaczenie gospodarcze i społeczne jest jednym z obszarów, co do którego kompetencje zostały częściowo przekazane na rzecz instytucji wspólnotowych. Na przykładzie ustawy o publicznym transporcie zbiorowym pokazano, jaki wpływ na krajowe przepisy prawa mają akty prawa europejskiego, a tym samym jak wpływają one na funkcjonowanie podmiotów świadczących usługi w zakresie miejskiego transportu publicznego.
Poland’s accession to the European Union has impacted the state legal system. qe decision to participate in this supranational organization implied the will to accept the entire body of legal solutions developed by the European Communities as the law binding domestically. qe accession treaty entailed, for instance, transferring some competences from the state authorities to the EU. Transport policy (due to its economic and social importance) is one of the fields where the competences were partly devolved to community institutions. Based on the act on public collective transport it has been demonstrated how the domestic laws are in}uenced by the European legal framework and thus how it affects the operation of entities providing services in the field of urban public transport.

Since the time when the first competition rules were adopted after the Velvet Revolution in early 1990s, Slovak competition law has undergone several changes. Three acts on economic competition were subsequently adopted (in 1991, 1994, 2001), each of them several times amended. Although Slovakia became a member of the EU in 2004, the convergence of national competition rules with the law of the European Union is evident in the significant changes that were introduced in 2004. The evolution of Slovak competition rules cannot be considered finished – major amendments are expected in 2014. The following paper will analyze in which aspects Slovak competition law is diverging from the rules of the European Union. Court jurisprudence reviewing administrative decisions issued in competition matters is also important in the assessment of the competition law environment. The paper will provide an overview of those features of Slovak competition law that shall be harmonised, as well as reasons for their harmonisations. Yet it must be stressed that European law is not the universal model of convergence and hence the paper will provide thoughts on which features of Slovak competition law might remain country-specific.
Depuis l'époque où les premières règles de concurrence ont été adoptées après la Révolution de velours en début des années 1990, le droit slovaque de la concurrence a subi plusieurs changements: trois actes sur la concurrence économique ont été adoptés par la suite (1991, 1994, 2001); chacun d'entre eux a également été modifié à plusieurs reprises. Bien que la Slovaquie soit devenue membre de l'UE en 2004, la convergence du droit slovaque de la concurrence vers des règles européennes de concurrence est évidente et des changements importants ont été introduits en 2004. Les modifications de la législation slovaque en matière de la concurrence ne peuvent pas être considérées comme terminées – les modifications considérables sont attendues en 2014. Le présent article analysera dans quels aspects le droit slovaque de la concurrence est divergent. De plus, la jurisprudence des tribunaux, examinant les cas en matière de la concurrence, est importante dans l'évaluation de l'environnement de la réglementation de la concurrence. Cet article offre un aperçu des caractéristiques du droit slovaque de la concurrence qui doit être harmonisé, ainsi que les raisons pour ces harmonisations. D'autre part, il faut souligner que le droit européen n'est pas le modèle universel de convergence et donc l’article présentera des pensées sur lesquelles les caractéristiques du droit national de la concurrence pourraient rester spécifique.

Unlike other general principles of EU law, which derive from the CJ jurisprudence, the principle of national identity is based on a clear legal provision. Article 4(2) TEU stipulates that the Union shall respect important State functions, like the territorial integrity of the State, maintaining law and order and safeguarding national security. The list of values covered by the national principle identity is open and it is for the Member State to decide what values should be protected by its national identity, while the CJ is only empowered to determine the relevance of national identity under EU law. This article analyses if the principle of national identity could influence the EC examination of State aid and if the EC should refrain from issuing an order to recover incompatible aid, if that aid was to be protected by the Member State’s national identity. There has not yet been a single judgment by the CJ on that issue and the question stays open. The analysis also focuses on the division of competences between Member States and EU institutions in carrying out that analysis, as well as on the requirements for that analysis, including the scope of an examination carried out by EU institutions.
Contrairement aux autres principes généraux du droit de l’Union européenne, qui découlent de la jurisprudence de la Cour de justice de l’Union européenne, le principe de l'identité nationale est basé sur une disposition légale claire. L’article 4(2) du Traité sur l’Union européenne prévoit que l'Union doit respecter les fonctions essentielles de l'État, comme l'intégrité territoriale de l'État, le maintien de l'ordre public et la sauvegarde de la sécurité nationale. La liste des valeurs couvertes par le principe de l'identité nationale est ouverte et c’est aux États membres de décider quelles valeurs doivent être protégées par son identité nationale, tandis que la Cour de justice de l’Union européenne est uniquement compétente à déterminer la pertinence de l'identité nationale en vertu du droit de l’Union européenne. Cet article analyse si le principe de l'identité nationale pourrait influencer l’examen d’aide d'État par la Commission européenne et si la Commission européenne devrait s'abstenir d’ordonner la récupération de l’aide incompatible, et à la fin si cette aide devait être protégée par l'identité nationale de l'État membre. Vu que jusqu’au présent il n’y avait pas un seul jugement de la Cour de justice de l’Union européenne concernant ce problème, la question reste ouverte. L'analyse entrepris dans cet article se focalise également sur la répartition des compétences entre les États membres et les institutions de l’Union européenne dans le traitement de ce problème, ainsi que sur les exigences pour l’analyse entrepris par l’autorité compétente, y compris sur la portée d'un examen effectué par les institutions de l’Union européenne.

This article explores the role of sustainability in EU competition law from the perspective of the theory of legal realism. It addresses the issue by analysing three interrelated themes. It first outlines the main normative and methodological arguments of the protagonists and the opponents of a more societally engaged account of competition policy. Such an account pleads for a more permissive interpretation of competition rules. Secondly, it develops an account of competition law, basing on the premises of the legal realist tradition, adjusting legal realism to the needs and specificities of our field and our time, and submitting that this legal philosophical theory is well-suited for capturing the present discussion. Finally, it projects this jurisprudential theory of legal realism to an applied dimension, offering an outline of the central theoretical issue of a more societally inclusive EU competition policy: the issue of balancing incommensurable values.
Cet article explore le rôle de la durabilité dans le droit européen de la concurrence du point de vue de la théorie du réalisme juridique. Il examine la question en analysant trois thèmes interdépendants. Il expose tout d’abord les principaux arguments normatifs et méthodologiques des protagonistes et des opposants à une conception plus socialement engagée de la politique de concurrence. Une telle approche appelle à une interprétation plus permissive des règles de concurrence. Ensuite, il développe une analyse du droit de la concurrence, en se basant sur les prémisses de la tradition réaliste juridique, en ajustant le réalisme juridique aux besoins et aux spécificités de notre domaine et de notre époque, et en soutenant que cette théorie philosophique juridique est bien adaptée pour capturer la discussion actuelle. Enfin, il projette cette théorie jurisprudentielle du réalisme juridique vers une dimension appliquée, en offrant un aperçu de la question théorique centrale d’une politique de concurrence européenne plus inclusive sur le plan social: la question de l’équilibre entre des valeurs incommensurables.

Research background: Since crises magnify differences and bring both challenges and opportunities, the current complex global setting makes the mutual interconnection a fundamental platform meant  to create confidence and also to lead to a unique strategic advantage. Due to its inherent particularities, the fashion industry is a relevant sphere for performing a categorial reflective triangulation study about the understanding and employment of creating shared values (CSV) within the EU framework. Purpose of the article: The purpose of the article is to research, analyze and critically highlight how CSV is approached by archetypical fashion industry businesses from all three fundamental segments (luxury, fast, slow) and how this fits into the EU law framework. Methods: A categorial reflective triangulation study in four steps is performed while using a content analysis, empirical field observation, qualitative manual Delphi approach and critical juxtaposition with glossing and Socratic questioning. Firstly, 30 archetypical fashion industry businesses are identified and split into luxury, slow and fast fashion segments. Secondly, for each business, research is done on how it identifies its CSVs. Thirdly, the verification of these CSVs is performed in order to confirm or reject the genuineness. Fourthly, the results are projected into the EU framework. Findings & value added: Based on the performed study and its critical analysis, there appear extremely interesting dynamics in the CSV perception and strategies by luxury, slow and fast fashion businesses with a clear overlap in the EU sphere. In particular, fashion businesses from all three segments take into consideration sustainability and the fight against waste, but each segment has a different pro-CSV strategy to do so, and it is critical to contemplate which of these three strategies will become sustainable.

