Opis:
The subject of the article concerns securing elections against various kinds of manipulations and other dangers regarding determination of result of the ballot. The starting point is the principle of free and fair elections, which today serves as a  standard regulated by international and domestic law. This principle emphasizes the need for introducing tools of protection which would protect democratic election (and as a result voters) from possible abuses which might lead to deformation of the will of the sovereign, and in consequence to shaping of elected authorities is different way as expected by voters. The principle of free and fair elections is a theoretical background for establishing practical solutions, examples of which are shown in the article. Along this background Polish solutions as well as suggested solutions are presented. The author expresses the need to legally establish the principle of free and fair elections as one of principles of electoral law recognized by law.

Artykuł podejmuje dwa główne zagadnienia. Pierwszym są dysfunkcje prawa, drugim możlie kierunki jego doskonalenia, w zakresie procesu ustawodawczego. Wady polskiego prawa są różne. Należą do nich między innymi  inflacja prawa, jego mała czytelność, brak jasnych podstaw aksjologicznych, transgresja rozumiana jako przekraczanie obszarów materialnych przez akty prawne usytuowane na różnych poziomach w hierarchii aktów prawnych. Mankamentami prawa są również jego zbyt częste zmiany oraz nadmierna instrumentalizacja. Dlatego istnieje potrzeba usprawnienia procesu ustawodawczego. Wydaje się, że zmiany powinny odpowiadać kilku podstawowym hasłom. Każde z nich zawiera oczywiście wiele pomniejszych elementów, które także powinny być przedmiotem ewentualnych korekt. Są nimi kierunkowe wskazania:  1) proces ustawodawczy powinien być bardziej racjonalny; 2) proces ustawodawczy powinien być bardziej profesjonalny; 3) proces ustawodawczy powinien być bardziej uspołeczniony; 4) proces ustawodawczy powinien być bardziej kontrolowany i 5) proces ustawodawczy powinien być bardziej  efektywny.
Article take two main issues. The first are the dysfunctions of the law, the second possibility directions of its improvement, in terms of the legislative process. Disadvantages of Polish law are different. These include, among other things, inflation law, his little clarity, the lack of clear axiological foundations, transgression understood as crossing areas by material acts arranged at different levels in the hierarchy of legal acts. Drawbacks of law are also the too frequent changes and excessive instrumentation. Therefore, there is need to improve the legislative process. It seems that the change should correspond to a few basic terms. Each course includes a number of smaller items, which should also be subject to any adjustments. They are directional indications: 1) the legislative process should be more rational; 2) the legislative process should be more professional; 3) the legislative process should be more socialized; 4) the legislative process should be more controlled and 5) legislative process should be more effective.

