    Any act has certain goal, and the judge’s trial discourse is a structured and layered goal system. Judges normally adopt some discourse strategies to reach their trial goals. Based on our trial corpora, we find judges commonly adopt some strong goal-driven discourse strategies, such as question-answer strategy, power control strategy, presupposition strategy, repetition strategy, and interruption strategy, etc., in order to realize their trial goals as well as discourse goals. Strategy in effect refers to means, with which the goal of discourse is to be achieved. As words are intended for both the expression and the achievement of goals, the choice of a means or a strategy relies on the decision of the goal. Only from this perspective is the link between strategy and goal meaningful, and in this sense, strategy means rhetoric. This paper aims to study the judge’s discourse strategies adopted in trials in Chinese courtrooms from the perspective of the goal principle.

    Celem badań polegających na przeprowadzeniu indywidualnych wywiadów pogłębionych z profesjonalnymi prawnikami oraz analizie treści nagrań wideo rozpraw sądowych w sprawach karnych zamieszczonych w serwisie YouTube było ustalenie, które elementy zachowania uczestników postępowania karnego (aktorów) służą potwierdzaniu przestępnego charakteru zarzucanego czynu oraz nadaniu sprawcy etykiety „przestępcy”? Badania zostały osadzone w nurcie naznaczania społecznego, a do interpretacji ich wyników wykorzystano metaforę teatralną Ervinga Goffmana i jego rozważania poświęcone wykonywaniu roli. Zrealizowane badania pozwoliły zidentyfikować i opisać strategie negocjacji statusu przestępcy. Wyróżnione zostały: obiektywizacja opinii, waga argumentacji, „sianie wątpliwości”, odwoływanie się do władzy i podkreślanie profesjonalizmu.
    The aim of the research was to investigate which elements of actions of criminal trial participants lead to criminalizing offenses and labeling offenders as “criminals.” The research was based on labeling theory in criminology and Goffman’s dramaturgical analysis and his perspective of social role. In-depth interviews with professional lawyers and analysis of recordings of court hearings available on YouTube were conducted. The findings of the research project allow answering the question: how lawyers define the strategies for negotiating the status of a criminal during the criminal trial. There were distinguished five strategies: objectivization of opinions, the weight of arguments, “doubts creating,” referring to the authority, and highlighting professionalism.

    Taking into consideration the characteristics of the Hungarian culture, language and legal system, this paper aims to study complex interrogation strategies used by Hungarian judges. This research is based on my corpus consisting of 10 Hungarian criminal trials recorded by a voice recorder, and written notes from direct observations. The analysis has a complex nature, since it relies on the results of (1) linguistics, because the main goal is to present effective interrogation strategies (2) law, because it is crucial to start the research with understanding the function of the discourse type being analysed:the question strategies are intrinsically connected to the institutional role and the legal system by nature, and (3) psychology has also a great role in the investigation of interrogation in two main aspects: the testimony is based on memories and interrogation has an interpersonal part which should not be omitted in discovering the effective question strategies. This research offers rare data to the courtroom interrogation strategies and the results may also have a significant role in legal practice.
    Biorąc pod uwagę cechy węgierskiej kultury, języka i systemu prawnego, niniejszy artykuł ma na celu zbadanie złożonych strategii przesłuchań stosowanych przez węgierskich sędziów. Badania oparte są na korpusie składającym się z 10 węgierskich procesów karnych zarejestrowanych przez dyktafon oraz pisemnych notatek z bezpośrednich obserwacji. Analiza ma złożony charakter, ponieważ opiera się na wynikach różnych dyscyplin naukowych: (1) językoznawstwa – głównym celem jest przedstawienie skutecznych strategii przesłuchań (2) prawa – ważne jest, aby rozpocząć badania od zrozumienia funkcji analizowanego typu dyskursu, ponieważ strategie pytań są z natury nierozerwalnie związane z rolą instytucjonalną i systemem prawnym, (3) psychologii, która odgrywa również wielką rolę w badaniu przesłuchań w dwóch głównych aspektach, ponieważ zeznania oparte są na wspomnieniach i przesłuchaniach, które cechują się interpersonalnością, której nie należy pomijać w odkrywaniu skutecznych strategii pytań. Badanie to oferuje rzadkie dane związane ze strategiami przesłuchań w sądzie, a wyniki mogą również odgrywać znaczącą rolę w praktyce prawnej.