Wasteful spending of public funds, leading to the creation of “ghost airports”, is often described as a regulatory failure and a major deficiency in European State aid control. It is pointed out that decisions to build or upgrade an airport are often illconceived, poorly implemented, and without economic justification. This raises the question whether European law, namely its State aid control system, contains inherent flaws or whether the European Commission’s decisionmaking process can be improved by increasing reliance on objective economic reasoning under the existing legal framework. This article provides an analysis of the decisionmaking problems leading to failed aid efforts; of the role of the economic approach in State aids; and of the standard of economic assessment required in State aid cases. The article concludes with de lege ferenda postulates.

The purpose of this article is to research various kinds of innovations in intergenerational tourism in the light of the Polish law and the EU law. The author is making an attempt to outline the scope of ‘intergenerational tourism’. At the same time, he is suggesting a modified version of the classical division of generations in Poland over the last scores of years. Discussed are the innovations applied by tourist entrepreneurs to encourage intergenerational tourism development, as well as the kind of innovations that should be considered as vital for promoting intergenerational tourism in the future. Analysed were the acts of the Polish law and the EU law regarding tourism either directly or indirectly, in search for such regulations that would in any way contribute to the promotion of intergenerational tourism.

An effective implementation of mutual recognition in the Area of Freedom, Security, and Justice requires mutual trust between the Member State. Mutual trust has been eroded in some Member States due to the rule of law crisis. However, it is not only the rule of law crisis, but also the departure of the Member States from the shared values of respect for fundamental rights, as well as the differences in the prosecutorial systems of individual Member States, that have caused changes in the perception of the principle of mutual recognition. This paper will examine the evolving approach to the principle of mutual recognition based on the recent Court of Justice of the European Union rulings on the European arrest warrant. The analysis concludes that the CJEU attaches more importance to the protection of the principle of mutual recognition, the prosecution of perpetrators of crime, and the unwavering presumption of respect for fundamental rights by the Member states than to the effective protection of fundamental rights.

Opis:
The main aim of this paper is to examine whether or not the legal amendments to Polish criminal law for the prevention of illegal immigration were necessary and if so, whether they are proportional to the perceived threat posed by such migration. The paper discusses the implementation of the relevant EU legislation, viz. Council Framework Decision 2002/946/JHA of 28 November 2002 on the strengthening of the penal framework to prevent the facilitation of unauthorised entry, transit and residence; Council Directive 2002/90/EC defining the facilitation of unauthorised entry, transit and residence; Directive 2009/52/WE/EC of the European Parliament and of the Council providing for minimum standards on sanctions and measures against employers of illegally resident third-country nationals; and the Council of Europe Convention on the Prevention of Terrorism; and the direct effects of this legislation on Polish criminal law as presented in the Polish Criminal Code (Arts. 264a and 259a k.k.), the aggravation of the penalties in Art. 264 § 3 k.k.; and the institution of Ustawa o skutkach nielegalnego zatrudnienia cudzoziemców nielegalnie przebywających na terytorium Polski (the Act on Liability for the Employment of Illegal Immigrants on Polish Territory). In addition, the article considers the effectiveness of the new criminal provisions, particularly on the basis of the number of convictions.
Głównym celem artykułu jest ocena zmian jakie zostały dokonane zmiany w polskim prawie karnym w zakresie zapobiegania nielegalnej migracji. Autorka stara się udzielić odpowiedzi na pytanie czy zmiany takie są konieczne, a jeśli tak, to czy są one proporcjonalne do postrzeganego zagrożenia związanego z migracją. Analizie poddano implementację europejskich aktów prawnych tj. Decyzji Ramowej Rady 2002/946/WSiSW z 28 listopada 2002 r. w sprawie wzmocnienia systemu karnego w celu zapobiegania ułatwianiu nielegalnego wjazdu, tranzytu i pobyt, Dyrektywa Rady 2002/90/WE z 28 listopada 2002 r. definiującej ułatwianie nielegalnego wjazdu, tranzytu i pobytu, Dyrektywy Parlamentu Europejskiego i Rady 2009/52/WE/WE z 18 czerwca 2009 r. przewidującej minimalne normy w odniesieniu do kar i środków stosowanych wobec pracodawców zatrudniających nielegalnie przebywających obywateli krajów trzecich, a także Konwencji Rady Europy o zapobieganiu terroryzmowi. Te akty prawne miały bezpośredni wpływ na polskie prawo karne, którym było wprowadzenie art. 264a kk, 259a kk, zaostrzenie kary w art. 264 § 3 kk i wprowadzenie ustawy o skutkach nielegalnego zatrudnienia cudzoziemców nielegalnie przebywających na terytorium Polski. Ponadto autorka poddała analizie skuteczność nowych przepisów karnych, zwłaszcza na podstawie liczby wyroków skazujących.

