    Postępowanie kontrolne Najwyższej Izby Kontroli w kształcie obowiązującym od 2012 r. doczekało się już wielu analiz i opracowań. Dotychczas nie podjęto jednak głębszej refleksji nad wprowadzoną wówczas instytucją powiadamiania o ocenach, uwagach i wnioskach zawartych w wystąpieniu pokontrolnym NIK. Artykuł przybliża te rozwiązania prawne, podnosząc liczne, związane z nimi wątpliwości interpretacyjne, wraz z propozycjami rozwiązań. Z pewnością nie wyczerpuje jednak tytułowej tematyki, może natomiast być punktem wyjścia do dalszych dyskusji, analiz i spojrzenia na zagadnienie z punktu widzenia praktyki.
    The article comprises an analysis of the solution introduced on the basis of Article 62a of the Act on the Supreme Audit Office, related to notifying about evaluations, remarks and conclusions included in management letters. Similarly to the other provisions of the amended (in fact the new one) the NIK audit procedure, the Article entered into force on 2 June 2021. It allows for clear differentiation between management letters addressed to the managers of auditees, and notifications about evaluations, remarks and conclusions comprised in management letters that are developed on the basis of other legal provisions. In the text such matters have been discussed as, among other, the origins of notification introduction, entities authorised to issue notifications, ad dressees of notifications and their obligations, and the matter of making a notification publicised. The author indicates legal doubts that arise on the basis of Article 62a of the Act on NIK, by presenting and substantiating proposals for solutions in the area. In some cases, the author also makes proposals for modifying this provision.

    Mimo istniejącego od ponad 16 lat ustawowego obowiązku, wiele samo rządów terytorialnych nie opracowuje programów opieki nad zabytkami. W artykule przeanalizowano podstawy prawne ich tworzenia, relacje między programami, a prowadzoną przez gminę ewidencją zabytków, przed stawiono stanowisko doktryny i orzecznictwa, a także powiązano je z usta leniami wybranych kontroli NIK. Zaproponowano rozwiązania, których wprowadzenie mogłoby ułatwić samorządom wykonanie tych zadań.
    In his article, the author presents self-governmental programmes for monuments pro tection, which have been introduced to the Polish legal system in the Act on monuments protection and maintenance of 2003. The article attempts to combine an analysis of legal basis for monuments protection and maintenance programmes, comments on the respective literature and judicature, and the results of NIK’s audits. Adoption and, consequently, implementation of programmes for monuments protection, has also been entrusted (in addition to State bodies) to self-governmental units on two levels: regional and local (Polish: województwo, and gmina and powiat respectively). Their programmes should play an important role not only in the national heritage system, but in other self-governmental activities as well. The article presents the legal basis for local self-government units as regards monuments protection and maintenance, as well as legal regulations related to self-governmental programmes for monuments maintenance. As for the literature, judicature and NIK’s audit findings, the author of the article discusses, among other, the role of self-governmental programmes as stra tegic tools to integrate local communities, the issues related to the obligation to adopt such programmes and report on their implementation, as well as the relation of pro grammes to the local registers of monuments. The article also comprises NIK’s con clusions related to the programmes discussed.

    Spośród wielu publikacji dotyczących rozwiązań przyjętych w ustawie z 23 grudnia 1994 r. o Najwyższej Izbie Kontroli1 , w tym zaprezentowanych na łamach „Kontroli Państwowej”, stosunkowo mało miejsca poświęcono do tej pory uwagom, o których mowa zwłaszcza w art. 53 pkt 5 ust. 1. To o tyle zaskakujące, że należą do podstawowych elementów wystąpienia pokontrolnego, kluczowego dokumentu powstającego w toku kontroli prowadzonej na podstawie tej ustawy i są jednym z narzędzi oddziaływania NIK2 . W artykule przedstawiono analizę podstawowych rozwiązań ustawowych oraz wynikających z zarządzenia w sprawie zadań kontrolerów. Zamysłem autora było, aby stała się ona punktem wyjścia do dalszych prac lub dyskusji obejmujących zawarte w opracowaniu propozycje zmian de lege ferenda.
    The article is dedicated to legal regulations related to comments in post audit statements of the Supreme Audit Office, referred to in several provisions of the Act on NIK and the regulation on auditors’ responsibilities. The basic provision in the area is Article 53(1)(5) of the Act on NIK since it specifies that comments make one of the elements of a post audit statement, which is the most important document developed in an audit. While the other two provisions (Article 62 and Article 62a) are secondary and supplementary. Comments are supposed to be – like conclusions – formulated only when irregularities are found and they are supposed to concern elimination of irregularities. The author has analysed this solution, presented its consequences and a proposal for changes in the regulations that would extend an opportunity for NIK to submit comments. The article also discusses the issues related to the obligation of an auditee to respond to comments, the possibility to oppose or appeal against them, and to conduct an ad hoc audit to check how comments have been used. NIK’s conclusions and comments have been compared, with regard to similarities and differences alike. While appreciating the role of comments, a proposal has been made to use them by NIK to increase its audit impact.

    Opis:
    Turystyka rowerowa jest w Polsce coraz bardziej popularna. Rosną więc oczekiwania dotyczące coraz wyższej jakości usług tej branży, odpowiedniego standardu miejsc noclegowych, a także przyjaznych miejsc na trasie. Odpowiedzią na nie jest budowa kolejnych szlaków rowerowych o różnym zasięgu: gminnym, międzygminnym, regionalnym i krajowym. Do tych ostatnich należy Wschodni Szlak Rowerowy Green Velo (dalej także Green Velo lub Szlak). To najdłuższa, licząca około 2 tys. km, spójnie oznakowana trasa w kraju, przebiegająca przez obszar pięciu województw: warmińsko-mazurskiego, podlaskiego, lubelskiego, podkarpackiego i świętokrzyskiego, wybudowana kosztem niemal 275 mln zł. NIK sprawdziła jak funkcjonuje oraz co jej zagraża. Ujawniono wiele nieprawidłowości w utrzymaniu dróg we właściwym stanie technicznym i ich oznakowaniu oraz zaniedbania dotyczące przeglądów gwarancyjnych i okresowych kontroli obiektów Szlaku. Zawodzi też współpraca podmiotów odpowiedzialnych za jego sprawne działanie i rozwój.
    The Eastern Cycling Route Green Velo is the longest comprehensive cycling route in Poland, constructed several years ago at the cost of almost 275 million zloty. The route is almost two thousand kilometres long, and it goes through five regions of Poland. The main goal of the planned and ad hoc audits related to Green Velo was to exam ine whether the route was maintained and used in accordance with the objectives set. While the detailed objectives of the audit were related to the compliance with the requirements of the project stability, the expected results of the route, and the regularity of its financing and use. The audit covered 39 entities, including 23 local self-government units – partners in the project, sampled for the audit due to, among other, the length of the Green Velo route running through the roads they manage. The audited entities are responsible for the maintenance of 416 kilometres of the route, and for 35 cyclists service points.

