This article discusses the issues related to the limits of the European Union competence in external relations in terms of the copyright law with a focus on the problem of defining its particular areas as “commercial” or “non-commercial”. According to Article 207 TFEU, the scope of the common commercial policy (under an exclusive competence of the EU) includes the commercial aspects of the copyright law; thus, it is vital to set a clear demarcation line. Through the analysis of settled case law of the European Court of Justice (incl. judgement in case C-414/11 and in case C-114/12) the authors diagnose numerous problems related to determining whether and to what extent the European Union has the exclusive competence over the intellectual property law. This also leads them to a conclusion that the European Union has a very wide competence as regards the conclusion of agreements concerning intellectual property rights, what poses a substantial risk.

RESEARCH OBJECTIVE: This article aims to present the principles of decision-making, distribution of competences regarding the common commercial policy (CCP), with attention given to the evolution of European Parliament’s (EP) role and to identify actions taken by the EP in relation to the CCP. THE RESEARCH PROBLEM AND METHODS: Due to the Member States’ delegation of powers to the supranational level and decision-making procedures, allegations that there is no democratic legitimacy in the European Union are of particular relevance to the CCP. In this context, special importance is given to the role of the European Parliament and powers vested in it, especially over the past years. The article employs an analytical and descriptive method. THE PROCESS OF ARGUMENTATION: The first part presented decision-making principles for the EU’s common commercial policy. Next, the evolution of the European Parliament’s role in the shaping of the CCP was discussed. Finally, the last part gives attention to the EP’s actions in practice and attempts to assess what was a decisive factor behind the Parliament’s specific position. RESEARCH RESULTS: The Treaty of Lisbon increased the formal powers of the European Parliament with regard to the CCP, but at the same time, diminished the role of Member States’ national parliaments (which was due to the fact that the CCP coverage was extended and the scope of the EU’s exclusive competences was broadened). The research conducted has revealed that the EP is more and more often taking advantage of its position in the shaping of the EU commercial policy. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: Due to the fact that the role of the European Parliament in the decision-making process has increased, the issue of a democracy deficit in the shaping of the CCP, which was raised in the pre-Lisbon Treaty period, is currently becoming less formally legitimate.

Commercial fishers in Poland demonstrate a unique version of “transition fatigue” (Rovelli, Zaiceva 2009). The situation leading to this phenomenon is related to three changes that occurred during the twentieth century. First, communist rule was marked by an orchestrated process of industrialization and a shift toward state-controlled fisheries after WWII. Second, political and organizational changes during the transition from a socialist to a free market economy in the nineties weakened social support and welfare structures in place during communism (and failed to replace them with something else). Third, accession to the European Union in May of 2004 introduced a new fisheries management strategy to the Polish fishing industry and the communities on the Baltic Sea coast. A regulatory vacuum created during the nineties has had negative effects on contemporary management strategies. EU-wide goals to reduce overcapacity since 2004 have significantly altered the composition of the Polish Baltic Sea fleet, while it is unclear that decommissioning schemes in Poland have had the positive results intended (Kuzebski, Marciniak 2009). A fishing closure and subsequent protests throughout the cod fleet in 2006 and 2007 underlined persistent problems in the management of Atlantic cod (Gadus morhua). In light of a potential shift to transferrable fishing concessions in the cod fleet, policy-makers should account for “transition fatigue” during the implementation process.