Artykuł podejmuje temat ewaluacji ustawodawstwa w parlamencie Francji. Francuski model oceny uchwalonego ustawodawstwa jest wysoce oryginalny i – w jakiejś mierze – niepowtarzalny. Rozstrzyga o tym przede wszystkim podniesienie działań ewaluacyjnych do rangi rozstrzygnięć konstytucyjnych i wyraźne uznanie, że tzw. ewaluacja polityk publicznych (évaluation des politiques publiques) jest jedną z funkcji parlamentu. Doświadczeń francuskich nie można raczej traktować jako wzorcowych dla ustanowienia procedur podobnej oceny w pracach analitycznych polskiego Sejmu. Te są bowiem prowadzone na zasadach ogólnego doradztwa naukowego i eksperckiego, które jednak z formalnego punktu widzenia nie są właściwą procedurą parlamentarną (jak ma to miejsce we Francji). Niemniej można sięgnąć po ogólny schemat metodologii ewaluacji, która niezależnie czy ocena uchwalonych ustaw prowadzona jest przez organy parlamentu (np. komisje) czy też podmioty wchodzące w skład Kancelarii Sejmu (np. BAS) może być zaadoptowany. Chodzi tu przede wszystkim o wprowadzenie dwóch poziomów takiej oceny, tj. poziomu oceny stopnia prawnej implementacji ustawy w życie (za pośrednictwem odpowiednich aktów wykonawczych) oraz poziomu właściwej oceny skutków jakie ustawa wywołuje (ocena merytoryczna). Wydaje się, że w ślad za rozwiązaniami francuskimi można by było również wprowadzić, jako rozwiązanie optymalne, temporalne założenia takiej kontroli, tj. okres sześciu miesięcy na ocenę tego, czy ustawa została przez rząd prawidłowo wprowadzona do obiegu prawnego oraz okres trzech lat na ocenę tego, czy skutki jakie ustawa wywołuje odpowiadają tym, jakie przewidywano w momencie przedłożenia projektu ustawy.
The article deals with the subject of evaluation of legislation in the French parliament. The French model for the assessment of adopted legislation is highly original and – to some extent – unique. This is mainly determined by the increase of evaluation activities to the rank of constitutional decisions and a clear recognition that the so-called evaluation of public policies (évaluation des politiques publiques) is one of the functions of the parliament. French experience can not be treated as a model for the establishment of similar assessment procedures in the analytical work of the Polish Sejm. These are carried out on the basis of general scientific and expert advice, which, however, from a formal point of view, are not the proper parliamentary procedure (as is the case in France). However, one can reach for a general scheme of evaluation methodology, which regardless of whether the assessment of adopted laws is carried out by parliament bodies (eg committees) or entities that are part of the Sejm Chancellery (eg BAS) can be adopted. This is primarily about the introduction of two levels of such an assessment, i.e. the level of assessment of the legal degree of implementation of the Act (through the relevant implementing acts) and the level of proper impact assessment that the Act triggers (substantive evaluation). It seems that following the French solutions, one could also introduce, as a solution, optimal, temporal assumptions for such control, i.e. a period of six months to assess whether the law was correctly introduced by the government into the legal circulation and a period of three years to assess this whether the effects that the Act triggers correspond to what was expected at the time the bill was submitted.

Artykuł przedstawia tło ideowe powstania konstytucji Piątej Republiki Francuskiej. Punktem wyjścia jest założenie, że reforma państwa dokonana w 1958 r. miała swoje źródło w kryzysie wewnętrznym, jak i w otoczeniu międzynarodowym Francji. Kryzys wewnętrzny był związany z niestabilnością polityczną, a przede wszystkim zbyt silną pozycją parlamentu oraz chaotycznym systemem partyjnym. Otoczenie zewnętrzne z kolei to upadek międzynarodowej roli Francji oraz problemy dekolonizacji, szczególnie w Algierii. Artykuł przedstawia myśl polityczną osób tradycyjnie postrzeganych jako „ojcowie” konstytucji z 1958 orku. Zalicza się do nich André Tardieu, Raymon-da Carré de Malberga, Rene Capitanta, Michela Debré i Charlesa de Gaulle’a. Artykuł udowadnia, że nie mieli oni identycznych pomysłów, że czasami ich poglądy ewoluowały. Ostatecznie jednak złożyły się na spójną myśl polityczną, która zapoczątkowała gaullizm, a w sensie ustrojowym położyła fundament pod konstytucję Piątej Republiki. Kluczowe dla tej myśli politycznej są: osadzenie systemu politycznego w tle wartości, pośród których znaczenie zasadnicze ma idea silnego państwa; uznanie konieczności zrównoważenia władz; wyeksponowanie roli prezydenta postrzeganego, niczym wojskowy, jako szef państwa.
The article presents the background of the ideological formation of the Constitution of the French Fifth Republic. The starting point is the assumption that the state reform made in 1958 had its origin in the crisis internally and in the international environment of France. The internal crisis was associated with political instability, and above all very strong position of Parliament and the chaotic party system. The external environment, in turn, is the collapse of the international role of France and the problems of decolonization, particularly in Algeria. The article presents the political thought of traditionally perceived as the creators of the Constitution 1958. These include André Tardieu, Raymond Carré de Malberg, Rene Capitanta, Michel Debré and Charles de Gaulle. Article proves that they did not have identical ideas that sometimes their views have evolved. Ultimately, however, they contributed to a coherent political thought, which began gaullism, and in the sense of the political system laid the foundation for the constitution of the Fifth Republic. Keywords for this political thought are the rear of the political system in the background values, among which is crucial idea of a strong state; recognition of the necessity to balance the authorities; visibility of the role of the president is perceived, like the military, as chef of state.

