In these remarks I make an attempt to understand and present the functioning of authorities in science. I do use in the first place the earlier claims which present this issue in a historical perspective. This allows to grasp the social process of emergence of the authorities as well the changing of their position in the way they are functioning. Especially the thoughts of Max Weber are being considered by my as useful in this matter. I do share his general thesis saying that even the greatest of scientific authorities – called by me in these remarks ”centennial” – couldn't occur and function without their social and cultural ”background”. This had led in large extent to the situation where these authorities fist played a significant role in the development of science and  then went over to a more or less dignified ”retirement”. In this and other issues I present some of my own remarks and sugestions.

The purpose of this article is to analyse the competences of the supervisory authority provided for in the General Data Protection Regulation (GDPR) as a tool to shape the practice of personal data processing. This article verifies the thesis that the status of the supervisory authority formed in the GDPR, taking into account the authority’s independence, makes it possible to exercise the authority thoroughly, which is the basis for shaping personal data processing practice. Supervisory authorities have a wide range of powers to carry out the duties assigned to them. This is guaranteed by their independence. The exercise of powers resonates with all entities that fall under the jurisdiction of those authorities. The decisions of the authorities become the subject of interest of both the literature and personal data administrators. The powers connected with imposing administrative penalties might play a particular role. Their imposition causes that entities which are in similar circumstances may expect to be subject to the same penalties. In order to avoid this situation, they tend to adapt their practices to the model adopted in the decision. Opinions and recommendations, as well as codes of conduct approved by the supervisory authorities for particular sectors, which are a benchmark for administrators in those sectors, play an important preventive role.

The paper presents changes in the way of organizing administrative duties enforcement authorities that took place after 1990. It was found that the changes were caused primarily by alterations in the public administration system. The positive side of the changes is the introduction of the principle that enforcement authorities can be established only by law. The number of bodies authorized to conduct administrative enforcement has decreased, which creates better conditions for the specialization of officials in the field of administrative enforcement. On the other hand, the negative side of the changes is their partial nature and modification of changes after a short period of their validity, and even a return to previous solutions. The legislator does not seem to have a coherent concept of the organization of the administrative enforcement apparatus.

Biuro Dokumentacji Skarbowej (BDS) było organem podatkowym i wywiadem gospodarczym o szerokim zakresie uprawnień ustalonym w 1998 roku w Polsce. W momencie złożenia przez Polskę wniosku do UE BDS stworzył swoje własne kontakty zagraniczne, zwłaszcza z francuską Narodową Dyrekcją Wywiadu i Dochodzeń Celnych. Jednocześnie pożądano dobrych kanałów wymiany informacji z Ukrainą i Białorusią. Osiągnięto również nowe stosunki z niemieckimi organami podatkowymi. Te działania BDS są bardzo interesującą i mało znaną publiczności. Ponadto w artykule przedstawiono problemy BDS w relacjach śródlądowych wynikające z prawa i zmian cywilnych. Wraz z utworzeniem Krajowej Administracji Skarbowej w 2017 r. zamiast BDS i innych organów podatkowych, kompetencje tej instytucji zostały nawet rozszerzone.
Biuro Dokumentacji Skarbowej (BDS) was the tax authority and economy intelligence with wide eligibility established in 1998 in Poland. In the time of Poland’s application to the EU the BDS created its own foreign contacts, especially with the French National Directorate of the Intelligence and Customs Investigations. In the same time good information exchange channels with Ukraine and Belarus were craved. Also new relations with German tax authorities were gained. These actions of the BDS is a very interesting matter and little-known to the public. Furthermore the paper presents BDS’s problems in inland relations due to the law and civil changes. With establishing of Krajowa Administracja Skarbowa in 2017 instead of BDS and other tax authorities the eligibilities of this institution were even enlarged.

