The modern world is opening up to a series of innovations, differences and broadly understood diversity. The pace of changes becomes a peculiar substructure of creating patchwork nations. The variety of races, colors, religions and cultures. All of the above contain a point which, like an electron, resembles an omnipresent “variant”. This constant value is a human being. We are accompanied by a sense of belonging to a specific place, culture and values. On this basis, we expect something (e.g. having rights and freedoms). Citizenship seems to be a binder that puts us in a clearly narrowed community with certain values and often allows us to distinguish our own “self”. Created by history, absorbing presence, citizenship is an important element of our affiliation to the country, to culture and to the values hidden behind them. In the world of diversity, it seems to be a desirable and important element. The purpose of this article is to discuss the contemporary role assigned to citizenship, as well as to show the citizenship as a factor shaping the position of the individual and justifying the distinction made in specific areas of human functioning in the state.

In the case pending before the Constitutional Tribunal, a review is to be carried out in relation to the statute granting consent for ratification by the President of the Republic of Poland of the European Council Decision of 25 March 2011 amending Article 136 of the Treaty on the Functioning of the European Union with regard to a stability mechanism for Member States whose currency is the euro. Article 90 in conjunction with Article 120 the first sentence in fine of Polish Constitution and Article 48 (6) of the Treaty on European Union are invoked as a standard for the review. In the opinion of the Sejm, those standards for the review are inadequate. In relation to other matters, the Sejm applies for discontinuance of the proceedings due to inadmissibility of making a decision.

The Constitution of the Republic of Poland does not define in a comprehensive manner the matter to be standardized in laws and grants the legislator considerable freedom in determining their content. In view of the subject matter of this opinion, based on views founded on the doctrine of Polish constitutional law and on the jurisprudence of the Constitutional Tribunal and the Supreme Court, it can be concluded that the legislator should regulate by law, among other matters, the following matters reserved for statutory regulation (the principle of exclusivity of the act): regulations concerning citizenship and the rights, freedoms and duties of the individual, as well as the basic competences, principles of how public authorities are organised and function. On the basis of this assumption, it was examined whether there is any indication to the legislator from the constitutional norms relevant to the judicial authority. The following were taken into account: the right to a fair trial (Article 45), the principle of the separateness and independence of the judiciary (Article 173), the principle of bi-instantiality of court proceedings and the principle of statutory determination of the system and jurisdiction of courts (Article 176), the principle of the presumption of competence being assigned to common courts (Article 177), and the principle of the non-removability and non-transferability of judges (Article 180). On the basis of an analysis of these constitutional norms, it was concluded that the Constitution of the Republic of Poland enforces statutory regulation of the organisational structure and the material, local and appeal jurisdiction of common courts, and only allows for entrusting specific matters to be regulated by executive bodies by means of a regulation. In the event of any doubts as to whether a given case should be classified into the category of specific matters, the principle of exclusivity of the Act applies.

The reform of higher education in the Republic of Poland, which was introduced by the Act of 20 July 2018 Law on higher education and science (Dz.U. 2018, item 1668, as amend-ed; hereinafter: Law on higher education and science), revitalized interests in the free-dom of scientific research, optimal ways of its implementation and the role of the state in the support of scientific and research activities. For this reason providing an answer to questions concerning the genesis of regulation of the freedom of scientific research in the Constitution of the Republic of Poland of 2nd April, 1997 (Dz.U. 1997, No. 78, item 483, as amended; hereinafter: the Constitution of the Republic of Poland), specifically in relation to its recognition and position in the Polish constitution, the normative con-tent of the freedom, the beneficiaries and entities obliged to comply with it, appears ap-propriate. These issues seem to be of particular importance. First of all, the freedom of scientific research shall be one of the crucial elements of a knowledge-based economy, with a significant role of higher educational institutions. Secondly, the proper function-ing of universities indicates a broader establishment of human rights. What is more, the hitherto undertaken attempts to define the freedom of scientific research seem not to be incisive enough. The aim of this article, therefore, is to draw attention to the issues and difficulties associated with the freedom of scientific research. The answers given to the aforementioned questions, however, having regard to the limited scope of the publica-tion, cannot be deemed definitive.
Reforma szkolnictwa wyższego w Rzeczypospolitej Polskiej, której emanacją jest usta-wa z 20 lipca 2018 r.Prawo o szkolnictwie wyższym i nauce (Dz.U. 2018 r., poz. 1668 ze zm.; dalej: Prawo o szkolnictwie wyższym i nauce) przyniosła renesans zainteresowa-nia wolnością badań naukowych, optymalnymi sposobami jej realizacji oraz rolą pań-stwa we wspieraniu działalności naukowo-badawczej. Stąd celowe wydaje się udzielenie odpowiedzi na pytania o genezę regulacji wolności badań naukowych w Konstytucji RP z 2 kwietnia 1997 r. (Dz.U. Nr 78, poz. 483 ze zm.; dalej: Konstytucja Rzeczypospolitej Polskiej), miejsce wolności badań naukowych i sposób jej ujęcia w systematyce w ustawie zasadniczej; treść normatywną wolności badań naukowych, a także podmioty wolności badań naukowych i adresatów tej ostatniej. Kwestie te mają – z kilku względów – zna-czenie szczególne. Po pierwsze, wolność badań naukowych powinna być jednym z klu-czowych elementów gospodarki opartej na wiedzy, w której uczelnie wyższe odgrywają doniosłą rolę. Po drugie, prawidłowe funkcjonowanie uniwersytetów jest jednym z mier-ników szerszych praw człowieka. Po trzecie, wolność badań naukowych jest zagadnie-niem dość słabo poznanym. Owe odpowiedzi, ze względu na ograniczone ramy niniejsze-go opracowania, nie pretendują do miana wyczerpujących. Celem niniejszego artykułu jest jedynie zarysowanie tematu i związanych z nim problemów.

We present the institution of a local referendum from a comparative perspective on the example of legal regulations in Ukraine and Poland. The study is the result of the ongoing research of the two Authors and is of crucial importance in the current political situation – the Russian aggression against Ukraine. Hence, it is relevant both nationally, Europe-wide and internationally. The analysis includes a legal comparative analysis of institutions and an attempt to assess their effectiveness. The authors point out that there is a need for effective ‘safeguarding’ in Ukraine to prevent the referendum from being used as a political instrument (at hoc), against the will of the people. The analysis uses a dogmatic and comparative legal method and draws on the authors’ experience of holding local referendums. This research may be useful not only for the researchers of the local government law but also for the legislators.

Transformations in the sphere of public finance in Poland and the new legal regulations which they entail have given rise to a debate on future constitutional solutions concerning this sector. There is also a need for an assessment of the existing constitutional provisions regarding this area. The constitutional aspects of public finance should be studied on the grounds of dogmatic and legal analysis, with reference to the theory of public finance. The budget act (and its main component – the state budget) is a complex and multifaceted document containing provisions based on both cash and accrual approaches, regarding annual and multiannual perspectives alike. The phrase ‘financial plan’, which is used in the literature in reference to the state budget, does not reflect the legal standing of this act as it is, above all, an annual public-law authorisation granted to the government by the parliament. Potential changes in the constitutional provisions on the state budget should aim at developing legislation concerning budget planning principles, such as the principle of completeness, accuracy, balance and others. Theconstitution should also contain modified or altered paragraphs regarding: i. the validity of governmental project of the budget until the budget act is passed (e.g. introduction of budget prorogation), ii. President’s prerogative to shorten the parliamentary term (if a budget is not passed within stipulated time), iii. increasing the budgetary authority of the Senate, iv. the limits of public debt and the possibilities of its financing (laws on state debt, public deficit and its financing are already provided by the EU law), v. the system and financing of local government units (identifying the types of tax revenue of local governments and specifying the range of business activities which they can conduct), vi. issues related to taxation (preferably taking into account not only the legal perspective, but also social and economic ones).

The issue of constitutional protection of natural resources does not arouse the interest of lawyers, including constitutionalists, in Poland. In none of the drafts of the new Constitution of the Republic of Poland presented after 1989 was this issue regulated. After the new Constitution of the Republic of Poland came into force in 1997, no draft amendment to this act dealing with natural resources was submitted either. The constitutional surveys conducted in 2011 and 2017 did not explicitly call for a complete or even very extensive amendment of the Constitution. Most often, they indicated the need for punctual amendments or concerning certain areas of constitutional regulation. In light of the experience with forest management, it would be advisable to extend constitutional protection to all strategic natural resources.