Even if the Declaration is not a binding document, in the author’s opinion, it cannot be ignored. It expressly outlines a scenario for federalization of the European Union. The future directions of European integration cannot be shaped by a few presidents of the parliaments of EU Member States. Doubts are also raised the need for a more extensive integration. The Declaration should not be in favour of creating a new political structure of the European Union, but rather promote a departure from localism and particularism that act today as a real obstacle to the success of the Union. The document can be interpreted as an incentive to create a more integrated structure based on the states of “old Europe” while leaving another, more “loose”, form for all other States, which would be unfavourable from the point of view of Polish interests. The author recommends three variants to be applied by the Sejm in response to the Declaration: the rejection, renegotiation (which is very unlikely), or make efforts to sign a new and different declaration.

Konstytucyjne przepisy wyznaniowe, które należy postrzegać jako swoisty podzbiór w obrębie szeroko ujmowanych praw i wolności człowieka, stanowią grupę tych przepisów które albo explicite, albo implicite regulują sytuację konfesyjną jednostki. Przepisy, które wprost określają położenie jednostki z uwagi na jej wyznanie i prezentowany światopogląd można przy tym określić mianem przepisów sensu stricto wyznaniowych. Obejmują one, z jednej strony, indywidualną wolność sumienia i wyznania, z drugiej zaś wolność kolektywną, odnoszoną do społeczności religijnych jakimi są kościoły i inne związki wyznaniowe. Ta wąska grupa przepisów wyznaniowych nie jest jednak jednolita. W jej ramach można bowiem odnaleźć przepisy generalnie odnoszące się do wolności sumienia i wyznania (art. 25, 53 Konstytucji) i przepisy, które podejmują kwestie szczegółowe (art. 48, art. 35 ust. 2 i art. 85). Obok grupy przepisów wyznaniowych sensu stricto można również wskazać inne przepisy, które pośrednio można skorelować z konfesyjną dziedziną życia jednostki. Tę grupę przepisów można nazwać przepisami sensu largo wyznaniowymi. Pośród nich najważniejszym jest przepis gwarantujący generalne prawo decydowania o swoim życiu osobistym (art. 47 Konstytucji). Pokazuje on wszak iunctim wolności sumienia i wyznania z prawem do prywatności, które jest dzisiaj najważniejszym prawem jednostki poręczonym jej w ustawie zasadniczej, a zarazem pewnego rodzaju „wstępem” i „początkiem” wszystkich, a przynajmniej większości praw i wolności. Wolność sumienia i wyznania, jak i cała dziedzina konfesyjna jest przecież nierozerwalnie związana z ochroną życia prywatnego (osobistego), względem którego państwo i jego organy muszą zachować postawę désintéressement. Temu też służą coraz bardziej rozbudowane i uszczegółowione unormowania wyznaniowe konstytucji, które niezależnie od wszelkich podziałów i klasyfikacji zawsze stanowią jedynie pochodną praw i wolności jednostki. Konstytucyjna materia konfesyjna i konstytuujący ją przepis wyznaniowy jest wszak zawsze formą poręczenia niezbywalnych praw jednostki, które swoje aksjologiczne (ale i prawne) źródło znajdują w konstytucyjnej zasadzie godności. Ta ostatnia jest przykładem swoistego „spotkania się” normy na swój sposób religijnej (czy kanonicznej) i normy prawa państwowego. W obu systemach norm godność człowieka jest wszak wartością najwyższą i niezbywalną, i w obu stanowi rację innych wartości i praw.
The constitutional provisions on denomination, which should be seen as a specific subset within the widely recognized human rights and freedoms, comprise a collection of provisions that either explicitly or implicitly regulate the matters of the religious persuasion of any individual. The provisions that explicitly relate to the position of the individual because of his or her religion and outlook can be referred to as denominational in the strict sense. These include, on the one hand, individual freedom of conscience and religion, and on the other hand, collective freedom related to the religious communities such as churches and other religious organizations. This narrow set of denominational provisions is not uniform. It covers both the general rules regarding freedom of conscience and religion (Articles 25 and 53 of the Constitution) and provisions tackling more specific issues (Article 48, Article 35(2) and Article 85). Besides denominational provisions sensu stricto, also others can be singled out that may be directly tied to the religious aspect the individual's life. This set can be referred to as denominational provisions sensu largo. Among them, the most important provision is the one ensuring the general right to decide about one's personal life (Article 47 of the Constitution). It shows the iunctim, after all, of freedom of conscience and religion with the right to privacy, which today is the most important individual right guaranteed in the Constitution, and also a kind of 'prelude' to and 'beginning' of all, or at least most of the rights and liberties. Freedom of conscience and religion, and the whole denominational area alike, is after all inextricably linked to the protection of private (personal) life, which the state and its bodies must approach with désintéressement. The increasingly complex and detailed denominational regulations contained in the Constitution seem to accommodate this requirement; irrespective of any divisions and classifications, they are but a derivative of individual rights and freedoms. The constitutional denominational substance together with its constituting denominational provision is after all a form of guarantee of inalienable individual's rights that have their axiological (but also legal) source in the constitutional principle of dignity. The latter is an example of the 'encounter' of the, in a way, religious (or canonical) standard and the standard of state law. In both systems of standards, human dignity is indeed the highest and inalienable value, and in both provides the reason for other rights and values.