As a result of suburbanization, intensification of urbanization processes in suburban areas is taking place. The suburban zone is understood to be an area located in direct neighbourhood of a city or town, related to it and being systematically transformed. It is also defined as a transient area between a village and a city/town, mainly in spatial terms (mixed forms of space development and transient settlement types). The aim of this paper is to define the attitudes of suburban local government authorities towards neighbouring city/town. In order to achieve this aim, methods of analytic description, direct observation, analysis of documents such as “Local development plans”, “Development Strategies”, “The study of causation and directions in spatial management” of suburban municipalities in the Kielce county were used.

Institutions and institutional structures play an important role in the theory and research of processes involved in economic progress. The competitive position of territorial units depends on their effective performance, especially on the efficiency of local governments. Skills, qualifications and functional abilities of local authorities gain importance. In this context, creating and stimulating the economic growth locally is essential, because it equates with building the foundation of development processes in all areas of life. Our purpose was to evaluate the institutional efficiency of local authorities manifested by administrative decisions they take. The data submitted to our analysis consisted of appeals against decisions taken by local governments. The objective was to analyze the appeals filed to local government appeal boards and how they were examined in compliance with the binding law. The time period spanned the years 2007 to 2013. The analysis covered appeals lodged to the Local Government Appeal Board in Olsztyn.

The author presents historical a background and events which led to the existence of the Polish authorities on exile as well as publications of Polish legal acts during the World War II, in the post-war period and nowadays. The author claims that omitting the Polish legislation from the period of 1939–1945 in official journal proves an unjustifiable refuse to regard the legality of the Polish authorities in exile during those years. A solution to that issue has been given in the article. The Authors suggests that the Government Legislation Centre’s should publish legal acts from that period as well as subsequent acts issued by the Polish authorities in exile. In the author’s opinion these acts form a part of the Polish legal system.

Complicated situation in Ukraine’s modern politics and mass media requires an examination of the historical background, in particular the situation of Ukrainian mass media on the eve of the elections to the Parliament of Ukraine on 28 October 2012. The main objective of the study is to analyze the activities and development tendencies of Ukrainian mass media on the eve of parliamentary elections of 2012. Methodology of the research is based on the use of historical and comparative-historical method in the analysis of the political content in mass media. The effect of information transmission as a factor of election influencing the mass media, the effect of political content carriers of the mass media, specialties of a particular mass media group activities are analyzed. The methodology for complex analysis of the mass media in election conditions is proposed.

The aim of the paper is to evaluate alternative food networks (farmers’ markets and community gardens) in Slovak towns in order to determine the views of town self-governing authorities. Data was collected through a questionnaire sent to representatives of towns. The results have shown that only 39% of towns regularly organise farmers’ markets but, overall, 52% of towns support or plan to support their organisation. There are a total of 40 community gardens in 17 towns, mainly in the west of Slovakia. The paper discusses the ways in which Slovak towns support alternative food networks.

Goal – to analyze the activities of public authorities and local governments in the context of decentralization, to identify the main problems of the relationship between public authorities and local governments in order to improve their work. Research methodology – in the article the author applied general (system analysis method, method of argumentation theory) and private scientific methods of cognition (legal: formal‑legal and comparative‑legal methods). Score/results – the article analyzes the process of decentralization of public administration, on the basis of domestic experience, offers ways of functional and structural optimization of relations between public authorities, explores the principles of improving the relationship between public authorities and local governments in the decentralization process. Originality/value – the work is done by the author independently without any help and assistance of others. The article provides links to citations, as well as links to legislation. The nature of the article is a review report.