    In about 9% civil and criminal cases that are settled in Swedish District courts every year, i.e. in roughly 10 000 court hearings, an interpreter is employed when at least one of the involved parties speaks another language than Swedish. In this paper, aspects of interpretation in the courtroom are discussed in general, and examples from court proceedings are used to analyse disfluent situations. The role of the interpreter is viewed, and compared to that of other participants’ in the discourse. Aspects of legal rights for the individual are discussed in relation to examples from other language communities. The results show that the confusing situations and misinterpretations are not only dependent on the decisions made by the interpreter. The attitudes and the linguistic behaviour of all discourse participants may contribute to the disfluencies.
    W około 9% spraw karnych i cywilnych w Szwecji czyli około 10 000 rozpraw sądowych pojawia się konieczność zatrudnienia tłumacza, gdyż jedna ze stron postępowania nie zna języka szwedzkiego. Celem artykułu jest przedstawienie zasad przekładu ustnego. Autorzy przeanalizowali przykłady z postępowań sądowych by pokazać problem zaburzeń dyskursu. Rola tłumacza ustnego została przedstawiona z perspektywy uczestnika dyskursu. Wyniki badań wykazały, że niejednoznaczne sytuacje komunikacyjne wynikają nie tylko z błędów w przekładzie, ale także z innych czynników. Postawy i zachowania językowe wszystkich uczestników dyskursu mogą przyczynić się do powstawania omawianych typów zaburzeń.

    Despite the striking affinities of classical Greek and Latin rhetoric with the pragmatist/interactionist analysis of the situated negotiation of reality and its profound relevance for the analysis of human group life more generally, few contemporary social scientists are aware of the exceptionally astute analyses of persuasive interchange developed by Aristotle, Cicero, and Quintilian. Having considered the analyses of rhetoric developed by Aristotle (384-322 BCE) and Cicero (106-43 BCE) in interactionist terms (Prus 2007a; 2010), the present paper examines Quintilian’s (35-95 CE) contributions to the study of persuasive interchange more specifically and the nature of human knowing and acting more generally. Focusing on the education and practices of orators (rhetoricians), Quintilian (a practitioner as well as a distinctively thorough instructor of the craft) provides one of the most sustained, most systematic analyses of influence work and resistance to be found in the literature. Following an overview of Quintilian’s “ethnohistorical” account of Roman oratory, this paper concludes by drawing conceptual parallels between Quintilian’s analysis of influence work and the broader, transcontextual features of symbolic interactionist scholarship (Mead 1934; Blumer 1969; Prus 1996; 1997; 1999; Prus and Grills 2003). This includes “generic social processes” such as: acquiring perspectives, attending to identity, being involved, doing activity, engaging in persuasive interchange, developing relationships, experiencing emotionality, attaining linguistic fluency, and participating in collective events. Offering a great many departure points for comparative analysis, as well as ethnographic examinations of the influence process, Quintilian’s analysis is particularly instructive as he addresses these and related aspects of human knowing, acting, and interchange in highly direct, articulate, and detailed ways. Acknowledging the conceptual, methodological, and analytic affinities of The Institutio Oratoria of Quintilian with symbolic interactionism, an epilogue, Quintilian as an Intellectual Precursor to American Pragmatist Thought and the Interactionist Study of Human Group Life, addresses the relative lack of attention given to classical Greek and Latin scholarship by the American pragmatists and their intellectual progeny, as well as the importance of maintaining a more sustained transcontextual and transhistorical focus on the study of human knowing, acting, and interchange.

    Z badań naukowych wynika, że emocje i poznawcze reprezentacje toczącej się na Sali rozpraw sprawy wpływają na zdrowie psychiczne uczestników postępowania, a w szerszej perspektywie –całych społeczeństw. Od lat 90. problem ten jest dostrzegany i badany przez terapeutyczną jurysprudencję, której najważniejsze założenia mówią o terapeutycznej i antyterapeutycznej mocy postępowania sądowego. Podstawową rolę we właściwym wykorzystaniu tych możliwości odgrywają główni aktorzy postępowania, pełnomocnicy i przede wszystkim sędziowie. W artykule poruszono problem zarządzania przez sędziego pozaprawną warstwą postępowania sądowego w sprawach dotyczących dzieci. Przedstawiono strategie i przykłady stosowania przez sędziów technik kierowania emocjami na sali rozpraw. W podsumowaniu zaproponowano szersze otworzenie się wymiaru sprawiedliwości na wiedzę psychologiczną, psychiatryczną i socjologiczną, a także szkolenia rozwijające umiejętności sędziów w zakresie wzmacniania terapeutycznego oddziaływania sali sądowej.
    Research shows that emotions and cognitive representations which appear in judicial proceeding have impact on health of victims, offenders, and other people involved in the legal process, including the whole society. The phenomenon has been explored by the Therapeutic Jurisprudence movement since early nineties. The approach suggests that the law and legal procedure can function as a therapist. The main roles in producing therapeutic or anti-therapeutic consequences of court proceedings play judges. The purpose of this article is to show how judges manage to control psychological dimension of courtroom proceedings in which children are involved, to foster its therapeutic outcomes. Some examples of emotional control strategy and techniques are presented. In conclusion interdisciplinary approach to judicial proceedings is recommended as well as trainings for judges in identifying therapeutic goals of court hearing and applying useful techniques explicitly and systematically.

