At the end of the 19th century the first wave of the movement law & economics has taken place in Europe. One of its protagonists was Leon Petrażycki (Leo von Petrażycki, 1867–1931), a Polish jurist who studied in Russia and in Germany. His book “Die Lehre vom Einkommen” whose title can be best translated as “The Doctrine of Income” was published in Berlin in 1893 (1st volume) and 1895 (2nd volume). The doctrine of Petrażycki, who insisted on using economic instead of technical-legal concepts, reveals astonishing resemblances to the modern movement of law & economics, inaugurated in 1960-ties in the USA.

Opis:
The biography of an Austrian specialist in Roman law, Paul Koschaker (1879–1951), who spent the Nazi-time as an elderly professor at important law faculties of Germany, such as Leipzig, Berlin and Tubingen, is reexamined. Recent attempts of image cultivation, which try to acclaim Koschaker the most courageous fighter against every form of totalitarianism in Europe and nearly the patron saint for European jurists, are proved unjustified.

The concept of transnational law is by many modern scholars identified exclusively with the global law or world’s law of the 21st century. However, in legal history we find much older cases of lawmaking which occurs without the intervention of state agencies or even beyond the state. From this point of view we analyze briefly the ancient Roman ius civile, the medieval canon law, the Roman-canon utrumque ius, the old-European capitulations and the cases of legal pluralism which could be found within the Russian Empire.

Based on a recent biography of Franz Wieacker (1908–1994) two central questions are examined. Is it allowed to analyze a young, but already prominent German law professor of the Nazi era as a pure scholar whose identity remained unchanged from the times of Weimar to the Federal Republic of Germany? Is it plausible to treat the Nazis as progenitors of current European legal history, and in particular as founding fathers of European legal tradition?

Values are present not only in law and politics, but also in respective branches of scholarship. Interestingly, already in antiquity even parts of world were con- sidered as value-laden. Already by then, prevailed the bad opinion about the East, represented by Byzantium. As from the ruins of the Western Roman Empire the Europe of Charlemagne emerged, beyond its eastern border a “new” Europe appeared which inherited all the negative features of the East, first of all the economic, moral and legal backwardness. It is the West of Europe, where west- ern civilization and western legal tradition come from. They were assimilated by Poland through its Christianization in the 10 thcentury and through German colonization in the 12–13 thcentury. Poland became in this way a kind of “East of the West”, but the German “bearer of culture” was considered in Eastern Europe directly an advocate of the Occident. Only in two isolated cases Poland overtook Western Europe: the dispute of Paulus Vladimiri against the Teutonic Knights at the council of Constance (1414–1418) and the promulgation of the May constitu- tion in 1791. However, in most cases also within the borders of Europe the West revealed itself unable to learn from the rest.

But first of all: have the exiled actually contributed something to this “shared” legal history?

The Roman Church was a leading public institution of the Middle Ages and its law, canon law, belonged to most powerful factors of European legal history. Today’s lawyers have hardly any awareness of the canonist origins of several current legal institutions. Together with Roman law, canon law constituted the system of “both laws” (utrumque ius) which were the only laws acknowledged as “learned” and, consequently, taught at medieval universities. The dualism of secular (imperium) and spiritual power (sacerdotium), symbolized by so-called two swords doctrine, conferred to the Western legal tradition its balance and stability. We analyze the most important institutional achievements of the medieval canon lawyers: acquisitive prescription, the Roman-canonical procedure, the theory of just war, marriage and family law, freedom of contract, the inheritance under will, juristic personality, some institutions of constitutional law, in particular those based on the concept of representation, and finally commercial law. Last not least, the applicability of canon law defined the territorial extension of medieval and early modern Christian civilization which exceeded by far the borders of the Holy Roman Empire, where Roman law was effective as the law of the ruler. Hence, the first scholar to associate Roman law with (continental) Europe as a relatively homogeneous legal area, Paul Koschaker, committed in his monograph Europa und das römische Recht, published in 1947, the error of taking a part for the whole. In fact, Western legal tradition was based, in its entirety, not on Roman, but rather on canon law; embracing the common law of England, it represented – to cite Harold Joseph Berman – the first great “transnational legal culture”. At the end, some structural features of canon law are discussed, such as the frequent use of soft-law instruments and the respect for tradition, clearly visible in the approach to the problem of codification.

Rechtshistoriker schenken vornehmlich, wenn nicht ausschließlich, denjenigen Rechtsinstituten ihr Interesse, die eine Fortsetzung im geltenden Recht finden. Diese Kontinuitätsideologie, die bereits auf die deutsche Historische Rechtsschule zurückgeht, erhält aktuell Impulse von der Ankündigung des neuen europäischen Privatrechts auf der Grundlage des alten römischen. Eine solche, in Deutschland sehr verbreitete, Ideologie degradiert die Privatrechtsgeschichte zu einer applikativ-selektiven Traditionspflege. Die polnische Romanistik bildete sich unter ganz anderen Bedingungen heraus. Die Kontinuität des altpolnischen Rechts, das keine benerkenswerten romanistischen Einflüsse aufweist, brach infolge der Teilungen Polens zusammen. Auf diese historische Gegebenheit geht die präzise Trennung zwischen Rechtsdogmatik und Rechtsgeschichte zurück. Die erstere war eine Dogmatik des geltenden fremdem Rechts romanistischen Ursprungs, die letzetere eine Geschichte des nicht mehr geltenden einheimischen Rechts slawischen Ursprungs. Mithin nahm Polen das römische Recht spät, aus zweiter Hand und in einer bereits „historisierten” Gestalt als Grundlage des kodifizierten Zivilrechts auf. Dementsprechend war die Legitimation des romanistischen Studiums in Polen traditionell nicht-utilitaristisch und blieb dies in erhöhtem Maß zwischen den beiden Weltkrigen, als Polen die westeuropäischen Kodifikationen durch ein neues Privatrecht zu ersetzen begann, und nach dem 2. Weltkrieg, als das überkommene Zivilrecht durch „sozialistische” Prinzipien überlagert wurde.

Bariatric surgery is currently the only effective treatment option for morbidly obese patients. There has been observed a considerable disproportion between the number of procedures conducted in Poland and the number of patients requiring such treatment. There are no studies assessing bariatric knowledge among general practitioners who play crucial role in polish health care system.The aim of the study was to assess the knowledge of general practitioners regarding bariatric surgery.Material and methods. An anonymous questionnaire conducted among 282 general practitioners in 2010-2011 during local educational conferences. The questionnaire consisted of 10 questions relating to fundamental issues of bariatric surgery.Results. Only one twelfth (8.1%) of the general practitioners questioned knows the indications for bariatric surgery, can apply them, and has epidemiological awareness. 61.5% of general practitioners know the surgical procedures used for the treatment of obesity, whereas 58% of them show the knowledge of surgical technique in which they are performed. Only 23% of general practitioners were aware that bariatric surgery decreases cancer risk. 92% of the participants noticed a necessity of education regarding the surgical treatment of obesity.Conclusions. Bariatric knowledge among general practitioners is not adequate to scientific research results published during the last years. Most general practitioners who participated in our study are aware of that and are awaiting for educational programmes focused on this issue.