W artykule zawarto analizę prawa UE dotyczącego zatrudnienia czasowego. Ustalono jego konsekwencje dla ustawodawstwa krajowego. Przedstawiono wyrok ETS w sprawie C-38/13, w którym Trybunał uznał, że polskie regulacje kodeksu pracy różnicujące długość okresu wypowiedzenia umów o pracę na czas określony i nieokreślony za niezgodne z prawem UE –dyrektywą Rady 99/70/WE. Orzeczenie to może mieć istotne znaczenie dla dalszej praktyki zatrudnienia pracowników na czas określony.
The text contains an analysis of the EU law on temporary employment and presentes its implications for the national legislation. It also discusses the sentence of the ECJ in Case C-38/13, in which the Court stated that the fact that Polish labour code regulations on the length of the termination of employment contracts, distinguishing between a permanent and temporary employment is incompatible with the EU law – Council Directive 99/70/ EC. The sentence may have important implications for further practice to employ staff on fixed periods.

The aim of this article is to investigate how the principle of transparency, deriving from the Treaties and the secondary law, is implemented in the course of conditions and rules imposed during the public procurement procedure. Firstly, the principle of transparency in the EU legal system is discussed and explained are its sources, types and aspects, as well as the necessity to adapt it with time. Secondly, the principle of transparency in the EU public procurement law is outlined, with particular emphasis on its sector specific sources and aims it serves. Furthermore, the question is analysed whether the notion of “transparency” is a principle or a legal obligation, used to implement other principles. Thirdly and lastly, the principle of transparency is discussed, as reflected at different stages of public procurement procedure.

The study addresses the task of determining the scope of sovereignty (exclusive competence) of member states in the area of the development of national power policy on the basis of Treaties, mainly the Treaty on European Union. The author makes an attempt to prove that the impact of the EU legislation on the national legal order, pursuant to the EU regulations, is subject to selective exclusion, and the member states are entitled to supremacy relative to the EU power policy in specific areas of the development of the power policy. Therefore, the member states kept their autonomous right to develop the market of energy supplies in a manner that would make it possible to maintain the balance between the supplies and the demand within the limits necessary for keeping the energy security at the national level required for the public order and the national security. The hierarchical relation of the EU interest and the national public interest arising from the supremacy of the EU law and its direct effectiveness does not jeopardize the national objectives defined in this way. The national energy security, understood in this way, opens the space for specific preferences of national suppliers subject to the national legislative regime as well as the national power authorities and power enterprises managing the transfer or distribution infrastructure.

The use of AI in public administration is becoming a reality, although it is still a long way from large-scale undertakings . The right to good administration, well-established in EU legal order, is equally real, however, it must be borne in mind that this right has so far been defined only in relation to traditional administration . Therefore, the purpose of the paper is to examine whether the use of AI in public administration would allow individuals to fully exercise their right to good administration. To achieve this purpose, it is reconstructed, on the basis of EU law provisions in force and the case-law of the CJEU, the meaning and scope of the right to good administration, and analysed, taking into account a definition of AI systems and planned legislative changes, whether and to what extent the reconstructed understanding of this right enables the use of AI systems in public administration. In the course of research the hypothesis that the right to good administration does not preclude the use of AI systems in public administration is verified . As the conducted analysis shows, the right to good administration as interpreted in traditional administration enables the use of AI systems in public administration, provided that the appropriate quality of these systems and the level of knowledge and skills of the parties and authorities are ensured .