    Court interpreting is becoming an increasingly important issue in Translation Studies and interpreting research. The article will be devoted to the analysis of the concepts of competence and quality and their manifestation in the court interpreter’s work. It is assumed that the interpreter’s competence is accomplished in three basic fields, i.e., linguistic (embracing the perfect command of the mother tongue and the foreign language), cultural (knowledge on two cultural realities) and cognitive (combining such cognitive factors as intelligence, experience, general knowledge or motivation). Quality is the concept in interpreting closely related with successful performance and communication (with all its aspects). The attempt at quality description, apart from subjective impressions resulting from our understanding of the importance of features that good – competent – translation and effective communication should have, cannot be devoid of focusing on three principal factors, i.e., the interpreter (as the text author/ producer), interpreting process and product, which is the result of this process and involvement (and competence) on the part of the interpreter. All the above aspects pose a real challenge for the court interpreter.
    Tłumaczenie sądowe (ustne) staje się coraz istotniejsze w badaniach nad przekładem w ogóle i tłumaczeniem ustnym w szczególności. Artykuł poświęcony jest analizie takich pojęć jak kompetencja i jakość oraz ich realizacja w pracy tłumacza sądowego (przysięgłego). Przyjęto założenie, że kompetencja tłumacza jest realizowana w trzech głównych domenach, a mianowicie językowej (obejmującej doskonałą znajomość języka obcego i ojczystego), kulturowej (wiedza dotycząca dwóch rzeczywistości językowych) oraz kognitywnej (łączącej takie czynniki poznawcze jak inteligencja, doświadczenie, wiedza ogólna czy motywacja). Pojęcie jakości w przekładzie ustnym jest ściśle związane z dobrym tłumaczeniem i skuteczną komunikacją. Próba opisu jakości powinna również koncentrować się na trzech głównych filarach tłumaczenia, a zatem na tłumaczu (jako autorze/twórcy tekstu), procesie tłumaczeniowym i jego produkcie z tego procesu wynikającym oraz zaangażowaniu i kompetencji tłumacza. Powyższe aspekty stanowią prawdziwe wyzwanie dla tłumacza sądowego (przysięgłego).

    In recent years, the European Union (“EU”) has faced unprecedented challenges in the rule of law. Besides apparent dangers, it has also offered the Union, its institutions and member states important space for new openings, self-rediscovery, and revisiting certain integration paradigms. This analysis argues that the “rule of law/value crisis” in the EU has created the same space for the Court of Justice to take on the paradigmatic jurisprudential shift from the market to the union of law and values. It posits that the European discourse must revisit the theory of supranational adjudication and offer a new reading of the Court’s mandate and function within the evolving supranational governance and design. In this process, reference to Art. 19 TEU and its connection to Art. 2 TEU have a special explicatory and axiological significance.
    W ostatnich latach Unia Europejska stanęła w obliczu bezprecedensowych wyzwań w obszarze praworządności. Oprócz oczywistych zagrożeń, stworzyło to również Unii, jej instytucjom i państwom członkowskim ważną przestrzeń do nowego otwarcia, samopoznania i rewizji niektórych paradygmatów integracji. Niniejsza analiza dowodzi, że „kryzys praworządności/wartości” w UE stworzył dokładnie taką przestrzeń dla Trybunału Sprawiedliwości do paradygmatycznej zmiany orzeczniczej od rynku do unii prawa i wartości. Analiza ta dowodzi, że dyskurs europejski musi zrewidować teorię ponadnarodowego orzekania i zaproponować nowe odczytanie mandatu i funkcji Trybunału w ramach ewoluującego ponadnarodowego projektu. W tym procesie odwołanie do „prawa” w art. 19 TUE i jego powiązanie z art. 2 TUE ma szczególne znaczenie eksplikacyjne i aksjologiczne.