Abstract: The role of political parties in redefinition of the ratio of representative The main theme of this article is the role of political parties in the system of representation of interests that are expressed at the national forum of political representation, which is the parliament. The said system originated without political parties, which were to emerge and show their political weightiness later on, to nowadays become an indispensable element of the political process. The latter involves both election and ruling, but also voicing of the interests, opinions, demands, and expectations of the electorate. Parties, mostly viewed critically today, at the dawn of the representative system were perceived radically different, that is, as a remedy to the aches of the said system, capable of eradicating the corruption. They were also compounded with the free (representative) mandate, which was to be another antidote to corruption as well as other pathological phenomena. It was believed that the formula where a deputy represents the general interests of the electorate is the most consistent with the form of political party. Therefore parties were designed as clearly additional and auxiliary element. Slowly but surely, however, they gained autonomy, attaining their separate and independent significance to the degree where they, as it is claimed contemporarily, reshaped the formula of the mandate, turning it form individual to collective, with political parties themselves as its owners that have become the primary subjects and agents; first of all, of the political competition, then, of the parliamentary political games. All in all, political parties seen through a prism of representation, are a kind of pendentive thereof. The paper attempts to address the question of whether the prime ministerial system has already emerged as a separate system of governance that differs from classical systems, and whether it can no longer be treated as a certain sub-class in an extensive range of parliamentary systems, but rather as a new type of system in its own right. The principal issue appears to be whether the inherent properties of the prime ministerial variety of governance are sufficiently distinct, significant and different from the parliamentary system, however broadly understood, to give the former a status of a separate governance system from the methodological point of view. It should be observed that the contemporary British system, which serves as a foundation for our deliberations on the prime ministerial form of governance, has deviated from the classical or typical parliamentary system far enough to actually take the direction of a separate system of governance, namely prime ministerial governance. Firstly, this is evidenced by the removal of the monarch from the political system and establishing executive power as a virtually one-element entity concentrated in the Cabinet, and embodied by its leader. Secondly, the figure of Prime Minister is highly emphasized as he is elected ‘under the guise of common elections’ and he successfully monopolizes the work of his entire Cabinet, becoming a certain ‘trademark’ of this Cabinet, which is well supported by the principle of joint accountability of all Cabinet members, a principle that is exceptionally strictly and consistently implemented in the British system. The ongoing politological processes that tend to presidentialize and personalize politics are only accelerating these changes and making them even more apparent. The consequence in Britain is that it is the Prime Minister who accrues the power to govern and he by no means falls under the principle of classical parliamentary systems, where the government leader is only “the first among equals”. Thirdly, the House of Commons has practically lost its controlling power over the Cabinet, as primarily evidenced in the absence of a vote of no confidence, which would serve as a tool of political accountability of executive power before the legislative, the essence of any form of parliamentary governance. Fourthly, in a highly specific, deeply endemic party system which entails that various links between government and parliament typical of the parliamentary style of democracy are de facto transferred onto the internal party stage, this to an extent also explains the relevance of the division between government and opposition, a division which is neither as clear, nor as far-reaching as in the case of other parliamentary systems. All this allows us to conclude that the British system is sufficiently different to be deemed new in comparison to a typical or classical parliamentary system. The transformations that have taken place there have gone far beyond the proper, or classical, model of parliamentary governance thus forming not only a sub-class, but a separate type (or model) of governance.