EU law currently applies to 27 countries and is available in 23 languages which all carry equal status. In practice, this is achieved though translation and by the work of the DGT (Directorate General Translation), which hosts the largest translation service in the world. But from a legal point of view, translation is institutionally ‘non-existent’ and EU languages are all equal and authentic. The issue has been given attention in the last two decades mostly from scholars, linguists and translators (Correia 2003, Kjær 1999, Koskinen 2000, Šarčević 2001, Tosi 2001, Wagner 2000), thus raising awareness on the paradox of translation and the lack of a proper EU language policy and legal culture. Focusing exclusively on legal texts and on the pragmatics of norms (Olivecrona 1994:[1962], von Wright 1963), I will argue that the equal authenticity of the EU language versions and the multilingual practice of the Union are less contradictory than they seem. The principle of equal authenticity applies only when texts are authenticated and published in the EU Official Journal. Before that, nothing prevents to regard them as translations or language versions. 
Prawo UE obecnie odnosi się do 27 krajów, dostępne jest także w 23 językach, z których każdy ma równy status. W praktyce, jest to efekt przekładu i pracy DGT (Directorate General Translation), która zapewnia usługi tłumaczeniowe. Z prawnego punktu widzenia, przekład nie istnieje od strony instytucjonalnej, a języki UE są wszystkie równe i prawdziwe. Przez ostatnie dwie dekady zagadnienie to cieszy się zainteresowaniem głównie naukowców, językoznawców i tłumaczy (Correia 2003, Kjær 1999, Koskinen 2000, Šarčević 2001, Tosi 2001, Wagner 2000), wskazując na paradoksy translatorskie oraz brak odpowiedniej polityki językowej UE i kultury prawnej. Skupiając się wyłącznie na tekstach prawnych oraz na pragmatyce normy (Olivecrona 1994:[1962], von Wright 1963) Autorka stara się dowieść, że autentyczność równości wersji języków UE oraz praktyka wielojęzyczna nie są sprzeczne. 
Il diritto europeo è in vigore nei 27 stati membri dell’Unione ed è disponibile in 23 lingue, tutte facenti ugualmente fede. Ciò è possibile grazie al DGT (Directorate General Translation) che vanta uno dei maggiori servizi di traduzione del mondo, ma da un punto di vista legale, la traduzione rimane un puro mezzo, istituzionalmente ‘inesistente’. La problematica ha ricevuto negli ultimi due decenni, considerevole attenzione da parte di ricercatori, linguisti e traduttori (Correia 2003, Kjær 1999, Koskinen 2000, Šarčević 2001, Tosi 2001, Wagner 2000), i quali hanno puntato il dito sul paradosso della traduzione e sull’assenza di una politica linguistica e di una cultura legale europea a livello unitario.Basandomi esclusivamente su testi legali e sulla pragmatica delle norme giuridiche (Olivecrona 1994:[1962], von Wright 1963), intendo dimostrare che l’autenticità linguistica delle traduzioni del diritto europeo è meno contraddittoria di quanto sembra. Il principio di autenticità è valido solo quando i testi vengono autenticati e pubblicati sulla Gazzetta Ufficiale dell’UE, ma prima di quel momento, nulla impedisce di considerarli traduzioni o versioni linguistiche.

Wraz z wejściem w życie rozporządzenia Parlamentu Europejskiego i Rady (UE) 2017/2402 z 12.12.2017 r. w sprawie ustanowienia ogólnych ram dla sekurytyzacji oraz utworzenia szczególnych ram dla prostych, przejrzystych i standardowych sekurytyzacji, a także zmieniającego dyrektywy 2009/65/WE, 2009/138/WE i 2011/61/UE oraz rozporządzenia (WE) nr 1060/2009 i (UE) nr 648/2012 (Dz.Urz. UE L 347 z 28.12.2017, s. 35–80), dalej „rozporządzenie 2017/2402”, na nowo został ukształtowany stan prawny dotyczący sekurytyzacji. Działalność uczestników tego procesu została objęta nadzorem, który jest sprawowany przez Komisję Nadzoru Finansowego. Tym samym podmiotami nadzorowanymi stały się również podmioty niepochodzące z tradycyjnych segmentów rynku finansowego: bankowego, kapitałowego oraz ubezpieczeniowego. Istotnym, w szczególności dla rynku polskiego, nowym obowiązkiem jest sprawozdawczość, której zasady zastały określone w rozporządzeniu. Niniejsza analiza dotyczy tego obowiązku oraz sposobu jego nadzorowania, w tym sankcjonowania jego niedochowania.
With the entry into force of Regulation (EU) 2017/2402 of the European Parliament and of the Council of 12 December 2017 on establishing a general framework for securitization and creating a specific framework for simple, transparent and standardized securitization, and amending Directives 2009/65 / EC, 2009/138 / EC and 2011/61 / EU and Regulations (EC) No 1060/2009 and (EU) No 648/2012 (Official Journal EU L 347 of 28.12.2017, pp. 35–80), hereinafter 'Regulation 2017/2402' the securitization legal status has been modified. The activities of participants in this process have been supervised. The supervision is exercised by the Polish Financial Supervision Authority. Thus, supervised entities became entities not only from traditional financial market segments: banking, capital and insurance. An important, especially for the Polish market, new obligation is reporting, the principles of which have been set out in the Regulation. This analysis concerns this obligation and the way it is supervised, including sanctioning its failure to comply.