The article focuses on selected aspects of collaboration between public authorities and public benefit organizations (PBOs). PBOs not only enable the development of active citizenship, but also contribute to the effective implementation of public tasks, thus helping the authorities in implementing their statutory duties. An outcome of the collaboration may be, among other things, an agreement to implement certain tasks, taking the form of, for example, the realization of a task or the support provided for its realization following competitive tendering and in justified cases without the tender, or performed within the framework of a local initiative. The main focus of the article is to determine the scope of the autonomy of the parties in the classic approach, keeping in mind that the autonomy is one of the main principles governing civil law. Parties in a civil law contract must be able to create autonomous relationships. Consequently, in order to fulfil its functions, civil law must be an open system which regulates typical situations in a non-authoritative manner. The essential question seems to be to what extent this attitude may be transposed to public law. Undoubtedly, an agreement as a form of an administrative activity will never have the same legal nature as an agreement concluded between private parties. An administrative body that applies private law forms of action does not become subject to the same rights as a private entity and, consequently, is not exempt from the obligation to comply with the fundamental constitutional principles and values that have been established with a view of protecting civil rights and freedoms.

According to the Author, publication of legislative achievements of state authorities in exile connects the system of a Polish State, which functioned in exile on the legal basis of Constitution of 23rd April 1935, with the contemporary legal system, thus it constitutes preservation of continuity of a Polish State.

According to the author, the civil law regime of tort liability of the state and other public authorities cannot be used to claim damages from the state for living in polluted air. Polluted air is a mass problem. The civil law classic mechanism of tort liability is not adapted to this kind of mass phenomena. In the author’s opinion, such a conclusion stems from the principle of equality of citizens against public burdens. The author believes that this principle is the most important basis for the tort liability of the state. Moreover, he draws attention to various types of aberrations in the shape of the state liability regime, which arise as a result of the CJEU’s case law.

This paper examines the current management of municipal solid waste in Kano metropolis and highlights the problems that impede efficient management. Focus group discussion was employed to ascertain people’s perception of the existing municipal solid waste management services, expectations, and the extent to which residents are willing to support and participate in the process. The results of the study indicated many issues combined to impede efficient management such as the negative externalities namely: the service is free; the incoherent association of poor management of municipal solid waste with diseases occurrences; religious and cultural beliefs; a pervasive lack of trust of all government institution and initiatives related to municipal waste management services. The results also revealed that although public awareness and participation has been shown to be critical in the success of municipal solid waste management endeavour all over the world, it is absent in Kano metropolis. The study recommends use of focus group disussion and other similar mechanisms such as town meetings to create awareness as a means to enunciate citizens charter that will enhance public support and participation in municipal solid waste management in Kano metropolis.

Adopting new technologies into the practice of national government can significantly improve the quality of public services and the government’s general performance. In this paper we present the results of our research on Poland’s performance of e-government in comparison to EU15 and NMS12. The analysis is based on data provided by Eurostat’s Information Society’s comprehensive database. We find that Poland, on average, is lagging behind other European countries from both SMEs perspective and especially from citizens perspective in implementing effective technologies in public sector. In this paper we deliver some recommendations for the polish government.

Celem artykułu jest poszukiwanie przyczyn sprawności samorządów lokalnych w wykorzystywaniu funduszy pomocowych jako wyniku funkcjonowania w regionach o wyższym poziomie społeczeństwa obywatelskiego, które nadaje specyficzną strukturę działaniom zbiorowym i indywidualnym, podejmowanym dla zaspokojenia potrzeb społeczności lokalnych i realizacji celów zbiorowych. Postawiona teza dotyczy uwarunkowanej kulturowo zdolności do samoorganizacji, społecznego współdziałania, stopnia zaufania do otoczenia, tworzących kapitał społeczny w poszczególnych regionach, jako czynnika warunkującego sprawne działanie instytucji na przykładzie zdolności samorządów gminnych do wykorzystania środków z programu SAPARD. Autorka określa operacyjną definicję sprawności władz samorządowych w pozyskiwaniu środków z funduszy pomocowych oraz bada regionalne zróżnicowanie tej sprawności w Polsce, wykorzystując przy tym 9 wskaźników.
"The article deals with determinants of efficient absorption of European Union's structural funds by local authorities entities. It focuses on factors connected with civil society that distinguish different regions. As it was broadly recognized and explored, the ""basis of civil society is the social capital of a region. Social capital includes networks and relationships between people that transmit their shared attitudes and values and therefore influences on structures of common initiatives undertaken by individuals and different groups in order to fulfill local societies' needs. The author studies to what extent social capital of different regions conditioned by cultural factors influences institutional efficiency of local authorities in Poland in relation to absorption of pre-accession fund SAPARD."