    This publication defines and characterizes the body language and tries to show its place and its role in the courtroom in the criminal proceedings. According to Albert Mehrabian - one of the first researchers of the body language - only 7% are affected by the words, 38% by the voice signals (the voice tone, the modulation) and 55% by the non-verbal signals. In view of the above fact it follows that the skills of the effective occurrence pay off so are the considerations in this context justified?

    Celem artykułu jest przedstawienie zjawiska intertekstualności jako stałego elementu rozprawy sądowej. Intertekstualność zostanie ukazana jako zjawisko współtworzące zarówno wzorzec normatywny, jak i uzualny rozprawy sądowej postrzeganej jako złożone zdarzenie komunikacyjne. Analiza intertekstualności zostanie dokonana na podstawie normatywnych źródeł wzorca gatunkowego rozprawy sądowej, jak również materiału badawczego pozyskanego w drodze obserwacji uczestniczącej. Przywołane w artykule przykłady będą odgrywały rolę ilustrującą te działania i zdarzenia komunikacyjne związane z intertekstualnością, które stanowią przejaw: (1) realizacji wzorca normatywnego rozprawy sądowej; (2) działań kształtowanych w drodze praktyki postępowania; (2) przekroczenia wzorca normatywnego. Szczególna uwaga zostanie zwrócona na aspekt strukturalny i funkcjonalny tych przejawów intertekstualności, które kształtowane są w drodze praktyki postępowania.
    The aim of this article is to present a permanent part a of trial which is a phenomenon of intertextuality. The phenomenon co-creates the model of trial (seen as a complex communication event). The analysis of intertextuality is conducted on the basis of normative sources of the model of trial and the material recorded during field research in the courtroom. The examples of communication acts and events used in the article are: (1) components of the normative model of trial; (2) created due to communication practice; (3) examples of the normative model of trial contravening. The specific aim of this article is to describe structural and functional aspects of these communication acts and events, which are created due to communication practice.

    Opis:
    The purpose of this paper is twofold. Firstly, it introduces the transformations, which the criminal trial procedure in Poland will undergo following the amendment of the Code of Criminal Procedure of 27 September 2013. Secondly, it explains the consequences that the altered criminal law will have on Polish courtroom discourse. The paper comprises three major parts. It commences with the demonstration of the inquisitorial procedure of witness examination in criminal trials as investigated, described, and expounded by Bednarek (2014), prior to the amendment of criminal law in Poland. Subsequently, it presents the criticism of the inquisitorial criminal trial by the representatives of academia and legal practitioners in Poland, and explains the reasons for the transformation of the inquisitorial criminal trial into an adversarial one. Finally, it demonstrates the new regulations of the Code of Criminal Procedure pertaining to the criminal trial and establishes what effects they will have on Polish courtroom discourse. The paper ends with concluding remarks emphasizing the pressing need for novel and thorough investigations of the language used by judges, attorneys for the prosecution and attorneys for the defense in criminal trials in Poland following the amendment of the criminal law. At the time when this paper is being written the study of courtroom discourse conducted by Bednarek (2014) is the only investigation of talk in interaction in the milieu of Polish courts that focuses on the modus operandi of witness examination from the point of view of linguistics.
    Głównym celem artykułu jest przedstawienie transformacji, jakiej ulega procedowanie rozpraw karnych w Polsce w konsekwencji modernizacji k.p.k. z dnia 27 września 2013, a także wyjaśnienie skutków zmian prawa karnego na polski dyskurs sądowy. Artykuł składa się z trzech części. Rozpoczyna się prezentacją inkwizycyjnej procedury przesłuchania świadków w sprawach karnych, które zbadała, opisała i objaśniła Bednarek (2014). Następnie demonstruje uwagi krytyczne polskich przedstawicieli nauki oraz praktyków pod adresem inkwizycyjnej rozprawy karnej, a także wyjaśnia przyczyny transformacji rozprawy karnej z inkwizycyjnej na kontradyktoryjną. Ostatnia część artykułu demonstruje nowe przepisy k.p.k. odnoszące się do rozprawy karnej oraz omawia skutki, jakie one spowodują w polskim dyskursie sądowym.  Artykuł kończą uwagi podkreślające pilną potrzebę przeprowadzenia nowych, kompleksowych badań dotyczących języka używanego przez sędziów, prokuratorów i obrońców w rozprawach karnych w Polsce w świetle zmiany prawa karnego.