This work endeavours to define energy policy, comprehended in our times in comparison to threats and challenges to the functioning of the energy sector within the EU internal market. Analysis of the legal of the manifestations (acts) of the national and EU energy policy, the relationships between the national energy policy focused on achieving national targets inside a member state, as well as the energy and climate policy of the EU, its interpretation and considered scenarios of a change indicate only a partial discrepancy of both policies, directions and action strategies defined in them, which are accompanied by implementation instruments. On a domestic basis the objective of the energy policy is to balance the efforts of the players in the energy market to maximise the achieved financial effect with the necessity of the stable functioning and development of energy companies, above all, manufacturers and operators of a system compliant with this policy on the one side and customers expecting low prices, reliability and stability of supplies on the other side. Development of production based on emission-free and low-emission technologies (including renewable energy sources, RES) seems to be a necessity resulting from the EU legislation. In this respect the EU energy policy and the Union political discourse explicitly present a strong commitment to the development of new manufacturing technologies, without any encouragement to restitute or develop technologies not based on RES or cogeneration. The strategic task of the state is to skilfully combine Union tendencies with the Treaty freedom of the state to define use of indigenous sources of primary energy and carefully considered support for the transformation of the national power industry.

In the digital transformation process, the phases focusing on technical and economic aspects were followed by a phase exposing human capital issues. In approximately 3,000 acts of the European Union relating to the digital transformation process published in Eur-lex, as well as in an increasing number of national acts of the Member States, the terms “digital competences” and “digital skills” appear. They occur, inter alia, in the context of the financing of development tasks and their achievement indicators. In the application of existing law, it must be taken into account that the scopes and interrelationships of these new terms are framed differently. This ambiguity may have a negative impact on the effectiveness of digital transformation. It is postulated that the terminological consistency of the multi-level regulation should be improved and, in doing so, it should be noted that the prominence of digital skills in prospective acts and the way in which knowledge is captured can affect the use of the potential of universities.

Opis:
The objective of this study is to analyze the process of implementing European Union law into the legal system of the Republic of Poland. EU law is to be incorporated in the Polish legal system in such a way as to safeguard its binding force. In other words, it is necessary to ensure the effectiveness of European Union law in the legal system of the Republic of Poland. The Member States are obliged to implement European Union law. This obligation arises out of the adoption of the treaties establishing the European Union, but it is also rooted in the Constitution. It is worth noting that a Member State has the autonomy to select the method of incorporating European Union law in its legal system. In the case of the Republic of Poland, the process of implementing European Union law is linked particularly closely to the adoption of statutes implementing the provisions of European Union law into the legal system of the Republic of Poland. Should Poland fail to implement EU laws in its legal system properly, it may incur financial liability to the European Union, as well as its own citizens.
Celem opracowania jest analiza procesu implementacji prawa Unii Europejskiej do systemu prawnego Rzeczypospolitej Polskiej. Prawo Unii Europejskiej musi być wykonane w systemie prawnym Rzeczypospolitej Polskiej w taki sposób, aby zostało zapewnione jego obowiązywanie. Innymi słowy należy zapewnić skuteczność prawa Unii Europejskiej w systemie prawnym Rzeczypospolitej Polskiej. Implementacja prawa Unii Europejskiej stanowi obowiązek państw członkowskich wynikający z przyjęcia traktatów statuujących Unię Europejską. Obowiązek ten posiada również swoją podstawę konstytucyjną. Na uwagę zasługuje fakt, iż państwo posiada swobodę w zakresie wyboru sposobu wykonania prawa Unii Europejskiej w swoim systemie prawnym. W przypadku Rzeczypospolitej Polskiej proces implementacji prawa Unii Europejskiej jest związany w szczególności z uchwalaniem ustaw implementujących przepisy prawa Unii Europejskiej do systemu prawnego Rzeczypospolitej Polskiej. Brak prawidłowej implementacji może prowadzić do odpowiedzialności finansowej państwa członkowskiego względem Unii Europejskiej a także obywateli.

