Miejsca kultu to przestrzeń, która ma pomóc w nawiązaniu relacji i w spotkaniu z Bogiem. Jest to miejsce wyłączone z użytkowania świeckiego. Jednak nie jest pozbawione konieczności utrzymania i zabezpieczenia właśnie w wymiarze świeckim. Ideałem jest, gdy raz ustanowione miejsce kultu jako takie trwa niezakłócenie przez lata. Nie jest to jednak możliwe w każdym przypadku. Kościoły i kaplice niszczeją tak przez działania człowieka (chociażby wojny), jak i przyrody (kataklizmy). Niebezpiecznym czynnikiem jest także upływ czasu wraz z laicyzacją społeczności odpowiedzialnej za utrzymanie świątyni. Szczególnym przypadkiem jest Francja, gdzie sytuacja własnościowa Kościoła powoduje, że często można znaleźć ogłoszenie o możliwości kupna kościoła lub kaplicy. Społeczność lokalna zaś, najczęściej gmina, musi podjąć decyzję o sprzedaży budynku, który tylko obciąża budżet. Celem artykułu jest przedstawienie sytuacji desakralizacji miejsca kultu we Francji z perspektywy zarówno prawa kościelnego, jak i francuskiego.
A place of worship is a space that is meant to help you establish a relationship and encounter God. It is a place excluded from secular use. However, it is not devoid of the need to maintain and secure precisely in the secular dimension. The ideal is that once established a place of worship as such lasts undisturbed for years. However, this is not always possible. Churches and chapels are destroyed by the actions of man (e.g. war) and nature (cataclysms). Another dangerous factor is the passage of time with the secularization of the community responsible for the maintenance of the temple. A special case is France, where the property situation of the Church means that it is often possible to find an advertisement of the possibility of buying a church or chapel. And the local community, most often the municipality, has to make a decision to sell the building, which only charges the budget. The aim of the article was to present the situation of the desacralization of a place of worship in France from the perspective of both ecclesiastical and French law. - Źródło:
