Opis:
The concept of mediation in foreign language teaching and learning is becoming increasingly present in literature, but due to the evolving nature of this term, many studies do not include all of its aspects. Since the publication of Common European Framework of Reference for Languages in 2001, the notion of mediation has been considerably developed and the scope of mediation activities has been extended. This article is devoted to the term “mediating concepts”, which is used in Companion Volume from 2018, which updates the CEFR 2001. On the basis of the latest studies, we would like to discover what is understood by the latest idea of “mediating concepts” and what are the practical applications of these theoretical considerations, using the example of a new method of teaching French: C’est parti!

Impossibilium nulla obligatio est, Initial impossibility of performance, German Law
Opis:
On 1 January 2002 the Act on the Modernisation of the Law of Obligations (Gesetz zur Modernisierung des Schuldrechts vom 26 November 2001, BGBl I, 3138 ff.) entered into force, which fundamentally changed large parts of the German law of obligations. The aim of the reform was not only a need of cover gaps in the over hundred years old German Civil Code (BGB) regulations concerning the national obligation law. Beyond that was the reform aimed at bringing some of the most outdated parts of the German Civil Code into line with modern international developments. According to this, during the preparation of the reform the stipulations of Community law (expecially the need of implementation by 1 January 2002 the Directive 1999/44/EC of the European Parliament and Council on certain aspects of the sale of consumer goods and associated guarantees) and the UN Convention on the International Sale of Goods (CISG) as well as the Principles of European Contract Law (PECL) were taken into consideration. In the end, a number of specific statutes aiming at the consumer protection have been integrated into the BGB as well as many areas of the law of obligations (for instance sales contracts, credit transactions, etc.) have been affected. However, the largest changes concerned the breach of contract, which one of the part is the regulation of initial impossibility of performance. According to the old § 306 BGB, a contract, the performance of which was impossible, was void. § 307 BGB (old version) allowed the purchaser to recover his negative interest if the vendor knew or should have known about the impossibility. It was incorrectly said that the rule from the old § 306 BGB has its origin in Roman law, more precisely in the Celsus phrase impossibilium nulla obligatio est (D.50.17.185). According to the new § 311 a BGB a contract is not invalid merely because at the time it was concluded performance of the obligation assumed was impossible. The new regulation stays in line with Art. 4:102 PECL and Art. 3.3 Principles of International Commercial Contracts (The Unidroit-Principles).

Numerous human transcripts contain tandem repeats of trinucleotide motifs, the function of which remains unknown. In this study we used the available gene expression EST data to characterize the abundance of a large group of these transcripts in different tissues and determine the mRNAs which had the highest contribution to the observed levels of transcripts containing different types of the CNG repeats. A more extensive characteristics was performed for transcripts containing the CUG repeats, and those encoding the repeat-binding proteins. The scarcity of double-stranded CUG repeats as well as various proportions of the single-stranded and double-stranded CUG repeat-binding proteins were revealed in the studied transcriptomes. The observed correlated levels of transcripts containing single-stranded CUG repeats and of proteins binding single-stranded CUG repeats may imply that in addition to transcripts which only provide binding sites for these proteins there may be a substantial portion of the transcripts whose metabolism is directly regulated by such proteins. Our results showing a highly variable composition of triplet repeat-containing transcripts and their interacting proteins in different tissues may contribute to a better understanding of the mechanism of RNA-mediated pathogenesis in triplet repeat expansion diseases.

The concept of Christian morality depends on the place that is given to love and how this love is expressed (its specificity). In the context of contemporary concepts of love and the loss of man in the field of love, it is particularly important to recognize the new commandment of love. Love is, on the one hand, a gift of God, and on the other – it has been clearly formulated as a commandment. In the following publication – based on the teachings of Pope Benedict contained in the encyclical Deus caritas est – the theme of love will be presented as the New Covenant law, expressed in the Jesus new commandment of love. This reflection will be an attempt to explain in what key to properly understand the new commandment of love, which Jesus proclaimed to his disciples and how it should be implemented in the life of a believer. For love is the heart of the morality of the New Covenant.
Koncepcja moralności chrześcijańskiej zależy od miejsca, jakie przyznaje się miłości i jak się tę miłość (jej specyfikę) ujmuje. W kontekście współczesnych koncepcji miłości i zagubienia człowieka na płaszczyźnie miłości szczególnie ważne staje się rozpoznanie nowego przykazania miłości. Miłość jest z jednej strony darem Boga, a z drugiej – zostało wyraźnie sformułowane jako przykazanie. W niniejszej publikacji – w oparciu o nauczanie papieża Benedykta zawarte w encyklice Deus caritas est – zostanie ukazany temat miłości jako prawa Nowego Przymierza, wyrażony w Jezusowym nowym przykazaniu miłości . W refleksji będzie podjęta próba wyjaśnienia, w jakim kluczu właściwie rozumieć nowe przykazanie miłości, które Jezus proklamował wobec swoich uczniów oraz jak powinno być ono realizowane w życiu człowieka wierzącego. Miłość bowiem jest sercem moralności Nowego Przymierza.

This study is devoted to the issue of the subsequent inability to provide services by an agricultural producer under a cultivation contract, in a situation where the inability to perform an obligation is a consequence of circumstances for which neither party is responsible. The legislator has specifically regulated the inability to provide services by an agricultural producer in art. 622 of the Civil Code. However, for a full analysis of this issue, it is necessary to refer to the provisions of the general part of the law on obligations. The current legal regulation puts the risk of the agricultural producer in too asymmetrical way. Therefore, the current legal status has been critically addressed.
Niniejsze opracowanie poświęcone jest zagadnieniu następczej niemożliwości świadczenia producenta rolnego z umowy kontraktacji w sytuacji, gdy brak możliwości wykonania zobowiązania jest następstwem okoliczności, za które żadna ze stron nie ponosi odpowiedzialności. Ustawodawca w sposób szczególny uregulował przypadek niemożliwości świadczenia producenta rolnego w art. 622 Kodeksu cywilnego. Niemniej dla pełnej analizy tego zagadnienia niezbędne jest sięgnięcie do przepisów części ogólnej prawa zobowiązań. Obecna regulacja prawna w sposób zbyt niesymetryczny obciąża ryzykiem producenta rolnego. Do aktualnego stanu prawnego odniesiono się zatem w sposób krytyczny.

Otwarcie linii TGV Est-Europeenne umozliwiło zwiększenie rozkładowej prędkości jazdy pociągu, licząc prędkość na odcinku od starru do zatrzymania aż o 18 km/h i wynosi ona obecnie prawie 280 km/h. Na Tajwanie linia dużej prędkości Taipei-Kaohsiung wyniosła ten kraj z około czterdziestego miejsca na trzecie w światowej tabeli krajów eksploatujących pociągi dużej prędkości. W najbliższych latach należy się spodziewać dalszego zwiększania prędkości jazdy pociągów, gdyż wciąż budowane są nowe linie.

Rozwój sieci kolei dużych prędkości we Francji trwa już ponad 25 lat. Od 27 września 1981 r., kiedy otwarto pierwszy odcinek linii dużych prędkości Paryż - Południowy Wschód (Paris - Sud-Est), do czasów obecnych, linie takie połączyły największe aglomeracje Francji, a ich długość wynosi 1573 km. Oddziaływanie tej sieci linii powiększa fakt, że pociągi dużych prędkości (TGV) kursują również po zmodernizowanych odcinkach liniach konwencjonalnych i obsługują około 7000 km linii.