The article presents the main principles of the French doctrine of the political representation. This doctrine refers to the concept of transference. According to her one entity transfers its rights and obligations to another entity. Transmission entity is represented (voter), while the entity for which the transfer is made is representative (member of parliament). Representation means so that the member of parliament speaks on behalf of the nation. The focal point of this concept is the belief of the fictional nation as a sovereign. As a result, the traditional doctrine of the French was of the view that the nation as something fictional can exist only in the parliament and can be expressed only by the parliamentarian. This position concluding cry that no nation outside of the representatives of the nation. The second element of the French approach was the assumption of a community dimension representation. Evidence of this was the representative mandate to exclude instructions, orders and command will vote. These two assumptions to this day is the essence of the French project of political representation.

The analysis focuses on the relations between the presidential and semi-presidential system of government and the model of control of legal norms. The authors formulate question, is there a correlation between these government systems and the model of constitutional review of the law? The authors argue that there is no such dependence. They justify that the system of government is created independently of the model of law constitutional re- view. They justify why it is and what are the consequences for the system of government.
W artykule poddano analizie sposób ukształtowania kontroli konstytucyjności prawa w prezydenckim i pół-prezydenckim systemach rządów. Bada się w nim zależność między tymi systemami rządów a realizowanym w nich modelem kontroli konstytucyjności prawa. Dowodzi się, że są to komponenty ustroju państwa tworzone niezależnie od siebie, nieoddziałujące na siebie aksjologicznie, instytucjonalnie czy behawioralnie. Stwierdza się, że w prezydenckim i pół-prezydenckim systemie rządów nie ustanowiono wyjątkowego, właściwego dla nich, modelu kontroli konstytucyjności prawa.

The author points out that the Council Decision 2020/2053 requires ratification in accordance with the law of Member States. In the case of Poland it should be the procedure specified in Article 89 para. 1 of the Constitution, therefore requiring a prior consent granted in a statute. This mode has to be chosen to avoid imposing a significant financial burden on the state and because of earlier practice regarding the ratification of such decisions. The author excludes the possibility of the so called great ratification (Article 90 of the Constitution, majority of 2/3 votes in the Sejm), because the decision does not grant any new powers to the Union.

Opracowanie charakteryzuje orzecznictwo Trybunału Konstytucyjnego dotyczące problematyki obecności nauki religii w szkołach publicznych w Polsce. Zagadnienie obecności religii w szkole publicznej jest dzisiaj jednym z głównych problemów w stosunkach państwa z kościołami i innymi związkami wyznaniowymi. Większość z tych problemów jest rozstrzygana przez Trybunał Konstytucyjny, który jednak zdaniem autora często formułuje tezy wątpliwe, niedostatecznie uzasadnione, czasami kontrowersyjne. Na poparcie tego twierdzenia autor przedstawia orzeczenie z 2 grudnia 2009 r. (w sprawie o sygnaturze akt U 10/07), w którym Trybunał zajął się kwestią zbadania konstytucyjności wliczania oceny z religii do średniej ocen ucznia. W ocenie autora, Trybunał uznając konstytucyjność wliczania tej oceny do średniej, przyjął błędną identyfikację rozstrzyganego problemu
The paper looks into the case-law of the Constitutional Tribunal concerning the teaching of religion in Polish state schools. The teaching of religion in a state school has long been attracting attention as a major issue in the relations between the state, churches and other religious organizations. Most of these are resolved by the Constitutional Tribunal, which, however, in the author's view, often advances theses that are debatable, inadequately justified and at times controversial. To support his assertion, the author highlights a decision of 2 December 2009 (file ref. U 10/07) in which the tribunal examined the constitutionality of including the grade in religion in the calculation of the overall pupil's performance. In the author's opinion, in acknowledging the constitutionality of such action, the tribunal assumed a misguided identification of the examined problem.