In order to facilitate national competition authorities (NCAs) in their application of EU competition rules, the EU legislator adopted Directive 2019/1/EU. The Directive’s aim is to empower the competition authorities of the Member States to be more effective enforcers of competition law and to ensure the proper functioning of the internal market. The so-called ECN+ Directive introduces minimum harmonisation rules allowing competition authorities to have common investigative, decision-making (notably fining decisions) and enforcement powers. The Directive, furthermore, sets minimum safeguards for the NCAs’ independence, accountability and resources as well as harmonizes leniency programmes including the coordination of national leniency programmes with each other and with that of the European Commission. This paper critically analyzes the legal and policy developments that paved the way for the adoption of this Directive. Moreover, it examines the changes the implementation of the Directive is likely to generate in current Hungarian law and policy of competition protection. The focus of the paper’s assessment is on the institutional aspects of the Directive and the enforcement of Articles 101 and 102 TFEU, in particular the mechanisms for ensuring independence and accountability of the NCAs. Through the assessment of the Hungarian implementation, the paper aims to shed light on a broader context of the Directive and the enforcement of EU competition law in EU Member States. The paper shows that the implementation of the Directive may fail to translate into (more) effective enforcement without an effective institutional capacity on the side of the NCAs, and in the broader legal and constitutional context of competition law and its multilevel enforcement.
Pour faciliter l’application des règles de concurrence de l’UE par les autorités nationales de concurrence, le législateur européen a adopté la directive 2019/1/UE. L’objectif de la directive est de permettre aux autorités de concurrence des États membres d’être plus efficaces dans l’application du droit de la concurrence et d’assurer le bon fonctionnement du marché intérieur. La directive dite «ECN+» définit des règles minimales d’harmonisation permettant aux autorités de concurrence de disposer de pouvoirs communs d’enquête, de décision (notamment en matière d’amendes) et d’exécution. En outre, la directive fixe des guaranties minimales pour l’indépendance, la responsabilité et les ressources des ANC, harmonise les programmes de clémence, y compris la coordination des programmes nationaux de clémence entre eux et entre ces programmes et ceux de la Commission européenne. Le présent article analyse de manière critique les développements juridiques et politiques qui ont ouvert la voie à l’adoption de la directive. En outre, il examine les changements que la mise en oeuvre de la directive est susceptible de générer dans la législation et la politique hongroises actuelles en matière de protection de la concurrence. Au centre de l’évaluation du présent document figurent les aspects institutionnels de la directive et l’application des articles 101 et 102 du TFUE, en particulier les mécanismes garantissant l’indépendance et la responsabilité des ANC. Grâce à l’évaluation de la transposition hongroise, le présent article vise à clarifier le contexte plus large de la directive et de l’application du droit communautaire de la concurrence dans les États membres de l’UE. L’article montre que la mise en oeuvre de la directive pourrait ne pas se traduire par une application (plus) efficace sans une capacité institutionnelle effective de la part des ANC et dans le contexte juridique et constitutionnel plus large du droit de la concurrence et son application à plusieurs niveaux.