    Rewitalizacja należy do obszarów aktywności władz lokalnych ukierunkowanych zarówno na poprawę zagospodarowania przestrzeni, jak i jakość życia mieszkańców. W ostatnich latach, również ze względu na pakiet dostępnych działań wspierających gminy w programowaniu i wdrażaniu rewitalizacji, odnotowuje się wzrastające zainteresowanie nią samorządów i ich partnerów. Jednak zamiarom realizacji przedsięwzięć nie zawsze towarzyszy właściwe zrozumienie istoty tego procesu i związanych z nim pojęć, zwłaszcza w nowatorskim i kompleksowym podejściu wyrażonym w ustawie o rewitalizacji. Dotyczy to przede wszystkim terminów: obszar zdegradowany, stan kryzysowy, partycypacja społeczna, komplementarność czy monitoring i ewaluacja. Dlatego NIK przeprowadziła dwie kontrole planowe: regionalną na Podkarpaciu, a następnie koordynowaną w pięciu województwach, którymi objęła każdy z czterech etapów procesu rewitalizacji. Na każdym ujawniono wiele błędów. W konsekwencji gminy nie osiągnęły zaplanowanych efektów. Wnioski mogą mieć znaczenie także dla przyszłych założeń rewitalizacji w Polsce.
    Revitalisation is an area of local authorities’ activity, directed both towards spatial ma nagement improvements and towards increasing the inhabitants’ life quality. Over the last years, also due to the portfolio of measures to support municipalities in revitali sation programming and implementation, a decrease can be observed in the interest of self-governments and their partners. However, intentions to take action does not always coincide with the proper understanding of the process’s nature, or the related notions, especially in its innovative and comprehensive approach set forth in the act on revitalisation. This concerns mainly a degraded area, a state of crisis, social par ticipation, complementarity, as well as monitoring and evaluation. That is why NIK conducted two planned audits: an audit in the Podkarpacie region, and later a coor dinated audit in five regions, which covered, in total, each of the four stages of the revitalisation process. At each stage, numerous errors have been identified – which has been presented in the article. As a result, municipalities did not reach the planned outcomes of revitalisation. The conclusions of these audits can be of importance also for future revitalisation programmes in Poland.

    Opis:
    Zapewnienie odpowiednich warunków mieszkaniowych jest ważnym problemem społecznym i gospodarczym. Jednak w zasobach gmin1 wciąż znajduje się wiele budynków z lokalami o niskim standardzie – w bardzo złym stanie technicznym, niewyposażonych w odpowiednie instalacje wodno-kanalizacyjne lub z dużą liczbą lokatorów. NIK zbadała to zagadnienie na terenie pięciu województw. Ustaliła, że tylko połowa kontrolowanych samorządów podejmowała działania służące poprawie sytuacji. W opinii Izby powodem były nie tylko ograniczone możliwości finansowe, ale także nieracjonalna i niezgodna z przepisami polityka mieszkaniowa tych jednostek.
    After the socio-economic transformation in 1989, the housing situation in Poland has started to improve slowly. However, it is still far from desired. There are many houses in Poland that belong to substandard category, with bad technical conditions, without sewage systems, or overcrowded. It is estimated that even one in ten Poles live in such conditions. The problem has been observed by NIK that conducted the audit “Activities of municipalities aimed at improving the technical state of buildings with lowered housing conditions”. The audit covered 20 municipalities from five regions: Dolnośląskie, Łódzkie, Podkarpackie, Śląskie and Zachodniopomorskie. The audit was conducted in 37 units, and since the majority of them entrusted part of their tasks to administrators – these were also audited. The selection of auditees was based on the volume and diversity of municipal housing resources, including the number of buildings with substandard apartments, old buildings and buildings with poor conditions, as well as the type or size of the local self-government unit. The scope of the audit comprised organisational solutions as for the tasks related to municipal buildings with substandard apartments, issues related to guaranteeing their safety and improving their technical conditions, as well as planning, financing and implementation of the tasks related to the management and maintenance of municipal housing resources.

    Opis:
    A new approach to comparative modeling of proteins, TRACER, is described and benchmarked against classical modeling procedures. The new method unifies true three-dimensional threading with coarse-grained sampling of query protein conformational space. The initial sequence alignment of a query protein with a template is not required, although a template needs to be somehow identified. The template is used as a multi-featured fuzzy three-dimensional scaffold. The conformational search for the query protein is guided by intrinsic force field of the coarse-grained modeling engine CABS and by compatibility with the template scaffold. During Replica Exchange Monte Carlo simulations the model chain representing the query protein finds the best possible structural alignment with the template chain, that also optimizes the intra-protein interactions as approximated by the knowledge based force field of CABS. The benchmark done for a representative set of query/template pairs of various degrees of sequence similarity showed that the new method allows meaningful comparative modeling also for the region of marginal, or non-existing, sequence similarity. Thus, the new approach significantly extends the applicability of comparative modeling.