EU Competence and Intellectual Property Rights. Internally Shared, Externally Exclusive? Abstract: The European Union’s competence in external relations remains widely debated whenever the conclusion of an international agreement is about to happen. The recent focus mainly concerns the EU’s planned external trade agreements which grant it exclusive competence in this area. This is particularly complex in the field of intellectual property rights, where the EU has exclusive competence only with respect to the commercial aspects of the domain. This paper examines how the notion of the commercial aspects of intellectual property is interpreted by the Court of Justice of the European Union. We also analyze the possible implications of the broad approach adopted by the Court. In this regard, we first discuss the Court’s line of argument in the Daiichi Sankyo case. Then we scrutinize and verify the interpretation applied by the Court, which is significant in order to predict future case law developments in this area. We also relate the Court’s verdict to the EU’s internal regulations which brings us to the conclusion that the approaches taken in external trade relations and within the internal market contradict each other, leading to a legal or interpretative dead-end. Although detailed and specific, the results of this analysis make it possible to understand the complexities underlying the political turbulences that often occur when the EU negotiates international trade treaties.
Kompetencje wyłączne Unii Europejskiej w relacjach zewnętrznych tej organizacji są przedmiotem wielu debat za każdym razem gdy ma dojść do zawarcia przez UE umowy międzynarodowej. W ostatnich latach szczególną uwagę przywiązuje się do planowanego zawierania przez UE umów o wolnym handlu, w której to dziedzinie Traktaty przyznają Unii kompetencje wyłączne. Problem zakresu tych kompetencji okazuje się szczególnie problematyczny w odniesieniu do ochrony własności intelektualnej. W tej dziedzinie Unii Europejskiej przyznano kompetencje wyłączne jedynie w zakresie handlowych aspektów tej dziedziny. W niniejszym artykule badamy jak pojęcie „handlowych aspektów własności intelektualnej” interpretowane jest w orzecznictwie Trybunału Sprawiedliwości Unii Europejskiej (TSUE). Rozważamy także skutki, jakie nieść może za sobą szeroka wykładnia tego pojęcia zaproponowana przez Trybunał. W związku z tym, w niniejszym artykule po pierwsze, omówiliśmy linię orzeczniczą TSUE rozpoczętą wyrokiem w sprawie Daiichi Sankyo. Następnie ustalamy i dokonujemy oceny metod wykładni przyjętych przez Trybunał w ramach tej linii orzeczniczej. Jest to szczególnie istotne dla przewidzenia dalszego rozwoju orzecznictwa w tym zakresie. Odnosimy też powyższe wnioski TSUE do regulacji rynku wewnętrznego, dochodząc do wniosku, że odmienne podejścia przyjęte przez Trybunał w relacjach zewnętrznych oraz w ramach rynku wewnętrznego wykluczają się wzajemnie i prowadzą do prawnego czy interpretacyjnego impasu. Mimo że przedstawiona w niniejszym artykule analiza odnosi się do konkretnego i szczegółowego problemu, to wywiedzione na jej podstawie wnioski pozwalają na zrozumienie przyczyn prawnych i politycznych komplikacji towarzyszących zawieraniu przez Unię Europejską umów o wolnym handlu.

This article explores shifts in participation by artisanal Polish fishermen in management of the Atlantic cod (Gadus morhua) fishery since accession to the European Union. The European Union works to promote the long-term presence and influence of artisanal fishermen throughout Europe, and entering into the European Union system included an enhanced focus on stakeholder participation in Polish fisheries. However, impacts of this on artisanal fishermen have not been clear. For this project, shifts in participation by Polish artisanal fishermen in existing stakeholder forums were explored. A list of stakeholder groups in the Polish fishery was formulated, and stakeholders from multiple groups were interviewed about the fisheries management process. Participation by artisanal fishermen over time was qualitatively analyzed using inductive content analysis. Interview responses did not suggest that artisanal fishermen have experienced a marked increase in participation in the EU CFP system since accession in 2004. Although an increased number of potential spaces for them to participate exist, project participants did not identify artisanal fishermen as consistently or effectively active within them. This research is timely and important, because it addresses potential impacts of EU accession on artisanal fishermen in Poland. At the same time, descriptions of participation outlined in this paper are preliminary, and are meant to guide further inquiry into stakeholder participation in Polish fisheries management.

Switzerland’s foreign policy priorities include, among other things, relations not only with neighbouring countries, but also with the EU. Being a country which is located in the heart of Europe, Switzerland considers the relations with the European Union (EU) and its Member States to be of special importance. The paper aims to present mutual relations between Switzerland and the European Union over the past years, demonstrate benefits and threats arising from Switzerland’s decision to choose, as the only one of all third countries, a path of “bilateral agreements”, as well as describe possible scenarios for mutual relations following the rejection of an institutional agreement, which was expected to put that relationship on a new path. The strategy of bilateralism brings many bene fits to Switzerland. However, due to the firm position of the EU, it will be necessary to look for new scenarios for the development of mutual cooperation. Perhaps such a solution would be to renegotiate the free trade agreement with Switzerland and turn it into a next-generation trade agreement.

The article presents the outcomes of the research concerned the issue of the European Union’s foreign economic policy, as well as its models and instruments. The EU applies various approaches in relations with third countries, that is determined by differences in aims it intends to achieve in every specific case. The EU acquis constitutes only general framework of the European Union’s foreign economic policy, that results in disorderliness and incoherence of European Union in relations with third countries. The Author identified key determinants, that actually shape current models of the European Union’s foreign economic policy towards various groups of states. Significant problems and failures have been found. Analysis carried out in the article leads to the conclusion that current models and instruments of foreign economic policy, used by the EU, are not sufficiently efficient and often do not allow to meet new challenges effectively. New approaches and solutions have been proposed by the Author can help to improve the foreign economic policy of the EU and to adjust it to the contemporary global challenges.