Artykuł stanowi analizę inicjatywy Komisji Europejskiej dotyczącej wprowadzenia nowego, komplementarnego narzędzia do przepisów unijnego prawa konkurencji. Inicjatywa ta ma być jednym ze środków dostosowujących prawo i politykę konkurencji do realiów nowoczesnej gospodarki. Nowe narzędzie miałoby umożliwić Komisji prowadzenie badań rynkowych w zakresie problemów strukturalnych związanych z konkurencją, z możliwością narzucenia przedsiębiorcom środków zaradczych. W artykule przedstawiono uwagi dotyczące podstawy prawnej inicjatywy, wyboru odpowiedniego wariantu oraz kwestii związanych z zasadą proporcjonalności i środków zaradczych. Postulowane jest wypracowanie rozwiązania, które eliminowałoby luki w egzekwowaniu przepisów przy jednoczesnym zachowaniu jasnych ram prawnych i zapewnieniu skutecznej kontroli sądowej.
The article analyses the European Commission's initiative to introduce a new, complementary tool to EU competition law. The initiative is one of the measures aimed at making sure that competition policy and rules are fit for the modern economy. The new tool would enable the Commission to conduct market investigations on structural problems, with the possibility of imposing remedies. The article presents some comments on the legal basis of the initiative, selection of the appropriate option, and issues related to the principle of proportionality and remedies. It is postulated to find a solution that would eliminate the gaps in enforcement while maintaining a clear legal framework and ensuring effective judicial control.

Aby zrozumieć, czy i dlaczego prawo Unii Europejskiej powinno znajdować zastosowanie do naruszeń praworządności przez państwo członkowskie, należy sięgnąć przede wszystkim do aktów prawnych UE. Jednakże ze względu na fakt, że prawo unijne odzwierciedla aksjologię i cele wspólnoty europejskiej, znajomość tych czynników będzie pomocna przy wykładni traktatów i innych dokumentów. Idea praworządności zaczerpnięta z konstytucyjnej tradycji państw członkowskich ma fundamentalne znaczenie dla Unii Europejskiej. z tego względu wielokrotnie odwołują do niej traktaty, orzeczenia Trybunału Sprawiedliwości UE, rezolucje, komunikaty etc. Racjonalnym następstwem zrozumienia istotności przestrzegania prawa i szacunku państw do wspólnej aksjologii, jest przyznanie organom unijnym kompetencji, aby ingerować w sytuacje, gdzie to prawo nie jest respektowane. Tak też zbudowany jest system prawny UE, na mocy którego szczególnie Komisja, lecz także Parlament i Rada otrzymały kompetencje do interweniowania w razie naruszania praworządności przez państwo członkowskie.
In order to understand whether and why European Union law should apply to violations of the rule of law by a Member State, we should first of all refer to EU legal acts. However, due to the fact that EU law reflects the axiology and goals of the European community, knowledge of these factors will be helpful in interpreting treaties and other documents. The idea of the rule of law, drawn from the constitutional tradition of the Member States, is of fundamental importance for the European Union. for this reason, it is repeatedly referred to in treaties, judgments of the Court of Justice of the EU, resolutions, communications, etc. The rational consequence of understanding the importance of compliance with the law and the respect of states to a common axiology is granting EU bodies the competence to interfere in situations where this right is not respected. This is also how the EU legal system is built, under which notably the Commission, but also Parliament and the Council, have been given powers to intervene in cases of violations of the rule of law by a Member State.

This paper presents the most important aspects related to the system of European patent with unitary effect. The author takes a legal analytical approach and considers economic aspects, and issues surrounding European patent, European patent with unitary effect and the agreement on a Unified Patent Court. The conclusions drawn from the analysis are presented from two perspectives – interests of Poland and the EU.

As of 27 November 2017 the deadline passed by which the European Union Directive 2013/48/EU on the right of access to a lawyer should have been implemented by the Member States in their respective legal systems. Poland completed the said responsibility only ostensibly, for no legal norms which regulate the standard of the right to formal defence contained in Polish Code of Criminal Procedure have been amended. This very situation makes it necessary to consider whether the norms of the directive in question may cause the so-called direct effect in Poland’s domestic legal system, particularly: whether prosecuted individuals may directly invoke the directive in order to, based on its content, seek the assistance of a lawyer in the course of criminal proceedings. Therefore, it stands to reason that, at least in relation to some of the competences envisioned in the directive, such eventuality exists, whereas in remainder of the cases the judicial bodies are obliged to interpret the respective norms of the Code of Criminal Procedure in pro-EU manner, thereby elevating the standard of right to formal defence present in Polish criminal proceedings. Nonetheless, the real transposition of this directive should be postulated, since invoking its direct effect cannot exempt a Member State from implementing it in accordance with EU treaties as a way to harmonize domestic legal systems.