Opis:
Until 1919, after Poland regained its independence, the system of territorial state administration with its general competences was in its transitional period. Only central and poviat authorities existed while the intermediate tier, i.e. voivodship level, did not exist. Additionally, there was lack of uniform legal regulations for the organization and scope of general administration. The above postulates were satisfactorily catered for by the order of the President of 19 January, 1928, concerning the organization and scope of general administration (Journal of Laws of 1936, No. 80, pos. 555), which fully regulated and determined the legal status of a voivode. This position was assigned two basic functions. The first one was that of a local representative for the state government, whose task was to oversee the realization of the state policy which was to be executed within the current laws. The other function was to act as the head of administration with general competences.

This paper describes the main aspects of methodology of creating and implementation the Development Strategy for the Poznań Agglomeration. Metropolis Poznań 2020. After 25 years of municipal autonomy in strongly urbanised areas, Polish metropolitan areas now face the start of an integration process in the field of metropolitan governance which has become necessary in response to the dynamic suburbanisation processes. City of Poznań, 20 suburban municipalities and district of Poznań signed an Agreement of Cooperation among the Local Governments of the Poznań Agglomeration The members of the Agglomeration Council unanimously supported the founding of the Metropolitan Research Centre and each municipality provided resources for this purpose, proportionally to their respective populations. The most promising are the prospects for cooperation in creating a Development Strategy for the Poznań Metropolitan Area and new association: Poznań Metropolis.

Subject and purpose of work: The purpose of the study was to identify the areas of activity of the local authorities in the context of the implementation of public tasks that could be financed with funds from the issue of the so-called green bonds. Materials and methods: The main research method was critical analysis of documents (using document of a normative nature and of various ranks) and the literature on broadly defined public finance and financial market issues. The individual case method, as well as inductive and deductive reasoning were also supportive in achieving the purpose of the study. Results: The study presents areas related to the provision of public services and identifies those ofthem which represent negative environmental impact. The identified characteristics of public task entities included provide the premise for answering the question: will an instrument such as the ‘green bonds’ constitute a secure source of funding? The study shows the evolution of legislative changes relevant to the implementation of environmentally sustainable projects while presenting the benefits of their implementation. Conclusions: The conclusions indicate the benefits of financing investments with funds from the issue of ‘green bonds’ for the budget of the local authority, the issuer and the bondholders.

Redefinition of the role of central administration in the policy of support for cluster development Clusters are perceived as accelerator of progress and competitiveness. Thus, the stimulation of their development has become a signifi cant element of EU countries’ policy. The selection of proper instruments that support cluster development poses a peculiarly signifi cant problem. In Poland for a couple of years clusters have become the object of special interest of public authorities of different levels as well. Validity of public administration getting engaged in cluster initiatives’ development is undisputed. Principally it should consist in the stimulation of business environment to take up various forms of cooperation and creation of proper support instruments. In regional policy it plays a strictly qualitative role. However, although this problem has been given a high rank, Polish policy faces numerous restrictions here.

The paper is dedicated to the problems of the participation of the ZNP (Związek Nauczycielstwa Polskiego – The Association of Polish Teachers) in the process of the preparation of teachers for the educational tasks after WWII. The author presents the conditions of the changes of the political system, the stages of the ideological and political takeover of this teachers’ organisation, and the symptoms of the influence of various unions on the teaching environment that was aimed to instil the scientific worldview and to prepare the teachers to implement the goals and the tasks of socialist education.