The SARS-CoV-2 pandemic has undoubtedly become a challenge for all lawmakers around the world - implying, among others, the need to introduce restrictions on freedom of expression due to health protection. Different countries dealt with this challenge in various ways, which was influenced not only by the systems in force in these states, but also by the specific characteristics and conditions of these countries. Hence, the purpose of this study is to answer how did the pandemic affect the legal situation in the Republic of Poland, with particular attention being paid to: 1) statements whose purpose or effect was to make it difficult or impossible for the state to perform the obligations implied by "health protection"; 2) statements substantively contesting the official information policy of the state on pandemic issues; 3) statements of representatives of the authorities, which are a reaction to the expression referred to above in points 1 and 2. Of course, this study - due to the modest volume - does not pretend to be exhaustive. Its purpose is only to outline the title topic and related issues.

The content of this publication is a presentation of the meaning of the formula which refers to human dignity. The understanding of this idea should always remain in accordance with the legislative and judicial acquis of countries of western civilisation sphere. Based on judicature and source literature, respective attributes of human dignity, which Article 30 of the Constitution of the Republic of Poland refers to, have been explained. A change of the attitudes of constitutional lawyers’ community and the Constitutional Tribunal has been highlighted, with the possibility of referring to the content of this article as an independent model of constitutionality of law under an abstract and concrete control. Initially, human dignity was considered as a general rule and not legal rights.

The aim of the study is to draw attention to the principle of sustainable development, which is contained in the Article 5 of the Constitution of the Republic of Poland. As a constitutional value, it certainly refers to such goods as ensuring environmental protection and protection of human and civil rights. It is a systemic principle and its main purpose is to oblige public authorities to undertake specific socio-economic and political activities taking into account present and future generations. This principle is analyzed in many sciences, most often in economic and administrative-legal terms. There is no single, legal definition of this principle, which would allow for the uniformity of interpretation of the legal provisions referring to its application and observance.
Celem opracowania jest zwrócenie uwagi na zasadę zrównoważonego rozwoju, która zawarta została w artykule 5 Konstytucji RP i odniesienia jej w przepisach prawa administracyjnego. Jako wartość konstytucyjna odnosi się na pewno do takich dóbr jak zapewnienie ochrony środowiska i ochrony prawa człowieka i obywatela. Jest to zasada ustrojowa i jej celem jest przede wszystkim zobowiązanie organów władzy publicznej do podejmowania określonych działań społeczno-gospodarczych i politycznych mając na uwadze obecne i przyszłe pokolenia. Zasada ta analizowana jest w wielu naukach, najczęściej w ekonomicznych i administracyjno- prawnych. Nie ma jednej, legalnej definicji tej zasady, co pozwalałoby na jednolitość interpretacji przepisów prawa odsyłających do jej stosowania i przestrzegania.

The main research aim of this article is an analysis of the length of the parliamentary term of office in Poland based on the analysis of legal rules. According to the art. 98 para. 1 of the Constitution, the parliamentary term of office starts on the day on which the Sejm assembles for its first sitting and ends on the day preceding the first assembly of the newly elected Sejm. Although the mentioned rule also expressly states that parliamentary term of office lasts 4 years, the length of the particular terms of office could be very different. If the parliamentary term of office is shortened, it could last even less than two months. If it is prolongated because of the introduction of the extraordinary measure, it could last approx. 5 years (in case of emergency state), or it maximal length can not be defined. Moreover, even in case of the “normal” terms of office they could have different length – slightly less than 4 years or longer than 4 years by even a few weeks. The presented considerations lead to the conclusion that there is need to make certain amendments of the rules of law concerning this area, which would ensure minimal 4 years length of the “normal” parliamentary term and regulate the organisation of the parliamentary elections after the termination of the extraordinary measure. Author analysed the legal rules basing on legal-dogmatic method and interpreted them by using such methods of their interpretation as: language-logical, teleological and systematic.

The aim of this article is to present marriage and family protection in the light of Polish constitutional law. The Constitution of the Republic of Poland provides for this protection through a constitutional guarantee. The publication shall present aspects of marriage and family not only on the basis of the regulations of the Basic Law, but also in accordance with the Family and Guardianship Code. The discussion in this article focuses mainly on protection of the institution of marriage and family as the fundamental social unit. Furthermore, a comparative analysis of constitutional legislation including the Basic Law of the Republic of Italy and Spain in the field of marriage and family protection has been performed.
